			 <quote><short-title>Second Chance Reauthorization Act of
			 2011</short-title></quote>.</text>
		</section><section changed="deleted" committee-id="SSJU00" id="id717AA17CF07A433E9005E9453D9013E2" reported-display-style="strikethrough"><enum>2.</enum><header>Improvements to
			 existing programs</header>
			<subsection id="id8C4E8E496C2F4EA0A3AA3CEA8AB6E962"><enum>(a)</enum><header>Reauthorization
			 of adult and juvenile offender State and local demonstration
			 projects</header><text>Section 2976 of title I of the Omnibus Crime Control and
			 Safe Streets Act of 1968 (42 U.S.C. 3797w) is amended—</text>
				<paragraph id="id9BC898287004467F8992B1387DF4B52C"><enum>(1)</enum><text>by striking
			 subsection (a) and inserting the following:</text>
					<quoted-block changed="deleted" committee-id="SSJU00" display-inline="no-display-inline" id="id140916ED573A427E8A2E060FC4C52EDE" reported-display-style="strikethrough" style="OLC">
						<subsection id="id8C54B2A1711A45668DA5656611B8B6E4"><enum>(a)</enum><header>Grant
				authorization</header><text>The Attorney General shall make grants to States,
				local governments, territories, or Indian tribes, or any combination thereof
				(in this section referred to as an <term>eligible entity</term>), in
				partnership with stakeholders, services providers, and nonprofit organizations
				for the purpose of strategic planning and implementation of adult and juvenile
				offender reentry
				projects.</text>
						</subsection><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="id60750E68E7A346C6BC0B45EAF98689BE"><enum>(2)</enum><text>by striking
			 subsections (d), (e), and (f) and inserting the following:</text>
					<quoted-block changed="deleted" committee-id="SSJU00" display-inline="no-display-inline" id="idEC31BB8FED654875A8BC6A7610A49409" reported-display-style="strikethrough" style="OLC">
						<subsection id="id1B8340D7127A4BCB8F84BD46F2735735"><enum>(d)</enum><header>Combined grant
				application</header><text>The Attorney General shall develop a procedure to
				allow applicants to submit a single application for a planning grant under
				subsection (e) and an implementation grant under subsection (f).</text>
						</subsection><subsection id="idBB6C63934EBD4E5FB732A7B202CEB27A"><enum>(e)</enum><header>Planning
				grants</header>
							<paragraph id="id1672DBACEE6F445398B6DC721AAD5831"><enum>(1)</enum><header>In
				general</header><text>Except as provided in paragraph (3), the Attorney General
				may make a grant to an eligible entity of not more than $75,000 to develop a
				strategic, collaborative plan for an adult or juvenile offender reentry
				demonstration project as described in subsection (h) that includes—</text>
								<subparagraph id="idF2E8F8ECB6D848E7A5BDE8CBC5C3DB9B"><enum>(A)</enum><text>a budget and a
				budget justification;</text>
								</subparagraph><subparagraph id="id2E728018F39E4C4496D22945340527D2"><enum>(B)</enum><text>a description of
				the outcome measures that will be used to measure the effectiveness of the
				program in promoting public safety and public health;</text>
								</subparagraph><subparagraph id="id5472088D591A4CA99A283B85BD22AAA8"><enum>(C)</enum><text>the activities
				proposed;</text>
								</subparagraph><subparagraph id="idD71A58C8640B4C1480DC0AC1312EA573"><enum>(D)</enum><text>a schedule for
				completion of the activities described in subparagraph (C); and</text>
								</subparagraph><subparagraph id="idF1BF6581980049F394F1B882309BA3B9"><enum>(E)</enum><text>a description of
				the personnel necessary to complete the activities described in subparagraph
				(C).</text>
								</subparagraph></paragraph><paragraph id="id22B13686189E4ACFB3E95FBA7FBD3464"><enum>(2)</enum><header>Application</header>
								<subparagraph id="id104EBBE61BE54BA783F9A2B1A1DD384E"><enum>(A)</enum><header>In
				general</header><text>An eligible entity desiring a planning grant under this
				subsection shall submit to the Attorney General an application that shall
				include a commitment by the applicant to partner with a local evaluator to
				identify and analyze data that will—</text>
									<clause id="id79656737C22F4BB5B1332A814AD125AB"><enum>(i)</enum><text>enable the grantee
				to target the intended offender population; and</text>
									</clause><clause id="idE10878F88CA4432BBFFA3AF5FA4F31E1"><enum>(ii)</enum><text>serve as a
				baseline for purposes of the evaluation.</text>
									</clause></subparagraph><subparagraph id="id34961E2C60DA49D7B7597FC63D68D586"><enum>(B)</enum><header>Procedure</header><text>The
				Attorney General shall develop a procedure to evaluate the qualifications of a
				local evaluator described in subparagraph (A).</text>
								</subparagraph></paragraph><paragraph id="idC0B6D06AC2714640AC5B4C103C6B13B3"><enum>(3)</enum><header>Maximum total
				grants and minimum allocation</header>
								<subparagraph id="idF864CC34A44B4726AD6A7554744B9B99"><enum>(A)</enum><header>Maximum
				amount</header><text>The Attorney General may not make planning grants and
				implementation grants to 1 eligible entity in a total amount that is more than
				a $1,000,000.</text>
								</subparagraph><subparagraph id="id29185374B18D43FB886083DB490E6594"><enum>(B)</enum><header>Minimum
				allocation</header><text>Unless all eligible applications submitted by a State,
				or unit of local government within such State, for a planning grant have been
				awarded funds under this section, the State, in combination with the all of the
				grantees within the State (other than Indian tribes), shall be allocated for
				each fiscal year not less than 0.75 percent of the total amount appropriated in
				the fiscal year under this section for planning and implementation
				grants.</text>
								</subparagraph></paragraph><paragraph id="id698EA88E68CB4358A2D6A29484B074DA"><enum>(4)</enum><header>Period of
				grant</header><text>A planning grant made under this subsection shall be for a
				period of 1 year, beginning on the first day of the month in which the planning
				grant is made.</text>
							</paragraph></subsection><subsection id="idABF23AA92F444C98A718FEAE01810ED3"><enum>(f)</enum><header>Implementation
				grants</header>
							<paragraph id="id3AEECA0ED7924A578D7F72F4BE76A664"><enum>(1)</enum><header>Applications</header><text>An
				eligible entity desiring an implementation grant under this subsection shall
				submit to the Attorney General an application that—</text>
								<subparagraph id="idCCAE06D28CE2461AB0E16DC4EE373BA4"><enum>(A)</enum><text>contains a reentry
				strategic plan as described in subsection (h), which describes the long-term
				strategy and incorporates a detailed implementation schedule, including the
				plans of the applicant to fund the program after Federal funding is
				discontinued;</text>
								</subparagraph><subparagraph id="IDe557e10ac49b4bfca1f3e6f17531397b"><enum>(B)</enum><text>identifies the
				local government role and the role of governmental agencies and nonprofit
				organizations that will be coordinated by, and that will collaborate on, the
				offender reentry strategy of the applicant, and certifies the involvement of
				such agencies and organizations;</text>
								</subparagraph><subparagraph id="ID7457172d6fa64bb0b68f89ff1fafa2ed"><enum>(C)</enum><text>describes the
