		<official-title>To clarify the responsibilities of the Secretary of the
		  Interior in making a determination whether to take off-reservation land into
		  trust for gaming purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Off-Reservation Land Acquisition
			 Guidance Act</short-title></quote>.</text>
		</section><section id="ID709d7dfe9d174133ac373ff610c6346f"><enum>2.</enum><header>Off-reservation
			 land acquisition guidance</header>
			<subsection id="id1F3A49BC067247FAB279DEC311E9AED5"><enum>(a)</enum><header>Definition of
			 off-Reservation land</header><text>In this Act, the term <term>off-reservation
			 land</term> means land that is—</text>
				<paragraph id="ID93cdf615e0584b5992d4291ebaeb20ef"><enum>(1)</enum><text>located outside
			 of, and noncontiguous to, the reservation of an Indian tribe;</text>
				</paragraph><paragraph id="ID25d541a9672d4c319d78553a129459ff"><enum>(2)</enum><text>likely to qualify
			 for, result in, or be associated with the development of an Indian gaming
			 facility; and</text>
				</paragraph><paragraph id="ID7502e304036240fdbd3da9751ab17d59"><enum>(3)</enum><text>located beyond a
			 reasonable commuting distance from the reservation of that Indian tribe.</text>
				</paragraph></subsection><subsection id="IDa06230e3e89a45f6ad86760d1e429fad"><enum>(b)</enum><header>Procedure</header><text display-inline="yes-display-inline">Before determining whether to take
			 off-reservation land into trust for the benefit of an Indian tribe under
			 section 5 of the Act of June 18, 1934 (25 U.S.C. 465) (commonly known as the
			 <quote>Indian Reorganization Act</quote>), the Secretary shall evaluate—</text>
				<paragraph id="id5DC708265D5A427488B2A056E6D6B108"><enum>(1)</enum><text display-inline="yes-display-inline">the anticipated benefits to the Indian
			 tribe associated with taking the off-reservation land into trust; and</text>
				</paragraph><paragraph id="id62E3BBC3E79444BD964850F5A8B2B6DD"><enum>(2)</enum><text display-inline="yes-display-inline">any concerns raised by applicable State and
			 local governments relating to the acquisition of the off-reservation
			 land.</text>
				</paragraph></subsection><subsection id="ID8904add61df845d8a2123ab53c85b7e1"><enum>(c)</enum><header>Evaluation</header>
				<paragraph id="id2F1F4BC6CD354A7A99247906B1B28979"><enum>(1)</enum><header>Benefit to
			 tribe</header><text>In evaluating the anticipated benefits to the Indian tribe
			 of taking a parcel of off-reservation land into trust, the Secretary shall
			 prepare a report that includes an assessment of—</text>
					<subparagraph id="ID50600f7974c94cde94809e3310f05d65"><enum>(A)</enum><text>the impacts of
			 taking the applicable off-reservation land into trust on the on-reservation
			 unemployment rate;</text>
					</subparagraph><subparagraph id="ID8ae19386ff594c6da0efc123a3046f9e"><enum>(B)</enum><text>the impacts of
			 taking the applicable off-reservation land into trust on reservation life and
			 tribal membership if the members, dependents, and descendants of the Indian
			 tribe relocate to the off-reservation land or adjacent communities;</text>
					</subparagraph><subparagraph id="ID5abc1a05618b4b289d160b314b5e7c2b"><enum>(C)</enum><text>the specific
			 on-reservation benefits of taking the off-reservation land into trust,
			 including an assessment of whether on-reservation jobs will be created and, if
			 so, the quantity of jobs expected to be created; and</text>
					</subparagraph><subparagraph id="ID718d1974c185413483a30ce98a006d16"><enum>(D)</enum><text>whether the
			 tribal government can efficiently exercise the governmental and regulatory
			 responsibilities of the tribal government if a gaming facility is constructed
			 on the off-reservation land.</text>
					</subparagraph></paragraph><paragraph id="ID68df8afd0017479cad566e856340357f"><enum>(2)</enum><header>State and local
			 concerns</header><text>In evaluating any concerns raised by applicable State
			 and local governments relating to taking a parcel of off-reservation land into
			 trust, the Secretary shall prepare a report that includes an assessment
			 of—</text>
					<subparagraph id="IDfeadaf0badb74edf9316ae33729afc33"><enum>(A)</enum><text>whether the
			 transfer of jurisdiction to the Indian tribe over the parcel is likely to
			 disrupt established local governmental operations;</text>
					</subparagraph><subparagraph id="ID5e8fcee8075d44fba622e93e5e9ac211"><enum>(B)</enum><text>potential impacts
			 on real property taxes and special assessments on adjacent land and property,
			 including any impact on State and local governments resulting from the
			 exemption of the parcel from the taxation;</text>
					</subparagraph><subparagraph id="idE8730A32DDBD4388A0A25ADE7A20B889"><enum>(C)</enum><text>whether the
			 Indian tribe has submitted intergovernmental agreements necessary to address
			 State and local government concerns, including agreements regarding law
