			</subsection><subsection id="ID62CA1F74B46846C6AB51A37EA24418C3"><enum>(b)</enum><header>Amendment of
			 title 46, united states code</header><text>Except as otherwise expressly
			 provided, whenever in this Act an amendment or repeal is expressed in terms of
			 an amendment to, or a repeal of, a section or other provision, the reference
			 shall be considered to be made to a section or other provision of title 46,
			 United States Code.</text>

			 of system</header><text>Section 50109(d) is amended to read as follows:</text>

				transportation system</header>
						<paragraph id="ID76818EC80C4A42ACA6634306D2DB9E00"><enum>(1)</enum><header>Report on
				waterways</header><text>Not later than July 31, 2012, the Secretary, in
				consultation with the Secretary of Defense and the commanding officer of the
				Army Corps of Engineers, and with the concurrence of the Secretary of the
				department in which the Coast Guard is operating, shall submit a report to the
				Committee on Commerce, Science, and Transportation of the Senate and the
				Committee on Armed Services and the Committee on Transportation and
				Infrastructure of the House of Representatives on the status of the Nation's
				coastal and inland waterways that—</text>
							<subparagraph id="ID4BEF9F93EB5A43E2BA852F99E4A80236"><enum>(A)</enum><text>describes the
				state of the United States marine transportation infrastructure, including
				intercoastal infrastructure, intracoastal infrastructure, inland waterway
				infrastructure, ports, and marine facilities;</text>
							</subparagraph><subparagraph id="ID375D8B6014CC4BA093CC6E4C6F52792A"><enum>(B)</enum><text>provides estimates
				of the investment levels required—</text>
								<clause id="ID0C5E20C13432413FA63153FE30B7E60A"><enum>(i)</enum><text>to maintain the
				infrastructure; and</text>
								</clause><clause id="ID471D19ACBD024EABAA6C389F9F404722"><enum>(ii)</enum><text>to improve the
				infrastructure; and</text>
								</clause></subparagraph><subparagraph id="IDB4CA3B8629F14658AFFCFEE0796460DC"><enum>(C)</enum><text>describes the
				overall environmental management of the maritime transportation system and the
				integration of environmental stewardship into the overall system.</text>
							</subparagraph></paragraph><paragraph id="IDEE00E69E09BF4D88BE6302E1B7D266CF"><enum>(2)</enum><header>Marine
				transportation</header><text>The Secretary may investigate, make determinations
				concerning, and develop a repository of statistical information relating to
				marine transportation, including its relationship to transportation by land and
				air, to facilitate research, assessment, and maintenance of the maritime
				transportation system. As used in this paragraph, the term <term>marine
				transportation</term> includes intercoastal transportation, intracoastal
				transportation, inland waterway transportation, ports, and marine
				facilities.</text>
						</paragraph><paragraph id="ID1475258E8ED048D4AA03F49E5417BFF2"><enum>(3)</enum><header>Authorization of
				appropriations</header><text>There are authorized to be appropriated to the
				Secretary such sums as may be necessary to carry out this
				subsection.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="IDE0EB10D4F4D24258AFD192C1700B6892"><enum>(b)</enum><header>Container-on-barge
			 transportation</header>
				<paragraph id="ID36FB1233C1664E9E9B539F38343E5758"><enum>(1)</enum><header>Assessment and
			 report</header><text>Not later than 6 months after the date of enactment of
			 this Act, the Maritime Administration shall assess the potential for using
			 container-on-barge transportation on the inland waterways system and submit a
			 report, together with the Administration's findings, conclusions, and
			 recommendations, to the Committee on Commerce, Science, and Transportation of
			 the Senate and the Committee on Armed Services and the Committee on
			 Transportation and Infrastructure of the House of Representatives. If the
			 Administration determines that it would be in the public interest, the report
			 may include recommendations for a plan to increase awareness of the potential
			 for use of such container-on-barge transportation and recommendations for the
			 development and implementation of such a plan.</text>
				</paragraph><paragraph id="ID59AECDAF360943E580A82BDC6567D24C"><enum>(2)</enum><header>Factors</header><text>In
			 conducting the assessment, the Administration shall consider—</text>
					<subparagraph id="IDC3D45B5B55A2404BB539B302C1B974B9"><enum>(A)</enum><text>the environmental
			 benefits of increasing container-on-barge movements on our inland and
			 intracoastal waterways system;</text>
					</subparagraph><subparagraph id="IDEFC5ECAB26114089B339C510261DC6AC"><enum>(B)</enum><text>regional
			 differences in the inland waterways system;</text>
					</subparagraph><subparagraph id="ID3C3E5A54A6DC4F07BECCDA37917E51E7"><enum>(C)</enum><text>existing programs
			 established at coastal and Great Lakes ports for establishing awareness of deep
			 sea shipping operations;</text>
					</subparagraph><subparagraph id="IDA9A121E45EFB4283B1FF4C86997A093B"><enum>(D)</enum><text>mechanisms to
			 ensure that implementation of the plan will not be inconsistent with antitrust
			 laws; and</text>
					</subparagraph><subparagraph id="IDE438B11CD68F4A638D4F3CDCAFF2341F"><enum>(E)</enum><text>potential
			 frequency of service at inland river ports.</text>
					</subparagraph></paragraph></subsection></section><section changed="deleted" committee-id="SSCM00" id="ID697F7FEBEC2948B3B55A0DBCED0704D9" reported-display-style="strikethrough"><enum>3.</enum><header>Short sea
			 transportation program amendments</header>
			<subsection id="ID586060244D4A4CE78948574D67749AD8"><enum>(a)</enum><header>Program
			 purpose</header><text>Section 55601(a) is amended by inserting <quote>and to
			 promote more efficient use of the navigable waters of the United States</quote>
			 after <quote>congestion</quote>.</text>
			</subsection><subsection id="IDB4B390CE4E5C4BF9994A12AB8C3BFE67"><enum>(b)</enum><header>Designation of
			 routes</header><text>Section 55601(c) is amended by inserting <quote>and to
			 promote more efficient use of the navigable waters of the United States</quote>
			 after <quote>coastal corridors</quote>.</text>
			</subsection><subsection id="ID8F50372B123241A98CE4EB5F8D8B9C8F"><enum>(c)</enum><header>Project
			 designation</header><text>Section 55601(d) is amended to read as
			 follows:</text>

				congestion; or</text>
						</paragraph><paragraph id="IDC54130676A1844EF9DCC115839E27244"><enum>(2)</enum><text>promotes more
				efficient use of the navigable waters of the United
				States.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="ID1FCA4FABCCF943F1A8CE48A7AB93756C"><enum>(d)</enum><header>Documentation</header><text>Section
			 55605 is amended by striking <quote>by vessel</quote> and inserting <quote>by a
			 documented vessel</quote>.</text>
			</subsection></section><section changed="deleted" committee-id="SSCM00" id="ID37579700B8B2455AB6EA874210894606" reported-display-style="strikethrough"><enum>4.</enum><header>Use of national
			 defense reserve fleet and ready reserve force vessels</header><text display-inline="no-display-inline">Section 11 of the Merchant Ship Sales Act of
			 1946 (50 U.S.C. App. 1744), is amended—</text>
			<paragraph id="IDE9DD565B47B6468F95D28AAC21FE06CD"><enum>(1)</enum><text>in subsection
			 (b)—</text>
				<subparagraph id="ID28E8CADF4A1E49928248301B00C0B361"><enum>(A)</enum><text>by striking
			 <quote>or</quote> in paragraph (4) after the semicolon;</text>
				</subparagraph><subparagraph id="ID0B869008592043AABD7F67C1BA9102AB"><enum>(B)</enum><text>by striking the
			 period at the end of paragraph (5) and inserting <quote>; or</quote>;
			 and</text>
				</subparagraph><subparagraph id="ID66332D37240046DC9A5EEB1ED0E03AE9"><enum>(C)</enum><text>by adding at the
			 end the following:</text>