				evidence-based methodology and outcome measures that will be used to evaluate
				the program funded with a grant under this subsection, and specifically
				explains how such measurements will provide valid measures of the impact of
				that program; and</text>
								</subparagraph><subparagraph id="ID42857cb0119147e79a6925d3ef75f1b1"><enum>(D)</enum><text>describes how the
				project could be broadly replicated if demonstrated to be effective.</text>
								</subparagraph></paragraph><paragraph id="id7B46129BF82F4F4BB2064FE05A4A514C"><enum>(2)</enum><header>Requirements</header><text>The
				Attorney General may make a grant to an applicant under this subsection only if
				the application—</text>
								<subparagraph id="ID3d4507cf6a204ddcad351d8270b28016"><enum>(A)</enum><text>reflects explicit
				support of the chief executive officer of the State, unit of local government,
				territory, or Indian tribe applying for a grant under this subsection;</text>
								</subparagraph><subparagraph id="ID631b25326be04f47b1e0f728addeaa2b"><enum>(B)</enum><text>provides extensive
				discussion of the role of State corrections departments, community corrections
				agencies, juvenile justice systems, or local jail systems in ensuring
				successful reentry of offenders into their communities;</text>
								</subparagraph><subparagraph id="ID884fb3e19ec040869e9addef977478ff"><enum>(C)</enum><text>provides extensive
				evidence of collaboration with State and local government agencies overseeing
				health, housing, child welfare, education, substance abuse, victims services,
				and employment services, and with local law enforcement agencies;</text>
								</subparagraph><subparagraph id="IDf20d762b8d1a4485a80d9509c2ae3c73"><enum>(D)</enum><text>provides a plan
				for analysis of the statutory, regulatory, rules-based, and practice-based
				hurdles to reintegration of offenders into the community;</text>
								</subparagraph><subparagraph id="IDddaada5987c740ff877ef12acb2f16b9"><enum>(E)</enum><text>includes the use
				of a State, local, territorial, or tribal task force, described in subsection
				(i), to carry out the activities funded under the grant;</text>
								</subparagraph><subparagraph id="ID562bd29cf66444de83cb9b35cb0aec61"><enum>(F)</enum><text>provides a plan
				for continued collaboration with a local evaluator as necessary to meeting the
				requirements under subsection (h); and</text>
								</subparagraph><subparagraph id="id2440BBFF77764BDC871598073BF9F55B"><enum>(G)</enum><text>demonstrates that
				the applicant participated in the planning grant process or engaged in
				comparable planning for the reentry project.</text>
								</subparagraph></paragraph><paragraph id="id17701AC5EC794D2088A8DA64ECDA5CC1"><enum>(3)</enum><header>Priority
				considerations</header><text>The Attorney General shall give priority to grant
				applications under this subsection that best—</text>
								<subparagraph id="ID8b5f0537998246ca8a5f24b191a2625f"><enum>(A)</enum><text>focus initiative
				on geographic areas with a disproportionate population of offenders released
				from prisons, jails, and juvenile facilities;</text>
								</subparagraph><subparagraph id="ID8b16394c15564653a2a1f88e956a53c0"><enum>(B)</enum><text>include—</text>
									<clause id="ID70eb7d57490f4103b3f684d1db9ec417"><enum>(i)</enum><text>input from
				nonprofit organizations, in any case where relevant input is available and
				appropriate to the grant application;</text>
									</clause><clause id="ID861e6c9697ff4a5fab9f11706d9832f2"><enum>(ii)</enum><text>consultation with
				crime victims and offenders who are released from prisons, jails, and juvenile
				facilities;</text>
									</clause><clause id="ID9e43c722720c47fa962afacea2921f37"><enum>(iii)</enum><text>coordination
				with families of offenders; and</text>
									</clause><clause id="idF85C8113F2864C0A895C97F5294FEDA0"><enum>(iv)</enum><text>input, where
				appropriate from the juvenile justice coordinating council of the
				region;</text>
									</clause></subparagraph><subparagraph id="IDac3502f0b34c4112b529fcbc29fec0a7"><enum>(C)</enum><text>demonstrate
				effective case assessment and management abilities in order to provide
				comprehensive and continuous reentry, including—</text>
									<clause id="ID9944ea535b82405b8f116ed6b62ca158"><enum>(i)</enum><text>planning while
				offenders are in prison, jail, or a juvenile facility, prerelease transition
				housing, and community release;</text>
									</clause><clause id="ID813f61e940a2421aa359eb538533c254"><enum>(ii)</enum><text>establishing
				prerelease planning procedures to ensure that the eligibility of an offender
				for Federal or State benefits upon release is established prior to release,
				subject to any limitations in law, and to ensure that offenders obtain all
				necessary referrals for reentry services, including assistance identifying and
				securing suitable housing; and</text>
									</clause><clause id="ID9e2a566db6a94f21b05f38d1083668db"><enum>(iii)</enum><text>delivery of
				continuous and appropriate drug treatment, medical care, job training and
				placement, educational services, or any other service or support needed for
				reentry;</text>
									</clause></subparagraph><subparagraph id="ID65c79e4b24234b9e9cc2ab2aec59904b"><enum>(D)</enum><text>review the process
				by which the applicant adjudicates violations of parole, probation, or
				supervision following release from prison, jail, or a juvenile facility, taking
				into account public safety and the use of graduated, community-based sanctions
				for minor and technical violations of parole, probation, or supervision
				(specifically those violations that are not otherwise, and independently, a
				violation of law);</text>
								</subparagraph><subparagraph id="ID4ced9a44ee0e4a12ab43f57cea96c1ab"><enum>(E)</enum><text>provide for an
				independent evaluation of reentry programs that include, to the maximum extent
				possible, random assignment and controlled studies to determine the
				effectiveness of such programs;</text>
								</subparagraph><subparagraph id="ID701d058fd9db49f8ae1a3e19a2981c8e"><enum>(F)</enum><text>target high-risk
				offenders for reentry programs through validated assessment tools; and</text>
								</subparagraph><subparagraph id="ID732c27c97d3d4f4f8f57af4b21e47c89"><enum>(G)</enum><text>target offenders
				with histories of homelessness, substance abuse, or mental illness, including a
				prerelease assessment of the housing status of the offender and behavioral
				health needs of the offender with clear coordination with mental health,
				substance abuse, or homelessness services systems to achieve stable and
				permanent housing outcomes with appropriate support service.</text>
								</subparagraph></paragraph><paragraph id="id1548610643424AF6BF98FA30CC589A21"><enum>(4)</enum><header>Amount</header><text>The
				amount of a grant made under this subsection may not be more than
				$925,000.</text>
							</paragraph><paragraph id="id7FA49933CA91474187CECD60658016DC"><enum>(5)</enum><header>Period of
				grant</header><text>A grant made under this subsection shall be effective for a
				2-year period—</text>
