		<official-title>To amend title 23, United States Code, to provide for the
		  establishment of a commercial truck safety program, and for other
		  purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Commercial Truck Safety
			 Act</short-title></quote>.</text>
		</section><section id="ID793be159bf5b4365944a37231aa7ae3b"><enum>2.</enum><header>Commercial truck
			 safety program</header>
			<subsection id="idADE1782C32B34A71B601A09EA09EC251"><enum>(a)</enum><header>In
			 general</header><text>Chapter 4 of title 23, United States Code, is amended by
			 adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id93F4101C2D914E2BAC2C82565F80FE44" style="USC">
					<section id="idBC038952DBA24700B9CD4489EAB88C3A"><enum>413.</enum><header>Commercial
				truck safety program</header>
						<subsection id="ID95c330da18ce4fa3a12dfb02ca3a54ce"><enum>(a)</enum><header>Definition of
				covered truck</header><text>In this section, the term <term>covered
				truck</term> means a 6-axle truck with a maximum gross weight of up to 100,000
				pounds.</text>
						</subsection><subsection id="idA1CD42AD03E74EFDA8728BA3EB27A15D"><enum>(b)</enum><header>Program</header><text>The
				Secretary shall establish a program to improve commercial motor vehicle safety
				on highways on the Interstate System in accordance with this section.</text>
						</subsection><subsection id="ID49d91fce8f8d463bab5d211de7b22087"><enum>(c)</enum><header>State waivers
				for covered trucks on Interstate System</header>
							<paragraph id="ID59a8a2232d684f209f6686193b2cadc6"><enum>(1)</enum><header>In
				general</header><text>Not later than 60 days after the date of enactment of
				this section, the Secretary shall initiate a rulemaking to establish, by
				regulation, a demonstration program under which the Governor of a State may
				request from the Secretary, and the Secretary may grant, a 3-year waiver to
				covered trucks to operate on highways on the Interstate System in the
				State.</text>
							</paragraph><paragraph id="IDd4ff371683394d99930e3da7ea8d104f"><enum>(2)</enum><header>Submission of
				request</header><text>The Governor of a State seeking a waiver under this
				subsection shall submit to the Secretary a request for the waiver that
				includes—</text>
								<subparagraph id="ID5ce8ec88482e4e2da79458c7594fdb0e"><enum>(A)</enum><text>a description of
				the proposed route of each highway, or portion of a highway, on the Interstate
				System on which covered trucks would be permitted to operate;</text>
								</subparagraph><subparagraph id="ID23ef5af2e9d34600b01818ceb2acd043"><enum>(B)</enum><text>a certification
				by the chief engineer of the State transportation department that the proposed
				route could safely accommodate traffic that includes covered trucks;</text>
								</subparagraph><subparagraph id="IDbbb2e8136c5f44378d2121198d46f40c"><enum>(C)</enum><text>a certification
				that the Interstate System within the State is maintained in good repair;
				and</text>
								</subparagraph><subparagraph id="IDb8e496ee8deb4af282e504d2ba9ad2ef"><enum>(D)</enum><text>such other
				information as the Secretary may require.</text>
								</subparagraph></paragraph><paragraph id="ID1dcfee266c00447a9bb513c715cd0ff1"><enum>(3)</enum><header>Determinations</header>
								<subparagraph id="ID5dd155570ae64e68a9b0e2c06a3dede9"><enum>(A)</enum><header>In
				general</header><text>The Secretary shall—</text>
									<clause id="IDb4b27e7bde644ad1b887d0b40ade07eb"><enum>(i)</enum><text>not later than 30
				days after the date of receipt of a waiver request under paragraph (2)—</text>
										<subclause id="idC14823AEF17942469A76A0FE250DD1FE"><enum>(I)</enum><text>acknowledge
				receipt of the request; and</text>
										</subclause><subclause id="IDa3d0c51e3a7b4f4796053254dbf618b6"><enum>(II)</enum><text>commence a
				review of the waiver request; and</text>
										</subclause></clause><clause id="ID0ca30ff0db63436f9dd8706cfba830e6"><enum>(ii)</enum><text>not later than
				90 days after the date of receipt, notify the Governor and appropriate members
				of the State legislature of the decision of the Secretary on the
				request.</text>
									</clause></subparagraph><subparagraph id="ID40c7639da6df466b8c117b7e25d37217"><enum>(B)</enum><header>Disapproval</header><text>If
				the Secretary disapproves a request for a waiver under this subsection, the
				Secretary shall include with the notice of disapproval the specific safety
				concerns of the Secretary with respect to the highways covered by the
				request.</text>
