			 short-time compensation programs</header>
			<subsection id="IDac192163a44e40f1952135a5fdfa6625"><enum>(a)</enum><header>Definition</header>
				<paragraph id="idBDE72D3B4E874A15B8BB5B2840ADAD30"><enum>(1)</enum><header>In
			 general</header><text>Section 3306 of the Internal Revenue Code of 1986 (26
			 U.S.C. 3306) is amended by adding at the end the following new
			 subsection:</text>
					<quoted-block display-inline="no-display-inline" id="idE34AE962AB824462AC0596FDF01C5670" style="OLC">
						<subsection id="IDdb9aeaf647244789a93811374b45301a"><enum>(v)</enum><header>Short-Time
				compensation program</header><text>For purposes of this chapter, the term
				<term>short-time compensation program</term> means a program under
				which—</text>
							<paragraph id="IDe5f6ba8d2a994fd897e0b09e20b8245b"><enum>(1)</enum><text>the participation
				of an employer is voluntary;</text>
							</paragraph><paragraph id="ID5557abf396e340b8acd72e2b2f346ef6"><enum>(2)</enum><text>an employer
				reduces the number of hours worked by employees in lieu of layoffs;</text>
							</paragraph><paragraph id="IDd253652f6ee941ee9ad7ca6641f3d4d0"><enum>(3)</enum><text>such employees
				whose workweeks have been reduced by at least 10 percent, and by not more than
				the percentage, if any, that is determined by the State to be appropriate (but
				in no case more than 60 percent), are eligible for unemployment
				compensation;</text>
							</paragraph><paragraph id="ID662e70272d184440b15a08446eb645af"><enum>(4)</enum><text>the amount of
				unemployment compensation payable to any such employee is a pro rata portion of
				the unemployment compensation which would otherwise be payable to the employee
				if such employee were totally unemployed;</text>
							</paragraph><paragraph id="IDf936453b77674429b83623028eb8ac60"><enum>(5)</enum><text>such employees
				are not expected to meet the availability for work or work search test
				requirements while collecting short-time compensation benefits, but are
				required to be available for their normal workweek;</text>
							</paragraph><paragraph id="ID0d49a53b45574954a743c456f9a5009a"><enum>(6)</enum><text>eligible
				employees may participate, as appropriate, in training (including
				employer-sponsored training or worker training funded under the Workforce
				Investment Act of 1998) to enhance job skills if such program has been approved
				by the State agency;</text>
							</paragraph><paragraph id="ID75c5e61c5a81493c88b613b345d2ac63"><enum>(7)</enum><text>the State agency
				shall require employers to certify that the employer will continue to provide
				health benefits and retirement benefits under a defined benefit plan (as
				defined in section 414(j)) and contributions under a defined contribution plan
				(as defined in section 414(i)) to any employee whose workweek is reduced under
				the program under the same terms and conditions as though the workweek of such
				employee had not been reduced;</text>
							</paragraph><paragraph id="IDf496c67b70d44828acca8731d86a6b26"><enum>(8)</enum><text>the State agency
				shall require an employer to submit a written plan describing the manner in
				which the requirements of this subsection will be implemented (including a plan
				for giving advance notice, where feasible, to an employee whose workweek is to
				be reduced) together with an estimate of the number of layoffs that would have
				occurred absent the ability to participate in short-time compensation and such
				other information as the Secretary of Labor determines is appropriate;</text>
							</paragraph><paragraph id="ID1e82ced2593649f68617e8f869b526f5"><enum>(9)</enum><text>in the case of
				employees represented by a union, the appropriate official of the union has
				agreed to the terms of the employer’s written plan and implementation is
				consistent with employer obligations under the applicable Federal laws;
				and</text>
							</paragraph><paragraph id="ID1290c41d72d1401aa8de41897042e684"><enum>(10)</enum><text>upon request by
				the State and approval by the Secretary of Labor, only such other provisions
				are included in the State law that are determined to be appropriate for
				purposes of a short-time compensation
				program.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="IDa12564ff13034bc78b96475186709a5a"><enum>(2)</enum><header>Effective
			 date</header><text>Subject to paragraph (3), the amendment made by paragraph
			 (1) shall take effect on the date of the enactment of this Act.</text>
				</paragraph><paragraph id="idC33EE47E2F324BA0AA5EF4071F79A324"><enum>(3)</enum><header>Transition