				</subparagraph></paragraph><paragraph id="ID819892CD46414CCF8A4310B18C776E0F"><enum>(2)</enum><text>by adding at the
			 end the following:</text>

					<subsection id="IDD670E712675D428A937AA3C8707B495A"><enum>(f)</enum><header>Civil
				contingency operations and promotional and media events</header><text>The
				Secretary of Transportation may allow, with the concurrence of the Secretary of
				Defense, the use of a vessel in the National Defense Reserve Fleet for civil
				contingency operations requested by another Federal agency, and for Maritime
				Administration promotional and media events that are related to demonstration
				projects and research and development supporting the Maritime Administration's
				mission, if the Secretary of Transportation determines the use of the vessel is
				in the best interest of the United States Government after—</text>
						<paragraph id="IDDE7DB41F51874272933B711AA1260955"><enum>(1)</enum><text>considering the
				availability of the National Defense Reserve Fleet and Ready Reserve Force
				resources;</text>
						</paragraph><paragraph id="IDF3F63043E1F549B09FE5FB7FCDF7F103"><enum>(2)</enum><text>considering the
				impact on National Defense Reserve Fleet and Ready Reserve Force mission
				support to the defense and homeland security requirements of the United States
				Government;</text>
						</paragraph><paragraph id="ID4223838EADB641DBB8865E1B5A9266C6"><enum>(3)</enum><text>ensuring that the
				use of the vessel supports the mission of the Maritime Administration and does
				not significantly interfere with vessel maintenance, repair, safety, readiness,
				or resource availability;</text>
						</paragraph><paragraph id="IDC2EBBFF8F85B44D9831466E7DE78435F"><enum>(4)</enum><text>ensuring that
				safety precautions are taken, including indemnification of liability, when
				applicable;</text>
						</paragraph><paragraph id="ID58126390C0FA4CAB90A2576863219A10"><enum>(5)</enum><text>ensuring that any
				cost incurred by the use of the vessel is funded as a reimbursable transaction
				between Federal agencies, as applicable; and</text>
						</paragraph><paragraph id="IDA2A52ABF3702498A82781263CB8C9A6B"><enum>(6)</enum><text>considering any
				other factors the Secretary of Transportation determines are
				appropriate.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section changed="deleted" committee-id="SSCM00" id="ID8011D7182CA34573855C17DC4615DAD0" reported-display-style="strikethrough"><enum>5.</enum><header>Green ships
			 program</header>
			<subsection id="ID7F399BED099444C29BF8DB49CB345E1E"><enum>(a)</enum><header>In
			 general</header><text>Chapter 503 is amended by adding at the end the
			 following:</text>

					<section id="IDC427C2D78DA44A2197C72E8074669823"><text>§ 50307. Green ships
				program</text>
						<subsection id="ID601585277EF9499B966A3CB76A52025C"><enum>(a)</enum><header>In
				general</header><text>The Secretary of Transportation may establish a green
				ships program to engage in the environmental study, research, development,
				assessment, and deployment of emerging marine technologies through the use of
				public vessels under the control of the Maritime Administration or private
				vessels under United States registry, and through partnerships and cooperative
				efforts with academic, public, private, and non-governmental entities.</text>
						</subsection><subsection id="IDE4DA6179542B4C93B3BF190B3EEC1EF9"><enum>(b)</enum><header>Program
				requirements</header><text>The program—</text>
							<paragraph id="ID90BD5E74816942989A1ECADAFCB5D12B"><enum>(1)</enum><text>shall identify,
				evaluate, test, demonstrate, or improve emerging marine technologies that are
				likely to achieve environmental improvements—</text>
								<subparagraph id="ID232655190F3748E0AF726F81FF2E5814"><enum>(A)</enum><text>by reducing air
				emissions, water emissions, or other ship discharges;</text>
								</subparagraph><subparagraph id="ID8ED66C78577E4A0E948634DBDB20E044"><enum>(B)</enum><text>by increasing fuel
				economy or the use of alternative fuels; or</text>
								</subparagraph><subparagraph id="IDA0B2468F8E7340388410D84F9B638932"><enum>(C)</enum><text>by controlling
				aquatic invasive species; and</text>
								</subparagraph></paragraph><paragraph id="IDB0607BC8BAFA4B38AA6D7C54D46BE235"><enum>(2)</enum><text>shall be
				coordinated with the Environmental Protection Agency, the United States Coast
				Guard, and other Federal, State, local, or tribal agencies, as
				appropriate.</text>
							</paragraph></subsection><subsection id="ID148AA500B87A4BF4AFBB55D71DDCD49D"><enum>(c)</enum><header>Program
				coordination</header><text>Program coordination under subsection (b)(2) may
				include—</text>
							<paragraph id="ID1B497233730043918A0704AAB831FB99"><enum>(1)</enum><text>activities that
				are associated with the development or approval of validation and testing
				regimes; and</text>
							</paragraph><paragraph id="ID100C2DD70EB34E628EB67A2E2277A687"><enum>(2)</enum><text>certification or
				validation of emerging technologies that demonstrate significant environmental
				benefits.</text>
							</paragraph></subsection><subsection id="IDFFFE014AA306409AA22C96CA21A404CE"><enum>(d)</enum><header>Funding and
				fees</header>
							<paragraph id="IDF90969ED5A0A49B1BBB18FD9F3868902"><enum>(1)</enum><header>In
				general</header><text>In carrying out the green ships program, the Secretary of
				Transportation may apply such funds as may be appropriated and such funds or
				resources as may become available by gift, cooperative agreement, or otherwise,
				including the collection of fees, for the purposes of the program and its
				administration.</text>
							</paragraph><paragraph id="ID29D8061B4BC446E18AB0120F8D27E5D4"><enum>(2)</enum><header>Establishment of
				fees</header><text>Pursuant to section 9701 of title 31, the Secretary of
				Transportation may promulgate regulations establishing fees to recover
				reasonable costs to the Secretary and to academic, public, and non-governmental
				entities associated with the program.</text>
							</paragraph><paragraph id="ID21FB3BC57E3A4E77B47BDF4630482C54"><enum>(3)</enum><header>Fee
				deposit</header><text>Any fees collected under this section shall be deposited
				in a special fund of the United States Treasury for services rendered under the
				program, which thereafter shall remain available until expended to carry out
				the Secretary of Transportation's activities for which the fees were
				collected.</text>
							</paragraph></subsection><subsection id="ID45EDAE869176465BAA1294DDAC8D26EA"><enum>(e)</enum><header>Report</header><text>The
				Secretary of Transportation shall report on the activities, expenditures, and
				results of the green ships program during the preceding fiscal year in the
				annual budget submission to
				Congress.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="IDF26AD2B9DD284CD1AECBB74C7E833701"><enum>(b)</enum><header>Conforming
			 amendment</header><text>The table of contents for chapter 503 is amended by
			 inserting after the item relating to section 50306 the following:</text>

			 national defense reserve fleet vessels</header><text display-inline="no-display-inline">Section 113(e)(15) of title 40, United
			 States Code, is amended to read as follows:</text>