								<subparagraph id="id5A7FA19AC40D498DBFE7AB080E351765"><enum>(A)</enum><text>beginning on the
				date on which the planning grant awarded under subsection (e) concludes;
				or</text>
								</subparagraph><subparagraph id="idB4B2F73BC581429E89B4C720A0842C58"><enum>(B)</enum><text>in the case of an
				implementation grant awarded to an eligible entity that did not receive a
				planning grant, beginning on the date on which the implementation grant is
				awarded.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="idE031A4D0058C40B893FB76E6B852EDEF"><enum>(3)</enum><text>in subsection
			 (g)(1)(B)(ii), by striking <quote>50 percent</quote> and inserting <quote>75
			 percent</quote>;</text>
				</paragraph><paragraph id="idA50FECFAFD554A01A94C1A9FEA3BA988"><enum>(4)</enum><text>in subsection
			 (h)—</text>
					<subparagraph id="id07AF8C88561E4757801C41ECD94E7081"><enum>(A)</enum><text>by redesignating
			 paragraphs (2) and (3) as paragraphs (3) and (4), respectively; and</text>
					</subparagraph><subparagraph id="id9BFAF77217CC420696A740C7F2213CAA"><enum>(B)</enum><text>by striking
			 paragraph (1) and inserting the following:</text>
						<quoted-block changed="deleted" committee-id="SSJU00" display-inline="no-display-inline" id="id635D5956EBF145189ED15A4733CDC88F" reported-display-style="strikethrough" style="OLC">
							<paragraph id="id26C967BE4DA347CF985F222E29350506"><enum>(1)</enum><header>In
				general</header><text>As a condition of receiving financial assistance under
				subsection (f), each application shall develop a comprehensive reentry
				strategic plan that—</text>
								<subparagraph id="idCAF2A859C4CB44C9A11C6AB1D7BB5B02"><enum>(A)</enum><text>contains a plan to
				assess inmate reentry needs and measurable annual and 3-year performance
				outcomes;</text>
								</subparagraph><subparagraph id="id337F586AA572485F9B65536339A24457"><enum>(B)</enum><text>uses, to the
				maximum extent possible, randomly assigned and controlled studies, or rigorous
				quasi-experimental studies with matched comparison groups, to determine the
				effectiveness of the program funded with a grant under subsection (f);
				and</text>
								</subparagraph><subparagraph id="idE3DA69B09B6E4429871C4A22CE856A29"><enum>(C)</enum><text>includes as a goal
				of the plan to reduce the rate of recidivism for offenders released from
				prison, jail or a juvenile facility with funds made available under subsection
				(f).</text>
								</subparagraph></paragraph><paragraph id="id214143230F414D85A8CFF4338A49497B"><enum>(2)</enum><header>Local
				evaluator</header><text>A partnership with a local evaluator described in
				subsection (e)(2) shall require the local evaluator to use the baseline data
				and target population characteristics developed under a subsection (e) planning
				grant to derive a feasible and meaningful target goal for recidivism reduction
				during the 3-year period beginning on the date of implementation of the
				program.</text>
							</paragraph><after-quoted-block>;
				</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="idA68C8A8824E4490B9D8A8E2E3D9790DF"><enum>(5)</enum><text>in subsection
			 (i)(1), by striking <quote>under this section</quote> and inserting
			 <quote>under subsection (f)</quote>;</text>
				</paragraph><paragraph id="idE085AC1EC6DB4B25905E685F51C2B25E"><enum>(6)</enum><text>in subsection
			 (j)—</text>
					<subparagraph id="id8399D055BD5F4D3EA1F683573E02696A"><enum>(A)</enum><text>in paragraph (1),
			 by inserting <quote>for an implementation grant under subsection (f)</quote>
			 after <quote>applicant</quote>;</text>
					</subparagraph><subparagraph id="id2804E7F61FF14144A2CF94C612BADAE6"><enum>(B)</enum><text>in paragraph
			 (2)—</text>
						<clause id="id92347A9A135E4331BF9824CDB746F391"><enum>(i)</enum><text>in subparagraph
			 (E), by inserting <quote>, where appropriate</quote> after
			 <quote>support</quote>; and</text>
						</clause><clause id="id6DFC6D0C71F646F9B66179FB5EB77F3C"><enum>(ii)</enum><text>by striking
			 subparagraphs (F), (G), and (H), and inserting the following:</text>
							<quoted-block changed="deleted" committee-id="SSJU00" display-inline="no-display-inline" id="idFAB0AEE454904A309629936B3328D65E" reported-display-style="strikethrough" style="OLC">
								<subparagraph id="idC07E0F4429F84623B66020AD3133C886"><enum>(F)</enum><text>a cost-benefit
				analysis to determine the cost effectiveness of the reentry program;</text>
								</subparagraph><subparagraph id="id7F2C2C5150894C8A97EA7A0BD3988B1D"><enum>(G)</enum><text>increased number
				of staff trained to administer reentry services;</text>
								</subparagraph><subparagraph id="id055F8E215FEE4CAFB89953F2563B9164"><enum>(H)</enum><text>increased
				proportion of individuals served by the program among those eligible to receive
				services;</text>
								</subparagraph><subparagraph id="id0E6AAEFB5B16453CA2C82AEDA5D0E9B3"><enum>(I)</enum><text>increased number
				of individuals receiving risk screening needs assessment, and case planning
				services;</text>
								</subparagraph><subparagraph id="idA6B7C554E99B40A8AF4A82DC29640430"><enum>(J)</enum><text>increased
				enrollment in, and completion of treatment services, including substance abuse
				and mental health services among those assessed as needing such
				services;</text>
								</subparagraph><subparagraph id="id832BA97F5C344C7EB6680F796F775504"><enum>(K)</enum><text>increased
				enrollment in and degrees earned from educational programs, including GED,
				vocational training, and college education;</text>
								</subparagraph><subparagraph id="idE65277EB4CCC48B1BADEE6EA249AD4FA"><enum>(L)</enum><text>increased number
				of individuals obtaining and retaining employment;</text>
								</subparagraph><subparagraph id="id1077A8CF8954429E844ABBABA8E881B1"><enum>(M)</enum><text>increased number
				of individuals obtaining housing;</text>
								</subparagraph><subparagraph id="id8AD70EE9AF3C47B8BA13F4AD150A0CE7"><enum>(N)</enum><text>reduction in drug
				and alcohol use; and</text>
								</subparagraph><subparagraph id="id7517327F8DA544D28491E77EAFD172BB"><enum>(O)</enum><text>reduction in
				recidivism rates for individuals receiving reentry services after release, as
				compared to either baseline recidivism rates in the jurisdiction of the grantee
				or recidivism rates of the control or comparison
				group.</text>
								</subparagraph><after-quoted-block>;
				</after-quoted-block></quoted-block>
						</clause></subparagraph><subparagraph id="idE1C5A4CA518C4BE59224172A94EB673B"><enum>(C)</enum><text>in paragraph (4),
			 by striking <quote>this section</quote> and inserting <quote>subsection
			 (f)</quote>; and</text>
					</subparagraph><subparagraph id="id2AFBD2435CB04491B2C65337CB8428E7"><enum>(D)</enum><text>in paragraph (5),
			 by striking <quote>this section</quote> and inserting <quote>subsection
			 (f)</quote>;</text>
					</subparagraph></paragraph><paragraph id="id5281EDA7C58D4DB1AD6B219267E485E6"><enum>(7)</enum><text>in subsection
			 (k)(1), by striking <quote>this section</quote> each place the term appears and
			 inserting <quote>subsection (f)</quote>;</text>
				</paragraph><paragraph id="idD1317162E3AE4724B86045D36DBF1642"><enum>(8)</enum><text>in subsection
			 (l)—</text>
