<section id="HE9F52896ACE5436F9BB7CA2FF11E0561"><enum>101.</enum><header>Findings;
purposes</header>
<subsection id="HDBCA0749A5D34B5F884BF8B7CD67DFA6"><enum>(a)</enum><header>Findings</header><text>Congress
finds the following:</text>
<paragraph id="H5070499A7949423CB8F46118D4896B50"><enum>(1)</enum><text>Women with infants
and toddlers are a rapidly growing segment of the labor force today.</text>
</paragraph><paragraph id="H7642E2B910EA45098012CBCDE7960039"><enum>(2)</enum><text>Statistical
surveys of families show that over 50 percent of mothers with children less
than 1 year of age are in the labor force.</text>
</paragraph><paragraph id="H9C693476F2FF45D8B8003B992BD5E6B"><enum>(3)</enum><text>All major medical
authorities recommend that mothers breastfeed exclusively for 6 months and
continue breastfeeding for at least the first year of a child’s life, and that
arrangements be made to allow a mother’s expressing of milk if mother and child
must separate.</text>
</paragraph><paragraph id="HC213179C2BA742FB9858DDA18ECE0309"><enum>(4)</enum><text>Research studies
show that children who are not breastfed have an increased risk of common
childhood illnesses, such as ear infections, eczema, and diarrhea and vomiting,
and of more serious diseases including severe lower respiratory infections,
leukemia, and sudden infant death syndrome (SIDS).</text>
</paragraph><paragraph id="HFE0AE220DB4F4D54923D90E1B8C5E17F"><enum>(5)</enum><text>Research studies
have also shown that children who are not breastfed have an increased risk of a
number of chronic diseases, including type 2 diabetes, asthma, and childhood
obesity.</text>
</paragraph><paragraph id="H215A9C6933834C7DA04E241C03AEF619"><enum>(6)</enum><text>Exclusive
breastfeeding and longer durations of breastfeeding are also associated with
better maternal health outcomes, including a reduced risk of ovarian cancer and
breast cancer.</text>
</paragraph><paragraph id="HC6694770DC2A48A5B4E52738E977C70"><enum>(7)</enum><text>The health benefits
to children from breastfeeding translate into a decrease in parental
absenteeism due to infant illness. One-day absences to care for sick children
occur more than twice as often for mothers of formula feeding infants.</text>
</paragraph><paragraph id="H55FBE16B610C4C6EBB68D515BA8118C4"><enum>(8)</enum><text>Congress intended
to include breastfeeding and expressing breast milk as protected conduct under
the amendment made to title VII of the <act-name parsable-cite="CRA64">Civil
Rights Act of 1964</act-name> by the Act entitled <quote>An Act to amend title
VII of the <act-name>Civil Rights Act of 1964</act-name> to prohibit sex
discrimination on the basis of pregnancy</quote>, approved October 31, 1978
(commonly known as the <quote><act-name>Pregnancy Discrimination
Act</act-name></quote>).</text>
</paragraph><paragraph id="H2AFBAE2045E7462A9466E2AD04119FE5"><enum>(9)</enum><text>Although title VII
of the <act-name parsable-cite="CRA64">Civil Rights Act of 1964</act-name>, as
so amended, applies with respect to <quote>pregnancy, childbirth, or related
medical conditions</quote>, a few courts have failed to reach the conclusion
that breastfeeding and expressing breast milk in the workplace are covered by
such title.</text>
</paragraph></subsection><subsection id="HA65A93025E194BAD8328F3B982440800"><enum>(b)</enum><header>Purposes</header><text>The
purposes of this title are—</text>
<paragraph id="H8D2BE89E15EE494886ECB9F6E3D4C300"><enum>(1)</enum><text>to promote the
health and well-being of infants whose mothers return to the workplace after
childbirth; and</text>
</paragraph><paragraph id="HB7FC4E3E01034C56B0B7F56209AF7785"><enum>(2)</enum><text>to clarify that
breastfeeding and expressing breast milk in the workplace are protected conduct
under the amendment made by the Act commonly known as the
<quote><act-name>Pregnancy Discrimination Act</act-name></quote> to title VII
of the <act-name parsable-cite="CRA64">Civil Rights Act of
1964</act-name>.</text>
</paragraph></subsection></section><section id="H4A8DEC293B4545BA00F3412CAC92EAD8"><enum>102.</enum><header>Amendments to
Title VII of the <act-name parsable-cite="CRA64">Civil Rights Act of
1964</act-name></header><text display-inline="no-display-inline">Section 701(k)
of the <act-name parsable-cite="CRA64">Civil Rights Act of 1964</act-name> (42
U.S.C. 2000e(k)) is amended—</text>
<paragraph id="H5059559BB8414DD8AC29195035DC1F12"><enum>(1)</enum><text>by inserting
<quote>(including lactation)</quote> after <quote>childbirth</quote>;
and</text>
</paragraph><paragraph id="H80D148A3CE9F4CF786EB1909B0971900"><enum>(2)</enum><text>by adding at the
end the following: <quote>For purposes of this subsection, the term
<term>lactation</term> means a condition that may result in the feeding of a
child directly from the breast or the expressing of milk from the
breast.</quote>.</text>
</paragraph></section><enum>II</enum><header>Reasonable break
time</header>
<section id="idF8A570BBB56244939E769FE9D51D654F"><enum>201.</enum><header>Reasonable
break time for nursing mothers</header><text display-inline="no-display-inline">Section 13 of the Fair Labor Standards Act
of 1938 (29 U.S.C. 213) is amended in subsection (a), by inserting
<quote>(except section 7(r) in the case of paragraph (1) of this
subsection)</quote> after <quote>and 7</quote>.</text>
