			 the California Desert Protection Act of 1994</header>
			<subsection id="idD5FE7BC35FE947848B49A74016EABDC1"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Public Law 103–433
			 (16 U.S.C. 410aaa et seq.) is amended by adding at the end the
			 following:</text>

					<title id="id08D10B44DB044FE9991E70A6075AA079"><enum>XIII</enum><header>Mojave Trails
				National Monument</header>
						<section id="id1B2210AE4528460EBFB78EFF5FA3EE4E"><enum>1301.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>
							<paragraph id="idCA88B9FD5E5D4D3F89F5471EE7387294"><enum>(1)</enum><header>Map</header><text>The
				term <quote>map</quote> means the map entitled <quote>Boundary Map, Mojave
				Trails National Monument</quote> and dated November 19, 2009.</text>
							</paragraph><paragraph id="id4C344D4F1C7A4828AE09341FCAE1F098"><enum>(2)</enum><header>Monument</header><text>The
				term <quote>Monument</quote> means the Mojave Trails National Monument
				established by section 1302(a).</text>
							</paragraph><paragraph id="id129C0E53E0104C349957C2711656A1CA"><enum>(3)</enum><header>Study
				area</header><text>The term <quote>study area</quote> means the land
				that—</text>
								<subparagraph id="id7C6BC05D38CE462B88E74D6C40117386"><enum>(A)</enum><text>is described
				in—</text>
									<clause id="id19B590F5B9974138A3263BDA583EDF0E"><enum>(i)</enum><text>the notice of the
				Bureau of Land Management of September 15, 2008 entitled <quote>Notice of
				Proposed Legislative Withdrawal and Opportunity for Public Meeting;
				California</quote> (73 Fed. Reg. 53269); or</text>
									</clause><clause id="idA4A68E4E4BAB422FB1B305EAEC569604"><enum>(ii)</enum><text>any subsequent
				notice in the Federal Register that is related to the notice described in
				clause (i); and</text>
									</clause></subparagraph><subparagraph id="id333AD817CACA4ED69F4FAE429EA58305"><enum>(B)</enum><text>has been
				segregated by the Director of the Bureau of Land Management.</text>
								</subparagraph></paragraph></section><section id="id11ABF93458C1447FB92E160AEC0FE8BA"><enum>1302.</enum><header>Establishment
				of the Mojave Trails National Monument</header>
							<subsection id="ID64aa19a97ce14aeaa5df370c256729af"><enum>(a)</enum><header>Establishment</header><text>There
				is designated in the State the Mojave Trails National Monument.</text>
							</subsection><subsection id="idC637AF2F54AD43A99A92F846EA4DDC6F"><enum>(b)</enum><header>Purposes</header><text>The
				purposes of the Monument are—</text>
								<paragraph id="id0374C2831264485B919C5368B5461028"><enum>(1)</enum><text>to preserve the
				nationally significant biological, cultural, recreational, geological,
				educational, historic, scenic, and scientific values—</text>
									<subparagraph id="id406CEEC635B84AB1B5E3DF2168157C2F"><enum>(A)</enum><text>in the Central
				and Eastern Mojave Desert; and</text>
									</subparagraph><subparagraph id="id808F038D7C9C4BC2A45A9FF6A5CF459F"><enum>(B)</enum><text>along historic
				Route 66; and</text>
									</subparagraph></paragraph><paragraph id="idB50AA2E042DC45A39DCF883F186C1553"><enum>(2)</enum><text>to secure the
				opportunity for present and future generations to experience and enjoy the
				magnificent vistas, wildlife, land forms, and natural and cultural resources of
				the Monument.</text>
								</paragraph></subsection><subsection id="IDcc91a9f81fe049988651c1dd2454eeac"><enum>(c)</enum><header>Boundaries</header>
								<paragraph id="id658A8AE50F9C4ABC979D45550A6C37F5"><enum>(1)</enum><header>In
				general</header><text>Except as provided in paragraph (2), the Monument shall
				consist of the Federal land and Federal interests in land within the boundaries
				depicted on the map.</text>
								</paragraph><paragraph id="id4588426659804CB3AE493D2E14D44C23"><enum>(2)</enum><header>Exclusions</header>
									<subparagraph id="idE31620444DDB42959B3F4B3BBD689FAE"><enum>(A)</enum><header>Study
				area</header><text>Subject to subparagraph (B), the study area shall be
				excluded from the Monument to permit the Secretary of the Navy to study the
				land within the study area for—</text>
										<clause id="id05B5DC732D0C4911AD146C585BAA2BD5"><enum>(i)</enum><text>withdrawal in
				accordance with the Act of February 28, 1958 (43 U.S.C. 155 et seq.);
				and</text>
										</clause><clause id="idBCEA0D13DF1E43C4987CBE8C184A27B2"><enum>(ii)</enum><text>potential
				inclusion into the Marine Corps Air Ground Combat Center at Twentynine Palms,
				California, for national defense purposes.</text>
										</clause></subparagraph><subparagraph id="id28417A91D8404DBEA0CA8E5FCB2B18E7"><enum>(B)</enum><header>Incorporation
				in monument</header><text>After action by the Secretary of Defense and Congress
				regarding the withdrawal under subparagraph (A), any land within the study area
				that is not withdrawn shall be incorporated into the Monument.</text>
									</subparagraph></paragraph></subsection><subsection id="IDe14e3157fe1c448f8828d0ba13fea8c7"><enum>(d)</enum><header>Map; legal
				descriptions</header>
								<paragraph id="ID61840edbdb114bb0bea406a14323492a"><enum>(1)</enum><header>Legal
				description</header><text>As soon as practicable after the date of enactment of
				this title, the Secretary shall submit to the Committee on Natural Resources of
				the House of Representatives and the Committee on Energy and Natural Resources
				of the Senate legal descriptions of the Monument, based on the map.</text>
								</paragraph><paragraph id="ID93d24494f8c94ff9be20bce8e49e7c47"><enum>(2)</enum><header>Corrections</header><text>The
				map and legal descriptions of the Monument shall have the same force and effect
				as if included in this title, except that the Secretary may correct clerical
				and typographical errors in the map and legal descriptions.</text>
								</paragraph><paragraph id="idE54B6E67D8E3461D85AFE8E26FDFC515"><enum>(3)</enum><header>Availability of
				map</header><text>The map shall be on file and available for public inspection
				in the appropriate offices of the Bureau of Land Management.</text>
								</paragraph></subsection></section><section id="id61D8AC5D32744D3883599D81583B6BD1"><enum>1303.</enum><header>Management of
				the Monument</header>
							<subsection id="IDdfbff874e3b74cbdb7c817db76212fd0"><enum>(a)</enum><header>In
				general</header><text>The Secretary shall—</text>
								<paragraph id="id7EA35E532E9645008C076DA017BFF217"><enum>(1)</enum><text>only allow uses
				of the Monument that—</text>
									<subparagraph id="idDC1F082EB364466FB89A28934335ED38"><enum>(A)</enum><text>further the
				purposes described in section 1302(b);</text>
									</subparagraph><subparagraph id="id1C043D06EFC04AC1A1D05E966859F949"><enum>(B)</enum><text>are included in
				the management plan developed under subsection (g); and</text>
									</subparagraph><subparagraph id="IDc51972ff6dda4516b168b8e6ff011946"><enum>(C)</enum><text>do not interfere
				with the utility rights-of-way or corridors authorized under section 1304(f);
				and</text>
									</subparagraph></paragraph><paragraph id="idA4B0894C2EEC4238A9DB1732D34AB626"><enum>(2)</enum><text>subject to valid
				existing rights, manage the Monument to protect the resources of the Monument,
				in accordance with—</text>
									<subparagraph id="ID3720bbfa1f304f2a95ad278525ed20a0"><enum>(A)</enum><text>this Act;</text>
									</subparagraph><subparagraph id="ID08edfcbf2dca497997d6065e2340c184"><enum>(B)</enum><text>the Federal Land
				Policy and Management Act of 1976 (43 U.S.C. 1701 et seq.); and</text>
									</subparagraph><subparagraph id="ID3ec41698e136441cadde14bf7196337d"><enum>(C)</enum><text>any other
				applicable provisions of law.</text>
									</subparagraph></paragraph></subsection><subsection id="IDb8b6365e61804319af26e5b9c9a792b4"><enum>(b)</enum><header>Cooperation
				agreements; general authority</header><text>Consistent with the management plan
				and existing authorities applicable to the Monument, the Secretary may enter
				into cooperative agreements and shared management arrangements (including
				special use permits with any person (including educational institutions and
				Indian tribes)), for the purposes of interpreting, researching, and providing
				education on the resources of the Monument.</text>
							</subsection><subsection id="ID44fd7530638f43729ba9d70f9cedc3a3"><enum>(c)</enum><header>Administration
				of subsequently acquired land</header><text>Any land or interest in land within
				the boundaries of the Monument that is acquired by the Secretary after the date
				of enactment of this title shall be managed by the Secretary in accordance with
				this title.</text>
							</subsection><subsection id="ID0ffcc4df24bc4990a0dc447c0505d956"><enum>(d)</enum><header>Limitations</header>
								<paragraph id="id693107C764144AF7AA91D5BE1A83D766"><enum>(1)</enum><header>Property
				rights</header><text>The establishment of the Monument does not—</text>
									<subparagraph id="id275B96A6D17A4F698C5376568F7D432D"><enum>(A)</enum><text>affect—</text>
										<clause id="id69D598AE5586435E860F6FFF47D31B4C"><enum>(i)</enum><text>any property
				rights of an Indian reservation, individually held trust land, or any other
				Indian allotments;</text>
										</clause><clause id="id340261A79B254E55AE16D73B922306BC"><enum>(ii)</enum><text>any land or
				interests in land held by the State, any political subdivision of the State, or
				any special district; or</text>
										</clause><clause id="idC219969EFF2E447F8B02163B85DEE738"><enum>(iii)</enum><text>any private
				property rights within the boundaries of the Monument; or</text>
										</clause></subparagraph><subparagraph id="idD64BA8DF9947469A90472BC8180BBF05"><enum>(B)</enum><text>grant to the
				Secretary any authority on or over non-Federal land not already provided by
				law.</text>
									</subparagraph></paragraph><paragraph id="id21B2FB765C884E73B2DF2CE3310BA5D7"><enum>(2)</enum><header>Authority</header><text>The
				authority of the Secretary under this title extends only to Federal land and
				Federal interests in land included in the Monument.</text>
								</paragraph></subsection><subsection id="IDc6846e60df064a12bbfeac16b429e4d1"><enum>(e)</enum><header>Adjacent
				management</header>
								<paragraph id="IDe8a6aabd6a0949f79750e42d3d662767"><enum>(1)</enum><header>In
				general</header><text>Nothing in this title creates any protective perimeter or
				buffer zone around the Monument.</text>
								</paragraph><paragraph id="idC3C0ACC4FE4E47C6ACF2018A496C5852"><enum>(2)</enum><header>Activities
				outside monument</header><text>The fact that an activity or use on land outside
				the Monument can be seen or heard within the Monument shall not preclude the
				activity or use outside the boundary of the Monument.</text>
								</paragraph><paragraph id="id1C77ACB9A3AE477887312A00598E47C6"><enum>(3)</enum><header>No additional
				regulation</header><text>Nothing in this title requires additional regulation
				of activities on land outside the boundary of the Monument.</text>
								</paragraph></subsection><subsection id="ID25b60773dd0a4310a2f1fcf8fbe29ef3"><enum>(f)</enum><header>Air and water
				quality</header><text>Nothing in this title affects the standards governing air
				or water quality outside the boundary of the Monument.</text>
							</subsection><subsection id="IDcbda11852ebb40a5beef0ac694b2169f"><enum>(g)</enum><header>Management
				plan</header>
								<paragraph id="ID4d0d1bbcf7c64f1288cb8b2fe77e99a2"><enum>(1)</enum><header>In
				general</header><text>The Secretary shall—</text>
									<subparagraph id="idB84E2D4CD64D4083AE577B0B1C1351B5"><enum>(A)</enum><text>not later than 3
				years after the date of enactment of this title, complete a management plan for
				the conservation and protection of the Monument; and</text>
									</subparagraph><subparagraph id="id52568C2789BD46CBA09FE0E25F36B3F6"><enum>(B)</enum><text>on completion of
				the management plan—</text>
										<clause id="id97D6BB8713034950B2C2F1587FB7A5AF"><enum>(i)</enum><text>submit the
				management plan to—</text>
											<subclause id="idF8374093BD424937881B28E59E6FF2CF"><enum>(I)</enum><text>the Committee on
				Natural Resources of the House of Representatives; and</text>
											</subclause><subclause id="idD136DE2D118E4C47A843EC7179359A07"><enum>(II)</enum><text>the Committee on
				Energy and Natural Resources of the Senate; and</text>
											</subclause></clause><clause id="id8A834395E1A847B9994935544C4530FD"><enum>(ii)</enum><text>make the
				management plan available to the public.</text>
										</clause></subparagraph></paragraph><paragraph id="IDfb50559ffff246c39695c0d2578294a5"><enum>(2)</enum><header>Inclusions</header><text>The
				management plan shall include provisions that—</text>
									<subparagraph id="idE9A3C81B2A814CD7B7C757CDCF124F6E"><enum>(A)</enum><text>provide for the
				conservation and protection of the Monument;</text>
									</subparagraph><subparagraph id="idDA8D12E051F045138AE3443A34DFE792"><enum>(B)</enum><text>authorize the
				continued recreational uses of the Monument (including hiking, camping,
				hunting, mountain biking, sightseeing, off-highway vehicle recreation on
				designated routes, rockhounding, and horseback riding), if the recreational
				uses are consistent with this section and any other applicable law;</text>
									</subparagraph><subparagraph id="id6A0BF97E610B48E5B808C5D87681529C"><enum>(C)</enum><text>address the need
				for and, as necessary, establish plans for, the installation, construction, and
				maintenance of public utility energy transport facilities within rights-of-way
				in the Monument, including provisions that require that the activities be
				conducted in a manner that minimizes the impact on Monument resources
				(including resources relating to the ecological, cultural, historic, and scenic
				viewshed of the Monument), in accordance with any other applicable law;</text>
									</subparagraph><subparagraph id="IDd605648b05254678a22cd2bfade9ae19"><enum>(D)</enum><text>address the
				designation and maintenance of roads, trails, and paths in the Monument;</text>
									</subparagraph><subparagraph id="IDe111276736b8494eb77ca85bd22ab526"><enum>(E)</enum><text>address regional
				fire management planning and coordination between the Director of the Bureau of
				Land Management, the Director of the National Park Service, and San Bernardino
				County; and</text>
									</subparagraph><subparagraph id="ID2543923bcde64960899c5aa32ffefb40"><enum>(F)</enum><text>address the
				establishment of a visitor center to serve the Monument and adjacent public
				land.</text>
									</subparagraph></paragraph><paragraph id="ID873bcd97fe2e45ee9733697779e97fb5"><enum>(3)</enum><header>Preparation and
				implementation</header>
									<subparagraph id="ID537e22369bd84c18b72ca23319c4fe79"><enum>(A)</enum><header>Applicable
				law</header><text>The Secretary shall prepare and implement the management plan
				in accordance with the National Environmental Policy Act of 1969 (42 U.S.C.
				4321 et seq.) and any other applicable laws.</text>
									</subparagraph><subparagraph id="idECA0096465F0461B867C24B040A9F6BA"><enum>(B)</enum><header>Consultation</header><text>In
				preparing and implementing the management plan, the Secretary shall
				periodically consult with—</text>
										<clause id="id5979379D085444F2AD65C6DDA7F012B4"><enum>(i)</enum><text>the advisory
				committee established under section 1306;</text>
										</clause><clause id="id16C9A073E6804B02B149A3571E2CCFC7"><enum>(ii)</enum><text>interested
				private property owners and holders of valid existing rights located within the
				boundaries of the Monument; and</text>
										</clause><clause id="id3F7D4D92957E4F4CBC8DA230AC7F64EE"><enum>(iii)</enum><text>representatives
				of the Fort Mojave Indian tribe, the Colorado River Indian Tribe, the
				Chemehuevi Indian tribe, and other Indian tribes with historic or cultural ties
				to land within, or adjacent to, the Monument regarding the management of
				portions of the Monument containing sacred sites or cultural importance to the
				Indian tribes.</text>
										</clause></subparagraph></paragraph><paragraph id="IDb53e5ec0b2634ef99ebfc56dd8d59208"><enum>(4)</enum><header>Interim
				management</header><text>Except as otherwise provided in this Act, pending
				completion of the management plan for the Monument, the Secretary shall manage
				any Federal land and Federal interests in land within the boundary of the
				Monument—</text>
									<subparagraph id="id68B71D50BFDE4650A1EA9AE3FB15AFF9"><enum>(A)</enum><text>consistent with
				the existing permitted uses of the land;</text>
									</subparagraph><subparagraph id="idEF8B15E2F1D1446681604B7456B9E0D6"><enum>(B)</enum><text>in accordance
				with the general guidelines and authorities of the existing management plans of
				the Bureau of Land Management for the land; and</text>
									</subparagraph><subparagraph id="id75D88A16EAE147909258965B9018D5B6"><enum>(C)</enum><text>in a manner
				consistent with—</text>
										<clause id="idFE7E08DFC76348F3AEF524CDC97FCFFF"><enum>(i)</enum><text>the purposes
				described in section 1302(b);</text>
										</clause><clause id="id8428249473BE4B1B81E6A0C37D78B0C6"><enum>(ii)</enum><text>the provisions
				of the management plan under paragraph (2); and</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="idCF622F43BE124E35984FCD1860B0169A"><enum>(iii)</enum><text>applicable
				Federal law.</text>
										</clause></subparagraph></paragraph></subsection><subsection id="ID391111ce7c3245d2b2f840d3f516f827"><enum>(h)</enum><header>Effect of
				section</header><text>Nothing in this section diminishes or alters existing
				authorities applicable to Federal land included in the Monument.</text>
							</subsection></section><section id="id0D3C596C3ECF43699F12BA99E7B8CBB6"><enum>1304.</enum><header>Uses of the
				monument</header>
							<subsection id="IDa48de18b47774390811335ec6732a664"><enum>(a)</enum><header>Use of
				off-Highway vehicles</header>
								<paragraph id="id68806B3C3A324B59B45EECF9B6855DD7"><enum>(1)</enum><header>In
				general</header><text>The use of off-highway vehicles in the Monument
				(including the use of off-highway vehicles for commercial touring) shall be
				permitted to continue on designated routes, subject to all applicable law and
				and authorized by the management plan.</text>
								</paragraph><paragraph id="id3753FABC9B1C403CA8BF92C8E2A8D4C2"><enum>(2)</enum><header>Nondesignated
				routes</header><text>Off-highway vehicle access shall be permitted on
				nondesignated routes and trails in the Monument—</text>
									<subparagraph id="id6F84D121F0AA4D2E8BF8818097F0310D"><enum>(A)</enum><text>for
				administrative purposes;</text>
									</subparagraph><subparagraph id="id6AB21E6ECAB946E78BE175D583550F9A"><enum>(B)</enum><text>to respond to an
				emergency; or</text>
									</subparagraph><subparagraph id="id5947A0D29BC54B62B378C83EF1A60E06"><enum>(C)</enum><text>as authorized
				under the management plan.</text>
									</subparagraph></paragraph><paragraph id="IDe8b41e5a355d48a091b65e0ca22f5a85"><enum>(3)</enum><header>Inventory</header><text>Not
				later than 2 years after the date of enactment of this title, the Director of
				the Bureau of Land Management shall complete an inventory of all existing
				routes in the Monument.</text>
								</paragraph></subsection><subsection id="ID42d5b90d3cc947ed9b6588a94c028128"><enum>(b)</enum><header>Hunting,
				trapping, and fishing</header>
								<paragraph id="ID27342bb59a0e4a1b9e07f6049f4451cc"><enum>(1)</enum><header>In
				general</header><text>Except as provided in paragraph (2), the Secretary shall
				permit hunting, trapping, and fishing within the Monument in accordance with
				applicable Federal and State laws (including regulations) in effect as of the
				date of enactment of this title.</text>
								</paragraph><paragraph id="id6E15C1D16797418E93666904CF87C3A2"><enum>(2)</enum><header>Trapping</header><text>No
				amphibians or reptiles may be collected within the Monument.</text>
								</paragraph><paragraph id="IDa0d45a89c0fc4580a73116d91ac580ae"><enum>(3)</enum><header>Regulations</header><text>The
				Secretary, after consultation with the California Department of Fish and Game,
				may issue regulations designating zones where, and establishing periods during
				which, no hunting, trapping, or fishing shall be permitted in the Monument for
				reasons of public safety, administration, resource protection, or public use
				and enjoyment.</text>
								</paragraph></subsection><subsection id="ID62385a7dea994754b305c1086769e1d0"><enum>(c)</enum><header>Grazing</header>
								<paragraph id="id8D8EFABD819043EB8ECE2BD6332B6ED7"><enum>(1)</enum><header>In
				general</header><text>Nothing in this title terminates any valid existing
				grazing allotment within the Monument.</text>
								</paragraph><paragraph id="id3974FC926A184C17A90D7F6AB07CB8B5"><enum>(2)</enum><header>Effect on blair
				permit</header><text>Nothing in this title affects the Lazy Daisy grazing
				permit (permittee number 9076) on land included in the Monument, including the
				transfer of title to the grazing permit to the Secretary or to a private
				party.</text>
								</paragraph><paragraph id="ID301c778622634e1a89a76e0a7e725911"><enum>(3)</enum><header>Permit
				retirement</header><text>The Secretary may acquire base property and associated
				grazing permits within the Monument for purposes of permanently retiring the
				permit if—</text>
									<subparagraph id="id4EF58BD609544A5698EFE83CECA2A746"><enum>(A)</enum><text>the permittee is
				a willing seller;</text>
									</subparagraph><subparagraph id="id41F19327BCF2469885C5EC0C2080DA88"><enum>(B)</enum><text>the permittee and
				Secretary reach an agreement concerning the terms and conditions of the
				acquisition; and</text>
									</subparagraph><subparagraph id="id66FFA20DA67F4118BC76080C74F3E522"><enum>(C)</enum><text>termination of
				the allotment would further the purposes of the Monument described in section
				1302(b).</text>
									</subparagraph></paragraph></subsection><subsection id="IDddd9a4be1d8841169688839027e5d485"><enum>(d)</enum><header>Access to State
				and private land</header><text>The Secretary shall provide adequate access to
				each owner of non-Federal land or interests in non-Federal land within the
				boundary of the Monument to ensure the reasonable use and enjoyment of the land
				or interest by the owner.</text>
							</subsection><subsection id="ID3a2dc78206f847fea37dcd854ac019aa"><enum>(e)</enum><header>Limitations</header>
								<paragraph id="id19B78C736529486B8E43C1DF44ACE346"><enum>(1)</enum><header>Commercial
				enterprises</header><text>Except as provided in paragraphs (2) and (3), or as
				required for the maintenance, upgrade, expansion, or development of energy
				transport facilities in the corridors described in subsection (g), no
				commercial enterprises shall be authorized within the boundary of the Monument
				after the date of enactment of this title.</text>
								</paragraph><paragraph id="id1660C24C24604BA783DB7789E0652D0B"><enum>(2)</enum><header>Authorized
				exceptions</header><text>The Secretary may authorize exceptions to paragraph
				(1) if the Secretary determines that the commercial enterprises would further
				the purposes described in section 1302(b).</text>
								</paragraph><paragraph id="id2CA3045965F14B22B12BC68EFB03D8A7"><enum>(3)</enum><header>Applicability</header><text>This
				subsection does not apply to—</text>
									<subparagraph id="id02E0EC83AB6A48399EF6B74F661DEE1D"><enum>(A)</enum><text>transmission and
				telecommunication facilities that are owned or operated by a utility subject to
				regulation by the Federal Government or a State government or a State utility
				with a service obligation (as those terms are defined in section 217 of the
				Federal Power Act (16 U.S.C. 824q)); or</text>
									</subparagraph><subparagraph id="IDd2134042773d4333893cbdcd0d72373b"><enum>(B)</enum><text>commercial
				vehicular touring enterprises within the Monument that operate on designated
				routes.</text>
									</subparagraph></paragraph></subsection><subsection id="ID4eaa39fda31e48979b532fdde1e467c9"><enum>(f)</enum><header>Utility
				rights-of-Way</header>
								<paragraph id="id877F0A62BC7A4CF096E41801013B059D"><enum>(1)</enum><header>In
				general</header><text>Nothing in this title precludes, prevents, or inhibits
				the maintenance, upgrade, expansion, or development of energy transport
				facilities within the Monument that are critical to reducing the effects of
				climate change on the environment.</text>
								</paragraph><paragraph id="idCC004DC785844880A26EF1DA54E0D21D"><enum>(2)</enum><header>Authorization</header><text>The
				Secretary shall, to the maximum extent practicable—</text>
									<subparagraph id="idEF3B03D40D294329A775C3E4654B0141"><enum>(A)</enum><text>permit
				rights-of-way and alignments that best protect the values and resources of the
				Monument described in section 1302(b); and</text>
									</subparagraph><subparagraph id="idFE425C2AB55F4AE283991C9BF02873EA"><enum>(B)</enum><text>ensure that
				existing rights-of-way and utility corridors within the Monument are fully
				utilized before permitting new rights-of-way or designating new utility
				corridors within the Monument.</text>
									</subparagraph></paragraph><paragraph id="ID37397545684041d2bf73ebc74f38d8e8"><enum>(3)</enum><header>Effect on
				existing facilities and rights-of-way</header><text>Nothing in this section
				terminates or limits—</text>
									<subparagraph id="id8EEA9FA0F4EF4B73B0B534A3487C2B4E"><enum>(A)</enum><text>any valid
				right-of-way within the Monument in existence on the date of enactment of this
				title (including customary operation, maintenance, repair, or replacement
				activities in a right-of-way); or</text>
									</subparagraph><subparagraph id="idEACA56B192DC4ACF9911E253F934266E"><enum>(B)</enum><text>a right-of-way
				authorization issued on the expiration of an existing right-of-way
				authorization described in subparagraph (A).</text>
									</subparagraph></paragraph><paragraph id="ID9e1c5aae4e444ba18ea90848b5330173"><enum>(4)</enum><header>Upgrading and
				expansion of existing rights-of-way</header><text>Nothing in this subsection
				prohibits the upgrading (including the construction or replacement), expansion,
				or assignment of an existing utility transmission line for the purpose of
				increasing the capacity of—</text>
									<subparagraph id="idE93E0B88DF924AA782D911CD9F677F17"><enum>(A)</enum><text>a transmission
				line in existing rights-of-way; or</text>
									</subparagraph><subparagraph id="idAC5F7167BAD6440495A3F76E9D9600DD"><enum>(B)</enum><text>a right-of-way
				issued, granted, or permitted by the Secretary that is contiguous or adjacent
				to existing transmission line rights-of-way.</text>
									</subparagraph></paragraph><paragraph id="ID698d7ce1e4744f2c9f53711f63d76886"><enum>(5)</enum><header>Interstate 40
				transportation corridor</header><text>For purposes of underground utility
				rights-of-way under this subsection, the Secretary shall consider the
				Interstate 40 transportation corridor to be equivalent to an existing utility
				right-of-way corridor.</text>
								</paragraph><paragraph id="IDdcddc809f438450c83107e610bff2b14"><enum>(6)</enum><header>New
				rights-of-way</header>
									<subparagraph id="id3F794A222EF347AB9359933720C2FAC3"><enum>(A)</enum><header>In
				general</header><text>Any new rights-of-way or new uses within existing
				rights-of-way shall—</text>
										<clause id="idF79834C386E346F6A9F83088A3F1A927"><enum>(i)</enum><text>only be permitted
				in energy corridors or expansions of energy corridors that are designated as of
				the date of enactment of this title; and</text>
										</clause><clause id="idE182205370C5433086B1C459EB1BF32C"><enum>(ii)</enum><text>subject to
				subparagraph (B), require review and approval under the
				<act-name parsable-cite="NEPA69">National Environmental Policy Act of
				1969</act-name> (42 U.S.C. 4321 et seq.).</text>
										</clause></subparagraph><subparagraph id="idC370E02599A24AE48C2CE975949E22E9"><enum>(B)</enum><header>Approval</header><text>New
				rights-of-way or uses or expansions of existing corridors under subparagraph
				(A) shall only be approved if the head of the applicable lead Federal agency,
				in consultation with other agencies as appropriate, determines that the new
				rights-of-way, uses, or expansions are consistent with—</text>
										<clause id="id12041880B819487C93B70A188BCE428E"><enum>(i)</enum><text>this
				title;</text>
										</clause><clause id="idC03FC2E14B2946EA9679376DC3274C24"><enum>(ii)</enum><text>other applicable
				laws;</text>
										</clause><clause id="id24A83D0E33F3443C80CF4358C2470B47"><enum>(iii)</enum><text>the purposes of
				the Monument described in section 1302(b); and</text>
										</clause><clause id="ID645c1e4d16f24a75af883c2976d104b1"><enum>(iv)</enum><text>the management
				plan for the Monument.</text>
										</clause></subparagraph></paragraph></subsection><subsection id="ID8019baa552bc44d9949f82b03d5a8281"><enum>(g)</enum><header>West wide
				energy corridor</header>
								<paragraph id="IDb7b615eb63df48eab7d49ad6231e00fa"><enum>(1)</enum><header>Alternative
				alignment</header><text>Subject to paragraph (2), to further the purposes of
				the Monument described in section 1302(b), the Secretary may require a
				realignment of the energy right-of-way corridor numbered 27–41 and designated
				under the energy corridor planning process established by section 368 of the
				Energy Policy Act of 2005 (42 U.S.C. 15926) if an alternative alignment within
				the Monument—</text>
									<subparagraph id="ID830e76c81eeb4203a705e52cf99cd030"><enum>(A)</enum><text>provides
				substantially similar energy transmission capacity and reliability;</text>
									</subparagraph><subparagraph id="IDafb61f202dbb467681e54a83158d35a6"><enum>(B)</enum><text>does not impair
				other existing rights-of-way; and</text>
									</subparagraph><subparagraph id="ID0ab3d5af3f0b4305b622b58a0b48ddd4"><enum>(C)</enum><text>is compatible
				with military training requirements.</text>
									</subparagraph></paragraph><paragraph id="ID86e61644d953498dad6eba1d38482fda"><enum>(2)</enum><header>Consultation</header><text>Before
				establishing an alternative alignment of the energy right-of-way corridor under
				paragraph (1), the Secretary shall consult with—</text>
									<subparagraph id="id3FF25DFD93854E3F96491CE89D9A0D68"><enum>(A)</enum><text>the Secretary of
				Energy;</text>
									</subparagraph><subparagraph id="idCD737C770438484F8C363CC6230F3DE0"><enum>(B)</enum><text>the Secretary of
				Defense;</text>
									</subparagraph><subparagraph id="id30AD6DA0BF354B94BD8D347AFA8777D4"><enum>(C)</enum><text>the State,
				including the transmission permitting agency of the State;</text>
									</subparagraph><subparagraph id="id6523D34500A7478DA158366EE0DDA591"><enum>(D)</enum><text>units of local
				government in the State; and</text>
									</subparagraph><subparagraph id="id64D24C37C7534FEE9B6C7B682124159F"><enum>(E)</enum><text>any entities
				possessing valid existing rights-of-way within—</text>
										<clause id="id25CF2943A4124A1EAF5D1420D9762823"><enum>(i)</enum><text>the energy
				corridor described in paragraph (1); or</text>
										</clause><clause id="id49438B00D35940739A03C1C4AB694C84"><enum>(ii)</enum><text>any potential
				alternative energy corridor.</text>
										</clause></subparagraph></paragraph><paragraph commented="no" id="IDeacba98646f94fb6ad3a87fe3989b788"><enum>(3)</enum><header>Effect on
				energy transport corridors</header><text>Nothing in this subsection diminishes
				the utility of energy transport corridors located within the Monument and
				identified under section 368 of the Energy Policy Act of 2005 (42 U.S.C.
