			 purposes of this Act, the term <term>congressional defense committees</term>
			 has the meaning given that term in section 101(a)(16) of title 10, United
			 States Code.</text>
		</section><section commented="no" display-inline="no-display-inline" id="id23F21C71D9A4452BA97D07C1FA1CBFA5" section-type="subsequent-section"><enum>4.</enum><header>Scoring of budgetary
			 effects</header><text display-inline="no-display-inline">The budgetary effects
			 of this Act, for the purpose of complying with the Statutory Pay-As-You-Go-Act
			 of 2010, shall be determined by reference to the latest statement titled
			 <quote>Budgetary Effects of PAYGO Legislation</quote> for this Act, submitted
			 for printing in the Congressional Record by the Chairman of the Senate Budget
			 Committee, provided that such statement has been submitted prior to the vote on
			 passage.</text>

	<legis-body display-enacting-clause="no-display-enacting-clause">
		<division id="idE5A233CCDFA648AB93A144DE981057E7"><enum>B</enum><header>Military
			 Construction Authorizations</header>
			<section id="ID78521421252441cf8553926eb8ed0b65"><enum>2001.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This division may be
			 cited as the <quote><short-title>Military Construction
			 Authorization Act for Fiscal Year 2012</short-title></quote>.</text>
			</section><section id="ID7fa35372951e4221be96fb242b1fee57"><enum>2002.</enum><header>Expiration of
			 authorizations and amounts required to be specified by law</header>
				<subsection id="IDddb57a138d56487e8ca5b8d88b34b501"><enum>(a)</enum><header>Expiration of
			 authorizations after three years</header><text>Except as provided in subsection
			 (b), all authorizations contained in titles XXI through XXVII for military
			 construction projects, land acquisition, family housing projects and
			 facilities, and contributions to the North Atlantic Treaty Organization
			 Security Investment Program (and authorizations of appropriations therefor)
			 shall expire on the later of—</text>
					<paragraph id="ID42c1a6f950c843708ad5a93fb175c8a7"><enum>(1)</enum><text>October 1, 2014;
			 or</text>
					</paragraph><paragraph id="IDe6b468f686cc47c3a7810b1d05dc4fe6"><enum>(2)</enum><text>the date of the
			 enactment of an Act authorizing funds for military construction for fiscal year
			 2015.</text>
					</paragraph></subsection><subsection id="IDd7ea2de7c75b4aa5aee078291a454c8e"><enum>(b)</enum><header>Exception</header><text>Subsection
			 (a) shall not apply to authorizations for military construction projects, land
			 acquisition, family housing projects and facilities, and contributions to the
			 North Atlantic Treaty Organization Security Investment Program (and
			 authorizations of appropriations therefor), for which appropriated funds have
			 been obligated before the later of—</text>
					<paragraph id="IDbfd6775891f6464389354ebce1390234"><enum>(1)</enum><text>October 1, 2014;
			 or</text>
					</paragraph><paragraph id="ID56110290f22e49afa11aa586dc94b5b4"><enum>(2)</enum><text>the date of the
			 enactment of an Act authorizing funds for fiscal year 2015 for military
			 construction projects, land acquisition, family housing projects and
			 facilities, or contributions to the North Atlantic Treaty Organization Security
			 Investment Program.</text>
					</paragraph></subsection></section><section id="id8650D50970CF4AF5984EECA396CEE294"><enum>2003.</enum><header>Funding
			 tables</header>
				<subsection id="IDf51c19a7a10747b6bcf751e186c9ff92"><enum>(a)</enum><header>In
			 general</header><text>The amounts authorized to be appropriated by sections
			 2104, 2204, 2304, 2403, 2411, 2502, and 2606 shall be available in the amounts
			 specified in the funding table in section 4501.</text>

			 and realignment activities</header><text>The amounts authorized to be
			 appropriated by section 2703 shall be available in the amounts specified in the

			 United States</header><text>Using amounts appropriated pursuant to the
			 authorization of appropriations in section 2104(1), the Secretary of the Army
			 may acquire real property and carry out military construction projects for the
			 installations or locations inside the United States, and in the amounts, set
			 forth in the following table:</text>

