			 Authorizations</header>
				<subsection commented="no" display-inline="no-display-inline" id="H1005EAAAC875468C99CBDD59D7D73353"><enum>(a)</enum><header display-inline="yes-display-inline">Specifications of amounts and personnel
			 levels</header><text display-inline="yes-display-inline">The amounts authorized
			 to be appropriated under section 101 and the authorized personnel levels
			 (expressed as full-time equivalent positions) as of September 30, 2012, for the
			 conduct of the intelligence activities of the elements listed in paragraphs (1)
			 through (16) of section 101, are those specified in the classified Schedule of
			 Authorizations prepared to accompany the bill S. __ of the One Hundred Twelfth
			 Congress.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="H7E39D46A3B64489E93080CADE029224E"><enum>(b)</enum><header display-inline="yes-display-inline">Availability of classified Schedule of
			 Authorizations</header><text display-inline="yes-display-inline">The classified
			 Schedule of Authorizations referred to in subsection (a) shall be made
			 available to the Committee on Appropriations of the Senate, the Committee on
			 Appropriations of the House of Representatives, and to the President. The
			 President shall provide for suitable distribution of the Schedule, or of
			 appropriate portions of the Schedule, within the executive branch.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="H74D2B18A028C42CA971A14F60ACBC821" section-type="subsequent-section"><enum>103.</enum><header display-inline="yes-display-inline">Personnel ceiling adjustments</header>
				<subsection commented="no" display-inline="no-display-inline" id="H29A2C0E15F7F44939CC7D85228C79A91"><enum>(a)</enum><header display-inline="yes-display-inline">Authority for increases</header><text display-inline="yes-display-inline">The Director of National Intelligence may
			 authorize the employment of civilian personnel in excess of the number of
			 full-time equivalent positions for fiscal year 2012 authorized by the
			 classified Schedule of Authorizations referred to in section 102(a) if the
			 Director of National Intelligence determines that such action is necessary for
			 the performance of important intelligence functions, except that the number of
			 personnel employed in excess of the number authorized under such section may
			 not, for any element of the intelligence community, exceed 3 percent of the
			 number of civilian personnel authorized under such section for such
			 element.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="H9B37FAC11DCC4610A3A831C4738D9235"><enum>(b)</enum><header display-inline="yes-display-inline">Authority for conversion of activities
			 performed by contract personnel</header>
					<paragraph id="H10C5340695B24CDCBE24B6D5BC39F7E2"><enum>(1)</enum><header>In
			 general</header><text>In addition to the authority in subsection (a) and
			 subject to paragraph (2), if the head of an element of the intelligence
			 community makes a determination that activities currently being performed by
			 contract personnel should be performed by employees of such element, the
			 Director of National Intelligence, in order to reduce a comparable number of
			 contract personnel, may authorize for that purpose employment of additional
			 full-time equivalent personnel in such element equal to the number of full-time
			 equivalent contract personnel performing such activities.</text>
					</paragraph><paragraph id="H28BA632BAD93438D84C20C4A33C50ADF"><enum>(2)</enum><header>Concurrence and
			 approval</header><text>The authority described in paragraph (1) may not be
			 exercised unless the Director of National Intelligence concurs with the
			 determination described in such paragraph.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HFC1CE2F5CDF64CCC9238721EFFA8730C"><enum>(c)</enum><header display-inline="yes-display-inline">Treatment of certain
			 personnel</header><text display-inline="yes-display-inline">The Director of
			 National Intelligence shall establish guidelines that govern, for each element
			 of the intelligence community, the treatment under the personnel levels
			 authorized under section 102(a), including any exemption from such personnel
			 levels, of employment or assignment—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="H344BFF19D20845219B35E06B35E3DE2B"><enum>(1)</enum><text display-inline="yes-display-inline">in a student program, trainee program, or
			 similar program;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8903A084A6E44B0F9FCC4D8950894051"><enum>(2)</enum><text display-inline="yes-display-inline">in a reserve corps or as a reemployed
			 annuitant; or</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBE7C26A4CB884D05861CC0FA6F72FCC3"><enum>(3)</enum><text display-inline="yes-display-inline">in details, joint duty, or long-term,
			 full-time training.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H716EB22DC70C49F1BA60C975B728B12E"><enum>(d)</enum><header display-inline="yes-display-inline">Notice to congressional intelligence
			 committees</header><text display-inline="yes-display-inline">The Director of
			 National Intelligence shall notify the congressional intelligence committees in
			 writing at least 15 days prior to the initial exercise of an authority
			 described in subsection (a) or (b).</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="HABE044F0221E4F89BEFC510AA78801AB" section-type="subsequent-section"><enum>104.</enum><header display-inline="yes-display-inline">Intelligence Community Management
			 Account</header>
				<subsection commented="no" display-inline="no-display-inline" id="HBD7B8CE1793743BD9C59176ADC7E9E81"><enum>(a)</enum><header display-inline="yes-display-inline">Authorization of
			 appropriations</header><text display-inline="yes-display-inline">There is
			 authorized to be appropriated for the Intelligence Community Management Account
			 of the Director of National Intelligence for fiscal year 2012 the sum of
			 $585,187,000. Within such amount, funds identified in the classified Schedule
			 of Authorizations referred to in section 102(a) for advanced research and
			 development shall remain available until September 30, 2013.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="HF82B6AAEB4A14033B80F80AB835ED0C9"><enum>(b)</enum><header display-inline="yes-display-inline">Authorized personnel levels</header><text display-inline="yes-display-inline">The elements within the Intelligence
			 Community Management Account of the Director of National Intelligence are
			 authorized 800 full-time equivalent personnel as of September 30, 2012.
			 Personnel serving in such elements may be permanent employees of the Office of
			 the Director of National Intelligence or personnel detailed from other elements
			 of the United States Government.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="H2D1083DAFEDD459A97207E554B25F289"><enum>(c)</enum><header display-inline="yes-display-inline">Classified authorizations</header>
					<paragraph commented="no" display-inline="no-display-inline" id="HCCB8C5F361364E1E8EC153404D10FD79"><enum>(1)</enum><header display-inline="yes-display-inline">Authorization of
			 appropriations</header><text display-inline="yes-display-inline">In addition to
			 amounts authorized to be appropriated for the Intelligence Community Management
			 Account by subsection (a), there are authorized to be appropriated for the
			 Community Management Account for fiscal year 2012 such additional amounts as
			 are specified in the classified Schedule of Authorizations referred to in
			 section 102(a). Such additional amounts made available for advanced research
			 and development shall remain available until September 30, 2013.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H40192E192B0A4C97BAC482C50AD1DDE0"><enum>(2)</enum><header display-inline="yes-display-inline">Authorization of personnel</header><text display-inline="yes-display-inline">In addition to the personnel authorized by
			 subsection (b) for elements of the Intelligence Community Management Account as
			 of September 30, 2012, there are authorized such full-time equivalent personnel
			 for the Community Management Account as of that date as are specified in the
			 classified Schedule of Authorizations referred to in section 102(a).</text>
					</paragraph></subsection></section></title><title commented="no" id="H651EF14CA4894634A5381BF137666E17" level-type="subsequent"><enum>II</enum><header display-inline="yes-display-inline">Central Intelligence Agency Retirement and
			 Disability System</header>
			<section commented="no" display-inline="no-display-inline" id="H4D535F6B7B274438997584D791C55D5C" section-type="subsequent-section"><enum>201.</enum><header display-inline="yes-display-inline">Authorization of
			 appropriations</header><text display-inline="no-display-inline">There is
			 authorized to be appropriated for the Central Intelligence Agency Retirement
			 and Disability Fund for fiscal year 2012 the sum of $513,700,000.</text>