				15926), Energy Corridors E or I (as designated in the California Desert
				Conservation Area Plan), or energy corridors numbered 27–41 and 27–225 and
				designated by a record of decision—</text>
									<subparagraph commented="no" id="idB6C155772A7A49A68A57F87E418196A4"><enum>(A)</enum><text>to provide
				locations for—</text>
										<clause commented="no" id="idBEFC8B66D79D4DAA8FD712CB87EDE2DA"><enum>(i)</enum><text>electric
				transmission facilities that improve reliability, relieve congestion, and
				enhance the national grid; and</text>
										</clause><clause commented="no" id="id936AA2DABE91467E885ECCC9475DF7B1"><enum>(ii)</enum><text>oil, gas, and
				hydrogen pipelines; and</text>
										</clause></subparagraph><subparagraph commented="no" id="ID3203a2f72ec5412ca68fed1d2aaac8ac"><enum>(B)</enum><text>to provide
				locations for electric transmission facilities that—</text>
										<clause commented="no" id="IDfafd372e64784f51918da1e358e57b43"><enum>(i)</enum><text>promote renewable
				energy generation;</text>
										</clause><clause commented="no" id="ID7d187746183d40de98a0b06b640eb592"><enum>(ii)</enum><text>otherwise
				further the interest of the United States if the transmission facilities are
				identified as critical—</text>
											<subclause commented="no" id="id4C5CED7329B0469C82A44E38483DC858"><enum>(I)</enum><text>in a Federal law;
				or</text>
											</subclause><subclause commented="no" id="idFA2E29392F9C48248D6E61CEC7D6E562"><enum>(II)</enum><text>through a
				regional transmission planning process; or</text>
											</subclause></clause><clause commented="no" id="ID2244ab60ebe14898bbb73ef746a988a8"><enum>(iii)</enum><text>consist of
				high-voltage transmission facilities critical to the purposes described in
				clause (i) or (ii).</text>
										</clause></subparagraph></paragraph><paragraph commented="no" id="IDb6a2f675361d4435856f00c5ef68562c"><enum>(4)</enum><header>Land use
				planning</header><text>In conducting land use planning for the Monument, the
				Secretary—</text>
									<subparagraph commented="no" id="id4C6586B9E0C24AB685ABA2949BEF5BE9"><enum>(A)</enum><text>shall consider
				the existing locations of the corridors described in paragraph (3); and</text>
									</subparagraph><subparagraph commented="no" id="idF3C8975EFA0D46788BD1ECDC185A901D"><enum>(B)</enum><text>subject to
				paragraph (5), may amend the location of any energy corridors to comply with
				purposes of the Monument if the amended corridor—</text>
										<clause commented="no" id="IDdd410dbea48748b592e546e355d19027"><enum>(i)</enum><text>provides
				connectivity across the landscape that is equivalent to the connectivity
				provided by the existing location;</text>
										</clause><clause commented="no" id="IDb1f2ccf536e541cd889164df89b4fc5a"><enum>(ii)</enum><text>meets the
				criteria established by—</text>
											<subclause commented="no" id="id2F7780FC03734322864BE65B1CC75D75"><enum>(I)</enum><text>section 368 of
				the Energy Policy Act of 2005 (42 U.S.C. 15926); and</text>
											</subclause><subclause commented="no" id="id81207B3FA7A14B2E97F285FD106123F4"><enum>(II)</enum><text>the record of
				decision for the applicable corridor; and</text>
											</subclause></clause><clause commented="no" id="ID5c8403c423474fbeaa4c4b1f94178c71"><enum>(iii)</enum><text>does not impair
				or restrict the uses of existing rights-of-way.</text>
										</clause></subparagraph></paragraph><paragraph commented="no" id="ID4bc4987cfe304b5c9fe21c7038f84ed4"><enum>(5)</enum><header>Consultation
				required</header><text>Before amending a corridor under paragraph (4)(B), the
				Secretary shall consult with all interested parties (including the persons
				identified in section 368(a) of the Energy Policy Act of 2005 (42 U.S.C.
				15926(a))), in accordance with applicable laws (including regulations).</text>
								</paragraph></subsection><subsection id="ID5879c5db9f2b41aab54987d92d8c14ae"><enum>(h)</enum><header>Overflights</header><text>Nothing
				in this title or the management plan restricts or precludes—</text>
								<paragraph id="id79E2BC540C844D2B924DECCBE8DE41F2"><enum>(1)</enum><text>overflights
				(including low-level overflights) of military, commercial, and general aviation
				aircraft that can be seen or heard within the Monument;</text>
								</paragraph><paragraph id="id2B60A0777C584327B8C3A8D5A2B23911"><enum>(2)</enum><text>the designation
				or creation of new units of special use airspace; or</text>
								</paragraph><paragraph id="id3EE036A43BCD419B8CEB829A413B19F6"><enum>(3)</enum><text>the establishment
				of military flight training routes over the Monument.</text>
								</paragraph></subsection><subsection id="IDa65b515d478348a3af40e047c4e59f9d"><enum>(i)</enum><header>Withdrawals</header>
								<paragraph id="IDaef77c92846e45de8ba9c3cd48d7945a"><enum>(1)</enum><header>In
				general</header><text>Subject to valid existing rights and except as provided
				in paragraph (2), the Federal land and interests in Federal land included
				within the Monument are withdrawn from—</text>
									<subparagraph id="IDa13a3da8c60b4fd38128d0e5d0c82ca8"><enum>(A)</enum><text>all forms of
				entry, appropriation, or disposal under the public land laws;</text>
									</subparagraph><subparagraph id="IDe38053ca65c94a979ba5056fd828454e"><enum>(B)</enum><text>location, entry,
				and patent under the public land mining laws;</text>
									</subparagraph><subparagraph id="IDbecd6ac1a7cb4f39bf860619e9b063fa"><enum>(C)</enum><text>operation of the
				mineral leasing, geothermal leasing, and mineral materials laws; and</text>
									</subparagraph><subparagraph id="idBD87778F68E2474693BEA323DD90DED4"><enum>(D)</enum><text>energy
				development and power generation.</text>
									</subparagraph></paragraph><paragraph id="IDc34eeb0ac7814127a4edc0330ffd9ea8"><enum>(2)</enum><header>Exchange</header><text>Paragraph
				(1) does not apply to an exchange that the Secretary determines would further
				the protective purposes of the Monument.</text>
								</paragraph></subsection><subsection id="ID7d325c14feae4a8e932077c3fb595170"><enum>(j)</enum><header>Access to
				renewable energy facilities</header>
								<paragraph id="idFB490DE6FD204212B82AFD6B945A1F38"><enum>(1)</enum><header>In
				general</header><text>On a determination that no reasonable alternative access
				exists and subject to paragraph (2), the Secretary may allow new right-of-ways
				within the Monument to provide vehicular access to renewable energy project
				sites outside the boundaries of the Monument.</text>
								</paragraph><paragraph id="id5F84F77852B94204AAFF2E6FD89DDB6B"><enum>(2)</enum><header>Restrictions</header><text>To
				the maximum extent practicable, the rights-of-way shall be designed and sited
				to be consistent with the purposes of the Monument described in section
				1302(b).</text>
								</paragraph></subsection></section><section id="idBB686243DD3E4DCF86C1E39EBBBC7111"><enum>1305.</enum><header>Acquisition
				of land</header>
							<subsection id="ID7ca3502f70a7424e8ca71417ed2914ab"><enum>(a)</enum><header>In
				general</header><text>The Secretary may acquire for inclusion in the Monument
				any land or interests in land within the boundary of the Monument owned by the
				State, units of local government, Indian tribes, or private individuals only
				by—</text>
								<paragraph id="IDf59aa7bf39644b0bb4f9518f9205d66a"><enum>(1)</enum><text>donation;</text>
								</paragraph><paragraph id="IDddab797cd6b74066bec07e6baad864aa"><enum>(2)</enum><text>exchange with a
				willing party; or</text>
								</paragraph><paragraph id="ID8e88c645b15841d6b21508f201e53df0"><enum>(3)</enum><text>purchase from a
				willing seller for fair market value.</text>
								</paragraph></subsection><subsection id="ID8d6bf01789ea40a69fab37d9a9b59bb8"><enum>(b)</enum><header>Use of
				easements</header><text>To the maximum extent practicable and only with the
				approval of the landowner, the Secretary may use permanent conservation
				easements to acquire an interest in land in the Monument rather than acquiring
				fee simple title to the land.</text>
							</subsection><subsection id="IDa1a9c9ad8c074a73b306d38b95df3213"><enum>(c)</enum><header>Incorporation
				of acquired land and interests in land</header><text>Any land or interest in
				land within the boundaries of the Monument that is acquired by the United
				States after the date of enactment of this title shall be added to and
				administered as part of the Monument.</text>
							</subsection><subsection id="IDe2106fba0101400d87db8a55dead6831"><enum>(d)</enum><header>Donated and
				acquired land</header>
								<paragraph id="idB575CE01DACD42259D4C1A25E2BE15B7"><enum>(1)</enum><header>In
				general</header><text>All land within the boundary of the Monument donated to
				the United States or acquired using amounts from the land and water
				conservation fund established under section 2 of the
				<act-name parsable-cite="LWCFA">Land and Water Conservation Fund Act of 1965
				(16 U.S.C. 460l</act-name>–5) before, on, or after the date of enactment of
				this title—</text>
									<subparagraph id="id88BF489BC1A641A5B5C0851C2D3DC65F"><enum>(A)</enum><text>is withdrawn from
				mineral entry;</text>
									</subparagraph><subparagraph id="id2C3A1382115A4DCAAE8FB9B64E865214"><enum>(B)</enum><text>shall be managed
				in accordance with section 1904; and</text>
									</subparagraph><subparagraph id="ID04379b735af649fe99498a88e084f50b"><enum>(C)</enum><text>shall be managed
				consistent with the purposes of the Monument described in section
				1302(b).</text>
									</subparagraph></paragraph><paragraph id="id41934202989747D0A86733BEC7C478BE"><enum>(2)</enum><header>Effect on
				monument</header><text>Land within the boundary of the Monument that is
				contiguous to land donated to the United States or acquired using amounts from
				the land and water conservation fund established under section 2 of the
				<act-name parsable-cite="LWCFA">Land and Water Conservation Fund Act of 1965
				(16 U.S.C. 460l</act-name>–5) shall be managed in a manner consistent with
				conservation purposes, subject to applicable law.</text>
								</paragraph></subsection></section><section id="id68516ABBB7F84A66AB027EDBD035EB79"><enum>1306.</enum><header>Advisory
				Committee</header>
							<subsection id="id198AB1DD5FA14355BF5CECCC7E2B1DD3"><enum>(a)</enum><header>In
				general</header><text>The Secretary shall establish an advisory committee for
				the Monument, the purpose of which is to advise the Secretary with respect to
				the preparation and implementation of the management plan required by section
				1303(g).</text>
							</subsection><subsection id="IDc281d9bb1ddf4fe0aa468239ed0fb964"><enum>(b)</enum><header>Membership</header><text>To
				the extent practicable, the advisory committee shall include the following
				members, to be appointed by the Secretary:</text>
								<paragraph id="ID5d6dde2e14e948f0a13d2fcc0ac34d73"><enum>(1)</enum><text>A representative
				with expertise in natural science and research selected from a regional
				university or research institute.</text>
								</paragraph><paragraph id="IDf14f803cf18e44619fda0e1080ded972"><enum>(2)</enum><text>A representative
				of the California Natural Resources Agency.</text>
								</paragraph><paragraph id="idE2CD4593C3634F4994652780AD534984"><enum>(3)</enum><text>A representative
				of the California Public Utilities Commission.</text>
								</paragraph><paragraph id="ID557e81e4fc744714bb788594dafd5ef5"><enum>(4)</enum><text>A representative
				of the County of San Bernardino, California.</text>
								</paragraph><paragraph id="ID2051c37b7de24b86841b164fdecf0333"><enum>(5)</enum><text>A representative
				of each of the cities of Barstow, Needles, Twentynine Palms, and Yucca Valley,
				California.</text>
								</paragraph><paragraph id="IDd05c2ca0c5324101a3148d6ed9106a99"><enum>(6)</enum><text>A representative
				of each of the Colorado River, Fort Mojave, and the Chemehuevi Indian
				tribes.</text>
								</paragraph><paragraph id="IDe74f9c1c4afe49f0ab16c9981903e8b2"><enum>(7)</enum><text>A representative
				from the Department of Defense.</text>
								</paragraph><paragraph id="ID650124a47a6d42f4a8385d1da35c3cc8"><enum>(8)</enum><text>A representative
				of the Wildlands Conservancy.</text>
								</paragraph><paragraph id="ID0e882f799cd8415d8edadc97b0094191"><enum>(9)</enum><text>A representative
				of a local conservation organization.</text>
								</paragraph><paragraph id="IDa8a65fc11bd04d3da18c563b2c825988"><enum>(10)</enum><text>A representative
				of a historical preservation organization.</text>
								</paragraph><paragraph id="ID6c6f356e6a4c472682559a0e64b2269a"><enum>(11)</enum><text>A representative
				from each of the following recreational activities:</text>
									<subparagraph id="id3E3F2A831B3D4D0084D648D7DB73DDF4"><enum>(A)</enum><text>Off-highway
				vehicles.</text>
									</subparagraph><subparagraph id="idC01B25BC51064B27A7D0E3E6AE649830"><enum>(B)</enum><text>Hunting.</text>
									</subparagraph><subparagraph id="id65C20D8F3F04439F852C102561A79C41"><enum>(C)</enum><text>Rockhounding.</text>
									</subparagraph></paragraph></subsection><subsection id="ID43c93a776e0f483dbb8663eba00c9732"><enum>(c)</enum><header>Terms</header>
								<paragraph id="ID41224c430b254a63a7c1938254867254"><enum>(1)</enum><header>In
				general</header><text>In appointing members under paragraphs (1) through (11)
				of subsection (b), the Secretary shall appoint 1 primary member and 1 alternate
				member that meets the qualifications described in each of those
				paragraphs.</text>
								</paragraph><paragraph id="id96CF1D8711BC41138E088EC856154D08"><enum>(2)</enum><header>Vacancy</header>
									<subparagraph id="id33BA21934E384CADBFC69331EACC3CEA"><enum>(A)</enum><header>Primary
				member</header><text>A vacancy on the advisory committee with respect to a
				primary member shall be filled by the applicable alternate member.</text>
									</subparagraph><subparagraph id="idBC903C6873F943C7A5FC86AEEA39CBE3"><enum>(B)</enum><header>Alternate
				member</header><text>The Secretary shall appoint a new alternate members in the
				event of a vacancy with respect to an alternate member of the advisory
				committee.</text>
									</subparagraph></paragraph><paragraph id="IDae8d0342001843a7b52fbc673f325b70"><enum>(3)</enum><header>Termination</header>
									<subparagraph id="idC6EAE8638E5D4F05961D5CF91C757A61"><enum>(A)</enum><header>In
				general</header><text>The term of all members of the advisory committee shall
				terminate on the termination of the advisory committee under subsection
				(g).</text>
									</subparagraph><subparagraph id="id0ECF459F6B4B452C9D7735B5DF4B1DFD"><enum>(B)</enum><header>New advisory
				committee</header><text>At the discretion of the Secretary, the Secretary may
				establish a new advisory committee on the termination of the advisory committee
				under subsection (g) to provide ongoing recommendations on the management of
				the Monument.</text>
									</subparagraph></paragraph></subsection><subsection id="IDdfb2c909cca4439dabc5c68f61f63672"><enum>(d)</enum><header>Quorum</header><text>A
				quorum of the advisory committee shall consist of a majority of the primary
				members.</text>
							</subsection><subsection id="ID1b2d4dd0b3c640af82d53a651ba13f71"><enum>(e)</enum><header>Chairperson and
				procedures</header>
								<paragraph id="idF0E11F04D54F4CBB8A73BE9BA8A15C3D"><enum>(1)</enum><header>In
				general</header><text>The advisory committee shall select a chairperson and
				vice chairperson from among the primary members of the advisory
				committee.</text>
								</paragraph><paragraph id="id5992307FFC934E35834B480DFB9763F2"><enum>(2)</enum><header>Duties</header><text>The
				chairperson and vice chairperson selected under paragraph (1) shall establish
				any rules and procedures for the advisory committee that the chairperson and
				vice-chairperson determine to be necessary or desirable.</text>
								</paragraph></subsection><subsection id="ID414bbf91430744efb7c7d6b8a0b6e94c"><enum>(f)</enum><header>Service without
				compensation</header><text>Members of the advisory committee shall serve
				without pay.</text>
							</subsection><subsection id="ID1a0c5fd205054338a4ea7a1679ece111"><enum>(g)</enum><header>Termination</header><text>The
				advisory committee shall cease to exist on—</text>
								<paragraph id="id36A3D2A58AA247BC9FD22CBA8A3947AC"><enum>(1)</enum><text>the date on which
				the management plan is officially adopted by the Secretary; or</text>
								</paragraph><paragraph id="idCB87BD86ABAC48D0925523D07AC7F937"><enum>(2)</enum><text>at the discretion
				of the Secretary, a later date established by the Secretary.</text>
								</paragraph></subsection></section><section id="idE923E58AB6514CDFA68AC332A20F77B0"><enum>1307.</enum><header>Renewable
				energy right-of-way applications</header>
							<subsection id="ID12b35d82f4254407b041195dfb36ca47"><enum>(a)</enum><header>In
				general</header><text>Applicants for rights-of-way for the development of solar
				energy facilities that have been terminated by the establishment of the
				Monument shall be granted the right of first refusal to apply for replacement
				sites that—</text>
								<paragraph id="ID06c65940c5ce4a92867c45db1ffca382"><enum>(1)</enum><text>have not