					<subparagraph id="id26937554BF144CCBBACA4926BC6E27CE"><enum>(A)</enum><text>in paragraph (2),
			 by inserting <quote>beginning on the date on which the most recent
			 implementation grant is made to the grantee under subsection (f)</quote> after
			 <quote>2-year period</quote>; and</text>
					</subparagraph><subparagraph id="id71DF62EA978C43FFB0ABC32F560EE927"><enum>(B)</enum><text>in paragraph (4),
			 by striking <quote>over a 2-year period</quote> and inserting <quote>during the
			 2-year period described in paragraph (2)</quote>;</text>
					</subparagraph></paragraph><paragraph id="id3A9591BCE8C54C8582BD2B3CE0878982"><enum>(9)</enum><text>in subsection
			 (o)(1), by striking <quote>appropriated</quote> and all that follows and
			 inserting the following: <quote>appropriated—</quote></text>

			 alternatives to incarceration program</header>
				<paragraph id="ID72974957e14a488e9a60c8e83dfe7243"><enum>(1)</enum><header>Authorization</header><text>Title
			 I of the Omnibus Crime Control and Safe Streets Act of 1968 (42 U.S.C. 3711 et
			 seq.) is amended by striking part CC (42 U.S.C. 3797q et seq.) and inserting
			 the following:</text>

				alternatives to incarceration program</header>
							<section id="idB1D3A5335AD94A38ADBB4E1284FA849C"><enum>2901.</enum><header>Definitions</header><text display-inline="no-display-inline">In this part:</text>
								<paragraph id="id5612D2BEA18A4BF985452C68A60EF9A1"><enum>(1)</enum><header>Eligible
				offender</header><text>The term <term>eligible offender</term> means an
				individual who—</text>
									<subparagraph id="idDEF917A0E798483C99618B6443060240"><enum>(A)</enum><text>has been charged,
				sentenced, or convicted of a crime for which a sentence of imprisonment of more
				than 1 year is authorized; and</text>
									</subparagraph><subparagraph id="idED93246EDD6F47789E128957DC45D713"><enum>(B)</enum><text>does not have 1 or
				more prior convictions for a felony crime of violence involving the use or
				attempted use of force against a person with the intent to cause death or
				serious bodily harm.</text>
									</subparagraph></paragraph><paragraph id="idAAFE228E0204464EB1674906013B9DF6"><enum>(2)</enum><header>Probation with
				enforcement program</header><text>The term <term>probation with enforcement
				program</term> means a program that—</text>
									<subparagraph id="idE497A9B043284112BEB78EBC543658BD"><enum>(A)</enum><text>reduces drug use,
				crime, and recidivism by requiring swift, predictable, and graduated sanctions
				for noncompliance with the conditions of probation, as determined by the
				Attorney General;</text>
									</subparagraph><subparagraph id="idAACF1591A72448909BF6556F1F06E2D8"><enum>(B)</enum><text>identifies for
				enrollment in the program eligible offenders who are serving a term of
				probation and who are at high risk of failing to observe the conditions of
				supervision and of being returned to incarceration as a result of the
				failure;</text>
									</subparagraph><subparagraph id="id0A81129E370944AB9FAC03D095ECF38F"><enum>(C)</enum><text>notifies eligible
				offenders of the rules of the probation demonstration program, and consequences
				for violating such rules;</text>
									</subparagraph><subparagraph id="id2B7272194C0E43AD8FBFC598492968A6"><enum>(D)</enum><text>monitors eligible
				offenders for illicit drug use with regular and rapid-result drug
				screening;</text>
									</subparagraph><subparagraph id="id412FC47BD45346A39730CAC782B4FC8F"><enum>(E)</enum><text>monitors eligible
				offenders for violations of other rules and probation terms, including failure
				to pay court-ordered financial obligations, such as child support or victim
				restitution;</text>
									</subparagraph><subparagraph id="idBF3CA18FD0C144E3AE18AA5409FB3034"><enum>(F)</enum><text>responds to
				violations of the other rules and probation terms with immediate arrest of the
				violating eligible offender, and swift and certain modification of the
				conditions of probation, including imposition of short jail stays (which may
				gradually become longer with each additional violation and
				modification);</text>
									</subparagraph><subparagraph id="id94181B017B914528ACE3C6EDD887AE67"><enum>(G)</enum><text>immediately
				responds to eligible offenders who have absconded from supervision with service
				of bench warrants and immediate sanctions;</text>
									</subparagraph><subparagraph id="id0B18A8F29B7F4CF9B833BC8463784E12"><enum>(H)</enum><text>provides rewards
				to eligible offenders who comply with such rules;</text>
									</subparagraph><subparagraph id="id39D32910093C47739FF3F907130D6183"><enum>(I)</enum><text>ensures funding
				for, and referral to, substance abuse treatment for eligible offenders who
				repeatedly fail to refrain from illicit drug use; and</text>
									</subparagraph><subparagraph id="id5113F5295D2B4A5EBF3B0F473FEDF347"><enum>(J)</enum><text>establishes
				procedures to terminate program participation by, and initiate revocation to a
				term of incarceration for, eligible offenders who habitually fail to abide by
				program rules and pose a threat to public safety.</text>
									</subparagraph></paragraph><paragraph id="id4E40B3C5601A47009AC1793A25478A37"><enum>(3)</enum><header>Law enforcement
				or prosecution drug treatment alternative to prison program</header><text>The
				term <term>law enforcement or prosecution drug treatment alternative to prison
				program</term> means a program that—</text>
									<subparagraph id="idE6A6E3A65D9B4BA28E233796DD3A584C"><enum>(A)</enum><text>is administered by
				a prosecutor or law enforcement officer of a State, Indian tribe, or local
				government;</text>
									</subparagraph><subparagraph id="idB3DB79CF42DA4F48AFEA39A45501B70A"><enum>(B)</enum><text>requires an
				eligible offender who is sentenced to participate in the program (instead of
				incarceration) to participate in a comprehensive substance abuse treatment
				program that is approved by the State or Indian tribe and licensed, if
				necessary, to provide medical and other health services;</text>
									</subparagraph><subparagraph id="idDEDF8AAA6B8549DDA04DFA3245121155"><enum>(C)</enum><text>requires an
				eligible offender to receive the consent of the prosecutor or law enforcement
				officer involved to participate in the program;</text>
									</subparagraph><subparagraph id="idFEB31E6061224443A757F9B03821ADF0"><enum>(D)</enum><text>in the case of an
				eligible offender who is sentenced to participate in the program, requires the
				offender to serve a sentence of imprisonment with respect to the crime involved
				if the prosecutor or law enforcement officer, in conjunction with the treatment
				provider, determines that the eligible offender has not successfully completed
				the relevant substance abuse treatment program described in subparagraph
				(B);</text>
									</subparagraph><subparagraph id="idA1183386405749F2B4721D0306478736"><enum>(E)</enum><text>provides for the
				dismissal of the criminal charges that lead to the participation of an eligible
				offender in the program if the eligible offender is determined to have
				successfully completed the program;</text>
									</subparagraph><subparagraph id="idD7566406AB5D4044AA6D51B1A2BAEE8C"><enum>(F)</enum><text>requires each
