		<legis-type>A BILL</legis-type>
		<official-title>To amend title 5, United States Code, to deny retirement
		  benefits accrued by an individual as a Member of Congress if such individual is
		  convicted of certain offenses.</official-title>

		<section display-inline="no-display-inline" id="H0756FA2EF25C4E71846C2D00E5C0BDA5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Congressional Integrity and Pension
			 Forfeiture Act of 2011</short-title></quote>.</text>
		</section><section id="HB597B8AC57994A6DB47F408F7030F61E"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds that—</text>
			<paragraph id="H1F55877006E241AB979600D7F53AD50"><enum>(1)</enum><text>Members of Congress
			 pledge to uphold the Constitution and the laws of the United States;</text>
			</paragraph><paragraph id="H87AA661839D44BE68EA481006DF180AB"><enum>(2)</enum><text>Members of
			 Congress and other elected government officials are elected to serve in, and
			 pledge to uphold, the public trust;</text>
			</paragraph><paragraph id="HD3D825C76D0F422F8EB5B3594DE9D8B0"><enum>(3)</enum><text>a
			 breach of the public trust by a Member of Congress or other elected government
			 official is a serious offense that should have serious consequences; and</text>
			</paragraph><paragraph id="H02AD36D06D7C4E2DAEE6C00063766129"><enum>(4)</enum><text>taxpayers should
			 not pay for the congressional retirement benefits of present or former Members
			 of Congress who have been convicted of a felony committed while serving as an
			 elected government official.</text>
			</paragraph></section><section id="HBC8D647B808A442BB5903761A135005B"><enum>3.</enum><header>Application to
			 other elected officials and criminal offenses</header>
			<subsection id="id179053683B6F46FDA841AB31DFB90DF6"><enum>(a)</enum><header>Application to
			 other elected officials</header>
				<paragraph id="idBEADE2405FB24098A6854B248109667A"><enum>(1)</enum><header>Civil Service
			 Retirement System</header><text>Section 8332(o)(2)(A) of title 5, United States
			 Code, is amended—</text>
					<subparagraph id="id6759CA1EEB144262ACACF5C6F6D036EC"><enum>(A)</enum><text>in clause (i), by
			 inserting <quote>, the President, the Vice President, or an elected official of
			 a State or local government</quote> after <quote>Member</quote>; and</text>
					</subparagraph><subparagraph id="idCF70A2678FAD4B92AC2D818243E13364"><enum>(B)</enum><text>in clause (ii),
			 by inserting <quote>, the President, the Vice President, or an elected official
			 of a State or local government</quote> after <quote>Member</quote>.</text>
					</subparagraph></paragraph><paragraph id="idD4FB89FAFE3B4F50BE4E25ED269834EE"><enum>(2)</enum><header>Federal
			 Employees Retirement System</header><text>Section 8411(l)(2) of title 5, United
			 States Code, is amended—</text>
					<subparagraph id="id21EA1637A4864A3E85D6264CA78C3542"><enum>(A)</enum><text>in subparagraph
			 (A), by inserting <quote>, the President, the Vice President, or an elected
			 official of a State or local government</quote> after <quote>Member</quote>;
			 and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDF41A183B4B64C8A8D8AEBE5EA43E89F"><enum>(B)</enum><text>in subparagraph
			 (B), by inserting <quote>, the President, the Vice President, or an elected
			 official of a State or local government</quote> after
			 <quote>Member</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="id6AEDD69321F443A798B7F1D38B86566E"><enum>(b)</enum><header>Criminal
			 offenses</header><text display-inline="yes-display-inline">Section 8332(o)(2)
			 of title 5, United States Code, is amended—</text>
				<paragraph id="idE4342608F6F649D6B453B8109646F117"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (A), by striking clause
			 (iii) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="id4E31503354894E1099F757B41CD55DB7" style="OLC">
						<clause id="ID40dfe48dce154d62b5ea4373ce60ee55"><enum>(iii)</enum><text>The
				offense—</text>
							<subclause id="id3A4FB9B16AB245BD9A12E144BB672A43"><enum>(I)</enum><text>is committed
				after the date of enactment of this subsection and—</text>
								<item id="idE9F8F7F60B624FA7B387796A76A58DE5"><enum>(aa)</enum><text>is
				described under subparagraph (B)(i), (iv), (xvi), (xix), (xxiii), (xxiv), or
				(xxvi); or</text>
								</item><item id="id585FD169B3144AE0B8FA73CE6A87B0ED"><enum>(bb)</enum><text>is
				described under subparagraph (B)(xxvii) or (xxviii), but only with respect to
				an offense described under subparagraph (B)(i), (iv), (xvi), (xix), (xxiii),
