		<section id="HA8537B55760F41C2BA631A12B43C93F5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Fair Employment Opportunity Act of
			 2011</short-title></quote>.</text>
		</section><section id="H39F4FB4043EB44A6ACB37B229DF0B1F6"><enum>2.</enum><header>Findings and
			 purpose</header>
			<subsection id="H109D6E330CBA4C228531416839BD843B"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds that denial of employment
			 opportunities to individuals because they are or have been unemployed is
			 discriminatory and burdens commerce by—</text>
				<paragraph id="HED9F721D7D03411E8FB334DD2F41A28C"><enum>(1)</enum><text>reducing personal
			 consumption and undermining economic stability and growth;</text>
				</paragraph><paragraph id="HD7FF7193843D48318A58B8D695AAAE8B"><enum>(2)</enum><text>squandering human
			 capital essential to the Nation’s economic vibrancy and growth;</text>
				</paragraph><paragraph id="HF301C06DC9F34761B9B855FDC275FDA9"><enum>(3)</enum><text>increasing demands
			 for Federal and State unemployment insurance benefits, reducing trust fund
			 assets, and leading to higher payroll taxes for employers, cuts in benefits for
			 jobless workers, or both;</text>
				</paragraph><paragraph id="H251E5220E7974470961EB9B44EFB7883"><enum>(4)</enum><text>imposing
			 additional burdens on publicly funded health and welfare programs; and</text>
				</paragraph><paragraph id="H2423985381AA4DE3B122F19D9C01C132"><enum>(5)</enum><text>depressing income,
			 property, and other tax revenues that the Federal Government, States, and
			 localities rely on to support operations and institutions essential to
			 commerce.</text>
				</paragraph></subsection><subsection id="H186DA65E035F44369BBBAA58F433098B"><enum>(b)</enum><header>Purposes</header><text>The
			 purposes of this Act are—</text>
				<paragraph id="id168FDE73D23C4000B502FBCAF9BF4145"><enum>(1)</enum><text>to prohibit
			 consideration of an individual’s status as unemployed in considering applicants
			 for, screening for, or hiring for positions, except where a requirement related
			 to employment status is a bona fide occupational qualification reasonably
			 necessary to successful performance in the job; and</text>
				</paragraph><paragraph id="idD3D7373959734E2AA4DD466632240B17"><enum>(2)</enum><text>to eliminate the
			 burdens imposed on commerce due to the exclusion of such individuals from
			 employment.</text>
				</paragraph></subsection></section><title id="idA5F09B3ED6E34BFE9F7EE719109B715D"><enum>I</enum><header>Fair
			 employment for nonfederal employees</header>
			<section id="H7F1A6DB0D7FB4FEB8F1E3501D9D19E8F"><enum>101.</enum><header>Definitions</header><text display-inline="no-display-inline">As used in this Act—</text>
				<paragraph id="H156A052653B24D12807FBC9401397ED2"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>affected individual</term>
			 means any person who was not considered for employment, or was not hired by an
			 employer, as an employee, because of the person’s current employment status
			 (current as of the date of the decision concerning consideration or hiring), or
			 any person who was not considered, screened, or referred for an employment
			 opportunity, as an employee, by an employment agency because of the person’s
			 current employment status (current as of the date of the decision concerning
			 consideration, screening, or referral);</text>
				</paragraph><paragraph id="idE489DE4AEE00499A8571ADF0B4F2D061"><enum>(2)</enum><text>the term
			 <term>employee</term> has the meaning given the term in section 3 of the Fair
			 Labor Standards Act of 1938 (29 U.S.C. 203), but shall not include an employee
			 covered under subchapter V of chapter 63 of title 5, United States Code;</text>
				</paragraph><paragraph id="HE34D76E5F42F4BF8BA5825AD0B481987"><enum>(3)</enum><text>the term
			 <term>employer</term>—</text>
					<subparagraph id="idB9569D84A80D48BC92BFE23936DE29D6"><enum>(A)</enum><text>means any person
			 engaged in commerce or any industry or activity affecting commerce who has 15
			 or more employees for each working day in each of 20 or more calendar weeks in
			 the current or preceding calendar year;</text>
					</subparagraph><subparagraph id="id46561DAAD30940BD89037EA5C1C9B406"><enum>(B)</enum><text>includes—</text>
						<clause id="H00F5B8F1341C44A6A9CD0596AF009557"><enum>(i)</enum><text>any
			 person who acts, directly or indirectly, in the interest of an employer