			 matters</header>
			<section id="idCC64106B464C4E189DEEEEE85E419D3E"><enum>301.</enum><header>Restriction on
			 conduct of intelligence activities</header><text display-inline="no-display-inline">The authorization of appropriations by this
			 Act shall not be deemed to constitute authority for the conduct of any
			 intelligence activity that is not otherwise authorized by the Constitution or
			 the laws of the United States.</text>
			</section><section commented="no" display-inline="no-display-inline" id="H908CEBB0D75F4E0A8E8B6C3A4FC3DD41" section-type="subsequent-section"><enum>302.</enum><header>Increase in employee
			 compensation and benefits authorized by law</header><text display-inline="no-display-inline">Appropriations authorized by this Act for
			 salary, pay, retirement, and other benefits for Federal employees may be
			 increased by such additional or supplemental amounts as may be necessary for
			 increases in such compensation or benefits authorized by law.</text>
			</section><section commented="no" display-inline="no-display-inline" id="ID639E943972D440E6927D3140B061F9A7" section-type="subsequent-section"><enum>303.</enum><header display-inline="yes-display-inline">Enhancement of authority for flexible
			 personnel management among the elements of the intelligence
			 community</header><text display-inline="no-display-inline">Section 102A of the
			 National Security Act of 1947 (50 U.S.C. 403–1) is amended by adding at the end
			 the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="ID8A203383D96E424BB598CC6DADF49D34" style="OLC">
					<subsection commented="no" display-inline="no-display-inline" id="ID6F035A429E2E4FB4A4D631709265863E"><enum>(v)</enum><header display-inline="yes-display-inline">Authority To establish positions in
				excepted service</header><paragraph commented="no" display-inline="yes-display-inline" id="ID9A905FE534B34948A685B6FCB3A3C381"><enum>(1)</enum><text display-inline="yes-display-inline">The Director of National Intelligence, with
				the concurrence of the head of the covered department concerned and in
				coordination with the Director of the Office of Personnel Management,
				may—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="IDECBCB9A881ED4C908D144A77A835FA17" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">convert competitive service positions, and
				the incumbents of such positions, within an element of the intelligence
				community in such department, to excepted service positions as the Director of
				National Intelligence determines necessary to carry out the intelligence
				functions of such element; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDA33FE7852C174F438D6C21775BAAFB5A" indent="up1"><enum>(B)</enum><text>establish new positions in the
				excepted service within an element of the intelligence community in such
				department, if the Director of National Intelligence determines such positions
				are necessary to carry out the intelligence functions of such element.</text>
							</subparagraph></paragraph><paragraph id="ID51c5c37ef8b2468da11cb13bd8bd8d59" indent="up1"><enum>(2)</enum><text>An incumbent occupying a position on
				the date of the enactment of the <short-title>Intelligence
				Authorization Act for Fiscal Year 2012</short-title> selected to be converted
				to the excepted service under this section shall have the right to refuse such
				conversion. Once such individual no longer occupies the position, the position
				may be converted to the excepted service.</text>
						</paragraph><paragraph id="ID867dde00142546be9c0ca6b82c5b2fd7" indent="up1"><enum>(3)</enum><text>In this subsection, the term
				<quote>covered department</quote> means the Department of Energy, the
				Department of Homeland Security, the Department of State, or the Department of
				the Treasury.</text>
						</paragraph></subsection><after-quoted-block>.
				</after-quoted-block></quoted-block>
			</section><section id="ID29a38a3129df4e75862b760232f3ad8d"><enum>304.</enum><header>Cost
			 estimates</header>
				<subsection id="idB7CD211ECD8A44C3BCEC31D312F8F79D"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 506A of the
			 National Security Act of 1947 (50 U.S.C. 415a–1) is amended—</text>
					<paragraph id="idC22E5EB05DD14684A14480224128DD0E"><enum>(1)</enum><text>in subsection
			 (a)(2)—</text>
						<subparagraph id="id628E84C295AF4F719971AC7EB312EC10"><enum>(A)</enum><text>by inserting
			 <quote>(A)</quote> after <quote>(2)</quote>; and</text>
						</subparagraph><subparagraph id="id85B05B1ADA7342469AA57F7AEA8661BA"><enum>(B)</enum><text>by inserting at
			 the end the following new subparagraph:</text>
							<quoted-block display-inline="no-display-inline" id="idE5FA381516C4432F9D77CD1815257FE7" style="OLC">
								<subparagraph id="IDf987bae9369b4e88895e5d9dae82f977" indent="up2"><enum>(B)</enum><text>For major system acquisitions
				requiring a service or capability from another acquisition or program to
				deliver the end-to-end functionality for the intelligence community end users,
				independent cost estimates shall include, to the maximum extent practicable,
				all estimated costs across all pertinent elements of the intelligence
				community. For collection programs, this includes the cost of new analyst
				training, new hardware and software for data exploitation and analysis, and any
				unique or additional costs for data processing, storing, and power, space, and
				cooling across the life cycle of the program. If such costs for processing,
				exploitation, dissemination, and storage are scheduled to be executed in other
				elements of the intelligence community, the independent cost estimate shall
				identify and annotate such costs for such other elements
				accordingly.</text>
								</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
						</subparagraph></paragraph><paragraph id="id528D34D8F28A4965B9A705FD65691E68"><enum>(2)</enum><text>in subsection
			 (e)(2)—</text>
						<subparagraph id="idC35FB70542EC4310B0D0E2998F84C262"><enum>(A)</enum><text>by inserting