				substance abuse provider treating an eligible offender under the program
				to—</text>
										<clause id="id098B2428927C42CFB5E203BB907B2ED0"><enum>(i)</enum><text>make periodic
				reports of the progress of the treatment of the eligible offender to the law
				enforcement officer involved and to the appropriate court in which the eligible
				offender was convicted; and</text>
										</clause><clause id="idF0DB5C38E14A43268FF7CF929DEE0847"><enum>(ii)</enum><text>notify the
				prosecutor or law enforcement officer involved and the appropriate court if the
				eligible offender absconds from the facility of the treatment provider or
				otherwise violates the terms and conditions of the program, consistent with
				Federal and State confidentiality requirements; and</text>
										</clause></subparagraph><subparagraph id="idE6AB35CACB77425CA89060E4036581A6"><enum>(G)</enum><text>has an enforcement
				unit comprised of law enforcement officers involved, the duties of which shall
				include—</text>
										<clause id="idDC21027BEA51490888B63F6F13C2B69E"><enum>(i)</enum><text>verifying the
				address of an eligible offender and other contacts; and</text>
										</clause><clause id="id0BCAA6892492496D94CEF18AB7FBC716"><enum>(ii)</enum><text>if necessary,
				locating, apprehending, and arresting an eligible offender who has absconded
				from the facility of a substance abuse treatment provider or otherwise violated
				the terms and conditions of the program and returning the eligible offender to
				the appropriate court for sentencing for the crime involved.</text>
										</clause></subparagraph></paragraph><paragraph id="id815E1D64EB5D468584B47D696EFF822E"><enum>(4)</enum><header>Reentry
				court</header><text>The term <term>reentry court</term> means a program
				that—</text>
									<subparagraph id="idC5CC9E829F4C4ABFAB826CFAEF0AA4AE"><enum>(A)</enum><text>monitors juvenile
				and adult eligible offenders reentering the community;</text>
									</subparagraph><subparagraph id="id2BBC90863CF54652975BA46366070485"><enum>(B)</enum><text>provides juvenile
				and adult eligible offenders reentering the community with coordinated and
				comprehensive reentry services and programs, such as—</text>
										<clause id="id7D724A5BE5A14005AEA8CFC8AA55548E"><enum>(i)</enum><text>drug and alcohol
				testing and assessment for treatment;</text>
										</clause><clause id="idB1A84C7C3A72405885B4A31F4A5306C8"><enum>(ii)</enum><text>assessment for
				substance abuse from a substance abuse professional who is approved by the
				State or Indian tribe and licensed by the appropriate entity to provide alcohol
				and drug addiction treatment, as appropriate;</text>
										</clause><clause id="idDC265F2B1EDB4B5BB631D774B15E572E"><enum>(iii)</enum><text>substance abuse
				treatment from a provider that is approved by the State or Indian tribe, and
				licensed, if necessary, to provide medical and other health services;</text>
										</clause><clause id="id8D080B9679E14C58B8DF821F44D55EA9"><enum>(iv)</enum><text>health (including
				mental health) services and assessment;</text>
										</clause><clause id="idCBEA3AE851784269ABCB1C0E1093F87C"><enum>(v)</enum><text>aftercare and case
				management services that—</text>
											<subclause id="id289E8899B7784CFE9EBC3F69FD306F4A"><enum>(I)</enum><text>facilitate access
				to clinical care and related health services; and</text>
											</subclause><subclause id="id36E0C978E2FE4F9C9B2B36F0E179971E"><enum>(II)</enum><text>coordinate with
				such clinical care and related health services; and</text>
											</subclause></clause><clause id="idD372461818324F1BB1B33EAF14AD4015"><enum>(vi)</enum><text>any other
				services needed for reentry;</text>
										</clause></subparagraph><subparagraph id="idC0850E96FF274C3A98E483138FB7B461"><enum>(C)</enum><text>convenes community
				impact panels, victim impact panels, or victim impact educational
				classes;</text>
									</subparagraph><subparagraph id="idBA240E10537D4807964B59E6A1AF6279"><enum>(D)</enum><text>provides and
				coordinates the delivery of community services to juvenile and adult eligible
				offenders, including—</text>
										<clause id="id42172DBD0E0C44E2915A90D28B4F47DD"><enum>(i)</enum><text>housing
				assistance;</text>
										</clause><clause id="id35EDBFFEB1664FCAA8AD2B1BC3D2600C"><enum>(ii)</enum><text>education;</text>
										</clause><clause id="id776F58B4F76241448CF57B2848637E57"><enum>(iii)</enum><text>job
				training;</text>
										</clause><clause id="id47FAD76037634A448AFE5B4884235639"><enum>(iv)</enum><text>conflict
				resolution skills training;</text>
										</clause><clause id="id33F1EC05B01C441BABFF19BCD238F1A5"><enum>(v)</enum><text>batterer
				intervention programs; and</text>
										</clause><clause id="id80932BA667B147998BF3AF2F4B5A5412"><enum>(vi)</enum><text>other appropriate
				social services; and</text>
										</clause></subparagraph><subparagraph id="id94AE237C86AD4EA68235BBF7D09730EC"><enum>(E)</enum><text>establishes and
				implements graduated sanctions and incentives.</text>
									</subparagraph></paragraph></section><section id="id3DABF54D06484B89A4DF6B1EDBFD9948"><enum>2902.</enum><header>Grant
				authority</header>
								<subsection id="ID21ca98ed348a48ddbb0aff34b6e95414"><enum>(a)</enum><header>In
				general</header><text>The Attorney General may make grants to States, local
				governments, territories, Indian tribes, nonprofit agencies, or any combination
				thereof, to develop, implement, or expand programs that provide alternatives to
				incarceration, in accordance with this part.</text>
								</subsection><subsection id="ID304f3a84be1844ccb72887e98db8b928"><enum>(b)</enum><header>Allowable
				uses</header>
									<paragraph id="id4148FEF4797C4291890992C5F3F5D9D4"><enum>(1)</enum><header>In
				general</header><text>A grant under this part may be used for the expenses of a
				law enforcement or prosecution drug treatment alternatives to prison program, a
				problem-solving court, including a reentry court, or a probation with
				enforcement program including for—</text>
										<subparagraph id="IDdb5a5d453c894aa8b98e0a87801ebb32"><enum>(A)</enum><text>salaries,
				personnel costs, equipment costs, and other costs directly related to the
				operation or evaluation of the program;</text>
										</subparagraph><subparagraph id="ID8a33dbafa6df4843bfc3145a65130edd"><enum>(B)</enum><text>payments for
				providers that are approved by the State or Indian tribe and licensed, if
				necessary, to provide needed treatment or education to eligible offenders
				participating in the program, including aftercare supervision, mental health
				services, substance abuse services, vocational training, education, and job
				placement; and</text>
										</subparagraph><subparagraph id="ID623ded5eb7be43e09124d3408d051e35"><enum>(C)</enum><text>payments to public
				and nonprofit private entities that are approved by the State or Indian tribe
				and licensed, if necessary, to provide mental health, alcohol and drug
				addiction treatment to offenders participating in the program.</text>
										</subparagraph></paragraph><paragraph id="ID8dd35a9eb57443c5bae373d6382e27c2"><enum>(2)</enum><header>Supplement and