				Administration with respect to the acquisition, procurement, operation,
				maintenance, preservation, sale, lease, charter, construction, reconstruction,
				reconditioning (including outfitting and equipping incidental to construction,
				reconstruction, or reconditioning), or disposal for recycling (including
				related contracts for towing, dry-docking, sale or purchase of services for
				recycling, and vessel management), of a merchant vessel or shipyard, ship site,
				terminal, pier, dock, warehouse, or other installation necessary or appropriate
				for carrying out a program of the Administration authorized by law or
				non-administrative activities incidental to a program of the Administration
				authorized by law, but the Administration shall, to the maximum extent it
				considers practicable, consistent with the purposes of its programs and the
				effective, efficient conduct of its activities, coordinate its operations with
				the requirements of this subtitle and with policies and regulations prescribed
				under this
				subtitle;</text>
				</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section changed="deleted" committee-id="SSCM00" id="IDADCD8D799BA04D2B852184F7568E5BF3" reported-display-style="strikethrough"><enum>7.</enum><header>Ship scrapping
			 reporting requirement</header><text display-inline="no-display-inline">Section
			 3502 of the Floyd D. Spence National Defense Authorization Act for Fiscal Year
			 2001 (enacted into law by section 1 of Public Law 106–398; 16 U.S.C. 5405 note;
			 114 Stat. 1654A–490) is amended by amending subsection (f) to read as
			 follows:</text>

				<subsection id="IDCFD2234CEED14014A98A907B554AA6BC"><enum>(f)</enum><text>The Secretary of
				Transportation shall provide briefings, upon request, to the Committee on
				Commerce, Science, and Transportation and the Committee on Armed Forces of the
				Senate and the Committee on Transportation and Infrastructure, the Committee on
				Resources, and the Committee on Armed Forces of the House of Representatives
				on—</text>
					<paragraph id="IDD267B51755FD41E096F4F9A6C1910193"><enum>(1)</enum><text>the progress made
				to recycle vessels;</text>
					</paragraph><paragraph id="ID61A34F6CE1AF428980F3B9CD042D800C"><enum>(2)</enum><text>any problems
				encountered in recycling vessels; and</text>
					</paragraph><paragraph id="ID6FFEB2AA80924990ACF67C861702F9F7"><enum>(3)</enum><text>any other issues
				relating to vessel recycling and
				disposal.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

				years of age if the vessel is a tank vessel, or is less than 25 years of age

				2014, is covered by an operating agreement under this
				chapter.</text>

				</paragraph></subsection><subsection id="IDC932806D14B94F4E9A636F1A51828EEA"><enum>(b)</enum><text>Section 53102(b)
			 is amended to read as follows:</text>

				the requirements of paragraph (1), (2), (3), or (4) of subsection (c);</text>
						</paragraph><paragraph id="IDF6758C640E604200A94918F38CA0BDC6"><enum>(2)</enum><text>the vessel is
				operated (or in the case of a vessel to be constructed, will be operated) in
				providing transportation in foreign commerce;</text>
						</paragraph><paragraph id="IDDF1FCB6FF0DC4447A17C04F78BC1AA40"><enum>(3)</enum><text>the vessel is
				self-propelled and—</text>
							<subparagraph id="IDC7BC5565F88E4523989DB3621D1CDDCA"><enum>(A)</enum><text>is a tank vessel
				that is 10 years of age or less on the date the vessel is included in the
				Fleet; or</text>
							</subparagraph><subparagraph id="ID279370418E5E4202BD4C3F98F5DC7D9E"><enum>(B)</enum><text>is any other type
				of vessel that is 15 years of age or less on the date the vessel is included in
				the Fleet;</text>
							</subparagraph></paragraph><paragraph id="ID09360025B48B49949DC9E6F5479EC871"><enum>(4)</enum><text>the vessel—</text>
							<subparagraph id="ID530582197337485292E359F6007DDF1B"><enum>(A)</enum><text>is suitable for
				use by the United States for national defense or military purposes in time of
				war or national emergency, as determined by the Secretary of Defense;
				and</text>
							</subparagraph><subparagraph id="ID2C1702BFC877479D8CC5041ECB53E9EA"><enum>(B)</enum><text>is commercially
				viable, as determined by the Secretary; and</text>
							</subparagraph></paragraph><paragraph id="ID3C46EB5AA9204F61AB14E19FD16B43D8"><enum>(5)</enum><text>the vessel—</text>
							<subparagraph id="ID3BDC8215778D42EC840DE85B103D008D"><enum>(A)</enum><text>is a United
				States-documented vessel; or</text>
							</subparagraph><subparagraph id="IDC5312ABB2C0F4B0780DE85F6092B672C"><enum>(B)</enum><text>is not a United
				States-documented vessel, but—</text>
								<clause id="ID05EF6BD6BBE64385BC946176E9BD7764"><enum>(i)</enum><text>the owner of the
				vessel has demonstrated an intent to have the vessel documented under chapter
				121 of this title if it is included in the Fleet; and</text>
								</clause><clause id="IDEE38B48117D547BD83066C27AF22CDE2"><enum>(ii)</enum><text>at the time an
				operating agreement for the vessel is entered into under this chapter, the
				vessel is eligible for documentation under chapter 121 of this
				title.</text>
								</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="IDFD161D4D3A82406BB1CCA6D6019342BE"><enum>(c)</enum><text>Section 53103 is
			 amended—</text>
				<paragraph id="ID7974CDD580F74C86B1E9B1B5FB171D26"><enum>(1)</enum><text>by amending
			 subsection (b) to read as follows:</text>

				Existing Operating Agreements.—The Secretary is authorized to amend an
				operating agreement that is in existence on December 31, 2014, for a
				participating fleet vessel, or any subsequent replacement of the participating
				fleet vessel, to extend the operating agreement through September 30, 2025. The
				terms and conditions of the extended operating agreement shall include terms
				and conditions authorized under this chapter, as amended from time to time. If
				a contractor does not agree to an extended operating agreement before February
				28, 2015, the Secretary may award the operating agreement to another
				contractor. Beginning on February 28, 2015, operating agreements shall not be
				transferable by the contractor.</text>
						</subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="ID0A69F2487E0F4158B8EDBC34B423380C"><enum>(2)</enum><text>by amending
			 subsection (c) to read as follows:</text>
					<quoted-block changed="deleted" committee-id="SSCM00" display-inline="no-display-inline" id="IDDAA7023EC6574C8C802D63218CFA277C" reported-display-style="strikethrough" style="OLC">
						<subsection id="IDC1AE4208FB9546CF8537B5787F98D88D"><enum>(c)</enum><header>Procedure for
				awarding new operating agreements</header><text>The Secretary may enter into a
				new operating agreement with an applicant that meets the requirements of
				section 53102(c) (for vessels that meet the qualifications of section 53102(b))
				on the basis of priority for vessel type established by military requirements
				of the Secretary of Defense. The Secretary shall allow an applicant at least 30
				days to submit an application for a new operating agreement. After
				consideration of military requirements, priority shall be given to an applicant
				that is a U.S. citizen under section 50501 of this title. The Secretary may not
				approve an application without the consent of the Secretary of Defense. The
				Secretary shall enter into an operating agreement with the applicant or provide
				a written reason for denying the
				application.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="IDF32540B79DDB44A5A071DBCE26E60C58"><enum>(d)</enum><text>Section 53104 is
			 amended—</text>
				<paragraph id="ID654FE4741B2E4ACB9964F1398204A31E"><enum>(1)</enum><text>in subsection (c),
			 by striking paragraph (3); and</text>

