		<official-title>To make funds available to reimburse certain fishermen
		  for legal fees and costs incurred in connection with improper fines and for
		  other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Fisheries Fee Fairness Act of
			 2011</short-title></quote>.</text>
		</section><section id="idA5ACD0CC5BC14F93978054FAB5E03B31"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="idBE8231319B1E42DDB83A222645A8B11B"><enum>(1)</enum><header>Appropriate
			 legal fees and costs</header><text>The term <term>appropriate legal fees and
			 costs</term> means the legal fees and costs incurred by a covered
			 person—</text>
				<subparagraph id="idC120850F2E6B4A528DBE52AF1840F935"><enum>(A)</enum><text>that the
			 Secretary determines were appropriately incurred by the covered person in
			 association with challenging a fisheries enforcement penalty that was directed
			 to be remitted to the covered person; and</text>
				</subparagraph><subparagraph id="id0DBB1BF57E4E476592737C5A816E35BC"><enum>(B)</enum><text>prior to the date
			 that is 30 days after such a fisheries enforcement penalty was directed to be
			 remitted to the covered person by the Secretary.</text>
				</subparagraph></paragraph><paragraph id="idEE10F3BE8FE74AD7A4091A3A131FA7E2"><enum>(2)</enum><header>Covered
			 person</header><text>The term <term>covered person</term> means—</text>
				<subparagraph id="id21720099909249218BCE4197671FFE90"><enum>(A)</enum><text>a person that the
			 Secretary directed be remitted a fisheries enforcement penalty in the Decision
			 Memorandum; or</text>
				</subparagraph><subparagraph id="id3ED11420BA7B4D24A2653F0471C830B5"><enum>(B)</enum><text>a person
			 that—</text>
					<clause id="id5F3A196C231F4BB49E83821E151D308A"><enum>(i)</enum><text>received a Notice
			 of Violation and Assessment for a fisheries enforcement penalty issued on or
			 after March 17, 1994, that was settled or otherwise resolved prior to February
			 3, 2010;</text>
					</clause><clause id="idB25138F09E9048899FB100EEA109DB6F"><enum>(ii)</enum><text>paid a civil
			 penalty for such fisheries enforcement penalty;</text>
					</clause><clause id="id216383BCFDD94E3BB72148D606DF9CB3"><enum>(iii)</enum><text>submitted a
			 complaint prior to May 7, 2011, seeking remittance of such civil penalty;
			 and</text>
					</clause><clause id="idBBC094B38EEA4CFD90D04443D6F4108B"><enum>(iv)</enum><text>the Secretary
			 directs receive such remittance or a portion of such remittance.</text>
					</clause></subparagraph></paragraph><paragraph id="id3A71A17267F7497C97F4CA04C2E758E2"><enum>(3)</enum><header>Decision
			 Memorandum</header><text>The term <term>Decision Memorandum</term> means the
			 Secretarial Decision Memorandum issued by the Secretary on May 17, 2011,
			 entitled Decisions regarding Certain NOAA Fisheries Enforcement Cases Based on
			 Special Master Swartwood's Report and Recommendations.</text>
			</paragraph><paragraph id="idFE80548858154E11B4F3446182C927A0"><enum>(4)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Commerce.</text>
			</paragraph></section><section id="idC601CEF8BC4F4A1EB06B9EF90E350030"><enum>3.</enum><header>Authority to
			 reimburse legal fees and costs</header>
			<subsection id="id01AF1828AA564CFAB953B0EBD4EB1F0F"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Notwithstanding any
			 other provision of law, the Secretary may use sums made available under section
			 311(e)(1) of the Magnuson-Stevens Fishery Conservation and Management Act (16
			 U.S.C. 1861(e)(1)) to reimburse appropriate legal fees and costs to covered
			 persons.</text>
			</subsection><subsection id="id2D17478CD9664F28A0D182B4218A3507"><enum>(b)</enum><header>Timing</header>
				<paragraph id="idFC9F21A25A88400F94F8CE9715F622A1"><enum>(1)</enum><header>Submission of
			 request</header><text>A covered person seeking reimbursement of appropriate
			 legal fees and costs under subsection (a) shall submit to the Secretary a
			 request for such reimbursement—</text>
					<subparagraph id="idF3C2B7568E904CB399E6523891BBAFD3"><enum>(A)</enum><text>in the case the
			 covered person is described in section 2(2)(A), not later than 1 year after the
			 date of the enactment of this Act; or</text>
					</subparagraph><subparagraph id="idFFE59DC09FF6406792FE7F8136D50698"><enum>(B)</enum><text>in the case of a
			 covered person described in section 2(2)(B), not later than 1 year after the
			 date the Secretary directs such covered person receive a remittance of a
			 fisheries enforcement penalty.</text>
					</subparagraph></paragraph><paragraph id="idF668F3881E1840168D03809460E5E8B5"><enum>(2)</enum><header>Determination</header><text>Not
			 later than 90 days after receiving an application under paragraph (1), the
			 Secretary shall make a final determination on whether to provide such
			 reimbursement and the amount of any such reimbursement.</text>
				</paragraph></subsection><subsection id="idEF989D1C8F624A998F1D40124E2D245D"><enum>(c)</enum><header>Maximum
			 reimbursement</header><text>The Secretary may not provide more than $200,000 in
			 reimbursement of appropriate legal fees and costs under subsection (a) to a
			 covered person.</text>
