		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Asset Forfeiture Responsibility
			 Act of 2011</short-title></quote>.</text>
		</section><section id="idC57D66B3DA0B400AB385D1F8A045A347"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to strengthen and
			 improve monitoring in the fisheries across the United States.</text>
		</section><section id="H1704A3DD73904EE49B4ED2D711361859"><enum>3.</enum><header>Fisheries
			 Investment Fund</header>
			<subsection id="IDaaa9fa5b4e3043d5a314cb28b64ec584"><enum>(a)</enum><header>Establishment</header><text>There
			 is established in the general fund of the Treasury a separate account, which
			 shall be known as the <term>Fisheries Investment Fund</term>.</text>
			</subsection><subsection id="ID1ad4efefca37412f95970e75f9d7f8ba"><enum>(b)</enum><header>Source of
			 funds</header>
				<paragraph id="idF8539CA2158B477FA2204CC9D8BD8AE5"><enum>(1)</enum><header>In
			 general</header><text>All sums received by the United States as fines,
			 penalties, and forfeitures of property for violations of any provision of the
			 Magnuson-Stevens Fishery Conservation and Management Act (16 U.S.C. 1801 et
			 seq.) or any other marine resource law enforced by the Secretary of Commerce
			 shall be deposited into the Fisheries Investment Fund.</text>
				</paragraph><paragraph id="id6937BC881E5842ECACF291A551F3A940"><enum>(2)</enum><header>Availability of
			 funds</header><text>Fees deposited in the Fisheries Investment Fund State shall
			 remain available until expended.</text>
				</paragraph></subsection><subsection id="ID8b102e1801a74b1d94b7ca1b0ac207b7"><enum>(c)</enum><header>Use of
			 funds</header><text>Fees deposited in the Fisheries Investment Fund shall be
			 used—</text>
				<paragraph id="idAACB2C8B25214B86AAFA15127D2070E4"><enum>(1)</enum><text>subject to
			 subsection (d), to reimburse reasonable attorneys' fees to a covered person;
			 and</text>
				</paragraph><paragraph id="id75A4464A190E4D07AF1F4A2BC6FDADC8"><enum>(2)</enum><text>to
			 conduct—</text>
					<subparagraph id="id29DB3C471A0D4203BD0C1E3DF2F23E74"><enum>(A)</enum><text>the audit
			 required by subsection (e);</text>
					</subparagraph><subparagraph id="id878ACE9199E54E0AA2D0F5C6368990CB"><enum>(B)</enum><text>enforcement
			 activities as described in section 311(e)(1) of the Magnuson-Stevens Fishery
			 Conservation and Management Act (16 U.S.C. 1861(e)(1)), as amended by section
			 5; and</text>
					</subparagraph><subparagraph id="id56650EEB2C88463C96D852E40BDFA237"><enum>(C)</enum><text>monitoring
			 activities as described in subsection (l) of section 305 of the
			 Magnuson-Stevens Fishery Conservation and Management Act (16 U.S.C. 1855(l)),
			 as added by section 4.</text>
					</subparagraph></paragraph></subsection><subsection id="id1E0DF7A0B896464188E699A6E74C44C4"><enum>(d)</enum><header>Reimbursement
			 of attorneys' fees</header>
				<paragraph id="id023FD8D80B6A4CECB20A89B7F4D0479A"><enum>(1)</enum><header>Authority to
			 provide reimbursement</header><text>During fiscal years 2012 and 2013, the
			 Secretary of Commerce may reimburse the reasonable attorneys' fees of a covered
			 person pursuant to subsection (c)(1).</text>
				</paragraph><paragraph id="id3BAD8CEC225942D489BCCAFDF8748934"><enum>(2)</enum><header>Application</header><text>A
			 covered person seeking reimbursement under paragraph (1) shall submit to the
			 Secretary an application for such reimbursement no more than 60 days after the
			 date the Secretary directs a fisheries enforcement penalty be remitted to the
			 covered person.</text>
				</paragraph><paragraph id="idB8484773CAB94A89887DE66FC610882C"><enum>(3)</enum><header>Definitions</header><text>In
			 this section:</text>
					<subparagraph id="id03CD8C940C7248E19333E13C2E6B0E33"><enum>(A)</enum><header>Covered
			 person</header><text>The term <term>covered person</term> means any
			 person—</text>
						<clause id="id3A44A8CBC7EF4FF9A7CEE741D8D1EB0C"><enum>(i)</enum><text>that the
			 Secretary of Commerce has directed be remitted a fisheries enforcement penalty
			 at the recommendation of the report of Special Master Swartwood; or</text>
						</clause><clause id="id07DCEA0CA17D4FA78BE990D7EB0D32B4"><enum>(ii)</enum><text>that—</text>
							<subclause id="id909591D0A93D4351A0E942305A779083"><enum>(I)</enum><text>submitted a
			 complaint to the Special Master prior to May 7, 2011, seeking remittance of a
			 fisheries enforcement penalty; and</text>
							</subclause><subclause id="id8954BD494F0041198A7D63D9DC707067"><enum>(II)</enum><text>the Secretary
			 directs to receive such remittance or a portion of such remittance.</text>
							</subclause></clause></subparagraph><subparagraph id="id900B511D592648CEA12A88489BF1AE28"><enum>(B)</enum><header>Reasonable