				(xxiv), or (xxvi); or</text>
								</item></subclause><subclause id="idC84927ABB40F4864BFC6EC7E9BB8C464"><enum>(II)</enum><text>is committed
				after the date of enactment of the Congressional Integrity and Pension
				Forfeiture Act of 2011 and—</text>
								<item id="idA75C967B3D184F4FBE296CFAC71A19B4"><enum>(aa)</enum><text>is
				described under subparagraph (B)(ii), (iii), (v), (vi), (vii), (viii), (ix),
				(x), (xi), (xii), (xiii), (xiv), (xv), (xvii), (xviii), (xx), (xxi), (xxii), or
				(xxv); or</text>
								</item><item commented="no" display-inline="no-display-inline" id="idC40B42ACBC62446FBFB78CB1944CD59F"><enum>(bb)</enum><text>is described
				under subparagraph (B)(xxvii) or (xxviii), but only with respect to an offense
				described under subparagraph (B)(ii), (iii), (v), (vi), (vii), (viii), (ix),
				(x), (xi), (xii), (xiii), (xiv), (xv), (xvii), (xviii), (xx), (xxi), (xxii), or
				(xxv).</text>
								</item></subclause></clause><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="id36FA75A4F7A049E2A0E6DBB253BFB48E"><enum>(2)</enum><text display-inline="yes-display-inline">by striking subparagraph (B) and inserting
			 the following:</text>
					<quoted-block display-inline="no-display-inline" id="idDA951CD605A14A79AD3EFBEF09E6ADFA" style="OLC">
						<subparagraph id="ID8ac3994d35a647aeb35d15031d5d55d7"><enum>(B)</enum><text>An offense
				described in this subparagraph is only the following, and only to the extent
				that the offense is a felony:</text>
							<clause id="IDff4eff9f60f6400db7f51cc5cead3c06"><enum>(i)</enum><text>An offense under
				section 201 of title 18 (relating to bribery of public officials and
				witnesses).</text>
							</clause><clause id="ID3d75822c379b47f59bbee2ad45ea0011"><enum>(ii)</enum><text>An offense under
				section 203 of title 18 (relating to compensation to Member of Congress,
				officers, and others in matters affecting the Government).</text>
							</clause><clause id="ID6468e0429c8740afa18424375092cd49"><enum>(iii)</enum><text>An offense
				under section 204 of title 18 (relating to practice in the United States Court
				of Federal Claims or the Unites States Court of Appeals for the Federal Circuit
				by Member of Congress).</text>
							</clause><clause id="IDcbd92bd923064c95ab5e0a6c2c7de73b"><enum>(iv)</enum><text>An offense under
				section 219 of title 18 (relating to officers and employees acting as agents of
				foreign principals).</text>
							</clause><clause id="ID620cbabf41334e7dbc75fcec5287538a"><enum>(v)</enum><text>An offense under
				section 286 of title 18 (relating to conspiracy to defraud the Government with
				respect to claims).</text>
							</clause><clause id="IDd574a3b5412d4e6c98c698b6217d9d1c"><enum>(vi)</enum><text>An offense under
				section 287 of title 18 (relating to false, fictitious or fraudulent
				claims).</text>
							</clause><clause id="ID0bb265c9394b44d79e18f333484cc513"><enum>(vii)</enum><text>An offense
				under section 597 of title 18 (relating to expenditures to influence
				voting).</text>
							</clause><clause id="ID412ab01483c04af29dccbd8c54972ed3"><enum>(viii)</enum><text>An offense
				under section 599 of title 18 (relating to promise of appointment by
				candidate).</text>
							</clause><clause id="IDbbc92e417b984c1dafcd4e1daa281fe5"><enum>(ix)</enum><text>An offense under
				section 602 of title 18 (relating to solicitation of political
				contributions).</text>
							</clause><clause id="ID91c874844ee94f459d240a8d8f1fa521"><enum>(x)</enum><text>An offense under
				section 606 of title 18 (relating to intimidation to secure political
				contributions).</text>
							</clause><clause id="IDfba36c40b48d429db00a3415c049ece3"><enum>(xi)</enum><text>An offense under
				section 607 of title 18 (relating to place of solicitation).</text>
							</clause><clause id="ID4e964a1e10a84852974bd482cfdbbb32"><enum>(xii)</enum><text>An offense
				under section 641 of title 18 (relating to public money, property or
				records).</text>
							</clause><clause id="id8C1C5D3DECF74DE8B5726EA9732CD766"><enum>(xiii)</enum><text>An offense
				under section 666 of title 18 (relating to theft or bribery concerning programs
				receiving Federal funds).</text>
							</clause><clause id="ID434ce5fd6a9345a79c02e13e6d71b894"><enum>(xiv)</enum><text>An offense
				under section 1001 of title 18 (relating to statements or entries
				generally).</text>
							</clause><clause id="IDa5e94162bcd3430d93ca2e93b89f72c5"><enum>(xv)</enum><text>An offense under
