		<section id="HE3526A96CE5149F28F8FEA574C286F3A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Responsible Electronics Recycling
			 Act</short-title></quote>.</text>
		</section><section id="HF9EF249EC74A492E9A13752BD6F2B50F"><enum>2.</enum><header>Electronic waste
			 export restrictions</header>
			<subsection id="H6588422D15724070AC7C7D9546EC3EFA"><enum>(a)</enum><header>Amendment</header><text>Subtitle
			 C of the Solid Waste Disposal Act (42 U.S.C. 6921 et seq.) is amended by adding
			 at the end the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="H8732212BF7354632B979D7F20E90DFBF" style="OLC">
					<section id="H88A85EF4D75C4473962EF26DF886911B"><enum>3024.</enum><header>Electronic
				waste export restrictions</header>
						<subsection id="H5C7DDD7849784BC9B7E7127D42DB093C"><enum>(a)</enum><header>In
				general</header><text>Beginning on the date that is 24 months after the date of
				enactment of this section, no person shall export restricted electronic waste
				to a country described in subsection (e).</text>
						</subsection><subsection id="HD6543B765DCB4E6EA273C5091D7B2A38"><enum>(b)</enum><header>Definitions;
				rule of construction</header><text>For purposes of this section:</text>
							<paragraph id="H015489B8D7FF416789B7A3CE6A5A9ABE"><enum>(1)</enum><header>Consignee</header><text display-inline="yes-display-inline">The term <term>consignee</term> means the
				ultimate repair, refurbishment, treatment, storage, or disposal facility in a
				receiving country to which restricted electronic waste will be sent.</text>
							</paragraph><paragraph id="HF2F8BEFDA099418087D6CFF1B717180D"><enum>(2)</enum><header>Covered
				electronic equipment</header>
								<subparagraph id="HDE8AD08C6C184803BF98865F903A62A6"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">The term
				<term>covered electronic equipment</term> means the following used items, whole
				or in fragments, including parts, components, or assemblies thereof:</text>
									<clause id="H0E33A15B0E394180905AFE0786E94BA6"><enum>(i)</enum><text>Computers.</text>
									</clause><clause id="HC8170375F1C340E58B8ADABF5407E594"><enum>(ii)</enum><text>Central
				processing units.</text>
									</clause><clause id="H70BC289F2ABD41A089040F8E59E6BAD3"><enum>(iii)</enum><text>Mobile computers
				(including notebooks, netbooks, tablets, and e-book readers).</text>
									</clause><clause id="H2811F029665A4E02992F0CF9AF0AFA3C"><enum>(iv)</enum><text>Computer
				accessories (including input devices, webcams, speakers, data storage devices,
				servers, and monitors).</text>
									</clause><clause id="HC2C364352FC747248A85CC3CECC10B6E"><enum>(v)</enum><text>Televisions
				(including portable televisions and portable DVD players).</text>
									</clause><clause id="H6D45EFD0BE54451381FC0104FAF9948B"><enum>(vi)</enum><text>Video display
				devices (including digital picture frames and portable video devices).</text>
									</clause><clause id="HFCC9506A9F394F6880DA50FC1652666B"><enum>(vii)</enum><text>Digital imaging
				devices (including printers, copiers, facsimile machines, image scanners, and
				multifunction machines).</text>
									</clause><clause id="HD21DE5EBC0EE4A5BAA3C6DC68AB58488"><enum>(viii)</enum><text>Television
				peripheral devices (including video cassette recorders, DVD players, video game
				systems, game controllers, signal converter boxes, and cable and satellite
				receivers).</text>
									</clause><clause id="HD8ADBA1087F04A4FB68037076C05F866"><enum>(ix)</enum><text>Digital cameras
				and projectors.</text>
									</clause><clause id="HAB0A3710AC8045DCBE6EE76BE1B3C306"><enum>(x)</enum><text>Digital audio
				players.</text>
									</clause><clause id="HAAB767BABFD74E1D9AB0F2804D7DFE28"><enum>(xi)</enum><text>Telephones and
				electronic communication equipment (including cellular phones and wireless
				internet communication devices).</text>
									</clause><clause id="H8DE7B21D3A634C7A9D22E0BAA66107CD"><enum>(xii)</enum><text>Networking
				devices (including routers, network cards, modems, and hubs).</text>
