		<official-title>To convey certain land to Clark County, Nevada, to
		  designate the Nellis Dunes National Off-Highway Vehicle Recreation Area, and
		  for other purposes. </official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Nellis Dunes National Off-Highway
			 Vehicle Recreation Area Act of 2011</short-title></quote>.</text>
		</section><section id="id4BDADEF3857A444CB1D751AA261F2BA8"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="idA6A5995B20C44512852092DF8EB0B8D7"><enum>(1)</enum><header>City</header><text>The
			 term <term>City</term> means the city of North Las Vegas, Nevada.</text>
			</paragraph><paragraph id="id5AAF9FCD93E74F5299326042548B90B2"><enum>(2)</enum><header>County</header><text>The
			 term <term>County</term> means Clark County, Nevada.</text>
			</paragraph><paragraph id="idB7E1110C7DF84866A2B9D643A814884B"><enum>(3)</enum><header>Economic
			 Support Area</header><text>The term <term>Economic Support Area</term> means
			 the land identified on the map as the <quote>Economic Support
			 Area</quote>.</text>
			</paragraph><paragraph id="id76B3A1E1030B47F3BD0E508F1F71006B"><enum>(4)</enum><header>Federal
			 land</header><text>The term <term>Federal land</term> means the approximately
			 1,211 acres of Federal land in the County, as depicted on the map.</text>
			</paragraph><paragraph id="idA76CDD6C216D439B8158B0B5711F16EF"><enum>(5)</enum><header>Map</header><text>The
			 term <term>map</term> means the map entitled <term>Clark County Off Highway
			 Vehicle Recreation Park</term> and dated July 28, 2011.</text>
			</paragraph><paragraph id="idCC2E46915BA84EBD8AE7DB66B7744F05"><enum>(6)</enum><header>Net
			 proceeds</header><text>The term <term>net proceeds</term> means the amount that
			 is equal to the difference between—</text>
				<subparagraph id="idEA46DDA3070B454AAF93A472CBB5F925"><enum>(A)</enum><text>the amount of
			 gross revenues received by the County from the development of the Economic
			 Support Area; and</text>
				</subparagraph><subparagraph id="id9E2780CCDB1749FFB896568C95496291"><enum>(B)</enum><text>the total amount
			 expended by the County for capital improvements to each of the Economic Support
			 Area and the Recreation Area.</text>
				</subparagraph></paragraph><paragraph id="id98B0AED189D043ABA168C6236755A186"><enum>(7)</enum><header>Recreation
			 area</header><text>The term <term>Recreation Area</term> means the Nellis Dunes
			 National Off-Highway Vehicle Recreation Area designated by section 4(a).</text>
			</paragraph><paragraph id="id638875CDD6784BA1AABC3D6F621444E8"><enum>(8)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text>
			</paragraph><paragraph id="id3336F241FD564E3F923ACA42A54ED2F0"><enum>(9)</enum><header>State</header><text>The
			 term <term>State</term> means the State of Nevada.</text>
			</paragraph></section><section id="id902368E8178F40B79442F2A7B6B276EC"><enum>3.</enum><header>Conveyance of
			 Federal land to Clark County, Nevada</header>
			<subsection id="id27AD9606743043D695D9AB9AE8ABAE54"><enum>(a)</enum><header>Conveyance</header><text>As
			 soon as practicable after the date of enactment of this Act, the Secretary
			 shall convey to the County, subject to valid existing rights, for no
			 consideration, all right, title, and interest of the United States in and to
			 the parcels of Federal land.</text>
			</subsection><subsection id="IDead788c90e184212891e27d1e4d6a14c"><enum>(b)</enum><header>Use of Federal
			 land</header>
				<paragraph id="ID836b370d6fb44cb4931980ed18c70a66"><enum>(1)</enum><header>In
			 general</header><text>The parcels of Federal land conveyed under subsection
			 (a)—</text>
					<subparagraph id="ID241d01ced5d44320b48ceffa2f7f109b"><enum>(A)</enum><text>shall be used by
			 the County—</text>
						<clause id="ID70e6757714974245a6571fc4e6b2720a"><enum>(i)</enum><text>to
			 provide a suitable location for the establishment of a centralized off-road
			 vehicle recreation park in the County;</text>
						</clause><clause id="ID1fc39fd70b5b4b45a47a8dae306a9c1d"><enum>(ii)</enum><text>to
			 provide the public with opportunities for off-road vehicle recreation,