					</subsection></section><section id="IDe5191e17ac7c46ed96cb74aa7d6c9de7"><enum>2103.</enum><header>Improvements
			 to military family housing units</header><text display-inline="no-display-inline">Subject to section 2825 of title 10, United
			 States Code, and using amounts appropriated pursuant to the authorization of
			 appropriations in section 2104(5)(A), the Secretary of the Army may improve
			 existing military family housing units in an amount not to exceed
			 $103,000,000.</text>
				</section><section id="IDe87ee04872a24b54a770e5e800a2a963"><enum>2104.</enum><header>Authorization
			 of appropriations, Army</header><text display-inline="no-display-inline">Funds
			 are hereby authorized to be appropriated for fiscal years beginning after
			 September 30, 2011, for military construction, land acquisition, and military
			 family housing functions of the Department of the Army in the total amount of
			 $3,748,646,000, as follows:</text>

			 construction projects outside the United States authorized by section 2101(b),
			 $334,400,000.</text>
					</paragraph><paragraph id="ID15e7d52c0372447299607dae3e2a8398"><enum>(3)</enum><text>For unspecified
			 minor military construction projects authorized by section 2805 of title 10,
			 United States Code, $20,000,000.</text>

			 construction of increment 1 of an aviation complex, phase 3A at Fort

					</paragraph></section><section id="IDc4cbf3d91992424aaa463048f091e8ab"><enum>2105.</enum><header>Modification
			 of authority to carry out certain fiscal year 2009 project</header><text display-inline="no-display-inline">In the case of the authorization contained
			 in the table in section 2101(a) of the Military Construction Authorization Act
			 for Fiscal Year 2009 (division B of Public Law 110–417; 122 Stat. 4658) for
			 Fort Benning, Georgia, for construction of a Multipurpose Training Range at the
			 installation, the Secretary of the Army may construct up to 1,802 square feet
			 of loading dock consistent with the Army’s construction guidelines for
			 Multipurpose Training Ranges.</text>
				</section><section id="id9D384BEFFDE64A9AB5FFB02B2BAA1477"><enum>2106.</enum><header>Modification
			 of authority to carry out certain fiscal year 2010 project</header><text display-inline="no-display-inline">In the case of the authorization contained
			 in the table in section 2101(a) of the Military Construction Authorization Act
			 for Fiscal Year 2010 (division B of Public Law 111–84; 123 Stat. 2629) for
			 Joint Base Lewis-McChord, Washington, for construction of an access road
			 adjoining McChord Air Force Base and Fort Lewis, the Secretary of the Army may
			 construct a secure elevated roadway over the existing railroad and public road
			 in lieu of an on-grade road and access control point.</text>
				</section><section id="ID12550872c1384f29a3e3f30d2e7865c0"><enum>2107.</enum><header>Modification
			 of authority to carry out certain fiscal year 2011 projects</header>
					<subsection id="IDf97d229d13064918acea35ac4403adfa"><enum>(a)</enum><header>Hawaii</header><text>In
			 the case of the authorization contained in the table in section 2101(a) of the
			 Military Construction Authorization Act for Fiscal Year 2011 (division B of
			 Public Law 111–383; 124 Stat. 4437) for Schofield Barracks, Hawaii, for
			 renovations of buildings 450 and 452, the Secretary of the Army may renovate
			 building 451 in lieu of building 452.</text>
					</subsection><subsection id="ID9010f62d7bf044eba7c8a2e713c1d7a6"><enum>(b)</enum><header>New
			 York</header><text>In the case of the authorization contained in the table in
			 section 2101(a) of the Military Construction Authorization Act for Fiscal Year
			 2011 (division B of Public Law 111–383; 124 Stat. 4437) for Fort Drum, New
			 York, for construction of an Aircraft Maintenance Hangar at the installation,
			 the Secretary of the Army may construct up to 39,049 square yards of parking
			 apron consistent with the Army’s construction guidelines for Aircraft
			 Maintenance Hangars and associated parking aprons.</text>
					</subsection><subsection id="ID3a3884e9d9e64ad79052236cbd951544"><enum>(c)</enum><header>Germany</header><text>In
			 the case of the authorization contained in the table in section 2101(b) of the
			 Military Construction Authorization Act for Fiscal Year 2011 (division B of
			 Public Law 111–383; 124 Stat. 4438) for Wiesbaden Air Base, Germany, for
			 construction of an Information Processing Center at the installation, the
			 Secretary of the Army may construct up to 9,400 square yards of vehicle parking
			 garage consistent with the Army’s construction guidelines for parking garages,
			 in lieu of renovating 9,400 square yards of parking area.</text>
					</subsection></section><section id="ID35c570befa8842faa8d911fb6f467b0f"><enum>2108.</enum><header>Additional
			 authority to carry out certain fiscal year 2012 project</header>
					<subsection id="ID2c40f825ee244f9a89b3101420715240"><enum>(a)</enum><header>Project
			 authorization</header><text>The Secretary of the Army may carry out a military
			 construction project to construct a water treatment facility for Fort Irwin,
			 California, in the amount of $115,000,000.</text>
					</subsection><subsection id="ID59105b8c6d884236811b2dce66b5a8f3"><enum>(b)</enum><header>Use of
			 unobligated prior-year army military construction funds</header><text>The
			 Secretary may use available, unobligated Army military construction funds
			 appropriated for a fiscal year before fiscal year 2012 for the project
			 described in subsection (a).</text>
					</subsection><subsection id="IDa92e378176bc4709aeeb88ccaf816d48"><enum>(c)</enum><header>Congressional
			 notification</header><text>The Secretary of the Army shall provide information
			 in accordance with section 2851(c) of title 10, United States Code, regarding
			 the project described in subsection (a). If it becomes necessary to exceed the
			 estimated project cost, the Secretary shall utilize the authority provided by
			 section 2853 of such title regarding authorized cost and scope of work
			 variations.</text>
					</subsection></section><section id="ID1ef878bacb8e459c88da1adb10cdab83"><enum>2109.</enum><header>Extension of
			 authorizations of certain fiscal year 2008 projects</header>
					<subsection id="ID121e1197f15043d99cc6c9ba3c7f7dbb"><enum>(a)</enum><header>Extension</header><text>Notwithstanding
			 section 2002 of the Military Construction Authorization Act for Fiscal Year
			 2008 (division B of Public Law 110–181; 122 Stat. 503), authorizations set
			 forth in the table in subsection (b), as provided in section 2101 of that Act
			 (122 Stat. 504), shall remain in effect until October 1, 2012, or the date of
			 the enactment of an Act authorizing funds for military construction for fiscal
			 year 2013, whichever is later.</text>

