		<official-title>To amend the Family and Medical Leave Act of 1993 to
		  permit leave to care for a same-sex spouse, domestic partner, parent-in-law,
		  adult child, sibling, grandchild, or grandparent who has a serious health
		  condition.</official-title>

		<section id="HD603E5414F244388A4B7593543326029" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Family and Medical Leave Inclusion
			 Act</short-title></quote>.</text>
		</section><section id="HDD451C732E2F482280E8E6B79F6935A1"><enum>2.</enum><header>Leave to care for
			 a same-sex spouse, domestic partner, parent-in-law, adult child, sibling,
			 grandchild, or grandparent</header>
			<subsection id="H65E87E679BFD48CAB93B12A45F187280"><enum>(a)</enum><header>Definitions</header>
				<paragraph id="HE5D4A8510E9B4D639388DF6983E88D61"><enum>(1)</enum><header>Inclusion of
			 adult children and children of a domestic partner</header><text display-inline="yes-display-inline">Section 101(12) of such Act (29 U.S.C.
			 2611(12)) is amended—</text>
					<subparagraph id="H385BCBDBF6FF46B4BE13A293ABD4E10C"><enum>(A)</enum><text>by inserting
			 <quote>a child of an individual’s domestic partner,</quote> after <quote>a
			 legal ward,</quote>; and</text>
					</subparagraph><subparagraph id="H4C87A2EDF959439795C54424F5E820BE"><enum>(B)</enum><text>by striking
			 <quote>who is—</quote> and all that follows and inserting <quote>and includes
			 an adult child.</quote>.</text>
					</subparagraph></paragraph><paragraph id="H5AE2E6F200FE485A8DCC92A6BCB2E90"><enum>(2)</enum><header>Inclusion of
			 grandchildren, grandparents, parents-in-law, siblings, and domestic
			 partners</header><text>Section 101 of such Act (29 U.S.C. 2611) is further
			 amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="HFE1AA65F9B3F471E8100DE8B317772B8" style="OLC">
						<paragraph commented="no" id="HC663A0518F2440CDA4A4632034B2C941"><enum>(20)</enum><header>Domestic
				partner</header><text display-inline="yes-display-inline">The term
				<term>domestic partner</term>, used with respect to an employee, means—</text>
							<subparagraph commented="no" id="HB2168326B3664BE8BC863CE8003C05EE"><enum>(A)</enum><text>the person
				recognized as the domestic partner of the employee under any domestic partner
				registry or civil union law of the State or political subdivision of a State
				where the employee resides, or the person who is lawfully married to the
				employee under the law of the State where the employee resides and who is the
				same sex as the employee; or</text>
							</subparagraph><subparagraph commented="no" id="H53A4BCD7B03644FBA78D1F64FA2EDA03"><enum>(B)</enum><text>in the case of an
				unmarried employee who lives in a State where a person cannot marry a person of
				the same sex under the laws of the State, a single, unmarried adult person of
				the same sex as the employee who is in a committed, personal (as defined in
				regulations issued by the Secretary) relationship with the employee, who is not
				a domestic partner to any other person, and who is designated to the employer
				by such employee as that employee’s domestic partner.</text>
							</subparagraph></paragraph><paragraph id="idB9E166552F7B4735B6B21CF5EF5E68FE"><enum>(21)</enum><header>Grandchild</header><text display-inline="yes-display-inline">The term <term>grandchild</term>, used with
				respect to an employee, means any person who is a son or daughter of a son or
				daughter of the employee.</text>
						</paragraph><paragraph id="H4526D10DFE794A8A002211FC8506737"><enum>(22)</enum><header>Grandparent</header><text>The
				term <term>grandparent</term>, used with respect to an employee, means a parent
				of a parent of the employee.</text>
						</paragraph><paragraph id="H9B42219C43554A8F9F00C8F6C58431A4"><enum>(23)</enum><header>Parent-in-law</header><text>The
				term <term>parent-in-law</term>, used with respect to an employee, means a
				parent of the spouse or domestic partner of the employee.</text>
						</paragraph><paragraph id="H75347EACA7E54A29AB10D9BDCB8EB4BF"><enum>(24)</enum><header>Sibling</header><text display-inline="yes-display-inline">The term <term>sibling</term>, used with
				respect to an employee, means any person who is a son or daughter of the
				employee’s parent.</text>
						</paragraph><paragraph id="id07E0810CF8C440B1B3A66F409761FCEE"><enum>(25)</enum><header>Son-in-law or