			 described in subparagraph (A) with respect to employing individuals to work for
			 the employer; and</text>
						</clause><clause id="H44AF9EB508E04D319F13CD4752CFCCA3"><enum>(ii)</enum><text>any
			 successor in interest of an employer described in subparagraph (A);</text>
						</clause></subparagraph><subparagraph id="id36580353DCAE4EEEB1D2A7C8CFA9D8EA"><enum>(C)</enum><text>includes any
			 public agency, as defined in section 3 of the Fair Labor Standards Act of 1938
			 (29 U.S.C. 203), but shall not include an employing agency covered under
			 subchapter V of chapter 63 of title 5, United States Code; and</text>
					</subparagraph><subparagraph id="id4E721597910D4450A8F87A29DDE926A6"><enum>(D)</enum><text>includes the
			 Government Printing Office and the Library of Congress;</text>
					</subparagraph></paragraph><paragraph id="HF6494AEF2765494AB02F6AD8C2FB2468"><enum>(4)</enum><text display-inline="yes-display-inline">the term <term>employment agency</term>
			 means any person regularly undertaking with or without compensation to procure
			 employees for an employer or to procure for individuals opportunities to work
			 as employees for an employer and includes an agent of such a person, and
			 includes any person who maintains an Internet website that publishes
			 advertisements or announcements of openings in jobs for employees;</text>
				</paragraph><paragraph id="H1B0067C19ADA4C73ACF910F369C5218A"><enum>(5)</enum><text>the term
			 <term>Secretary</term> means the Secretary of Labor; and</text>
				</paragraph><paragraph commented="no" id="HFEE1FFD9C87D4242844D82A7B9B5089B"><enum>(6)</enum><text>the term
			 <term>status as unemployed</term>, used with respect to an individual, means
			 the individual’s present or past unemployment, regardless of the length of time
			 such individual was unemployed.</text>
				</paragraph></section><section id="HA09B5B88795F4323B9CF354A9438B050"><enum>102.</enum><header>Prohibited
			 acts</header>
				<subsection id="H184274610B6B4DC98AFA6621C288D1C9"><enum>(a)</enum><header>Employers</header><text>It
			 shall be an unlawful practice for an employer to—</text>
					<paragraph id="HE82BD2AC5A36400D83AA35D42B226236"><enum>(1)</enum><text>fail or refuse to
			 consider for employment, or fail or refuse to hire, an individual as an
			 employee, because of the individual’s status as unemployed;</text>
					</paragraph><paragraph id="H3D6C04E48869446B9FFB40763EC9D9AF"><enum>(2)</enum><text>publish in print,
			 on the Internet, or in any other medium, an advertisement or announcement for
			 an employee for any job that includes—</text>
						<subparagraph id="HE429E52A3D0849CEA71A5654EDEC775F"><enum>(A)</enum><text display-inline="yes-display-inline">any provision stating or indicating that an
			 individual’s status as unemployed disqualifies the individual for a job;
			 and</text>
						</subparagraph><subparagraph id="H7C706D5051E74BE9BFADFC4D3C58AC3A"><enum>(B)</enum><text display-inline="yes-display-inline">any provision stating or indicating that an
			 employer will not consider or hire an individual for employment based on that
			 individual’s status as unemployed; and</text>
						</subparagraph></paragraph><paragraph id="H2261A33C77564C1DBFEA550F1F9A1473"><enum>(3)</enum><text display-inline="yes-display-inline">direct or request that an employment agency
			 take an individual’s status as unemployed into account in considering,
			 screening, or referring applicants for employment as an employee.</text>
					</paragraph></subsection><subsection id="HEB56A32C89984EAB8C0D5852562ECCAD"><enum>(b)</enum><header>Employment
			 agencies</header><text>It shall be an unlawful practice for an employment
			 agency to—</text>
					<paragraph id="H9309A69B5FFA436BAF2E27001446712D"><enum>(1)</enum><text display-inline="yes-display-inline">fail or refuse to consider, screen, or
			 refer an individual for employment as an employee based on the individual’s
			 status as unemployed;</text>
					</paragraph><paragraph id="H17B5B6B32CD34A48A1D8D3E01F7018A4"><enum>(2)</enum><text display-inline="yes-display-inline">limit, segregate, or classify individuals
			 in any manner that may limit their access to information about jobs, or
			 consideration, screening, or referral for jobs, as employees, because of their
			 status as unemployed; or</text>
					</paragraph><paragraph id="H82267A5A45894681AB9030830885D095"><enum>(3)</enum><text>publish, in print