			 period for existing programs</header><text>In the case of a State that is
			 administering a short-time compensation program as of the date of the enactment
			 of this Act and the State law cannot be administered consistent with the
			 amendment made by paragraph (1), such amendment shall take effect on the
			 earlier of—</text>
					<subparagraph id="idFB71011F590C41AB803240AEF27C3E2C"><enum>(A)</enum><text>the date the
			 State changes its State law in order to be consistent with such amendment;
			 or</text>
					</subparagraph><subparagraph id="id101D5DB68F1748BF9D1530DF5BB7129C"><enum>(B)</enum><text>the date that is
			 2 years and 6 months after the date of the enactment of this Act.</text>
					</subparagraph></paragraph></subsection><subsection id="ID3c9b6bb20e7f4388b804f3a9f7bbcc86"><enum>(b)</enum><header>Conforming
			 amendments</header>
				<paragraph id="id3E5DB283DEEF4FEDB47AA97FB5C081E9"><enum>(1)</enum><header>Internal
			 Revenue Code of 1986</header>
					<subparagraph id="IDacf3156b37994db0ab36ad828f842f9c"><enum>(A)</enum><text>Subparagraph (E)
			 of section 3304(a)(4) of the Internal Revenue Code of 1986 is amended to read
			 as follows:</text>
						<quoted-block display-inline="no-display-inline" id="id7E4181FE4DBE445AB703EC634934D49E" style="OLC">
							<subparagraph id="ID19d2469042af47989e46dd844a2b675a"><enum>(E)</enum><text>amounts may be
				withdrawn for the payment of short-time compensation under a short-time
				compensation program (as defined under section
				3306(v));</text>
							</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="ID1a83c8a532754999a2cd6661eadf6d1f"><enum>(B)</enum><text>Subsection (f) of
			 section 3306 of the Internal Revenue Code of 1986 is amended—</text>
						<clause id="id0BE062D2136A44849CEA406E97B3E982"><enum>(i)</enum><text>by
			 striking paragraph (5) (relating to short-time compensation) and inserting the
			 following new paragraph:</text>
							<quoted-block display-inline="no-display-inline" id="idF2D24B57A4DB4BEF83AECC4F30F2B3E5" style="OLC">
								<paragraph id="IDdb5a5c75be7b486385262214b50e0aac"><enum>(5)</enum><text>amounts may be
				withdrawn for the payment of short-time compensation under a short-time
				compensation program (as defined in subsection (v));
				and</text>
								</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
						</clause><clause commented="no" display-inline="no-display-inline" id="id4D8747ECAE7549D5AED11A5478907E5C"><enum>(ii)</enum><text>by redesignating
			 paragraph (5) (relating to self-employment assistance program) as paragraph
			 (6).</text>
						</clause></subparagraph></paragraph><paragraph id="ID0f23dcfab1d949b69b807e9e0919a11d"><enum>(2)</enum><header>Social Security
			 Act</header><text>Section 303(a)(5) of the Social Security Act is amended by
			 striking <quote>the payment of short-time compensation under a plan approved by
			 the Secretary of Labor</quote> and inserting <quote>the payment of short-time
			 compensation under a short-time compensation program (as defined in section
			 3306(v) of the Internal Revenue Code of 1986)</quote>.</text>
				</paragraph><paragraph id="IDa799bca15e7d479486a9b5558905c178"><enum>(3)</enum><header>Unemployment
			 Compensation Amendments of 1992</header><text>Subsections (b) through (d) of
			 section 401 of the Unemployment Compensation Amendments of 1992 (26 U.S.C. 3304
			 note) are repealed.</text>
				</paragraph></subsection></section><section id="ID5079f7242821472bbacbc2b6d3f216e5"><enum>3.</enum><header>Temporary
			 financing of short-time compensation payments in States with programs in
			 law</header>
			<subsection id="ID3ef025a1c4ff46629bdef27610b8b970"><enum>(a)</enum><header>Payments to
			 States</header>
				<paragraph id="IDf831d262360741348128777b24ed1f34"><enum>(1)</enum><header>In
			 general</header><text>Subject to paragraph (3), there shall be paid to a State
			 an amount equal to 100 percent of the amount of short-time compensation paid
			 under a short-time compensation program (as defined in section 3306(v) of the
			 Internal Revenue Code of 1986, as added by section 2(a)) under the provisions
			 of the State law.</text>
				</paragraph><paragraph id="ID3b6b730d06334692a18bb5572a27ec7a"><enum>(2)</enum><header>Terms of
			 payments</header><text>Payments made to a State under paragraph (1) shall be
			 payable by way of reimbursement in such amounts as the Secretary estimates the
			 State will be entitled to receive under this section for each calendar month,
			 reduced or increased, as the case may be, by any amount by which the Secretary
			 finds that the Secretary's estimates for any prior calendar month were greater
