		<official-title>To amend the Surface Mining Control and Reclamation Act
		  of 1977 to authorize certified States and tribes to use amounts made available
		  from the Abandoned Mine Reclamation Fund for hard rock and coal mining
		  reclamation projects and to extend liability protection to certified States and
		  Indian tribes carrying out approved abandoned mine reclamation
		  programs.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Surface Mining Control and
			 Reclamation Act Amendments Act of 2011</short-title></quote>.</text>
		</section><section id="IDe07c270eb47a42e2a2052346dd202ce3"><enum>2.</enum><header>Amendments to
			 the Surface Mining Control and Reclamation Act of 1977</header>
			<subsection id="IDff5e12870f6b4be980de648dd1191958"><enum>(a)</enum><header>State
			 reclamation program</header><text>Section 405 of the Surface Mining Control and
			 Reclamation Act of 1977 (30 U.S.C. 1235) is amended in subsection (h) by
			 striking <quote>subsection 402(g)</quote> and inserting <quote>subsections (g)
			 and (i)(2) of section 402</quote>.</text>
			</subsection><subsection id="ID2cd5276d4dde4149985471e873ad0efb"><enum>(b)</enum><header>Certification</header><text>Section
			 411 of the Surface Mining Control and Reclamation Act of 1977 (30 U.S.C. 1240a)
			 is amended—</text>
				<paragraph id="IDc410837a227f44949fd7b47fe6b2b87c"><enum>(1)</enum><text>by striking
			 subsection (b) and inserting the following—</text>
					<quoted-block display-inline="no-display-inline" id="idB7FAA342C27F4F619E34CF52B7706C8C" style="OLC">
						<subsection id="ID48717d313d92445ab4a5af2997dfdf2f"><enum>(b)</enum><header>Eligible land,
				water, and facilities</header>
							<paragraph id="id94DD387C78164B119D618DFD5F3D841C"><enum>(1)</enum><header>In
				general</header><text>If the Secretary has concurred in a State or tribal
				certification under subsection (a)—</text>
								<subparagraph id="idBBDCED9526E64BB2B5FFEB6CECD3DBF6"><enum>(A)</enum><text>section 404 shall
				not apply; and</text>
								</subparagraph><subparagraph id="idEABFED5819334FE6A691FD67BF22CF8C"><enum>(B)</enum><text>any amounts
				received by the State or Indian tribe under this title may be used for eligible
				land, water, and facilities—</text>
									<clause id="ID917dafae5abd4915b9d70755c095a9e5"><enum>(i)</enum><text>that were—</text>
										<subclause id="idCE550C7C3DD342B0A11BA44FE9E4178E"><enum>(I)</enum><text>mined or
				processed for minerals or affected by such mining or processing; and</text>
										</subclause><subclause id="id37ED47F176BB443E8F31EA17D24057CF"><enum>(II)</enum><text>abandoned or
				left in an inadequate reclamation status before August 3, 1977; and</text>
										</subclause></clause><clause id="ID8584c3c0dcb849fa85bae259b613143c"><enum>(ii)</enum><text>for which no
				continuing reclamation responsibility exists under State or other Federal
				laws.</text>
									</clause></subparagraph></paragraph><paragraph id="id0900121C7A1F49DD98257F186B5B09B8"><enum>(2)</enum><header>Applicable date
				for Forest Service and BLM</header><text>In determining the eligibility under
				this subsection of Federal land, waters, and facilities under the jurisdiction
				of the Forest Service or Bureau of Land Management, instead of the date
				referred to in paragraph (1)(B)(i)(II) the applicable date shall be August 28,
				1974, and November 26, 1980,
				respectively.</text>
							</paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="IDee6be62abc8f46ad8a3abc0a9caf8cda"><enum>(2)</enum><text>in subsection
			 (f), by striking <quote>annual grants made available under section
			 402(g)(1)</quote> and inserting <quote>amounts received under subsections (g)
			 and (i)(2) of section 402</quote>; and</text>
				</paragraph><paragraph id="IDe9cd1a363c4641a6b72388610a4bf191"><enum>(3)</enum><text>in subsection
			 (h), by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id0EEF0AF306F040BFAB8E291E22B252AE" style="OLC">
						<paragraph id="id5ACEAFF721A44F5EB19F7F096C45FD2E"><enum>(5)</enum><header>Approved
				abandoned mine reclamation program</header>
							<subparagraph id="idBA8926DF196C444AA10760ACC6D37316"><enum>(A)</enum><header>In
				general</header><text>Any State or Indian tribe that makes a certification
				under subsection (a) in which the Secretary concurs may use any amounts
				received under this title to carry out an approved abandoned mine reclamation
				program in accordance with subsections (b) through (g).</text>
							</subparagraph><subparagraph id="id0350BE285B024742B2AE2BF3AF5EB03D"><enum>(B)</enum><header>Liability</header><text>Section
				405(l) shall apply to both uncertified and certified States or Indian tribes in
				carrying out an abandoned mine reclamation program approved under this
				title.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
