		<official-title>To provide for a time-out on certain regulations, and for
		  other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Regulatory Time-Out Act of
			 2011</short-title></quote>.</text>
		</section><section id="id12066A0B8C0942F1B8FFD7C7F65C5E5A"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act—</text>
			<paragraph id="idF7E22D65162E4AF1804CCE6647D9FA70"><enum>(1)</enum><text>the term
			 <term>agency</term> has the meaning given that term under section 3502(1) of
			 title 44, United States Code; and</text>
			</paragraph><paragraph id="id7A0B023E84F5471DB403C6C2A690EBDF"><enum>(2)</enum><text>the term
			 <term>covered regulation</term> means a final regulation that—</text>
				<subparagraph id="idE41ECEB0B41449049F9C3588362C149A"><enum>(A)</enum><text>directly or
			 indirectly increases costs on businesses in a manner which will have an adverse
			 effect on job creation, job retention, productivity, competitiveness, or the
			 efficient functioning of the economy;</text>
				</subparagraph><subparagraph id="id75F6643CC4FB4D44AFA74E716B792411"><enum>(B)</enum><text>is likely
			 to—</text>
					<clause id="ID06051fc840a44c9f8ca23be9d599b347"><enum>(i)</enum><text>have an annual
			 effect on the economy of $100,000,000 or more;</text>
					</clause><clause id="idE2381896F74F41C29FC9D76342387A3E"><enum>(ii)</enum><text>adversely affect
			 in a material way the economy, a sector of the economy, productivity,
			 competition, jobs, the environment, public health or safety, or State, local,
			 or tribal governments or communities;</text>
					</clause><clause id="ID6e214ff23946476db4d3be9708be750a"><enum>(iii)</enum><text>create a
			 serious inconsistency or otherwise interfere with an action taken or planned by
			 another agency;</text>
					</clause><clause id="ID257930d56e814a748aa0bf1df90614e3"><enum>(iv)</enum><text>materially alter
			 the budgetary impact of entitlements, grants, user fees, or loan programs or
			 the rights and obligations of recipients thereof; or</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="IDd50fc7449ce3495bbd51406ab552032d"><enum>(v)</enum><text>raise novel legal
			 or policy issues; and</text>
					</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2E846FBAF6A147F28A826BBDCBBE7E5B"><enum>(C)</enum><text>did not take
			 effect before September 1, 2011.</text>
				</subparagraph></paragraph></section><section id="id61575B25547D4FA89E96AB57695A01EF"><enum>3.</enum><header>Time-out period
			 for regulations</header>
			<subsection id="idAAE2E259B49E4347AF811CBDDA86E247"><enum>(a)</enum><header>Prior
			 regulations</header><text display-inline="yes-display-inline">A covered
			 regulation that took effect before the date of enactment of this Act shall be
			 treated as though that regulation never took effect for the 1-year period
			 beginning on the date of enactment of this Act.</text>
			</subsection><subsection id="idE0747D5BBB7F4602A5BFC9E584625F79"><enum>(b)</enum><header>Prospective
			 regulations</header><text display-inline="yes-display-inline">A covered
			 regulation that has not taken effect before the date of enactment of this Act,
			 may not take effect during the 1-year period beginning on the date of enactment
			 of this Act.</text>
			</subsection></section><section id="id42C6A8F85CE0408BA78429245F1C5BA0"><enum>4.</enum><header>Exemptions</header>
			<subsection id="idA3B78F6BB43A410FA9C67F1659061D0C"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The head of an agency
			 may exempt a covered regulation prescribed by that agency from the application
			 of section 3, if the head of the agency—</text>
				<paragraph id="id6F6149E794CC4B22850058C748158978"><enum>(1)</enum><text display-inline="yes-display-inline">makes a specific finding that the covered
			 regulation—</text>
					<subparagraph id="idE3D462196809463BA3E86BCB5E9E2127"><enum>(A)</enum><text display-inline="yes-display-inline">is necessary due to an imminent threat to
			 human health or safety, or any other emergency;</text>
					</subparagraph><subparagraph id="idDE9BA626C8A74642B9E9CACBBAD7F8EC"><enum>(B)</enum><text display-inline="yes-display-inline">is necessary for the enforcement of a
			 criminal law;</text>
					</subparagraph><subparagraph id="idECB891CAEE0348E8B938B89663694B92"><enum>(C)</enum><text>has as its
			 principal effect—</text>
						<clause id="id16A1121D53C5484392E91269CAD84C55"><enum>(i)</enum><text>fostering private
			 sector job creation and the enhancement of the competitiveness of workers in
			 the United States;</text>
						</clause><clause id="idACC8E6DA80F8451F8C1FFE7D673C2708"><enum>(ii)</enum><text>encouraging
			 economic growth; or</text>
						</clause><clause id="idC492E3DBED774454B54624A72D0A3FCA"><enum>(iii)</enum><text>repealing,
			 narrowing, or streamlining a rule, regulation, or administrative process, or
			 otherwise reducing regulatory burdens;</text>
						</clause></subparagraph><subparagraph id="idDC068DBF86704EC48C0772763281FF28"><enum>(D)</enum><text>pertains to a
			 military or foreign affairs function of the United States; or</text>
					</subparagraph><subparagraph id="idFBA6CB04E4FD4DB3B23EEFE8C51ADFD2"><enum>(E)</enum><text>is limited to
			 interpreting, implementing, or administering the Internal Revenue Code of 1986;
			 and</text>
					</subparagraph></paragraph><paragraph id="idACDC3758344747C591FFD86B3FBAE4B2"><enum>(2)</enum><text>submits the
			 finding to Congress and publishes the finding in the Federal Register.</text>
				</paragraph></subsection><subsection id="idF9DD360D96B0491CAE243350ABF941E6"><enum>(b)</enum><header>Review</header><text>Not
			 later than 10 days after the date of enactment of this Act each agency shall
			 submit any covered regulation that the head of the agency determines is exempt
			 under this section to the Office of Management and Budget and Congress.</text>
			</subsection><subsection id="id6DE235FD9D2A4F22B08732C00DB0E5F0"><enum>(c)</enum><header>Nondelegable
			 authority</header><text>The head of an agency may not delegate the authority
			 provided under this section to exempt the application of any provision of this
			 Act.</text>