									</clause><clause id="H4D7F2E6446D14354A242B103B1A6D5CF"><enum>(xiii)</enum><text>Audio
				equipment.</text>
									</clause><clause id="H77C559191C454B65B9A2648D1214C5F8"><enum>(xiv)</enum><text>Portable video
				game systems.</text>
									</clause><clause id="HF1F7D731BE4847B09A06A4199980FF59"><enum>(xv)</enum><text>Personal digital
				assistants.</text>
									</clause><clause id="H84D53042F0CF45C99EC8F15ABBD7F19C"><enum>(xvi)</enum><text>Portable global
				positioning system navigation devices.</text>
									</clause><clause id="HBDD76BA7073D4C46AD2C63A842918C66"><enum>(xvii)</enum><text>Other used
				electronic products the Administrator determines to be similar under the
				procedures promulgated in accordance with subsection (c).</text>
									</clause></subparagraph><subparagraph id="H56CFCA80EA1547B1BED656A974B3BEC0"><enum>(B)</enum><header>Exception</header><text>The
				term <term>covered electronic equipment</term> shall not include parts of a
				motor vehicle.</text>
								</subparagraph></paragraph><paragraph id="H6FF8B02456C94DF7A709130BDAFE5F2F"><enum>(3)</enum><header>Restricted
				electronic waste</header>
								<subparagraph id="H11F9E7AF9AF74B5C8EB5BBE44F7FD60D"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">The term
				<term>restricted electronic waste</term> means—</text>
									<clause id="H835C5064A7E5446DAEFAAA235A7645CF"><enum>(i)</enum><text>items of covered
				electronic equipment, that include, contain, are derived from, or consist
				of—</text>
										<subclause id="HCFB64DB504F64DE8BCBFB8D122D50095"><enum>(I)</enum><text>cathode ray tubes
				or cathode ray tube glass in any form, or cathode ray tube phosphor residues or
				dusts in any form;</text>
										</subclause><subclause id="H29B58514F2FF4D8398B9F038C38B89F8"><enum>(II)</enum><text>a lamp or other
				device containing mercury phosphor;</text>
										</subclause><subclause id="H8A628023A5954C15BE705A3ECBF3D1AD"><enum>(III)</enum><text>batteries
				containing—</text>
											<item id="H2B1C1915FCA54198804654654123BDD3"><enum>(aa)</enum><text>lead, cadmium, or
				mercury; or</text>
											</item><item id="HEF6D0CAB0E88444F9294A50C112CB3D3"><enum>(bb)</enum><text>organic solvents
				exhibiting the characteristic of ignitability, as defined in section 261.21 of
				title 40, Code of Federal Regulations;</text>
											</item></subclause><subclause id="H2873AB718139417495EA2AC25700D919"><enum>(IV)</enum><text>switches or any
				other devices containing mercury;</text>
										</subclause><subclause id="HC68C2222BE6F4816B775C24A0918F8F7"><enum>(V)</enum><text>hexavalent
				chromium;</text>
										</subclause><subclause id="H518FDE0CC43B4EB599160E36C3708E11"><enum>(VI)</enum><text>other than
				batteries described in subclause (III), items containing antimony, barium,
				cadmium, lead, thallium, beryllium, arsenic, or selenium, including—</text>
											<item id="HAB6AA52CA07C40189D9B7BB5F31F362C"><enum>(aa)</enum><text>circuit
				boards;</text>
											</item><item id="HCD157BD158AC4976B36AE25663E5E51F"><enum>(bb)</enum><text>printer
				drums;</text>
											</item><item id="H8FAE97A61D334B519D527C75E6B19C89"><enum>(cc)</enum><text>liquid crystal
				displays;</text>
											</item><item id="HC5CFB49743C04A7ABCCB6757A31B82A1"><enum>(dd)</enum><text>flatscreen glass;
				and</text>
											</item><item id="HD97358A3B3BC48158E4564CFDFC3C5E6"><enum>(ee)</enum><text>light emitting
				diodes; or</text>
											</item></subclause></clause><clause id="H0DFEF2800DAD465BA9513508C131E3DE"><enum>(ii)</enum><text>any other covered
				electronic equipment, or materials derived therefrom, containing any other
				toxic material, in elemental or compound form, identified by the Administrator
				under subsection (c).</text>
									</clause></subparagraph><subparagraph id="H2B4164878FE0415CB34DDD3EB176682A"><enum>(B)</enum><header>Exceptions</header><text>The
				term <term>restricted electronic waste</term> shall not apply to items
				described in this subparagraph.</text>
									<clause id="HAE3067DEC45B4894B87776E4C228C6B7"><enum>(i)</enum><header>De
