		<official-title>To amend titles 23, 45, and 49, United States Code, to
		  encourage the use of private-public partnerships in
		  transportation.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Lincoln Legacy Infrastructure
			 Development Act</short-title></quote>.</text>
		</section><section id="id6859A001555949CC90D011933776BC0C"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
			<paragraph id="ID09e23277233a44fc8e138f905026e380"><enum>(1)</enum><text>the American
			 Association of State Highway and Transportation Officials estimates current
			 highway, bridge, public transit, and freight and passenger rail funding needs
			 are approximately $225,000,000,000 to $340,000,000,000 per year through 2055,
			 while current spending is less than $90,000,000,000 per year;</text>
			</paragraph><paragraph id="ID3bb077faa01e4443a12ac375111dbb57"><enum>(2)</enum><text>according to the
			 organization known as Transportation for America, 69,223 bridges, or 11.5
			 percent of all highway bridges in the United States, are considered
			 structurally deficient;</text>
			</paragraph><paragraph id="ID1a4e2d0778514bcb90bac7ba18013f67"><enum>(3)</enum><text>according to the
			 Congressional Research Service, for fiscal year 2010, the Highway Trust Fund,
			 the primary funding source for highways and transit, received approximately
			 $35,000,000,000 in revenue but spent approximately $50,000,000,000;</text>
			</paragraph><paragraph id="ID4798fff9762d4295b00e98cd751ab04f"><enum>(4)</enum><text>Congress
			 transferred $34,500,000,000 in general revenue to the Highway Trust Fund during
			 the period of fiscal years 2008 to 2010 to keep the Highway Trust Fund
			 solvent;</text>
			</paragraph><paragraph id="IDa6f8dec80586452b855888dec3c6c4f0"><enum>(5)</enum><text>Highway Trust
			 Fund outlays during the period of fiscal years 2011 to 2021 are expected to
			 exceed revenues and interest by approximately $120,000,000,000;</text>
			</paragraph><paragraph id="ID0d76c2c680884f2e9fd14cde6cad9dad"><enum>(6)</enum><text>the Congressional
			 Budget Office estimates that the Highway Trust Fund will be unable to meet
			 obligations of the Highway Trust Fund sometime during fiscal year 2012;</text>
			</paragraph><paragraph id="ID9a0ffe9e7e184ef8a0d4e487f7ca4ffe"><enum>(7)</enum><text>the United States
			 Chamber of Commerce estimates that further deterioration of transportation
			 networks could result in as much as $336,000,000,000 in lost growth during the
			 5 years after the date of enactment of this Act;</text>
			</paragraph><paragraph id="ID01a2eaacbb0c4e04ac3156a31b0e9b2c"><enum>(8)</enum><text>private-public
			 partnerships are an important tool to help address transportation
			 infrastructure shortfalls;</text>
			</paragraph><paragraph id="ID7aa48c752f724206835951d64f43cf68"><enum>(9)</enum><text>infrastructure
			 experts estimate that there is more than $400,000,000,000 available for
			 private-sector capital infrastructure investment;</text>
			</paragraph><paragraph id="ID4f1aaad1deab4f18baf9b4a53170b594"><enum>(10)</enum><text>according to the
			 Federal Highway Administration, 29 States and 1 United States territory have
			 enacted legislation enabling private-public partnerships; and</text>
			</paragraph><paragraph id="ID48a9a35c12c446efa2b44919999ba7db"><enum>(11)</enum><text>State and local
			 governments are uniquely positioned to further develop and use innovative
			 financing methods for all modes of infrastructure.</text>
			</paragraph></section><section id="id0B379F72AB31459092B4D4F933E4F057"><enum>3.</enum><header>Private-public
			 partnership challenge grants</header>
			<subsection id="id43AD713FCDDF4442A40213CDBC27E8A1"><enum>(a)</enum><header>In
			 general</header><text>Chapter 1 of title 23, United States Code, is amended by
			 inserting after section 149 the following:</text>
				<quoted-block display-inline="no-display-inline" id="idF2856F3CEE2B41CC9C858E7CDCDE744A" style="USC">
					<section id="id7742162A6829481BA35EFB2AAC58ECE9"><enum>150.</enum><header>Private-public