			 or less than the amounts which should have been paid to the State. Such
			 estimates may be made on the basis of such statistical, sampling, or other
			 method as may be agreed upon by the Secretary and the State agency of the State
			 involved.</text>
				</paragraph><paragraph id="ID07344e06f17a4de0875ca89239d9d91a"><enum>(3)</enum><header>Limitations on
			 payments</header>
					<subparagraph id="ID034a2a013ed74d9c92487039370de728"><enum>(A)</enum><header>General payment
			 limitations</header><text>No payments shall be made to a State under this
			 section for short-time compensation paid to an individual by the State during a
			 benefit year in excess of 26 times the amount of regular compensation
			 (including dependents’ allowances) under the State law payable to such
			 individual for a week of total unemployment.</text>
					</subparagraph><subparagraph id="ID383f3599cd0f42168cd7bdca3eb69d1d"><enum>(B)</enum><header>Employer
			 limitations</header><text>No payments shall be made to a State under this
			 section for benefits paid to an individual by the State under a short-time
			 compensation program if such individual is employed by an employer on a
			 seasonal, temporary, or intermittent basis.</text>
					</subparagraph></paragraph></subsection><subsection id="IDc4e7673573f94ddfb9d0f308b401b31e"><enum>(b)</enum><header>Applicability</header>
				<paragraph id="idDF27086D298A418398374E525EACF41F"><enum>(1)</enum><header>In
			 general</header><text>Payments to a State under subsection (a) shall be
			 available for weeks of unemployment—</text>
					<subparagraph id="ID97ec9994158940f0b09780cee963408d"><enum>(A)</enum><text>beginning on or
			 after the date of the enactment of this Act; and</text>
					</subparagraph><subparagraph id="ID0da3f6824cc3486ca22f18acd1fac048"><enum>(B)</enum><text>ending on or
			 before the date that is 3 years and 6 months after the date of the enactment of
			 this Act.</text>
					</subparagraph></paragraph><paragraph id="id4BA69CE4DB6B46829E1654F672303000"><enum>(2)</enum><header>Three-year
			 funding limitation for combined payments under this section and section
			 4</header><text>States may receive payments under this section and section 4
			 with respect to a total of not more than 156 weeks.</text>
				</paragraph></subsection><subsection id="idDD2541B9AB9D485CBA474A14DF23B6E8"><enum>(c)</enum><header>Two-Year
			 transition period for existing programs</header><text>During any period that
			 the transition provision under section 2(a)(3) is applicable to a State with
			 respect to a short-time compensation program, such State shall be eligible for
			 payments under this section. Subject to paragraphs (1)(B) and (2) of subsection
			 (b), if at any point after the date of the enactment of this Act the State
			 enacts a State law providing for the payment of short-time compensation under a
			 short-time compensation program that meets the definition of such a program
			 under section 3306(v) of the Internal Revenue Code of 1986, as added by section
			 2(a), the State shall be eligible for payments under this section after the
			 effective date of such enactment.</text>
			</subsection><subsection id="ID9e582f8494714ec9a65287e0b282e78b"><enum>(d)</enum><header>Funding and
			 certifications</header>
				<paragraph id="IDf588528917344cb3aedba647cbbf8efe"><enum>(1)</enum><header>Funding</header><text>There
			 are appropriated, out of moneys in the Treasury not otherwise appropriated,
			 such sums as may be necessary for purposes of carrying out this section.</text>
				</paragraph><paragraph id="ID13279eb8abb44c4c99ea336498ffe486"><enum>(2)</enum><header>Certifications</header><text>The
			 Secretary shall from time to time certify to the Secretary of the Treasury for
			 payment to each State the sums payable to such State under this section.</text>
				</paragraph></subsection><subsection id="ID4dea8c856abb46cd9cb5af59bdec3e9a"><enum>(e)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="id9DFA1F1B19A84624B881A8171CE1AD50"><enum>(1)</enum><header>Secretary</header><text>The
			 term <quote>Secretary</quote> means the Secretary of Labor.</text>
				</paragraph><paragraph id="id127E26D1AE5E40BCB5905AA6E0340D16"><enum>(2)</enum><header>State; State
			 agency; State law</header><text>The terms <term>State</term>, <quote>State
			 agency</quote>, and <quote>State law</quote> have the meanings given those
			 terms in section 205 of the Federal-State Extended Unemployment Compensation
			 Act of 1970 (26 U.S.C. 3304 note).</text>
				</paragraph></subsection></section><section id="ID339b0796cd534816b0294d17e46470c4"><enum>4.</enum><header>Temporary