			 for tour normalization until—</text>

			 Cost Assessment and Program Evaluation conducts an analysis of alternatives to
			 tour normalization that identifies alternative courses of action and their
			 associated life cycle costs, potential benefits, advantages, and
			 disadvantages;</text>
					</paragraph><paragraph id="id689C67EE052F4F72A84DC13DF7009A59"><enum>(2)</enum><text display-inline="yes-display-inline">the Secretary of the Army submits to the
			 congressional defense committees a master plan for completing all phases of

				</section></title><title id="idB9A4AA7415AB4D88B09003D3FDA79963"><enum>XXVIII</enum><header>Military
			 Construction General Provisions</header>
				<subtitle id="id15549E1F561E46F39D7741FC63F12B4C"><enum>A</enum><header>Military
			 Construction Program and Military Family Housing Changes</header>
					<section id="id324D00E2B6E940EBBF2F60C24C2572CF"><enum>2801.</enum><header>General
			 military construction transfer authority</header>
						<subsection id="idE8C816EBD70E4F51B1C9ACE7C59E12C0"><enum>(a)</enum><header>Authority to
			 transfer authorization of appropriations</header>
							<paragraph id="idC41D2332465C416C88576371E1196547"><enum>(1)</enum><header>Authority</header><text>Upon
			 a determination by the Secretary of a military department, or with respect to
			 the Defense Agencies, the Secretary of Defense, that such action is necessary
			 in the national interest, the Secretary concerned may transfer amounts of
			 authorization of appropriations made available to that military department or
			 Defense Agency in this division for fiscal year 2012 between any such
			 authorization of appropriations for that military department or Defense Agency
			 for that fiscal year. Amounts of authorization of appropriations so transferred
			 shall be merged with and be available for the same purposes as the
			 authorization of appropriations to which transferred.</text>
							</paragraph><paragraph id="idDCB1273FE6174576971CADEA7E8EF297"><enum>(2)</enum><header>Aggregate
			 limit</header><text>The aggregate amount of authorizations that the Secretaries
			 concerned may transfer under the authority of this section may not exceed
			 $400,000,000.</text>
							</paragraph></subsection><subsection id="id99CA993A7F294CE3980260CCFA26F0E7"><enum>(b)</enum><header>Limitation</header><text>The
			 authority provided by this section to transfer authorizations may only be used
			 to fund increases in the cost of military construction projects that have been
			 authorized by law.</text>
						</subsection><subsection id="idCC516F550D114F62932432A65A72B357"><enum>(c)</enum><header>Effect on
			 authorization amounts</header><text>A transfer made from one account to another
			 under the authority of this section shall be deemed to increase the amount
			 authorized for appropriation for the account to which the amount is transferred
			 by an amount equal to the amount transferred.</text>
						</subsection><subsection id="id2717DA3BEE294880A208F10F8162A511"><enum>(d)</enum><header>Notice to
			 Congress</header><text>The Secretary concerned shall promptly notify the
			 congressional defense committees of each transfer made by that Secretary under
			 subsection (a).</text>
						</subsection></section><section id="IDd6425207724b4e10a5fe5d7ed463eae5"><enum>2802.</enum><header>Extension of
			 temporary, limited authority to use operation and maintenance funds for
			 construction projects outside the United States</header>
						<subsection id="IDa28921b2a9b64d4fbdb0c341914cd67d"><enum>(a)</enum><header>One-year
			 extension of authority</header><text>Section 2808 of the Military Construction
			 Authorization Act for Fiscal Year 2004 (division B of Public Law 108–136; 117
			 Stat. 1723), as most recently amended by section 2804 of the Military
			 Construction Authorization Act for Fiscal Year 2011 (division B of Public Law
			 111–383; 124 Stat. 4459), is amended—</text>