				not supplant</header><text>Grants made under this part shall be used to
				supplement, and not supplant, non-Federal funds that would otherwise be
				available for programs described in this part.</text>
									</paragraph></subsection><subsection id="ID752f471f799c4b3fac8b71e90028a26f"><enum>(c)</enum><header>Applications</header>
									<paragraph id="id2B030ECC5B524CE49B35570F6FADAC2A"><enum>(1)</enum><header>In
				general</header><text>A State, local government, territory, Indian tribe, or
				nonprofit agency desiring a grant under this part shall submit an application
				to the Attorney General in such form and containing such information as the
				Attorney General may reasonably require.</text>
									</paragraph><paragraph id="idE773C91078B2444CA01A90EDE528204F"><enum>(2)</enum><header>Application
				contents</header><text>An application submitted under paragraph (1)
				shall—</text>
										<subparagraph id="IDc44596955fc74301b3240943ef7f8720"><enum>(A)</enum><text>describe the
				program to be assisted under this part and the need for the program to serve
				eligible offenders;</text>
										</subparagraph><subparagraph id="IDb8391e735dd44deeb659cea96abd1b63"><enum>(B)</enum><text>describe a
				long-term strategy and detailed implementation plan for the program, including
				how the applicant plans to pay for the program after the Federal funding is
				discontinued;</text>
										</subparagraph><subparagraph id="ID49ff80c057b4437cb8d24c16c887ec8a"><enum>(C)</enum><text>identify the
				governmental and community agencies the activities of which shall be
				coordinated under the project;</text>
										</subparagraph><subparagraph id="ID5a2a556eac064041bee1ddf63018f507"><enum>(D)</enum><text>certify
				that—</text>
											<clause id="ID6ec585ffcbe8420ca4cc1391d932b590"><enum>(i)</enum><text>all agencies
				affected by the program, including community corrections and parole entities,
				have been appropriately consulted in the development of the program; and</text>
											</clause><clause id="IDe646156f7d25429f8f0efb274f8553d9"><enum>(ii)</enum><text>there will be
				appropriate coordination with all such agencies in the implementation of the
				program; and</text>
											</clause></subparagraph><subparagraph id="ID492ad326dd894c24bf83d0ea08ce093a"><enum>(E)</enum><text>describe the
				methodology and outcome measures that will be used to evaluate the
				program.</text>
										</subparagraph></paragraph></subsection></section><section id="ID6b9a316df3b64dc9be49b379f6136a13"><enum>2903.</enum><header>Federal
				share</header>
								<subsection id="id6D3F34939AF546F3B164B691729CBA06"><enum>(a)</enum><header>Matching
				requirement</header><text display-inline="yes-display-inline">The Federal share
				of the cost of an activity carried out using a grant under this part shall be
				not more than 50 percent.</text>
								</subsection><subsection id="ID0db138269d0e40689d556d1fa90c1f92"><enum>(b)</enum><header>In-Kind
				contributions</header>
									<paragraph id="ID8850bb2b11f24376a5878a860bbd09f0"><enum>(1)</enum><header>In
				general</header><text>Subject to paragraph (2), the recipient of a grant under
				this part may meet the matching requirement under subsection (a) by making
				in-kind contributions of goods or services that are directly related to the
				purpose for which the grant was awarded.</text>
									</paragraph><paragraph id="IDda493ee105e645c7ab1376e4cf7c1929"><enum>(2)</enum><header>Maximum
				percentage</header><text>Not more than 75 percent of the amount provided by a
				recipient of a grant under this part to meet the matching requirement under
				subsection (a) may be provided through in-kind contributions under paragraph
				(1).</text>
									</paragraph></subsection></section><section id="ID24a4653fafee44c3af1fcb668b56abd6"><enum>2904.</enum><header>Geographic
				distribution</header><text display-inline="no-display-inline">The Attorney
				General shall ensure that, to the extent practicable, the distribution of
				grants under this part is equitable and includes States, local governments,
				territories, Indian tribes, or nonprofit agencies—</text>
								<paragraph id="IDb9b64d16b3df453189875cc52b722227"><enum>(1)</enum><text>in each State;
				and</text>
								</paragraph><paragraph id="IDc7bd1b29db7d443095a61ae59e1dfa23"><enum>(2)</enum><text>in rural,
				suburban, tribal, and urban jurisdictions.</text>
								</paragraph></section><section id="IDc0b4e50f09fa439085a25f9c7e99d95e"><enum>2905.</enum><header>Reports and
				evaluations</header><text display-inline="no-display-inline">Each entity
				receiving a grant under this section shall submit to the Attorney General, for
				each fiscal year in which funds received under the grant are expended, a
				report, at such time and in such manner as the Attorney General may reasonably
				require, that contains—</text>
								<paragraph id="IDf14e1584196d4e2c9082f613ea794678"><enum>(1)</enum><text>a summary of the
				activities carried out under the program assisted by the grant;</text>
								</paragraph><paragraph id="ID474a1bad133645848f45b41d2dc91c8e"><enum>(2)</enum><text>an assessment of
				whether the activities are meeting the need for the program identified in the
				application submitted under section 2902(c); and</text>
								</paragraph><paragraph id="IDc201fa3e9c1c4a97a44fc9dbf81566f7"><enum>(3)</enum><text>such other
				information as the Attorney General may require.</text>
								</paragraph></section><section id="IDf0d6ac1f1f2e42b298efdeeb18570be7"><enum>2906.</enum><header>Training and
				technical assistance</header><text display-inline="no-display-inline">The
				Attorney General may, using amounts made available to carry out this part,
				establish training and technical assistance for grantees, including—</text>
								<paragraph id="ID0ef2884eb29a4bfcbd878e310475071e"><enum>(1)</enum><text>providing
				education, training, and technical assistance for States, Indian tribes,
				territories, local governments, service providers, and nonprofit organizations
				relating to problem-solving courts, law enforcement drug treatment alternative
				to prison programs, and probation with enforcement programs;</text>
								</paragraph><paragraph id="ID02f1a91994614dd182f3d5f7f7fcb7af"><enum>(2)</enum><text>collecting data
				and best practices from grantees and other agencies and organizations;</text>
								</paragraph><paragraph id="ID454bdc4bba6f4e7bbc3ed31458944d61"><enum>(3)</enum><text>developing and
				disseminating evaluation tools, mechanisms, and measures to better assess and
				document performance measures and outcomes;</text>
								</paragraph><paragraph id="ID3e6c38776f924481b4fd65acb4c61726"><enum>(4)</enum><text>disseminating
				information to States and other relevant entities about best practices, policy
				standards, and research findings; and</text>
								</paragraph><paragraph id="ID9574f544327a4c24b172a022fb3fac2f"><enum>(5)</enum><text>interdisciplinary
				and profession-specific training for relevant professionals on information and
				skills necessary to plan, implement, or expand problem-solving courts, law
				enforcement drug treatment alternative to prisons programs, and probation with
				enforcement programs.</text>