				minimis</header><text>Covered electronic equipment described in subparagraphs
				(A)(i)(VI) and (A)(ii), including separated component streams (such as plastics
				or metals), which does not exceed de minimis levels set by the Administrator
				under subsection (d).</text>
									</clause><clause commented="no" id="H409C4FF74E67458BB27F605D8688CAA4"><enum>(ii)</enum><header>Reuse</header><text>Covered
				electronic equipment that is—</text>
										<subclause commented="no" id="H8F9DBC726FD04D6B9419710C89D70F12"><enum>(I)</enum><text>tested prior to
				export pursuant to subsection (i)(1), and found to be—</text>
											<item commented="no" id="H4C90B970D48B4D98A93CB9A05BC79555"><enum>(aa)</enum><text>functional for
				the purpose for which the equipment was designed, or, in the case of
				multifunction devices, fully functional for at least one of the primary
				purposes for which the equipment was designed; and</text>
											</item><item commented="no" id="H72CB9EBB89AA43A8856B2309CB8A6A3C"><enum>(bb)</enum><text>appropriately
				packaged for shipment to prevent the equipment from losing functionality due to
				damage during transit; and</text>
											</item></subclause><subclause commented="no" id="H950D9795F4C84A689BBF935C929CC504"><enum>(II)</enum><text>appropriately
				labeled or marked pursuant to subsection (i)(3)(A).</text>
										</subclause></clause><clause id="H7A66BBA3ED064F63A34E8F2B5E59889B"><enum>(iii)</enum><header>Certain
				cathode ray tube glass</header><text>Furnace-ready cathode ray tube glass
				cullet, cleaned of all phosphors, to be used as a direct feedstock in a
				lead-glass manufacturing furnace without further processing or preparation
				required other than quality control, which the competent authority in the
				importing country states in writing is not waste.</text>
									</clause><clause id="H1593ED2508244D1BA0B7C0191EDE8E64"><enum>(iv)</enum><header>Warranties</header><text display-inline="yes-display-inline">Customer returns, to point of sale, to
				original equipment manufacturers, or to contractual warranty collectors, of
				recently purchased covered electronic equipment that is either—</text>
										<subclause id="HC277DBD98E914454B517F74F3ADF3634"><enum>(I)</enum><text display-inline="yes-display-inline">under original equipment manufacturer
				warranty to customers; or</text>
										</subclause><subclause id="H53762080BCD1420686DF2A65DCDD51C0"><enum>(II)</enum><text display-inline="yes-display-inline">under warranty from the original design
				manufacturer or original component manufacturer to the original equipment
				manufacturer, or otherwise returned by the original purchaser of the electronic
				equipment, due to defect or customer dissatisfaction, and the manufacturer
				accepts such returns for the purposes of repair or replacement in order to
				return to the customer a functional working product or part of the same type
				and model, except that products and parts covered in this subparagraph shall
				not include—</text>
											<item id="HF7C9D8A7F4254064ADEAF3F61B9C003A"><enum>(aa)</enum><text display-inline="yes-display-inline">covered electronic equipment accepted for
				return from individuals or businesses under general takeback, recycling,
				trade-in (for purposes of recycling, disposal, sales promotions, or obtaining
				credit for product purchases or leases) or buy-back programs, events, or
				policies designed to collect used or waste electronic equipment;</text>
											</item><item id="H5BC83B5B48244CCF89F5508C41D2BCCC"><enum>(bb)</enum><text display-inline="yes-display-inline">covered electronic equipment returned at
				the end of leases to customers; or</text>
											</item><item id="H65340C9DF2374FFFA503A0DCA8E35924"><enum>(cc)</enum><text display-inline="yes-display-inline">covered electronic equipment collected by
				asset recovery programs.</text>
											</item></subclause></clause><clause id="H5ECBE611169E4E7386A94EFC1AA6DD18"><enum>(v)</enum><header>Recalls</header><text display-inline="yes-display-inline">Recalls of covered electronic equipment by
