		<section id="id9504A1CD661D4DB29E0D145D30A00D28" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Ban Poisonous Additives Act of
			 2011</short-title></quote>.</text>
		</section><section id="idC6B70131D21C4FE0A289E81EB186A9B3" section-type="subsequent-section"><enum>2.</enum><header>Requirements with
			 respect to bisphenol A</header>
			<subsection id="idE1387C787D3049CA85643B2203E856D1"><enum>(a)</enum><header>Ban on use of
			 bisphenol A in food and beverage containers for children</header>
				<paragraph id="id599FC27DF07D433CBDFF7FB9B02B08C3"><enum>(1)</enum><header>Baby food;
			 unfilled baby bottles and cups</header><text>Section 402 of the Federal Food,
			 Drug, and Cosmetic Act (21 U.S.C. 342) is amended by adding at the end the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="idAF01EFDFD0AC42B29095F856FFF70B81" style="OLC">
						<subsection id="id00614E1DEAB94A7CBA75A2BF69186F9C"><enum>(j)</enum><paragraph commented="no" display-inline="yes-display-inline" id="idE103CB9EF893426EB347D69855D0F728"><enum>(1)</enum><text>If it is a food
				intended for children 3 years of age or younger, the container of which
				(including the lining of such container) is composed, in whole or in part, of
				bisphenol A.</text>
							</paragraph><paragraph id="idB5F7E0A4A31E4AE49E722A62D8416DDF" indent="up1"><enum>(2)</enum><text>If it is a baby bottle or cup that is
				composed, in whole or in part, of bisphenol
				A.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="id0F738E7152E74841948606F70961509E"><enum>(2)</enum><header>Definition</header><text>Section
			 201 of the Federal Food, Drug, and Cosmetic Act (21 U.S.C. 321) is amended by
			 adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idDC180281E2E44577B9CCCFC5632DD8F6" style="OLC">
						<subsection id="idDBCC36188A7D4BA48FFE33F69BD7EC5A"><enum>(rr)</enum><header>Baby bottle or
				cup</header><text>For purposes of section 402(j), the term <term>baby bottle or
				cup</term> means a bottle or cup that—</text>
							<paragraph id="id8252A687567C48C1980753F088A1DB35"><enum>(1)</enum><text>is intended to
				aid in the feeding or providing of drink to children 3 years of age or younger;
				and</text>
							</paragraph><paragraph id="id0441E9BD495949B7AE942A66379859D6"><enum>(2)</enum><text>does not contain
				a food when such bottle or cup is sold or distributed at
				retail.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="id04B8B202EC7A47E8B759CFBD3208AAC8"><enum>(3)</enum><header>Effective
			 dates</header>
					<subparagraph id="id2CB0F2DB1B7F48EFB546392DCBF8CB9E"><enum>(A)</enum><header>Baby
			 food</header><text>Section 402(j)(1) of the Federal Food, Drug, and Cosmetic
			 Act, as added by paragraph (1), shall take effect 1 year after the date of
			 enactment of this Act.</text>
					</subparagraph><subparagraph id="idA70438E4A9AC42F88F6381B657A92B12"><enum>(B)</enum><header>Unfilled baby
			 bottles and cups</header><text>Section 402(j)(2) of the Federal Food, Drug, and
			 Cosmetic Act, as added by paragraph (1), shall take effect 180 days after the
			 date of enactment of this Act.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" id="id46F66B51A4C341E296C4D6CF5AB805EE"><enum>(b)</enum><header>Ban on use of
			 bisphenol A in infant formula containers</header>
				<paragraph commented="no" id="id7CC691E06B18459C93146D1F7BB713A8"><enum>(1)</enum><header>In
			 general</header><text>Section 412(a) of the Federal Food, Drug, and Cosmetic
			 Act (21 U.S.C. 350a(a)) is amended—</text>
					<subparagraph commented="no" id="idBA470CA171BC488B92E72064A3CBC6D8"><enum>(A)</enum><text>in paragraph (2),
			 by striking <quote>, or</quote> and inserting <quote>,</quote>;</text>
					</subparagraph><subparagraph commented="no" id="idA8DFF9B38FCF49349B56C385932EC994"><enum>(B)</enum><text>in paragraph (3),
			 by striking the period at the end and inserting <quote>, or</quote>; and</text>
