		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Clean Rivers Act of
			 2011</short-title></quote>.</text>
		</section><section id="id392B9A8CDBD8434AB3A035B7819B8CF4"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="id0B08FE632A934C81A75B5081F848374E"><enum>(1)</enum><header>Appropriate
			 congressional committees</header><text>The term <term>appropriate congressional
			 committees</term> means—</text>
				<subparagraph id="idB967DA9BC3D04CBCB1FC703148CE1DF5"><enum>(A)</enum><text>the Committee on
			 Commerce, Science, and Transportation and the Committee on Appropriations of
			 the Senate; and</text>
				</subparagraph><subparagraph id="id401AD98621E04F8EA64314CD93787FB3"><enum>(B)</enum><text>the Committee on
			 Transportation and Infrastructure, the Committee on Energy and Commerce, and
			 the Committee on Appropriations of the House of Representatives.</text>
				</subparagraph></paragraph><paragraph id="id7788F1FCCF014EC1B13D61DA08000122"><enum>(2)</enum><header>Gathering
			 lines</header><text>The term <term>gathering lines</term> has the meaning given
			 the term pursuant to section 60101(b) of title 49, United States Code.</text>
			</paragraph><paragraph id="id7BF7FBE8A9FE4B8DA97FD6657E2A6FB4"><enum>(3)</enum><header>Hazardous
			 liquid pipeline facility</header><text>The term <term>hazardous liquid pipeline
			 facility</term> has the meaning given the term in section 60101(a) of title 49,
			 United States Code.</text>
			</paragraph><paragraph id="ID569E39A7AE294A8BB8194A9568303F9E"><enum>(4)</enum><header>Indian
			 tribe</header><text>The term <term>Indian tribe</term> has the meaning given
			 the term in section 4 of the <act-name parsable-cite="ISDA">Indian
			 Self-Determination and Education Assistance Act</act-name> (25 U.S.C.
			 450b).</text>
			</paragraph></section><section id="id7A97FF9223C146909C699B913EC620DD"><enum>3.</enum><header>Review of
			 pipeline river crossings</header>
			<subsection id="id63A4697CE0E94EBBA3302732ED0D79C6"><enum>(a)</enum><header>Review
			 required</header>
				<paragraph id="id3086A487758B4889B7167EF6DDD17699"><enum>(1)</enum><header>In
			 general</header><text>Not later than 180 days after the date of the enactment
			 of this Act, the Administrator of the Pipeline and Hazardous Materials Safety
			 Administration shall complete a review of the adequacy of the Administration’s
			 regulations with respect to pipelines regulated by the Administration that
			 cross inland bodies of water with a width of at least 100 feet from high water
			 mark to high water mark.</text>
				</paragraph><paragraph id="id9BCAFAADC4E04830855FB35BF37254EF"><enum>(2)</enum><header>Scope</header><text>The
			 review required under paragraph (1) shall include data about the
			 geo­mor­phol­o­gy of individual rivers, including flood hydraulics, riverbed
			 mobility, and channel migration, with respect to—</text>
					<subparagraph id="ID3e95800ba6724570b840a44a014b91ba"><enum>(A)</enum><text>existing depth of
			 cover requirements;</text>
					</subparagraph><subparagraph id="ID97304a42872842a791394fe0859b55aa"><enum>(B)</enum><text>existing
			 requirements for pipeline operators to inspect the conditions of river
			 crossings during extraordinary events irrespective of periodic inspection
			 requirements;</text>
					</subparagraph><subparagraph id="ID20e8adeef7514ec985dc1b514ace391f"><enum>(C)</enum><text>existing
			 requirements for Integrity Management Plans to include evaluations of the
			 probability and consequences of flooding at river crossings;</text>
					</subparagraph><subparagraph id="id301FC800485B4FE0B13601ED954BB18B"><enum>(D)</enum><text>existing
			 requirements for installing crossings with respect to horizontal directional
			 drilling; and</text>
					</subparagraph><subparagraph id="ID7e6dd8396f724527b35b8baa017a698d"><enum>(E)</enum><text>issuance by the
			 Administration of emergency orders to address unsafe conditions or practices
			 posing an imminent hazard.</text>
					</subparagraph></paragraph><paragraph id="idC0BD61448F4D4346B0CFE14265934ACA"><enum>(3)</enum><header>Consultation</header><text>In
			 conducting the review required under paragraph (1), the Administrator shall
