		<legis-type>A BILL</legis-type>
		<official-title>To amend the National Labor Relations Act to ensure
		  fairness in election procedures with respect to collective bargaining
		  representatives.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Fair Representation in Elections
			 Act of 2011</short-title></quote>.</text>
		</section><section id="idC05D7F20D5CF4BA8805BAF4801216291"><enum>2.</enum><header>Amendments to
			 the National Labor Relations Act</header><text display-inline="no-display-inline">Section 9 of the National Labor Relations
			 Act (29 U.S.C. 159) is amended—</text>
			<paragraph id="idD2B669A063604FE3A4405B0EE31C172F"><enum>(1)</enum><text>in subsection
			 (b), by inserting <quote>prior to an election</quote> after <quote>in each
			 case</quote>; and</text>
			</paragraph><paragraph id="id0FFB05A3B4D24BF4AE7024438F9514BC"><enum>(2)</enum><text>in subsection
			 (c)—</text>
				<subparagraph id="id887970B300E04C07A2A165937F5058CA"><enum>(A)</enum><text>in the flush
			 matter following paragraph (1)(B)—</text>
					<clause id="id44F1938B37804E8ABA8D381350E71433"><enum>(i)</enum><text>by
			 inserting <quote>of 14 days in advance</quote> after <quote>appropriate hearing
			 upon due notice</quote>;</text>
					</clause><clause id="id7A8B4DF7E0CE4D32AD037F5222DECD1F"><enum>(ii)</enum><text>by
			 inserting <quote>, and a review of post-hearing appeals,</quote> after
			 <quote>the record of such hearing</quote>; and</text>
					</clause><clause id="id8E9A522EECA6420FB6D5C8E279DAE8E2"><enum>(iii)</enum><text>by adding at
			 the end the following: <quote>No election shall be conducted less than 40
			 calendar days following the filing of an election petition. The employer shall
			 provide the Board a list of employee names and home addresses of all eligible
			 voters within 7 days following the Board’s determination of the appropriate
			 unit or following any agreement between the employer and the labor organization
			 regarding the eligible voters.</quote>; and</text>
					</clause></subparagraph><subparagraph id="id7C0AFE3BAE184C04B146760DEC638C2B"><enum>(B)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id57E703A87052417FA63D013C0BC83701" style="OLC">
						<paragraph id="idE49B2508EF264A26AB4D3579DBA79867" indent="up1"><enum>(6)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id3594E9494ACC442E9F6BE843224E49C8"><enum>(A)</enum><text>No election shall
				take place after the filing of any petition unless and until—</text>
								<clause id="id2BE071E75E7F465587878C86F34D991F" indent="up1"><enum>(i)</enum><text>a hearing is conducted before a
				qualified hearing officer in accordance with due process on any and all
				material, factual issues regarding jurisdiction, statutory coverage,
				appropriate unit, unit inclusion or exclusion, or eligibility of individuals;
				and</text>
								</clause><clause id="idE46221EE568E4C2A8FB54DFCB1A229D9" indent="up1"><enum>(ii)</enum><text>the issues are
				resolved by a Regional Director, subject to appeal and review, or by the
				Board.</text>
								</clause></subparagraph><subparagraph id="id5FF3E6B257BD400AAFEF98CDABF727D4" indent="up1"><enum>(B)</enum><text>No election results shall be final
				and no labor organization shall be certified as the bargaining representative
				of the employees in an appropriate unit unless and until the Board has ruled
				on—</text>
								<clause id="id61548095A35F4FF3838105A1060A3582"><enum>(i)</enum><text>each pre-election issue not resolved
				before the election; and</text>
								</clause><clause id="id4AFA7A8FA0F64ABCB95E9ABAF412DF9F"><enum>(ii)</enum><text>the resolution,
				following a hearing conducted in accordance with due process, of each issue
				pertaining to the conduct or results of the
				election.</text>