			 <quote>(A)</quote> after <quote>(2)</quote>;</text>
						</subparagraph><subparagraph id="id7A339E5D42574CCD95327567FF3493C3"><enum>(B)</enum><text>in subparagraph
			 (A), as so designated, by striking <quote>associated with the acquisition of a
			 major system,</quote> and inserting <quote>associated with the development,
			 acquisition, procurement, operation, and sustainment of a major system across
			 its proposed life cycle,</quote>; and</text>
						</subparagraph><subparagraph id="idED055FF0FADD4374B257FF12FE846602"><enum>(C)</enum><text>by adding at the
			 end the following:</text>
							<quoted-block display-inline="no-display-inline" id="idAB2A93BEB31A4B299C9C4645AF59257C" style="OLC">
								<subparagraph id="id42068CEF9DCE417BA3A79B9397386836" indent="up1"><enum>(B)</enum><text>In accordance with subsection
				(a)(2)(B), each independent cost estimate shall include all costs required
				across elements of the intelligence community to develop, acquire, procure,
				operate, and sustain the system to provide the end-to-end intelligence
				functionality of the system, including—</text>
									<clause id="id35E2B2332FF44C14ABF7E420204A8325"><enum>(i)</enum><text>for collection programs, the cost
				of new analyst training, new hardware and software for data exploitation and
				analysis, and any unique or additional costs for data processing, storing, and
				power, space, and cooling across the life cycle of the program; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="id7CA4DA11E2C9485C99850634DA1E4E9B"><enum>(ii)</enum><text>costs for processing,
				exploitation, dissemination, and storage costs are scheduled to be executed in
				other elements of the intelligence community, such element shall identify and
				annotate such costs accordingly.</text>
									</clause></subparagraph><after-quoted-block>.
				</after-quoted-block></quoted-block>
						</subparagraph></paragraph></subsection><subsection id="id230AF2F51E6740AB8F8E65E6405A2B6E"><enum>(b)</enum><header>Effective
			 date</header><text>The amendments made by this section shall take effect 180
			 days after the date of the enactment of this Act.</text>
				</subsection></section><section id="id21FD7E7CB63D40208CD680EA954EC7B0"><enum>305.</enum><header>Preparation of
			 nuclear proliferation assessment statements</header><text display-inline="no-display-inline">Section 123 of the Atomic Energy Act of 1954
			 (42 U.S.C. 2153) is amended—</text>
				<paragraph id="ID5570e22fd52c4b6d8d7ede240aab2ee3"><enum>(1)</enum><text>in subsection a.,
			 in the first undesignated paragraph after paragraph (9)—</text>
					<subparagraph id="ID365fffed93774c7eb91e58da44e774c4"><enum>(A)</enum><text>by striking the
			 third sentence and inserting <quote>The Secretary of State and the Director of
			 National Intelligence shall provide to the President an unclassified Nuclear
			 Proliferation Assessment Statement as follows: Parts A and B of such assessment
			 shall be prepared by the Secretary of State, in consultation with the Director
			 of National Intelligence. Part A shall analyze the consistency of the text of
			 the proposed agreement for cooperation with all the requirements of this
			 chapter, with specific attention to whether the proposed agreement is
			 consistent with each of the criteria set forth in this subsection. Part B shall
			 analyze the adequacy of the safeguards and other control mechanisms and the
			 peaceful use assurances contained in the agreement for cooperation to ensure
			 that any assistance furnished thereunder will not be used to further any
			 military or nuclear explosive purposes. Part C of such assessment shall be
			 prepared by the Director of National Intelligence, in consultation with the
			 Secretary of State, and consist of a comprehensive analysis of the country’s
			 export control system with respect to nuclear-related matters, including
			 interactions with other countries of proliferation concern and the actual or
			 suspected nuclear, dual-use, or missile-related transfers to such
			 countries.</quote>; and</text>
					</subparagraph><subparagraph id="IDb2dd3afa14d7406a92523fcc77ca15d6"><enum>(B)</enum><text>by striking
			 <quote>Each Nuclear Proliferation Assessment Statement prepared pursuant to
			 this Act shall be accompanied by a classified annex, prepared in consultation
			 with the Director of Central Intelligence,</quote> and inserting <quote>Each
			 Nuclear Proliferation Assessment Statement prepared pursuant to this Act shall
			 be accompanied by a classified annex prepared by the Director of National
			 Intelligence and the Secretary of State</quote>;</text>
					</subparagraph></paragraph><paragraph id="idC111EE87953E486AAC44799082BAD785"><enum>(2)</enum><text>in subsection b.,
			 by inserting <quote>and in addition has submitted such Nuclear Proliferation
			 Assessment Statement and any annexes to accompany it to the Select Committee on
			 Intelligence of the Senate and the Permanent Select Committee on Intelligence
			 of the House of Representatives,</quote> after <quote>Representatives,</quote>;
			 and</text>
				</paragraph><paragraph id="IDa799526a8d324e8ca7228c593c517ce5"><enum>(3)</enum><text>in subsection d.,
			 in the first proviso, by striking <quote>prepared by the Secretary of
			 State,</quote> and inserting <quote>prepared pursuant to this
			 section,</quote>.</text>
				</paragraph></section><section id="idF9DFCDC07CD8484DAD8C996FA92DE4B7"><enum>306.</enum><header>Detainees held
			 at United States Naval Station, Guantanamo Bay, Cuba</header>
				<subsection id="id93B6337BA13B4E90A5E528D5EC0D547B"><enum>(a)</enum><header>Department of
			 Homeland Security Appropriations Act, 2010</header><text>Subsection (e) of
			 section 552 of the Department of Homeland Security Appropriations Act, 2010
			 (Public Law 111–83; 123 Stat. 2178) is amended—</text>
					<paragraph id="ID8ceaf5d41de04d2f9c9f4febecd554c8"><enum>(1)</enum><text>in the matter