			 including a location for races, competitive events, training and other
			 commercial services that directly support a centralized off-road vehicle
			 recreation area and County park; and</text>
						</clause><clause id="ID8cb806b0724e4d0a9505f4647a97a92e"><enum>(iii)</enum><text>to provide a
			 designated area and facilities that would discourage unauthorized use of
			 off-highway vehicles in areas that have been identified by the Federal
			 Government, State government, or County government as containing
			 environmentally sensitive land; and</text>
						</clause></subparagraph><subparagraph id="ID622c25ef1934495fbc0bfbb6f1257c5f"><enum>(B)</enum><text>shall not be
			 disposed of by the County.</text>
					</subparagraph></paragraph><paragraph id="ID7bc698615ff4416886cbc50199eeb24d"><enum>(2)</enum><header>Reversion</header><text>If
			 the County ceases to use any parcel of the Federal land for the purposes
			 described in paragraph (1)(A) or paragraph (3)—</text>
					<subparagraph id="ID538b731f6c2247e7ad14c68472bc251e"><enum>(A)</enum><text>title to the
			 parcel shall revert to the United States, at the option of the United States;
			 and</text>
					</subparagraph><subparagraph id="ID85f9edc7a9704401abab10e61e8ec726"><enum>(B)</enum><text>the County shall
			 be responsible for any reclamation necessary to revert the parcel to the United
			 States.</text>
					</subparagraph></paragraph><paragraph id="ID5325d65588f2485491937b79983ccca8"><enum>(3)</enum><header>Renewable and
			 solar energy</header><text>The Federal land conveyed to the County under
			 subsection (a) and the land conveyed to the County under section 1(c) of Public
			 Law 107–350 (116 Stat. 2975) may be used for the incidental purpose of
			 generating renewable energy and solar energy for use by the Clark County Off
			 Highway Vehicle Recreation Park, the shooting park authorized under Public Law
			 107–350 (116 Stat. 2975), and the County.</text>
				</paragraph><paragraph id="ID6fda09094c674f09969266e881cde5b5"><enum>(4)</enum><header>Consultation
			 with the Secretary of the Air Force</header>
					<subparagraph id="id63DA1E1010F647CEA82561120316CA5E"><enum>(A)</enum><header>Restriction</header><text>Any
			 project authorized under paragraph (3) shall not interfere with the national
			 security mission of Nellis Air Force Base (or any military operation).</text>
					</subparagraph><subparagraph id="id4D7056E8146F4670AC839CB8139E5EAB"><enum>(B)</enum><header>Condition</header><text>Before
			 the construction of any proposed project under paragraph (3), the project
			 proponent shall consult with the Secretary of Defense (or a designee).</text>
					</subparagraph></paragraph></subsection><subsection id="ID0fe92327719344028f870aaf0bc91e1e"><enum>(c)</enum><header>Economic
			 Support Area</header>
				<paragraph id="ID46f25663fbf54633b924a416ea4a5d81"><enum>(1)</enum><header>Designation</header><text>There
			 is designated the Economic Support Area.</text>
				</paragraph><paragraph id="idD5EB07AED4D04DBA8DA450331E18C298"><enum>(2)</enum><header>Interlocal
			 agreement</header>
					<subparagraph id="id47F535D80A5B4DBC95ED32219D7B37BA"><enum>(A)</enum><header>In
			 general</header><text>Before the Economic Support Area may be developed, the
			 City and County shall enter into an interlocal agreement regarding the
			 development of the Economic Support Area.</text>
					</subparagraph><subparagraph id="IDd3e4ab982a744f20a48b8ac95910afce"><enum>(B)</enum><header>City of North
			 Las Vegas</header><text>As a precondition of the development of the Economic
			 Support Area, the County shall use the best efforts of the County to cooperate
			 with the City to ensure compatible development of the Economic Support
			 Area.</text>
					</subparagraph><subparagraph id="ID6bb67621832845ac857526aac6100013"><enum>(C)</enum><header>Limitation of
			 agreement</header><text>In no case shall the interlocal agreement under this
			 paragraph compromise or interfere with the aviation rights provided under
			 subsection (f) and section 4(d).</text>
					</subparagraph><subparagraph id="IDd92fbe26415e454b92b5ba89bded29a9"><enum>(D)</enum><header>Future