				</paragraph></subsection><subsection id="IDD1F2FDCCEF85454F9E2F430ACDAF2E9B"><enum>(f)</enum><text>Section 53106 is
			 amended—</text>

			 contents for chapter 531 is amended by striking the item relating to section
			 53109.</text>
			</subsection><subsection id="IDAC1393A91E894AC2902569C046DF165D"><enum>(j)</enum><text>Section 53111 is
			 amended by striking <quote>and (3) $186,000,000 for each fiscal year thereafter
			 through fiscal year 2025.</quote> and inserting the following:</text>

			 amended by adding at the end the following:</text>

						<subsection id="ID9FE654DCF30A41369023A821A59072B8"><enum>(a)</enum><header>In
				general</header><text>Notwithstanding section 2218(f) of title 10, United
				States Code, upon replacement of any vessel subject to an operating agreement
				under this chapter, and subject to agreement by the vessel owner, the Secretary
				is authorized, subject to concurrence with the Secretary of Defense, to acquire
				the vessel being replaced for inclusion in the National Defense Reserve
				Fleet.</text>
						</subsection><subsection id="ID2CA4C37F7966483889316CBB4139EDB7"><enum>(b)</enum><header>Requirements</header><text>In
				order to be eligible for acquisition by the Secretary under this section, a
				vessel shall—</text>
							<paragraph id="IDEAC00047310947F2AD471A6E0368512A"><enum>(1)</enum><text>have been included
				in a Maritime Security Program Operating Agreement for not less than 3 years;
				and</text>
							</paragraph><paragraph id="ID3CA78F7594114655BB0CD85A5C10222F"><enum>(2)</enum><text>meet
				recapitalization requirements for the Ready Reserve Force.</text>
							</paragraph></subsection><subsection id="ID4830993B4C2E4C238D9855AF918F330B"><enum>(c)</enum><header>Fair market
				value</header><text>The Maritime Administration shall establish a fair market
				value for the acquisition of an eligible vessel under this section.</text>
						</subsection><subsection id="ID2747DB6C8F8C479FA07CA3EA7B8BF593"><enum>(d)</enum><header>Appropriations</header><text>A
				vessel acquisition under this section shall be subject to the availability of
				appropriations and the appropriations shall be part of the National Defense
				Reserve Fleet appropriations and separate from Maritime Security Program
				appropriations.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="ID1425C47A742542ABB2E5FA61A31048E6"><enum>(l)</enum><header>Effective date
			 of amendments</header><text>The amendments made by—</text>
				<paragraph id="IDB5B3AAFA46AD4E5D9BC77DC31DEB98E2"><enum>(1)</enum><text>paragraphs (2),
			 (3), and (4) of section 8(a) of this Act take effect on December 31,
			 2014;</text>
				</paragraph><paragraph id="ID2DD1B535AC934498A6110A6F38622162"><enum>(2)</enum><text>section 8(c)(1) of
			 this Act take effect on December 31, 2014; and</text>
				</paragraph><paragraph id="ID4C2A214AD033409FA9D03CC0C7712F39"><enum>(3)</enum><text>section 8(f)(2) of
			 this Act take effect on December 31, 2014.</text>
				</paragraph></subsection></section><section changed="deleted" committee-id="SSCM00" id="ID368CF3EA12E141A6B369EF90D0046E59" reported-display-style="strikethrough"><enum>9.</enum><header>Maritime
			 workforce study</header>
			<subsection id="IDEB2461F872E54B90A981A02184D24418"><enum>(a)</enum><header>Training
			 study</header><text>The Comptroller General of the United States shall conduct
			 a study on the training needs of the maritime workforce.</text>
			</subsection><subsection id="ID76BE6B40754840C1810DEBAC325E9F59"><enum>(b)</enum><header>Study
			 components</header><text>The study shall—</text>
				<paragraph id="ID81A2751833E74B0EB00774171FF62C41"><enum>(1)</enum><text>analyze the impact
			 of training requirements imposed by domestic and international regulations and
			 conventions, companies, and government agencies that charter or operate
			 vessels;</text>
				</paragraph><paragraph id="ID0D11D64C9F544CB38EABDBE9F9047B7A"><enum>(2)</enum><text>evaluate the
			 ability of the Nation's maritime training infrastructure to meet the current
			 needs of the maritime industry;</text>
				</paragraph><paragraph id="IDB474001E4235443181E62AD4F8FD62C1"><enum>(3)</enum><text>evaluate the
			 ability of the Nation's maritime training infrastructure to effectively meet
			 the needs of the maritime industry in the future;</text>
				</paragraph><paragraph id="IDF3758A9287C64EFB97FCA7656AF5EBCA"><enum>(4)</enum><text>identify trends in
			 maritime training;</text>
				</paragraph><paragraph id="ID86FEAC219B8A4DC19269E2331B47C818"><enum>(5)</enum><text>compare the
			 training needs of U.S. mariners with the vocational training and educational
			 assistance programs available from Federal agencies to evaluate the ability of
			 Federal programs to meet the training needs of U.S. mariners;</text>
				</paragraph><paragraph id="ID1B1F84BDBC83430BB04AF603B958BA8B"><enum>(6)</enum><text>include
			 recommendations for future programs to enhance the capabilities of the Nation's
			 maritime training infrastructure; and</text>
				</paragraph><paragraph id="ID13257F4543E44784B0F3F0502BFC3865"><enum>(7)</enum><text>include
			 recommendations for future programs to assist U.S. mariners and those entering
			 the maritime profession achieve the required training.</text>
				</paragraph></subsection><subsection id="IDBECD213AA4D149E5823234D6011C5CEB"><enum>(c)</enum><header>Final
			 report</header><text>Not later than 1 year after the date of enactment of this
			 Act, the Comptroller General shall submit a report on the results of the study
			 to the Committee on Commerce, Science, and Transportation of the Senate and the
			 Committee on Transportation and Infrastructure of the House of
			 Representatives.</text>
			</subsection></section><section changed="deleted" committee-id="SSCM00" id="IDF6CAC57CDCC447F08C122BF391A9A31A" reported-display-style="strikethrough"><enum>10.</enum><header>Authorization of
			 appropriations for fiscal year 2012</header><text display-inline="no-display-inline">There are authorized to be appropriated to
			 the Secretary of Transportation for programs of the Maritime Administration the
			 following amounts:</text>

			 training</header><text>For expenses necessary for operations and training
			 activities, not to exceed $161,539,000 for the fiscal year ending September 30,

			 capital improvements at the U.S. Merchant Marine Academy, to remain available
			 until expended; and</text>
				</subparagraph><subparagraph id="ID5937279943C648BEA82296FD3E4B09EA"><enum>(B)</enum><text>$11,100,000 is for
			 maintenance and repair for training ships at State Maritime Schools, to remain
			 available until expended.</text>
				</subparagraph></paragraph><paragraph id="IDD22EE6FFEE564698914A4CCEA7BD4CD9"><enum>(2)</enum><header>Maritime
			 guaranteed loans</header><text>For administrative expenses related to loan
			 guarantee commitments under chapter 537 of title 46, United States Code, not to
			 exceed $3,750,000, which shall be paid to the appropriation for
			 <quote>Operations and Training</quote>, Maritime Administration.</text>