			 intelligence relating to terrorist recidivism of detainees held at United
			 States Naval Station, Guantanamo Bay, Cuba</header><text display-inline="no-display-inline">Section 334 of the Intelligence
			 Authorization Act for Fiscal Year 2010 (Public Law 111–259; 124 Stat. 2688) is
			 amended—</text>
				<paragraph id="idA0C9C943693549239FD1198EB35CD686"><enum>(1)</enum><text display-inline="yes-display-inline">in the matter preceding paragraph (1), by
			 inserting <quote>(a) <header-in-text level="subsection" style="OLC">In

							<paragraph id="idDEFD1451F6734363834907B3CDF943D1"><enum>(1)</enum><header>Requirement for
				updates</header><text display-inline="yes-display-inline">Not less frequently
				than once every 6 months, the Director of National Intelligence, in
				consultation with the Director of the Central Intelligence Agency and the
				Secretary of Defense, shall update and make publicly available an unclassified
				summary consisting of the information required by subsection (a) and the number
				of individuals formerly detained at the Naval Detention Facility at Guantanamo
				Bay, Cuba, who are confirmed or suspected recidivists.</text>
							</paragraph><paragraph id="id682C735AC576408597269DEE334A3E45"><enum>(2)</enum><header>Initial
				update</header><text display-inline="yes-display-inline">The initial update
				required by paragraph (1) shall be made publicly available not later than 10
				days after the date the first report following the date of the enactment of the
				<short-title>Intelligence Authorization Act for Fiscal
				Year 2012</short-title> is submitted to members and committees of Congress
				pursuant to section 319 of the Supplemental Appropriations Act, 2009 (Public
				Law 111–32; 10 U.S.C. 801 note).</text>
							</paragraph></subsection><after-quoted-block>.
				</after-quoted-block></quoted-block>
				</paragraph></section><section id="idE133058E8F7C484FAC8927A0BEF1B902"><enum>308.</enum><header>Submission of
			 information on Guantanamo Bay detainee transfers</header>
				<subsection id="id7093BFBF7B0740728307DDBF0F34E195"><enum>(a)</enum><header>Requirement for
			 submission</header><text>Not later than 45 days after the date of the enactment
			 of this Act, the Director of National Intelligence, in coordination with the
			 Secretary of State, shall submit to the congressional intelligence committees
			 information concerning the transfer or potential transfer of individuals who
			 are or have been detained by the United States at Naval Station, Guantanamo
			 Bay, Cuba.</text>
				</subsection><subsection id="id305509EB9FC947BDABDE62C9D27ED456"><enum>(b)</enum><header>Information
			 required</header><text>The information required by subsection (a) shall include
			 the following:</text>
					<paragraph id="ID9d4fad587f4f41eba4a95eefc36660a8"><enum>(1)</enum><text>An assessment of
			 the sufficiency of the monitoring undertaken by each foreign country to which
			 an individual referred to in subsection (a) has been transferred.</text>
					</paragraph><paragraph id="id39788728AA65498FAC8C1428E127ED3A"><enum>(2)</enum><text>Any written or
			 verbal agreement between the Secretary of State and the government of a foreign
			 country that describes monitoring and security assurances related to such an
			 individual.</text>
					</paragraph><paragraph id="id78CD492336E24F2EAB07633F1B6F38CC"><enum>(3)</enum><text>Each Department
			 of State cable, memorandum, or report relating to or describing the threat such
			 an individual may or may not pose.</text>
					</paragraph></subsection></section><section id="H172670AD19BA41B39432F28FE22B5435"><enum>309.</enum><header>Enhanced
			 procurement authority to manage supply chain risk</header>
				<subsection id="H86ADF03F92CA4A7C8D44C17F002CDFA9"><enum>(a)</enum><header>Definitions</header><text>In
			 this section:</text>
					<paragraph id="H5713C843C2EA4336A7170342036569EA"><enum>(1)</enum><header>Covered
			 agency</header><text>The term <term>covered agency</term> means any element of
			 the intelligence community other than an element within the Department of
			 Defense.</text>
					</paragraph><paragraph id="IDbb55abe6da334efdb68928cc0b8d714d"><enum>(2)</enum><header>Covered item of
			 supply</header><text>The term <quote>covered item of supply</quote> means an
			 item of information technology (as that term is defined in section 11101 of
			 title 40, United States Code) that is purchased for inclusion in a covered
			 system, and the loss of integrity of which could result in a supply chain risk
			 for a covered system.</text>
					</paragraph><paragraph id="H83A7F120ECCE4630BDED83090E3C81B2"><enum>(3)</enum><header>Covered
			 procurement</header><text>The term <term>covered procurement</term>
			 means—</text>
						<subparagraph id="H4300FD1827EB4054B5A488523EFB07BF"><enum>(A)</enum><text>a source selection
			 for a covered system or a covered item of supply; or</text>
						</subparagraph><subparagraph id="HCB523C63D9F34529B9E7C9DAB5684988"><enum>(B)</enum><text>any contract
			 action involving a contract for a covered system or a covered item of supply
			 where such contract includes a clause establishing requirements relating to
			 supply chain risk.</text>
						</subparagraph></paragraph><paragraph id="H68911E9EA56644889DFB03A7B61ED088"><enum>(4)</enum><header>Covered
			 procurement action</header><text>The term <term>covered procurement
			 action</term> means any of the following actions, if the action takes place in
			 the course of conducting a covered procurement:</text>
						<subparagraph id="H17A2AE1A09004F91867A5B4568CECB93"><enum>(A)</enum><text>The exclusion of a
			 source for the purpose of reducing supply chain risk in the acquisition of
			 covered systems.</text>
						</subparagraph><subparagraph id="HFDDD447795824111BCC596650788B6D2"><enum>(B)</enum><text>The exclusion of a
			 source that fails to achieve an acceptable rating with regard to an evaluation
			 factor providing for the consideration of supply chain risk in the evaluation
			 of proposals for the award of a contract or the issuance of a task or delivery
			 order.</text>
						</subparagraph><subparagraph id="H31BCDFB2E9DC4EB099DD9C00CB6179AD"><enum>(C)</enum><text>The decision to
			 withhold consent for a contractor to subcontract with a particular source or to
			 direct a contractor for a covered system to exclude a particular source from
			 consideration for a subcontract under the contract.</text>
						</subparagraph></paragraph><paragraph id="ID6f510b14986f44399634a01681783d11"><enum>(5)</enum><header>Covered
			 system</header>
						<subparagraph id="idA73318F9CE4442E18142F764B372FBBC"><enum>(A)</enum><header>In
			 general</header><text>The term <quote>covered system</quote> means any
			 information system (including any telecommunications system) used or operated
			 by an agency or by a contractor of an agency, or other organization on behalf
			 of an agency—</text>
							<clause id="ID9af7337814414df580af6c3334091dc8"><enum>(i)</enum><text>the
			 function, operation, or use of which—</text>
								<subclause id="ID201ecd9a66bf4cbd87d1ac954332d78b"><enum>(I)</enum><text>involves
			 intelligence activities;</text>