			 conveyances</header><text>Any future conveyance of Federal land for addition to
			 the Clark County Off Highway Vehicle Park or the Recreation Area shall be
			 subject to—</text>
						<clause id="idE471D1BBB0554B418CC0409620B63FEB"><enum>(i)</enum><text>the
			 binding interlocal agreement under this paragraph; and</text>
						</clause><clause id="id8F6573C66AE04721A32F752722D0AB80"><enum>(ii)</enum><text>the aviation
			 easement requirements under subsection (f).</text>
						</clause></subparagraph><subparagraph id="ID705dfbf2fd5049f8a83ff78ad8603942"><enum>(E)</enum><header>Management
			 plan</header><text>The Secretary, in consultation with the Secretary of the Air
			 Force and the County, may develop a special management plan for the Federal
			 land—</text>
						<clause id="id85CA4DAC636840258F56B1E17EE55A01"><enum>(i)</enum><text>to
			 enhance public safety and safe off-highway recreation use; and</text>
						</clause><clause id="idFD363A74EB7A4182A879EA388EA97309"><enum>(ii)</enum><text>to
			 ensure compatible development with the mission requirements of the Nellis Air
			 Force Base.</text>
						</clause></subparagraph></paragraph><paragraph id="IDc73fd08ce2144447b4883c7e1ae7c333"><enum>(3)</enum><header>Use of net
			 proceeds</header><text>Of the net proceeds from the development of the Economic
			 Support Area, the County shall—</text>
					<subparagraph id="idB0C1C29264E44520B7027FD753C15F4F"><enum>(A)</enum><text>deposit 50
			 percent in a special account in the Treasury, to be used by the Secretary to
			 develop, maintain, and operate the Recreation Area; and</text>
					</subparagraph><subparagraph id="idB06B23BA0F44448091653445A5A4C92C"><enum>(B)</enum><text>retain 50
			 percent, to be used by the County for capital improvements and maintaining and
			 operating the park established under subsection (b)(1).</text>
					</subparagraph></paragraph></subsection><subsection id="IDec9aeae64f114636aee2d1caffdb130f"><enum>(d)</enum><header>Agreement with
			 Nellis Air Force Base</header>
				<paragraph id="ID533f5db6cb4a48fe9ea3281fbc0b2f4c"><enum>(1)</enum><header>In
			 general</header><text>Before the Federal land may be conveyed to the County
			 under subsection (a), the Clark County Board of Commissioners, the Bureau of
			 Land Management, and Nellis Air Force Base shall enter into an interlocal
			 agreement for the Federal land and the Recreation Area—</text>
					<subparagraph id="id03D05075E7384FFC8399746285FE97A6"><enum>(A)</enum><text>to enhance safe
			 off-highway recreation use; and</text>
					</subparagraph><subparagraph id="idB49CC0BBB3CC4BA0BD15EC4693B14B7B"><enum>(B)</enum><text>to ensure that
			 development of the Federal land is consistent with the long-term mission
			 requirements of Nellis Air Force Base.</text>
					</subparagraph></paragraph><paragraph id="IDc7e1c2f0707e48a2a05c1e0adddb48eb"><enum>(2)</enum><header>
			 Limitation</header><text>The use of the Federal land conveyed under subsection
			 (a) shall not compromise the national security mission or aviation rights of
			 Nellis Air Force Base.</text>
				</paragraph></subsection><subsection id="IDcbd493f363e04c0a808a3450b11b42ed"><enum>(e)</enum><header>Additional
			 terms and conditions</header><text>With respect to the conveyance of Federal
			 land under subsection (a), the Secretary may require such additional terms and
			 conditions as the Secretary considers to be appropriate to protect the
			 interests of the United States.</text>
			</subsection><subsection id="ID6875e8bdab814f209f1e8e1a1ea46be3"><enum>(f)</enum><header>Aviation
			 easement</header>
				<paragraph id="id09A10A9EC2AB4969B373473FDF60B174"><enum>(1)</enum><header>In
			 general</header><text>Each deed entered into for the conveyance of the Federal
			 land shall contain a perpetual aviation easement reserving to the United States
			 all rights necessary to preserve free and unobstructed overflight in and
			 through the airspace above, over, and across the surface of the Federal land
			 for the passage of aircraft owned or operated by any Federal agency or other
			 Federal entity.</text>
				</paragraph><paragraph id="id01B72EEF50EE4E15A8EACD865C4118A9"><enum>(2)</enum><header>Requirements</header><text>Each