			 financing of short-time compensation agreements</header>
			<subsection id="ID58b29cc1d8444cc49018fc2f59a68778"><enum>(a)</enum><header>Federal-State
			 agreements</header>
				<paragraph id="id342EA7804D9F43999B80175A3A35C1F1"><enum>(1)</enum><header>In
			 general</header><text>Any State which desires to do so may enter into, and
			 participate in, an agreement under this section with the Secretary provided
			 that such State's law does not provide for the payment of short-time
			 compensation under a short-time compensation program (as defined in section
			 3306(v) of the Internal Revenue Code of 1986, as added by section 2(a)).</text>
				</paragraph><paragraph id="idE86B8E246F9B46D4AB14CEB92E304C1C"><enum>(2)</enum><header>Ability to
			 terminate</header><text>Any State which is a party to an agreement under this
			 section may, upon providing 30 days’ written notice to the Secretary, terminate
			 such agreement.</text>
				</paragraph></subsection><subsection id="ID8ebc6aeb867b4d0b944f7b935616b86e"><enum>(b)</enum><header>Provisions of
			 Federal-State agreement</header>
				<paragraph commented="no" id="ID962a5d7491204e23829bef5ad926dabb"><enum>(1)</enum><header>In
			 general</header><text>Any agreement under this section shall provide that the
			 State agency of the State will make payments of short-time compensation under a
			 plan approved by the State. Such plan shall provide that payments are made in
			 accordance with the requirements under section 3306(v) of the Internal Revenue
			 Code of 1986, as added by section 2(a).</text>
				</paragraph><paragraph id="ID8be6698fdd554b969b85d50b51691ed4"><enum>(2)</enum><header>Limitations on
			 plans</header>
					<subparagraph id="ID0aefcfc93e234c2c89e687c3869276cc"><enum>(A)</enum><header>General payment
			 limitations</header><text>A short-time compensation plan approved by a State
			 shall not permit the payment of short-time compensation to an individual by the
			 State during a benefit year in excess of 26 times the amount of regular
			 compensation (including dependents’ allowances) under the State law payable to
			 such individual for a week of total unemployment.</text>
					</subparagraph><subparagraph id="IDb6e5975948f64bff9823dc0833068f9e"><enum>(B)</enum><header>Employer
			 limitations</header><text>A short-time compensation plan approved by a State
			 shall not provide payments to an individual if such individual is employed by
			 an employer on a seasonal, temporary, or intermittent basis.</text>
					</subparagraph></paragraph><paragraph id="IDd81c7b5482194fe6ab513468b02533d2"><enum>(3)</enum><header>Employer
			 payment of costs</header><text>Any short-time compensation plan entered into by
			 an employer must provide that the employer will pay the State an amount equal
			 to one-half of the amount of short-time compensation paid under such plan. Such
			 amount shall be deposited in the State’s unemployment fund and shall not be
			 used for purposes of calculating an employer’s contribution rate under section
			 3303(a)(1) of the Internal Revenue Code of 1986.</text>
				</paragraph></subsection><subsection id="ID097cea5438374ae18511df5fcf5d4255"><enum>(c)</enum><header>Payments to
			 States</header>
				<paragraph id="IDd2b1c54710b842f986d4f4c673110cc9"><enum>(1)</enum><header>In
			 general</header><text>There shall be paid to each State with an agreement under
			 this section an amount equal to—</text>
					<subparagraph id="id52AC0B62554D44FCA75285698EA5DD40"><enum>(A)</enum><text>one-half of the
			 amount of short-time compensation paid to individuals by the State pursuant to
			 such agreement; and</text>
					</subparagraph><subparagraph id="ID6acaed980772444c9c7955b92ea20e7e"><enum>(B)</enum><text>any additional
			 administrative expenses incurred by the State by reason of such agreement (as
			 determined by the Secretary).</text>
					</subparagraph></paragraph><paragraph id="IDe737870fd73c41cba47a02e23c1abeeb"><enum>(2)</enum><header>Terms of
			 payments</header><text>Payments made to a State under paragraph (1) shall be
			 payable by way of reimbursement in such amounts as the Secretary estimates the
			 State will be entitled to receive under this section for each calendar month,
			 reduced or increased, as the case may be, by any amount by which the Secretary
			 finds that the Secretary's estimates for any prior calendar month were greater
			 or less than the amounts which should have been paid to the State. Such
			 estimates may be made on the basis of such statistical, sampling, or other