								</subclause><subclause id="ID28dd37f660384709a4deeeda997749b4"><enum>(II)</enum><text>involves
			 cryptologic activities related to national security;</text>
								</subclause><subclause id="ID62c3bb92973c4240887381b592e8501a"><enum>(III)</enum><text>involves
			 command and control of military forces;</text>
								</subclause><subclause id="ID9e76e95b46054f0b801190b59e8118ea"><enum>(IV)</enum><text>involves
			 equipment that is an integral part of a weapon or weapons system; or</text>
								</subclause><subclause id="ID8b0e4f485e9c4ac8af907109b1e7b93f"><enum>(V)</enum><text>subject to
			 subparagraph (B), is critical to the direct fulfillment of military or
			 intelligence missions; or</text>
								</subclause></clause><clause id="ID9cc2bf73520544cd95ad52100e06582e"><enum>(ii)</enum><text>is
			 protected at all times by procedures established for information that have been
			 specifically authorized under criteria established by an Executive order or an
			 Act of Congress to be kept classified in the interest of national defense or
			 foreign policy.</text>
							</clause></subparagraph><subparagraph id="IDb9abe9500969403b849c94dddd78346f"><enum>(B)</enum><header>Exception of
			 administrative and business applications</header><text>Subparagraph (A)(i)(V)
			 does not include a system that is to be used for routine administrative and
			 business applications (including payroll, finance, logistics, and personnel
			 management applications).</text>
						</subparagraph></paragraph><paragraph id="ID32e3747ec92049d8b412b0c7d478b6a3"><enum>(6)</enum><header>Supply chain
			 risk</header><text>The term <quote>supply chain risk</quote> means the risk
			 that an adversary may sabotage, maliciously introduce unwanted function, or
			 otherwise subvert the design, integrity, manufacturing, production,
			 distribution, installation, operation, or maintenance of a covered system so as
			 to surveil, deny, disrupt, or otherwise degrade the function, use, or operation
			 of such system.</text>
					</paragraph></subsection><subsection id="H621CAD30FD36418AB0B5878754B6BC2E"><enum>(b)</enum><header>Authority</header><text display-inline="yes-display-inline">Subject to subsection (c), the head of a
			 covered agency may, in conducting intelligence and intelligence-related
			 activities—</text>
					<paragraph id="HA3C34BE12896486B8CE44AE8685E47CA"><enum>(1)</enum><text>carry out a
			 covered procurement action; and</text>
					</paragraph><paragraph id="HBEC5EFD69AFC43088B57D42A3E208386"><enum>(2)</enum><text>limit,
			 notwithstanding any other provision of law, in whole or in part, the disclosure
			 of information relating to the basis for carrying out a covered procurement
			 action.</text>
					</paragraph></subsection><subsection id="HD58C87C8A37F43DAB0DE4F8553A9B868"><enum>(c)</enum><header>Determination
			 and notification</header><text>The head of a covered agency may exercise the
			 authority provided in subsection (b) only after—</text>
					<paragraph id="H940699706F13486680B18CB593627A4D"><enum>(1)</enum><text>any appropriate
			 consultation with procurement or other relevant officials of the covered
			 agency;</text>
					</paragraph><paragraph id="HD0BFF362B58D4D05B07B4CA6725C5CCB"><enum>(2)</enum><text>making a
			 determination in writing, in unclassified or classified form, that—</text>
						<subparagraph id="H2EA9B834445B406CB6A95EAC7573A9F1"><enum>(A)</enum><text>use of the
			 authority in subsection (b)(1) is necessary to protect national security by
			 reducing supply chain risk;</text>
						</subparagraph><subparagraph id="H3AFE57B3A64245D08C8960ABA9B66AA1"><enum>(B)</enum><text>less intrusive
			 measures are not reasonably available to reduce such supply chain risk;
			 and</text>
						</subparagraph><subparagraph id="H916112D092EF48598B0E0DEDD0901D30"><enum>(C)</enum><text>in a case where
			 the head of the covered agency plans to limit disclosure of information under
			 subsection (b)(2), the risk to national security due to the disclosure of such
			 information outweighs the risk due to not disclosing such information;</text>
						</subparagraph></paragraph><paragraph id="id17786059CF3446AD94462DC39632CEBC"><enum>(3)</enum><text>notifying the
			 Director of National Intelligence that there is a significant supply chain risk
			 to the covered system concerned, unless the head of the covered agency making
			 the determination is the Director of National Intelligence; and</text>
					</paragraph><paragraph id="H87A35FB7171E48A4A0E98F84931C1313"><enum>(4)</enum><text>providing a
			 classified or unclassified notice of the determination made under paragraph (2)
			 to the congressional intelligence committees that includes a summary of the
			 basis for the determination, including a discussion of less intrusive measures
			 that were considered and why they were not reasonably available to reduce
			 supply chain risk.</text>
					</paragraph></subsection><subsection id="H31C940D5CBD14F4D80CB59653E844FAC"><enum>(d)</enum><header>Savings</header><text>The
			 authority under this section is in addition to any other authority under any
			 other provision of law. The authority under this section shall not be construed
			 to alter or effect the exercise of any other provision of law.</text>
				</subsection><subsection id="H92074EE8063F43AE9D2752E1615D3D6C"><enum>(e)</enum><header>Effective
			 date</header><text>The requirements of this section shall take effect on the
			 date that is 180 days after the date of the enactment of this Act and shall
			 apply to contracts that are awarded on or after such date.</text>
				</subsection><subsection id="id342B7DBDFC3F4165A756206FB3776EEF"><enum>(f)</enum><header>Sunset</header><text>The
			 authority provided in this section shall expire on the date that section 806 of
			 the Ike Skelton National Defense Authorization Act for Fiscal Year 2011 (Public
			 Law 111–383; 10 U.S.C. 2304 note) expires.</text>
				</subsection></section><section id="idF2330CD1EE554B38B5021C68E9565B52"><enum>310.</enum><header>Report on
			 burial allowances</header><text display-inline="no-display-inline">Not later
			 than September 1, 2011, the Director of the Office of Personnel Management, in
			 consultation with the Director of National Intelligence, the Secretary of
			 Labor, and the Secretary of Defense, shall submit to the congressional
			 intelligence committees a report on current burial allowances for Federal
			 civilian or military personnel. Such report shall include any recommendations
			 of the Director for legislation to provide for burial allowances at a level
			 which adequately addresses the cost of burials and provides for equitable
			 treatment across the United States Government.</text>
			</section><section id="id7C91CF7633474EF58316623E35DF31A1"><enum>311.</enum><header>Modification
			 of certain reporting requirements</header>
				<subsection id="IDc6e53dfe9d794c2e83be5533936e9e58"><enum>(a)</enum><header>Intelligence
			 Reform and Terrorism Prevention Act of 2004</header><text>Section 1041(b) of
			 the Intelligence Reform and Terrorism Prevention Act of 2004 (50 U.S.C.
			 403–1b(b)) is amended by striking paragraphs (3) and (4).</text>