							<paragraph id="ID05d6cbfdf35248899b9f71f9264a7680"><enum>(1)</enum><text>in subsection
			 (c)(2), by striking <quote>fiscal year 2011</quote> and inserting <quote>fiscal

				title 31, an agreement under this section that is a cooperative agreement or a
				grant may be used to acquire property or services for the direct benefit or use
				of the United States
				Government.</text>
								</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
						</subsection><subsection id="IDfe35a33977b645cd8c3b34ce7c11694e"><enum>(b)</enum><header>Acquisition and
			 acceptance of property and interests</header><text>Subsection (d) of such
			 section is amended—</text>
							<paragraph id="ID06da47c8a56f4205830c5f2bd317a636"><enum>(1)</enum><text>in paragraph
			 (3)—</text>

				by the eligible entity in an interest-bearing account, and any interest shall
				be applied for the same purposes as the

								</subparagraph></paragraph><paragraph id="IDc49750c9d60b441994bb436cb7a1f2c6"><enum>(2)</enum><text>in paragraph
			 (5)—</text>
								<subparagraph id="ID37326fc2dfaa4b28b9808e16afb91ae4"><enum>(A)</enum><text>inserting
			 <quote>(A)</quote> after <quote>(5)</quote>;</text>
								</subparagraph><subparagraph id="ID6290e03ddcd34c268f713feea79f13bb"><enum>(B)</enum><text>by inserting
			 after the first sentence the following: <quote>No such requirement need be
			 included in the agreement if the property or interest is being transferred to a
			 State, or the agreement requires it to be subsequently transferred to a State,
			 and the Secretary concerned determines that the laws and regulations applicable
			 to the future use of such property or interest provide adequate assurance that
			 the property concerned will be developed and used in a manner appropriate for
			 purposes of this section.</quote>; and</text>
								</subparagraph><subparagraph id="id462E4AD475F94C38BB03FA4CA6A9DA88"><enum>(C)</enum><text>by adding at the
			 end the following new subparagraph:</text>
									<quoted-block display-inline="no-display-inline" id="idD2F60E411B644EE88DA93C4C1B4907AE" style="OLC">
										<subparagraph id="id752B2036B09041D3B0A1A3AB65392E74" indent="up2"><enum>(B)</enum><text>Notwithstanding subparagraph (A), if
				all or a portion of the property or interest acquired under the agreement is
				subsequently transferred to the United States and administrative jurisdiction
				over the property is under a Federal official other than a Secretary concerned,
				the Secretary concerned and that Federal official shall enter into a memorandum
				of agreement providing, to the satisfaction of the Secretary concerned, for the
				management of the property or interest concerned in a manner appropriate for
				purposes of this section. Such memorandum of agreement shall also provide that,
				should it be proposed that the property or interest concerned be developed or
				used in a manner not appropriate for purposes of this section, including
				declaring the property to be excess to the agency’s needs or proposing to
				exchange the property for other property, the Secretary concerned may request
				that administrative jurisdiction over the property be transferred to the
				Secretary concerned at no cost, and, upon such a request being made, the
				administrative jurisdiction over the property shall be transferred
				accordingly.</text>
										</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
								</subparagraph></paragraph></subsection></section><section id="IDee17aaff55d64ec5b814fbbbc4306f3e"><enum>2813.</enum><header>Department of
			 Defense conservation and cultural activities</header><text display-inline="no-display-inline">Section 2694(b)(2) of title 10, United
			 States Code, is amended—</text>
						<paragraph id="ID5c31b52cc4e24b4f9a0dab837a18def3"><enum>(1)</enum><text>in subparagraph
			 (B), by inserting <quote>and sustainability</quote> after
			 <quote>safety</quote>; and</text>