			 method as may be agreed upon by the Secretary and the State agency of the State
			 involved.</text>
				</paragraph><paragraph id="ID7b61f65be4eb4bcb82c94a2507fc36dd"><enum>(3)</enum><header>Funding</header><text>There
			 are appropriated, out of moneys in the Treasury not otherwise appropriated,
			 such sums as may be necessary for purposes of carrying out this section.</text>
				</paragraph><paragraph id="ID0c470eaf4b8f4a0581cfb00b559bb709"><enum>(4)</enum><header>Certifications</header><text>The
			 Secretary shall from time to time certify to the Secretary of the Treasury for
			 payment to each State the sums payable to such State under this section.</text>
				</paragraph></subsection><subsection id="ID9fba9dc0815445a8b777d6cee5ba9d2c"><enum>(d)</enum><header>Applicability</header>
				<paragraph id="id9F715E6042FF4F80AD6B53161F1793E2"><enum>(1)</enum><header>In
			 general</header><text>An agreement entered into under this section shall apply
			 to weeks of unemployment—</text>
					<subparagraph id="ID8934ca074b924203a49ce27fd4937f73"><enum>(A)</enum><text>beginning on or
			 after the date on which such agreement is entered into; and</text>
					</subparagraph><subparagraph id="IDb5de5bf9483646db9b1d75355914b65f"><enum>(B)</enum><text>ending on or
			 before the date that is 2 years and 13 weeks after the date of the enactment of
			 this Act.</text>
					</subparagraph></paragraph><paragraph id="idC717955D33854FB4B8E6F0803E4F7FDB"><enum>(2)</enum><header>Two-year
			 funding limitation</header><text>States may receive payments under this section
			 with respect to a total of not more than 104 weeks.</text>
				</paragraph></subsection><subsection id="ID88ebc4561b2a4481a88d594485b353bb"><enum>(e)</enum><header>Special
			 rule</header><text>If a State has entered into an agreement under this section
			 and subsequently enacts a State law providing for the payment of short-time
			 compensation under a short-time compensation program that meets the definition
			 of such a program under section 3306(v) of the Internal Revenue Code of 1986,
			 as added by section 2(a), the State—</text>
				<paragraph id="id023C9C2D29764F23AD69E40EF68736B7"><enum>(1)</enum><text>shall not be
			 eligible for payments under this section for weeks of unemployment beginning
			 after the effective date of such State law; and</text>
				</paragraph><paragraph id="id13505F9868944BEAA944211423D2F497"><enum>(2)</enum><text>subject to
			 paragraphs (1)(B) and (2) of section 3(b), shall be eligible to receive
			 payments under section 3 after the effective date of such State law.</text>
				</paragraph></subsection><subsection id="id1551E9695542442A8882E2263840A18B"><enum>(f)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="id650C6005B6EC4B1B8EA617720B5BC7FA"><enum>(1)</enum><header>Secretary</header><text>The
			 term <quote>Secretary</quote> means the Secretary of Labor.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id11F81C340D074B459E53BD8A94781363"><enum>(2)</enum><header>State; State
			 agency; State law</header><text>The terms <term>State</term>, <quote>State
			 agency</quote>, and <quote>State law</quote> have the meanings given those
			 terms in section 205 of the Federal-State Extended Unemployment Compensation
			 Act of 1970 (26 U.S.C. 3304 note).</text>
				</paragraph></subsection></section><section id="IDe9d4b687a209483db075709bef174796"><enum>5.</enum><header>Grants for
			 short-time compensation programs</header>
			<subsection id="idDA346A7278F840649A0FC89B787F7F1E"><enum>(a)</enum><header>Grants</header>
				<paragraph id="IDd1250c95a98c4bab863ef089bddae61f"><enum>(1)</enum><header>For
			 implementation or improved administration</header><text>The Secretary shall
			 award grants to States that enact short-time compensation programs (as defined
			 in subsection (i)(2)) for the purpose of implementation or improved
			 administration of such programs.</text>
				</paragraph><paragraph id="ID58312661586a495ebf928487b2a1153e"><enum>(2)</enum><header>For promotion
			 and enrollment</header><text>The Secretary shall award grants to States that
			 are eligible and submit plans for a grant under paragraph (1) for such States
			 to promote and enroll employers in short-time compensation programs (as so
			 defined).</text>
				</paragraph><paragraph id="idDD2ADF1244204FA6A685DF33B6FE8DB1"><enum>(3)</enum><header>Eligibility</header>
					<subparagraph id="idDEB33702DED64426A8CB07739924B2DC"><enum>(A)</enum><header>In
			 general</header><text>The Secretary shall determine eligibility criteria for
			 the grants under paragraph (1) and (2).</text>
					</subparagraph><subparagraph id="id65AF4BD663954492B8EBD657DE397398"><enum>(B)</enum><header>Clarification</header><text>A