			 attorneys' fees</header><text>The term <term>reasonable attorneys' fees</term>
			 means attorneys' fees expended by a covered person—</text>
						<clause id="idE6B3684F23B645E5B56D6DC13FF647E6"><enum>(i)</enum><text>seeking
			 remittance of a fisheries enforcement penalty that the Secretary of Commerce
			 directs be remitted to the covered person;</text>
						</clause><clause id="id7526DFFA10B24C5897DA183ECE01FCB3"><enum>(ii)</enum><text>that were
			 incurred by the covered person prior to the date that is 60 days after such
			 fisheries enforcement penalty was directed by the Secretary to be remitted to
			 the covered person; and</text>
						</clause><clause id="id85B575FB6578488AABA7B7D55D97C117"><enum>(iii)</enum><text>that the
			 Secretary determines are reasonable.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="idFEA0DE217D6D4E35824D6AE8A011EF8E"><enum>(e)</enum><header>Audit</header><text>For
			 each of the fiscal years 2012, 2013, and 2014, the Secretary of Commerce or the
			 Secretary of the Treasury shall—</text>
				<paragraph id="ID5d609b366a0d4280ae49b2acf105fd2f"><enum>(1)</enum><text>prepare an annual
			 audit plan for the Fisheries Investment Fund;</text>
				</paragraph><paragraph id="ID6bc9e30690bc4f748bf6ece4c98d923d"><enum>(2)</enum><text>submit each such
			 audit plan to the Inspector General of the Department of Commerce or the
			 Inspector General of the Department of the Treasury, as appropriate;</text>
				</paragraph><paragraph id="ID886a93fd25a64e85ac7126e997b61c30"><enum>(3)</enum><text>carry out the
			 audit; and</text>
				</paragraph><paragraph id="id39E192C3E308417CA851DCE14B9EBE66"><enum>(4)</enum><text>submit the final
			 audit results to the Inspector General of the Department of Commerce or the
			 Inspector General of the Department of the Treasury, as appropriate, upon
			 completion.</text>
				</paragraph></subsection><subsection id="idC28F11D2760544C2BB8125B18259918C"><enum>(f)</enum><header>Authorization
			 of appropriations</header>
				<paragraph id="id558B646E954D4BDC93B40B6C84DB3415"><enum>(1)</enum><header>In
			 general</header><text>There is authorized to be appropriated to Secretary of
			 Commerce from the Fisheries Investment Fund for each fiscal year beginning with
			 fiscal year 2012—</text>
					<subparagraph id="id7965CE1DEF754B9281CEBD6368927ECF"><enum>(A)</enum><text>for the
			 reimbursement of reasonable attorneys' fees pursuant to subsection (d), the
			 amount necessary to provide such reimbursement;</text>
					</subparagraph><subparagraph id="id8F01EB2C51954F0A89D097C961DC7F8E"><enum>(B)</enum><text>for an audit
			 required by subsection (e), the amount necessary to conduct such audit;</text>
					</subparagraph><subparagraph id="idCD0841CC9B414935A5F0C736CFED95DC"><enum>(C)</enum><text>for enforcement
			 activities described in section 311(e)(1) of the Magnuson-Stevens Fishery
			 Conservation and Management Act (16 U.S.C. 1861(e)(1)), as amended by section
			 5, an amount that is not more than 33 percent of the total remaining amount in
			 the Fund; and</text>
					</subparagraph><subparagraph id="idC1957617EF674B2FB16738E616D6CB44"><enum>(D)</enum><text>for monitoring
			 activities described in subsection (l) of section 305 of the Magnuson-Stevens
			 Fishery Conservation and Management Act (16 U.S.C. 1855), as added by section
			 4, the total remaining amount in the Fund less any amount appropriated pursuant
			 to the authorization in subparagraph (C).</text>
					</subparagraph></paragraph><paragraph id="idADDD29DC95DD4DFE82BD746E397371D5"><enum>(2)</enum><header>Total remaining
			 amount in the Fund</header><text>In this subsection, the term <term>total
			 remaining amount in the Fund</term> means the following:</text>
					<subparagraph id="id65B938409BDA4F9A966E42C3FF4454F4"><enum>(A)</enum><text>For fiscal years
			 2012, the amount received by the United States in fiscal year 2011 as fines,
			 penalties, and forfeitures of property for violations of any provision of the
			 Magnuson-Stevens Fishery Conservation and Management Act (16 U.S.C. 1801 et
			 seq.) or any other marine resource law enforced by the Secretary of Commerce
			 less—</text>
						<clause id="id7D2F18F5DC574C39A423B2BF34A9416D"><enum>(i)</enum><text>the
			 amount necessary to provide reimbursement pursuant to paragraph (1)(A) for
			 fiscal year 2012; and</text>
						</clause><clause id="id15DAB029623B49EEB748E5A0C57CD569"><enum>(ii)</enum><text>the amount
			 necessary to conduct an audit pursuant to paragraph (1)(B) for fiscal year
			 2012.</text>
						</clause></subparagraph><subparagraph id="idEC22F3D751A94251817E422137C93E63"><enum>(B)</enum><text>For a fiscal year
			 after 2012, the amount deposited in the Fisheries Investment Fund for the prior
			 fiscal year less—</text>