			 or on the Internet or in any other medium, an advertisement or announcement for
			 any vacancy in a job, as an employee, that includes—</text>
						<subparagraph id="H25A454FF41844CB394CB92F47D72EBB9"><enum>(A)</enum><text display-inline="yes-display-inline">any provision stating or indicating that an
			 individual’s status as unemployed disqualifies the individual for a job;
			 and</text>
						</subparagraph><subparagraph id="H2CB2E4554CD64E8591F61DE69D3D8538"><enum>(B)</enum><text display-inline="yes-display-inline">any provision stating or indicating that an
			 employer will not consider or hire an individual for employment based on that
			 individual’s status as unemployed.</text>
						</subparagraph></paragraph></subsection><subsection id="H88C7CDE9C99B49B781C403B81882EF1E"><enum>(c)</enum><header>Interference
			 with rights, proceedings or inquiries</header><text display-inline="yes-display-inline">It shall be unlawful for any employer or
			 employment agency to—</text>
					<paragraph id="H665CC0D8607A43719FDCAF9F7FF29283"><enum>(1)</enum><text>interfere with,
			 restrain, or deny the exercise of or the attempt to exercise, any right
			 provided under this Act; or</text>
					</paragraph><paragraph id="H772DCC44DA114DA0B66EBB6B6A4B1255"><enum>(2)</enum><text display-inline="yes-display-inline">fail or refuse to hire, to discharge, or in
			 any other manner to discriminate against any individual, as an employee,
			 because such individual—</text>
						<subparagraph id="H42AE4BD82F6949638FF5927F20E58A6D"><enum>(A)</enum><text>opposed any
			 practice made unlawful by this Act;</text>
						</subparagraph><subparagraph id="HEA4AF621326147CF84E2C8F7136B1CF4"><enum>(B)</enum><text>has filed any
			 charge, or has instituted or caused to be instituted any proceeding, under or
			 related to this Act;</text>
						</subparagraph><subparagraph id="H220BE6A4082E47C48E5542CC670B7B93"><enum>(C)</enum><text>has given, or is
			 about to give, any information in connection with any inquiry or proceeding
			 relating to any right provided under this Act; or</text>
						</subparagraph><subparagraph id="H4A9D5AE9C4D5406DAB211D7A2FACD623"><enum>(D)</enum><text>has testified, or
			 is about to testify, in any inquiry or proceeding relating to any right
			 provided under this Act.</text>
						</subparagraph></paragraph></subsection><subsection id="HB823999E74024BA5975E665972355D41"><enum>(d)</enum><header>Bona fide
			 occupational qualification</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this
			 Act, consideration by an employer or employment agency of an individual’s
			 status as unemployed shall not be an unlawful employment practice under this
			 Act if an individual’s employment in a similar or related job for a period of
			 time reasonably proximate to the hiring of such individual is a bona fide
			 occupational qualification reasonably necessary to successful performance in
			 the job that is being filled.</text>
				</subsection></section><section id="H49F48EC748394D0AAC9B9939E54AFF81"><enum>103.</enum><header>Enforcement</header>
				<subsection id="H63A256EC2AE848309B1175BAF2D96D6D"><enum>(a)</enum><header>Civil action by
			 individual</header>
					<paragraph id="H626FDB51CE5D44EC85266E782866B562"><enum>(1)</enum><header>Liability for
			 employers and employment agencies</header><text>Any employer or employment
			 agency that violates subsection (a) or (b) of section 4 shall be liable to any
			 affected individual—</text>
						<subparagraph id="H3A6751503A5F437FB5C9365C0629332C"><enum>(A)</enum><text>for actual damages
			 equal to—</text>
							<clause id="H2B49A1DD755A4190811EA4A385742C85"><enum>(i)</enum><text>the
			 amount of—</text>
								<subclause id="H27CDD801953048EBA5AB2E7AB50BCF7A"><enum>(I)</enum><text>any wages, salary,
			 employment benefits, or other compensation denied or lost to such individual by
			 reason of the violation; or</text>
								</subclause><subclause id="HFD9E262F8385463CB10CAB229534618C"><enum>(II)</enum><text>in a case in
			 which wages, salary, employment benefits, or other compensation have not been
			 denied or lost to the individual, any actual monetary losses sustained by the
			 individual as a direct result of the violation or an amount of $1,000 per
			 violation per day, whichever is greater;</text>
								</subclause></clause><clause id="HC07A4B3B2329410786BD1013FF3BDF0C"><enum>(ii)</enum><text>the