			 State administering a short-time compensation program, including a program
			 being administered by a State that is participating in the transition under the
			 provisions of sections 2(a)(3) and 3(c), that does not meet the definition of a
			 short-time compensation program under section 3306(v) of the Internal Revenue
			 Code of 1986 (as added by 2(a)), and a State with an agreement under section 4,
			 shall not be eligible to receive a grant under this section until such time as
			 the State law of the State provides for payments under a short-time
			 compensation program that meets such definition and such law.</text>
					</subparagraph></paragraph></subsection><subsection id="idEBD3CBBFD3A1409C9EDB839CB811ADAB"><enum>(b)</enum><header>Amount of
			 grants</header>
				<paragraph id="idDFB7A09AECDF49078F04D7706367AB94"><enum>(1)</enum><header>In
			 general</header><text>The maximum amount available for making grants to a State
			 under paragraphs (1) and (2) shall be equal to the amount obtained by
			 multiplying $700,000,000 (less the amount used by the Secretary under
			 subsection (e)) by the same ratio as would apply under subsection (a)(2)(B) of
			 section 903 of the Social Security Act (42 U.S.C. 1103) for purposes of
			 determining such State's share of any excess amount (as described in subsection
			 (a)(1) of such section) that would have been subject to transfer to State
			 accounts, as of October 1, 2010, under the provisions of subsection (a) of such
			 section.</text>
				</paragraph><paragraph id="IDB73F1F1BD23342519C00C397E8074E5B"><enum>(2)</enum><header>Amount
			 available for different grants</header><text>Of the maximum incentive payment
			 determined under paragraph (1) with respect to a State—</text>
					<subparagraph id="ID346796E640364BBDA16A97E4E2C52681"><enum>(A)</enum><text>one-third shall
			 be available for a grant under subsection (a)(1); and</text>
					</subparagraph><subparagraph id="id01B1F32F30CB446BA4C030DB8F9F3FF1"><enum>(B)</enum><text>two-thirds shall
			 be available for a grant under subsection (a)(2).</text>
					</subparagraph></paragraph></subsection><subsection id="idB14AC741C3114F78B0F6AE2CB60D7DC7"><enum>(c)</enum><header>Grant
			 application and disbursal</header>
				<paragraph id="id2F1B9B23B2F549F7826553CFA5FACB76"><enum>(1)</enum><header>Application</header><text>Any
			 State seeking a grant under paragraph (1) or (2) of subsection (a) shall submit
			 an application to the Secretary at such time, in such manner, and complete with
			 such information as the Secretary may require. In no case may the Secretary
			 award a grant under this section with respect to an application that is
			 submitted after December 31, 2014.</text>
				</paragraph><paragraph id="ID86fd013c84fe43d0913670267ed0f3ad"><enum>(2)</enum><header>Notice</header><text>The
			 Secretary shall, within 30 days after receiving a complete application, notify
			 the State agency of the State of the Secretary's findings with respect to the
			 requirements for a grant under paragraph (1) or (2) (or both) of subsection
			 (a).</text>
				</paragraph><paragraph id="ID22efbba6c4bd4939b8a091e7094f7ebf"><enum>(3)</enum><header>Certification</header><text>If
			 the Secretary finds that the State law provisions meet the requirements for a
			 grant under subsection (a), the Secretary shall thereupon make a certification
			 to that effect to the Secretary of the Treasury, together with a certification
			 as to the amount of the grant payment to be transferred to the State account in
			 the Unemployment Trust Fund (as established in section 904(a) of the Social
			 Security Act (42 U.S.C. 1104(a))) pursuant to that finding. The Secretary of
			 the Treasury shall make the appropriate transfer to the State account within 7
			 days after receiving such certification.</text>
				</paragraph><paragraph id="ID12bf7bda056a4493bf860797209ec797"><enum>(4)</enum><header>Requirement</header><text>No
			 certification of compliance with the requirements for a grant under paragraph
			 (1) or (2) of subsection (a) may be made with respect to any State
			 whose—</text>
					<subparagraph id="idE4DBD47A87DF4A36BB972985B03D5CA5"><enum>(A)</enum><text>State law is not
			 otherwise eligible for certification under section 303 of the Social Security
			 Act (42 U.S.C. 503) or approvable under section 3304 of the Internal Revenue
			 Code of 1986; or</text>
					</subparagraph><subparagraph id="id52D05D7AD73B427588EF76D13D2F62F2"><enum>(B)</enum><text>short-time
			 compensation program is subject to discontinuation or is not scheduled to take