								</subparagraph><subparagraph id="ID275051d116444d76a5b456da8e19ed13"><enum>(C)</enum><header>Failure to
				Act</header><text>A request for a waiver shall be considered to be approved
				under this subsection if the Secretary fails—</text>
									<clause id="ID01783e4c79df4c2698b46364ee357f5a"><enum>(i)</enum><text>to approve or
				disapprove a request in accordance with subparagraph (A); or</text>
									</clause><clause id="ID0260f77633c24cf8a71993204c0aa4cb"><enum>(ii)</enum><text>to include with
				a notice of disapproval the specific safety concerns of the Secretary as
				required by subparagraph (B).</text>
									</clause></subparagraph></paragraph><paragraph id="ID6072e4770a7949b6af173b0be1a38459"><enum>(4)</enum><header>Data collection
				and review</header>
								<subparagraph id="idD62FF1B749F541DDA8E018AF26245F34"><enum>(A)</enum><header>In
				general</header><text>As a condition of receiving a waiver under this
				subsection, a State transportation department that receives such a waiver
				shall—</text>
									<clause id="IDa6365c3ecbd24cd08daf5c06634135b8"><enum>(i)</enum><text>collect data on
				the effects of the waiver (particularly the effects on accident rates involving
				heavier trucks);</text>
									</clause><clause id="ID84b086467be54a82b61aa8f2d8260a93"><enum>(ii)</enum><text>establish a
				safety committee to review the data; and</text>
									</clause><clause id="IDeb5cd9919eb447cc9dcfa142aefde82a"><enum>(iii)</enum><text>establish rules
				and operating procedures for the program under this section.</text>
									</clause></subparagraph><subparagraph id="IDd1eb7ccb66404c2c83d7850425b2289f"><enum>(B)</enum><header>Safety
				committee</header><text>The safety committee of a State referred to in
				subparagraph (A)(ii) shall—</text>
									<clause id="IDa251a6586024403c80ee3e8370636fd9"><enum>(i)</enum><text>be appointed by
				the Governor of the State;</text>
									</clause><clause id="id41682F2EE6DA4FC7B6EF66D643B9373F"><enum>(ii)</enum><text>at a minimum,
				consist of—</text>
										<subclause id="id9C67AF34AEC340A8BE843D4B3C993940"><enum>(I)</enum><text>1 member of the
				traveling public;</text>
										</subclause><subclause id="id2C79C3A538A445719A053419A48E707A"><enum>(II)</enum><text>1 member from a
				business that uses truck transportation services;</text>
										</subclause><subclause id="id89682AAE116E49799965D6302C1D7D58"><enum>(III)</enum><text>1 commercial
				truck driver;</text>
										</subclause><subclause id="idBFE786576A804952AA1CF38C96465A9E"><enum>(IV)</enum><text>1 professional
				engineer from the State department of transportation; and</text>
										</subclause><subclause id="idECC83AE478C84CF4A9D7BFAC670AD6E2"><enum>(V)</enum><text>1 member of a
				highway safety group; and</text>
										</subclause></clause><clause id="id23782032725C4AB598456762B67A47AE"><enum>(iii)</enum><text>submit to the
				State and the Secretary, for each of the 3 years a waiver received under this
				subsection is in effect, an annual report describing the data reviewed by the
				safety committee during the year covered by the report.</text>
									</clause></subparagraph><subparagraph id="ID3f327ffd61ce4ede86a4e0974a059bdb"><enum>(C)</enum><header>Record of
				approval</header><text>At the end of the 3-year period of the program under
				this subsection, unless the Secretary, with the advice of the safety committee
				of a State established under subparagraph (A)(ii), determines that a waiver
				granted to the State under this subsection has resulted in an adverse impact on
				highway safety in the State and publishes the determination in the Federal
				Register, the waiver provided to the State under this section shall be
				considered to be permanent.</text>
								</subparagraph><subparagraph id="ID38ac385fcb304228aad26e7b4e615572"><enum>(D)</enum><header>Waiver of
				vehicle weight limits</header><text>Notwithstanding section 127(a), a State
				that receives a waiver under this subsection shall not lose any apportionment
				to the State under chapter 1 by reason of noncompliance with any of the vehicle
				weight provisions of section 127 applicable to the use of certain vehicles
				weighing over 80,000 pounds on a
				highway.</text>
								</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="id762D3E0DC95947A29128E631437ABBED"><enum>3.</enum><header>Conforming
			 amendment</header><text display-inline="no-display-inline">The analysis for
			 chapter 4 of title 23, United States Code, is amended by adding at the end the
			 following:</text>
