		<official-title>To amend the Clean Air Act to limit Federal regulation of
		  nuisance dust in areas in which that dust is regulated under State, tribal, or
		  local law, to establish a temporary prohibition against revising any national
		  ambient air quality standard applicable to coarse particulate matter, and for
		  other purposes.</official-title>

		<section id="HB77AD0ED9EA7497DAFE19736B811218A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Farm Dust Regulation Prevention Act of
			 2011</short-title></quote>.</text>
		</section><section id="HB02B3E2AB0564F90B4AF060651D7AA63"><enum>2.</enum><header>Nuisance
			 dust</header><text display-inline="no-display-inline">Part A of title I of the
			 Clean Air Act (42 U.S.C. 7401 et seq.) is amended by adding at the end the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="H3876EBF104E440AE89D71355E8A895E3" style="OLC">
				<section id="H348F04F3376549CB86C8D99390D808B3"><enum>132.</enum><header>Regulation of
				nuisance dust primarily by State, tribal, and local governments</header>
					<subsection id="HF2E1EEFDC8E44E45AABC30CF31F06652"><enum>(a)</enum><header>Definition of
				nuisance dust</header><text display-inline="yes-display-inline">In this
				section, the term <term>nuisance dust</term> means particulate matter—</text>
						<paragraph id="H594ABD05EB4348FFB7E441248CCEBEBD"><enum>(1)</enum><text>generated from
				natural sources, unpaved roads, agricultural activities, earth moving, or other
				activities typically conducted in rural areas; or</text>
						</paragraph><paragraph id="HFB91EDD6A5A2484BB7F91CA64BA553DD"><enum>(2)</enum><text display-inline="yes-display-inline">consisting primarily of soil, windblown
				dust, or other natural or biological materials, or some combination of those
				materials.</text>
						</paragraph></subsection><subsection id="HDDDA2B3AB28F4B3696EB189AA367891A"><enum>(b)</enum><header>Applicability</header><text display-inline="yes-display-inline">Except as provided in subsection (c), this
				Act does not apply to, and references in this Act to particulate matter are
				deemed to exclude, nuisance dust.</text>
					</subsection><subsection id="H2F77230379174A1DAD683E026CE05938"><enum>(c)</enum><header>Exception</header><text display-inline="yes-display-inline">Subsection (b) does not apply with respect
				to any geographical area in which nuisance dust is not regulated under State,
				tribal, or local law to the extent that the Administrator finds that—</text>
						<paragraph id="HCD9FA1CDD933442B8B169188DE9BD977"><enum>(1)</enum><text display-inline="yes-display-inline">nuisance dust (or any subcategory of
				nuisance dust) causes substantial adverse public health and welfare effects at
				ambient concentrations; and</text>
						</paragraph><paragraph id="H011A8694D4764D4C89FC2085646DC9CA"><enum>(2)</enum><text display-inline="yes-display-inline">the benefits of applying standards and
				other requirements of this Act to nuisance dust (or such a subcategory of
				nuisance dust) outweigh the costs (including local and regional economic and
				employment impacts) of applying those standards and other requirements to
				nuisance dust (or such a
				subcategory).</text>
						</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section display-inline="no-display-inline" id="H77E2FD06421F402187777F1E792F903E" section-type="subsequent-section"><enum>3.</enum><header>Temporary prohibition
			 against revising any national ambient air quality standard applicable to coarse
			 particulate matter</header><text display-inline="no-display-inline">Before the
			 date that is 1 year after the date of the enactment of this Act, the
			 Administrator of the Environmental Protection Agency may not propose, finalize,
			 implement, or enforce any regulation revising the national primary ambient air
			 quality standard or the national secondary ambient air quality standard
			 applicable to particulate matter with an aerodynamic diameter greater than 2.5
			 micrometers under section 109 of the Clean Air Act (42 U.S.C. 7409).</text>