				encompasses at least two non-contiguous military installations, if those
				military installations are not all under the administrative jurisdiction of the
				same Secretary of a military department; and</text>
									</clause><clause id="IDdd31bc4e51344f6793ebb3e0ebaf7c66"><enum>(ii)</enum><text>providing synergistic benefits
				unavailable if the installations acted
				separately.</text>
									</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></section></subtitle><subtitle id="idD8B9A97C736B411FBA78A9F8CF5ECE4C"><enum>C</enum><header>Land
			 Conveyances</header>

			 Joseph T. Robinson, Arkansas</header><text display-inline="no-display-inline">Section 2852 of the Military Construction
			 Authorization Act for Fiscal Year 2010 (division B of Public Law 111–84; 123
			 Stat. 2685) is amended by striking <quote>to be acquired by the United States
			 of America</quote> and inserting <quote>to be acquired by the Military
			 Department of Arkansas</quote>.</text>
					</section><section id="idF27CEE5A61BD47E493B84C5290223DD2"><enum>2822.</enum><header>Clarification
			 of land conveyance authority, Camp Caitlin and Ohana Nui areas,
			 Hawaii</header><text display-inline="no-display-inline">Section 2856(a) of the
			 Military Construction Authorization Act for Fiscal Year 2010 (division B of
			 Public Law 111–84; 123 Stat. 2689) is amended by inserting before the period at
			 the end the following: <quote>, before the property or portion thereof is made
			 available for transfer pursuant to the Hawaiian Home Lands Recovery Act (title
			 II of Public Law 104–42; 109 Stat. 357), for use by any other Federal agency,
			 or for disposal under applicable laws</quote>.</text>
					</section></subtitle><subtitle id="id061E2F82B0624BD8998A80EBDC9F717A"><enum>D</enum><header>Other
			 Matters</header>
					<section id="idB85781C98B30431D91A7B1BE953BC0E6"><enum>2831.</enum><header>Investment
			 plan for the modernization of public shipyards under jurisdiction of Department
			 of the Navy</header>
						<subsection id="id0E90D6A560FF4840838640001AC17E31"><enum>(a)</enum><header>Plan
			 Required</header><text>Not later than March 1, 2012, the Secretary of the Navy
			 shall submit to the congressional defense committees a plan to address the
			 facilities and infrastructure requirements at each public shipyard under the
			 jurisdiction of the Department of the Navy.</text>
						</subsection><subsection id="id0705BFE7F07742E6B69E99F80C00CC2B"><enum>(b)</enum><header>Content</header><text>The
			 report required under subsection (a) shall include the following
			 elements:</text>
							<paragraph id="id8A392551121549E4A4E8F3E335E64834"><enum>(1)</enum><text>A description of
			 the operations and support required at each shipyard under the control of the
			 Secretary, including the location, year constructed, the classes of ships
			 serviced, number of personnel assigned, and the average age of facilities at
			 each location.</text>
							</paragraph><paragraph id="id7CD0DBA20654476EB53A0BCD70510733"><enum>(2)</enum><text>A review of all
			 workload requirements in the past 5 years, an assessment of the efficiency in
			 the use of existing facilities to meet the workload, and an estimate of the
			 workload planned for each shipyard through the current Future Years Defense
			 plan.</text>
							</paragraph><paragraph id="idA75762C472884BA9BBAE50CE078E0E08"><enum>(3)</enum><text>An assessment of
			 the adequacy of each facility—</text>
								<subparagraph id="id956ACA5FC2734BFA8DCFD2FFDCDB67C4"><enum>(A)</enum><text>to carry out
			 efficient depot-level ship maintenance with modern technology and
			 equipment;</text>
								</subparagraph><subparagraph id="idB42A0F5177F14BD6B8D4746D40744A68"><enum>(B)</enum><text>to ensure
			 workplace safety;</text>
								</subparagraph><subparagraph id="id9A630C5C7CAD4467A598B8D3A6888760"><enum>(C)</enum><text>to support
			 nuclear-related activities (where applicable);</text>
								</subparagraph><subparagraph id="id6C9381F8ACA44490BFDDACB3A577CA0C"><enum>(D)</enum><text>to maintain the
			 quality of life of the workforce; and</text>