				daughter-in-law</header><text display-inline="yes-display-inline">The term
				<term>son-in-law or daughter-in-law</term>, used with respect to an employee,
				means any person who is a spouse or domestic partner of a son or daughter of
				the
				employee.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H391AFE947A6B43A0B0B1DA67AC717395"><enum>(b)</enum><header>Leave
			 Requirement</header><text>Section 102 of the Family and Medical Leave Act of
			 1993 (29 U.S.C. 2612) is amended—</text>
				<paragraph id="HA54921A6FA244FA09389EC573211EB15"><enum>(1)</enum><text>in subsection
			 (a)(1)—</text>
					<subparagraph id="id8ADFAA9832BC48F184A7C3C75E56BEB4"><enum>(A)</enum><text>in subparagraph
			 (C), by striking <quote>spouse, or a son, daughter, or parent, of the employee,
			 if such spouse, son, daughter, or parent</quote> and inserting <quote>spouse or
			 domestic partner, or a son, daughter, parent, parent-in-law, grandparent, or
			 sibling, of the employee if such spouse, domestic partner, son, daughter,
			 parent, parent-in-law, grandparent, or sibling</quote>; and</text>
					</subparagraph><subparagraph id="idFE6BF5FD2F8D46EB81F82D0EA74CB787"><enum>(B)</enum><text>in subparagraph
			 (E), by striking <quote>spouse, or a son, daughter, or parent</quote> and
			 inserting <quote>spouse or domestic partner, or a son, daughter, parent,
			 parent-in-law, grandchild, or sibling,</quote>;</text>
					</subparagraph></paragraph><paragraph id="H43222FB04EBD4398A7B3179E352C5E54"><enum>(2)</enum><text>in subsection
			 (a)(3), by striking <quote>spouse, son, daughter, parent,</quote> and inserting
			 <quote>spouse or domestic partner, son, daughter, parent, son-in-law or
			 daughter-in-law, grandparent, sibling,</quote>;</text>
				</paragraph><paragraph id="HAC46F9680D144F2A9F0040E9299F7FD6"><enum>(3)</enum><text display-inline="yes-display-inline">in subsection (e)—</text>
					<subparagraph id="id490B97EB745D404396FF9616F90A293E"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (2)(A), by striking
			 <quote>spouse, parent,</quote> and inserting <quote>spouse, domestic partner,
			 parent, parent-in-law, grandchild, grandparent, sibling, </quote>; and</text>
					</subparagraph><subparagraph id="idD7CA560BE77C418CB37571E305217C60"><enum>(B)</enum><text>in paragraph (3),
			 by striking <quote>spouse, or a son, daughter, or parent,</quote> and inserting
			 <quote>spouse or domestic partner, or a son, daughter, parent, parent-in-law,
			 grandchild, or sibling,</quote>; and</text>
					</subparagraph></paragraph><paragraph id="idD0BCE152D66440FEA1A3CBC4FC91FECE"><enum>(4)</enum><text>in subsection
			 (f)—</text>
					<subparagraph id="idBD10B753BFB042C7B48557327BDA1EFE"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking <quote>a
			 husband and wife</quote> and inserting <quote>2 spouses or 2 domestic
			 partners</quote>; and</text>
					</subparagraph><subparagraph id="idA65ED3EA710045FDBE3959C75E9FE071"><enum>(B)</enum><text>in paragraph
			 (2)—</text>
						<clause id="idAF3CA8364BAE4558B90E0398C8597492"><enum>(i)</enum><text>in
			 subparagraph (A), by striking <quote>that husband and wife</quote> and
			 inserting <quote>those spouses or those domestic partners</quote>; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id2EF538F0F08747A0ABD7230D920988B4"><enum>(ii)</enum><text>in subparagraph
			 (B), by striking <quote>the husband and wife</quote> and inserting <quote>those
			 spouses or those domestic partners</quote>.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="HEF947A2C4174464890F57C62CAA1265B"><enum>(c)</enum><header>Certification</header><text>Section
			 103 of the Family and Medical Leave Act of 1993 (29 U.S.C. 2613) is
			 amended—</text>
				<paragraph id="HAFFFAC5A6EDC45189248005E50415053"><enum>(1)</enum><text>in subsection (a),
			 by striking <quote>spouse, or parent</quote> and inserting <quote>spouse,
			 domestic partner, parent, parent-in-law, grandchild, grandparent, or
			 sibling</quote>; and</text>
				</paragraph><paragraph id="HF63956DBBEA64F740022F9898E80C44F"><enum>(2)</enum><text>in subsection
			 (b)—</text>
					<subparagraph id="id104DCA504C3B4A59A084FCC5A4E559AB"><enum>(A)</enum><text>in paragraph
			 (4)(A), by striking <quote>spouse, or parent and an estimate of the amount of
			 time that such employee is needed to care for the son, daughter, spouse, or