				partnership challenge grants</header>
						<subsection id="id98DE00E1FB614B60985767EE20D8F5D8"><enum>(a)</enum><header>In
				general</header><text>The Secretary shall establish a program, to be known as
				the <quote>Private-Public Partnership Challenge Grant Program</quote> (referred
				to in this section as the <term>program</term>), to encourage States to
				develop, enact, and implement private-public partnership enabling legislation
				and procurement policies.</text>
						</subsection><subsection id="id920813DCB5884D59B8D3911E9B70B452"><enum>(b)</enum><header>Eligible
				recipients</header><text>The Secretary may provide a grant under the program to
				a State for use in implementing innovative and successful strategies to use
				private-public partnerships with respect to funding for rail, aviation,
				transit, highway, and waterway transportation.</text>
						</subsection><subsection id="idE6D25ACF4FF847958024EF25DA080D0C"><enum>(c)</enum><header>Application</header><text>A
				State that seeks to receive a grant under the program shall submit to the
				Secretary an application for the grant at such time, in such manner, and
				containing such information as the Secretary shall require.</text>
						</subsection><subsection id="ID4491c4a151d849bb98d9ab18d4372351"><enum>(d)</enum><header>Funding</header><text>The
				Secretary shall use to carry out the program amounts received as Federal
				surcharges on revenue generated from agreements resulting from the concession
				or lease of safety rest areas under section
				111(a)(2).</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id98E88A9EC6784503BE227FE450930C6D"><enum>(b)</enum><header>Conforming
			 amendment</header><text>The analysis for chapter 1 of title 23, United States
			 Code, is amended by inserting after the item relating to section 149 the
			 following:</text>

			 highways</header>
			<subsection id="id777FA7E07CCD48B493BA176CF9320263"><enum>(a)</enum><header>Agreements
			 relating to use of and access to rights-of-Way-Interstate System</header>
				<paragraph id="id44AE451D7B834B108E2914CF1D9817AD"><enum>(1)</enum><header>In
			 general</header><text>Section 111(a) of title 23, United States Code, is
			 amended—</text>
					<subparagraph id="idCF45928224DB4DF9A3DD9A371392C353"><enum>(A)</enum><text>by redesignating
			 subparagraphs (A) through (C) of paragraph (1) as clauses (i) through (iii),
			 respectively;</text>
					</subparagraph><subparagraph id="idE1BEFCF6D5514D06B0C95EDF94EAF3EB"><enum>(B)</enum><text>by redesignating
			 paragraphs (1) and (2) as subparagraphs (A) and (B), respectively;</text>
					</subparagraph><subparagraph id="id449C215ECEB742A3912EFD0C92902303"><enum>(C)</enum><text>by striking
			 <quote><header-in-text level="subsection" style="OLC">In
			 general.—</header-in-text>All agreements</quote> and inserting the
			 following:</text>

				and</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="id47A2821E31B24A8CB0CD73701466E02F"><enum>(D)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="id6416664D3AD94770A7E95FC06B23125E" style="OLC">
							<paragraph id="idE578C292D4724864A352E35F6AFA802E"><enum>(2)</enum><header>Commercialization,
				lease, and concession of Interstate safety rest
				areas</header><text>Notwithstanding paragraph (1), the Secretary may permit a
				State to enter into 1 or more agreements for the commercialization, lease, or
				concession of a safety rest area constructed or located on a right-of-way on
				the Interstate System in the State on the conditions that—</text>
								<subparagraph id="idA29061A3F6F14A01A8497D1B4A8D50A8"><enum>(A)</enum><text>access to the
				safety rest area, parking, and restrooms remains free of charge;</text>
								</subparagraph><subparagraph id="idB1F8850EBFDB41D1B6F846201C7278C8"><enum>(B)</enum><text>the safety of
				motorists is not compromised by the agreement; and</text>
								</subparagraph><subparagraph id="id540D0DE498904C71AF8E1C437A0D949A"><enum>(C)</enum><text>the State
				agrees—</text>
									<clause id="id956DBAE4B6F149AABD81ED11026611C3"><enum>(i)</enum><text>to pay to the