								</paragraph></section><section id="IDfca2c7f4bcea4712b6c42e11cd5dfea0"><enum>2907.</enum><header>Authorization
				of appropriations</header>
								<subsection id="id1533BC520BC7444083C48FFE5C0B7B71"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">There are authorized
				to be appropriated to carry out this part—</text>
									<paragraph id="idE1958108CDE648B6BBD8CA06E1818C78"><enum>(1)</enum><text>$10,000,000 for
				fiscal year 2012;</text>
									</paragraph><paragraph id="idAF89794DB9724DEEBF734631DC9F0471"><enum>(2)</enum><text>$12,000,000 for
				fiscal year 2013;</text>
									</paragraph><paragraph id="id33ACFD757D204B50A658D6A7E2E995EA"><enum>(3)</enum><text>$14,000,000 for
				fiscal year 2014;</text>
									</paragraph><paragraph id="idE9DE38704CCA43798EE5F479D2756210"><enum>(4)</enum><text>$16,000,000 for
				fiscal year 2015; and</text>
									</paragraph><paragraph id="id85C34E21D4BF4B23AA776E0435225DCC"><enum>(5)</enum><text>$20,000,000 for

									</paragraph></subsection><subsection id="ID107c18de883d474582596e7a35c47a29"><enum>(b)</enum><header>Limitations</header><text>Of
				the amounts made available pursuant to subsection (a) for a fiscal year—</text>
									<paragraph id="IDcf0f9bcb4d0f4c9a883ed84e73a88561"><enum>(1)</enum><text>not more than 2
				percent may be used by the Attorney General for salaries and administrative
				expenses; and</text>

			 accountability of grantees</header>
			<subsection id="id191BAE83237E4E5A8DCE4E689FF8A160"><enum>(a)</enum><header>Definition</header><text>In
			 this section, the term <quote>unresolved audit finding</quote> means an audit
			 report finding or recommendation that a grantee has used grant funds for an
			 unauthorized expenditure or otherwise unallowable cost that is not closed or
			 resolved during a 1-year period beginning on the date of an initial
			 notification of the finding or recommendation.</text>
			</subsection><subsection id="idDBF1BDC4F4824109AC11D1481C757D03"><enum>(b)</enum><header>Audit
			 requirement</header><text>Beginning in fiscal year 2012, and every 3 years
			 thereafter, the Inspector General of the Department of Justice shall conduct an
			 audit of not less than 5 percent of all grantees that are awarded funding
			 under—</text>
				<paragraph id="id0CCD0821208445E4B94C6448509D60D2"><enum>(1)</enum><text>section 2976(b) of
			 title I of the Omnibus Crime Control and Safe Streets Act of 1968 (42 U.S.C.
			 3797w(b));</text>
				</paragraph><paragraph id="id011420FFC5F0486CA865DB844A7CA9CE"><enum>(2)</enum><text>part CC of title I
			 of the Omnibus Crime Control and Safe Streets Act of 1968 (42 U.S.C. 3797q et
			 seq.), as amended by this Act;</text>
				</paragraph><paragraph id="idE55465A2CB01418DB4E84FCD3E6E6943"><enum>(3)</enum><text>part DD of title I
			 of the Omnibus Crime Control and Safe Streets Act of 1968 (42 U.S.C. 3797s et
			 seq.);</text>
				</paragraph><paragraph id="idE8568077A71A4F6D9FDD968F536F4724"><enum>(4)</enum><text>part JJ of title I
			 of the Omnibus Crime Control and Safe Streets Act of 1968 (42 U.S.C. 3797dd et

				</paragraph></subsection><subsection id="id226B2A6FF02C4BD99C12AF12D3A45F1F"><enum>(c)</enum><header>Mandatory
			 exclusion</header><text>A grantee that is found to have an unresolved audit
			 finding under an audit conducted under subsection (b) may not receive grant
			 funds under the grant programs described in paragraphs (1) through (5) of
			 subsection (b) in the fiscal year following the fiscal year to which the
			 finding relates.</text>
			</subsection><subsection id="idC87186FF8CDD4209ABE7D63ACC9BDADF"><enum>(d)</enum><header>Priority of
			 grant awards</header><text>The Attorney General, in awarding grants under the
			 programs described in paragraphs (1) through (5) of subsection (b) shall give
			 priority to eligible entities that during the 2-year period preceding the
			 application for a grant have not been found to have an unresolved audit
			 finding.</text>
			</subsection></section><section changed="deleted" committee-id="SSJU00" id="id44916B12CDB64776A621CB0D41CF6616" reported-display-style="strikethrough"><enum>4.</enum><header>Federal reentry
			 improvements</header>
			<subsection id="id5A5BCB70A2AC4887B087B12D5013150B"><enum>(a)</enum><header>Responsible
			 reintegration of offenders</header><text>Section 212 of the Second Chance Act
			 of 2007 (42 U.S.C. 17532) is repealed.</text>
			</subsection><subsection id="id8F3C26DE28F44797B0692ED87AAF7785"><enum>(b)</enum><header>Federal prisoner
			 reentry initiative</header><text>Section 231 of the Second Chance Act of 2007
			 (42 U.S.C. 17541) is amended—</text>

									<subparagraph id="id03E2EB098AFC4ED1A3AF52F7D17F1E98"><enum>(A)</enum><text>the term
				<quote>demonstrated to reduce recidivism</quote> means that the Director of
				Bureau of Prisons has determined that appropriate research has been conducted
				and has validated the effectiveness of the program on recidivism; and</text>
									</subparagraph><subparagraph id="idF13B8846770A4537AF135024777A425C"><enum>(B)</enum><text>the term
				<quote>successfully participates</quote> means that a prisoner has been
				enrolled for a period of not less than 180 days during the 12 months preceding
				the award of credit in 1 or more programs—</text>
										<clause id="idC4EC4D4424B94B6F93F259329A71AEAD"><enum>(i)</enum><text>for which the
				prisoner is eligible; and</text>
										</clause><clause id="idE631439FD5094506827E8A425C8CFE58"><enum>(ii)</enum><text>that meet the
				treatment and program needs of the prisoner.</text>
										</clause></subparagraph></paragraph><paragraph id="idDB18BB2310B241B7AA09B2843F7800AB"><enum>(2)</enum><header>Eligibility to
				earn additional credit</header><text>Any prisoner who, in the judgment of the
				Director of the Bureau of Prisons, successfully participates in a program that
				has been demonstrated to reduce recidivism, is eligible to earn additional
				credit toward satisfaction of the sentence being served by the prisoner.</text>
								</paragraph><paragraph id="ID9b21c6e941ea4770914e5f5484ff6219"><enum>(3)</enum><header>Credit toward
				service of sentence</header><text>Except as provided in paragraph (4), a
				prisoner may receive credit toward service of the sentence of the prisoner of
				up to 60 days per year for each year in which the prisoner is in custody of the
				Bureau of Prisons and successfully participates in a program described in
				paragraph (2). Any credits awarded under this subsection shall vest on the date
				the prisoner is released from custody.</text>
								</paragraph><paragraph id="idF6352B64DD6D4D70A06BE74138EA5E28"><enum>(4)</enum><header>Limitation on
				awards of credit</header>
									<subparagraph id="idAB4D1C7314AB421CAFC5B85163AC66C4"><enum>(A)</enum><header>In
				general</header><text>A prisoner may accrue credit toward service of the
				sentence of the prisoner under this subsection if—</text>
										<clause id="idD3E2F2AFF4814391BA6B1395F00995EA"><enum>(i)</enum><text>the credit accrued
				under this subsection is combined with reductions in the period of time the
				prisoner remains in custody resulting from participation in a residential
				substance abuse program; and</text>