				an original equipment manufacturer, original design manufacturer, or original
				component manufacturer where—</text>
										<subclause id="H01AD902CD44C464BAF52F51D0FA75C37"><enum>(I)</enum><text display-inline="yes-display-inline">the covered electronic equipment is subject
				to recall notice issued by the Consumer Product Safety Commission or other
				pertinent Federal authority;</text>
										</subclause><subclause id="HEE147FD36D4A4CA9848D4E8CD8E1F971"><enum>(II)</enum><text display-inline="yes-display-inline">the original design manufacturer or
				original component manufacturer requires the defective covered electronic
				equipment to be physically returned to that manufacturer as a term of the
				warranty; and</text>
										</subclause><subclause id="H85F736BDA00B42C793B26B20B5DD0957"><enum>(III)</enum><text display-inline="yes-display-inline">any export of recalled covered electronic
				equipment is to a country from whose competent authority the Administrator
				receives written consent pursuant to subsection (h)(2).</text>
										</subclause></clause></subparagraph></paragraph><paragraph id="HFEDC188EA0364191AD3EC82BEC114F60"><enum>(4)</enum><header>Rule of
				construction regarding chemical elements</header><text>Any reference to a
				chemical element shall be construed to be a reference to that element in
				compound or elemental form.</text>
							</paragraph></subsection><subsection id="H8161A2EE55934AF591DA15A9CFDBDFF2"><enum>(c)</enum><header>Additional
				covered electronic equipment and restricted materials</header><text display-inline="yes-display-inline">Not later than 18 months after the date of
				enactment of this section, the Administrator shall, after notice and
				opportunity for public comment, and after consultation with appropriate Federal
				and State agencies, develop and promulgate procedures for identifying—</text>
							<paragraph id="HE8FCECACBA3C412B944BA3CF95043821"><enum>(1)</enum><text display-inline="yes-display-inline">similar electronic equipment to add to the
				list of covered electronic equipment under subsection (b)(2); and</text>
							</paragraph><paragraph id="H0EC910F779A14877B80BD97A1F74491F"><enum>(2)</enum><text display-inline="yes-display-inline">additional restricted toxic materials to
				add to the list in subsection (b)(3)(A)(ii), the presence of which in covered
				electronic equipment poses a potential hazard to human health or the
				environment.</text>
							</paragraph><continuation-text continuation-text-level="subsection">Such
				procedures shall include a method for any interested party to propose a new
				product or material for review by the Administrator.</continuation-text></subsection><subsection id="H780657C67785431CB8FA42C5FB35295C"><enum>(d)</enum><header>De minimis
				levels</header><text display-inline="yes-display-inline">Not later than 18
				months after the date of enactment of this section, the Administrator shall,
				after notice and opportunity for public comment, and after consultation with
				appropriate Federal and State agencies, develop and promulgate procedures for
				identifying de minimis levels for restricted electronic waste described in
				subparagraphs (A)(i)(VI) and (A)(ii) of subsection (b)(3), below which such
				waste is determined by the Administrator not to pose a potential hazard to
				human health or the environment.</text>
						</subsection><subsection id="HE252DFE32D154DC48D715C44A7E2C236"><enum>(e)</enum><header>Countries to
				which prohibition applies</header><text>The countries referred to in subsection
				(a) are all countries which are not—</text>
							<paragraph id="H9318FB90D74842BAA1FAFACB21D2F7F1"><enum>(1)</enum><text display-inline="yes-display-inline">members of the Organization for Economic
				Co-operation and Development or the European Union; or</text>
							</paragraph><paragraph id="H815D02955C214FEFAE7F940F55316314"><enum>(2)</enum><text display-inline="yes-display-inline">Liechtenstein.</text>
							</paragraph></subsection><subsection id="HFBBFCE1007ED4CFE9839FF1DC3E547D7"><enum>(f)</enum><header>Notice to