			 consult with—</text>
					<subparagraph id="ID757d06e8a48c435283abff4a7d82d7a5"><enum>(A)</enum><text>Federal entities
			 with relevant data and expertise, including the United States Geological
			 Service, the Army Corps of Engineers, the National Transportation Safety Board,
			 the Bureau of Reclamation, and the Environmental Protection Agency; and</text>
					</subparagraph><subparagraph id="IDb0d6c0fcc218471a8e21e3f61b34b1d2"><enum>(B)</enum><text>regional, state,
			 Tribal, and local entities with relevant data and expertise, including State
			 and regional conservation district councils.</text>
					</subparagraph></paragraph></subsection><subsection id="id51C2C987CF0D4F52B2C98EE6E4758E22"><enum>(b)</enum><header>Report
			 required</header><text>Not later than 30 days after completing the review
			 required under subsection (a), the Administrator shall submit to the
			 appropriate congressional committees a report on the findings of the review,
			 including any recommendations for changes in laws or regulations.</text>
			</subsection><subsection id="idE95F0C460BB24A1082E3176B031F2C76"><enum>(c)</enum><header>Regulations</header><text>Not
			 later than one year after submittal of the report required under subsection
			 (b), the Administrator shall prescribe regulations to incorporate the findings
			 of the review conducted under subsection (a) and the recommendations included
			 in the report submitted under subsection (b).</text>
			</subsection></section><section id="id10F64AF676B34A2D9AAB827D8C638180"><enum>4.</enum><header>Increased
			 transparency</header>
			<subsection id="idA607BB34B9A349DF8BEBC1D654788A28"><enum>(a)</enum><header>River crossings
			 database</header><text>Not later than 180 days after the date of the enactment
			 of this Act, the Administrator of the Pipeline and Hazardous Materials Safety
			 Administration shall establish and maintain on a publicly available Internet
			 Web site of the Administration a database of all pipeline water crossings in
			 the United States, searchable nationally, by State, and by pipeline, including,
			 with respect to each crossing—</text>
				<paragraph id="ID5afc9bc5d5a0478195dcb4555efd3db7"><enum>(1)</enum><text>the pipeline
			 operator;</text>
				</paragraph><paragraph id="ID071cfab0750a4708af469157ef299eb0"><enum>(2)</enum><text>the
			 classification of crossing design;</text>
				</paragraph><paragraph id="IDa4eb24fea11d4cf0b831d3d21b5fea4a"><enum>(3)</enum><text>the estimated
			 depth of cover;</text>
				</paragraph><paragraph id="ID47f523cdfa8d45448c38f1497e173f53"><enum>(4)</enum><text>the date of
			 pipeline installation;</text>
				</paragraph><paragraph id="ID2395f4dc17704b9dbfe2c087eceff9cc"><enum>(5)</enum><text>the dates of
			 in-line inspections;</text>
				</paragraph><paragraph id="ID9fafb80fc79147bc9ff757d604d5fec6"><enum>(6)</enum><text>a summary of past
			 actionable anomalies resulting from in-line inspections; and</text>
				</paragraph><paragraph id="IDd6eedf5fa60d493d866a250539298789"><enum>(7)</enum><text>the operational
			 status of the pipeline during flows higher than 10-percent probability of
			 exceedance.</text>
				</paragraph></subsection><subsection id="idBC8F7906EB8343468C6277CCB8012E72"><enum>(b)</enum><header>National
			 statistics</header><text>Not later than 180 days after the date of the
			 enactment of this Act, the Administrator of the Pipeline and Hazardous
			 Materials Safety Administration shall establish and maintain on a publicly
			 available Internet Web site of the Administration a listing of national and
			 state statistics on pipeline safety, including—</text>
				<paragraph id="ID377815b0a2fb4c68947249d3575b6541"><enum>(1)</enum><text>the percentage of
			 pipeline crossings inspected by in-line inspection within the last 6 months,
			 year, five years, and greater than five years;</text>
				</paragraph><paragraph id="ID1d323d3b22ab4a469925d0eb139a5d36"><enum>(2)</enum><text>the percentage of
			 pipeline miles inspected by in-line inspection within the last 6 months, year,
			 five years, and greater than five years;</text>
				</paragraph><paragraph id="ID9d1d6498df4641ae983ccb54e834f1a7"><enum>(3)</enum><text>the percentage of