								</subparagraph><subparagraph id="id2820024E4B1542BBB49865962385D721"><enum>(E)</enum><text>to meet the
			 energy savings goals of the Secretary of the Navy for military
			 installations.</text>
								</subparagraph></paragraph><paragraph id="id6FD84201402F4CFAADFFD018FDD694A4"><enum>(4)</enum><text>An assessment of
			 the existing condition of each facility at each shipyard to include a review of
			 existing and projected deficiencies or inadequate conditions at each facility,
			 and whether any of the facilities listed are temporary structures.</text>
							</paragraph><paragraph id="id4F9986A08BB74617A764FE6CA2F0F2C7"><enum>(5)</enum><text>A description and
			 cost estimate for each project to improve, repair, renovate, or modernize
			 facilities or infrastructure.</text>
							</paragraph><paragraph id="id782106EE60A247C7BF18B10028B00916"><enum>(6)</enum><text>A description of
			 the facility improvements or new construction projects at each shipyard that
			 would improve the efficiency of the facility’s operations or generate energy
			 savings based upon a business case analysis.</text>
							</paragraph><paragraph id="id60A8C69330CD44428D193F490F688C5C"><enum>(7)</enum><text>An investment
			 strategy planned for each shipyard to correct deficiencies identified in
			 paragraph (4), including timelines to complete each project and cost estimates
			 and timelines necessary to complete the projects identified in paragraph
			 (6).</text>
							</paragraph><paragraph id="idBC221EBE94594B9DA50F26FD8BF14395"><enum>(8)</enum><text>A list of
			 projects, costs, and timelines through the future years defense plan to meet
			 the requirements of the minimum capital investment percentage required under
			 section 2476 of title 10, United States Code.</text>
							</paragraph></subsection></section><section id="id77DE6A3840D64539B8AEDAE5989D70F1"><enum>2832.</enum><header>Data servers
			 and centers</header>
						<subsection id="id051C4DA60C784A2883B9FCBE05EBA5E5"><enum>(a)</enum><header>Limitations on
			 obligation of funds</header>
							<paragraph id="idBC98E151852F4DA5BFECD7CC1EDC3B35"><enum>(1)</enum><header>Limitations</header>
								<subparagraph id="id0642DE723EF14DE2BA45310725F5F8FA"><enum>(A)</enum><header>Before
			 performance plan</header><text>During the period beginning on the date of the
			 enactment of this Act and ending on May 1, 2012, a department, agency, or
			 component of the Department of Defense may not obligate funds for a data
			 server, data server upgrade, data server farm, or data center unless approved
			 by the Chief Information Officer of the Department of Defense or the Chief
			 Information Officer of a component of the Department to whom the Chief
			 Information Officer of the Department has specifically delegated such approval
			 authority.</text>
								</subparagraph><subparagraph id="id2A64A0B27679486786CC2775CA17BED5"><enum>(B)</enum><header>Under
			 performance plan</header><text>After May 1, 2012, a department, agency, or
			 component of the Department may not obligate funds for a data center, or any
			 information systems technology used therein, unless that obligation is in
			 accordance with the performance plan required by subsection (b) and is approved
			 as described in subparagraph (A).</text>
								</subparagraph></paragraph><paragraph id="id77D51FFA277F43DF9E2B34F372D4C0F7"><enum>(2)</enum><header>Requirements
			 for approvals</header>
								<subparagraph id="idF07E773EDB2048E5A75285D3B5C6C4D8"><enum>(A)</enum><header>Before
			 performance plan</header><text>An approval of the obligation of funds may not
			 be granted under paragraph (1)(A) unless the official granting the approval
			 determines, in writing, that existing resources of the agency, component, or
			 element concerned cannot affordably or practically be used or modified to meet
			 the requirements to be met through the obligation of funds.</text>
								</subparagraph><subparagraph id="idEEF800F02802465FB2698A9A7EA972EB"><enum>(B)</enum><header>Under
			 performance plan</header><text>An approval of the obligation of funds may not
			 be granted under paragraph (1)(B) unless the official granting the approval