				previously been encumbered by right-of-way applications; and</text>
								</paragraph><paragraph id="ID7a9f320750f8465db76ee34dd1e24689"><enum>(2)</enum><text>are located
				within the Solar Energy Zones designated by the Solar Energy Programmatic
				Environmental Impact Statement of the Department of the Interior and the
				Department of Energy.</text>
								</paragraph></subsection><subsection id="ID754a065b1a3544d59a441e97e9e27901"><enum>(b)</enum><header>Eligibility</header><text>To
				be eligible for a right of first refusal under subsection (a), an applicant
				shall have, on or before December 1, 2009—</text>
								<paragraph id="idFA93270A95C940CF9119E77D0352A198"><enum>(1)</enum><text>submitted an
				application for a right-of-way to the Bureau of Land Management;</text>
								</paragraph><paragraph id="id313EB3862B614B0FAE8EB9313C78D377"><enum>(2)</enum><text>completed a plan
				of development to develop a solar energy facility on land within the
				Monument;</text>
								</paragraph><paragraph id="id8CC228C42A354A179DCC09DC3F509F71"><enum>(3)</enum><text>submitted cost
				recovery funds to the Bureau of Land Management to assist with the costs of
				processing the right-of-way application;</text>
								</paragraph><paragraph id="id527FFA6912524A188106F8FB174E0950"><enum>(4)</enum><text>successfully
				submitted an application for an interconnection agreement with an electrical
				grid operator that is registered with the North American Electric Reliability
				Corporation; and</text>
								</paragraph><paragraph id="ID1d6f9b4752de4aa88012e3e78d3ab85a"><enum>(5)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id765603277AE24C3CB03555339D310A3C"><enum>(A)</enum><text>secured a power
				purchase agreement; or</text>
									</subparagraph><subparagraph id="ID95bc7c14b7184502978d63c953a3e00d" indent="up1"><enum>(B)</enum><text>a financially and technically viable
				solar energy facility project, as determined by the Director of the Bureau of
				Land Management.</text>
									</subparagraph></paragraph></subsection><subsection id="IDdbce7bfb9e524d17b837834826ef1a8a"><enum>(c)</enum><header>Equivalent
				energy production</header><text>Each right-of-way for a replacement site
				granted under this section shall—</text>
								<paragraph id="ID4961385e467c40909aef17040c64644e"><enum>(1)</enum><text>authorize the
				same energy production at the replacement site as had been applied for at the
				site that had been the subject of the terminated application; and</text>
								</paragraph><paragraph id="IDda6a71fe80a34debac22d93065e9cd9f"><enum>(2)</enum><text>have—</text>
									<subparagraph id="IDade570b1e9284fbbb289c4eadffb530e"><enum>(A)</enum><text>appropriate solar
				insolation and geotechnical attributes; and</text>
									</subparagraph><subparagraph id="ID253b506e24a44976a14a43ad814cb0ce"><enum>(B)</enum><text>adequate access
				to existing transmission or feasible new transmission.</text>
									</subparagraph></paragraph></subsection><subsection id="ID00b257e87574493d9592401dbf003e02"><enum>(d)</enum><header>Existing
				rights-of-Way applications</header><text>Nothing in this section alters,
				affects, or displaces primary rights-of-way applications within the Solar
				Energy Study Areas unless the applications are otherwise altered, affected, or
				displaced as a result of the Solar Energy Programmatic Environmental Impact
				Statement of the Department of the Interior and the Department of
				Energy.</text>
							</subsection><subsection id="ID2fbde7ee7de2467d80c633b537a9076c"><enum>(e)</enum><header>Deadlines</header><text>A
				right of first refusal granted under this section shall only be exercisable by
				the later of—</text>
								<paragraph id="ID1bb4a295811a4042ab8e258a5d461921"><enum>(1)</enum><text>the date that is
				180 days after the date of enactment of this title; or</text>
								</paragraph><paragraph id="ID02eda90bcd63492c83b64bc20adc7b86"><enum>(2)</enum><text>the date that is
				180 days after the date of the designation of the Solar Energy Zones under the
				Solar Energy Programmatic Environmental Impact Statement.</text>
								</paragraph></subsection><subsection id="ID300db26ccb8b45469649eddc651c3c60"><enum>(f)</enum><header>Expedited
				application processing</header><text>The Secretary shall expedite the review of
				replacement site applications from eligible applicants, as described in
				subsection (b).</text>
							</subsection></section></title><title id="idB0A7560257CE483DB26AE09CB6983F9B"><enum>XIV</enum><header>Sand to Snow
				National Monument</header>
						<section id="id7A68159BC68E46B69422914094D7E635"><enum>1401.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>
							<paragraph id="id7391503F84334FF69423F55D483C387E"><enum>(1)</enum><header>Map</header><text>The
				term <quote>map</quote> means the map entitled <quote>Boundary Map, Sand to
				Snow National Monument</quote> and dated October 26, 2009.</text>
							</paragraph><paragraph id="id28ECEF376AC4496AB5A1FEB8176B82B6"><enum>(2)</enum><header>Monument</header><text>The
				term <quote>Monument</quote> means the Sand to Snow National Monument
				established by section 1402(a).</text>
							</paragraph><paragraph id="id62F9E3AA894B4478AD88F59500873901"><enum>(3)</enum><header>Secretaries</header><text>The
				term <quote>Secretaries</quote> means the Secretary of the Interior and the
				Secretary of Agriculture, acting jointly.</text>
							</paragraph></section><section id="id6FD1D36875E24D2F98AABC72B61C1886"><enum>1402.</enum><header>Establishment
				of the Sand to Snow National Monument</header>
							<subsection id="id69FE926DDE4345209B435BDE6D3DE5AF"><enum>(a)</enum><header>Establishment</header><text>There
				is designated in the State the Sand to Snow National Monument.</text>
							</subsection><subsection id="id272F517C432741D589011506CE0740ED"><enum>(b)</enum><header>Purposes</header><text>The
				purposes of the Monument are—</text>
								<paragraph id="idD0B2515E606948A78FB4905A1C191C56"><enum>(1)</enum><text>to preserve the
				nationally significant biological, cultural, educational, geological, historic,
				scenic, and recreational values at the convergence of the Mojave and Colorado
				Desert and the San Bernardino Mountains; and</text>
								</paragraph><paragraph id="id94EE6B49068747D99A6469021F58FC45"><enum>(2)</enum><text>to secure the
				opportunity for present and future generations to experience and enjoy the
				magnificent vistas, wildlife, land forms, and natural and cultural resources of
				the Monument.</text>
								</paragraph></subsection><subsection id="idD7320D7AE13247FEA4DB7FBA5101599E"><enum>(c)</enum><header>Boundaries</header><text>The
				Monument shall consist of the Federal land and Federal interests in land within
				the boundaries depicted on the map.</text>
							</subsection><subsection id="idCB538F05E6BB42CC9370149BDC535ABA"><enum>(d)</enum><header>Map; legal
				descriptions</header>
								<paragraph id="id0F400D53665C494D88E3BC3D880CD969"><enum>(1)</enum><header>Legal
				description</header><text>As soon as practicable after the date of enactment of
				this title, the Secretary shall submit to the Committee on Natural Resources of
				the House of Representatives and the Committee on Energy and Natural Resources
				of the Senate legal descriptions of the Monument, based on the map.</text>
								</paragraph><paragraph id="idD97A75DCC8804503AA833D21F1CA8CA7"><enum>(2)</enum><header>Corrections</header><text>The
				map and legal descriptions of the Monument shall have the same force and effect
				as if included in this title, except that the Secretary may correct clerical
				and typographical errors in the map and legal descriptions.</text>
								</paragraph><paragraph id="idAD4C840AC2F54F8E97C37DB3484F3925"><enum>(3)</enum><header>Availability of
				map</header><text>The map shall be on file and available for public inspection
				in appropriate offices of the Bureau of Land Management.</text>
								</paragraph></subsection></section><section id="idA60AC20675124182BE0888A4A641FFAB"><enum>1403.</enum><header>Management of
				the Monument</header>
							<subsection id="id8555BCC01CBF45C9893203D8A123349B"><enum>(a)</enum><header>In
				general</header><text>The Secretary shall—</text>
								<paragraph id="id3899ACEEC1AF457CA0FFB39710234A7F"><enum>(1)</enum><text>only allow uses
				of the Monument that—</text>
									<subparagraph id="idBFE105FA74A7400EA89ACDC23725B01C"><enum>(A)</enum><text>further the
				purposes described in section 1402(b);</text>
									</subparagraph><subparagraph id="idEACA7F3E4E9E44CD8586EBD76BB3F113"><enum>(B)</enum><text>are included in
				the management plan developed under subsection (g); and</text>
									</subparagraph><subparagraph id="ID9f59b4915feb4aaabc9d77ef11f39826"><enum>(C)</enum><text>do not interfere
				with the utility rights-of-way authorized under section 1405(e); and</text>
									</subparagraph></paragraph><paragraph id="idE62951023DF94001AF8EA71BB6227890"><enum>(2)</enum><text>subject to valid
				existing rights, manage the Monument to protect the resources of the Monument,
				in accordance with—</text>
									<subparagraph id="id06DA3C5B3F3E46A8AFA1B6AD04992C70"><enum>(A)</enum><text>this
				title;</text>
									</subparagraph><subparagraph id="id0D9BCD77259C420086D5F16D8F43F53C"><enum>(B)</enum><text>the Federal Land
				Policy and Management Act of 1976 (43 U.S.C. 1701 et seq.); and</text>
									</subparagraph><subparagraph id="idD5448D61B19D43C0B2E13BDE2C055818"><enum>(C)</enum><text>any other
				applicable provisions of law.</text>
									</subparagraph></paragraph></subsection><subsection id="id406883909B4140598A624C08BEEA5AE8"><enum>(b)</enum><header>Cooperation
				agreements; general authority</header><text>Consistent with the management plan
				and existing authorities applicable to the Monument, the Secretary may enter
				into cooperative agreements and shared management arrangements (including
				special use permits with any person (including educational institutions and
				Indian tribes)), for the purposes of interpreting, researching, and providing
				education on the resources of the Monument.</text>
							</subsection><subsection id="id7B250AE3114B43D099C9FBA341525328"><enum>(c)</enum><header>Administration
				of subsequently acquired land</header><text>Any land or interest in land within
				the boundaries of the Monument that is acquired by the Secretary of the
				Interior or the Secretary of Agriculture after the date of enactment of this
				title shall be managed by the Secretary of Agriculture or the Secretary of the
				Interior, respectively, in accordance with this title.</text>
							</subsection><subsection id="id51FF6EDD9F1E44178D5B61B9DF16290F"><enum>(d)</enum><header>Limitations</header>
								<paragraph id="id106F30BCCA714C858FD9379B47BEEB54"><enum>(1)</enum><header>Property
				rights</header><text>The establishment of the Monument does not—</text>
									<subparagraph id="id4152A32C8A3E4DF5B299D50FC33F22A5"><enum>(A)</enum><text>affect—</text>
										<clause id="id3AA7F5696ABB4238A82ED1E0D178F3AC"><enum>(i)</enum><text>any property
				rights of an Indian reservation, individually held trust land, or any other
				Indian allotments;</text>
										</clause><clause id="idC4BEE4F610BF4E7FB93A4E9CAFD7977E"><enum>(ii)</enum><text>any land or
				interests in land held by the State, any political subdivision of the State, or
				any special district; or</text>
										</clause><clause id="idED7602DF77444EC7BB5C34828904FD11"><enum>(iii)</enum><text>any private
				property rights within the boundaries of the Monument; or</text>
										</clause></subparagraph><subparagraph id="idF325CEBCBC8C41E99C5CE03B3E0F4E13"><enum>(B)</enum><text>grant to the
				Secretary any authority on or over non-Federal land not already provided by
				law.</text>
									</subparagraph></paragraph><paragraph id="idE7DC82D566C6489FB7F22526A87325E8"><enum>(2)</enum><header>Authority</header><text>The
				authority of the Secretary under this title extends only to Federal land and
				Federal interests in land included in the Monument.</text>
								</paragraph></subsection><subsection id="idC55B0897CEF7499F9708398A7D23EA03"><enum>(e)</enum><header>Adjacent
				management</header>
								<paragraph id="idD32240C606A64A689BD6244FAD66E48A"><enum>(1)</enum><header>In
				general</header><text>Nothing in this title creates any protective perimeter or
				buffer zone around the Monument.</text>
								</paragraph><paragraph id="id5603AF3EC0AF4AA68B4002C82E20C6D4"><enum>(2)</enum><header>Activities
				outside monument</header><text>The fact that an activity or use on land outside
				the Monument can be seen or heard within the Monument shall not preclude the
				activity or use outside the boundary of the Monument.</text>
								</paragraph><paragraph id="id4C3E780D472C488F8AE7284C055B462C"><enum>(3)</enum><header>No additional
				regulation</header><text>Nothing in this title requires additional regulation
				of activities on land outside the boundary of the Monument.</text>
								</paragraph></subsection><subsection id="id2D04D80812A849B69DE26121A08CAA87"><enum>(f)</enum><header>Air and water
				quality</header><text>Nothing in this title affects the standards governing air
				or water quality outside the boundary of the Monument.</text>
							</subsection><subsection id="id60BB890BFBB6433C84F3E801E65268DB"><enum>(g)</enum><header>Management
				plan</header>
								<paragraph id="idF3F7F616EAA848EFBAB5080ABF759AC3"><enum>(1)</enum><header>In
				general</header><text>The Secretaries shall—</text>
									<subparagraph id="idFF1F0774F56942D48084A8A52A0FE5DB"><enum>(A)</enum><text>not later than 3
				years after the date of enactment of this title, complete a management plan for
				the conservation and protection of the Monument; and</text>
									</subparagraph><subparagraph id="id975CABBA3D66436698F1E1325807606B"><enum>(B)</enum><text>on completion of
				the management plan—</text>
										<clause id="id2F0246654DAF4B4A9B924FA9870951B2"><enum>(i)</enum><text>submit the
				management plan to—</text>
											<subclause id="idCAF84C0521624890B0C98CDDD940CFF3"><enum>(I)</enum><text>the Committee on
				Natural Resources of the House of Representatives; and</text>
											</subclause><subclause id="id599F9A312641487EACF9D18259612568"><enum>(II)</enum><text>the Committee on
				Energy and Natural Resources of the Senate; and</text>
											</subclause></clause><clause id="id111301F4BD674A4B927103837EA841A2"><enum>(ii)</enum><text>make the
				management plan available to the public.</text>
										</clause></subparagraph></paragraph><paragraph id="id7695497FE1F240ABBC967A6A7A00441B"><enum>(2)</enum><header>Inclusions</header><text>The
				management plan shall include provisions that—</text>
									<subparagraph id="id6D40BA3B6FB743FFA9FB6D5C8D44FC64"><enum>(A)</enum><text>provide for the
				conservation and protection of the Monument;</text>
									</subparagraph><subparagraph id="idEC788C6540E84E9A8BE72FDDB7F7ACEB"><enum>(B)</enum><text>authorize the
				continued recreational uses of the Monument (including hiking, camping,
				hunting, mountain biking, sightseeing, off-highway vehicle recreation on
				designated routes, rockhounding, and horseback riding), if the recreational
				uses are consistent with this title and any other applicable law;</text>
									</subparagraph><subparagraph id="id1B114ABBAEF34BAEB17820B7B8A6A99D"><enum>(C)</enum><text>address the need
				for and, as necessary, establish plans for, the installation, construction, and
				maintenance of public utility energy transport facilities within rights-of-way
				in the Monument outside of designated wilderness areas, including provisions
				that require that—</text>
										<clause id="id7DB3B4F65C8B4202B348C84E7EA86939"><enum>(i)</enum><text>the activities be
				conducted in a manner that minimizes the impact on Monument resources
				(including resources relating to the ecological, cultural, historic, and scenic
				viewshed of the Monument), in accordance with any other applicable law;
				and</text>
										</clause><clause id="id7A0F721A37814AFEB68003E8FD5710BC"><enum>(ii)</enum><text>the facilities
				are consistent with this section and any other applicable law;</text>
										</clause></subparagraph><subparagraph id="idCAD112A5B3134EF689664068A5C18B30"><enum>(D)</enum><text>address the
				designation and maintenance of roads, trails, and paths in the Monument;</text>
									</subparagraph><subparagraph id="id8E600E0A39E347BABD86911FC31C889F"><enum>(E)</enum><text>address regional
				fire management planning and coordination between the Director of the Bureau of
				Land Management, the Chief of the Forest Service, Riverside County, and San
				Bernardino County; and</text>
									</subparagraph><subparagraph id="ID20ca1c23e2154ff6aed13a310145a6bd"><enum>(F)</enum><text>address the
				establishment of a visitor center to serve the Monument and adjacent public
				land.</text>
									</subparagraph></paragraph><paragraph id="id92C9F3F020D34B9691065A8C5AC2EB0B"><enum>(3)</enum><header>Preparation and
				implementation</header>
									<subparagraph id="id7431F2CAAFF24D06BA4E666247AA22E1"><enum>(A)</enum><header>Applicable
				law</header><text>The Secretary shall prepare and implement the management plan
				in accordance with the National Environmental Policy Act of 1969 (42 U.S.C.