			 pipeline crossings designated High Consequences Areas;</text>
				</paragraph><paragraph id="ID98d6377bb7674f67b943360a517bd53e"><enum>(4)</enum><text>the percentage of
			 pipeline miles designated High Consequence Areas;</text>
				</paragraph><paragraph id="IDfc89657debb040648e0ee81919b4c029"><enum>(5)</enum><text>the percentage of
			 total pipelines in compliance as of the last date of in-line inspection;</text>
				</paragraph><paragraph id="ID982abfe992a64b4aa9f2b03ed199f6e4"><enum>(6)</enum><text>the percentage of
			 pipeline miles in compliance as of the last date of in-line inspection;</text>
				</paragraph><paragraph id="IDcf5bc16802a8486b94756b51d4792ca0"><enum>(7)</enum><text>the percentage of
			 pipeline crossings which are bored crossings;</text>
				</paragraph><paragraph id="IDa183b1cbdfab45b0a715787aa83608a8"><enum>(8)</enum><text>the percentage of
			 pipeline crossings which are cut crossings;</text>
				</paragraph><paragraph id="ID0b7c329042f0428e8fea10583b8742e1"><enum>(9)</enum><text>the percentage of
			 pipeline crossings which are aerial crossings; and</text>
				</paragraph><paragraph id="ID8f47b17c1bd142638e814b641b3fdf4e"><enum>(10)</enum><text>any other
			 relevant statistics the agency determines.</text>
				</paragraph></subsection><subsection id="id788BDF1DFA184C9EB56299F94A0EFA0D"><enum>(c)</enum><header>Oil spill
			 response plans</header><text>Not later than one year after the date of the
			 enactment of this Act, the Administrator shall post on a publicly available
			 Internet Web site of the Administration the following information about
			 hazardous liquid pipeline response plans required of each pipeline operator
			 under part 194 of title 49, Code of Federal Regulations:</text>
				<paragraph id="ID9f8e871cd3cc4d59985e969f64ff55e2"><enum>(1)</enum><text>A status
			 indication of the review and approval of each plan.</text>
				</paragraph><paragraph id="IDb06d53e9e5c841118350fb1c871baf65"><enum>(2)</enum><text>A comprehensive
			 description of the requirements for such plans.</text>
				</paragraph><paragraph id="IDee69214e2b8c4d85a44fd8deda5ef91d"><enum>(3)</enum><text>A detailed
			 summary of each approved plan written by the operator that includes the key
			 elements of the plan, but which may exclude—</text>
					<subparagraph id="ID9b17ab0dd2f344a2a49b92cf9fb1b6db"><enum>(A)</enum><text>proprietary
			 information;</text>
					</subparagraph><subparagraph id="ID5a8fc914d074442596c60c934b59ac28"><enum>(B)</enum><text>security-sensitive
			 information, including as referenced in section 1520.5(a) of title 49, Code of
			 Federal Regulations;</text>
					</subparagraph><subparagraph id="ID62873f36e0bf4165b414b453ee62477e"><enum>(C)</enum><text>specific response
			 resources and tactical deployment plans; and</text>
					</subparagraph><subparagraph id="ID3bf58468fcde4211a924682551aa8992"><enum>(D)</enum><text>the specific
			 location of worst-case discharges.</text>
					</subparagraph></paragraph></subsection><subsection id="idFF071E5EDCA24DE387F52EE4C67F24A5"><enum>(d)</enum><header>Consultation on
			 oil spill response plan</header><text>The Administrator shall prescribe
			 regulations requiring pipeline operators—</text>
				<paragraph id="idBE51C9E13A314B02AD88F6495AD3DE7C"><enum>(1)</enum><text>in constructing
			 oil spill response plans, to consult with local first responders and emergency
			 services operators;</text>
				</paragraph><paragraph id="idC0DB458FF0FA480D913826E76CFD5C71"><enum>(2)</enum><text>to file approved
			 oil spill response plans with all local first responders and emergency services
			 operators that are listed in the plan; and</text>
				</paragraph><paragraph id="id01621381C1BB4E758801A63B66011265"><enum>(3)</enum><text>to provide
			 updated oil spill response plans to local first responders and emergency
			 services operators as necessary.</text>
				</paragraph></subsection></section><section id="id2064D5F9B58D484492D7D0515FC48253"><enum>5.</enum><header>Leak detection
			 performance standards</header><text display-inline="no-display-inline">Not
			 later than one year after the date of the enactment of this Act, the
			 Administrator of the Pipeline and Hazardous Materials Safety Administration