			 not apply to the Office of the Director of National Intelligence if the

			 intelligence committees that audited financial statements for such years for
			 such Office cannot be produced on a cost-effective basis.</text>

						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idEA367AAFD0654E91AB71AAEAD2B4B107"><enum>(2)</enum><text>did not meet the
			 foreign language requirements specified in section 104A(g)(1) of the National
			 Security Act of 1947 (50 U.S.C. 403–4a(g)(1)) at the time of such
			 transfer.</text>
						</paragraph></subsection></section><section commented="no" id="id57A136E3D9BC4BA48FD031C6C66B374A"><enum>412.</enum><header>Acceptance of
			 gifts</header><text display-inline="no-display-inline">Section 12 of the
			 Central Intelligence Agency Act of 1949 (50 U.S.C. 403l(a)) is amended—</text>
					<paragraph commented="no" id="id95AE2784E703444498DCBBCD6DD73C86"><enum>(1)</enum><text>in subsection
			 (a)—</text>
						<subparagraph commented="no" id="ID3c9fd2e4f0db4be883cb839a590f66cc"><enum>(A)</enum><text>by inserting
			 <quote>(1)</quote> after <quote>(a)</quote>; and</text>

				education, or recreation of an individual described in paragraph (3);
				and</text>
								</clause><subparagraph commented="no" id="id3D88E95163764C6FA28C8EE8639BC4A0" indent="up1"><enum>(B)</enum><text>under no circumstances may such a gift
				(or any income produced by any such gift) be used for operational
				purposes.</text>
								</subparagraph><paragraph commented="no" id="id158F3F69F2744F7398A3787428207348" indent="up1"><enum>(3)</enum><text>An individual described in this
				paragraph is an individual who—</text>
									<subparagraph commented="no" id="idECA315239CB6437E89628D63C8100883"><enum>(A)</enum><text>is an employee or a former employee of
				the Agency who suffered injury or illness while employed by the Agency
				that—</text>
										<clause id="ID9ded49ec2f0a48e085c58caa085c3ec8"><enum>(i)</enum><text>resulted from hostile or terrorist
				activities;</text>
										</clause><clause id="IDc2690392162340f1b75318f5953e91ba"><enum>(ii)</enum><text>occurred in connection with an
				intelligence activity having a significant element of risk; or</text>
										</clause><clause id="IDdb2afe7bd4bd41c1b407354626f012de"><enum>(iii)</enum><text>occurred under other
				circumstances determined by the Director to be analogous to the circumstances
				described in clause (i) or (ii);</text>
										</clause></subparagraph><subparagraph commented="no" id="id258A9C86A6AA47DE8391902E98B90144"><enum>(B)</enum><text>is a family member of such an employee
				or former employee; or</text>
									</subparagraph><subparagraph commented="no" id="idD9CB589834534CCAA22510F6DFBABD5A"><enum>(C)</enum><text>is a surviving family member of an
				employee of the Agency who died in circumstances described in clause (i), (ii),
				or (iii) of subparagraph (A).</text>
									</subparagraph></paragraph><paragraph commented="no" id="id58175A0BB259456D8AD02C91C2D44CD0" indent="up1"><enum>(4)</enum><text>The Director may not accept any gift
				under this section which is expressly conditioned upon any expenditure not to
				be met from the gift itself or from income produced by the gift unless such
				expenditure has been authorized by law.</text>
								</paragraph><paragraph commented="no" id="id61C093214BB54F60B28FA6098595C97C" indent="up1"><enum>(5)</enum><text>The Director may, in the Director's
				discretion, assign a gift accepted under the authority in this section to an
				individual described in paragraph (3) for the purposes described in paragraph
				(2)(iii).</text>
								</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
						</subparagraph></paragraph><paragraph commented="no" id="idBEEDD92361924D688F343AEBB4124984"><enum>(2)</enum><text>by adding at the
			 end the following new subsection:</text>

				regulations to carry out the authority provided in this section. Such
				regulations shall ensure that such authority is exercised consistent with all
				relevant ethical constraints and principles, including—</text>

				any prohibited conflict of interest or appearance of impropriety; and</text>

				against the acceptance of a gift from a foreign government or an agent of a
				foreign
				government.</text>

			 availability of information regarding the Inspector General of the Central
			 Intelligence Agency</header><text display-inline="no-display-inline">Section 17
			 of the Central Intelligence Agency Act of 1949 (50 U.S.C. 403q) is amended by
			 adding at the end the following new subsection:</text>