				administrator</header><text display-inline="yes-display-inline">No person shall
				export covered electronic equipment described in subsection (b)(3)(B) to a
				country described in subsection (e) unless, not later than 60 days before the
				initial export shipment, such person transmits to the Administrator written
				notice of an intended export. Such a notification may cover export activities
				extending over a maximum of 12 months for the same type of covered electronic
				equipment, exported to the same facility via the same transit countries. The
				notification shall include the following information:</text>
							<paragraph id="HD02CFAEE78964FC29190048723503C03"><enum>(1)</enum><text>The name, mailing
				address, telephone number, and if applicable, the Environmental Protection
				Agency or Resource Conservation and Recovery Act identification number.</text>
							</paragraph><paragraph id="H7E5AB0AA13CE4997AA715A2C08619C92"><enum>(2)</enum><text>Documentation of
				licensing of the exporter under subsection (g).</text>
							</paragraph><paragraph id="HE61AD139C98C4478B6FA74D20DC4A57E"><enum>(3)</enum><text>The name and site
				address of the consignee and any alternate consignee.</text>
							</paragraph><paragraph id="H9601B7A446E44E138E01296384A960B4"><enum>(4)</enum><text>A statement from
				the exporter that includes—</text>
								<subparagraph id="H2B83E505F0D841BE9809A174D7AA364E"><enum>(A)</enum><text>a description of
				the type and total quantity of covered electronic equipment that will be
				exported to the consignee;</text>
								</subparagraph><subparagraph id="HF1B4D818C2A74F448FE89A2C5A090332"><enum>(B)</enum><text>the estimated
				frequency or rate at which such covered electronic equipment is to be exported,
				and the period of time over which such covered electronic equipment is to be
				exported;</text>
								</subparagraph><subparagraph id="H9D2CE437D13D42C2AA2FE129E3B749F2"><enum>(C)</enum><text>all points of
				entry to and departure from each country through which the covered electronic
				equipment will pass in transit;</text>
								</subparagraph><subparagraph id="HD34FEFDF1D414A158E14A316F12DC476"><enum>(D)</enum><text>a description of
				the means by which each shipment of the covered electronic equipment will be
				transported, including the mode of transportation and type or types of
				container; and</text>
								</subparagraph><subparagraph id="H3AAA749C02A74BA48D7B7F81C26946F2"><enum>(E)</enum><text>a description of
				the manner in which the covered electronic equipment will be treated, stored,
				or disposed of in the receiving country.</text>
								</subparagraph></paragraph><paragraph id="HAAC86EAF517D474C9326AFB47ED07E2D"><enum>(5)</enum><text>A list of all
				transit countries through which the covered electronic equipment will be
				transported, and a description of the approximate length of time the covered
				electronic equipment will remain in each country and the nature of its handling
				while there.</text>
							</paragraph></subsection><subsection id="H4B1A5344B28D49C79984A03CB1F3E70E"><enum>(g)</enum><header>License</header><text display-inline="yes-display-inline">Covered electronic equipment may only be
				exported to a country described in subsection (e) under the exceptions to
				restricted electronic waste in subsection (b)(3)(B) by an entity licensed by
				the Administrator under regulations issued under subsection (i)(2).</text>
						</subsection><subsection id="HD1D4E5628827449996544FC5EA0E5748"><enum>(h)</enum><header>Additional
				export conditions for warranties and recalls</header>
							<paragraph id="H00B14898EB2F4115B9782DF3BE84FD9C"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">No person shall
				export covered electronic equipment to a country described in subsection (e)
				under the exceptions to restricted electronic waste in subsections
				(b)(3)(B)(iv) or (v) unless—</text>
								<subparagraph id="H0218E6856D5A4F7EB66FD7E17EFECFD1"><enum>(A)</enum><text display-inline="yes-display-inline">the export is made by an original equipment
				manufacturer or its contractual agent to the original design manufacturer or