				4321 et seq.) and any other applicable laws.</text>
									</subparagraph><subparagraph id="idD740142930AB44D2A277E68ADDED3F3F"><enum>(B)</enum><header>Consultation</header><text>In
				preparing and implementing the management plan, the Secretary shall
				periodically consult with—</text>
										<clause id="id0A8CCE7927E0474C9D683755D07959B5"><enum>(i)</enum><text>the advisory
				committee established under section 1406;</text>
										</clause><clause id="id096E178B02BE49DDAA9CA4BFF57D6A0B"><enum>(ii)</enum><text>interested
				private property owners and holders of valid existing rights located within the
				boundaries of the Monument; and</text>
										</clause><clause id="idB0C9B1D0CCC0413781C7BEE507374FCD"><enum>(iii)</enum><text>representatives
				of the Morongo Band of Mission Indians and other Indian tribes with historic or
				cultural ties to land within, or adjacent to, the Monument regarding the
				management of portions of the Monument that are of cultural importance to the
				Indian tribes.</text>
										</clause></subparagraph></paragraph><paragraph id="idA28D860E3DD14BAAB328E3BB0253D815"><enum>(4)</enum><header>Interim
				management</header><text>Except as otherwise prohibited by this Act, pending
				completion of the management plan for the Monument, the Secretary shall manage
				any Federal land and Federal interests in land within the boundary of the
				Monument—</text>
									<subparagraph id="idADA0DE5B673144928ACA42492A9F0F08"><enum>(A)</enum><text>consistent with
				the existing permitted uses of the land;</text>
									</subparagraph><subparagraph id="id7B2164C0A7094F87B3B42E4583447FA8"><enum>(B)</enum><text>in accordance
				with the general guidelines and authorities of the existing management plans of
				the Bureau of Land Management and the Forest Service for the land; and</text>
									</subparagraph><subparagraph id="id6CC4688803C3454F8E8DCD8FE88182B7"><enum>(C)</enum><text>in a manner
				consistent with—</text>
										<clause id="idCBB9C6647C314C12850A9235CCF0E1BC"><enum>(i)</enum><text>the purposes
				described in section 1402(b);</text>
										</clause><clause id="idC9A24A46CFCD4287AFA0ADDB43E56F99"><enum>(ii)</enum><text>the provisions
				of the management plan under paragraph (2); and</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="id842288A1D285458A926BDCF8F588B7D7"><enum>(iii)</enum><text>applicable
				Federal law.</text>
										</clause></subparagraph></paragraph><paragraph id="idDAFD2009D5B643779ADA99E5C0B26EE9"><enum>(5)</enum><header>Effect of
				section</header><text>Nothing in this section diminishes or alters existing
				authorities applicable to Federal land included in the Monument.</text>
								</paragraph></subsection></section><section id="idB5494447EEE0421C98C80FA9E002766B"><enum>1404.</enum><header>Uses of the
				Monument</header>
							<subsection id="id0D8F263DD9C74DA1A45394A202BD10F6"><enum>(a)</enum><header>Use of
				off-Highway vehicles</header>
								<paragraph id="id0D8704F78DA1429BBFBE2BCDDE6284C0"><enum>(1)</enum><header>In
				general</header><text>The use of off-highway vehicles in the Monument
				(including the use of off-highway vehicles for commercial touring) shall be
				permitted to continue on designated routes, subject to all applicable law and
				authorized by the management plan.</text>
								</paragraph><paragraph id="id07C62230F5D44FDF97BEB23F358C1EA5"><enum>(2)</enum><header>Nondesignated
				routes</header><text>Off-highway vehicle access shall be permitted on
				nondesignated routes and trails in the Monument—</text>
									<subparagraph id="idCC2AD62189824A8AA636E53D5A6806D4"><enum>(A)</enum><text>for
				administrative purposes;</text>
									</subparagraph><subparagraph id="idBCFF56F45E5E4638A38F0D1642FE7414"><enum>(B)</enum><text>to respond to an
				emergency; or</text>
									</subparagraph><subparagraph id="idB22FDA6106F84F24A4951D8877E056FD"><enum>(C)</enum><text>as authorized
				under the management plan.</text>
									</subparagraph></paragraph><paragraph id="id411F7E62059E42D49E0FDB5EBE212532"><enum>(3)</enum><header>Inventory</header><text>Not
				later than 2 years after the date of enactment of this title, the Director of
				the Bureau of Land Management shall complete an inventory of all existing
				routes in the Monument.</text>
								</paragraph></subsection><subsection id="idB8F03C05ECB148AC8B6D72401B8CA3AB"><enum>(b)</enum><header>Hunting,
				trapping, and fishing</header>
								<paragraph id="id2B2E81CD2E6F4E6283EAAEE9A5F4C4E5"><enum>(1)</enum><header>In
				general</header><text>Except as provided in paragraph (2), the Secretary shall
				permit hunting, trapping, and fishing within the Monument in accordance with
				applicable Federal and State laws (including regulations) as of the date of
				enactment of this title.</text>
								</paragraph><paragraph id="idF060CA4E002B456A822C66EBE281D55E"><enum>(2)</enum><header>Trapping</header><text>No
				amphibians or reptiles may be collected within the Monument.</text>
								</paragraph><paragraph id="id6ADB3FCFECCA4F9D9BDFB601B6D13D3A"><enum>(3)</enum><header>Regulations</header><text>The
				Secretary, after consultation with the California Department of Fish and Game,
				may issue regulations designating zones where, and establishing periods during
				which, no hunting, trapping, or fishing shall be permitted in the Monument for
				reasons of public safety, administration, resource protection, or public use
				and enjoyment.</text>
								</paragraph></subsection><subsection id="id40BAA9BE382A400CB5CCA35612978764"><enum>(c)</enum><header>Access to State
				and private land</header><text>The Secretary shall provide adequate access to
				each owner of non-Federal land or interests in non-Federal land within the
				boundary of the Monument to ensure the reasonable use and enjoyment of the land
				or interest by the owner.</text>
							</subsection><subsection id="id2A08ED18E44E48A6B1E4ACD1117136D7"><enum>(d)</enum><header>Limitations</header>
								<paragraph id="id988AD9782FBC4E7FA0B00132BC612E7F"><enum>(1)</enum><header>Commercial
				enterprises</header><text>Except as provided in paragraphs (2) and (3), or as
				required for the maintenance, upgrade, expansion, or development of energy
				transport facilities in the corridors described in subsection (e), no
				commercial enterprises shall be authorized within the boundary of the Monument
				after the date of enactment of this title.</text>
								</paragraph><paragraph id="idEA694201105A421C9F16951AD4D5276E"><enum>(2)</enum><header>Authorized
				exceptions</header><text>The Secretary may authorize exceptions to paragraph
				(1) if the Secretary determines that the commercial enterprises would further
				the purposes described in section 1402(b).</text>
								</paragraph><paragraph id="id06B155E819A44A15BD88F809E4057A51"><enum>(3)</enum><header>Transmission
				and telecommunication facilities</header><text>This subsection does not apply
				to—</text>
									<subparagraph id="id26B641C2C54B431B9BB80C8F06A19ECD"><enum>(A)</enum><text>transmission and
				telecommunication facilities that are owned or operated by a utility subject to
				regulation by the Federal Government or a State government or a State utility
				with a service obligation (as those terms are defined in section 217 of the
				Federal Power Act (16 U.S.C. 824q)); or</text>
									</subparagraph><subparagraph id="IDcde946f989d94420b1e4754cbf5ace73"><enum>(B)</enum><text>commercial
				vehicular touring enterprises within the Monument that operate on designated
				routes.</text>
									</subparagraph></paragraph></subsection><subsection id="ID69b7d944a7ae47e398ada3928c2953d8"><enum>(e)</enum><header>Utility
				rights-of-Way</header>
								<paragraph id="idB49A75F0C2CB4F1BBF082DE4BD19C283"><enum>(1)</enum><header>In
				general</header><text>Nothing in this Act precludes, prevents, or inhibits the
				maintenance, upgrade, expansion, or development of energy transport facilities
				within the Monument that are critical to reducing the effects of climate change
				on the environment.</text>
								</paragraph><paragraph id="id7FC0A078A8284B2BB645A099588632D0"><enum>(2)</enum><header>Right-of-way</header><text>To
				the maximum extent practicable—</text>
									<subparagraph id="id3A440D3E056A490AAE6BB0FB112CAD0F"><enum>(A)</enum><text>the Secretary
				shall permit rights of way and alignments that best protect the values and
				resources of the Monument described in section 1402(b); and</text>
									</subparagraph><subparagraph id="ID9e9ec8a550664b3fa9ce4c282f227475"><enum>(B)</enum><text>the Secretary
				shall ensure that existing rights-of-way and utility corridors within the
				Monument are fully utilized before permitting new rights-of-way or designating
				new utility corridors within the Monument.</text>
									</subparagraph></paragraph><paragraph id="id367B7FFF84654CBEB815A4391646AE07"><enum>(3)</enum><header>Effect on
				existing facilities and rights-of-way</header><text>Nothing in this section
				terminates or limits—</text>
									<subparagraph id="idDFACC1E124C44874914E3AA0713CEA14"><enum>(A)</enum><text>any valid
				right-of-way in existence within the Monument on the date of enactment of this
				title (including customary operation, maintenance, repair, or replacement
				activities in a right-of-way); or</text>
									</subparagraph><subparagraph id="id25A158B377C04811BBBF1B90BF71F600"><enum>(B)</enum><text>a right-of-way
				authorization issued on the expiration or the assignment of an existing
				right-of-way authorization described in subparagraph (A).</text>
									</subparagraph></paragraph><paragraph id="idC68F5F590A2A47FEA0811D189E10E79D"><enum>(4)</enum><header>Upgrading and
				expansion of existing rights-of-way</header><text>Nothing in this subsection
				prohibits the upgrading (including the construction or replacement), expansion,
				or assignment of an existing utility transmission line for the purpose of
				increasing the capacity of—</text>
									<subparagraph id="id17CF0D0BAD494F2698D9A5C9A00ED8C6"><enum>(A)</enum><text>a transmission
				line in existing rights-of-way; or</text>
									</subparagraph><subparagraph id="idE16ED8835D3F4054950080A1939EEC8C"><enum>(B)</enum><text>a right-of-way
				issued, granted, or permitted by the Secretary that is contiguous or adjacent
				to existing transmission line rights-of-way.</text>
									</subparagraph></paragraph><paragraph id="id9D4FDBDF0D0A4E60990141D9F2DBD1F3"><enum>(5)</enum><header>New
				rights-of-way</header>
									<subparagraph id="id36347CBD7E8D4AB0A606106009C3B57F"><enum>(A)</enum><header>In
				general</header><text>Any new rights-of-way or new uses within existing
				rights-of-way shall, subject to subparagraph (B), require review and approval
				under the <act-name parsable-cite="NEPA69">National Environmental Policy Act of
				1969</act-name> (42 U.S.C. 4321 et seq.).</text>
									</subparagraph><subparagraph id="idCD990ECC084B404F8A128F1F84B5A28D"><enum>(B)</enum><header>Approval</header><text>New
				uses under subparagraph (A) shall only be approved if the head of the
				applicable lead Federal agency, in consultation with other applicable agencies,
				determine that the uses are consistent with—</text>
										<clause id="idA2A6F1EDB7B54EF9975C4B547DC91F3F"><enum>(i)</enum><text>this
				title;</text>
										</clause><clause id="idE395A8F7463B4A2F9C70F688145E0AB3"><enum>(ii)</enum><text>other applicable
				laws;</text>
										</clause><clause id="id87FA444BAF084FB385F86C0193D740A9"><enum>(iii)</enum><text>the purposes of
				the Monument described in section 1402(b); and</text>
										</clause><clause id="id9F3FAB70413F4EC2894E94FF97FB0DD0"><enum>(iv)</enum><text>the management
				plan for the Monument.</text>
										</clause></subparagraph></paragraph><paragraph commented="no" id="id159233D5ECA64C2695AE8E3FD8609331"><enum>(6)</enum><header>Effect on
				energy transport corridors</header><text>Nothing in this subsection diminishes
				the utility of energy transport corridors located within the Monument
				designated by a record of decision—</text>
									<subparagraph commented="no" id="id6A2F95AE3ABA4CCBBE7D151B3A2FCA47"><enum>(A)</enum><text>to provide
				locations for—</text>
										<clause commented="no" id="idEECBF0EA67D04811B2AD84AC0306EE54"><enum>(i)</enum><text>electric
				transmission facilities that improve reliability, relieve congestion, and
				enhance the national grid; and</text>
										</clause><clause commented="no" id="id0A824EE0AD7741C6953B416BEC09E304"><enum>(ii)</enum><text>oil, gas, and
				hydrogen pipelines; and</text>
										</clause></subparagraph><subparagraph commented="no" id="id9A43AAFCD2204D50843D3AB6413A851D"><enum>(B)</enum><text>to provide
				locations for electric transmission facilities that—</text>
										<clause commented="no" id="id24DBA05FCCA64AECB8BA00A49562CAFE"><enum>(i)</enum><text>promote renewable
				energy generation;</text>
										</clause><clause commented="no" id="idC5B4417673B141CCAA9D302C62149F68"><enum>(ii)</enum><text>otherwise
				further the interest of the United States if the transmission facilities are
				identified as critical in law or through a regional transmission planning
				process; or</text>
										</clause><clause commented="no" id="id055A2E24AE6347A4995287ADD3ED0D9B"><enum>(iii)</enum><text>consist of
				high-voltage transmission facilities critical to the purposes described in
				clause (i) or (ii).</text>
										</clause></subparagraph></paragraph><paragraph commented="no" id="idD1CBBC0378D94753BEE49375DB906D08"><enum>(7)</enum><header>Land use
				planning</header><text>In conducting land use planning for the Monument, the
				Secretary—</text>
									<subparagraph commented="no" id="id08600757F6DC4878A7494AE9C8427182"><enum>(A)</enum><text>shall consider
				the existing locations of the corridors described in paragraph (6); and</text>
									</subparagraph><subparagraph commented="no" id="id2090458D2A1D4983A5F6CD7D27CCA7DD"><enum>(B)</enum><text>subject to
				paragraph (8), may amend the location of any energy corridors to comply with
				purposes of the Monument if the amended corridor—</text>
										<clause commented="no" id="id83B99756685B499A851FF579601EB323"><enum>(i)</enum><text>provides
				connectivity across the landscape that is equivalent to the connectivity
				provided by the existing location;</text>
										</clause><clause commented="no" id="idEAFA810988674AD4AE94834B9111DFAB"><enum>(ii)</enum><text>meets the
				criteria established by—</text>
											<subclause commented="no" id="id4FF55CDF67E040B684CD9B617198FBE2"><enum>(I)</enum><text>section 368 of
				the Energy Policy Act of 2005 (42 U.S.C. 15926); and</text>
											</subclause><subclause commented="no" id="idC3B3D01D735C436F99F0CB253B540270"><enum>(II)</enum><text>the record of
				decision for the applicable corridor; and</text>
											</subclause></clause><clause commented="no" id="id2B3F6EBE8EA147EA85D5C1E8906B1D18"><enum>(iii)</enum><text>does not impair
				or restrict the uses of existing rights-of-way.</text>
										</clause></subparagraph></paragraph><paragraph commented="no" id="idCFA8E70280024D9FA10FDC0675A15B79"><enum>(8)</enum><header>Consultation
				required</header><text>Before amending a corridor under paragraph (7)(B), the
				Secretary shall consult with all interested parties (including the persons
				identified in section 368(a) of the Energy Policy Act of 2005 (42 U.S.C.
				15926(a))), in accordance with applicable laws (including regulations).</text>
								</paragraph></subsection><subsection id="id873F9677E6D64BCBBD7DF3232A0700E0"><enum>(f)</enum><header>Overflights</header><text>Nothing
				in this title or the management plan restricts or precludes—</text>
								<paragraph id="id0C62285A0EE74FDAB807E6D5B50D37AF"><enum>(1)</enum><text>overflights
				(including low-level overflights) of military, commercial, and general aviation
				aircraft that can be seen or heard within the Monument;</text>
								</paragraph><paragraph id="id345BCFEDFE764DF28BCCBBF0282436F8"><enum>(2)</enum><text>the designation
				or creation of new units of special use airspace; or</text>
								</paragraph><paragraph id="idD80442DD3D4049A09FDDB6C5732F5741"><enum>(3)</enum><text>the establishment
				of military flight training routes over the Monument.</text>
								</paragraph></subsection><subsection id="idA1A885F442BA433DA9881543C20A2571"><enum>(g)</enum><header>Withdrawals</header>
								<paragraph id="id67886C0D3FBD4FD2AE1E0A4D24B957FA"><enum>(1)</enum><header>In
				general</header><text>Subject to valid existing rights and except as provided
				in paragraph (2), the Federal land and interests in Federal land included
				within the Monument are withdrawn from—</text>
									<subparagraph id="id64AE2A3B81E34D86AFE4F7AE28B3A428"><enum>(A)</enum><text>all forms of
				entry, appropriation, or disposal under the public land laws;</text>
									</subparagraph><subparagraph id="id30196488F1364E1494106255D087D679"><enum>(B)</enum><text>location, entry,
				and patent under the public land mining laws;</text>
									</subparagraph><subparagraph id="id740401DEE083489C9B5CED50EE87E9A6"><enum>(C)</enum><text>operation of the
				mineral leasing, geothermal leasing, and mineral materials laws; and</text>
									</subparagraph><subparagraph id="id6AD3F024DBB5482CA46E2B921A6C131F"><enum>(D)</enum><text>energy
				development and power generation.</text>
									</subparagraph></paragraph><paragraph id="id25A07198681A4C0EA615BFD8872DC232"><enum>(2)</enum><header>Exchange</header><text>Paragraph
				(1) does not apply to an exchange that the Secretary determines would further
				the protective purposes of the Monument.</text>
								</paragraph></subsection><subsection id="id7757CC1F0C054399BFF660DFD34FC2D4"><enum>(h)</enum><header>Access to
				renewable energy facilities</header>
								<paragraph id="id10547CB1DB3D404799A123A32B7E5B9A"><enum>(1)</enum><header>In
				general</header><text>Subject to paragraph (2), the Secretary may allow new
				right-of-ways within the Monument to provide reasonable vehicular access to
				renewable energy project sites outside the boundaries of the Monument.</text>
								</paragraph><paragraph id="idBC6CCA49F61F45B3A0541C13A259A621"><enum>(2)</enum><header>Restrictions</header><text>To
				the maximum extent practicable, the rights-of-way shall be designed and sited
				to be consistent with the purposes of the Monument described in section
				1402(b).</text>
								</paragraph></subsection></section><section id="idC7C473D19C1B4581B8C7BA09F13AF7C5"><enum>1405.</enum><header>Acquisition
				of land</header>
							<subsection id="id7C2020814C17406AB15C1CC76874D670"><enum>(a)</enum><header>In
				general</header><text>The Secretary may acquire for inclusion in the Monument
				any land or interests in land within the boundary of the Monument owned by the
				State, units of local government, Indian tribes, or private individuals only
				by—</text>
								<paragraph id="id0AEFB037FA3348FB8009B4520EA87AA7"><enum>(1)</enum><text>donation;</text>
								</paragraph><paragraph id="id08233C8CF06840BB994E3054F03F174D"><enum>(2)</enum><text>exchange with a
				willing party; or</text>
								</paragraph><paragraph id="idCB6A1A4032BF4973BE1AF7407B7791A4"><enum>(3)</enum><text>purchase from a
				willing seller for fair market value.</text>
								</paragraph></subsection><subsection id="idA753A7661ADB4ADA86B946796FD724B3"><enum>(b)</enum><header>Use of
				easements</header><text>To the maximum extent practicable and only with the
				approval of the landowner, the Secretary may use permanent conservation
				easements to acquire an interest in land in the Monument rather than acquiring
				fee simple title to the land.</text>
							</subsection><subsection id="id2F0BC78D1C9046A7B235C8F3127CC343"><enum>(c)</enum><header>Incorporation
				of acquired land and interests in land</header><text>Any land or interest in
				land within the boundaries of the Monument that is acquired by the United
				States after the date of enactment of this title shall be added to and
				administered as part of the Monument.</text>
							</subsection><subsection id="idBDB32ED15E064A4CAE6BF817863651D2"><enum>(d)</enum><header>Donated and
				acquired land</header>
								<paragraph id="id2EFA7B6918954106B430B0DE437C3FF4"><enum>(1)</enum><header>In
				general</header><text>All land within the boundary of the Monument donated to
				the United States or acquired using amounts from the land and water
				conservation fund established under section 2 of the
				<act-name parsable-cite="LWCFA">Land and Water Conservation Fund Act of 1965
				(16 U.S.C. 460l</act-name>–5) before, on, or after the date of enactment of
				this title—</text>
									<subparagraph id="id1D003C0F84C54A6DB51F30996EBC7840"><enum>(A)</enum><text>is withdrawn from
				mineral entry;</text>
									</subparagraph><subparagraph id="idD20146AC500042E8A962582B85CB39A8"><enum>(B)</enum><text>shall be managed
				in accordance with section 1904; and</text>
									</subparagraph><subparagraph id="idA1BA8F21B3EF499EA62454B2EB2157B2"><enum>(C)</enum><text>shall be managed
				consistent with the purposes of the Monument described in section
				1402(b).</text>
									</subparagraph></paragraph><paragraph id="idD9F44CCF401246738237A280E05A60A0"><enum>(2)</enum><header>Effect on
				monument</header><text>Land within the boundary of the Monument that is
				contiguous to land donated to the United States or acquired using amounts from
				the land and water conservation fund established under section 2 of the
				<act-name parsable-cite="LWCFA">Land and Water Conservation Fund Act of 1965
				(16 U.S.C. 460l</act-name>–5) shall be managed in a manner consistent with
				conservation purposes, subject to applicable law.</text>
								</paragraph></subsection></section><section id="id8FB0CA5CA9304D23B6433A9737673E0A"><enum>1406.</enum><header>Advisory
				Committee</header>
							<subsection id="idAE5F08A2771247BEB82C572046C09C1C"><enum>(a)</enum><header>In
				general</header><text>The Secretary shall establish an advisory committee for
				the Monument, the purpose of which is to advise the Secretary with respect to
				the preparation and implementation of the management plan required by section
				1403(g).</text>
							</subsection><subsection id="id37A0F4E0EB224313920FD998F7443046"><enum>(b)</enum><header>Membership</header><text>To
				the extent practicable, the advisory committee shall include the following
				members, to be appointed by the Secretary:</text>
								<paragraph id="id57A94CEDE47640E49644A9AB197A99FA"><enum>(1)</enum><text>A representative
				with expertise in natural science and research selected from a regional
				university or research institute.</text>
								</paragraph><paragraph id="id315946159FA842DD9660D4CDE5E7FF4D"><enum>(2)</enum><text>A representative
				of the Department of Defense.</text>
								</paragraph><paragraph id="id38C5986F6E6D446CBE5E2C77AA5127E8"><enum>(3)</enum><text>A representative
				of the California Natural Resources Agency.</text>
								</paragraph><paragraph id="id8FDB6ADAB9E3499BAC6C61569399731E"><enum>(4)</enum><text>A representative
				of each of San Bernardino and Riverside Counties, California.</text>
								</paragraph><paragraph id="id993DEDAE13874CBDA134F746B8D537A5"><enum>(5)</enum><text>A representative
				of each of the cities of Desert Hot Springs and Yucca Valley,
				California.</text>
								</paragraph><paragraph id="idA033736F294E447BBA18862C94EACA43"><enum>(6)</enum><text>A representative
				of the Morongo Band of Mission Indians.</text>
								</paragraph><paragraph id="idFAF33C1D4F9346CF9D67C1DD82D93D0E"><enum>(7)</enum><text>A representative
				of the Friends of Big Morongo Preserve.</text>
								</paragraph><paragraph id="idD626248D6F11449B96C24D3F7E18FBF5"><enum>(8)</enum><text>A representative
				of the Wildlands Conservancy.</text>
								</paragraph><paragraph id="idBCE16A182066421E8EF26519212CBC3C"><enum>(9)</enum><text>A representative
				of the Coachella Valley Mountains Conservancy.</text>
								</paragraph><paragraph id="ID018fa0383643438592d8082f373923e8"><enum>(10)</enum><text>A representative
				of the San Gorgonio Wilderness Association.</text>
								</paragraph><paragraph id="ID8c7a613a8de442c28b2e9bc85dd5e2a7"><enum>(11)</enum><text>A representative
				of the Morongo Basin Community Services District.</text>
								</paragraph><paragraph id="id13320F4BCBAB42F6B5C12331BFBA96A6"><enum>(12)</enum><text>A representative
				from each of the following recreational activities:</text>
									<subparagraph id="idFFB2ADD3F0814805AC210F8E2963B33D"><enum>(A)</enum><text>Off-highway
				vehicles.</text>
									</subparagraph><subparagraph id="idC714E44DA2264612AE97B2EF31AC5163"><enum>(B)</enum><text>Hunting.</text>
									</subparagraph><subparagraph id="idE97EE5BD92F444F49622216E578F289C"><enum>(C)</enum><text>Rockhounding.</text>
									</subparagraph></paragraph></subsection><subsection id="id5F47100170CC45D69E8CB6C53D9F70D5"><enum>(c)</enum><header>Terms</header>
								<paragraph id="idBD90F352837547A99022FF70CBCC4449"><enum>(1)</enum><header>In
				general</header><text>In appointing members under paragraphs (1) through (12)
				of subsection (b), the Secretary shall appoint 1 primary member and 1 alternate
				member that meets the qualifications described in each of those
				paragraphs.</text>
								</paragraph><paragraph id="idB6B981F596B94EFAB38B52F893FC679E"><enum>(2)</enum><header>Vacancy</header>
									<subparagraph id="id161EE8BD8F1749EF80ACB5F1B0D2CB19"><enum>(A)</enum><header>Primary
				member</header><text>A vacancy on the advisory committee with respect to a
				primary member shall be filled by the applicable alternate member.</text>
									</subparagraph><subparagraph id="id43B4892630EE4D70B73B17522078D528"><enum>(B)</enum><header>Alternate
				member</header><text>The Secretary shall appoint a new alternate members in the
				event of a vacancy with respect to an alternate member of the advisory
				committee.</text>
									</subparagraph></paragraph><paragraph id="id8C7EBECF80B6482AA2300E3A288AB704"><enum>(3)</enum><header>Termination</header>