			 effect within 12 months of the certification.</text>
					</subparagraph></paragraph></subsection><subsection id="idC295711D07404E41BD72774CFBA51F48"><enum>(d)</enum><header>Use of
			 funds</header><text>The amount of any grant awarded under this section shall be
			 used for the implementation of short-time compensation programs and the overall
			 administration of such programs and the promotion and enrollment efforts
			 associated with such programs, such as through—</text>
				<paragraph id="id6BB316F8CD904C6992CDED4D00B7C218"><enum>(1)</enum><text>the creation or
			 support of rapid response teams to advise employers about alternatives to
			 layoffs;</text>
				</paragraph><paragraph id="id76BD2B2D49E34D1487B847135CF3902E"><enum>(2)</enum><text>the provision of
			 education or assistance to employers to enable them to assess the feasibility
			 of participating in short-time compensation programs; and</text>
				</paragraph><paragraph id="id102FDF0DAB5F45DAB9B404F45AE6BC7F"><enum>(3)</enum><text>the development
			 or enhancement of systems to automate—</text>
					<subparagraph id="id5DC5D2D1580047C2A556F9DAE077E581"><enum>(A)</enum><text>the submission
			 and approval of plans; and</text>
					</subparagraph><subparagraph id="id8743E6015F9744CB980FDF497444F9FC"><enum>(B)</enum><text>the filing and
			 approval of new and ongoing short-time compensation claims.</text>
					</subparagraph></paragraph></subsection><subsection id="id50B99C81E7FF43489C73535291780FF4"><enum>(e)</enum><header>Administration</header><text>The
			 Secretary is authorized to use 0.25 percent of the funds available under
			 subsection (g) to provide for outreach and to share best practices with respect
			 to this section and short-time compensation programs.</text>
			</subsection><subsection id="idC80113E4A9D74FE4BC4EF47C6CB6C52D"><enum>(f)</enum><header>Recoupment</header><text>The
			 Secretary shall establish a process under which the Secretary shall recoup the
			 amount of any grant awarded under paragraph (1) or (2) of subsection (a) if the
			 Secretary determines that, during the 5-year period beginning on the first date
			 that any such grant is awarded to the State, the State—</text>
				<paragraph id="idE1087B6B80E64387B0A56C677A43EA7B"><enum>(1)</enum><text>terminated the
			 State's short-time compensation program; or</text>
				</paragraph><paragraph id="id9D7161F81A0A4FC4A89A0AE98200566E"><enum>(2)</enum><text>failed to meet
			 appropriate requirements with respect to such program (as established by the
			 Secretary).</text>
				</paragraph></subsection><subsection id="IDcf1e5b31c48d45d0b115f05312741adb"><enum>(g)</enum><header>Funding</header><text>There
			 are appropriated, out of moneys in the Treasury not otherwise appropriated, to
			 the Secretary, $700,000,000 to carry out this section, to remain available
			 without fiscal year limitation.</text>
			</subsection><subsection id="IDaabf06cdba124728ae1fa15b30f9757e"><enum>(h)</enum><header>Reporting</header><text>The
			 Secretary may establish reporting requirements for States receiving a grant
			 under this section in order to provide oversight of grant funds.</text>
			</subsection><subsection id="id96B5B505DFB94FFD8BEB9873D05731A5"><enum>(i)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="id5C737EC638694BD3A824BF989D3EA2CE"><enum>(1)</enum><header>Secretary</header><text>The
			 term <quote>Secretary</quote> means the Secretary of Labor.</text>
				</paragraph><paragraph id="id796D4807F6484F6C88FE9E2F82431B7F"><enum>(2)</enum><header>Short-time
			 compensation program</header><text>The term <quote>short-time compensation
			 program</quote> has the meaning given such term in section 3306(v) of the
			 Internal Revenue Code of 1986, as added by section 2(a).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5DEAD1A953584AA99F46389E39C16259"><enum>(3)</enum><header>State; State
			 agency; State law</header><text>The terms <term>State</term>, <quote>State
			 agency</quote>, and <quote>State law</quote> have the meanings given those
			 terms in section 205 of the Federal-State Extended Unemployment Compensation
			 Act of 1970 (26 U.S.C. 3304 note).</text>
				</paragraph></subsection></section><section id="ID7fb31e92d88c44399f970428420e1a6e"><enum>6.</enum><header>Assistance and
			 guidance in implementing programs</header>
			<subsection id="id24E0115A01264C118B049D410C56552E"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">In order to assist
			 States in establishing, qualifying, and implementing short-time compensation
			 programs (as defined in section 3306(v) of the Internal Revenue Code of 1986,