			 parent</quote> and inserting <quote>spouse, domestic partner, parent,
			 parent-in-law, grandparent, or sibling and an estimate of the amount of time
			 that such employee is needed to care for such son, daughter, spouse, domestic
			 partner, parent, parent-in-law, grandparent, or sibling</quote>; and</text>
					</subparagraph><subparagraph id="H9889760C98494EA7B136D58042300044"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (7), by striking
			 <quote>parent, or spouse</quote> and inserting <quote>spouse, domestic partner,
			 parent, parent-in-law, grandparent, or sibling</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="HB0223E15F9094097B5AEA812BE50A3F5"><enum>(d)</enum><header>Employment and
			 Benefits Protection</header><text>Section 104(c)(3) of the Family and Medical
			 Leave Act of 1993 (29 U.S.C. 2614(c)(3)) is amended—</text>
				<paragraph id="HBA72360978424D3794FB6FA2737986D3"><enum>(1)</enum><text>in subparagraph
			 (A)(i), by striking <quote>spouse, or parent</quote> and inserting
			 <quote>spouse, domestic partner, parent, parent-in-law, grandparent, or
			 sibling</quote>; and</text>
				</paragraph><paragraph id="H4E08097F75594C81BA69342F641D62F4"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (C)(ii), by striking
			 <quote>spouse, or parent</quote> and inserting <quote>spouse, domestic partner,
			 parent, parent-in-law, grandparent, or sibling</quote>.</text>
				</paragraph></subsection></section><section id="H8DC8DC127FF64E3E95B0C5E850E24460"><enum>3.</enum><header>Federal
			 employees</header>
			<subsection id="HABCF38D451304EF7997C05AE8F5330C4"><enum>(a)</enum><header>Definitions</header>
				<paragraph id="HCF283AF35CCC4CCA9D41005EA02E85F0"><enum>(1)</enum><header>Inclusion of
			 adult children and children of a domestic partner</header><text display-inline="yes-display-inline">Section 6381(6) of title 5, United States
			 Code, is amended—</text>
					<subparagraph id="H2811DFDEFAEB4AE198E62AF5199E756E"><enum>(A)</enum><text>by inserting
			 <quote>a child of an individual’s domestic partner,</quote> after <quote>a
			 legal ward,</quote>; and</text>
					</subparagraph><subparagraph id="H8A707483882B440CB79B1F15B8EEE0C1"><enum>(B)</enum><text>by striking
			 <quote>who is—</quote> and all that follows and inserting <quote>and includes
			 an adult child.</quote>.</text>
					</subparagraph></paragraph><paragraph id="HC0B6A056692B4385B35E82331DFF74AE"><enum>(2)</enum><header>Inclusion of
			 grandchildren, grandparents, parents-in-law, siblings, and domestic
			 partners</header><text display-inline="yes-display-inline">Section 6381 of such
			 title is further amended—</text>
					<subparagraph id="HE6381532DD684EFEB613984957D05DCA"><enum>(A)</enum><text>in paragraph
			 (11)(B), by striking <quote>; and</quote> and inserting a semicolon;</text>
					</subparagraph><subparagraph id="HEA04AC1765584466845994D0B2A8EC41"><enum>(B)</enum><text>in paragraph (12),
			 by striking the period and inserting a semicolon; and</text>
					</subparagraph><subparagraph id="H74FB6B404650406A9EFC00061B6C6042"><enum>(C)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H1C0D5D0899F144F1830654001BFE2BF7" style="USC">
							<paragraph id="H4A2888E6EA92414BA9C0DE835CC88672"><enum>(13)</enum><text display-inline="yes-display-inline">the term <term>domestic partner</term>,
				used with respect to an employee, means—</text>
								<subparagraph commented="no" id="H3A517ABAB6644AB4B28C04E50127E900"><enum>(A)</enum><text>the person
				recognized as the domestic partner of the employee under any domestic partner
				registry or civil union law of the State or political subdivision of a State
				where the employee resides, or the person who is lawfully married to the
				employee under the law of the State where the employee resides and who is the
				same sex as the employee; or</text>
								</subparagraph><subparagraph commented="no" id="HEF7DA8990DB94E928516006EE4635B6C"><enum>(B)</enum><text>in the case of an
				unmarried employee who lives in a State where a person cannot marry a person of
				the same sex under the laws of the State, a single, unmarried adult person of
				the same sex as the employee who is in a committed, personal (as defined in
				regulations issued by the Office of Personnel Management) relationship with the
				employee, who is not a domestic partner to any other person, and who is