				Secretary, upon entering into an agreement under this subparagraph, a Federal
				surcharge equal to 5 percent of the total amount received by the State under
				the agreement, which amounts the Secretary shall deposit in the Highway Trust
				Fund at the rate that corresponds to the rate at which the State receives
				amounts under the agreement; and</text>
									</clause><clause id="id4571CD7D2F684562BCBB5B8273773B9D"><enum>(ii)</enum><text>to use the
				remaining amounts received by the State under the agreement only for purposes
				relating to a highway or transit transportation project carried out under this
				title or title
				49.</text>
									</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection id="id182C6DF59CBE4BFB97F718D575B9D428"><enum>(b)</enum><header>Vending
			 machines</header><text>Section 111(b) of title 23, United States Code, is
			 amended—</text>
				<paragraph id="idDC5EEF2655F64A2981085271CB1D99A0"><enum>(1)</enum><text>by striking
			 <quote>Notwithstanding</quote> and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="id6F0DA8F552F64117944094048F881E36" style="OLC">
						<paragraph id="id75E8E81879D44BD48063C0A257A480A0"><enum>(1)</enum><header>In
				general</header><text>Notwithstanding</text>
						</paragraph><after-quoted-block>;

				</paragraph><paragraph id="idD44F3DA1ADBE43509F96728D93C219BA"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id38693F2C71FA4A0D8E665CB6F2FC6FF2" style="OLC">
						<paragraph id="idC32B4E08C0FF4EB6A5A39037CC405DD9"><enum>(2)</enum><header>Blind vending
				facilities</header><text>Notwithstanding any other provision of this
				Act—</text>
							<subparagraph id="idAD06C021515C4ED199BFC88D228CDA82"><enum>(A)</enum><text>the Secretary
				shall not impose any surcharge on a State with respect to any blind vending
				facility established pursuant to paragraph (1); and</text>
							</subparagraph><subparagraph id="idE86873D6A8F54713868337949C2544E5"><enum>(B)</enum><text>the priority
				accorded licensed blind vendors by paragraph (1) shall not be otherwise limited
				or diminished as a result of the implementation of the
				<short-title>Lincoln Legacy Infrastructure Development
				Act</short-title>.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="id819F786D87A64495977BEA3D88FF0F13"><enum>(c)</enum><header>Toll roads,
			 bridges, tunnels, and ferries</header><text>Section 129(a)(3) of title 23,
			 United States Code, is amended in the last sentence by striking <quote>for any
			 purpose for which Federal funds may be obligated by a State under this
			 title</quote> and inserting <quote>, including revenues received as a result of
			 any agreement entered into by the State for the sale, lease, or concession of a
			 highway, bridge, or tunnel, only for purposes relating to a highway or transit
			 transportation project carried out under this title or title 49</quote>.</text>
			</subsection><subsection id="id18C41AAE7998409EB9828E8F36F70E2C"><enum>(d)</enum><header>HOV
			 facilities</header><text>Section 166(a) of title 23, United States Code, is
			 amended by striking paragraph (2) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="id1AE0CDDA64564BFB85AAA15D1293E62F" style="OLC">
					<paragraph id="idD2850B6058CF4DB79D483C1402176B5E"><enum>(2)</enum><header>Occupancy
				requirement</header>
						<subparagraph id="idC0DE29916E084603BA1C9ED0E8FC25DC"><enum>(A)</enum><header>In
				general</header><text>Except as provided in subparagraph (B) and in other
				provisions of this section, not fewer than 2 occupants per vehicle may be
				required for use of a HOV facility.</text>
						</subparagraph><subparagraph id="idF6062AF9CFFB41C999AAB6C119F98BBE"><enum>(B)</enum><header>Congestion</header><text>In
				any case in which a State determines that a HOV facility is a degraded facility
				(as described in subsection (d)(2)(B)) or that the average speed of traffic on
				a HOV facility slows to less than the minimum average operating speed (as