				original component manufacturer’s site of last assembly, or to a company
				contracted to make warranty repairs, for the purposes of business credit to the
				original equipment manufacturer, repair or refurbishment and subsequent reuse,
				or replacement;</text>
								</subparagraph><subparagraph id="HFAB7505543FC4BD4AD1E3DD416B7E919"><enum>(B)</enum><text display-inline="yes-display-inline">the original equipment manufacturer has a
				presence and assets in the United States; and</text>
								</subparagraph><subparagraph id="H78D1960DD58A4A7AA2DFA48A9DF98A03"><enum>(C)</enum><text display-inline="yes-display-inline">the person who exports the covered
				electronic equipment—</text>
									<clause id="H96E85369235E407EA2DA0F839B6CF025"><enum>(i)</enum><text>keeps copies of
				normal business records, such as contracts, demonstrating that each shipment of
				exported covered electronic equipment is intended for repair or refurbishment
				and subsequent reuse, or replacement, which documentation shall be retained for
				a period of at least 3 years after the date of export; and</text>
									</clause><clause id="H8D83A980F1764D2AA1D23B4988CF0E1F"><enum>(ii)</enum><text>submits an annual
				report to the Administrator on the amount and types of waste resulting from the
				refurbishment or replacement process, and how it was disposed of or recycled,
				which shall include—</text>
										<subclause id="H0C8734258399434F9BEE743245E9422C"><enum>(I)</enum><text>number and weight
				of units of products returned by the original equipment manufacturer for
				repair, refurbishment, or replacement listed by category and country of
				destination; and</text>
										</subclause><subclause id="HCB0A87902C0F4C67A53446C8824E0938"><enum>(II)</enum><text>the covered
				electronic equipment, or materials derived therefrom, sent onward to further
				reuse, disposal, or recycling following repair, refurbishment, or replacement,
				listed by weight, a description of the wastes, and the ultimate country
				destination.</text>
										</subclause></clause></subparagraph></paragraph><paragraph id="HD116328A70F54EA4AAB0238691D3D4CA"><enum>(2)</enum><header>Acknowledgment
				of consent</header>
								<subparagraph id="H1DF9518C875848469D95B8A09C52A7DA"><enum>(A)</enum><header>Requirement</header><text display-inline="yes-display-inline">No person shall export covered electronic
				equipment to a country described in subsection (e) under the exceptions to
				restricted electronic waste in subsections (b)(3)(B)(iv) or (v) until the
				Administrator—</text>
									<clause id="H6A06FC30742747E5970EB8F7C9B1E1FE"><enum>(i)</enum><text display-inline="yes-display-inline">obtains the written consent of the
				competent authority of the receiving country, and of each country through which
				the covered electronic equipment will pass in transit; and</text>
									</clause><clause id="H7ED3DCA3BA2B4017AEE30714CA266813"><enum>(ii)</enum><text display-inline="yes-display-inline">transmits to the exporter an Acknowledgment
				of Consent reflecting receipt of each country’s consent.</text>
									</clause></subparagraph><subparagraph id="HBC1C6400082D4315804C9FEABBBE09AA"><enum>(B)</enum><header>Country
				notification</header><text>In cooperation with other appropriate agencies, the
				Administrator shall provide notification in writing of an intended export
				submitted under subsection (f) to the receiving country and any transit
				countries.</text>
								</subparagraph><subparagraph id="H9C949E9BB7B44A679FA22BAC322031E0"><enum>(C)</enum><header>Consent and
				exporter notification</header><text>When the receiving country and all transit
				countries consent in writing to the receipt or transit of the covered
				electronic equipment, the Administrator shall transmit an Acknowledgment of
				Consent to the exporter. The consent from a receiving or transit country may be
				for a notice of multiple shipments or a specified duration as described in
				subsection (f). The exporter shall attach a copy of the Acknowledgment of