				designated to the employer by such employee as that employee’s domestic
				partner;</text>
								</subparagraph></paragraph><paragraph id="idB0FC16C4D7494A0EA45D16186A22DB5B"><enum>(14)</enum><text display-inline="yes-display-inline">the term <term>grandchild</term>, used with
				respect to an employee, means any person who is a son or daughter of a son or
				daughter of the employee;</text>
							</paragraph><paragraph id="H72FE442934F545038FB694F88A6B86C"><enum>(15)</enum><text>the term
				<term>grandparent</term>, used with respect to an employee, means a parent of a
				parent of the employee;</text>
							</paragraph><paragraph id="HDFABD73F2018400EBC1E33F18F9DF000"><enum>(16)</enum><text>the term
				<term>parent-in-law</term>, used with respect to an employee, means a parent of
				the spouse or domestic partner of the employee;</text>
							</paragraph><paragraph id="H3AD2F06F78FE49B494ACFDEA11FF88ED"><enum>(17)</enum><text>the term
				<term>sibling</term>, used with respect to an employee, means any person who is
				a son or daughter of the employee’s parent; and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF743EBE5B55C4D498509FC9BD01D3425"><enum>(18)</enum><text display-inline="yes-display-inline">the term <term>son-in-law or
				daughter-in-law</term>, used with respect to an employee, means any person who
				is a spouse or domestic partner of a son or daughter of the
				employee.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection id="HBAC26875D2BE45EFAECD9F312F57BFCC"><enum>(b)</enum><header>Leave
			 Requirement</header><text>Section 6382 of title 5, United States Code, is
			 amended—</text>
				<paragraph id="H91012CA479D34BA3A018820002DFFC8"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(1)—</text>
					<subparagraph id="id6199B07685FD4629A2497E97390BC857"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (C), by striking
			 <quote>spouse, or a son, daughter, or parent, of the employee, if such spouse,
			 son, daughter, or parent</quote> and inserting <quote>spouse or domestic
			 partner, or a son, daughter, parent, parent-in-law, grandparent, or sibling, of
			 the employee, if such spouse, domestic partner, son, daughter, parent,
			 parent-in-law, grandparent, or sibling</quote>; and</text>
					</subparagraph><subparagraph id="id91F92504709C4F8A8B2ED6EE16268485"><enum>(B)</enum><text>in subparagraph
			 (E), by striking <quote>spouse, or a son, daughter, or parent</quote> and
			 inserting <quote>spouse or domestic partner, or a son, daughter, parent,
			 parent-in-law, grandchild, or sibling,</quote>;</text>
					</subparagraph></paragraph><paragraph id="HD1D59C18D2884163A092F2430300E281"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (a)(3), by striking
			 <quote>spouse, son, daughter, parent,</quote> and inserting <quote>spouse or
			 domestic partner, son, daughter, parent, son-in-law or daughter-in-law,
			 grandparent, sibling,</quote>; and</text>

					</subparagraph><subparagraph id="id7003DD0CA30E48D5BA62BE66DDAFCA84"><enum>(B)</enum><text>in paragraph (3),
			 by striking <quote>spouse, or a son, daughter, or parent,</quote> and inserting
			 <quote>spouse or domestic partner, or a son, daughter, parent, parent-in-law,
			 grandchild, or sibling,</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="HAEBA5C1A910E405F8495B376D22398A7"><enum>(c)</enum><header>Certification</header><text>Section
			 6383 of title 5, United States Code, is amended—</text>
				<paragraph id="HA4C1757B3D3145A99D18ABBA0211A794"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), by striking
			 <quote>spouse, or parent</quote> and inserting <quote>spouse, domestic partner,
			 parent, parent-in-law, grandchild, grandparent, or sibling</quote>; and</text>
				</paragraph><paragraph id="H42A51FC9DDF5409B8C54E3F3092C896E"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b)(4)(A), by striking
			 <quote>spouse, or parent, and an estimate of the amount of time that such
			 employee is needed to care for such son, daughter, spouse, or parent</quote>
			 and inserting <quote>spouse, domestic partner, parent, parent-in-law,
			 grandparent, or sibling and an estimate of the amount of time that such
			 employee is needed to care for such son, daughter, spouse, domestic partner,
			 parent, parent-in-law, grandparent, or sibling</quote>.</text>