			 easement described in paragraph (1) shall include such terms and conditions as
			 the Secretary of the Air Force determines to be necessary to comply with
			 paragraph (1).</text>
				</paragraph></subsection></section><section id="IDca2d5ab2c8fd41efb1437ee272f666df"><enum>4.</enum><header>Designation of
			 the Nellis Dunes National Off-Highway Vehicle Recreation Area</header>
			<subsection id="ID5a88128d54544a7ba31dd48e4b217ed1"><enum>(a)</enum><header>In
			 General</header><text>The area known as <quote>Nellis Dunes</quote> in the
			 Bureau of Land Management Resource Management Plan shall be known and
			 designated as the <quote>Nellis Dunes National Off-Highway Vehicle Recreation
			 Area</quote>.</text>
			</subsection><subsection id="IDd0ecbc3a69d449f88612b9518ada7e39"><enum>(b)</enum><header>Management
			 plan</header><text>The Director of the Bureau of Land Management may develop a
			 special management plan for the Recreation Area to enhance the safe use of
			 off-highway vehicles for recreational purposes.</text>
			</subsection><subsection id="IDf4a7f681c3954533a10127e611817f9a"><enum>(c)</enum><header>Exclusion from
			 National Landscape Conservation System</header><text>The Recreation Area shall
			 not be considered to be a unit of the National Landscape Conservation
			 System.</text>
			</subsection><subsection id="id1B26A0FBEDED44A9AA1BE88EE03282F7"><enum>(d)</enum><header>Aviation
			 rights</header><text>The aviation rights described in section 3(f) shall apply
			 to the Recreation Area.</text>
			</subsection></section><section id="IDdec2e597d02d4c37ade2ca9577244515"><enum>5.</enum><header>Withdrawal and
			 reservation of land for Nellis Air Force Base</header>
			<subsection id="ID6840447b642347d7aa2b5ae2a7d4cdef"><enum>(a)</enum><header>Withdrawal</header><text>Subject
			 to valid existing rights and except as otherwise provided in this
			 section—</text>
				<paragraph id="ID0d8f76661b02442bb028d3dd5292ab2f"><enum>(1)</enum><text>the Federal land
			 and interests in Federal land identified on the map as land to be withdrawn for
			 Nellis Air Force Base are withdrawn from all forms of appropriation under the
			 general land laws, including the mining, mineral leasing, and geothermal
			 leasing laws; and</text>
				</paragraph><paragraph id="ID26413aad611a488d80dc9692defd9312"><enum>(2)</enum><text>jurisdiction over
			 the land and interest in lands withdrawn and reserved by this section is
			 transferred to the Secretary of the Air Force.</text>
				</paragraph></subsection><subsection id="ID19112fae622b47b49900fe362db40a55"><enum>(b)</enum><header>Reservation</header><text>The
			 land withdrawn under subsection (a) is reserved for use by the Secretary of the
			 Air Force for—</text>
				<paragraph id="ID41c5ea04dbc84c4aa013fc4f34e636e1"><enum>(1)</enum><text>the enlargement
			 and protection of Nellis Air Force Base; or</text>
				</paragraph><paragraph id="IDed8e1d0d4ffb49d28230b344aedd6904"><enum>(2)</enum><text>other
			 defense-related purposes consistent with the purposes of this section.</text>
				</paragraph></subsection><subsection id="ID9e839bb89516447784f23c1e36c9ca32"><enum>(c)</enum><header>Changes in
			 use</header><text>The Secretary of the Air Force shall consult with the
			 Secretary before using the land withdrawn and reserved by this section for any
			 purpose other than the purposes described in section 3(b).</text>
			</subsection><subsection id="IDe951156c5fe2453faf91d6754e937af9"><enum>(d)</enum><header>Easement</header><text>The
			 United States reserves—</text>
				<paragraph id="id1BD32D035EA0451DA41A863C4F821BDF"><enum>(1)</enum><text>a right of flight
			 for the passage of aircraft in the airspace above the surface of the Federal
			 land conveyed to the County; and</text>
				</paragraph><paragraph id="id75C5211D5C3144438EED9D1359CD0635"><enum>(2)</enum><text>the right to
			 cause in the airspace any noise, vibration, smoke, or other effects that may be
			 inherent in the operation of aircraft landing at, or taking off from, Nellis
			 Air Force Base.</text>
				</paragraph></subsection></section></legis-body>