			 interest on the amount described in clause (i) calculated at the prevailing
			 rate; and</text>
							</clause><clause id="HBD84CBEB4E714DA5889FED58A277287D"><enum>(iii)</enum><text>an
			 additional amount as liquidated damages equal to the sum of the amount
			 described in clause (i) and the interest described in clause (ii), and any
			 punitive damages, except that if an employer or employment agency that has
			 violated section 4 proves to the satisfaction of the court that the act or
			 omission that violated section 4 was in good faith and that the employer had
			 reasonable grounds for believing that the act or omission was not a violation
			 of section 4, such court may, in its discretion, reduce the amount of the
			 liability to the amount and interest determined under clauses (i) and (ii),
			 respectively; and</text>
							</clause></subparagraph><subparagraph id="H1E4A6689F41D442DAB04664460111F7D"><enum>(B)</enum><text>for such equitable
			 relief as may be appropriate, including employment.</text>
						</subparagraph></paragraph><paragraph id="H7D605C7DF2D8463D998DEFA5ABC47AC7"><enum>(2)</enum><header>Right of
			 action</header><text>An action to recover the damages or equitable relief
			 prescribed in paragraph (1) may be maintained against any employer or
			 employment agency in any Federal or State court of competent jurisdiction by
			 any 1 or more persons for and on behalf of—</text>
						<subparagraph id="H1B27C799328D4DD29CB760508C865F37"><enum>(A)</enum><text>the affected
			 individual; or</text>
						</subparagraph><subparagraph id="HD29D7C753FE241DE84BA8A1475D94A4C"><enum>(B)</enum><text>the affected
			 individual and other individuals similarly situated.</text>
						</subparagraph></paragraph><paragraph id="H04DEC0994E574201857C59DC1F92FBCE"><enum>(3)</enum><header>Fees and
			 costs</header><text>The court in such an action shall, in addition to any
			 judgment awarded to the plaintiff, allow a reasonable attorney’s fee,
			 reasonable expert witness fees, and other costs of the action to be paid by the
			 defendant.</text>
					</paragraph><paragraph id="H8EC152B890EE4ECABB973D438DFAA14E"><enum>(4)</enum><header>Limitations</header><text>The
			 right provided by paragraph (2) to bring an action by or on behalf of any
			 affected individual shall terminate—</text>
						<subparagraph id="H4A6333A21AB142F29246B6144390744E"><enum>(A)</enum><text>on the filing of a
			 complaint by the Secretary in an action under subsection (d) in which restraint
			 is sought of any violation of section 4; or</text>
						</subparagraph><subparagraph id="H3651031E6AA54DEEA0904C2D0BEAEDCA"><enum>(B)</enum><text>on the filing of a
			 complaint by the Secretary in an action under subsection (b) in which a
			 recovery is sought of the damages described in paragraph (1)(A) owing to an
			 affected individual by an employer or employment agency liable under paragraph
			 (1),</text>
						</subparagraph><continuation-text continuation-text-level="paragraph">unless the
			 action described in subparagraph (A) or (B) is dismissed without prejudice on
			 motion of the Secretary.</continuation-text></paragraph></subsection><subsection id="H054596C71CB649EC84C9C8B34465C479"><enum>(b)</enum><header>Action by the
			 Secretary</header>
					<paragraph id="HF89F771DD5FB4310A4AF1F23DC65F838"><enum>(1)</enum><header>Administrative
			 action</header><text>The Secretary shall receive, investigate, and attempt to
			 resolve complaints of violations of section 4 in the same manner that the
			 Secretary receives, investigates, and attempts to resolve complaints of
			 violations of sections 6 and 7 of the Fair Labor Standards Act of 1938 (29
			 U.S.C. 206 and 207).</text>
					</paragraph><paragraph id="H1C39F3B171714411A61B3D39010988B0"><enum>(2)</enum><header>Civil
			 action</header><text>The Secretary may bring an action in any court of
			 competent jurisdiction—</text>
						<subparagraph id="H1DBB9091C27B4080A1B393640108E671"><enum>(A)</enum><text>to enjoin
			 violations of this title and seek other relief and necessary to prevent future
			 violations;</text>
						</subparagraph><subparagraph id="H416513F6A04240CAB8D824FF2738D3AE"><enum>(B)</enum><text>to recover—</text>
							<clause id="H2212CB4A6ECD4A0BAA6EFF528F3CECB8"><enum>(i)</enum><text>the
			 damages described in subsection (a)(1)(A);</text>
							</clause><clause id="HBC0F710C79D5430EB698270533BB5086"><enum>(ii)</enum><text>in