			 shall review the need for performance standards for leak detection systems used
			 by operators of hazardous liquid pipeline facilities, including specific
			 standards with respect to—</text>
			<paragraph id="id1BFDDF5A6BEE4F2199D756A7717DD0E4"><enum>(1)</enum><text display-inline="yes-display-inline">determining the size of leak a system is
			 capable of detecting; and</text>
			</paragraph><paragraph id="id6E61AE29343C41B69DCBB0A59C7A70C9"><enum>(2)</enum><text display-inline="yes-display-inline">the time required for the system to issue
			 an alarm in the event that a leak is detected.</text>
			</paragraph></section><section id="idD1BF92406A13418FB6AE8DF5340B5097"><enum>6.</enum><header>Emergency flow
			 restricting devices</header><text display-inline="no-display-inline">Not later
			 than one year after the date of the enactment of this Act, the Administrator of
			 the Pipeline and Hazardous Materials Safety Administration shall review the
			 adequacy of regulations on the circumstances under which an operator of a
			 hazardous liquid pipeline facility must use an emergency flow restricting
			 device.</text>
		</section><section id="id3BF2C9CA9610463F888392D86E63AB15"><enum>7.</enum><header>Onshore
			 gathering lines</header><text display-inline="no-display-inline">Not later than
			 one year after the date of the enactment of this Act, the Administrator of the
			 Pipeline and Hazardous Materials Safety Administration shall submit to the
			 appropriate congressional committees a report summarizing a review of all
			 onshore gas and hazardous liquid gathering lines not regulated by the
			 Administration, including recommendations with respect to—</text>
			<paragraph id="ID8c3bc6f61fd746e387983da4e9c21d00"><enum>(1)</enum><text>the sufficiency
			 of existing laws and regulations to ensure pipeline safety;</text>
			</paragraph><paragraph id="ID91f330c0336d47c7a66a7ad537d6357e"><enum>(2)</enum><text>the economical
			 and technical practicability of applying existing regulations to unregulated
			 onshore gathering lines; and</text>
			</paragraph><paragraph id="ID992f2910737a418ca71167c9e5d8dec4"><enum>(3)</enum><text>the modification
			 or revocation of existing statutory or regulatory exemptions, subject to a
			 risk-based assessment.</text>
			</paragraph></section><section id="id0494C5D181434972BE109BC9270FAF84"><enum>8.</enum><header>Expanded local
			 involvement in National Contingency Plan response management structure</header>
			<subsection id="id7584886AA86349F4BC3CEDF49DF4BDB9"><enum>(a)</enum><header>In
			 general</header><text>The National Contingency Plan for removal of oil and
			 hazardous substances shall be revised to provide for the greater involvement of
			 local authorities in the basic framework for the response management
			 structure.</text>
			</subsection><subsection id="id4725048E2F724043800EE197E0EA3E38"><enum>(b)</enum><header>Rule of
			 construction</header><text>Nothing in this section shall be construed as
			 limiting, reducing, or otherwise modifying the controlling role of the On-Scene
			 Coordinator in the response management structure referred to in subsection
			 (a).</text>
			</subsection></section><section id="id1033D95B8F054B0893E5163732723977"><enum>9.</enum><header>Tribal
			 consultation</header>
			<subsection id="id9EA376B82B994080BCBB95728D8AA294"><enum>(a)</enum><header>In
			 general</header><text>Not later than one year after the date of enactment of
			 this Act, the Administrator of the Pipeline and Hazardous Materials Safety
			 Administration shall establish a protocol for consulting with Indian tribes to
			 provide technical assistance for regulation of pipelines under the jurisdiction
			 of Indian tribes.</text>
			</subsection><subsection id="IDe39150c993734d5590a1314e45f64034"><enum>(b)</enum><header>Requirement for
			 operators</header><text>The operator of a pipeline that is located, wholly or
			 partially, on land under the jurisdiction of an Indian tribe shall file with
			 the Pipeline and Hazardous Materials Safety Administration a copy of any oil
			 spill response plan required under this Act for the pipeline.</text>
			</subsection></section></legis-body>