				Consent to the shipping papers or equivalent documents to ensure that the
				Acknowledgment of Consent accompanies the shipment of covered electronic
				equipment.</text>
								</subparagraph></paragraph><paragraph id="HE6C92FE40F074921AB4D63E2FCE63F5A"><enum>(3)</enum><header>Withdrawal of
				consent</header><text>Where the receiving country or a transit country objects
				to receipt or transit of the covered electronic equipment, or withdraws a prior
				consent, the Administrator shall notify the exporter in writing.</text>
							</paragraph></subsection><subsection id="H47C67CEA4CD34423AA167528495D405A"><enum>(i)</enum><header>Regulations</header><text display-inline="yes-display-inline">Not later than 18 months after the date of
				enactment of this section, the Administrator shall issue regulations for
				carrying out this section, including—</text>
							<paragraph commented="no" id="H4604B628CE63485B95A56DE65513D00C"><enum>(1)</enum><text>testing
				requirements for covered electronic equipment proposed to be exported under
				subsection (b)(3)(B)(ii);</text>
							</paragraph><paragraph id="H02E02202DE154D30B7C79E34F06C646D"><enum>(2)</enum><text>establishing a
				process for licensing entities under subsection (g);</text>
							</paragraph><paragraph id="H1AE99EAC362742CA859361752D4744A0"><enum>(3)</enum><text>in consultation
				with the appropriate Federal agency or agencies, provisions for an efficient
				export control regime which will allow for—</text>
								<subparagraph id="H8FF5E19D10664C3F94E0932EE8059D21"><enum>(A)</enum><text>requiring a person
				exporting under this section to use appropriate labeling or marking,
				distinguishing among—</text>
									<clause id="H6E6908796A544807BB3A6AA444851CE8"><enum>(i)</enum><text>covered electronic
				equipment as permitted under this section;</text>
									</clause><clause id="HBBB1D687509144A6B818F27023259317"><enum>(ii)</enum><text>restricted
				electronic waste described in this section; and</text>
									</clause><clause id="H8BC6EE29358E43A5B03F44274885D9DE"><enum>(iii)</enum><text>tested working
				covered electronic equipment as permitted under this section; and</text>
									</clause></subparagraph><subparagraph id="HC1CB1E7802CC4FDEB255644D8C0C23AC"><enum>(B)</enum><text>enforcement
				mechanisms, tests, and procedures in coordination with enforcement procedures
				administered by other appropriate Federal agencies; and</text>
								</subparagraph></paragraph><paragraph id="HB6C718A8EFEB41CAB5C1C7AC81F1BDD7"><enum>(4)</enum><text>establishing a
				registry of violators, whereby any person or entity found to be exporting
				restricted electronic waste in violation of this section shall be listed on a
				public registry on a website maintained by the Administrator for a period of 5
				years after each violation.</text>
							</paragraph></subsection><subsection commented="no" id="HE78B2626E64E4B438D228CBBCD9B91A1"><enum>(j)</enum><header>Circuit
				boards</header><text display-inline="yes-display-inline">For the purposes of
				export to Organization for Economic Co-operation and Development member
				countries, circuit boards shall be subject to the Amber Control Procedure as
				described in the Organization for Economic Co-operation and Development Control
				System for waste
				recovery.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H3198A1A272F54A5B8762EFA11372D0B8"><enum>(b)</enum><header>Table of
			 contents amendment</header><text display-inline="yes-display-inline">The table
			 of contents for the Solid Waste Disposal Act is amended by adding after the
			 item relating to section 3023 the following new item:</text>

			<subsection id="H423E7668982444B5BA40CF464D158512"><enum>(a)</enum><header>Criminal
			 penalties</header><text>Section 3008(d) of the Solid Waste Disposal Act (42
			 U.S.C. 6928(d)) is amended—</text>
				<paragraph id="H3A4CE898AC7F4EF58FBCBF5023CD4B07"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>or</quote> at the end of
			 paragraph (6);</text>
				</paragraph><paragraph id="HB9806C75A5DE41CB9070C1FC26A6B344"><enum>(2)</enum><text>by inserting