				consultation with the Secretary of Defense and the commanding officer of the
				Army Corps of Engineers, and with the concurrence of the Secretary of the
				department in which the Coast Guard is operating, shall submit a report to the
				Committee on Commerce, Science, and Transportation of the Senate and the
				Committee on Armed Services and the Committee on Transportation and
				Infrastructure of the House of Representatives on the status of the Nation's
				coastal and inland waterways that—</text>
							<subparagraph id="ID775AC5E5DB634A75AF5E9173C629CB2A"><enum>(A)</enum><text>describes the state of
				the United States' marine transportation infrastructure, including intercoastal
				infrastructure, intracoastal infrastructure, inland waterway infrastructure,
				ports, and marine facilities;</text>
							</subparagraph><subparagraph id="IDF3C6BA6BA9F0469AB62751902C6FAB7D"><enum>(B)</enum><text>provides estimates of the
				investment levels required—</text>
								<clause id="ID065012865B7D425594FAFC80BBAEC46C"><enum>(i)</enum><text>to maintain the
				infrastructure; and</text>
								</clause><clause id="IDE330CA1B6F7E47488D5679B73DA1D65D"><enum>(ii)</enum><text>to improve the
				infrastructure; and</text>
								</clause></subparagraph><subparagraph id="ID0CA550E4ACBB4B48A3C48F8B68D8DD3E"><enum>(C)</enum><text>describes the overall
				environmental management of the maritime transportation system and the
				integration of environmental stewardship into the overall system.</text>
							</subparagraph></paragraph><paragraph id="IDE526AE0618104DFD940070F8857835C6"><enum>(2)</enum><header>Marine
				transportation</header><text>The Secretary may investigate, make determinations
				concerning, and develop a repository of statistical information relating to
				marine transportation, including its relationship to transportation by land and
				air, to facilitate research, assessment, and maintenance of the maritime
				transportation system. As used in this paragraph, the term <term>marine
				transportation</term> includes intercoastal transportation, intracoastal
				transportation, inland waterway transportation, ports, and marine
				facilities.</text>
						</paragraph><paragraph id="IDDDE4CD4995B545A08CC587A0FD8127BB"><enum>(3)</enum><header>Authorization of
				appropriations</header><text>There are authorized to be appropriated to the
				Secretary such sums as may be necessary to carry out this
				subsection.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="ID8CC654E055EA4B69BA392BB7749A08F4"><enum>(b)</enum><header>Container-on-barge
			 transportation</header>
				<paragraph id="ID128F14F17E6B4FBA96A4166A6A624CC9"><enum>(1)</enum><header>Assessment and
			 report</header><text>Not later than 6 months after the date of enactment of
			 this Act, the Maritime Administration shall assess the potential for using
			 container-on-barge transportation on the inland waterways system and submit a
			 report, together with the Administration's findings, conclusions, and
			 recommendations, to the Committee on Commerce, Science, and Transportation of
			 the Senate and the Committee on Armed Services and the Committee on
			 Transportation and Infrastructure of the House of Representatives. If the
			 Administration determines that it would be in the public interest, the report
			 may include recommendations for a plan to increase awareness of the potential
			 for use of such container-on-barge transportation and recommendations for the
			 development and implementation of such a plan.</text>
				</paragraph><paragraph id="IDD7738D25B2A24640ADCAA95645D7FCD7"><enum>(2)</enum><header>Factors</header><text>In
			 conducting the assessment, the Administration shall consider—</text>
					<subparagraph id="IDD1F67302E9D1474FAABD2987BFE3E4C6"><enum>(A)</enum><text>the environmental
			 benefits of increasing container-on-barge movements on our inland and
			 intracoastal waterways system;</text>
					</subparagraph><subparagraph id="IDC7BB467237004366B0AEB4483DE00E3F"><enum>(B)</enum><text>regional differences in
			 the inland waterways system;</text>
					</subparagraph><subparagraph id="IDB0DC2DA3EDBB428E88EB8B1EE9EFD966"><enum>(C)</enum><text>existing programs
			 established at coastal and Great Lakes ports for establishing awareness of deep
			 sea shipping operations;</text>
					</subparagraph><subparagraph id="ID88DBDC31216C42CD9511BF0B8EFA84A0"><enum>(D)</enum><text>mechanisms to ensure that
			 implementation of the plan will not be inconsistent with antitrust laws;
			 and</text>
					</subparagraph><subparagraph id="ID70E5ECF4D2F649EDB658F66BC951FC97"><enum>(E)</enum><text>potential frequency of
			 service at inland river ports.</text>

				the Secretary of Transportation determines the use of the vessel is in the best
				interest of the United States Government after—</text>
						<paragraph id="IDA2C691BC141C4B8C88E1B5A609FBACEE"><enum>(1)</enum><text>considering the
				availability of the National Defense Reserve Fleet and Ready Reserve Force
				resources;</text>
						</paragraph><paragraph id="ID21CC7602D7D14FE4AE78FD5871094CD8"><enum>(2)</enum><text>considering the impact on
				National Defense Reserve Fleet and Ready Reserve Force mission support to the
				defense and homeland security requirements of the United States
				Government;</text>
						</paragraph><paragraph id="ID2C28502EF16F487BA30A5E0E731F53BB"><enum>(3)</enum><text>ensuring that the use of
				the vessel supports the mission of the Maritime Administration and does not
				significantly interfere with vessel maintenance, repair, safety, readiness, or
				resource availability;</text>
						</paragraph><paragraph id="IDD36FCD5A6B8B4738B9E325A0F665D93C"><enum>(4)</enum><text>ensuring that safety
				precautions are taken, including indemnification of liability, when
				applicable;</text>
						</paragraph><paragraph id="ID93966E74EAA94CEAB20B199520F1D7B0"><enum>(5)</enum><text>ensuring that any cost
				incurred by the use of the vessel is funded as a reimbursable transaction
				between Federal agencies, as applicable; and</text>
						</paragraph><paragraph id="IDCDABC3D04F7046C3B0F44DB9A71078FA"><enum>(6)</enum><text>considering any other
				factors the Secretary of Transportation determines are
				appropriate.</text>