			 determines that—</text>
									<clause id="id14F21D4D1A8A4962AEFAE604B253B9EB"><enum>(i)</enum><text>existing
			 resources of the Department do not meet the operation requirements to be met
			 through the obligation of funds; and</text>
									</clause><clause id="id0C5F89BD473E4D6D9945D168AEDBD7F8"><enum>(ii)</enum><text>the proposed
			 obligation is in accordance with the performance standards and measures
			 established by the Chief Information Officer of the Department under subsection
			 (b).</text>
									</clause></subparagraph></paragraph><paragraph id="idEC0807ACF21B453DBFF800A35F851B66"><enum>(3)</enum><header>Reports</header><text>Not
			 later than 30 days after the end of each calendar quarter, each Chief
			 Information Officer of a component of the Department who grants an approval
			 under paragraph (1) during such calendar quarter shall submit to the Chief
			 Information Officer of the Department a report on the approval or approvals so
			 granted during such calendar quarter.</text>
							</paragraph></subsection><subsection id="idF2F83E235E9B4B8F8D1D1E922244D90A"><enum>(b)</enum><header>Performance
			 plan for reduction of resources required for data servers and centers</header>
							<paragraph id="idB4188749D32E47C88A5905DCCCFF4C18"><enum>(1)</enum><header>Component
			 plans</header>
								<subparagraph id="idC7D79E036CE948C29EC1BFB478D66459"><enum>(A)</enum><header>In
			 general</header><text>Not later than January 15, 2012, the Secretaries of the
			 military departments and the heads of the Defense Agencies shall each submit to
			 the Chief Information Officer of the Department a plan for the department or
			 agency concerned to achieve the following:</text>
									<clause id="id5F2EBA8F312D4712B45F7353C74775B3"><enum>(i)</enum><text>A
			 reduction in the square feet of floor space devoted to information systems
			 technologies, attendant support technologies, and operations within data
			 centers.</text>
									</clause><clause id="id3EDD63B96FBF4A34B4A61FA8EA4206C4"><enum>(ii)</enum><text>A
			 reduction in the use of all utilities necessary to power and cool information
			 systems technologies and data centers.</text>
									</clause><clause id="idD8CCBBDC20FF41888E693959B8F07647"><enum>(iii)</enum><text>An increase in
			 multi-organizational utilization of data centers, information systems
			 technologies, and associated resources.</text>
									</clause><clause id="idF5DCFB53D770470F94C325B67E4A0D23"><enum>(iv)</enum><text>An
			 increase in virtualization of data servers.</text>
									</clause><clause id="idC0772BBA889E4D1491D3C265F3A52B04"><enum>(v)</enum><text>A
			 reduction in the number of commercial and government developed applications
			 running on data servers and within data centers.</text>
									</clause><clause id="id1A4774BF357A4A199EF6141C03344D6F"><enum>(vi)</enum><text>A
			 reduction in the number of government and vendor provided full-time equivalent
			 personnel, and in the cost of labor, associated with the operation of data
			 servers and data centers.</text>
									</clause></subparagraph><subparagraph id="idF451944E132E4532B0D311B950A57A4A"><enum>(B)</enum><header>Specification
			 of required elements</header><text>The Chief Information Officer of the
			 Department shall specify the particular performance standards and measures and
			 implementation elements to be included in the plans submitted under this
			 paragraph, including specific goals and schedules for achieving the matters
			 specified in subparagraph (A).</text>
								</subparagraph></paragraph><paragraph id="id2120DB3A17954375AEC9CE8FAD6E1727"><enum>(2)</enum><header>Defense-wide
			 plan</header>
								<subparagraph id="id5992F212E1AF45B3BC74CA4D8B500320"><enum>(A)</enum><header>In
			 general</header><text>Not later than April 1, 2012, the Chief Information
			 Officer of the Department shall submit to the congressional defense committees
			 a performance plan for a reduction in the resources required for data centers
			 and information systems technologies Department-wide. The plan shall be based
			 upon and incorporate appropriate elements of the plans submitted under