					</subparagraph><subparagraph commented="no" id="id7C05B87E420A4EF0BE89A01E5A8A87EF"><enum>(C)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="id848473380FCF4DEAAF6B2F5CE9FB5F46" style="OLC">
							<paragraph commented="no" id="id2F4ED9AAC8EE4FE6850646AC809AA63D"><enum>(4)</enum><text>the container of
				such infant formula (including the lining of such container and, in the case of
				infant formula powder, excluding packaging on the outside of the container that
				does not come into contact with the infant formula powder) is composed, in
				whole or in part, of bisphenol
				A.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph commented="no" id="id6A6741F0830B4C7C937C59030EFCA782"><enum>(2)</enum><header>Effective
			 date</header><text>The amendments made by paragraph (1) shall take effect 18
			 months after the date of enactment of this Act.</text>
				</paragraph></subsection><subsection commented="no" id="idE4E10406D84946F4899B2B81E21CC340"><enum>(c)</enum><header>Regulation of
			 other containers composed of bisphenol A</header>
				<paragraph commented="no" id="id90544BF48E784A02B8B4858D129CDC78"><enum>(1)</enum><header>Safety
			 assessment of products composed of BPA</header><text>Not later than December 1,
			 2012, the Secretary of Health and Human Services (referred to in this Act as
			 the <quote>Secretary</quote>) shall issue a revised safety assessment for food
			 containers composed, in whole or in part, of bisphenol A, taking into
			 consideration different types of such food containers and the use of such food
			 containers with respect to different foods, as appropriate.</text>
				</paragraph><paragraph commented="no" id="idF2427F4EDE74481385797ADA5929D8BB"><enum>(2)</enum><header>Safety
			 standard</header><text>Through the safety assessment described in paragraph
			 (1), and taking into consideration the requirements of section 409 of the
			 Federal Food, Drug, and Cosmetic Act (21 U.S.C. 348) and section 170.3(i) of
			 title 21, Code of Federal Regulations, the Secretary shall determine whether
			 there is a reasonable certainty that no harm will result from aggregate
			 exposure to bisphenol A through food containers or other items composed, in
			 whole or in part, of bisphenol A, taking into consideration potential adverse
			 effects from low dose exposure, and the effects of exposure on vulnerable
			 populations, including pregnant women, infants, children, the elderly, and
			 populations with high exposure to bisphenol A.</text>
				</paragraph><paragraph commented="no" id="id63E5509AB4814C509E6458BE8CB51871"><enum>(3)</enum><header>Application of
			 safety standard to alternatives</header><text>The Secretary shall use the
			 safety standard described under paragraph (2) to evaluate the proposed uses of
			 alternatives to bisphenol A.</text>
				</paragraph></subsection><subsection id="id0D0F452CC2394507BB6A7003DAEF90BC"><enum>(d)</enum><header>Savings
			 provision</header><text display-inline="yes-display-inline">Nothing in this
			 section shall affect the right of a State, political subdivision of a State, or
			 Indian Tribe to adopt or enforce any regulation, requirement, liability, or
			 standard of performance that is more stringent than a regulation, requirement,
			 liability, or standard of performance under this section or that—</text>
				<paragraph id="idE67224AB3BF14F57BF3848CA9D9AA67A"><enum>(1)</enum><text>applies to a
			 product category not described in this section; or</text>
				</paragraph><paragraph id="idFBC8C387F4E24EC786654A579D70FF84"><enum>(2)</enum><text>requires the
			 provision of a warning of risk, illness, or injury associated with the use of
			 food containers composed, in whole or in part, of bisphenol A.</text>
				</paragraph></subsection><subsection id="idA4E3C360720C42D69EF47CDF63C9B205"><enum>(e)</enum><header>Definition</header><text>For
			 purposes of this section, the term <term>container</term> includes the lining
			 of a container.</text>