									<subparagraph id="id809BEAEC4DB744F4A7555C97685A272F"><enum>(A)</enum><header>In
				general</header><text>The term of all members of the advisory committee shall
				terminate on the termination of the advisory committee under subsection
				(g).</text>
									</subparagraph><subparagraph id="id54DFA1D6CF1F4D5D9732752391D4EF18"><enum>(B)</enum><header>New advisory
				committee</header><text>At the discretion of the Secretary, the Secretary may
				establish a new advisory committee on the termination of the advisory committee
				under subsection (g) to provide ongoing recommendations on the management of
				the Monument.</text>
									</subparagraph></paragraph></subsection><subsection id="id282EFCB04A8A402584423922C37647BA"><enum>(d)</enum><header>Quorum</header><text>A
				quorum of the advisory committee shall consist of a majority of the primary
				members.</text>
							</subsection><subsection id="id277B55810F354C6F91E73A6394AB1657"><enum>(e)</enum><header>Chairperson and
				procedures</header>
								<paragraph id="id1FCA10CAE3A04D229C2047BC245594DB"><enum>(1)</enum><header>In
				general</header><text>The advisory committee shall select a chairperson and
				vice chairperson from among the primary members of the advisory
				committee.</text>
								</paragraph><paragraph id="id2D5DAB37008A4FF894CD7BCF6AA5F91C"><enum>(2)</enum><header>Duties</header><text>The
				chairperson and vice chairperson selected under paragraph (1) shall establish
				any rules and procedures for the advisory committee that the chairperson and
				vice-chairperson determine to be necessary or desirable.</text>
								</paragraph></subsection><subsection id="idAE52859D764343AEACA7647EA35405C9"><enum>(f)</enum><header>Service without
				compensation</header><text>Members of the advisory committee shall serve
				without pay.</text>
							</subsection><subsection id="id72044EB685F44166B8259574FAECE169"><enum>(g)</enum><header>Termination</header><text>The
				advisory committee shall cease to exist on—</text>
								<paragraph id="id7A7B08C2F023480E931AE99BBB493E77"><enum>(1)</enum><text>the date on which
				the management plan is officially adopted by the Secretary; or</text>
								</paragraph><paragraph id="idDF217FBF22BA4EA99B7C73E2548C9C82"><enum>(2)</enum><text>at the discretion
				of the Secretary, a later date established by the Secretary.</text>
								</paragraph></subsection></section></title><title id="id1E5B0A75CEC04BB5B2579B5653212EAD"><enum>XV</enum><header>Wilderness</header>
						<section id="id8E98D26B587B4FC392B4DCA677D3EE1C"><enum>1501.</enum><header>Designation
				of wilderness areas</header>
							<subsection id="id8D8263FD7684417CABE2E261CC35AD54"><enum>(a)</enum><header>Designation of
				wilderness areas To be administered by the Bureau of Land
				Management</header><text display-inline="yes-display-inline">In accordance with
				the Wilderness Act (16 U.S.C. 1131 et seq.) and sections 601 and 603 of the
				Federal Land Policy and Management Act of 1976 (43 U.S.C. 1781, 1782), the
				following land in the State is designated as wilderness areas and as components
				of the National Wilderness Preservation System:</text>
								<paragraph id="ID16e59fb6ebaf4361a1c9b190a566b380"><enum>(1)</enum><header>Avawatz
				mountains wilderness</header><text>Certain land in the Conservation Area
				administered by the Director of the Bureau of Land Management, comprising
				approximately 86,614 acres, as generally depicted on the map entitled
				<quote>Avawatz Mountains Proposed Wilderness</quote> and dated July 15, 2009,
				to be known as the <quote>Avawatz Mountains Wilderness</quote>.</text>
								</paragraph><paragraph id="IDe303cb39c991426782186513af7d7249"><enum>(2)</enum><header>Golden valley
				wilderness</header><text>Certain land in the Conservation Area administered by
				the Director of the Bureau of Land Management, comprising approximately 21,633
				acres, as generally depicted on the map entitled <quote>Golden Valley Proposed
				Wilderness</quote> and dated July 15, 2009, which shall be considered to be
				part of the <quote>Golden Valley Wilderness</quote>.</text>
								</paragraph><paragraph id="IDfd46dd716b1a460c8ba29e9d41b208a1"><enum>(3)</enum><header>Great falls
				basin wilderness</header>
									<subparagraph id="IDe5a8a92f55ed4ee5b3d54ee7ee4ec49e"><enum>(A)</enum><header>In
				general</header><text>Certain land in the Conservation Area administered by the
				Director of the Bureau of Land Management, comprising approximately 7,871
				acres, as generally depicted on the map entitled <quote>Great Falls Basin
				Proposed Wilderness</quote> and dated October 26, 2009, to be known as the
				<quote>Great Falls Basin Wilderness</quote>.</text>
									</subparagraph><subparagraph id="IDedc385ddea8247b2be13d5eaad923af4"><enum>(B)</enum><header>Limitations</header><text>Designation
				of the wilderness under subparagraph (A) shall not establish a Class I Airshed
				under the Clean Air Act (42 U.S.C. 7401 et seq.).</text>
									</subparagraph></paragraph><paragraph id="ID67caad60dc834f468576c4bf34380d65"><enum>(4)</enum><header>Kingston range
				wilderness</header><text>Certain land in the Conservation Area administered by
				the Bureau of Land Management, comprising approximately 53,321 acres, as
				generally depicted on the map entitled <quote>Kingston Range Proposed
				Wilderness Additions</quote> and dated July 15, 2009, which shall be considered
				to be a part of as the <quote>Kingston Range Wilderness</quote>.</text>
								</paragraph><paragraph id="ID23bf2a8cbf234bea8ffcc24524eb3fab"><enum>(5)</enum><header>Soda mountains
				wilderness</header><text>Certain land in the Conservation Area, administered by
				the Bureau of Land Management, comprising approximately 79,376 acres, as
				generally depicted on the map entitled <quote>Soda Mountains Proposed
				Wilderness</quote> and dated October 26, 2009, to be known as the <quote>Soda
				Mountains Wilderness</quote>.</text>
								</paragraph></subsection><subsection id="IDd2613f074e1745c8ba5a1b5673720d8d"><enum>(b)</enum><header>Designation of
				wilderness areas To be administered by the National Park Service</header><text display-inline="yes-display-inline">In accordance with the Wilderness Act (16
				U.S.C. 1131 et seq.) and sections 601 and 603 of the Federal Land Policy and
				Management Act of 1976 (43 U.S.C. 1781, 1782), the following land in the State
				is designated as wilderness areas and as components of the National Wilderness
				Preservation System:</text>
								<paragraph id="ID9ce264a22b1b43a8be39fa0a0022df45"><enum>(1)</enum><header>Death valley
				national park wilderness additions</header><text>Certain land in the
				Conservation Area administered by the Director of the National Park Service,
				comprising approximately 59,264 acres, as generally depicted on the map
				entitled <quote>Death Valley National Park Additions</quote> and dated October
				1, 2009, which shall be considered to be a part of the Death Valley National
				Park Wilderness.</text>
								</paragraph><paragraph id="ID31d7387991a0413dbd714af9b251f145"><enum>(2)</enum><header>Bowling alley
				wilderness</header><text>Certain land in the Conservation Area administered by
				the Director of the Bureau of Land Management, comprising approximately 30,888
				acres, as generally depicted on the map entitled <quote>Death Valley National
				Park Proposed Wilderness Area</quote>, numbered 143/100080, and dated June
				2009, which shall be considered to be a part of the Death Valley National Park
				Wilderness.</text>
								</paragraph></subsection><subsection id="id0113910E64B14C16968176C330710BD7"><enum>(c)</enum><header>Designation of
				wilderness area To be administered by the Forest Service</header>
								<paragraph id="idD5B9A07827D5491E8F78693F0C3BA1FE"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">In accordance with
				the Wilderness Act (16 U.S.C. 1131 et seq.) and sections 601 and 603 of the
				Federal Land Policy and Management Act of 1976 (43 U.S.C. 1781, 1782), the land
				in the State described in paragraph (2) is designated as a wilderness area and
				as a component of the National Wilderness Preservation System.</text>
								</paragraph><paragraph id="ID94367f91acc74f5d8f15e3c218317b5a"><enum>(2)</enum><header>Description of
				land</header><text>The land referred to in paragraph (1) is certain land in the
				San Bernardino National Forest, comprising approximately 7,141 acres, as
				generally depicted on the map entitled <quote>Proposed Sand to Snow National
				Monument</quote> and dated October 26, 2009, which shall considered to be a
				part of the San Gorgonio Wilderness.</text>
								</paragraph></subsection></section><section id="idC0E2CFE1D5E7450682A87D503FC34117"><enum>1502.</enum><header>Management</header>
							<subsection id="ID71081a16638f4b458330288a94d8bd8f"><enum>(a)</enum><header>Adjacent
				management</header>
								<paragraph id="ID11878fe1dbd845e89a613e67ee8b6cd5"><enum>(1)</enum><header>In
				General</header><text>Nothing in this title creates any protective perimeter or
				buffer zone around the wilderness areas designated by section 1501.</text>
								</paragraph><paragraph id="ID697103b95373429c9489f20e7ae3d0db"><enum>(2)</enum><header>Activities
				outside wilderness areas</header>
									<subparagraph id="idDE717B45D58347AC9FFA18484A33F828"><enum>(A)</enum><header>In
				general</header><text>The fact that an activity (including military activities)
				or use on land outside a wilderness area designated by section 1501 can be seen
				or heard within the wilderness area shall not preclude or restrict the activity
				or use outside the boundary of the wilderness area.</text>
									</subparagraph><subparagraph id="idDA37899E562E432AB5E59090F9CF9453"><enum>(B)</enum><header>Effect on
				nonwilderness activities</header>
										<clause id="idDD1E7E07CA874B6B90891CD5981CA1E7"><enum>(i)</enum><header>In
				general</header><text>In any permitting proceeding (including a review under
				the <act-name parsable-cite="NEPA69">National Environmental Policy Act of
				1969</act-name> (42 U.S.C. 4321 et seq.)) conducted with respect to a project
				described in clause (ii) that is formally initiated through a notice in the
				Federal Register before December 31, 2013, the consideration of any visual,
				noise, or other impacts of the project on a wilderness area designated by
				section 1501 shall be conducted based on the status of the area before
				designation as wilderness.</text>
										</clause><clause id="idF544EBA35A504801A61A2CA94375499B"><enum>(ii)</enum><header>Description of
				projects</header><text>A project referred to in clause (i) is a renewable
				energy project—</text>
											<subclause id="id4C0177E543484A0A8D6012522B3180EE"><enum>(I)</enum><text>for which the
				Bureau of Land Management has received a right-of-way use application on or
				before the date of enactment of this Act; and</text>
											</subclause><subclause id="id0E4E801A613B4EC99EF436873062ED9A"><enum>(II)</enum><text>that is located
				outside the boundary of a wilderness area designated by section 1501.</text>
											</subclause></clause></subparagraph></paragraph><paragraph id="ID6460427843e64c399d1644c73dafb821"><enum>(3)</enum><header>No additional
				regulation</header><text>Nothing in this title requires additional regulation
				of activities on land outside the boundary of the wilderness areas.</text>
								</paragraph><paragraph id="id95E438580E3447C68914D46B61C32332"><enum>(4)</enum><header>Effect on
				military operations</header><text>Nothing in this Act alters any authority of
				the Secretary of Defense to conduct any military operations at desert
				installations, facilities, and ranges of the State that are authorized under
				any other provision of law.</text>
								</paragraph></subsection><subsection id="IDdef1decf81fd43b7973ba43af14562e3"><enum>(b)</enum><header>Maps; legal
				descriptions</header>
								<paragraph id="ID28cffb80309b4eaa905ebd6c44c242ed"><enum>(1)</enum><header>In
				general</header><text>As soon as practicable after the date of enactment of
				this title, the Secretary shall file a map and legal description of each
				wilderness area and wilderness addition designated by section 1501 with—</text>
									<subparagraph id="id2157A776EFA0466EA9591A71D2F13B3C"><enum>(A)</enum><text>the Committee on
				Natural Resources of the House of Representatives; and</text>
									</subparagraph><subparagraph id="idCE2170A21D7C4CDD91F882F92A98BA67"><enum>(B)</enum><text>the Committee on
				Energy and Natural Resources of the Senate.</text>
									</subparagraph></paragraph><paragraph id="ID79f5b5dc6ab0447bb3aade8697f6412b"><enum>(2)</enum><header>Force of
				law</header><text>A map and legal description filed under paragraph (1) shall
				have the same force and effect as if included in this title, except that the
				Secretary may correct errors in the maps and legal descriptions.</text>
								</paragraph><paragraph id="IDc0929a6b717848c9a1cdab52a4564bba"><enum>(3)</enum><header>Public
				availability</header><text>Each map and legal description filed under paragraph
				(1) shall be filed and made available for public inspection in the appropriate
				office of the Secretary.</text>
								</paragraph></subsection><subsection id="IDf93bebaf3ab74868a72b46d6e44ad1a2"><enum>(c)</enum><header>Administration</header><text>Subject
				to valid existing rights, the land designated as wilderness or as a wilderness
				addition by section 1501 shall be administered by the Secretary in accordance
				with this Act and the Wilderness Act (16 U.S.C. 1131 et seq.), except that any
				reference in that Act to the effective date shall be considered to be a
				reference to the date of enactment of this title.</text>
							</subsection></section><section id="ID9b2704aba50d450ba762abbc3c2cab85"><enum>1503.</enum><header>Release of
				wilderness study areas</header>
							<subsection id="IDea5051ed51e441bfbb700f5d149f2bc7"><enum>(a)</enum><header>Finding</header><text>Congress
				finds that, for purposes of section 603 of the Federal Land Policy and
				Management Act of 1976 (43 U.S.C. 1782), any portion of a wilderness study area
				described in subsection (b) that is not designated as a wilderness area or
				wilderness addition by section 1501 or any other Act enacted before the date of
				enactment of this title has been adequately studied for wilderness.</text>
							</subsection><subsection id="ID4a8cd7ee77aa431197173b4fc6d98c96"><enum>(b)</enum><header>Description of
				study areas</header><text>The study areas referred to in subsection (a)
				are—</text>
								<paragraph id="ID30d819d82e3a43fa852a9f135c910ad6"><enum>(1)</enum><text>the Cady
				Mountains Wilderness Study Area;</text>
								</paragraph><paragraph id="id1C15F48676B447659773C51A56DB7394"><enum>(2)</enum><text>the Great Falls
				Basin Wilderness Study Area; and</text>
								</paragraph><paragraph id="ID1637d11d7988415c9dd19a03a84e0e08"><enum>(3)</enum><text>the Soda
				Mountains Wilderness Study Area.</text>
								</paragraph></subsection><subsection id="ID0bddaf7968ce4080ae9b1c0873c34de0"><enum>(c)</enum><header>Release</header><text>Any
				portion of a wilderness study area described in subsection (b) that is not
				designated as a wilderness area or wilderness addition by section 1501 is no
				longer subject to section 603(c) of the Federal Land Policy and Management Act
				of 1976 (43 U.S.C. 1782(c)).</text>
							</subsection></section></title><title id="id2C2651CC016E419083029D772C1EA105"><enum>XVI</enum><header>Designation of
				special management area</header>
						<section id="id1698DEA352D54728BED54FF9757BBBB1"><enum>1601.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>
							<paragraph id="IDf4b9fdda7cf94dda96ccf319bdf6267b"><enum>(1)</enum><header>Management
				area</header><text>The term <term>Management Area</term> means the Vinagre Wash
				Special Management Area.</text>
							</paragraph><paragraph id="id38FC9DA8A3A844D89C8F327A55A1DDDF"><enum>(2)</enum><header>Map</header><text>The
				term <quote>map</quote> means the map entitled <quote>Vinagre Wash Special
				Management Area-Proposed</quote> and dated November 10, 2009.</text>
							</paragraph><paragraph id="IDc80cf08e9b3b41de88f9cf8dfca9992e"><enum>(3)</enum><header>Public
				land</header><text>The term <term>public land</term> has the meaning given the
				term <quote>public lands</quote> in section 103 of the Federal Land Policy and
				Management Act of 1976 (43 U.S.C. 1702).</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID42d9a5dbc39c42faa3a43b837c5dc31c"><enum>(4)</enum><header>Secretary</header><text>The
				term <term>Secretary</term> means the Secretary of the Interior.</text>
							</paragraph></section><section id="ID43f7420b3a0d48c8ac4443fd51d235bc"><enum>1602.</enum><header>Establishment
				of the Vinagre Wash Special Management Area</header>
							<subsection id="idE334D8D8A3E046A7B04E17212BBE9D34"><enum>(a)</enum><header>Establishment</header><text>There
				is established the Vinagre Wash Special Management Area in the State, to be
				managed by the El Centro Field Office and the Yuma Field Office of the Bureau
				of Land Management.</text>
							</subsection><subsection id="idEFC827D29A52409E94047BAD2E1E56C9"><enum>(b)</enum><header>Purpose</header><text>The
				purpose of the Management Area is to conserve, protect, and enhance—</text>
								<paragraph id="id54462A4AB1AC438EB4618DE4820C76D8"><enum>(1)</enum><text>the plant and
				wildlife values of the Management Area; and</text>
								</paragraph><paragraph id="idDE1E4557CE8F46B8B6AC1864AD1C0C10"><enum>(2)</enum><text>the outstanding
				and nationally significant ecological, geological, scenic, recreational,
				archaeological, cultural, historic, and other resources of the Management
				Area.</text>
								</paragraph></subsection><subsection id="ID2ffe3eea246b472cb76334e09696e7ab"><enum>(c)</enum><header>Boundaries</header><text>The
				Management Area shall consist of the public land in Imperial County,
				California, comprising approximately 74,714 acres, as generally depicted on the
				map.</text>
							</subsection><subsection id="ID0e4760eea00945908b3553c38ff8c45e"><enum>(d)</enum><header>Map; legal
				description</header>
								<paragraph id="IDc26dc4ed0ace4d5083c600859c9533c7"><enum>(1)</enum><header>In
				general</header><text>As soon as practicable, but not later than 3 years, after
				the date of enactment of this title, the Secretary shall submit a map and legal
				description of the Management Area to—</text>
									<subparagraph id="id41D5B4E48FFD4280AA2377127374DD6F"><enum>(A)</enum><text>the Committee on
				Natural Resources of the House of Representatives; and</text>
									</subparagraph><subparagraph id="idD913CC09335E4A58AC56D424C9EB39D0"><enum>(B)</enum><text>the Committee on
				Energy and Natural Resources of the Senate.</text>
									</subparagraph></paragraph><paragraph id="IDf1d397ff605a44ce87e5e286a9c584ef"><enum>(2)</enum><header>Effect</header><text>The
				map and legal description submitted under paragraph (1) shall have the same
				force and effect as if included in this title, except that the Secretary may
				correct any errors in the map and legal description.</text>
								</paragraph><paragraph id="ID06edc4bc07a740319f4d628acfa1d945"><enum>(3)</enum><header>Availability</header><text>Copies
				of the map submitted under paragraph (1) shall be on file and available for
				public inspection in—</text>
									<subparagraph id="IDb481db4838bb4e3cbbffcd8cde8cfe5a"><enum>(A)</enum><text>the Office of the
				Director of the Bureau of Land Management; and</text>
									</subparagraph><subparagraph id="IDabf8a64711454ea8aabff9a71f59c60a"><enum>(B)</enum><text>the appropriate
				office of the Bureau of Land Management in the State.</text>
									</subparagraph></paragraph></subsection></section><section id="idF5C37881CDA54AC28D4B9AAB3D2EFF6D"><enum>1603.</enum><header>Management</header>
							<subsection id="ID54dcaa26605544ada84f8c21ff73112d"><enum>(a)</enum><header>In
				general</header><text>The Secretary shall allow hiking, camping, hunting, and
				sightseeing and the use of motorized vehicles, mountain bikes, and horses on
				designated routes in the Management Area in a manner that—</text>
								<paragraph id="id9705CB17C32644079C6759345893B35C"><enum>(1)</enum><text>is consistent
				with the purpose of the Management Area described in section 1602(b);</text>
								</paragraph><paragraph id="id8BBB15C772A74E4997B6BA23E6DA2A49"><enum>(2)</enum><text>ensures public
				health and safety; and</text>
								</paragraph><paragraph id="id75D48628AAD14D3B9118109213B6E61D"><enum>(3)</enum><text>is consistent
				with applicable law.</text>
								</paragraph></subsection><subsection id="ID10cec1352cd34c08afc660ae3bb7d11a"><enum>(b)</enum><header>Off-Highway
				vehicle use</header>
								<paragraph commented="no" id="id157CA6778EB94848AE0BEDEFECA8A029"><enum>(1)</enum><header>In
				general</header><text>Subject to paragraphs (2) and (3) and all other
				applicable laws, the use of off-highway vehicles shall be permitted on routes
				in the Management Area generally depicted on the map.</text>
								</paragraph><paragraph id="ID7eb2382f68fa46078fcf1c78e64ea9b1"><enum>(2)</enum><header>Closure</header><text>The
				Secretary may temporarily close or permanently reroute a portion of a route
				described in paragraph (1)—</text>
									<subparagraph id="idB8329B580F5F479ABFD750D5D5A34EE1"><enum>(A)</enum><text>to prevent, or
				allow for restoration of, resource damage;</text>
									</subparagraph><subparagraph id="idB5D94E2F5DF44A5CB52AC3D51C33B6F3"><enum>(B)</enum><text>to protect tribal
				cultural resources, including the resources identified in the tribal cultural
				resources management plan developed under section 1905(c);</text>
									</subparagraph><subparagraph id="id7EE99A59536148EC9E423D6603EAEA5B"><enum>(C)</enum><text>to address public
				safety concerns; or</text>
									</subparagraph><subparagraph id="idE68ACBB700F34D56A67493EFE362A777"><enum>(D)</enum><text>as otherwise
				required by law.</text>
									</subparagraph></paragraph><paragraph id="ID8b36c9b9d37e4769994035b5ac07be2b"><enum>(3)</enum><header>Designation of
				additional routes</header><text>During the 3-year period beginning on the date
				of enactment of this title, the Secretary—</text>
									<subparagraph id="idDAF1C375D96049E3B6D11651B9BE680E"><enum>(A)</enum><text>shall accept
				petitions from the public regarding additional routes for off-highway vehicles;
				and</text>
									</subparagraph><subparagraph id="id57BAEB75D60E48F8825E26B0662DC89C"><enum>(B)</enum><text>may designate
				additional routes that the Secretary determines—</text>
										<clause id="idEA7AC855C491420297628D127EAE05E6"><enum>(i)</enum><text>would provide
				significant or unique recreational opportunities; and</text>
										</clause><clause id="id96D830483BE849F285AACE3D4BCB0A67"><enum>(ii)</enum><text>are consistent
				with the purposes of the Management Area.</text>
										</clause></subparagraph></paragraph></subsection><subsection id="ID448d35451def4fe9a7f039ba116562a7"><enum>(c)</enum><header>Withdrawal</header><text>Subject
				to valid existing rights, all Federal land within the Management Area is
				withdrawn from—</text>
								<paragraph id="ID1ab9d4433dff4dcba73d650015263ba2"><enum>(1)</enum><text>all forms of
				entry, appropriation, or disposal under the public land laws;</text>
								</paragraph><paragraph id="ID9b78f2e192e44cdbb7b5e67e89bb8504"><enum>(2)</enum><text>location, entry,
				and patent under the mining laws; and</text>
								</paragraph><paragraph id="IDaeca1024d5064720b4ac0708ad000056"><enum>(3)</enum><text>right-of-way,
				leasing, or disposition under all laws relating to—</text>
									<subparagraph id="id2E77D2D363274F25B15185FED4678190"><enum>(A)</enum><text>minerals;
				or</text>
									</subparagraph><subparagraph id="idC0EDF906865C483FAFFF09AF931D79B3"><enum>(B)</enum><text>solar, wind, and
				geothermal energy.</text>
									</subparagraph></paragraph></subsection><subsection id="IDe8b95724d1ed4c83b8cb1a55196f4545"><enum>(d)</enum><header>No
				buffers</header><text>The establishment of the Management Area shall
				not—</text>
								<paragraph id="ID1dca1803a6c948f2911e23054a3d7d3f"><enum>(1)</enum><text>create a
				protective perimeter or buffer zone around the Management Area; or</text>
								</paragraph><paragraph id="ID696ef6e06e8c4b14be0029986829c0d1"><enum>(2)</enum><text>preclude uses or
				activities outside the Management Area that are permitted under other
				applicable laws, even if the uses or activities are prohibited within the
				Management Area.</text>
								</paragraph></subsection><subsection id="ID1567cafb7d964e869390d3a9ea8f01e0"><enum>(e)</enum><header>Notice of
				available routes</header><text>The Secretary shall ensure that visitors to the
				Management Area have access to adequate notice relating to the availability of
				designated routes in the Management Area through—</text>
								<paragraph id="ID71092dbff99249ea849296edbd04ad69"><enum>(1)</enum><text>the placement of
				appropriate signage along the designated routes;</text>
								</paragraph><paragraph id="IDf1f43095d65346fe924180f3c59fb1e5"><enum>(2)</enum><text>the distribution
				of maps, safety education materials, and other information that the Secretary
				determines to be appropriate; and</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDc3b973d17caa4333b8be9bdb550197f4"><enum>(3)</enum><text>restoration of
				areas that are not designated as open routes, including vertical
				mulching.</text>
								</paragraph></subsection><subsection id="ID557e518f934b41d2a5b3d1d0bd294180"><enum>(f)</enum><header>Stewardship</header><text>The
				Secretary, in consultation with Indian tribes and other interests, shall
				develop a program to provide opportunities for monitoring and stewardship of
				the Management Area to minimize environmental impacts and prevent resource