							</paragraph></subsection><after-quoted-block>.
				</after-quoted-block></quoted-block>
				</section><section id="idA6359645AC24484ABBEC3909A41616FD"><enum>414.</enum><header>Recruitment of
			 personnel in the Office of the Inspector General</header>
					<subsection id="idED4D6E361926483BB2F6C048A1B67C99"><enum>(a)</enum><header>Study</header><text>The
			 Director of the Central Intelligence Agency, in consultation with the Inspector
			 General of the Central Intelligence Agency, shall carry out a study of the
			 personnel issues of the Office of the Inspector General. Such study shall
			 include—</text>
						<paragraph id="idE00C611875B041E1A77C3F3E8C4837B0"><enum>(1)</enum><text>identification of
			 any barriers or disincentives to the recruitment or retention of experienced
			 investigators within the Office of the Inspector General; and</text>
						</paragraph><paragraph id="idDDAF5B3ACC7448E49E53EB117E282706"><enum>(2)</enum><text>a comparison of
			 the personnel authorities of the Inspector General with personnel authorities
			 of Inspectors General of other agencies and departments of the United States,
			 including a comparison of the benefits available to experienced investigators
			 within the Office of the Inspector General of the Central Intelligence Agency
			 with similar benefits available within the offices of Inspectors General of
			 such other agencies or departments.</text>
						</paragraph></subsection><subsection id="idCDBD97C1BAD346EA800297B9AE4CEA00"><enum>(b)</enum><header>Recommendations</header><text>Not
			 later than 90 days after the date of the enactment of this Act, the Director of
			 the Central Intelligence Agency shall submit to the congressional intelligence
			 committees—</text>
						<paragraph id="id49ACBA3B7CEB46B480A1C33B598FAC24"><enum>(1)</enum><text>any
			 recommendations of the Director for legislative action based on the results of
			 the study conducted under subsection (a); and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1AA0739DACF442138488339988BCE458"><enum>(2)</enum><text>a description of
			 any administrative actions taken by the Director based on such results.</text>
						</paragraph></subsection></section></subtitle><subtitle id="idA95DDE23D1164950824CE1DB1ADE9684"><enum>C</enum><header>National Security
			 Agency</header>
				<section commented="no" display-inline="no-display-inline" id="HEC786B051D5947DD94CDC342B0C7CAB8" section-type="subsequent-section"><enum>421.</enum><header display-inline="yes-display-inline">Confirmation of appointment of the Director
			 of the National Security Agency</header>
					<subsection commented="no" display-inline="no-display-inline" id="H71BBC6D4538748028C5173125B305200"><enum>(a)</enum><header display-inline="yes-display-inline">Director of National Security
			 Agency</header><text display-inline="yes-display-inline">Section 2 of the
			 National Security Agency Act of 1959 (50 U.S.C. 402 note) is amended—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="id8357F7C4F137497C8D2515ACE5025686"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting <quote>(b)</quote> before
			 <quote>There</quote>; and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8FFF441C4843439C83A55140F9BDF04F"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting before subsection (b), as so
			 designated by paragraph (1), the following new subsection</text>
							<quoted-block display-inline="no-display-inline" id="H28CC833A1AFF4F39948642E0B93E2CFD" style="traditional">
								<subsection commented="no" display-inline="no-display-inline" id="id8348568F40694831A3F78042F3623DD6"><enum>(a)</enum><paragraph commented="no" display-inline="yes-display-inline" id="idD2C6F211891B46E297C177BBED30081D"><enum>(1)</enum><text display-inline="yes-display-inline">There is a Director of the National
				Security Agency.</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC6C390992ECC4780AA3DE82B8EB3B858" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The Director of the National Security
				Agency shall be appointed by the President, by and with the advice and consent
				of the Senate.</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H67CB9B090DF5463DA71B1D268453EB21" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">The Director of the National Security
				Agency shall be the head of the National Security Agency and shall discharge
				such functions and duties as are provided by this Act or otherwise by
				law.</text>
									</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HFEE1E6D8CCA7458900AAE8026BA1D9D3"><enum>(b)</enum><header display-inline="yes-display-inline">Positions of importance and
			 responsibility</header><text display-inline="yes-display-inline">The President
			 may designate the Director of the National Security Agency as a position of
			 importance and responsibility under section 601 of title 10, United States
			 Code.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="H8F8005C47EF545DC8000321326E5A20"><enum>(c)</enum><header display-inline="yes-display-inline">Effective date and applicability</header>
						<paragraph commented="no" display-inline="no-display-inline" id="H92A0384FC4DF46F593FB98F88BA62D97"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The amendments made by subsection (a) shall
			 take effect on the date of the enactment of this Act and shall apply upon the
			 earlier of—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="H67481B403A4549B28800D6B3EACC85F"><enum>(A)</enum><text display-inline="yes-display-inline">the date of the nomination by the President
			 of an individual to serve as the Director of the National Security Agency,
			 except that the individual serving as such Director as of the date of the
			 enactment of this Act may continue to perform such duties after such date of
			 nomination and until the individual appointed as such Director, by and with the
			 advice and consent of the Senate, assumes the duties of such Director;
			 or</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H259EB7554117433594986B343F3B8908"><enum>(B)</enum><text display-inline="yes-display-inline">the date of the cessation of the
			 performance of the duties of such Director by the individual performing such
			 duties as of the date of the enactment of this Act.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0A3A00F105AA43F881B92F41D32FAA22"><enum>(2)</enum><header display-inline="yes-display-inline">Positions of importance and
			 responsibility</header><text display-inline="yes-display-inline">Subsection (b)
			 shall take effect on the date of the enactment of this Act.</text>
						</paragraph></subsection></section><section id="ID4c06be8c4b1745d68366bfa9f347d116"><enum>422.</enum><header>Additional
			 authorities for National Security Agency security personnel</header>
					<subsection id="ID1531f2220acc467b822b8e068f27854c"><enum>(a)</enum><header>Authority To
			 transport apprehended persons</header><text>Paragraph (5) of section 11(a) of
			 the National Security Agency Act of 1959 (50 U.S.C. 402 note) is amended to
			 read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="id6584BA8293394CA18731ED9C48189225" style="OLC">
							<paragraph id="ID00e44d01b5964498889f079c26f70201" indent="up1"><enum>(5)</enum><text>Agency personnel authorized by the
				Director under paragraph (1) may transport an individual apprehended under the
				authority of this section from the premises at which the individual was
				apprehended, as described in subparagraph (A) or (B) of paragraph (1), for the
				purpose of transferring such individual to the custody of law enforcement
				officials. Such transportation may be provided only to make a transfer of
				custody at a location within 30 miles of the premises described in
				subparagraphs (A) and (B) of paragraph
				(1).</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection id="ID9810819ebcb44afd81f0a4449fd8fcaf"><enum>(b)</enum><header>Conforming
			 amendment relating to tort liability</header><text>Paragraph (1) of section
			 11(d) of the National Security Agency Act of 1959 (50 U.S.C. 402 note) is
			 amended—</text>
						<paragraph id="IDee16e67046a74cb2a0c72de26b4ab91a"><enum>(1)</enum><text>in subparagraph
			 (B), by striking <quote>or</quote> at the end;</text>
						</paragraph><paragraph id="ID9cf81a187deb4deca19c6f0f22e9112e"><enum>(2)</enum><text>in subparagraph
			 (C), by striking the period at the end and inserting <quote>; or</quote>;
			 and</text>
						</paragraph><paragraph id="ID4a027f61648b4047a051f433f7474ef4"><enum>(3)</enum><text>by adding at the
			 end the following new subparagraph:</text>