				defined in subsection (d)(2)(A)), the State shall require not fewer than 3
				occupants per vehicle for use of the HOV
				facility.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="ID8e491a52bae049ce892cf0ad7dad3bb0"><enum>(e)</enum><header>Innovative
			 surface transportation financing methods</header>
				<paragraph id="id6A0F7885C68440749CD2650CBE42B135"><enum>(1)</enum><header>Value pricing
			 pilot program</header><text>Section 1012(b)(1) of the Intermodal Surface
			 Transportation Efficiency Act of 1991 (23 U.S.C. 149 note; 105 Stat. 1938) is
			 amended in the second sentence by striking <quote>as many as 15 such State or
			 local governments or public authorities</quote> and inserting <quote>States,
			 local governments, and public authorities</quote>.</text>
				</paragraph><paragraph id="id346D23D17AD84FB2BFFD8EB75D438E35"><enum>(2)</enum><header>Interstate
			 System reconstruction and rehabilitation pilot program</header><text>Section
			 1216(b)(2) of the Transportation Equity Act for the 21st Century (23 U.S.C. 129
			 note; 112 Stat. 212) is amended—</text>
					<subparagraph id="idF4AE8374630F46219AB7B19BF36E4AB7"><enum>(A)</enum><text>in the first
			 sentence, by striking <quote>3</quote> and inserting <quote>10</quote>;
			 and</text>
					</subparagraph><subparagraph id="id19FBC3DFE1764D55844F9C496C4CD175"><enum>(B)</enum><text>by striking the
			 second sentence.</text>
					</subparagraph></paragraph></subsection><subsection id="IDdc0760ef204441b3b9698344ebc3fa7d"><enum>(f)</enum><header>Express lanes
			 demonstration program</header><text>Section 1604(b)(2) of the SAFETEA–LU (23
			 U.S.C. 129 note; 119 Stat. 1250) is amended in the matter preceding
			 subparagraph (A)—</text>
				<paragraph id="id61D0D4D106774CD790B8B6CE8013D920"><enum>(1)</enum><text>by striking
			 <quote>15</quote>; and</text>

			 loans</header><text display-inline="yes-display-inline">Section 603(b) of title
			 23, United States Code, is amended—</text>
					<subparagraph id="id4E2716A4F3144657BEA00FA47FA21A54"><enum>(A)</enum><text display-inline="yes-display-inline">by striking paragraph (6); and</text>
					</subparagraph><subparagraph id="id1EBD95767477407AAC08BDAD7533CDC9"><enum>(B)</enum><text>by redesignating

			 by striking <quote>$122,000,000 for each of fiscal years 2005 through
			 2009</quote> and inserting <quote>$750,000,000 for each of fiscal years 2012
			 through 2017</quote>; and</text>
				</paragraph><paragraph id="id86FA34120A0240F79EDF62B994DDF5AA"><enum>(2)</enum><text>in paragraph (3)
			 by striking <quote>$2,200,000 for each of fiscal years 2005 through
			 2009</quote> and inserting <quote>$7,500,000 for each of fiscal years 2012
			 through 2017</quote>.</text>
				</paragraph></subsection></section><section id="id0569DF6F46DF47F0A7AE48572F2BBF4C"><enum>6.</enum><header>Railroad
			 Rehabilitation and Improvement Financing Program</header>
			<subsection id="idCB96D46B5268494C9A055E80EDFAD8B1"><enum>(a)</enum><header>Eligible
			 activities</header><text>Section 822(b)(1) of title 45, United States Code, is
			 amended—</text>
				<paragraph id="idE70447C3C3AC4F11B3910A6124062BE1"><enum>(1)</enum><text>in subparagraph
			 (B), by striking <quote>or</quote> at the end;</text>
				</paragraph><paragraph id="id768C907F3D41415EA63253662266AE91"><enum>(2)</enum><text>in subparagraph
			 (C), by striking the period at the end and inserting a semicolon; and</text>
				</paragraph><paragraph id="idCB889733677C483FB2F2EC08E70270A9"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id4B36FD1BCEFE428B8E2E86DC22FC5924" style="OLC">
						<subparagraph id="id8D1D0E8E20F84A0AB529BC06E38CCE5B"><enum>(D)</enum><text>carry out
				projects and activities that benefit high-speed rail; or</text>
						</subparagraph><subparagraph id="ID9bd4122a08f44b7c9019e06e001a2d99"><enum>(E)</enum><text>carry out
				development phase activities, including planning, feasibility analysis, revenue
				forecasting, environmental review, permitting, preliminary engineering and
				design work, and other preconstruction