				damage from recreational use, including volunteer assistance with—</text>
								<paragraph id="id92EB589582CC4C4789777F9AEBFF969F"><enum>(1)</enum><text>route
				signage;</text>
								</paragraph><paragraph id="id8769DCB531664947A73BFDDF4E71192F"><enum>(2)</enum><text>restoration of
				closed routes;</text>
								</paragraph><paragraph id="idB5529FE06E5041E3BAF84528DD3C59D5"><enum>(3)</enum><text>protection of
				Management Area resources; and</text>
								</paragraph><paragraph id="id25B8D29E0F554F4090DE1B267751E71F"><enum>(4)</enum><text>recreation
				education.</text>
								</paragraph></subsection><subsection id="ID16d1607c202a4351be760446c5ddc9a9"><enum>(g)</enum><header>Protection of
				tribal cultural resources</header><text>Not later than 2 years after the date
				of enactment of this title, the Secretary, in accordance with the National
				Historic Preservation Act (16 U.S.C. 470 et seq.) and any other applicable law,
				shall—</text>
								<paragraph id="ID7724ad5b904c44d8a0b2c6d8a0cf4e8d"><enum>(1)</enum><text>prepare and
				complete a tribal cultural resources survey of the Management Area; and</text>
								</paragraph><paragraph id="ID054bed8b204440beb42c098829320d66"><enum>(2)</enum><text>consult with the
				Quechan Indian Nation and other Indian tribes demonstrating ancestral,
				cultural, or other ties to the resources within the Management Area on the
				development and implementation of the tribal cultural resources survey under
				paragraph (1).</text>
								</paragraph></subsection></section><section id="IDd85d1089e7c44991a72122664514aac2"><enum>1604.</enum><header>Potential
				wilderness</header>
							<subsection id="ID387aaffcdd9341aa93c2a4fc2649e73e"><enum>(a)</enum><header>Protection of
				wilderness character</header>
								<paragraph id="id5489236F49D846E5A67E90A0BC8BD6F6"><enum>(1)</enum><header>In
				general</header><text>The Secretary shall manage the Federal land in the
				Management Area described in paragraph (2) in a manner that preserves the
				character of the land for the eventual inclusion of the land in the National
				Wilderness Preservation System.</text>
								</paragraph><paragraph id="IDbb5ee0555f8547b7a6413f3bcebd06d2"><enum>(2)</enum><header>Description of
				land</header><text>The Federal land described in this paragraph is—</text>
									<subparagraph id="ID358dfa10425149dbbf900f56190ca574"><enum>(A)</enum><text>the approximately
				9,160 acres of land, as generally depicted on the map entitled <quote>Indian
				Pass Wilderness Additions-Proposed</quote> and dated November 10, 2009;</text>
									</subparagraph><subparagraph id="IDbfa2321ffaad410b9197f08d882ef60e"><enum>(B)</enum><text>the approximately
				17,436 acres of land, as generally depicted on the map entitled <quote>Milpitas
				Wash Wilderness Area-Proposed</quote> and dated November 10, 2009;</text>
									</subparagraph><subparagraph id="IDfb6abc29cea14e718dabe31118065cbd"><enum>(C)</enum><text>the approximately
				13,647 acres of land, as generally depicted on the map entitled <quote>Buzzard
				Peak Wilderness Area-Proposed</quote> and dated November 10, 2009; and</text>
									</subparagraph><subparagraph id="IDcf53e4af126047228afb0c7efc32c3c5"><enum>(D)</enum><text>the approximately
				8,090 acres of land, as generally depicted on the map entitled <quote>Palo
				Verde Mountain Wilderness Additions-Proposed</quote> and dated November 10,
				2009.</text>
									</subparagraph></paragraph><paragraph id="id04789A25FE7B48D4B01EA2F2A7FEDA24"><enum>(3)</enum><header>Use of
				land</header>
									<subparagraph id="ID952ff6c526ab44c0ab397d97091ff00f"><enum>(A)</enum><header>Military
				uses</header><text>The Secretary shall manage the Federal land in the
				Management Area described in paragraph (2) in a manner that is consistent with
				the Wilderness Act (16 U.S.C. 1131 et seq.), except that the Secretary may
				authorize use of the land by the Secretary of the Navy for Naval Special
				Warfare Tactical Training, including long-range small unit training and
				navigation, vehicle concealment, and vehicle sustainment training, in
				accordance with applicable Federal laws.</text>
									</subparagraph><subparagraph id="IDc7165ceaad204d3eb5ee06aadbafc503"><enum>(B)</enum><header>Prohibited
				uses</header><text>The following shall be prohibited on the Federal land
				described in paragraph (2):</text>
										<clause id="ID3d360498f173418bbe41fd8ce0beccaf"><enum>(i)</enum><text>Permanent
				roads.</text>
										</clause><clause id="IDa7668b05db1246049f8647aa26baffe7"><enum>(ii)</enum><text>Commercial
				enterprises.</text>
										</clause><clause id="ID0accdb3017f2477c9a9bc85834557645"><enum>(iii)</enum><text>Except as
				necessary to meet the minimum requirements for the administration of the
				Federal land and to protect public health and safety—</text>
											<subclause id="idCBBC5F2483B74848BF1A22280679858A"><enum>(I)</enum><text>the use of
				mechanized vehicles; and</text>
											</subclause><subclause id="idCB941AA84CB14B6887FB16CD97D3A2A8"><enum>(II)</enum><text>the
				establishment of temporary roads.</text>
											</subclause></clause></subparagraph></paragraph><paragraph id="ID3284e760e6984430a8d272a1f35410b3"><enum>(4)</enum><header>Wilderness
				designation</header>
									<subparagraph id="id986E72C872B845218553C8502CAFF5AA"><enum>(A)</enum><header>In
				general</header><text>The Federal land described in paragraph (2) shall be
				designated as wilderness and as a component of the National Wilderness
				Preservation System on the date on which the Secretary, in consultation with
				the Secretary of Defense, publishes a notice in the Federal Register that all
				activities on the Federal land that are incompatible with the Wilderness Act
				(16 U.S.C. 1131 et seq.) have terminated.</text>
									</subparagraph><subparagraph id="id43E94CF3A5B64EC086858C7D61C87A74"><enum>(B)</enum><header>Designation</header><text>On
				designation of the Federal land under clause (i)—</text>
										<clause id="ID0fde83ac9f0b44aba4f49ea048602d6a"><enum>(i)</enum><text>the land
				described in paragraph (2)(A) shall be incorporated in, and shall be considered
				to be a part of, the Indian Pass Wilderness;</text>
										</clause><clause id="ID602aebccd578421aba778ff909b8a751"><enum>(ii)</enum><text>the land
				described in paragraph (2)(B) shall be designated as the <quote>Milpitas Wash
				Wilderness</quote>;</text>
										</clause><clause id="ID3cd16569941148bc90b26e8b1fc07d7b"><enum>(iii)</enum><text>the land
				described in paragraph (2)(C) shall be designated as the <quote>Buzzard Peak
				Wilderness</quote>; and</text>
										</clause><clause id="IDaf8569781a1e4b3980537bed7beb5493"><enum>(iv)</enum><text>the land
				described in paragraph (2)(D) shall be incorporated in, and shall be considered
				to be a part of, the Palo Verde Mountains Wilderness.</text>
										</clause></subparagraph></paragraph></subsection><subsection id="ID14dfa65e7076445396a5e4b2214cc7d8"><enum>(b)</enum><header>Administration
				of wilderness</header><text>Subject to valid existing rights, the land
				designated as wilderness or as a wilderness addition by this title shall be
				administered by the Secretary in accordance with this Act and the Wilderness
				Act (16 U.S.C. 1131 et seq.).</text>
							</subsection></section></title><title id="idD198FE6B92DB4D51926ECB24DC220059"><enum>XVII</enum><header>National Park
				System additions</header>
						<section id="idBEC7681B5C4A4F6A9997C1072DE234F3"><enum>1701.</enum><header>Death Valley
				National Park boundary revision</header>
							<subsection id="ID479773167d3b4d81a2aa7b774914bdd8"><enum>(a)</enum><header>In
				general</header><text>The boundary of Death Valley National Park is adjusted to
				include—</text>
								<paragraph id="id079D29CAE84E4D40BA3D491D5F9777A7"><enum>(1)</enum><text>the approximately
				33,041 acres of Bureau of Land Management land abutting the southern end of the
				Death Valley National Park that lies between Death Valley National Park to the
				north and Ft. Irwin Military Reservation to the south and which runs
				approximately 34 miles from west to east, as depicted on the map entitled
				<quote>Death Valley National Park Proposed Boundary Addition</quote>, numbered
				143/100,080, and dated June 2009;</text>
								</paragraph><paragraph id="id909914D9D0994A24B5B550243BCF94FF"><enum>(2)</enum><text>the approximately
				6,379 acres of Bureau of Land Management land in Inyo County, California,
				located in the northeast area of Death Valley National Park that is within, and
				surrounded by, land under the jurisdiction of the Director of the National Park
				Service, as depicted on the map entitled <quote>Proposed Crater Mine Area
				Addition to Death Valley National Park</quote>, numbered 143/100,079, and dated
				June 2009; and</text>
								</paragraph><paragraph id="IDdc7356dc54d44f568f952a78b40577ef"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id9EF1E63C7A824E138C166177EC9A5E19"><enum>(A)</enum><text>on transfer of title to
				the private land to the National Park Service, the approximately 280 acres of
				private land in Inyo County, California, located adjacent to the southeastern
				boundary of Death Valley National Park, as depicted on the map entitled
				<quote>Proposed Ryan Camp Addition to Death Valley National Park</quote>,
				numbered 143/100,097, and dated June 2009; and</text>
									</subparagraph><subparagraph id="idDB89C3CB9E0F42A4BF31624C485D6A80" indent="up1"><enum>(B)</enum><text>the approximately 1,040 acres of
				Bureau of Land Management land contiguous to the private land described in
				subparagraph (A), as depicted on the map entitled <quote>Proposed Ryan Camp
				Addition to Death Valley National Park</quote>, numbered 143/100,097, and dated
				June 2009.</text>
									</subparagraph></paragraph></subsection><subsection id="ID2b3eaee2fc714766a6e0ca2d7ba8fae0"><enum>(b)</enum><header>Availability of
				map</header><text>The maps described in paragraphs (1), (2), and (3) of
				subsection (a) shall be on file and available for public inspection in the
				appropriate offices of the National Park Service.</text>
							</subsection><subsection id="ID2dd9158ae63e40e0b4de4166214c4b85"><enum>(c)</enum><header>Administration</header><text>The
				Secretary of the Interior (referred to in this section as the
				<quote>Secretary</quote>) shall—</text>
								<paragraph id="id7DB5FDF357114A34862E062601C8A5BE"><enum>(1)</enum><text>administer any
				land added to Death Valley National Park under subsection (a)—</text>
									<subparagraph id="id8887ED2AF61146FCA36EFF8A67E7390D"><enum>(A)</enum><text>as part of Death
				Valley National Park; and</text>
									</subparagraph><subparagraph id="id501F6FB10A8F44A8A965175E5D2B46C8"><enum>(B)</enum><text>in accordance
				with applicable laws (including regulations); and</text>
									</subparagraph></paragraph><paragraph id="ID4209f9ac10e640dea07483d637fa8e92"><enum>(2)</enum><text>not later than
				180 days after the date of enactment of this title, develop a memorandum of
				understanding with Inyo County, California, permitting ongoing access and use
				to existing gravel pits along Saline Valley Road within Death Valley National
				Park for road maintenance and repairs in accordance with applicable laws
				(including regulations).</text>
								</paragraph></subsection></section><section id="idFF0D764B3F424900918550C0622A4D40"><enum>1702.</enum><header>Mojave
				National Preserve</header>
							<subsection id="ID4030e879e9bc449b93f700247548fd42"><enum>(a)</enum><header>In
				general</header><text>The boundary of the Mojave National Preserve is adjusted
				to include—</text>
								<paragraph id="id4ADE881C5FCF430F8D16ADCAADEB8D19"><enum>(1)</enum><text>the 29,221 acres
				of Bureau of Land Management land that is surrounded by the Mojave National
				Preserve to the northwest, west, southwest, south, and southeast and by the
				Nevada State line on the northeast boundary, as depicted on the map entitled
				<quote>Proposed Castle Mountain Addition to the Mojave National
				Preserve</quote>, numbered 170/100,075, and dated August 2009; and</text>
								</paragraph><paragraph id="IDd4f5259cd22b4bfd8cdecf29a37e40fb"><enum>(2)</enum><text>the 25 acres of
				Bureau of Land Management land in Baker, California, as depicted on the map
				entitled <quote>Mojave National Preserve–Proposed Boundary Addition</quote>,
				numbered 170/100,199, and dated August 2009.</text>
								</paragraph></subsection><subsection id="IDcf8240ecc68c400190215816a44cd6ce"><enum>(b)</enum><header>Availability of
				maps</header><text>The maps described in subsection (a) shall be on file and
				available for public inspection in the appropriate offices of the National Park
				Service.</text>
							</subsection><subsection id="ID8cd0016f0bd14292b3b149ecf8b673bf"><enum>(c)</enum><header>Administration</header><text>The
				Secretary shall administer any land added to Mojave National Preserve under
				subsection (a)—</text>
								<paragraph id="idD5AD40C110AD42CDB6BB2E7DBA48DFA1"><enum>(1)</enum><text>as part of the
				Mojave National Preserve; and</text>
								</paragraph><paragraph id="id65E39ADA26A241C3A216F8786CE22829"><enum>(2)</enum><text>in accordance
				with applicable laws (including regulations).</text>
								</paragraph></subsection></section><section id="IDff6e2222c1a447698872187d8816b829"><enum>1703.</enum><header>Joshua Tree
				National Park boundary revision</header>
							<subsection id="IDfc51d9abb9c2481ea711fe104074ebd4"><enum>(a)</enum><header>In
				general</header><text>The boundary of the Joshua Tree National Park is adjusted
				to include the 2,879 acres of land managed by Director of the Bureau of Land
				Management that are contiguous at several different places to the northern
				boundaries of Joshua Tree National Park in the northwest section of the Park,
				as depicted on the map entitled <quote>Joshua Tree National Park Proposed
				Boundary Additions</quote>, numbered 156/100,007, and dated June 2009.</text>
							</subsection><subsection id="ID3da299d6297e4c46a1f55f29592590b3"><enum>(b)</enum><header>Availability of
				map</header><text>The map described in subsection (a) and the map depicting the
				25 acres described in subsection (c)(2) shall be on file and available for
				public inspection in the appropriate offices of the National Park
				Service.</text>
							</subsection><subsection id="ID34f31d87c7d54fbc96547d7e14962b40"><enum>(c)</enum><header>Administration</header>
								<paragraph id="idAAC412695F31415AB5F895243D212439"><enum>(1)</enum><header>In
				general</header><text>The Secretary shall administer any land added to the
				Joshua Tree National Park under subsection (a) and the additional land
				described in paragraph (2)—</text>
									<subparagraph id="idEE074E6B0DEC4F9E987B4CD95736C0E7"><enum>(A)</enum><text>as part of Joshua
				Tree National Park; and</text>
									</subparagraph><subparagraph id="idAB1335DF33544AECA769D43244112C93"><enum>(B)</enum><text>in accordance
				with applicable laws (including regulations).</text>
									</subparagraph></paragraph><paragraph id="idE08F4D1E9DE94691884F8FBDC7BB8407"><enum>(2)</enum><header>Description of
				additional land</header><text>The additional land referred to in paragraph (1)
				is the 25 acres of land—</text>
									<subparagraph id="idF56BE36F98EF4A5BA016AC74A91E113D"><enum>(A)</enum><text>depicted on the
				map entitled <quote>Joshua Tree National Park Boundary Adjustment Map</quote>,
				numbered 156/80,049, and dated April 1, 2003;</text>
									</subparagraph><subparagraph id="id31DDA98045C345E891FC09FF74ED651D"><enum>(B)</enum><text>added to Joshua
				Tree National Park by the notice of the Department Interior of August 28, 2003
				(68 Fed. Reg. 51799); and</text>
									</subparagraph><subparagraph id="id4B2A27B7A3FE432FBF055F720260AEBF"><enum>(C)</enum><text>more particularly
				described as lots 26, 27, 28, 33, and 34 in sec. 34, T. 1 N., R. 8 E., San

									</subparagraph></paragraph></subsection></section><section id="idEC174C24F12B4D859BFC3F97F4B7433C"><enum>1704.</enum><header>Authorization
				of appropriations</header><text display-inline="no-display-inline">There are
				authorized to be appropriated such sums as are necessary to carry out this
				title.</text>
						</section></title><title id="idEB3DC36A8C3B4580A6EFEB09815B70B4"><enum>XVIII</enum><header>Off-highway
				vehicle recreation areas</header>
						<section id="ID9c03e82a51824259bbebde2149e552e1"><enum>1801.</enum><header>Designation
				of off-highway vehicle recreation areas</header>
							<subsection id="IDbfdc9299ff0a4389b7418e5187dda3f6"><enum>(a)</enum><header>Designation</header><text>In
				accordance with the <act-name parsable-cite="FLPMA">Federal Land Policy and
				Management Act of 1976</act-name> (43 U.S.C. 1701 et seq.) and resource
				management plans developed under this title and subject to valid existing
				rights, the following land within the Conservation Area in San Bernardino
				County, California, is designated as Off-Highway Vehicle Recreation
				Areas:</text>
								<paragraph id="IDbe61162b3e754823a13a663744e2cb17"><enum>(1)</enum><header>El mirage
				off-highway vehicle recreation area</header><text>Certain Bureau of Land
				Management land in the Conservation Area, comprising approximately 25,600
				acres, as generally depicted on the map entitled <quote>El Mirage Off-Highway
				Vehicle Recreation Area</quote> and dated July 15, 2009, which shall be known
				as the <quote>El Mirage Off-Highway Vehicle Recreation Area</quote>.</text>
								</paragraph><paragraph id="ID4b097f2b7a184e5f83c4f9a89967fc06"><enum>(2)</enum><header>Johnson valley
				off-highway vehicle recreation area</header>
									<subparagraph id="idF7FF187718D34043BDFD4D3622CBA7B9"><enum>(A)</enum><header>In
				general</header><text>Certain Bureau of Land Management land in the
				Conservation Area, comprising approximately 180,000 acres, as generally
				depicted on the map entitled <quote>Johnson Valley Off-Highway Vehicle
				Recreation Area</quote> and dated July 15, 2009, which shall be known as the
				<quote>Johnson Valley Off-Highway Vehicle Recreation Area</quote>.</text>
									</subparagraph><subparagraph id="idFFA624CD64FE413F885D4C50456FE868"><enum>(B)</enum><header>Exclusions</header>
										<clause id="id3334F86F1F9C40C18339951E3D2A9395"><enum>(i)</enum><header>In
				general</header><text>Subject to clause (iii), the land described in clause
				(ii) shall be excluded from the Johnson Valley Off-Highway Vehicle Recreation
				Area to permit the Secretary of the Navy to study the land for—</text>
											<subclause id="idD15CFD2329094E4BB7006D0D73BC0408"><enum>(I)</enum><text>withdrawal in
				accordance with the Act of February 28, 1958 (43 U.S.C. 155 et seq.);
				and</text>
											</subclause><subclause id="id516F0C1701D24C5A8748879F0AE40E17"><enum>(II)</enum><text>potential
				inclusion in the Marine Corps Air Ground Combat Center at Twentynine Palms,
				California, for national defense purposes.</text>
											</subclause></clause><clause id="id733326CB19774D269C32CC9EF58C4CA5"><enum>(ii)</enum><header>Study
				area</header><text>The land referred to in clause (i) is the land that—</text>
											<subclause id="id86E3195647294199B219426B211C6A85"><enum>(I)</enum><text>is described
				in—</text>
												<item id="id8821C6F5789441D5B98773625EFC20D8"><enum>(aa)</enum><text>the notice of
				the Bureau of Land Management of September 15, 2008 entitled <quote>Notice of
				Proposed Legislative Withdrawal and Opportunity for Public Meeting;
				California</quote> (73 Fed. Reg. 53269); or</text>
												</item><item id="idDE17D604FED24431BAF845E25967D97D"><enum>(bb)</enum><text>any subsequent
				notice in the Federal Register that is related to the notice described in item
				(aa); and</text>
												</item></subclause><subclause id="id774CB1FEE3B34E3B9B8980BC420BE46B"><enum>(II)</enum><text>has been
				segregated by the Director of the Bureau of Land Management.</text>
											</subclause></clause><clause id="id5C5073A41CB74E1EBDC1DB7F39FCD4AD"><enum>(iii)</enum><header>Incorporation
				in off-highway vehicle recreation area</header><text>After action by the
				Secretary of Defense and Congress regarding the withdrawal under subparagraph
				(A), any land within the study area that is not withdrawn shall be incorporated
				into the Johnson Valley Off-Highway Vehicle Recreation Area.</text>
										</clause></subparagraph><subparagraph id="IDcf978c9bf32b48668d1702cd94cf0230"><enum>(C)</enum><header>Joint use of
				certain land</header><text>The Secretary of Defense shall consider a potential
				joint use area within the Johnson Valley Off-Highway Vehicle Recreation Area as
				part of the environmental impact statement of the Department of Defense that
				would allow for continued recreational opportunities on the joint use area
				during periods in which—</text>
										<clause id="id080DDCC192E947D4AE6C0C19E8D2FABB"><enum>(i)</enum><text>the joint use
				area is not needed for military training activities; and</text>
										</clause><clause id="id3EED460F5B2149EDAA71151663B48768"><enum>(ii)</enum><text>public safety
				can be ensured.</text>
										</clause></subparagraph><subparagraph id="ID2fe88d243ac743558af5bd96f4e11b47"><enum>(D)</enum><header>Military access
				for administrative purposes</header><text>In cooperation with the Secretary of
				the Interior, the Secretary of the Navy may, after notifying the Secretary of
				the Interior, access the Johnson Valley Off-Highway Vehicle Recreation Area for
				national defense purposes supporting military training (including military
				range management and exercise control activities).</text>
									</subparagraph></paragraph><paragraph id="ID70664f1ec51d43c1aea8b85ecc60e123"><enum>(3)</enum><header>Rasor
				off-highway vehicle recreation area</header><text>Certain Bureau of Land
				Management land in the Conservation Area, comprising approximately 22,400
				acres, as generally depicted on the map entitled <quote>Rasor Off-Highway
				Vehicle Recreation Area</quote> and dated July 15, 2009, which shall be known
				as the <quote>Rasor Off-Highway Vehicle Recreation Area</quote>.</text>
								</paragraph><paragraph id="IDbdf149c1bd114eab82662ad6fc6312dd"><enum>(4)</enum><header>Spangler hills
				off-highway vehicle recreation area</header><text>Certain Bureau of Land
				Management land in the Conservation Area, comprising approximately 62,080
				acres, as generally depicted on the map entitled <quote>Spangler Hills
				Off-Highway Vehicle Recreation Area</quote> and dated July 15, 2009, which
				shall be known as the <quote>Spangler Off-Highway Vehicle Recreation
				Area</quote>.</text>
								</paragraph><paragraph id="ID44fdafe545514cb38e119540372b806d"><enum>(5)</enum><header>Stoddard valley
				off-highway vehicle recreation area</header><text>Certain Bureau of Land
				Management land in the Conservation Area, comprising approximately 54,400
				acres, as generally depicted on the map entitled <quote>Stoddard Valley
				Off-Highway Vehicle Recreation Area</quote> and dated July 15, 2009, which
				shall be known as the <quote>Stoddard Valley Off-Highway Vehicle Recreation
				Area</quote>.</text>
								</paragraph></subsection><subsection id="IDe37db7bc886249c1a3924dfa96b3e34f"><enum>(b)</enum><header>Purpose</header><text>The
				purpose of the off-highway vehicle recreation areas designated under subsection
				(a) is to preserve and enhance the recreational opportunities within the
				Conservation Area (including opportunities for off-highway vehicle recreation),
				while conserving the wildlife and other natural resource values of the
				Conservation Area.</text>
							</subsection><subsection id="ID3a095302c7f54074949783a789457065"><enum>(c)</enum><header>Maps and
				descriptions</header>
								<paragraph id="ID37b885fbb4a2467194103d8930800413"><enum>(1)</enum><header>Preparation and
				submission</header><text>As soon as practicable after the date of enactment of
				this title, the Secretary shall file a map and legal description of each
				off-highway vehicle recreation area designated by subsection (a) with—</text>
									<subparagraph id="id20E449862D2644639FD86186F596FB9E"><enum>(A)</enum><text>the Committee on
				Natural Resources of the House of Representatives; and</text>
									</subparagraph><subparagraph id="idE76B8E563688425E8EF12B76E31FB267"><enum>(B)</enum><text>the Committee on
				Energy and Natural Resources of the Senate.</text>
									</subparagraph></paragraph><paragraph id="ID5eb6c15d98f3430ebda0be0b0b5947e4"><enum>(2)</enum><header>Legal
				effect</header><text>The map and legal descriptions of the off-highway vehicle
				recreation areas filed under paragraph (1) shall have the same force and effect
				as if included in this title, except that the Secretary may correct errors in
				the map and legal descriptions.</text>
								</paragraph><paragraph id="IDb4dfc701d3504ca09a20f401e57bf595"><enum>(3)</enum><header>Public
				availability</header><text>Each map and legal description filed under paragraph
				(1) shall be filed and made available for public inspection in the appropriate
				offices of the Bureau of Land Management.</text>
								</paragraph></subsection><subsection id="ID816fdfabefca49b5b4e59580c1f449b7"><enum>(d)</enum><header>Use of the
				land</header>
								<paragraph id="IDc1a78f04f1384dc6bff873e428e00957"><enum>(1)</enum><header>Recreational
				activities</header>
									<subparagraph id="ID19ffc8892b45488fb03479a51714c656"><enum>(A)</enum><header>In
				general</header><text>The Secretary shall continue to authorize, maintain, and
				enhance the recreational uses of the off-highway vehicle recreation areas
				designated by subsection (a), including off-highway recreation, hiking,
				camping, hunting, mountain biking, sightseeing, rockhounding, and horseback
				riding, as long as the recreational use is consistent with this section and any
				other applicable law.</text>
									</subparagraph><subparagraph id="ID9b58566d8f6249f9ab08eeda8760bbe9"><enum>(B)</enum><header>Off-highway