				section 1341 of title 18 (relating to frauds and swindles, including as part of
				a scheme to deprive citizens of honest services thereby).</text>
							</clause><clause id="IDda105d405dc34ad0876efa8a8817ee98"><enum>(xvi)</enum><text>An offense
				under section 1343 of title 18 (relating to fraud by wire, radio, or
				television, including as part of a scheme to deprive citizens of honest
				services thereby).</text>
							</clause><clause id="ID5970667e84c44a1f96506468d3af5250"><enum>(xvii)</enum><text>An offense
				under section 1503 of title 18 (relating to influencing or injuring officer or
				juror).</text>
							</clause><clause id="id4DA36CDF97B044A9AB541CA8848FF8AA"><enum>(xviii)</enum><text>An offense
				under section 1505 of title 18 (relating to obstruction of proceedings before
				departments, agencies, and committees).</text>
							</clause><clause id="ID964cf1e00f7f4daa83984d460565d821"><enum>(xix)</enum><text>An offense
				under section 1512 of title 18 (relating to tampering with a witness, victim,
				or an informant).</text>
							</clause><clause id="IDd0a3ca108568470dadedfe7f7ef3393b"><enum>(xx)</enum><text>An offense under
				section 1951 of title 18 (relating to interference with commerce by threats of
				violence).</text>
							</clause><clause id="ID7e2ac0dde4c2454b91050ca9dbe1c4e3"><enum>(xxi)</enum><text>An offense
				under section 1952 of title 18 (relating to interstate and foreign travel or
				transportation in aid of racketeering enterprises).</text>
							</clause><clause id="ID29c8cf01a67f46bdad958caed1d66b44"><enum>(xxii)</enum><text>An offense
				under section 1956 of title 18 (relating to laundering of monetary
				instruments).</text>
							</clause><clause id="id7E3920760D8E4DDD860B9333B15D480D"><enum>(xxiii)</enum><text>An offense
				under section 1957 of title 18 (relating to engaging in monetary transactions
				in property derived from specified unlawful activity).</text>
							</clause><clause id="ID1a26846779de4dd2884e17ec359291b0"><enum>(xxiv)</enum><text>An offense
				under chapter 96 of title 18 (relating to racketeer influenced and corrupt
				organizations).</text>
							</clause><clause id="IDc59a974c771047c0b72e1b7e92c819b7"><enum>(xxv)</enum><text>An offense
				under section 7201 of the Internal Revenue Code of 1986 (relating to attempt to
				evade or defeat tax).</text>
							</clause><clause id="ID56924d84b9f446dfa94c5b588914f64a"><enum>(xxvi)</enum><text>An offense
				under section 104(a) of the Foreign Corrupt Practices Act of 1977 (relating to
				prohibited foreign trade practices by domestic concerns).</text>
							</clause><clause id="ID80cbbe0fc6e84b07a380289ae8626fbd"><enum>(xxvii)</enum><text>An offense
				under section 371 of title 18 (relating to conspiracy to commit offense or to
				defraud United States), to the extent of any conspiracy to commit an act which
				constitutes—</text>
								<subclause id="ID956ead13771840fe9454198c87f27a0c"><enum>(I)</enum><text>an offense under
				clause (i), (ii), (iii), (iv), (v), (vi), (vii), (viii), (ix), (x), (xi),
				(xii), (xiii), (xiv), (xv), (xvi), (xvii), (xviii), (xix), (xx), (xxi), (xxii),
				(xxiii), (xxiv), (xxv), or (xxvi); or</text>
								</subclause><subclause id="ID5a5f25e9cdb64d62b2bdd56b58e9c7e8"><enum>(II)</enum><text>an offense under
				section 207 of title 18 (relating to restrictions on former officers,
				employees, and elected officials of the executive and legislative
				branches).</text>
								</subclause></clause><clause id="IDeca56f6a6d14488fa3de4488af9a1ce6"><enum>(xxviii)</enum><text>Perjury
				committed under section 1621 of title 18 in falsely denying the commission of
				an act which constitutes—</text>
								<subclause id="ID6f28f5b3de6446aaabf529261ec3b2cb"><enum>(I)</enum><text>an offense under
				clause (i), (ii), (iii), (iv), (v), (vi), (vii), (viii), (ix), (x), (xi),
				(xii), (xiii), (xiv), (xv), (xvi), (xvii), (xviii), (xix), (xx), (xxi), (xxii),
				(xxiii), (xxiv), (xxv), or (xxvi); or</text>
								</subclause><subclause id="ID4f98b0b7783f43bdbf3a1cb801840b7e"><enum>(II)</enum><text>an offense under
				clause (xxvii), to the extent provided in such clause.</text>
								</subclause></clause><clause id="ID5c237f4a626546238ce86c93053e1245"><enum>(xxix)</enum><text>Subornation of
				perjury committed under section 1622 of title 18 in connection with the false
				denial or false testimony of another individual as specified in clause
				(xxviii).</text>