			 as added by section 2(a)), the Secretary of Labor (in this section referred to
			 as the <quote>Secretary</quote>) shall—</text>
				<paragraph id="ID08040e44ffec4a5a8d70e113c05ade0a"><enum>(1)</enum><text>develop model
			 legislative language which may be used by States in developing and enacting
			 such programs and periodically review and revise such model legislative
			 language;</text>
				</paragraph><paragraph id="ID1d1b651a693b4ae5abdb3b671a466bd3"><enum>(2)</enum><text>provide technical
			 assistance and guidance in developing, enacting, and implementing such
			 programs;</text>
				</paragraph><paragraph id="idD0082A525E53483E9DF92523ED18E972"><enum>(3)</enum><text>establish
			 reporting requirements for States, including reporting on—</text>
					<subparagraph id="idE834AB2BD53C4D75A98750812791F088"><enum>(A)</enum><text>the number of
			 estimated averted layoffs;</text>
					</subparagraph><subparagraph id="id4A7BBB6DA1794C19AD16578E52AC6C14"><enum>(B)</enum><text>the number of
			 participating employers and workers; and</text>
					</subparagraph><subparagraph id="id00927B16B2834980ADA3A8BD8D2E4B71"><enum>(C)</enum><text>such other items
			 as the Secretary of Labor determines are appropriate.</text>
					</subparagraph></paragraph></subsection><subsection id="id25D247E4245B41C291E4F3A0610FCAFE"><enum>(b)</enum><header>Model language
			 and guidance</header><text>The model language and guidance developed under
			 subsection (a) shall allow sufficient flexibility by States and participating
			 employers while ensuring accountability and program integrity.</text>
			</subsection><subsection id="idE8437FF8E987456F8CBFE03613BB72F5"><enum>(c)</enum><header>Consultation</header><text>In
			 developing the model legislative language and guidance under subsection (a),
			 and in order to meet the requirements of subsection (b), the Secretary shall
			 consult with employers, labor organizations, State workforce agencies, and
			 other program experts.”</text>
			</subsection></section><section id="ID53e9d0cd138c442f92acfb55c7152098"><enum>7.</enum><header>Reports</header>
			<subsection id="IDd06c5c45b2d647e5b3f44435fc6af618"><enum>(a)</enum><header>Initial
			 report</header>
				<paragraph id="id07E97F93C6664901B2411345FFA77D53"><enum>(1)</enum><header>In
			 general</header><text>Not later than 4 years after the date of the enactment of
			 this Act, the Secretary of Labor shall submit to Congress and to the President
			 a report or reports on the implementation of the provisions of this Act.</text>
				</paragraph><paragraph id="id66067D5834164F43BEAF04C6E10756AF"><enum>(2)</enum><header>Requirements</header><text>Any
			 report under paragraph (1) shall include the following:</text>
					<subparagraph id="IDef63a24761074fb1bb4edf8738c82e9d"><enum>(A)</enum><text>A description of
			 best practices by States and employers in the administration, promotion, and
			 use of short-time compensation programs (as defined in section 3306(v) of the
			 Internal Revenue Code of 1986, as added by section 2(a)).</text>
					</subparagraph><subparagraph id="idB4DF078F5B47494C9C2515EFEDC78C15"><enum>(B)</enum><text>An analysis of
			 the significant challenges to State enactment and implementation of short-time
			 compensation programs.</text>
					</subparagraph><subparagraph id="idDDD7612A5B0C464B8D588A5C6BEFA907"><enum>(C)</enum><text>A survey of
			 employers in States that have not enacted a short-time compensation program or
			 entered into an agreement with the Secretary on a short-time compensation plan
			 to determine the level of interest among such employers in participating in
			 short-time compensation programs.</text>
					</subparagraph><subparagraph id="id2811B1F9B82042F1933470E674AFF1F7"><enum>(D)</enum><text>Other matters
			 related to the implementation of the provisions of this Act as the Secretary of
			 Labor determines appropriate.</text>
					</subparagraph></paragraph></subsection><subsection id="ID534a0534aaa3423c88a6f9cbaaa6730e"><enum>(b)</enum><header>Subsequent
			 reports</header><text>After the submission of the report under subsection (a),
			 the Secretary of Labor may submit such additional reports on the implementation
			 of short-time compensation programs as the Secretary deems appropriate.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="idC1A57480501E471492BF4FD903C78E7A"><enum>(c)</enum><header>Funding</header><text>There
			 are appropriated, out of any moneys in the Treasury not otherwise appropriated,
			 to the Secretary of Labor, $1,500,000 to carry out this section, to remain
			 available without fiscal year limitation.</text>