				<section commented="no" id="id25A407E64E8A4EAB920F16C475DB86AE"><enum>431.</enum><header>Appropriations
			 for defense intelligence elements: accounts for transfer; transfer</header>
					<subsection id="ID22d1ae36be9d4908bd652ba88435326b"><enum>(a)</enum><header>In
			 general</header><text>Subchapter I of chapter 21 of title 10, United States
			 Code, is amended by adding at the end the following new section:</text>
						<quoted-block display-inline="no-display-inline" id="id757521BA908C46E78C2C5DFF08004ECC" style="USC">
							<section id="ID9cf040c16b8241049b05398e67584a93"><enum>429.</enum><header>Appropriations
				for defense intelligence elements: accounts for transfer; transfer</header>
								<subsection id="IDf4a4a0d759754a7ab77474fc2af2dc47"><enum>(a)</enum><header>Transfer of
				appropriations for defense intelligence elements</header><text>In addition to
				any other transfer authority available to the Secretary of Defense and
				notwithstanding section 1501 of title 31, United States Code, there may be
				transferred to an account established pursuant to subsection (b) the
				following:</text>
									<paragraph id="idF7C50DAD8C7C476FB771EDD90B4CECC4"><enum>(1)</enum><text>Appropriations
				transferred by the Secretary of Defense from appropriations of the Department
				of Defense available for intelligence, intelligence-related activities, and
				communications.</text>
									</paragraph><paragraph commented="no" id="H08E28CF83BE54E51A510116B259DE07E"><enum>(2)</enum><text>Appropriations and
				other amounts transferred by the Director of National Intelligence.</text>
									</paragraph><paragraph commented="no" id="HC04300B1037D42058757944F465A66CF"><enum>(3)</enum><text>Amounts and
				reimbursements in connection with transactions authorized by law between the
				defense intelligence elements and other entities.</text>
									</paragraph></subsection><subsection commented="no" id="idAD941A70894B491A8FA417A26318C81A"><enum>(b)</enum><header>Accounts for
				appropriations for defense intelligence elements</header><text>The Secretary of
				the Treasury shall establish one or more accounts for the receipt of
				appropriations and other amounts transferred pursuant to subsection (a).</text>
								</subsection><subsection id="IDe88a12d5c5a5404cb8cc7d5869d36fe3"><enum>(c)</enum><header>Availability
				and use of funds</header><text>Funds transferred to an account established
				under subsection (b) shall remain available for the same time period, and shall
				be available for the same purpose, as the original appropriations from which
				the funds were transferred.</text>
								</subsection><subsection commented="no" id="HEC141C344C41460B8CD0C75D2BCC6FCE"><enum>(d)</enum><header>Availability of
				appropriations and amounts transferred</header><paragraph commented="no" display-inline="yes-display-inline" id="H50E468AA331742B7AE4B8CC35ADAF7A3"><enum>(1)</enum><text>Appropriations
				transferred pursuant to subsection (a) shall remain available for the same time
				period, and shall be available for the same purposes, as the appropriations
				from which transferred.</text>
									</paragraph><paragraph commented="no" id="H8376DB17FD7C4C7D8C0D9DE762125210" indent="up1"><enum>(2)</enum><text>Appropriation balances in an account
				established pursuant to subsection (b) may be transferred back to the account
				or accounts from which such balances originated as an appropriation
				refund.</text>
									</paragraph></subsection><subsection id="IDefab7ffd60af49f393fb799d93149186"><enum>(e)</enum><header>Defense
				intelligence element defined</header><text>In this section, the term
				<quote>Defense intelligence element</quote> means any agency, office, or
				element of the Department of Defense that is an element of the intelligence
				community (as that term is defined in section 3(4) of the National Security Act
				of 1947 (50 U.S.C. 401a(4)).</text>
								</subsection></section><after-quoted-block>.
				</after-quoted-block></quoted-block>
					</subsection><subsection commented="no" id="H3A61E4AFCD4E4D1DB26E748A4516DC7A"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of sections at the beginning of subchapter I
			 of chapter 21 of such title is amended by inserting after the item relating to
			 section 428 the following new item:</text>

			 bank</header><text display-inline="no-display-inline">Subsection (b) of section
			 6372 of title 5, United States Code, is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="id9415C3D85D3A4D8999B1C61BE9DF376B" style="OLC">
						<subsection id="IDa21bab8e3e164e6997305061f9c354be"><enum>(b)</enum><paragraph commented="no" display-inline="yes-display-inline" id="idC415CF743A214B44BC5C1C252094A412"><enum>(1)</enum><text>Except as provided in
				paragraph (2) and notwithstanding any other provision of this subchapter,

				of law, the Director of the Federal Bureau of Investigation may authorize an
				individual employed in the Bureau to participate in a leave bank program
				administered by the Department of Justice under this subchapter if in the
				Director's judgment such participation will not adversely affect the protection
				of intelligence sources and
				methods.</text>