				activities.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="id85835D6BABC44B3080EE5E5C06579584"><enum>(b)</enum><header>Credit risk
			 requirements</header><text>Section 822(h)(2) of title 45, United States Code,
			 is amended by inserting <quote>For purposes of making a finding under
			 subsection (g)(4), the Secretary, through the Administrator of the Federal
			 Railroad Administration, shall consider the net present value of anticipated
			 dedicated revenues or user fees to be collateral offered by the
			 applicant.</quote> after <quote>the project.</quote>.</text>
			</subsection><subsection id="id08B06AF3BC504AEE863F35688DFC4E67"><enum>(c)</enum><header>Biannual
			 report</header><text>Not later than 6 months after the date of the enactment of
			 this Act, and every 6 months thereafter, the Administrator of the Federal
			 Railroad Administration shall submit a report to Congress that
			 describes—</text>
				<paragraph id="id6C0469BE18D64831B4DF2804CDFAC818"><enum>(1)</enum><text>the number of
			 loans pending and issued under section 822 of title 45, United States Code;
			 and</text>
				</paragraph><paragraph id="id0045727DB7834F4AAC9E0CF76D3071A1"><enum>(2)</enum><text>the time taken to
			 process each of the loans described in paragraph (1).</text>
				</paragraph></subsection></section><section id="HCB1E4DC660E749519F36F9476901FD12"><enum>7.</enum><header>Airport
			 privatization program</header>
			<subsection id="H1C6FD6E65344422DAF26627BB8E84852"><enum>(a)</enum><header>Approval of
			 applications</header><text display-inline="yes-display-inline">Section 47134(b)
			 of title 49, United States Code, is amended—</text>
				<paragraph id="H8013AFE2A4AB41FC9DA57C1E7D49E8F3"><enum>(1)</enum><text>in the matter
			 preceding paragraph (1) by striking <quote>with respect to not more than 5
			 airports</quote>; and</text>
				</paragraph><paragraph id="H57FCE9CFFC4741D6A3098A5AE46F2FB2"><enum>(2)</enum><text>in paragraph
			 (1)—</text>
					<subparagraph id="HDB279B371C0348DEA52221856C1545E1"><enum>(A)</enum><text>by striking
			 subparagraph (A) and inserting the following:</text>

				general</header><text display-inline="yes-display-inline">The Secretary may
				grant an exemption to an airport sponsor from the requirements of sections
				47107(b) and 47133 (and any other law, regulation, or grant assurance) to the
				extent necessary to permit the sponsor to recover from the sale or lease of the
				airport such amount as may be approved by the Secretary after the sponsor has
				consulted—</text>
								<clause id="H11B1B7692BD7423F8704EF752824FD8E"><enum>(i)</enum><text>in
				the case of a primary airport, with each air carrier and foreign air carrier
				serving the airport, as determined by the Secretary; and</text>
								</clause><clause id="H80ED592708004C90BD55F602D8441971"><enum>(ii)</enum><text>in the case of a
				nonprimary airport, with at least 65 percent of the owners of aircraft based at
				that airport, as determined by the
				Secretary.</text>
								</clause></subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="H0EACD1CD8B974EA191E2968E92148AD3"><enum>(B)</enum><text>by striking
			 subparagraph (C).</text>
					</subparagraph></paragraph></subsection><subsection id="HC9A5A4E1C78345CC96185C83F8810F14"><enum>(b)</enum><header>Terms and
			 conditions</header><text>Section 47134(c) of title 49, United States Code, is
			 amended—</text>
				<paragraph id="HA407EE2D7D4A4B36B285C153B45BB958"><enum>(1)</enum><text>by striking
			 paragraphs (4), (5), and (9);</text>
				</paragraph><paragraph id="H8A047446FBB54EF580D4A8A6144C4039"><enum>(2)</enum><text>by redesignating
			 paragraphs (6), (7), and (8) as paragraphs (4), (5), and (6), respectively;
			 and</text>
				</paragraph><paragraph id="HF7733A1700EC4FC5902116FC61D158C2"><enum>(3)</enum><text>by adding at the

			 subsection (d); and</text>

				<paragraph id="idC2F6C7247F91401C83D1B0156815BE83"><enum>(1)</enum><text>the term
			 <term>Administrator</term> mean the Administrator of the Federal Transit
			 Administration;</text>