				vehicle and off-highway recreation</header><text>To the extent consistent with
				applicable Federal law (including regulations) and this section, any authorized
				recreation activities and use designations in effect on the date of enactment
				of this title and applicable to the off-highway vehicle recreation areas
				designated by subsection (a) shall continue, including casual off-highway
				vehicular use, racing, competitive events, rock crawling, training, and other
				forms of off-highway recreation.</text>
									</subparagraph></paragraph><paragraph id="ID205b476e314d4dd3979c5d9248625255"><enum>(2)</enum><header>Wildlife
				guzzlers</header><text>Wildlife guzzlers shall be allowed in the off-highway
				vehicle recreation areas designated by subsection (a) in accordance with
				applicable Bureau of Land Management guidelines.</text>
								</paragraph><paragraph id="ID2f6d03fc075741eaac3f75eb566c0da9"><enum>(3)</enum><header>Prohibited
				uses</header><text>Residential and commercial development (including
				development of mining and energy facilities, but excluding transmission line
				rights-of-way and related telecommunication facilities) shall be prohibited in
				the off-highway vehicle recreation areas designated by subsection (a) if the
				Secretary determines that the development is incompatible with the purpose
				described in subsection (b).</text>
								</paragraph></subsection><subsection id="ID16a95dca870f4712a8b28f07b3234ce2"><enum>(e)</enum><header>Administration</header>
								<paragraph id="ID3d7cc5227d8549ae8966eaa45d8707cf"><enum>(1)</enum><header>In
				general</header><text>The Secretary shall administer the off-highway vehicle
				recreation areas designated by subsection (a) in accordance with—</text>
									<subparagraph id="id99610CAFDA664C1294B62E8A8C8D5F61"><enum>(A)</enum><text>this
				title;</text>
									</subparagraph><subparagraph id="idFC7193E99B164EEB99749F1F68DC5932"><enum>(B)</enum><text>the Federal Land
				Policy and Management Act of 1976 (43 U.S.C. 1701 et seq.); and</text>
									</subparagraph><subparagraph id="id5AF5EE6FD1E14C38B60B8B27DFDFD3CD"><enum>(C)</enum><text>any other
				applicable laws (including regulations).</text>
									</subparagraph></paragraph><paragraph id="IDc1aadba16f4d4775baea94792cf054a6"><enum>(2)</enum><header>Management
				plan</header>
									<subparagraph id="id8630635889EC4B8EA7C02337F2526DA5"><enum>(A)</enum><header>In
				general</header><text>As soon as practicable, but not later than 3 years after
				the date of enactment of this title, the Secretary shall—</text>
										<clause id="id7BB245162E6D4042B444DFFCCD2A625B"><enum>(i)</enum><text>amend existing
				resource management plans applicable to the land designated as off-highway
				vehicle recreation areas under subsection (a); or</text>
										</clause><clause id="id236BC6DC07C64EC3A4F50A45D4312494"><enum>(ii)</enum><text>develop new
				management plans for each off-highway vehicle recreation area designated under
				that subsection.</text>
										</clause></subparagraph><subparagraph id="id8E298EBC29FB4452AB29EA688EC05CEA"><enum>(B)</enum><header>Requirements</header><text>All
				new or amended plans under subparagraph (A) shall be designed to preserve and
				enhance safe off-highway vehicle and other recreational opportunities within
				the applicable recreation area consistent with—</text>
										<clause id="id0FFBD138034B461C8D34775F8038C71B"><enum>(i)</enum><text>the purpose
				described in subsection (b); and</text>
										</clause><clause id="id1D6B8B2DE3684CE2811F16948659DAF5"><enum>(ii)</enum><text>any applicable
				laws (including regulations).</text>
										</clause></subparagraph><subparagraph id="id3AC55D5BADF34D77B5805011F8A90A0F"><enum>(C)</enum><header>Interim
				plans</header><text>Pending completion of a new management plan under
				subparagraph (A), the existing resource management plans shall govern the use
				of the applicable off-highway vehicle recreation area.</text>
									</subparagraph></paragraph></subsection><subsection id="IDf5572a4415ab412aaa33e41a0bb1b1e1"><enum>(f)</enum><header>Study</header>
								<paragraph id="ID3a47d023a05b47ecb28eb40830f45e4e"><enum>(1)</enum><header>In
				general</header><text>As soon as practicable, but not later than 2 years, after
				the date of enactment of this title, the Secretary shall complete a study to
				identify Bureau of Land Management land adjacent to the off-highway vehicle
				recreation areas designated by subsection (a) that is suitable for addition to
				the off-highway vehicle recreation areas.</text>
								</paragraph><paragraph id="id85E14AB594A841E99EAF93A2AE5539CD"><enum>(2)</enum><header>Requirements</header><text>In
				preparing the study under paragraph (1), the Secretary shall—</text>
									<subparagraph id="ID00df6886d9ef4d0f957da6cdbe00a17e"><enum>(A)</enum><text>seek input from
				stakeholders, including—</text>
										<clause id="id57E5F621FCE145E0A861F569D686B659"><enum>(i)</enum><text>the State;</text>
										</clause><clause id="id88113BC4D08446099CBFCF3146F39691"><enum>(ii)</enum><text>San Bernardino
				County, California;</text>
										</clause><clause id="id7E9FA78CAFB74CC3A55D2A69A8F4CA57"><enum>(iii)</enum><text>the
				public;</text>
										</clause><clause id="id553D6479E4FF4364B3F6A80DEA18B5F2"><enum>(iv)</enum><text>recreational
				user groups; and</text>
										</clause><clause id="id4B07A385B57A4BD4B90C49BD0FB43AE2"><enum>(v)</enum><text>conservation
				organizations;</text>
										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID55187f171b364abca488a34719e0056a"><enum>(B)</enum><text>explore the
				feasibility of expanding the southern boundary of the off-highway vehicle
				recreation area described in subsection (a)(4) to include previously disturbed
				land;</text>
									</subparagraph><subparagraph id="ID7c24845b89294482b5692ce38ced84e5"><enum>(C)</enum><text>identify and
				exclude from consideration any land that—</text>
										<clause id="idA567A362B244421FA3DB93C0ACFAAB55"><enum>(i)</enum><text>is managed for
				conservation purposes;</text>
										</clause><clause id="idF9A4B6F383BF47B095FBFADF377E5F5A"><enum>(ii)</enum><text>may be suitable
				for renewable energy development; or</text>
										</clause><clause id="id11B26E4026CC450BB257C80BC3C5DEA8"><enum>(iii)</enum><text>may be
				necessary for energy transmission; and</text>
										</clause></subparagraph><subparagraph id="id1D80AEBCA685428D90B7E325A54DBF07"><enum>(D)</enum><text>not recommend or
				approve expansion areas that collectively would exceed the total acres
				administratively designated for off-highway recreation within the Conservation
				Area as of the date of enactment of this title.</text>
									</subparagraph></paragraph><paragraph id="ID0f99030f42b045229839c0a3f9b1b4ec"><enum>(3)</enum><header>Applicable
				law</header><text>The Secretary shall consider the information and
				recommendations of the study completed under paragraph (1) to determine the
				impacts of expanding off-highway vehicle recreation areas designated by
				subsection (a) on the Conservation Area, in accordance with—</text>
									<subparagraph id="IDec4e7a3469404c94ad57927ce91dac5b"><enum>(A)</enum><text>the National
				Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.);</text>
									</subparagraph><subparagraph id="IDa923d93857db4428a2a9d9a582991c3d"><enum>(B)</enum><text>the Endangered
				Species Act of 1973 (16 U.S.C. 1531 et seq.); and</text>
									</subparagraph><subparagraph id="IDe3aa68dac9284740ad423b83f9949194"><enum>(C)</enum><text>any other
				applicable law.</text>
									</subparagraph></paragraph><paragraph id="id33724D13F7554D0984BFE51DBE396108"><enum>(4)</enum><header>Submission to
				congress</header><text>On completion of the study under paragraph (1), the
				Secretary shall submit the study to—</text>
									<subparagraph id="idE2E44702EF2043A3BE21953564D86286"><enum>(A)</enum><text>the Committee on
				Natural Resources of the House of Representatives; and</text>
									</subparagraph><subparagraph id="idE13E0F1D095243678165B97756E39A14"><enum>(B)</enum><text>the Committee on
				Energy and Natural Resources of the Senate.</text>
									</subparagraph></paragraph><paragraph id="ID27fa43a0e8fb4c9393969244a4e123dd"><enum>(5)</enum><header>Authorization
				for expansion</header>
									<subparagraph id="id961A449FAC194F0DBC2239A9C9EB563F"><enum>(A)</enum><header>In
				general</header><text>On completion of the study under paragraph (1) and in
				accordance with all applicable laws (including regulations), the Secretary
				shall authorize the expansion of the off-highway vehicle recreation areas
				recommended under the study.</text>
									</subparagraph><subparagraph id="idD421E65020AD4AB0B82200F7283E552A"><enum>(B)</enum><header>Management</header><text>Any
				land within the expanded areas under subparagraph (A) shall be managed in
				accordance with this section.</text>
									</subparagraph></paragraph></subsection></section></title><title id="id917032D63721444480991E26BD65F0F9"><enum>XIX</enum><header>Miscellaneous</header>
						<section id="ID8d458dd5b45943149d9540492fb1a564"><enum>1901.</enum><header>State land
				transfers and exchanges</header>
							<subsection id="ID5a4d5ecdee7147a3ab02d2f2741fc089"><enum>(a)</enum><header>Transfer of
				land to Anza-Borrego Desert State Park</header>
								<paragraph id="id04EB806CDD3D48929F3BE32E2BAF2D8B"><enum>(1)</enum><header>In
				general</header><text>On termination of all mining claims to the land described
				in paragraph (2), the Secretary shall transfer the land described in that
				paragraph to the State.</text>
								</paragraph><paragraph id="idEF85292CBA344ABDA7AFFDE2B2F5F7A4"><enum>(2)</enum><header>Description of
				land</header><text>The land referred to in paragraph (1) is certain Bureau of
				Land Management land in San Diego County, California, comprising approximately
				934 acres, as generally depicted on the 2 maps entitled <quote>Anza-Borrego
				Desert State Park Additions-Table Mountain Wilderness Study Area</quote> and
				dated July 15, 2009.</text>
								</paragraph><paragraph id="idFC0525431C0C45E88E6A72D643E111E0"><enum>(3)</enum><header>Management</header>
									<subparagraph id="ID774863d103d642f5ae7912024d1e7cfa"><enum>(A)</enum><header>In
				general</header><text>The land transferred under paragraph (1) shall be managed
				in accordance with the provisions of the California Wilderness Act (California
				Public Resources Code sections 5093.30–5093.40).</text>
									</subparagraph><subparagraph id="IDd579895d5f7944559bb2dcf285150966"><enum>(B)</enum><header>Withdrawal</header><text>Subject
				to valid existing rights, the land transferred under paragraph (1) is withdrawn
				from—</text>
										<clause id="IDd0d9db72a7ee4025a89a53d9f0e99907"><enum>(i)</enum><text>all forms of
				entry, appropriation, or disposal under the public land laws;</text>
										</clause><clause id="ID433175ac5c0748c39a6785eac240bc7f"><enum>(ii)</enum><text>location, entry,
				and patent under the mining laws; and</text>
										</clause><clause id="IDf21d276f0b104b46be6ebe34b933ad38"><enum>(iii)</enum><text>disposition
				under all laws relating to mineral and geothermal leasing.</text>
										</clause></subparagraph><subparagraph id="IDe179a21356294d3c92013ef5500e3867"><enum>(C)</enum><header>Reversion</header><text>If
				the State ceases to manage the land transferred under paragraph (1) as part of
				the State Park System or in a manner inconsistent with the California
				Wilderness Act (California Public Resources Code sections 5093.30–5093.40), the
				land shall revert to the Secretary, to be managed as a Wilderness Study
				Area.</text>
									</subparagraph></paragraph></subsection><subsection id="ID5a9cfaf32a8d4ce88cf47157d04e9b9c"><enum>(b)</enum><header>Land
				exchanges</header>
								<paragraph id="ID9c5d3525ae3649339726700bc641e3b2"><enum>(1)</enum><header>In
				general</header><text>The Secretary shall, in consultation and cooperation with
				the California State Lands Commission (referred to in this section as the
				<quote>Commission</quote>), develop a process to exchange isolated parcels of
				State land within the Conservation Area for Federal land located in the
				Conservation Area or other Federal land in the State that—</text>
									<subparagraph id="id9D278843E76F4EA287C3BEEAF0697DC6"><enum>(A)</enum><text>is consistent
				with the plans described in paragraph (2); and</text>
									</subparagraph><subparagraph id="idEE4BC669D9DD401BA65B61270060E52F"><enum>(B)</enum><text>ensures that the
				conservation goals and objectives identified in those plans are not adversely
				impacted.</text>
									</subparagraph></paragraph><paragraph id="id1CF2AD204AB34F3790F3144362532825"><enum>(2)</enum><header>Description of
				plans</header><text>The plans referred to in paragraph (1) are—</text>
									<subparagraph id="id2628637C647047E98698CC9D077204E3"><enum>(A)</enum><text>the California
				Desert Renewable Energy Conservation Plan;</text>
									</subparagraph><subparagraph id="id41BF66AC1248446A90465647F2811D96"><enum>(B)</enum><text>the California
				Desert Conservation Area Plan;</text>
									</subparagraph><subparagraph id="id4A45DCB7DE6C4FF1893E6F4129982108"><enum>(C)</enum><text>the Northern and
				Eastern Colorado Desert Plan; and</text>
									</subparagraph><subparagraph id="idDDFDA7421C934FF29A0E4EAF01752270"><enum>(D)</enum><text>any other
				applicable plans.</text>
									</subparagraph></paragraph><paragraph id="idF46FF0243589413FB2FFCD5C4CDA6201"><enum>(3)</enum><header>Requirements</header><text>The
				process developed under paragraph (1) shall—</text>
									<subparagraph id="ID99c67fe33ddf4665aa7de59aa37fd060"><enum>(A)</enum><text>apply to all
				State land within the Conservation Area that is under the jurisdiction of the
				Commission;</text>
									</subparagraph><subparagraph id="IDdf3e985eaf1240fc8041626322f9cb63"><enum>(B)</enum><text>prioritize the
				elimination of State land from units of the National Park System, national
				monuments, and wilderness areas;</text>
									</subparagraph><subparagraph id="ID7987e8906aae4680a064edd0fd7787d1"><enum>(C)</enum><text>provide the
				Commission with consolidated land holdings sufficient to make the land viable
				for commercial or recreation uses, including renewable energy development,
				off-highway vehicle recreation, or State infrastructure or resource
				needs;</text>
									</subparagraph><subparagraph id="ID795160aaeee142f2b8400fc0309c84b3"><enum>(D)</enum><text>establish methods
				to ensure that—</text>
										<clause id="ID5231985b1ee344b9af1ad1638176ded6"><enum>(i)</enum><text>not later than 1
				year after the date of enactment of this title, the Secretary and the
				Commission complete an inventory of Federal land and State land in the
				Conservation Area under the jurisdiction of the Secretary and the Commission,
				respectively, and any other Federal land and property outside the Conservation
				Area that is determined to be suitable for exchange consistent with paragraph
				(1);</text>
										</clause><clause id="IDa0a3c2591d314e06b7ea589d83093c47"><enum>(ii)</enum><text>there is a
				public comment period of not less than 90 days with respect to—</text>
											<subclause id="idCFF757143BA849C386BC2A85FB2E7E12"><enum>(I)</enum><text>the inventory of
				land under clause (i); and</text>
											</subclause><subclause id="id6700F2D138FB4499BA0848D0D3133C3A"><enum>(II)</enum><text>any proposed
				land exchange under this section that involves more than 5,000 acres of Federal
				land;</text>
											</subclause></clause><clause id="ID7e231cb63f6d46a7a2a9b90ee837e2d4"><enum>(iii)</enum><text>in preparing
				the inventory of Federal land suitable for exchange under clause (i), the
				Secretary shall use best efforts to give priority to—</text>
											<subclause id="IDfed44abfad38432b8f8f6c8b8fa395a0"><enum>(I)</enum><text>land that has the
				potential for commercial development, including renewable energy development,
				such as wind and solar energy development;</text>
											</subclause><subclause id="IDd95c9805ba6744e19935d15232da7669"><enum>(II)</enum><text>the land
				described in section 707(b)(2);</text>
											</subclause><subclause id="IDbe403d068ed54825a35ddf27159d724d"><enum>(III)</enum><text>land located
				outside the boundaries of the Conservation Area (including closed military base
				land and land identified as surplus by the Administrator of the General
				Services Administration) to avoid, to the maximum extent feasible, conflicts
				with conservation of desert land;</text>
											</subclause></clause><clause id="IDd409bf0a431c46749a6cf8b25f1a02b8"><enum>(iv)</enum><text>the inventory
				under clause (i) is updated annually by the Secretary and resubmitted to the
				Commission; and</text>
										</clause><clause id="ID1a0ef86a011547ff8a01546f5e734102"><enum>(v)</enum><text>the land
				exchanges are completed by the date that is 10 years after the date of
				enactment of this title; and</text>
										</clause></subparagraph><subparagraph id="idD85F2E787464429AB609FD5FE69A4878"><enum>(E)</enum><text>provide for the
				submission of annual reports to Congress that—</text>
										<clause id="IDcff8e68516954f03b5dd3626ebceeed1"><enum>(i)</enum><text>describe any
				progress or impediments to accomplishing the goal described in subparagraph
				(D)(v); and</text>
										</clause><clause id="ID20091f896f354899a565114bff0ba0a1"><enum>(ii)</enum><text>any
				recommendations for legislation to accomplish the goal.</text>
										</clause></subparagraph></paragraph><paragraph id="IDe4b10cb51ee7471dba02d2ac338994bf"><enum>(4)</enum><header>Valuation</header><text>Notwithstanding
				paragraphs (2) through (5) of subsection (d) of section 206 of the Federal Land
				Policy and Management Act of 1976 (43 U.S.C. 1716(d)), if, within 180 days
				after the submission of an appraisal under subsection (d)(1) of that section,
				the Secretary and the Commission cannot agree to accept the findings of the
				appraisal—</text>
									<subparagraph id="IDdfece1c883b846d5bec4996064b535e1"><enum>(A)</enum><text>the Secretary and
				the Commission shall mutually agree to employ a process of bargaining or some
				other process to determine the values of the land involved in the
				exchange;</text>
									</subparagraph><subparagraph id="IDa88b74c7c46f448e83d0cb778a8e20c9"><enum>(B)</enum><text>the appraisal
				shall be submitted to an arbiter appointed by the Secretary from a list of
				arbitrators submitted to the Secretary by the American Arbitration Association
				for arbitration;</text>
									</subparagraph><subparagraph id="id49EDCB6F14DD4DD3A9E05F2D9AC56549"><enum>(C)</enum><text>although the
				decision of the arbiter under subparagraph (B) shall be nonbinding, the
				decision may be used by the Secretary and the Commission as a valid appraisal
				for—</text>
										<clause id="id97819A01E5C048F8890D15F1781C4A6C"><enum>(i)</enum><text>a
				period of 2 years; and</text>
										</clause><clause id="id7FBB9297F0B74A2FB9246E9FB321E183"><enum>(ii)</enum><text>on mutual
				agreement of the Secretary and the Commission, an additional 2-year period;
				or</text>
										</clause></subparagraph><subparagraph id="ID6524dacf8215414b81dea7794cc46fa4"><enum>(D)</enum><text>on mutual
				agreement of the Secretary and the Commission, the valuation process shall be
				suspended or modified.</text>
									</subparagraph></paragraph><paragraph id="IDec3c7f050b734483be69c600f5bf8869"><enum>(5)</enum><header>Treatment of
				land use restrictions and pending applications</header><text>For the purposes
				of this title—</text>
									<subparagraph id="IDb94236ced06c419398132cfa4dd32b8c"><enum>(A)</enum><text>the Secretary
				shall not exclude parcels from exchanges because the parcels are subject to
				designations or pending land use applications, including applications for the
				development of renewable energy;</text>
									</subparagraph><subparagraph id="ID0d04579bb56444f2b71485739b931b24"><enum>(B)</enum><text>all Federal land
				and State land proposed for exchange or sale shall be valued—</text>
										<clause id="id3730C8DC3E554F5DAD3E60F923F99444"><enum>(i)</enum><text>according to fair
				market value;</text>
										</clause><clause id="id74959AE5DF8B49AFA64F1C55B4820F50"><enum>(ii)</enum><text>in accordance
				with section 206(d) of the Federal Land Policy and Management Act of 1976 (43
				U.S.C. 1716(d)); and</text>
										</clause><clause id="id727F320B391845CD91CAB9A8128514BD"><enum>(iii)</enum><text>without regard
				to—</text>
											<subclause id="id4B3502D1CA7B4656BF53A4D8ABB744E4"><enum>(I)</enum><text>pending land use
				applications;</text>
											</subclause><subclause id="idC5DFE284FBBF4EB8BD549461AD61306F"><enum>(II)</enum><text>renewable energy
				designations; or</text>
											</subclause><subclause id="idE50D50E21D6C4979A51E4744D0B1A960"><enum>(III)</enum><text>any land use
				restrictions on adjacent land.</text>
											</subclause></clause></subparagraph></paragraph><paragraph id="ID6661a08b34fc46debe19a24e9af54bbb"><enum>(6)</enum><header>Cooperation
				agreements</header><text>The Secretary may—</text>
									<subparagraph id="IDa57ecb1e5d9944a0a5bd92fd20233737"><enum>(A)</enum><text>enter into such
				joint agreements with the General Services Administration and the Commission as
				the Secretary determines to be necessary to facilitate land exchanges,
				including agreements that establish accounting mechanisms—</text>
										<clause id="idE9C12614BCB54FE5867F21209FD1904E"><enum>(i)</enum><text>to be used for
				tracking the differential in dollar value of land conveyed in a series of
				transactions; and</text>
										</clause><clause id="id80D24C0007634AFDB05D79D6EF9B9A96"><enum>(ii)</enum><text>that,
				notwithstanding part 2200 of title 43, Code of Federal Regulations (or
				successor regulations), may carry outstanding cumulative credit balances until
				the completion of the land exchange process developed under paragraph (1);
				and</text>
										</clause></subparagraph><subparagraph id="ID514330146db7479ca22091de723f442f"><enum>(B)</enum><text>to the extent
				that the agreement does not conflict with this section, continue using the
				agreement entitled <quote>Memorandum of Agreement Between California State
				Lands Commission, General Services Administration, and the Department of the
				Interior Regarding: Implementation of the California Desert Protection
				Act</quote>, which became effective on November 7, 1995.</text>
									</subparagraph></paragraph><paragraph id="IDa9e3ddc3453c46a898082f8da172a316"><enum>(7)</enum><header>Existing
				law</header><text>Except as otherwise provided in this section, nothing in this
				section supersede or limits section 707.</text>
								</paragraph><paragraph id="ID887b24c92ba246ecb71c11513c55f178"><enum>(8)</enum><header>State land
				leases</header>
									<subparagraph id="idA7437A5E2393493AA3943B674C714421"><enum>(A)</enum><header>In
				general</header><text>The Secretary shall manage any State land described in
				subparagraph (B) in accordance with the terms and conditions of the applicable
				State lease agreement for the duration of the lease, subject to applicable laws
				(including regulations).</text>
									</subparagraph><subparagraph id="id16A77D308D534B14B406F958EE9C435E"><enum>(B)</enum><header>Description of
				State land</header><text>The State land referred to in subparagraph (A) is any
				State land within the Conservation Area that is subject to a lease or permit on
				the date of enactment of this title that is transferred to the Federal
				Government.</text>
									</subparagraph><subparagraph id="id6480CAA098684B778D428989B7BFDD72"><enum>(C)</enum><header>Expiration of
				lease</header><text>On the expiration of a State lease referred to in
				subparagraph (A), the Secretary shall provide lessees with the opportunity to
				seek Federal permits to continue the existing use of the State land without
				further action otherwise required under the <act-name parsable-cite="NEPA69">National Environmental Policy Act of 1969</act-name> (42
				U.S.C. 4321 et seq.).</text>
									</subparagraph><subparagraph id="idF37A13638EA04192B75627F088E92D5E"><enum>(D)</enum><header>Applicable
				law</header><text>Except as otherwise provided in this section, any State land
				transferred to the United States under this section shall be managed in
				accordance with all laws (including regulations) and rules applicable to the
				public land adjacent to the transferred State land.</text>
									</subparagraph></paragraph></subsection><subsection id="ID81b33a7c2d7840b3b8235e2620d6da5b"><enum>(c)</enum><header>Twentynine
				Palms Marine Corps Base</header>
								<paragraph id="ID338be942e83d45448f51dd7334ba2396"><enum>(1)</enum><header>In
				general</header><text>The Secretary and the Secretary of Defense, in
				consultation and in cooperation with the California State Lands Commission,
				shall develop a process to purchase or exchange parcels of State land within
				the area of expansion and land use restrictions planned for the Twentynine
				Palms Marine Corps Base.</text>
								</paragraph><paragraph id="ID4a3b022834a649a9923bbe00abb9cb49"><enum>(2)</enum><header>Requirements</header><text>The
				process developed under paragraph (1) for exchanged parcels of State land shall
				provide the California State Lands Commission with consolidated land holdings
				sufficient to make the land viable for commercial or recreational uses,
				including renewable energy development, off-highway vehicle recreation, or
				State infrastructure or resource needs.</text>
								</paragraph><paragraph id="ID00af075f3dcb416ca3614de9b655848e"><enum>(3)</enum><header>Applicable
				law</header><text>An exchange of land under this subsection shall be subject to
				the requirements of subsection (b).</text>