			 program</header>

						<subsection id="id284DB0CF676D4D589FBEA82448661287"><enum><added-phrase reported-display-style="italic">(a)</added-phrase></enum><header>In
				general</header><text>The Secretary of Transportation may establish a green
				ships program to engage in the environmental study, research, development,
				assessment, and deployment of emerging marine technologies and practices
				related to the marine transportation system through the use of public vessels
				under the control of the Maritime Administration or private vessels under
				United States registry, and through partnerships and cooperative efforts with
				academic, public, private, and non-governmental entities and facilities.</text>
						</subsection><subsection id="id393545867C3349788E1EF2B6C16421ED"><enum>(b)</enum><header>Program
				requirements</header><text>The program shall—</text>
							<paragraph id="idE833709505C94B89B0CD73884F46416E"><enum><added-phrase reported-display-style="italic">(1)</added-phrase></enum><text>identify, study,
				evaluate, test, demonstrate, or improve emerging marine technologies and
				practices that are likely to achieve environmental improvements by—</text>
								<subparagraph id="id983F273B79AB403187C2DFBDF17146F8"><enum><added-phrase reported-display-style="italic">(A)</added-phrase></enum><text>reducing air
				emissions, water emissions, or other ship discharges;</text>
								</subparagraph><subparagraph id="idF1D54EFAD6D941C1A15EA2CC53BF3F4B"><enum>(B)</enum><text>increasing fuel economy
				or the use of alternative fuels and alternative energy (including the use of
				shore power); or</text>
								</subparagraph><subparagraph id="id3AF8650779294D249C62EA9F508B9C26"><enum>(C)</enum><text>controlling aquatic
				invasive species; and</text>
								</subparagraph></paragraph><paragraph id="id0261CBA376E94751B77E23AAA4327A15"><enum><added-phrase reported-display-style="italic">(2)</added-phrase></enum><text>be coordinated
				with the Environmental Protection Agency, the United States Coast Guard, and
				other Federal, State, local, or tribal agencies, as appropriate.</text>
							</paragraph></subsection><subsection id="id573D243431BA4FCDBF53E2E4039EBBE4"><enum><added-phrase reported-display-style="italic">(c)</added-phrase></enum><header>Program
				coordination</header><text>Program coordination under subsection (b)(2) may
				include—</text>
							<paragraph id="id7D8FDC24202D40BDB9CD60030283503F"><enum><added-phrase reported-display-style="italic">(1)</added-phrase></enum><text>activities that
				are associated with the development or approval of validation and testing
				regimes; and</text>
							</paragraph><paragraph id="id085FC7C1DF214B12884883C67DAD008A"><enum>(2)</enum><text>certification or
				validation of emerging technologies or practices that demonstrate significant
				environmental benefits.</text>
							</paragraph></subsection><subsection id="ID27E38A319C374CDC8E7AE47BDDD3F0D3"><enum>(d)</enum><header>Funding and
				fees</header>
							<paragraph id="ID8A4D7258617B4B8D9E6E8245B78D1ED5"><enum>(1)</enum><header>In
				general</header><text>In carrying out the green ships program, the Secretary of
				Transportation may apply such funds as may be appropriated and such funds or
				resources as may become available by gift, cooperative agreement, or otherwise,
				including the collection of fees, for the purposes of the program and its
				administration.</text>
							</paragraph><paragraph id="ID4F88933E7E1B4D35B171547832A887BF"><enum>(2)</enum><header>Establishment of
				fees</header><text>Pursuant to section 9701 of title 31, the Secretary of
				Transportation may promulgate regulations establishing fees to recover
				reasonable costs to the Secretary and to academic, public, and non-governmental
				entities associated with the program.</text>
							</paragraph><paragraph id="IDD1D3745FF7CE4511A0C8C19906EA2FEE"><enum>(3)</enum><header>Fee
				deposit</header><text>Any fees collected under this section shall be deposited
				in a special fund of the United States Treasury for services rendered under the
				program, which thereafter shall remain available until expended to carry out
				the Secretary of Transportation's activities for which the fees were
				collected.</text>
							</paragraph></subsection><subsection id="ID555FB38F9E2C477A9DE92C18929994E3"><enum>(e)</enum><header>Report</header><text>The
				Secretary of Transportation shall report on the activities, expenditures, and
				results of the green ships program during the preceding fiscal year in the
				annual budget submission to
				Congress.</text>

					<subsection id="ID0235C3CD92FC454A8E5F8E7353ED231C"><enum>(b)</enum><header>Vessel
				eligibility</header><text>A vessel is eligible to be included in the Fleet
				if—</text>
						<paragraph id="ID9EE85D2081264771A9F245EB2B87BFE9"><enum>(1)</enum><text>the vessel meets the
				requirements of paragraph (1), (2), (3), or (4) of subsection (c);</text>
						</paragraph><paragraph id="IDA83AF4904BA14B9EB5C39BDBD1239D10"><enum>(2)</enum><text>the vessel is operated
				(or in the case of a vessel to be constructed, will be operated) in providing
				transportation in foreign commerce;</text>
						</paragraph><paragraph id="IDC29000082AF4415881C4292EFF1305B0"><enum>(3)</enum><text>the vessel is
				self-propelled and—</text>
							<subparagraph id="ID5E3183F6D4134FACA6D114FDE8B78DEE"><enum>(A)</enum><text>is a tank vessel that is
				10 years of age or less on the date the vessel is included in the Fleet;
				or</text>
							</subparagraph><subparagraph id="ID7B6108737198444B91D0C7960116EECA"><enum>(B)</enum><text>is any other type of
				vessel that is 15 years of age or less on the date the vessel is included in
				the Fleet;</text>
							</subparagraph></paragraph><paragraph id="IDD17D35C0CED9423D9FA5504527F99920"><enum>(4)</enum><text>the vessel—</text>
							<subparagraph id="ID4BBCC8E4144E4137A3B415348267F2FF"><enum>(A)</enum><text>is suitable for use by
				the United States for national defense or military purposes in time of war or
				national emergency, as determined by the Secretary of Defense; and</text>
							</subparagraph><subparagraph id="ID33058F84ED7C4DF3A71DFA4443D663A3"><enum>(B)</enum><text>is commercially viable,
				as determined by the Secretary; and</text>
							</subparagraph></paragraph><paragraph id="ID775AE5BCC0044FC3A86F81DE155D12F2"><enum>(5)</enum><text>the vessel—</text>
							<subparagraph id="IDBDE8E34DC3B6449C8FEBC614D04EE2A7"><enum>(A)</enum><text>is a United
				States-documented vessel; or</text>
							</subparagraph><subparagraph id="IDE1DC4B4D71264F278B04BD5FD04D2833"><enum>(B)</enum><text>is not a United
				States-documented vessel, but—</text>
								<clause id="ID96EA498B2D02472894A7056F218E9665"><enum>(i)</enum><text>the owner of the vessel
				has demonstrated an intent to have the vessel documented under chapter 121 of
				this title if it is included in the Fleet; and</text>
								</clause><clause id="ID58D62319844D45459C9EDBF10B0ADBE4"><enum>(ii)</enum><text>at the time an operating
				agreement for the vessel is entered into under this chapter, the vessel is
				eligible for documentation under chapter 121 of this
				title.</text>
								</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="ID144230F240844DABA61C9061A66DCCCE"><enum>(c)</enum><text>Section 53103 is
			 amended—</text>
				<paragraph id="IDCA60B3480473415C9C2BAD10CC688ECE"><enum>(1)</enum><text>by amending subsection
			 (b) to read as follows:</text>
					<quoted-block changed="added" committee-id="SSCM00" display-inline="no-display-inline" id="ID2EB7AAB18A3145B9BBBB97AEC9329E0C" reported-display-style="italic" style="OLC">
						<subsection id="IDA2102BCFF09E466CA3A355C4C7A2FE29"><enum>(b)</enum><header>Extension of existing
				operating agreements</header>
							<paragraph id="ID9929D45CCBA643D1B8B91B762D576548"><enum>(1)</enum><header>Offer to
				extend</header><text>Not later than 60 days after the date of enactment of the
				Maritime Administration Authorization Act for Fiscal Year 2012, the Secretary
				shall offer, to an existing contractor, to extend, through September 30, 2025,
				an operating agreement that is in existence on the date of enactment of that
				Act. The terms and conditions of the extended operating agreement shall include
				terms and conditions authorized under this chapter, as amended from time to
				time.</text>
							</paragraph><paragraph id="IDE1FE4772779E4B0992670B05E73F4A7D"><enum>(2)</enum><header>Time
				limit</header><text>An existing contractor shall have not later than 120 days
				after the date the Secretary offers to extend an operating agreement to agree
				to the extended operating agreement.</text>
							</paragraph><paragraph id="ID3BB9FC8D02E24CB1AF0D4233BF99188F"><enum>(3)</enum><header>Subsequent
				award</header><text>The Secretary may award an operating agreement to an
				applicant that is eligible to enter into an operating agreement for fiscal
				years 2016 through 2025 if the existing contractor does not agree to the
				extended operating agreement under paragraph
				(2).</text>
							</paragraph></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="ID9C6C51628F884A9EA0609DBF0CB9F50C"><enum>(2)</enum><text>by amending subsection
			 (c) to read as follows:</text>
					<quoted-block changed="added" committee-id="SSCM00" display-inline="no-display-inline" id="ID3F47C1E5A81743A2A0AA3359F255F22A" reported-display-style="italic" style="OLC">
						<subsection id="ID12B14B2E1D5D4E4796CFD3947BE36FF4"><enum>(c)</enum><header>Procedure for awarding
				new operating agreements</header><text>The Secretary may enter into a new
				operating agreement with an applicant that meets the requirements of section
				53102(c) (for vessels that meet the qualifications of section 53102(b)) on the
				basis of priority for vessel type established by military requirements of the
				Secretary of Defense. The Secretary shall allow an applicant at least 30 days
				to submit an application for a new operating agreement. After consideration of
				military requirements, priority shall be given to an applicant that is a U.S.
				citizen under section 50501 of this title. The Secretary may not approve an
				application without the consent of the Secretary of Defense. The Secretary
				shall enter into an operating agreement with the applicant or provide a written
				reason for denying the
				application.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="ID5D73F24A121841169819A306A39500FB"><enum>(d)</enum><text>Section 53104 is
			 amended—</text>
				<paragraph id="ID460AFD26FEDD4964999CEF36C34C1269"><enum>(1)</enum><text>in subsection (c), by
			 striking paragraph (3); and</text>
				</paragraph><paragraph id="ID6272F66C1A4C4659957C8374B7082217"><enum>(2)</enum><text>in subsection (e), by
			 striking <quote>an operating agreement under this chapter is terminated under
			 subsection (c)(3), or if</quote>.</text>
				</paragraph></subsection><subsection id="IDBE597EF5BBA94A08A659DF641F8982EE"><enum>(e)</enum><text>Section 53105 is
			 amended—</text>
				<paragraph id="ID8CD1D33191A54815B5E19E572E3BE575"><enum>(1)</enum><text>by amending subsection
			 (e) to read as follows:</text>