			 the case of a violation of section 4(c), a civil penalty of not less than $250
			 per violation (in addition to any other relief available under this
			 subparagraph); or</text>
							</clause><clause id="H67C077AE59094AA69171E859BCA416F7"><enum>(iii)</enum><text>such other
			 equitable relief as the court determines to be appropriate.</text>
							</clause></subparagraph></paragraph><paragraph id="H1C4685695F3F40E6817C8B62001FE683"><enum>(3)</enum><header>Sums
			 recovered</header><text>Any sums recovered by the Secretary pursuant to
			 paragraph (2)(B)(i) shall be held in a special deposit account and shall be
			 paid, on order of the Secretary, directly to each affected individual. Any such
			 sums recovered pursuant to paragraph (2)(B)(i) that are not paid to an affected
			 individual because of inability to do so within a period of 3 years and any
			 sums recovered pursuant to paragraph (2)(B)(ii) shall be deposited into the
			 Treasury of the United States as miscellaneous receipts.</text>
					</paragraph></subsection><subsection id="H85BB9CCF1386458DB9DA7355501AE8F2"><enum>(c)</enum><header>Limitation</header>
					<paragraph id="H264372776EE447C591E9BABCA79EE770"><enum>(1)</enum><header>In
			 general</header><text>Except as provided in paragraph (2), an action under
			 subsection (a) may be brought not later than 2 years after the date of the last
			 event constituting the alleged violation for which the action is brought,
			 except that the limitation period for filing an action by an individual shall
			 be tolled during the period during which the Secretary is considering a
			 complaint against any defendant named in a complaint filed with the Secretary
			 under subsection (b)(1).</text>
					</paragraph><paragraph id="HD829D856C70B44F58340522B630E1D3E"><enum>(2)</enum><header>Willful
			 violation</header><text>In the case of such action brought for a willful
			 violation of section 4, such action may be brought not later than 3 years after
			 the date of the last event constituting the alleged violation for which such
			 action is brought, except that the limitation period for filing an action by an
			 individual shall be tolled during the period during which the Secretary is
			 considering a complaint, against the defendant involved, that is filed with the
			 Secretary under subsection (b)(1).</text>
					</paragraph><paragraph id="H0AAF28BA94A24F21AC3FDE682461736B"><enum>(3)</enum><header>Commencement</header><text>In
			 determining when an action is commenced by the Secretary under this section for
			 the purposes of this subsection, it shall be considered to be commenced on the
			 date when the Secretary files a complaint in a court of competent
			 jurisdiction.</text>
					</paragraph></subsection><subsection id="H8C2AEC4516064D82B06EE99913114CE0"><enum>(d)</enum><header>Action for
			 injunction by Secretary</header><text>The district courts of the United States
			 shall have jurisdiction, for cause shown, in an action brought by the
			 Secretary—</text>
					<paragraph id="H8BF6718885EE4E1DB51130F3B30688C0"><enum>(1)</enum><text>to restrain
			 violations of section 4;</text>
					</paragraph><paragraph id="HC9EE7FB683864EA2AC56B65B2D6D4425"><enum>(2)</enum><text>to award such
			 other equitable relief as may be appropriate, including employment; and</text>
					</paragraph><paragraph id="id550F0F5177AA48AEA059525D525EA8E7"><enum>(3)</enum><text>to award monetary
			 damages.</text>
					</paragraph></subsection><subsection id="H33D6E87B3C564B66AE848E650E9F5814"><enum>(e)</enum><header>Solicitor of
			 Labor</header><text>The Solicitor of Labor may appear for and represent the
			 Secretary on any litigation brought under this section.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="idE9A7AA4B5F96485E805D6EF2DAC393FC"><enum>(f)</enum><header display-inline="yes-display-inline">Government Printing Office and Library of
			 Congress</header><text display-inline="yes-display-inline">With respect to the
			 Government Printing Office (acting as an employer or employment agency), and
			 with respect to the Library of Congress (acting as an employer or employment
			 agency), the authority of the Secretary of Labor under this title shall be
			 exercised respectively by the Public Printer and the Librarian of
			 Congress.</text>
				</subsection></section></title><title id="id79FF6077AB05483AAC3E3BAAD0E9630A"><enum>II</enum><header>Fair employment