				</paragraph><paragraph id="id84574C9EF0704F44A4E6B579270A7E98"><enum>(2)</enum><text>the term
			 <term>covered HOT lane facility</term> means any high occupancy/toll lane
			 facility used by a bus service operated by a public transportation agency,
			 without regard to whether the high occupancy/toll lane facility was converted
			 from a high occupancy vehicle facility;</text>
				</paragraph><paragraph id="id0ED9D15D57BA4A51ABDEB3D36EBC9164"><enum>(3)</enum><text>the term
			 <term>eligible project</term> means a project carried out using funding under
			 section 5307 or 5309 of title 49, United States Code;</text>
				</paragraph><paragraph id="id5D08D770C45749FCA99E89AE86EFC29F"><enum>(4)</enum><text>the term
			 <term>eligible recipient</term> means a recipient of funding under section 5307
			 or 5309 of title 49, United States Code;</text>

			 <term>experimental program</term> means the public-private partnership

				</paragraph></subsection><subsection id="id7654FBB746064BA3B736728E28083A46"><enum>(b)</enum><header>Public-Private
			 partnership experimental program</header>
				<paragraph id="id5E4490B531B543F7B0EC77D3834D4D9C"><enum>(1)</enum><header>Program
			 established</header><text>The Administrator shall establish a 6-year
			 public-private partnership experimental program to encourage eligible
			 recipients to carry out tests and experimentation in the project development
			 process that are designed to—</text>
					<subparagraph id="idA54A623447C24BC6B64FE3A149CA238A"><enum>(A)</enum><text>attract private
			 investment in covered projects; and</text>
					</subparagraph><subparagraph id="id2076023916954F23B6989289B8F2DED7"><enum>(B)</enum><text>increase project
			 management flexibility and innovation, improve efficiency, allow for timely
			 project implementation, and create new revenue streams.</text>
					</subparagraph></paragraph><paragraph id="id6A4BD776E8A7490F9781439DE3E6AFF1"><enum>(2)</enum><header>Implementation
			 of program</header><text>The experimental program shall—</text>
					<subparagraph id="id336D3D8F785644DDB7F1B5C8243E81DF"><enum>(A)</enum><text>except as
			 provided in paragraph (5), identify any provisions of chapter 53 of title 49,
			 United States Code, and any regulations or practices thereunder, that impede
			 greater use of public-private partnerships and private investment in covered
			 projects; and</text>
					</subparagraph><subparagraph id="id3DD72E13F79C46269347380944E8063B"><enum>(B)</enum><text>develop
			 procedures and approaches that—</text>
						<clause id="id6AED4C29D78947A6882A3C05C83ABE26"><enum>(i)</enum><text>address the
			 impediments described in subparagraph (A), in a manner similar to the Special
			 Experimental Project Number 15 of the Federal Highway Administration (commonly
			 referred to as <quote>SEP–15</quote>); and</text>
						</clause><clause id="id6D67188283C44635A36C9852C3C4BD77"><enum>(ii)</enum><text>protect the
			 public interest and any public investment in covered projects.</text>
						</clause></subparagraph></paragraph><paragraph id="id2F69DBB9CC0342F096FA2F33E5A34FFF"><enum>(3)</enum><header>Report</header><text>Not
			 later than 2 years after the date of enactment of this Act, and every 2 years
			 thereafter until the termination of the experimental program, the Administrator
			 shall submit to Congress a report on the status of the experimental
			 program.</text>
				</paragraph><paragraph id="id7518B00B6B4A4842A65619A9636CB28F"><enum>(4)</enum><header>Rulemaking</header><text>Not
			 later than 180 days after the date of enactment of this Act, the Administrator
			 shall issue rules to carry out the experimental program.</text>
				</paragraph><paragraph id="id0E06E04B37834C2B9E169D144977F0EE"><enum>(5)</enum><header>Rule of
			 construction</header><text>Nothing in this subsection may be construed to allow
			 the Administrator to waive any requirement under—</text>
					<subparagraph id="id67916BAAD366491BAED8CAB0E659BCF7"><enum>(A)</enum><text>section 5333 of
			 title 49, United States Code;</text>
