		  under existing geothermal leases, and for other purposes.</official-title>

		<section id="H1E7AEB07C3B54440A718FA9261AED89F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Exploring for Geothermal Energy on
			 Federal Lands Act</short-title></quote>.</text>
		</section><section id="H9F69207D5CE640C4B17BF60B93BC3F52"><enum>2.</enum><header>Geothermal
			 exploration notice and exclusion</header>
			<subsection id="HA2C4BF20EE524F0795EB2BCABD293D5F"><enum>(a)</enum><header>Definition of
			 geothermal exploration test project</header><text display-inline="yes-display-inline">In this section the term <term>geothermal
			 exploration test project</term> means the drilling of a well to test or explore
			 for geothermal resources on lands leased by the Department of the Interior for
			 the development and production of geothermal resources, that—</text>
				<paragraph id="H1D6F68DE8EB247D795E9D5531582B616"><enum>(1)</enum><text>is carried out by
			 the holder of the lease;</text>
				</paragraph><paragraph id="H069F790C896347198C20F7BDFA3ED366"><enum>(2)</enum><text>causes—</text>
					<subparagraph id="HFEB063EAB4884DDF801189DC65F645A2"><enum>(A)</enum><text>less than 1 acre
			 of soil or vegetation disruption at the location of each geothermal exploration
			 well; and</text>
					</subparagraph><subparagraph id="H24C55D966FFA458BACB72B4F3DDD9C9A"><enum>(B)</enum><text>not more than 5
			 acres of soil or vegetation disruption during access or egress to the test
			 site;</text>
					</subparagraph></paragraph><paragraph id="HD1E7CA3BC9B94CCABF2280E55B79BE25"><enum>(3)</enum><text>is
			 developed—</text>
					<subparagraph id="H83711EE096AB4308B9C0599F570530D4"><enum>(A)</enum><text>no deeper than
			 2,500 feet;</text>
					</subparagraph><subparagraph id="H6804BCEFE32141E5A0FA95BF6DD268A2"><enum>(B)</enum><text>less than 8 inches
			 in diameter;</text>
					</subparagraph><subparagraph id="H17BBFB9D3FAB447E9A0110ED654DDF90"><enum>(C)</enum><text>in a manner that
			 does not require off-road motorized access other than to and from the well site
			 along an identified off-road route for which notice is provided to the
			 Secretary of the Interior under subsection (c);</text>
					</subparagraph><subparagraph id="H58B83206618547C6B174DAFAB999ABE3"><enum>(D)</enum><text>without
			 construction of new roads other than upgrading of existing drainage crossings
			 for safety purposes; and</text>
					</subparagraph><subparagraph id="HBDCC7B498011412889278237854766D0"><enum>(E)</enum><text>with the use of
			 rubber-tired digging or drilling equipment vehicles; and</text>
					</subparagraph></paragraph><paragraph id="HCA9B5DBE52E34E97A60C7182B27EA654"><enum>(4)</enum><text>is completed in
			 less than 45 days, including—</text>
					<subparagraph id="HA2AC1B2FEDE24CF2B364B4E25AA46DEC"><enum>(A)</enum><text>removal of any
			 surface infrastructure from the site; and</text>
					</subparagraph><subparagraph id="H966736DBB0D54BB89A43FE145F03678F"><enum>(B)</enum><text>restoration of the
			 project site to approximately the condition that existed at the time the
			 project began.</text>
					</subparagraph></paragraph></subsection><subsection id="HDADDE4431756457A80FD04637F3C847D"><enum>(b)</enum><header>NEPA
			 exclusion</header><text>Section 102(2)(C) of the National Environmental Policy
			 Act of 1969 (42 U.S.C. 4321 et seq.) shall not apply with respect to a project
			 that the Secretary of the Interior determines under subsection (c) is a
			 geothermal exploration test project.</text>
			</subsection><subsection id="H5B1EFF8A0F9D4BB9BC8194B51F0A58C9"><enum>(c)</enum><header>Notice of
			 intent; review and determination</header>
				<paragraph id="HA9C0F3510F394B3C9433DC2421173DC8"><enum>(1)</enum><header>Requirement to
			 provide notice</header><text>A leaseholder intending to carry out a geothermal
			 exploration test project shall provide notice to the Secretary of the Interior
			 not later than 30 days prior to the start of drilling under the project.</text>
				</paragraph><paragraph id="H8241518E70344DBF83360DE73455BA3A"><enum>(2)</enum><header>Review of
			 project</header><text>The Secretary shall by not later than 10 days after
			 receipt of a notice of intent under paragraph (1) from a leaseholder—</text>
					<subparagraph id="H45C9FC8284A64CE589C5A442AF4DEFDE"><enum>(A)</enum><text>review the project
			 described in the notice and determine whether it is a geothermal exploration
			 test project under subsection (a);</text>
					</subparagraph><subparagraph id="HD7238A1BEB3248229864635C8806CD7F"><enum>(B)</enum><text>notify the
			 leaseholder—</text>
						<clause id="H2EBBCD92C9BE4C57AFBF6E278CF159A4"><enum>(i)</enum><text>that
			 under subsection (b) of this section, section 102(2)(C) of the National
			 Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.) does not apply to the
			 project; or</text>
						</clause><clause id="HF3D6C034FCF44D8089CA8C6FEA17F21E"><enum>(ii)</enum><text>that section
			 102(2)(C) of the National Environmental Policy Act of 1969 (42 U.S.C. 4321 et
			 seq.) applies to the project, including clear and detailed findings on any
			 deficiencies in the project that preclude the application of subsection (b) of
			 this section to the project.</text>
						</clause></subparagraph></paragraph><paragraph id="HA6A12C4DA2D5420E8791A32E4CB4D21E"><enum>(3)</enum><header>Opportunity to
			 remedy</header><text>If the Secretary provides notice under paragraph
			 (2)(B)(ii) that section 102(2)(C) of the National Environmental Policy Act of
			 1969 (42 U.S.C. 4321 et seq.) applies to the project, the Secretary shall
			 provide the leaseholder an opportunity to remedy the deficiencies described in
			 the notice prior to the date the leaseholder intended to start of drilling
			 under the project.</text>
				</paragraph></subsection></section></legis-body>