			 enforcement jurisdiction on the parcel;</text>
					</subparagraph><subparagraph id="ID3f65532c32d547dda0cd782f83e574e3"><enum>(D)</enum><text>the compatibility
			 of the anticipated use of the land with the zoning and land use requirements of
			 the applicable State and local governments;</text>
					</subparagraph><subparagraph id="ID931a0294987d437a9a44f00ec3cf5a35"><enum>(E)</enum><text>traffic, noise,
			 and other negative effects on development associated with, or generated by, the
			 anticipated use of the land, including any impact on local water resources and
			 water and wastewater infrastructure; and</text>
					</subparagraph><subparagraph id="IDcafae215e6a1486ba3856a9e2ea982a0"><enum>(F)</enum><text>any potential
			 incompatible use between the anticipated use of the land and adjacent or
			 contiguous land zoned or used for—</text>
						<clause id="ID8d63274d9f06472db9f6586adfd62cad"><enum>(i)</enum><text>national
			 parks;</text>
						</clause><clause id="IDd075c6dc0af2440eb813a11c7dbc49cf"><enum>(ii)</enum><text>national
			 monuments;</text>
						</clause><clause id="ID5148e811346842ca948b3b900f5f5dfa"><enum>(iii)</enum><text>conservation
			 areas;</text>
						</clause><clause id="IDd6b8caa1bbfc458b9d7b50347c66a2ca"><enum>(iv)</enum><text>national fish
			 and wildlife refuges;</text>
						</clause><clause id="ID7db4b95608a8445b8714c5c13d105a76"><enum>(v)</enum><text>daycare
			 centers;</text>
						</clause><clause id="IDb6963bbdf69e49258177effaca7153b6"><enum>(vi)</enum><text>schools;</text>
						</clause><clause id="ID94211f7739984758bdf3105828dca25b"><enum>(vii)</enum><text>churches;
			 or</text>
						</clause><clause id="ID8b973d8f2c67473a9492b8903c0dabe8"><enum>(viii)</enum><text>residential
			 developments.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="IDdbc5d175e9a4424fb346e45c0a240c4a"><enum>(d)</enum><header>Submission from
			 Indian tribe</header><text display-inline="yes-display-inline">The Indian tribe
			 requesting off-reservation land to be taken into trust under section 5 of the
			 Act of June 18, 1934 (25 U.S.C. 465) (commonly known as the <quote>Indian
			 Reorganization Act</quote>) shall disclose and submit to the Secretary—</text>
				<paragraph id="id2B2BBDF2DB3947F6891DF115682D8AD5"><enum>(1)</enum><text display-inline="yes-display-inline">any plan, contract, agreement, or other
			 information relating to the use, or intended use, of the off-reservation land
			 by the Indian tribe, along with written documentation of the plan, contract, or
			 agreement;</text>
				</paragraph><paragraph id="id4A7696B33C3548FB88B14996370F2262"><enum>(2)</enum><text display-inline="yes-display-inline">a request for a written opinion from the
			 Office of Indian Gaming that the off-reservation land is eligible for gaming;
			 and</text>
				</paragraph><paragraph id="id435FA71A494542739544FDA337AF4789"><enum>(3)</enum><text display-inline="yes-display-inline">any other information the Secretary
			 requires in determining whether to take the off-reservation land into trust for
			 the benefit of the Indian tribe.</text>
				</paragraph></subsection><subsection id="id1594AF2F45D1484D99F2F09B7CEB968C"><enum>(e)</enum><header>Applicability</header><text>The
			 Secretary shall not take the applicable off-reservation land into trust under
			 section 5 of the Act of June 18, 1934 (25 U.S.C. 45) (commonly known as the
			 “Indian Reorganization Act”), unless the Secretary determines that—</text>
				<paragraph id="id22B1B637809B4CDFB8A682898ADFE46D"><enum>(1)</enum><text>the Indian tribe
			 has adequately addressed the concerns identified in the written assessments
			 under subsection (c)(2);</text>
				</paragraph><paragraph id="idEE44E6FEEAEA482BA741080EE4BC3C15"><enum>(2)</enum><text>the Indian tribe
			 has provided the information required under subsection (d); and</text>
				</paragraph><paragraph id="id6CBC245132F04CB78FC4B2D1A0A99227"><enum>(3)</enum><text>the proposed use
			 of the land by the Indian tribe is compatible with State and local requirements
			 for planning and zoning and public health and safety.</text>
				</paragraph></subsection></section><section id="IDe5e320a6f73a4e35949e2635d2fcf69d"><enum>3.</enum><header>Stay of
			 decisionmaking</header>
			<subsection id="id637D1B1841A941798F23B05AA7A287AD"><enum>(a)</enum><header>In
			 general</header><text>Unless explicitly required by an Act of Congress, the
			 Secretary shall not approve any application for taking off-reservation land
			 into trust that is pending on the date of enactment of this Act until the date
			 on which the Secretary promulgates regulations to carry out this Act.</text>
			</subsection><subsection id="IDbb09248c8db7471aa4abc3545b8f4bcc"><enum>(b)</enum><header>Future
			 effect</header><text>All applications for taking off-reservation land into
			 trust that are pending on the date of enactment of this Act shall be subject to
			 the provisions of the regulations described in subsection (a).</text>