			 for federal employees</header>
			<section id="id3F6C136CC1A44709A906443447E6CF58"><enum>201.</enum><header>Prohibited
			 acts</header><text display-inline="no-display-inline">Title 5, United States
			 Code, is amended by inserting after chapter 23 the following:</text>
				<quoted-block display-inline="no-display-inline" id="id1D5CA510C0034C1BA05B04F9BFBA67DD" style="USC">
					<chapter id="id3319A16C9DAE43F78918444EC47AA5E5"><enum>25</enum><header>Prohibition on
				discrimination based on employment status</header>
						<section id="idA2944D53073B40339642ECBA071A984B"><enum>2501.</enum><header>Definitions</header><text display-inline="no-display-inline">As used in this chapter—</text>
							<paragraph id="id105974221FAD4592AEC6130AEFFF6FAE"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>affected individual</term>
				means any person who was not considered for employment, or was not hired by an
				employing agency, as an employee, because of the person’s current employment
				status (current as of the date of the decision concerning consideration or
				hiring), or any person who was not considered, screened, or referred for an
				employment opportunity, as an employee, by an employment agency because of the
				person’s current employment status (current as of the date of the decision
				concerning consideration, screening, or referral);</text>
							</paragraph><paragraph id="idD663FCAC296D47B2992A8D542328DBCB"><enum>(2)</enum><text>the term
				<term>employee</term> means an individual described in section
				6381(1)(A);</text>
							</paragraph><paragraph id="id296A9E14A52048D8882B834C01E115FE"><enum>(3)</enum><text>the term
				<term>employing agency</term> means an agency covered under subchapter V of
				chapter 63;</text>
							</paragraph><paragraph id="id0B8E26523A7D446EB7670C242EF4CAF5"><enum>(4)</enum><text display-inline="yes-display-inline">the term <term>employment agency</term>
				means any person regularly undertaking with or without compensation to procure
				employees for an employing agency or to procure for individuals opportunities
				to work as employees for an employing agency and includes an agent of such a
				person, and includes any person who maintains an Internet website that
				publishes advertisements or announcements of openings in jobs for
				employees;</text>
							</paragraph><paragraph id="id6B972FB10FB14E6B96730CA45D8B41EF"><enum>(5)</enum><text>the term
				<term>Secretary</term> means the Secretary of Labor; and</text>
							</paragraph><paragraph commented="no" id="id5ECBA55EDD084909AA4B904BFDB6B12F"><enum>(6)</enum><text>the term
				<term>status as unemployed</term>, used with respect to an individual, means
				the individual’s present or past unemployment, regardless of the length of time
				such individual was unemployed.</text>
							</paragraph></section><section id="id2FE1BD04008B42B0AC7E42067B0B9883"><enum>2502.</enum><header>Prohibited
				acts</header>
							<subsection id="id644D78A1BEF4484D8595125665847214"><enum>(a)</enum><text>It shall be an
				unlawful practice for an employing agency to—</text>
								<paragraph id="idB524C79BAEB6484DA6917A8C40B09592"><enum>(1)</enum><text>fail or refuse to
				consider for employment, or fail or refuse to hire, an individual as an
				employee, because of the individual’s status as unemployed;</text>
								</paragraph><paragraph id="idB2D738128E05427CB74A851728B07FCE"><enum>(2)</enum><text>publish in print,
				on the Internet, or in any other medium, an advertisement or announcement for
				an employee for any job that includes—</text>
									<subparagraph id="id535D1012EB204BC2A80725AE1F3246F9"><enum>(A)</enum><text display-inline="yes-display-inline">any provision stating or indicating that an
				individual’s status as unemployed disqualifies the individual for a job;
				and</text>
									</subparagraph><subparagraph id="id9D0BDC16E0894E6B8DE85E8A37EBC479"><enum>(B)</enum><text display-inline="yes-display-inline">any provision stating or indicating that an
				employing agency will not consider or hire an individual for employment based
				on that individual’s status as unemployed; and</text>
									</subparagraph></paragraph><paragraph id="id039100A54C6A409892A60BF032C362DF"><enum>(3)</enum><text display-inline="yes-display-inline">direct or request that an employment agency
				take an individual’s status as unemployed into account in considering,