				agreements</header><text>A contractor under an operating agreement may transfer
				the agreement (including all rights and obligations under the operating
				agreement) to any person that is eligible to enter into the operating agreement
				under this chapter if the Secretary and the Secretary of Defense determine that
				the transfer is in the best interests of the United States. A transaction shall
				not be considered a transfer of an operating agreement if the same legal entity
				with the same vessels remains the contracting party under the operating
				agreement.</text>
						</subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="ID51542690826844B586BC365ACFAAF3E1"><enum>(2)</enum><text>by amending subsection
			 (f) to read as follows:</text>
					<quoted-block changed="added" committee-id="SSCM00" display-inline="no-display-inline" id="ID4FCD5870A1704126AC38883A576FA058" reported-display-style="italic" style="OLC">
						<subsection id="IDEDB02BC931154F3B9B5FA7C2F7FE15F5"><enum>(f)</enum><header>Replacement
				vessels</header><text>A contractor may replace a vessel under an operating
				agreement with another vessel that is eligible to be included in the Fleet
				under section 53102(b), if the Secretary, in conjunction with the Secretary of
				Defense, approves the replacement of the
				vessel.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="ID0187C9C15C3D47CD842895BEE948E498"><enum>(f)</enum><text>Section 53106 is
			 amended—</text>
				<paragraph id="ID05B64AD364294842B9A4E9B2D2672BBB"><enum>(1)</enum><text>in subsection (a)(1), by
			 striking <quote>and (C) $3,100,000 for each of fiscal years 2012 through
			 2025.</quote> and inserting the following:</text>

				53112. Acquisition of fleet vessels</text>
						<subsection id="ID9DBCCB8F2CCA46C18F7B08042668F9BA"><enum>(a)</enum><header>In
				general</header><text>Notwithstanding section 2218(f) of title 10, United
				States Code, upon replacement of any vessel subject to an operating agreement
				under this chapter, and subject to agreement by the vessel owner, the Secretary
				is authorized, subject to concurrence with the Secretary of Defense, to acquire
				the vessel being replaced for inclusion in the National Defense Reserve
				Fleet.</text>
						</subsection><subsection id="ID092DB90F160A48FD80797EC426446EB1"><enum>(b)</enum><header>Requirements</header><text>In
				order to be eligible for acquisition by the Secretary under this section, a
				vessel shall—</text>
							<paragraph id="ID9AF71F27349744B8B7890A9A28767179"><enum>(1)</enum><text>have been included in a
				Maritime Security Program Operating Agreement for not less than 3 years;
				and</text>
							</paragraph><paragraph id="ID8E2B3E50D5C848989A1AF4A36D75652A"><enum>(2)</enum><text>meet recapitalization
				requirements for the Ready Reserve Force.</text>
							</paragraph></subsection><subsection id="ID2CD8CD86BAB94341A93F27DA27A76227"><enum>(c)</enum><header>Fair market
				value</header><text>The Maritime Administration shall establish a fair market
				value for the acquisition of an eligible vessel under this section.</text>
						</subsection><subsection id="ID1FA0DB731E10484CA2BFE77370FB8A4E"><enum>(d)</enum><header>Appropriations</header><text>A
				vessel acquisition under this section shall be subject to the availability of
				appropriations and the appropriations shall be part of the National Defense
				Reserve Fleet appropriations and separate from Maritime Security Program
				appropriations.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="ID88701D99060D4230BB76300022A9E01A"><enum>(k)</enum><text>The table of contents for
			 chapter 531 is amended—</text>