			 paragraph (1).</text>
								</subparagraph><subparagraph id="id108215D5951040DB9CF0F1001B124429"><enum>(B)</enum><header>Elements</header><text>The
			 performance plan required under this paragraph shall include the
			 following:</text>
									<clause id="id84EB412025C24D18B7903F1EEC697026"><enum>(i)</enum><text>A
			 Department-wide performance plan for achieving the matters specified in
			 paragraph (1)(A), including performance standards and measures for data centers
			 and information systems technologies, goals and schedules for achieving such
			 matters, and an estimate of cost savings anticipated through implementation of
			 the plan.</text>
									</clause><clause id="id565C9D37186D45588C69BE2A012246AE"><enum>(ii)</enum><text>A
			 Department-wide strategy for each of the following:</text>
										<subclause id="idE38A6DDE1FA646A79EF07ADC5EB60CCD"><enum>(I)</enum><text>Desktop, laptop,
			 and mobile device virtualization.</text>
										</subclause><subclause id="id1F3927164889433794EC200E8E64FCE3"><enum>(II)</enum><text>Transitioning to
			 cloud computing through data center virtualization and consolidation.</text>
										</subclause><subclause id="id1326713CF1C846A8BD2B897171B7007C"><enum>(III)</enum><text>Migration of
			 Defense data and government-provided services from Department-owned and
			 operated data centers to cloud computing services generally available within
			 the private sector.</text>
										</subclause><subclause id="id456DB9EB88AF4D6BB52D494CD8074070"><enum>(IV)</enum><text>Utilization of
			 private sector-managed security services for data centers and cloud computing
			 services.</text>
										</subclause></clause></subparagraph></paragraph><paragraph id="id7FE3A2AC6F094A52B22D1424944016E1"><enum>(3)</enum><header>Responsibility</header><text>The
			 Chief Information Officer of the Department shall discharge the responsibility
			 for establishing performance standards and measures for data centers and
			 information systems technologies for purposes of this subsection. Such
			 responsibility may not be delegated.</text>
							</paragraph></subsection><subsection id="id5171C87EF6C441828ED8801B6E223412"><enum>(c)</enum><header>Exception</header><text>The
			 Chief Information Officer of the Department and the Chief Information Officer
			 of the Office of the Director of National Intelligence may jointly exempt from
			 the applicability of this section such intelligence components of the
			 Department of Defense (and the programs and activities thereof) that are funded
			 through the National Intelligence Program (NIP) as the Chief Information
			 Officers consider appropriate.</text>
						</subsection><subsection id="id1B76285145D54152AA352B30B53C37FF"><enum>(d)</enum><header>Reports on cost
			 savings</header>
							<paragraph id="id515A639B5A624B2D92910C8ACB91CA53"><enum>(1)</enum><header>In
			 general</header><text>Not later than March 1 of each fiscal year, and ending in
			 fiscal year 2016, the Chief Information Officer of the Department shall submit
			 to the appropriate committees of Congress a report on the cost savings, cost
			 reductions, cost avoidances, and performance gains achieved, and anticipated to
			 be achieved, as of the date of such report as a result of activities undertaken
			 under this section.</text>
							</paragraph><paragraph id="id7200A4C54E4842A6B550A21421D6C16B"><enum>(2)</enum><header>Appropriate
			 committees of Congress defined</header><text>In this subsection, the term
			 <term>appropriate committees of Congress</term> means—</text>
								<subparagraph id="id49F8471263DC4A2E91D9F8A410E023FB"><enum>(A)</enum><text>the Committee on
			 Armed Services, the Committee on Appropriations, and the Select Committee on
			 Intelligence of the Senate; and</text>
								</subparagraph><subparagraph id="idD7125EC1DB434612A28A8096C9DF6FF8"><enum>(B)</enum><text>the Committee on
			 Armed Services, the Committee on Appropriations, and the Permanent Select
			 Committee on Intelligence of the House of Representatives.</text>
								</subparagraph></paragraph></subsection></section></subtitle></title></division></legis-body>