			 <quote>or</quote> at the end of paragraph (7)(B); and</text>
				</paragraph><paragraph id="H1C9A2DAF760F496487C5C5B2FC3FD4D5"><enum>(3)</enum><text>by inserting after
			 paragraph (7) the following new paragraph:</text>

				</paragraph></subsection><subsection id="HFCC1507016514B5DBA739B641128A901"><enum>(b)</enum><header>Inspections</header><text>Section
			 3007(a) of the Solid Waste Disposal Act (42 U.S.C. 6927(a)) is amended—</text>
				<paragraph id="H9A3EFC447846403F8294AEC4121FE1D9"><enum>(1)</enum><text>by inserting
			 <quote>or restricted electronic wastes</quote> after <quote>or has handled
			 hazardous wastes</quote>; and</text>
				</paragraph><paragraph id="H45F2A8D651C04538BEC27CB9679138E7"><enum>(2)</enum><text>by inserting
			 <quote>or restricted electronic wastes</quote> after <quote>or other place
			 where hazardous wastes</quote>.</text>
				</paragraph></subsection></section><section id="H0FD757D053A94935AB40500E69113109"><enum>4.</enum><header>Rare earth
			 materials recycling research initiative</header>
			<subsection id="HFEB8308C2E6A4596A46F414EA5976765"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text>
				<paragraph id="H49286242C75F433893B0E09EA3902884"><enum>(1)</enum><header>Administrator</header><text display-inline="yes-display-inline">The term <term>Administrator</term> means
			 the Administrator of the Environmental Protection Agency.</text>
				</paragraph><paragraph id="H124CF31C0F9C459598014CEAE4E15478"><enum>(2)</enum><header>Initiative</header><text display-inline="yes-display-inline">The term <term>Initiative</term> means the
			 Rare Earth Materials Recycling Research Initiative established under subsection
			 (b).</text>
				</paragraph><paragraph id="HE8A3EC9DD7E9421C8B652D5B07F93CE2"><enum>(3)</enum><header>Rare earth
			 material</header><text display-inline="yes-display-inline">The term <term>rare
			 earth material</term> means any of the following chemical elements in any
			 physical form or chemical combination:</text>

			 identified by the Secretary as rare or in critical supply.</text>
					</subparagraph></paragraph><paragraph id="H6B67E921BC9D4EFF8E59A67ECD5A7019"><enum>(4)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Energy.</text>
				</paragraph></subsection><subsection id="H912DBD80B5C546B384B45183CC32562C"><enum>(b)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 120 days after the date of
			 enactment of this Act, the Secretary, in consultation with the Administrator
			 and the heads of other appropriate Federal agencies, shall establish the Rare
			 Earth Materials Recycling Research Initiative to assist in and coordinate the
			 development of research in the recycling of rare earth materials found in
			 electronic devices.</text>
			</subsection><subsection id="H657660EF223946E28FE66D3C54636885"><enum>(c)</enum><header>Grants</header><text display-inline="yes-display-inline">Under the Initiative, the Secretary shall
			 establish a competitive research application program under which the Secretary
			 shall provide grants to applicants to conduct research on one or more of the
			 following activities:</text>
				<paragraph id="HCF0183E2B0514A6CB90934DFF43C7E8E"><enum>(1)</enum><text display-inline="yes-display-inline">The safe removal, separation, and recycling
			 of rare earth material from electronics.</text>
				</paragraph><paragraph id="HE5442BEF58474790BB2842C4D1B47459"><enum>(2)</enum><text display-inline="yes-display-inline">Technology, component, and material design
			 of electronics more suitable for disassembly and recycling of rare earth
			 material.</text>
				</paragraph><paragraph id="H427056293D104424B0EDFFFDA04AF06A"><enum>(3)</enum><text display-inline="yes-display-inline">Collection, logistics, and reverse supply
			 chain optimization as related to recycling rare earth materials from
			 electronics.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H4A83DA163D8940E8A5B563C6BBC06465"><enum>(d)</enum><header>Grant
			 requirements</header><text display-inline="yes-display-inline">The Secretary
			 shall issue requirements for applying for grants under the Initiative.</text>