			 study</header>
			<subsection id="ID98C63DD5D4F34D2EA79A5D10E798271E"><enum>(a)</enum><header>Training
			 study</header><text>The Comptroller General of the United States shall conduct
			 a study on the training needs of the maritime workforce.</text>
			</subsection><subsection id="IDDE12DFD562954864A824D51DFC2B10C0"><enum>(b)</enum><header>Study
			 components</header><text>The study shall—</text>
				<paragraph id="ID47E5EAA4F70C47E0B488B2363475310A"><enum>(1)</enum><text>analyze the impact of
			 training requirements imposed by domestic and international regulations and
			 conventions, companies, and government agencies that charter or operate
			 vessels;</text>
				</paragraph><paragraph id="ID17750945F6D742F989DC18E067BBDCA8"><enum>(2)</enum><text>evaluate the ability of
			 the Nation's maritime training infrastructure to meet the current needs of the
			 maritime industry;</text>
				</paragraph><paragraph id="IDE0EC718A463C4A379B09A37CA5A84CA2"><enum>(3)</enum><text>evaluate the ability of
			 the Nation's maritime training infrastructure to effectively meet the needs of
			 the maritime industry in the future;</text>
				</paragraph><paragraph id="IDD1414714CD754B4687803F458B044998"><enum>(4)</enum><text>identify trends in
			 maritime training;</text>
				</paragraph><paragraph id="ID59543A02A13548EB9B55771176D9864C"><enum>(5)</enum><text>compare the training
			 needs of U.S. mariners with the vocational training and educational assistance
			 programs available from Federal agencies to evaluate the ability of Federal
			 programs to meet the training needs of U.S. mariners;</text>
				</paragraph><paragraph id="ID8ED0BFB7EC2A43E5B08AEB949FD713B9"><enum>(6)</enum><text>include recommendations
			 for future programs to enhance the capabilities of the Nation's maritime
			 training infrastructure; and</text>
				</paragraph><paragraph id="IDDD48024819654D4D9AD5189C49401A98"><enum>(7)</enum><text>include recommendations
			 for future programs to assist U.S. mariners and those entering the maritime
			 profession achieve the required training.</text>
				</paragraph></subsection><subsection id="ID58A25F6DB19A4BB09C31AC7E712B4751"><enum>(c)</enum><header>Final
			 report</header><text>Not later than 1 year after the date of enactment of this
			 Act, the Comptroller General shall submit a report on the results of the study
			 to the Committee on Commerce, Science, and Transportation of the Senate and the
			 Committee on Transportation and Infrastructure of the House of
			 Representatives.</text>
			</subsection></section><section changed="added" committee-id="SSCM00" id="ID8D64D7C1597B4F2E9DD783099A7918AC" reported-display-style="italic"><enum>10.</enum><header>Maritime administration
			 vessel recycling contract award practices</header>
			<subsection id="IDD859AD23FBB74B088ABD7C751C630F9F"><enum>(a)</enum><header>In
			 general</header><text>Not later than 12 months after the date of enactment of
			 this Act, the Inspector General of the Department of Transportation shall
			 conduct an assessment of the source selection procedures and practices used to
			 award the Maritime Administration's National Defense Reserve Fleet vessel
			 recycling contracts. The Inspector General shall assess the process,
			 procedures, and practices used for the Maritime Administration's qualification
			 of vessel recycling facilities. The Inspector General shall report the findings
			 to the Committee on Commerce, Science, and Transportation and the Committee on
			 Armed Services of the Senate, and the Committee on Transportation and
			 Infrastructure and the Committee on Armed Services of the House of
			 Representatives.</text>
			</subsection><subsection id="IDECB0DF0D453E4E609A7EC0DE2CB66F4B"><enum>(b)</enum><header>Assessment</header><text>The
			 assessment under subsection (a) shall include a review of whether the Maritime
			 Administration's contract source selection procedures and practices are
			 consistent with law, the Federal Acquisition Regulations (FAR), and Federal
			 best practices associated with making source selection decisions.</text>
			</subsection><subsection id="IDC19E189440F241CCBDF01F86BAD72C36"><enum>(c)</enum><header>Considerations</header><text>In
			 making the assessment under subsection (a), the Inspector General may consider
			 any other aspect of the Maritime Administration's vessel recycling process that
			 the Inspector General deems appropriate to review.</text>
			</subsection></section><section changed="added" committee-id="SSCM00" id="ID92A8C37C53ED4ADAA7B0118A8F634965" reported-display-style="italic"><enum>11.</enum><header>Prohibition on maritime
			 administration receipt of polar icebreakers</header><text display-inline="no-display-inline">Until the date that is 2 years after the
			 date on which the Committee on Commerce, Science, and Transportation of the
			 Senate and the Committee on Transportation and Infrastructure of the House of
			 Representatives receive the polar icebreaker business case analysis under
			 subsection 307(f) of the Coast Guard Authorization Act of 2010 (14 U.S.C. 92
			 note), or until the Coast Guard has replaced the Coast Guard Cutter POLAR SEA
			 (WAGB 11) and the Coast Guard Cutter POLAR STAR (WAGB 10) with 2 <quote>in
			 commission, active</quote> heavy polar icebreakers—</text>
			<paragraph id="IDD88A14550E8448F9AA7F4CBECB088D11"><enum>(1)</enum><text>the Administrator of the
			 Maritime Administration may not receive, maintain, dismantle, or recycle either
			 cutter; and</text>
			</paragraph><paragraph id="ID6AED23E89F7B45A2B74B559BD3CCC9F3"><enum>(2)</enum><text>the Commandant may
			 not—</text>
				<subparagraph id="ID0673B8A88168432BA2D4569F986F2F36"><enum>(A)</enum><text>transfer or relinquish
			 ownership of either of the cutters;</text>
				</subparagraph><subparagraph id="ID55F7DE07D17D4719AEB00D94B287F92F"><enum>(B)</enum><text>dismantle a major
			 component of, or recycle parts from, the POLAR SEA, unless the POLAR STAR
			 cannot be made to function properly without doing so;</text>
				</subparagraph><subparagraph id="IDCB15C4D327A14D53B1F03973DF109301"><enum>(C)</enum><text>change the homeport of
			 either of the cutters;</text>
				</subparagraph><subparagraph id="ID135489717C5F49039E668624E7EED4D9"><enum>(D)</enum><text>expend any funds—</text>
					<clause id="ID34FC445AB912455F9F798636F53C0955"><enum>(i)</enum><text>for any expenses directly
			 or indirectly associated with the decommissioning of either of the cutters,
			 including expenses for dock use or other goods and services;</text>
					</clause><clause id="IDC3CCA37753A04E26B66188094B01F41E"><enum>(ii)</enum><text>for any personnel
			 expenses directly or indirectly associated with the decommissioning of either
			 of the cutters, including expenses for a decommissioning officer; or</text>
					</clause><clause id="ID10F3B001F3E64FCABC547DE8625C0F11"><enum>(iii)</enum><text>for any expenses
			 associated with a decommissioning ceremony for either of the cutters;</text>
					</clause></subparagraph><subparagraph id="ID06CB610573334A3483E9C85FBAB135A8"><enum>(E)</enum><text>appoint a decommissioning
			 officer to be affiliated with either of the cutters; or</text>
				</subparagraph><subparagraph id="ID390489681BA24D8CAD002F80B340F74E"><enum>(F)</enum><text>place either of the
			 cutters in inactive status, including a status of—</text>
					<clause id="ID32B3AAE5446B4B48B0A4F9D88FEA1E93"><enum>(i)</enum><text>out of commission, in
			 reserve;</text>
					</clause><clause id="ID73744C53575D4AD888CCC25434E8E850"><enum>(ii)</enum><text>out of service, in
			 reserve; or</text>
					</clause><clause id="IDB588F36EC2214C2ABA79B20B3EF73149"><enum>(iii)</enum><text>pending placement out

			 appropriations for fiscal year 2012</header><text display-inline="no-display-inline">There are authorized to be appropriated to
			 the Secretary of Transportation for programs of the Maritime Administration the
			 following amounts:</text>
			<paragraph id="ID606041CC80964243B7405C47148941C5"><enum>(1)</enum><header>Operations and
			 training</header><text>For expenses necessary for operations and training
			 activities, not to exceed $161,539,000 for the fiscal year ending September 30,
			 2012, of which—</text>
				<subparagraph id="ID8B59A170819148EEB7123A441E9DC02D"><enum>(A)</enum><text>$28,885,000 is for
			 capital improvements at the U.S. Merchant Marine Academy, to remain available
			 until expended; and</text>
				</subparagraph><subparagraph id="ID0287DA78B2864295A8A787545D6D0C51"><enum>(B)</enum><text>$11,100,000 is for
			 maintenance and repair for training ships at State Maritime Schools, to remain
			 available until expended.</text>
				</subparagraph></paragraph><paragraph id="IDEA781047055B4213A7CC0894B3D85172"><enum>(2)</enum><header>Maritime guaranteed
			 loans</header><text>For administrative expenses related to loan guarantee
			 commitments under chapter 537 of title 46, United States Code, not to exceed
			 $3,750,000, which shall be paid to the appropriation for <quote>Operations and
			 Training</quote>, Maritime Administration.</text>
			</paragraph><paragraph id="IDDEE0DE6BA5584419B7BD70A6E54E5607"><enum>(3)</enum><header>Ship
			 disposal</header><text>For disposal of non-retention vessels in the National
			 Defense Reserve Fleet, $18,500,000, to remain available until expended.</text>