					</subparagraph><subparagraph id="id0DA317CB51BB4C63A848EB0AFB93DD32"><enum>(B)</enum><text>the National
			 Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.); or</text>
					</subparagraph><subparagraph id="id94F58BFC7D474CEFB04557AD43910DAD"><enum>(C)</enum><text>any other
			 provision of Federal law not described in paragraph (2)(A).</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idAD47EA299C54433DA1C32B09FC5E89A7"><enum>(c)</enum><header>Determination
			 of number of fixed guideway miles</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id107B8070BA034890ADE13D7366D2D9DB"><enum>(1)</enum><header>In
			 general</header><text>For purposes of apportioning funding under sections 5307
			 and 5309 of title 49, United States Code, the Administrator shall deem covered
			 HOT lane facility miles in an area to be fixed guideway miles attributable to
			 the area.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4E527D8CAEA44B3FAA8F715E026B757D"><enum>(2)</enum><header>Amount
			 apportioned not affected</header><text>Notwithstanding any other provision of
			 law, the Secretary may not apportion an amount for an urbanized area under
			 section 5307 or 5309 of title 49, United States Code, for fiscal year 2012, or
			 any fiscal year thereafter, that is less than the amount apportioned for the
			 urbanized area under section 5307 or 5309, respectively, for fiscal year 2011,
			 if the reduction in amount is solely attributable to the requirement under
			 paragraph (1).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idED9FBC9A6B624911B39B91EAFC646DC2"><enum>(3)</enum><header>Availability of
			 funds</header><text>There shall be available from the Mass Transit Account of
			 the Highway Trust fund for fiscal year 2012, and each fiscal year thereafter,
			 such sums as are necessary to carry out this subsection.</text>
				</paragraph></subsection></section><section id="idE0DD571BDB0A410BB983B22200C9E76E"><enum>9.</enum><header>Removal of cap
			 on exempt facility bonds used to finance qualified highway or surface freight
			 transfer facilities</header>
			<subsection id="idDA359467D95A46748D17E2756AFA08D5"><enum>(a)</enum><header>In
			 general</header><text>Subsection (m) of section 142 of the Internal Revenue
			 Code of 1986 is amended—</text>
				<paragraph id="id9B334994993A48A488A1704F09941305"><enum>(1)</enum><text>by striking
			 paragraph (2), and</text>
				</paragraph><paragraph id="id3B2729F9DB8E44B5BB097B1E665AE5F0"><enum>(2)</enum><text>by redesignating
			 paragraphs (3) and (4) as paragraphs (2) and (3).</text>
				</paragraph></subsection><subsection id="id626832DF596E484A838A221C65CF968A"><enum>(b)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to bonds
			 issued after the date of the enactment of this Act.</text>
			</subsection></section><section id="id4091F7F9979D45A28385F562FBA2A744"><enum>10.</enum><header>Reduction in
			 annual adjustments to pay schedules for Federal employees for fiscal years 2013
			 through 2021</header><text display-inline="no-display-inline">For each of
			 fiscal years 2013 through 2021, section 5303(a) of title 5, United States Code,
			 shall be applied by substituting <quote>1 percentage point</quote> for
			 <quote>one-half of 1 percentage point</quote>.</text>
		</section><section id="idBA9F8018B39941729497BD681313C77C"><enum>11.</enum><header>Funding</header><text display-inline="no-display-inline">Of the Federal funds saved for the period of
			 fiscal years 2013 through 2021 as a result of the application of section 9 of
			 this Act and subsections (b) and (c) of section 147 of the Continuing
			 Appropriations Act, 2011 (Public Law 111–242; 124 Stat. 2607, 124 Stat.
			 3518)—</text>
			<paragraph id="IDb9233e92e335499685cb482c2809f78b"><enum>(1)</enum><text>such sums as may
			 be necessary to carry out this Act and any amendments made by this Act shall be
			 deposited into the Highway Trust Fund; and</text>
			</paragraph><paragraph id="IDd4f4ce3d68ac451b8abb9b353fef3866"><enum>(2)</enum><text>the remainder of
			 the funds shall be used for purposes of deficit reduction.</text>