								</paragraph></subsection><subsection id="IDf3bc2670491d41879a121503e9bc092c"><enum>(d)</enum><header>Holtville
				Airport, Imperial County</header>
								<paragraph id="id960169B54C674DB98A4299699460BD35"><enum>(1)</enum><header>In
				general</header><text>On the submission of an application by Imperial County,
				California, the Secretary of Transportation shall, in accordance with section
				47125 of title 49, United States Code, and section 2641.1 of title 43, Code of
				Federal Regulations (or successor regulations) seek a conveyance from the
				Secretary of approximately 3,500 acres of Bureau of Land Management land
				adjacent to the Imperial County Holtville Airport (L04) for the purposes of
				airport expansion.</text>
								</paragraph><paragraph id="id01741D289FE64AC99617EB1AB630CDC5"><enum>(2)</enum><header>Segregation</header><text>The
				Secretary (acting through the Director of the Bureau of Land Management) shall,
				with respect to the land to be conveyed under paragraph (1)—</text>
									<subparagraph id="id9EBCACEEF6AB447A81B9574E78D265FA"><enum>(A)</enum><text>segregate the
				land; and</text>
									</subparagraph><subparagraph id="id56258860ABB049EFB3E766E9AD8864AA"><enum>(B)</enum><text>prohibit the
				appropriation of the land until—</text>
										<clause id="id5A736C001FCA4C92B0673C2ECB7D1035"><enum>(i)</enum><text>the date on which
				a notice of realty action terminates the application; or</text>
										</clause><clause id="idC388A7FE3FB946E7BF4A7C949A99FEF2"><enum>(ii)</enum><text>the date on
				which a document of conveyance is published.</text>
										</clause></subparagraph></paragraph></subsection><subsection id="idD6217329203A41B08A9B57D14CB69C46"><enum>(e)</enum><header>Needles Solar
				Reserve, San Bernardino County</header>
								<paragraph id="idED37A876A1644889B7421E64858C92CA"><enum>(1)</enum><header>In
				general</header><text>The Secretary shall grant to the Commission a right of
				first refusal to exchange the State land described in paragraph (2) for Bureau
				of Land Management land identified for disposal.</text>
								</paragraph><paragraph id="id6C01D8BE2A5A41DD86A787ED909C7B28"><enum>(2)</enum><header>Secondary right
				of refusal</header><text>If the Commission declines to exchange State land for
				Bureau of Land Management land identified for disposal within the city limits
				of Needles, California, the City of Needles shall have a secondary right of
				refusal to acquire the land.</text>
								</paragraph></subsection></section><section id="id66E77A6DECBE4673ACD2CC36BB122F94"><enum>1902.</enum><header>Military
				activities</header><text display-inline="no-display-inline">Nothing in this
				Act—</text>
							<paragraph id="ID16778c2a46214f9ab239e99e63443624"><enum>(1)</enum><text>restricts or
				precludes Department of Defense motorized access by land or air—</text>
								<subparagraph id="idA62DAD2307F444C198C385A529C9D2F7"><enum>(A)</enum><text>to respond to an
				emergency within a wilderness area designated by this Act; or</text>
								</subparagraph><subparagraph id="idFE5A2CAFDEAC45EDA7C07A8AAFA49004"><enum>(B)</enum><text>to control access
				to the emergency site;</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDdf238cd35c4045e89cb8799729207e49"><enum>(2)</enum><text>prevents
				nonmechanized military training activities previously conducted on wilderness
				areas designated by this title that are consistent with—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="idEE52E28B9D66402C89B9D9ACC806A795"><enum>(A)</enum><text>the Wilderness
				Act (16 U.S.C. 1131 et seq.); and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA9317DD7B0B04063B34B22BD5F8F6883"><enum>(B)</enum><text>all applicable
				laws (including regulations);</text>
								</subparagraph></paragraph><paragraph id="IDc18c2d7463c844ef9f4d28363cfcd2cb"><enum>(3)</enum><text>restricts or
				precludes low-level overflights of military aircraft over the areas designated
				as wilderness, national monuments, special management areas, or recreation
				areas by this Act, including military overflights that can be seen or heard
				within the designated areas;</text>
							</paragraph><paragraph id="ID0e39c987156f4f29ba8e64f30b77d45a"><enum>(4)</enum><text>restricts or
				precludes flight testing and evaluation in the areas described in paragraph
				(3); or</text>
							</paragraph><paragraph id="IDf6524542f9b84003984043fba3c9ab0d"><enum>(5)</enum><text>restricts or
				precludes the designation or creation of new units of special use airspace, or
				the establishment of military flight training routes, over the areas described
				in paragraph (3).</text>
							</paragraph></section><section id="ID686cc8397dd8441bb69f7b99d61064a7"><enum>1903.</enum><header>Climate
				change and wildlife corridors</header>
							<subsection id="IDac7511dc012c40b0a3d94bb5a6d3e1f1"><enum>(a)</enum><header>In
				general</header><text>The Secretary shall—</text>
								<paragraph id="idACB3EB1C42354D6B8FE2AA36D66EAE6F"><enum>(1)</enum><text>assess the
				impacts of climate change on the Conservation Area; and</text>
								</paragraph><paragraph id="id9A7E80EFA69A4FA2963A68CFAB439E85"><enum>(2)</enum><text>establish
				policies and procedures to ensure the preservation of wildlife corridors and
				facilitate species migration likely to occur due to climate change.</text>
								</paragraph></subsection><subsection id="IDd585d8b581354847ac982a8d817637b7"><enum>(b)</enum><header>Study</header>
								<paragraph id="id2B125B5F35874D82ABCF102A3F2DD73F"><enum>(1)</enum><header>In
				general</header><text>As soon as practicable, but not later than 2 years, after
				the date of enactment of this title, the Secretary shall complete a study
				regarding the impact of global climate change on the Conservation Area.</text>
								</paragraph><paragraph id="id3BBD2B2998AA433AA66CB40490584FEE"><enum>(2)</enum><header>Components</header><text>The
				study under paragraph (1) shall—</text>
									<subparagraph id="idAF048CC5DEE94B2E920C200CA9C02596"><enum>(A)</enum><text>identify the
				species migrating, or likely to migrate, due to climate change;</text>
									</subparagraph><subparagraph id="ID22e428c592aa4d38ab6e0eeb25f354d5"><enum>(B)</enum><text>examine the
				impacts and potential impacts of climate change on—</text>
										<clause id="id343EAD76C9774995AF7D22EE8F941006"><enum>(i)</enum><text>plants, insects,
				and animals;</text>
										</clause><clause id="id373EF36C3FAC43959EF070C27E738588"><enum>(ii)</enum><text>soil;</text>
										</clause><clause id="id6A511E40EA524EB0A8D1FF0675AC4DF0"><enum>(iii)</enum><text>air
				quality;</text>
										</clause><clause id="idA482353538C84B56BC92292C5A41D215"><enum>(iv)</enum><text>water quality
				and quantity; and</text>
										</clause><clause id="idFF20871E98154072AF8D8DA1FEE860FB"><enum>(v)</enum><text>species migration
				and survival;</text>
										</clause></subparagraph><subparagraph id="id8CCEB598898D4D38B5A5F2CCDDF16ADD"><enum>(C)</enum><text>identify critical
				wildlife and species migration corridors recommended for preservation;
				and</text>
									</subparagraph><subparagraph id="id14CA76A8C70940399DB5F511DB738F88"><enum>(D)</enum><text>include
				recommendations for ensuring the biological connectivity of public land managed
				by the Secretary and the Secretary of Defense throughout the Conservation
				Area.</text>
									</subparagraph></paragraph><paragraph id="IDdf5dadd364384249b03f60f41b31adae"><enum>(3)</enum><header>Rights-of-way</header><text>The
				Secretary shall consider the information and recommendations of the study under
				paragraph (1) to determine the individual and cumulative impacts of
				rights-of-way for projects in the Conservation Area, in accordance with—</text>
									<subparagraph id="id0AFC62C67C174AC0B0EEC02F475F60FC"><enum>(A)</enum><text>the
				<act-name parsable-cite="NEPA69">National Environmental Policy Act of
				1969</act-name> (42 U.S.C. 4321 et seq.);</text>
									</subparagraph><subparagraph id="idB4AF0D64BC3C4AE8B3D9B6F50FE7DEAC"><enum>(B)</enum><text>the
				<act-name parsable-cite="ESA">Endangered Species Act of 1973</act-name> (16
				U.S.C. 1531 et seq.); and</text>
									</subparagraph><subparagraph id="idD6A013E6E2BA4712BE0325F8FFECF6C6"><enum>(C)</enum><text>any other
				applicable law.</text>
									</subparagraph></paragraph></subsection><subsection id="ID38678c21b4ea4162bda9133c40ad59cc"><enum>(c)</enum><header>Land management
				plans</header><text>The Secretary shall incorporate into all land management
				plans applicable to the Conservation Area the findings and recommendations of
				the study completed under subsection (b).</text>
							</subsection></section><section id="ID01548340b4b542268111cc1291b47ff0"><enum>1904.</enum><header>Prohibited
				uses of donated and acquired land</header>
							<subsection id="ID39e4f512a00f4eb9824b51712500dd9d"><enum>(a)</enum><header>Definitions</header><text>In
				this section:</text>
								<paragraph id="ID587a1a2dace14b5ea4cc780b16278847"><enum>(1)</enum><header>Acquired
				land</header><text>The term <term>acquired land</term> means any land acquired
				for the Conservation Area using amounts from the Land and Water Conservation
				Fund established under section 2 of the Land and Water Conservation Fund Act of
				1965 (16 U.S.C. 460l–5).</text>
								</paragraph><paragraph id="ID6fcb628a9b4b4e6aab2d59403109267c"><enum>(2)</enum><header>Donated
				land</header><text>The term <term>donated land</term> means any private land
				donated to the United States for conservation purposes in the Conservation
				Area.</text>
								</paragraph><paragraph id="ID7faabf1108c6425daeadb4387828c458"><enum>(3)</enum><header>Donor</header><text>The
				term <term>donor</term> means an individual or entity that donates private land
				within the Conservation Area to the United States.</text>
								</paragraph><paragraph id="IDccf20bfa86fd45d7a4702ef5a0835bc3"><enum>(4)</enum><header>Secretary</header><text>The
				term <term>Secretary</term> means the Secretary of the Interior, acting through
				the Director of the Bureau of Land Management.</text>
								</paragraph></subsection><subsection id="ID5a573fb186f0485985f6409852644ec4"><enum>(b)</enum><header>Prohibitions</header><text>Except
				as provided in subsection (c), there shall be prohibited with respect to
				donated land or acquired land—</text>
								<paragraph id="idD0307989A5AB4449AC7443CC8A0B4FC9"><enum>(1)</enum><text>disposal;
				or</text>
								</paragraph><paragraph id="id394DC42AD82A4661B5C157F2C2DE7CE8"><enum>(2)</enum><text>any land use
				authorization that would result in appreciable damage or disturbance to the
				public lands, including—</text>
									<subparagraph id="idF51BECDDA44D440FBCD638B434719418"><enum>(A)</enum><text>rights-of-way;</text>
									</subparagraph><subparagraph id="idF2301A493FB946659603722342CAF1AB"><enum>(B)</enum><text>leases;</text>
									</subparagraph><subparagraph id="idA4CA530E1B4D4127A3DC2F229804B7AD"><enum>(C)</enum><text>livestock
				grazing;</text>
									</subparagraph><subparagraph id="id5150A7F845C246AA899CDE8D1BE280C5"><enum>(D)</enum><text>infrastructure
				development;</text>
									</subparagraph><subparagraph id="id17B44A48B8F6461C9389FF4FE8BEF1FE"><enum>(E)</enum><text>mineral
				entry;</text>
									</subparagraph><subparagraph id="IDefbf208152df4183baa28b9354e2ac5a"><enum>(F)</enum><text>off-highway
				vehicle use, except on—</text>
										<clause id="id803D76403FEF414EB64D7D81A6436415"><enum>(i)</enum><text>designated
				routes;</text>
										</clause><clause id="idF88752E41816433A9DD797900067E9E5"><enum>(ii)</enum><text>off-highway
				vehicle areas designated by law; and</text>
										</clause><clause id="id0C82BC5C934641278329F793079EF834"><enum>(iii)</enum><text>administratively
				designated open areas; and</text>
										</clause></subparagraph><subparagraph id="id3E5DEC51B8CB40989A8139A1834A858D"><enum>(G)</enum><text>any other
				activities that would create impacts contrary to the conservation purposes for
				which the land was donated or acquired.</text>
									</subparagraph></paragraph></subsection><subsection id="IDb908d77eb58144afbd6263791eff6a97"><enum>(c)</enum><header>Exceptions</header>
								<paragraph id="idAA29390D1DE14DD19778F485CDD8EA2F"><enum>(1)</enum><header>Authorization
				by secretary</header><text>Subject to paragraph (2), the Secretary may
				authorize limited exceptions to prohibited uses of donated land or acquired
				land in the Conservation Area if—</text>
									<subparagraph id="ID3d159e1ba922425ab18682e23e925307"><enum>(A)</enum><text>an applicant has
				submitted a right-of-way use application to the Bureau of Land Management
				proposing renewable energy development on the donated land or acquired land on
				or before December 1, 2009; or</text>
									</subparagraph><subparagraph id="id2E514DE1FD684390BBA68F866AA30469"><enum>(B)</enum><text>after the
				completion of an analysis under the <act-name parsable-cite="NEPA69">National
				Environmental Policy Act of 1969</act-name> (42 U.S.C. 4321 et seq.), including
				full public participation in the analysis, the Secretary has determined
				that—</text>
										<clause id="id0C32E9D5A1FD40E49EB02E2E1E3ED820"><enum>(i)</enum><text>the use of the
				donated land or acquired land is in the public interest;</text>
										</clause><clause id="id6B2935BA994F48FF97ACA83C1BF96390"><enum>(ii)</enum><text>the impacts of
				the use are fully and appropriately mitigated; and</text>
										</clause><clause id="IDed0ac8927a904697a07d0d24d6a59792"><enum>(iii)</enum><text>the land was
				donated or acquired on or before December 1, 2009.</text>
										</clause></subparagraph></paragraph><paragraph id="ID19de2c5d2f644da396f1a67a5123096d"><enum>(2)</enum><header>Conditions</header>
									<subparagraph id="idCC004B1F08DD4F4FAD70CF0691FBC701"><enum>(A)</enum><header>In
				general</header><text>If the Secretary grants an exception to the prohibition
				under paragraph (1), the Secretary shall require the permittee to acquire and
				donate comparable private land to the United States to mitigate the use.</text>
									</subparagraph><subparagraph id="id2AEEC6DCDDC947AC9068EC1C1BE06D0E"><enum>(B)</enum><header>Approval</header><text>The
				private land to be donated under subparagraph (A) shall be approved by the
				Secretary after consultation, to the maximum extent practicable, with the donor
				of the private land proposed for non-conservation uses.</text>
									</subparagraph></paragraph></subsection><subsection id="ID1899536a9deb495b940bfccaf3985c2d"><enum>(d)</enum><header>Existing
				agreements</header><text>Nothing in this section affects permitted or
				prohibited uses of donated land or acquired land in the Conservation Area
				established in any easements, deed restrictions, memoranda of understanding, or
				other agreements in existence on the date of enactment of this title.</text>
							</subsection><subsection id="ID6ad7bbf544034b57805cffd299cb646e"><enum>(e)</enum><header>Deed
				restrictions</header><text>The Secretary may accept deed restrictions requested
				by donors for land donated to the United States within the Conservation Area
				after the date of enactment of this title.</text>
							</subsection></section><section id="IDd386ae26297d4816b8b3f4bebba4f681"><enum>1905.</enum><header>Tribal uses
				and interests</header>
							<subsection id="id54A994CE50884A88A2ACEF659852967F"><enum>(a)</enum><header>Access</header><text display-inline="yes-display-inline">The Secretary shall ensure access to areas
				designated under this Act by members of Indian tribes for traditional cultural
				and religious purposes, consistent with applicable law, including Public Law
				95–341 (commonly known as the “American Indian Religious Freedom Act”) (42
				U.S.C. 1996).</text>
							</subsection><subsection id="idE5C62153CE074675A83205A28EBFAB2B"><enum>(b)</enum><header>Temporary
				closure</header>
								<paragraph id="id940ECE4B24D94555B22931842BF8A423"><enum>(1)</enum><header>In
				general</header><text>In accordance with applicable law, including Public Law
				95–341 (commonly known as the “American Indian Religious Freedom Act”) (42
				U.S.C. 1996), and subject to paragraph (2), the Secretary, on request of an
				Indian tribe or Indian religious community, shall temporarily close to general
				public use any portion of an area designated as a national monument, special
				management area, wild and scenic river, or National Park System unit under this
				Act (referred to in this subsection as a <quote>designated area</quote>) to
				protect the privacy of traditional cultural and religious activities in the
				designated area by members of the Indian tribe or Indian religious
				community.</text>
								</paragraph><paragraph id="idDE7ACAD17E6C46A9BA255135B198512A"><enum>(2)</enum><header>Limitation</header><text>In
				closing a portion of a designated area under paragraph (1), the Secretary shall
				limit the closure to the smallest practicable area for the minimum period
				necessary for the traditional cultural and religious activities.</text>
								</paragraph></subsection><subsection id="ID0a3b1ce6db874edbb969214bb111abf9"><enum>(c)</enum><header>Tribal cultural
				resources management plan</header>
								<paragraph id="idA215D80001E64136A23A60484FE68273"><enum>(1)</enum><header>In
				general</header><text>Not later than 2 years after the date of enactment of
				this title, the Secretary of the Interior shall develop and implement a tribal
				cultural resources management plan to identify, protect, and conserve cultural
				resources of Indian tribes associated with the Xam Kwatchan Trail network
				extending from Avikwaame (Spirit Mountain, Nevada) to Avikwlal (Pilot Knob,
				California).</text>
								</paragraph><paragraph id="IDa18624ff986843efa3d8eedab798da7f"><enum>(2)</enum><header>Consultation</header><text>The
				Secretary shall consult on the development and implementation of the tribal
				cultural resources management plan under paragraph (1) with—</text>
									<subparagraph id="id1E3A8802585D401F88E7122877E45C97"><enum>(A)</enum><text>each of—</text>
										<clause id="IDe0f4844a08c342d1b789a88d845b7a29"><enum>(i)</enum><text>the Chemehuevi
				Indian Tribe;</text>
										</clause><clause id="IDc1cffd97d04c47ce9daad70a41208765"><enum>(ii)</enum><text>the Hualapai
				Tribal Nation;</text>
										</clause><clause id="ID63aa11957c8a4e0eb2e2c803534b946c"><enum>(iii)</enum><text>the Fort Mojave
				Indian Tribe;</text>
										</clause><clause id="ID90c00e54bd004a338e90322f88df056f"><enum>(iv)</enum><text>the Colorado
				River Indian Tribes;</text>
										</clause><clause id="ID1952fec5fbd34e47938730f1ab131f27"><enum>(v)</enum><text>the Quechan
				Indian Tribe; and</text>
										</clause><clause id="ID00ccdc906cac4695b51d70111175335e"><enum>(vi)</enum><text>the Cocopah
				Indian Tribe; and</text>
										</clause></subparagraph><subparagraph id="id9C5C91C9B1B04B8FAAB8007F990224B7"><enum>(B)</enum><text>the Advisory
				Council on Historic Preservation.</text>
									</subparagraph></paragraph><paragraph id="ID64bb486b913c42c1acdd50389567b095"><enum>(3)</enum><header>Resource
				protection</header><text>The tribal cultural resources management plan
				developed under paragraph (1) shall be—</text>
									<subparagraph id="id68414FCFB7D245A29654FC3F51142CB2"><enum>(A)</enum><text>based on a
				completed tribal cultural resources survey; and</text>
									</subparagraph><subparagraph id="idB0873A1E6F6246D99327AC2C156BC0CF"><enum>(B)</enum><text>include
				procedures for identifying, protecting, and preserving petroglyphs, ancient
				trails, intaglios, sleeping circles, artifacts, and other resources of
				cultural, archaeological, or historical significance in accordance with all
				applicable laws and policies, including—</text>
										<clause id="id2A910BA1F6A74803BE9C3256CE1DD816"><enum>(i)</enum><text>the National
				Historic Preservation Act (16 U.S.C. 470 et seq.);</text>
										</clause><clause id="id36590D9DC6D54052A10E241ED5F7A74B"><enum>(ii)</enum><text>Public Law
				95–341 (commonly known as the <quote>American Indian Religious Freedom
				Act</quote>)(42 U.S.C. 1996);</text>
										</clause><clause id="id3804170FCAAD46F5B0D71022683B95B9"><enum>(iii)</enum><text>the
				Archaeological Resources Protection Act of 1979 (16 U.S.C. 470aa et
				seq.);</text>
										</clause><clause id="id18CFF7BEE28245909EB5F19341EF931B"><enum>(iv)</enum><text>the Native
				American Graves Protection and Repatriation Act (25 U.S.C. 3001 et seq.);
				and</text>
										</clause><clause id="idE00F4CA8EB2F4E43BC565323DB2D1C85"><enum>(v)</enum><text>Public Law
				103–141 (commonly known as the <quote>Religious Freedom Restoration Act of
				1993</quote>)(42 U.S.C. 2000bb et seq.).</text>
										</clause></subparagraph></paragraph></subsection><subsection id="ID133bd614167547e5bc7d6612998c4fc7"><enum>(d)</enum><header>Withdrawal</header><text>Subject
				to valid existing rights, all Federal land within the area administratively
				withdrawn and known as the <quote>Indian Pass Withdrawal Area</quote> is
				permanently withdrawn from—</text>
								<paragraph id="ID1ff3324db6124bab8c1191db499c793e"><enum>(1)</enum><text>all forms of
				entry, appropriation, or disposal under the public laws;</text>
								</paragraph><paragraph id="ID4ca8cd1d4d944a2291573ccfa1ecbfe3"><enum>(2)</enum><text>location, entry,
				and patent under the mining laws; and</text>
								</paragraph><paragraph id="ID76b7d50992d24a159a7031123382b6e9"><enum>(3)</enum><text>right-of-way
				leasing and disposition under all laws relating to mineral, solar, wind, and
				geothermal
				energy.</text>
								</paragraph></subsection></section></title><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="IDd1a2c3f7b13e47cabee2bd2c4a81111e"><enum>(b)</enum><header>Conforming
			 amendments</header>
				<paragraph id="idD3CAA8826F1A4E67AE911CD984E13047"><enum>(1)</enum><header>Short
			 title</header><text>Section 1 of the California Desert Protection Act of 1994
			 (16 U.S.C. 410aaa note) is amended by striking <quote>1 and 2, and titles I
			 through IX</quote> and inserting <quote>1, 2, and 3, titles I through IX, and
			 titles XIII through XIX</quote>.</text>
				</paragraph><paragraph id="idB09DB3F2B9C748029EE1132D4FFC33F1"><enum>(2)</enum><header>Definitions</header><text>The

				activities</header><text>Any nonwilderness activities (including renewable
				energy projects, mining, camping, hunting, and military activities) in areas
				immediately adjacent to the boundary of a wilderness area designated by this
				Act shall not be restricted or precluded by this Act, regardless of any actual
				or perceived negative impacts of the nonwilderness activities on the wilderness
				area, including any potential indirect impacts of nonwilderness activities
				conducted outside the designated wilderness area on the viewshed, ambient noise
				level, or air quality of wilderness
				area.</text>
								</paragraph></subsection><after-quoted-block>; </after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="id52D0B50544E44A17A310F1BB3F513FA4"><enum>(B)</enum><text>in subsection
			 (f), by striking <quote>designated by this title and </quote> inserting
			 <quote>, potential wilderness areas, special management areas, and national
			 monuments designated by this title or titles XIII through XIX</quote>;
			 and</text>

				Director of the Bureau of Land Management shall not access or process any
				application for a right-of-way for development projects that propose to use
				native groundwater from aquifers adjacent to the Mojave National Preserve that
				individually or collectively, in combination with proposed or anticipated
				projects on private land, require the use of native groundwater in excess of
				the estimated recharge rate as determined by the United States Geological
				Survey.</text>

				</paragraph><paragraph id="id66F80881A664466FB8DE99103BD7D42E"><enum>(5)</enum><header>Amendments to
			 the California Military Lands Withdrawal and Overflights Act of 1994</header>
					<subparagraph id="idEA6DAC20494849B39BE2097A91DCD301"><enum>(A)</enum><header>Findings</header><text>Section
			 801(b)(2) of the California Military Lands Withdrawal and Overflights Act of
			 1994 (16 U.S.C. 410aaa–82 note) is amended by inserting <quote>, national
			 monuments, special management areas, potential wilderness areas,</quote> before
			 <quote>and wilderness areas</quote>.</text>
					</subparagraph><subparagraph id="IDcd12ee02e0244d69bc00cf5afe6b8c82"><enum>(B)</enum><header>Overflights;
			 special airspace</header><text>Section 802 of the California Military Lands
			 Withdrawal and Overflights Act of 1994 (16 U.S.C. 410aaa–82) is amended—</text>

							</clause><clause id="ID7047c27b035a405989b9a02406ca93af"><enum>(v)</enum><text>The 10-mile
				segment from 0.25 miles downstream of the Trail 2W01 crossing to the upper
				limit of the Mojave dam flood zone in sec. 17, T. 3 N., R. 3 W., as a wild
				river.</text>
							</clause><clause id="IDb05976382d5a427ea485fc15badfa206"><enum>(vi)</enum><text>The 11-mile
				segment of Holcomb Creek from 100 yards downstream of the Road 3N12 crossing to
				.25 miles downstream of Holcomb Crossing, as a recreational river.</text>

				segment of the Holcomb Creek from 0.25 miles downstream of Holcomb Crossing to

				the Snow Valley Ski Resort; or</text>

				segment of the South Fork Whitewater River from the confluence of the River
				with the East Fork to the section line between sections 32 and 33, T. 1 S., R.

						</subparagraph><subparagraph id="IDc451724fe18d45d9907f50451a3a7ca3"><enum>(D)</enum><text>The 1-mile
				segment of the South Fork Whitewater River from the section line between
				sections 32 and 33, T. 1 S., R. 2 E., to the section line between sections 33
				and 34, T. 1 S., R. 2 E., as a recreational river.</text>
						</subparagraph><subparagraph id="ID89f102cf0d5141c18e31f5f1d0e57327"><enum>(E)</enum><text>The 4.9-mile
				segment of the South Fork Whitewater River from the section line between