				screening, or referring applicants for employment as an employee.</text>
								</paragraph></subsection><subsection id="id0F1F32B0A79A400EA554E08866DF657F"><enum>(b)</enum><text>It shall be an
				unlawful practice for an employment agency to—</text>
								<paragraph id="id5180E097D3F44B37A335213FC397D72A"><enum>(1)</enum><text display-inline="yes-display-inline">fail or refuse to consider, screen, or
				refer an individual for employment as an employee based on the individual’s
				status as unemployed;</text>
								</paragraph><paragraph id="id978B5EAE4CDF456E84DFBF05C75FC85F"><enum>(2)</enum><text display-inline="yes-display-inline">limit, segregate, or classify individuals
				in any manner that may limit their access to information about jobs, or
				consideration, screening, or referral for jobs, as employees, because of their
				status as unemployed; or</text>
								</paragraph><paragraph id="id488CBD4FCF5A4043BE8ACB180742D0DD"><enum>(3)</enum><text>publish, in print
				or on the Internet or in any other medium, an advertisement or announcement for
				any vacancy in a job, as an employee, that includes—</text>
									<subparagraph id="id2182206724A24D1597A1499EB8040314"><enum>(A)</enum><text display-inline="yes-display-inline">any provision stating or indicating that an
				individual’s status as unemployed disqualifies the individual for a job;
				and</text>
									</subparagraph><subparagraph id="id10A195494B7B46C6B7B8B1D5EC9C87C9"><enum>(B)</enum><text display-inline="yes-display-inline">any provision stating or indicating that an
				employing agency will not consider or hire an individual for employment based
				on that individual’s status as unemployed.</text>
									</subparagraph></paragraph></subsection><subsection id="id6FE97C6F2D87429E9F583206B7E9D13B"><enum>(c)</enum><text display-inline="yes-display-inline">It shall be unlawful for any employing
				agency or employment agency to—</text>
								<paragraph id="idDFEE1F51181F4471A0E6518850894D41"><enum>(1)</enum><text>interfere with,
				restrain, or deny the exercise of or the attempt to exercise, any right
				provided under this chapter; or</text>
								</paragraph><paragraph id="idC59ED55C44C04541969D134AB15EBC3B"><enum>(2)</enum><text display-inline="yes-display-inline">fail or refuse to hire, to discharge, or in
				any other manner to discriminate against any individual, as an employee,
				because such individual—</text>
									<subparagraph id="id4F96D8DECD694F5D89CB6DD09A3A26DF"><enum>(A)</enum><text>opposed any
				practice made unlawful by this chapter;</text>
									</subparagraph><subparagraph id="id25E31D5246064AE6A683E3CABA90899B"><enum>(B)</enum><text>has filed any
				charge, or has instituted or caused to be instituted any proceeding, under or
				related to this chapter;</text>
									</subparagraph><subparagraph id="id6CAF9FB9E050439B8B5AFD7411E425F6"><enum>(C)</enum><text>has given, or is
				about to give, any information in connection with any inquiry or proceeding
				relating to any right provided under this chapter; or</text>
									</subparagraph><subparagraph id="idD9A08237D2F14CECB1DEC8EDB7E1C6BD"><enum>(D)</enum><text>has testified, or
				is about to testify, in any inquiry or proceeding relating to any right
				provided under this chapter.</text>
									</subparagraph></paragraph></subsection><subsection id="id9878FEA4CFB64FDDAAA2062D871ED4A1"><enum>(d)</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of this
				chapter, consideration by an employing agency or employment agency of an
				individual’s status as unemployed shall not be an unlawful employment practice
				under this chapter if an individual’s employment in a similar or related job
				for a period of time reasonably proximate to the hiring of such individual is a
				bona fide occupational qualification reasonably necessary to successful
				performance in the job that is being filled.</text>
							</subsection></section><section id="id2CB08E2F022A4974AD102EB477E2610C"><enum>2503.</enum><header>Enforcement</header><text display-inline="no-display-inline">The Office of Personnel Management shall
				prescribe regulations necessary for the administration of this chapter. The
				regulations prescribed under this chapter shall, to the extent appropriate, be
				consistent with the regulations prescribed by the Secretary of Labor to carry
				out title I of the Fair Employment Opportunity Act of
				2011.</text>