						<clause id="id8AB136C64AB54C06B433D8FC8477CFC2"><enum>(i)</enum><text>the
			 amount necessary to provide reimbursement pursuant to paragraph (1)(A) for the
			 current fiscal year; and</text>
						</clause><clause id="id24B03BABAB8641AF941CABEA032D2499"><enum>(ii)</enum><text>the amount
			 necessary to conduct an audit pursuant to paragraph (1)(B) for the current
			 fiscal year.</text>
						</clause></subparagraph></paragraph></subsection></section><section id="HD00961139E72406BBF4B7888306345F0"><enum>4.</enum><header>Use of funds for
			 monitoring</header><text display-inline="no-display-inline">Section 305 of the
			 Magnuson-Stevens Fishery Conservation and Management Act (16 U.S.C. 1855) is
			 amended by adding at the end the following new subsection:</text>
			<quoted-block display-inline="no-display-inline" id="HB2462CE499AB403A9383190076374601" style="OLC">
				<subsection id="H8650B87AF53D4D3DB45A40BD85A364BA"><enum>(l)</enum><header>Monitoring
				activities</header>
					<paragraph id="id8ECE57A7CFC8450299C03DB2AB44CAF5"><enum>(1)</enum><header>In
				general</header><text>The Secretary may pay from sums appropriated to the
				Secretary for monitoring activities from the Fisheries Investment Fund
				established under section 3(a) of the <short-title>Asset
				Forfeiture Responsibility Act of 2011</short-title> monitoring activities
				selected by the Councils, including, in order of priority—</text>
						<subparagraph id="ID7ab7a0b74ec84747b605ecc5aa4bd90f"><enum>(A)</enum><text>at-sea observers
				and shoreside monitoring;</text>
						</subparagraph><subparagraph commented="no" id="IDc3b7fcc00ebc44c8ab13008157252ad3"><enum>(B)</enum><text>preparing fishery
				impact statements, as described in section 303(a)(9); and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID432c5cf32c8f4068af1c32fa9d06d79c"><enum>(C)</enum><text>other priorities
				established by a Council as necessary to rebuild or maintain sustainable
				fisheries, ensure healthy ecosystems, and maintain fishing communities.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA6F3B3B0B77F497CAB35BB0A95524661"><enum>(2)</enum><header>Allocation of
				funds among Councils</header><text>For each fiscal year, the sums appropriated
				to the Secretary for monitoring activities from the Fisheries Investment Fund
				established under section 3(a) of the <short-title>Asset
				Forfeiture Responsibility Act of 2011</short-title> and used to carry out
				monitoring activities under paragraph (1) shall be allocated among the Councils
				so that the proportion of such sums that a Council receives is equal to the
				proportion of the sums deposited in such Fund from violations occurring in the
				area over which that Council exercises fishery management
				jurisdiction.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="idD5ACB94F2DC847CBBEFB2DD440CA23C6"><enum>5.</enum><header>Use of funds for
			 enforcement</header>
			<subsection id="id0935345BB01B4AF482A45795149CCE2A"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 311(e) of the
			 Magnuson-Stevens Fishery Conservation and Management Act (16 U.S.C. 1861(e)) is
			 amended—</text>
				<paragraph id="HF6DB93916D48428FBCEAC96E69D2F16E"><enum>(1)</enum><text>in paragraph
			 (1)—</text>
					<subparagraph id="idA7A4756A328A4B8BBD791D1F645DEB4D"><enum>(A)</enum><text>by amendment the
			 material preceding subparagraph (A) to read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="id5FC07E56BCF3452E80F7C9D821F4ED15" style="OLC">
							<paragraph id="idD09A379872354194A0323E3FE6E71B8B"><enum>(1)</enum><text>The Secretary may
				pay from sums appropriated to the Secretary for enforcement activities from the
				Fisheries Investment Fund established under section 3(a) of the
				<short-title>Asset Forfeiture Responsibility Act of
				2011</short-title>—</text>
							</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="idDBD6DFF15220441EBDD4D517ABF7937A"><enum>(B)</enum><text>by striking
			 subparagraph (C); and</text>
					</subparagraph></paragraph><paragraph id="H9F94F171E19348B59BC5BCC7F7421701"><enum>(2)</enum><text>in paragraph (2),
			 by moving such paragraph two ems to the left.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HB347B2C879C347E0B6F9038E715F4CC7"><enum>(b)</enum><header>Conforming
			 amendment</header><text>Section 311(f) of the Magnuson-Stevens Fishery
			 Conservation and Management Act (16 U.S.C. 1861(f)) is amended by striking
			 paragraph (4).</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="id9F2DFB7D04664B259214690D8830E7E4"><enum>6.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">This Act and the
			 amendments made by this Act shall apply with respect to sums received on or
			 after the date of the enactment of this Act.</text>