										</clause><clause id="id4EC518F6993649609841F391E6F75A52"><enum>(ii)</enum><text>credit received
				under section 3624(b) does not exceed 33 percent of the sentence imposed on the
				prisoner.</text>
										</clause></subparagraph><subparagraph id="idFDED2E636C0D441BB369A1BD926989D6"><enum>(B)</enum><header>Prior time
				credit</header><text>No credits shall be awarded for any time spent in—</text>
										<clause id="idD1189D2FA6274CDB9801CC019863A894"><enum>(i)</enum><text>programs during
				the 180-day period preceding the enactment of the
				<short-title>Second Chance Reauthorization Act of
				2011</short-title>; or</text>
										</clause><clause id="id5C24F8BCDF88481F8F532ECC2B16DB7D"><enum>(ii)</enum><text>official
				detention prior to the date the sentence commences under section
				3585(a).</text>
										</clause></subparagraph></paragraph><paragraph id="id4BD048466C6B4EA999B44D67AA51808E"><enum>(5)</enum><header>Receipt of
				credit at end of year</header><text>A prisoner may receive credit at the end of
				each year of the sentence being served by the prisoner, beginning at the end of
				the first year of the sentence, subject to a determination by the Director by
				the Bureau of Prisons that during the year the prisoner display exemplary
				compliance with institutional disciplinary regulations. For purposes of this
				section, the first year shall commence on the date the sentence commences under
				section
				3585(a).</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6C71B837B92C48739621BD7C2D795103"><enum>(2)</enum><header>Effective
			 date</header><text>The amendments made by paragraph (1) shall take effect 180
			 days after the date of enactment of this Act.</text>

			 <quote><short-title>Second Chance Reauthorization Act of
			 2011</short-title></quote>.</text>

			 programs</header>
			<subsection id="id8ae361ad-3535-4425-b020-d36614408e9d"><enum>(a)</enum><header>Reauthorization of
			 adult and juvenile offender State and local demonstration
			 projects</header><text>Section 2976 of title I of the Omnibus Crime Control and
			 Safe Streets Act of 1968 (42 U.S.C. 3797w) is amended—</text>
				<paragraph id="idadb15094-18de-430a-bd26-80d44e9272a7"><enum>(1)</enum><text>by striking subsection
			 (a) and inserting the following:</text>
					<quoted-block changed="added" committee-id="SSJU00" display-inline="no-display-inline" id="id7e5cfc5b-b8c0-4b92-93a0-394417fa54c9" reported-display-style="italic" style="OLC">
						<subsection id="id3564cd7e-9663-4d2e-90da-3035f1f4b486"><enum>(a)</enum><header>Grant
				authorization</header><text>The Attorney General shall make grants to States,
				local governments, territories, or Indian tribes, or any combination thereof
				(in this section referred to as an <term>eligible entity</term>), in
				partnership with stakeholders, services providers, and nonprofit organizations
				for the purpose of strategic planning and implementation of adult and juvenile
				offender reentry
				projects.</text>
						</subsection><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="idd46bc70b-1ad3-4e12-b1a0-db8c01a2c9b1"><enum>(2)</enum><text>by striking subsections
			 (d), (e), and (f) and inserting the following:</text>
					<quoted-block changed="added" committee-id="SSJU00" display-inline="no-display-inline" id="id3a393f8c-9057-4f4d-865d-275d897de59e" reported-display-style="italic" style="OLC">
						<subsection id="id94085369-d148-4b99-a4c7-b49806c27884"><enum>(d)</enum><header>Combined grant
				application</header><text>The Attorney General shall develop a procedure to
				allow applicants to submit a single application for a planning grant under
				subsection (e) and an implementation grant under subsection (f).</text>
						</subsection><subsection id="id22694b80-0a20-465e-bc42-56ac112e67b8"><enum>(e)</enum><header>Planning
				grants</header>
							<paragraph id="idce44e595-0909-4892-91c0-b5683a2cbf47"><enum>(1)</enum><header>In
				general</header><text>Except as provided in paragraph (3), the Attorney General
				may make a grant to an eligible entity of not more than $75,000 to develop a
				strategic, collaborative plan for an adult or juvenile offender reentry
				demonstration project as described in subsection (h) that includes—</text>
								<subparagraph id="id1b522bf1-ca0e-479b-bf32-b5fbaa38e946"><enum>(A)</enum><text>a budget and a budget
				justification;</text>
								</subparagraph><subparagraph id="idc70f605e-cc36-4a92-bad2-924074b5d298"><enum>(B)</enum><text>a description of the
				outcome measures that will be used to measure the effectiveness of the program
				in promoting public safety and public health;</text>
								</subparagraph><subparagraph id="ide765cdb8-a266-474f-8c51-55b5c8a77236"><enum>(C)</enum><text>the activities
				proposed;</text>
								</subparagraph><subparagraph id="id3b805589-2f10-4d8c-872f-1a649bb8e15c"><enum>(D)</enum><text>a schedule for completion
				of the activities described in subparagraph (C); and</text>
								</subparagraph><subparagraph id="id26b04345-d9c2-4dcc-94e7-e77c16dfbd8b"><enum>(E)</enum><text>a description of the
				personnel necessary to complete the activities described in subparagraph
				(C).</text>
								</subparagraph></paragraph><paragraph id="idde4f26ab-f692-4dd9-9f66-b74294b0e98b"><enum>(2)</enum><header>Application</header>
								<subparagraph id="ide8e812b0-b0e9-433b-8c97-bad0c7e5453f"><enum>(A)</enum><header>In
				general</header><text>An eligible entity desiring a planning grant under this
				subsection shall submit to the Attorney General an application that shall
				include a commitment by the applicant to partner with a local evaluator to
				identify and analyze data that will—</text>
									<clause id="id33763f53-05c9-4bdb-9652-f4c6b69ce2bd"><enum>(i)</enum><text>enable the grantee to
				target the intended offender population; and</text>
									</clause><clause id="id17e2d8cf-281d-4401-807b-7a9584d2013b"><enum>(ii)</enum><text>serve as a baseline for
				purposes of the evaluation.</text>
									</clause></subparagraph><subparagraph id="id26c74570-b080-421f-9e86-7127ed8df182"><enum>(B)</enum><header>Procedure</header><text>The
				Attorney General shall develop a procedure to evaluate the qualifications of a
				local evaluator described in subparagraph (A).</text>
								</subparagraph></paragraph><paragraph id="idb003c813-683c-47f2-bda1-e71a4fdd068f"><enum>(3)</enum><header>Maximum total grants
				and minimum allocation</header>
								<subparagraph id="iddf4d223c-2e1a-4fa2-8dbb-9d2055bb69df"><enum>(A)</enum><header>Maximum
				amount</header><text>The Attorney General may not make planning grants and
				implementation grants to 1 eligible entity in a total amount that is more than
				a $1,000,000.</text>
								</subparagraph><subparagraph id="id1bd263db-71cb-4b96-8344-ae952993980b"><enum>(B)</enum><header>Minimum
				allocation</header><text>Unless all eligible applications submitted by a State,
				or unit of local government within such State, for a planning grant have been
				awarded funds under this section, the State, in combination with the all of the
				grantees within the State (other than Indian tribes), shall be allocated for
				each fiscal year not less than 0.75 percent of the total amount appropriated in
				the fiscal year under this section for planning and implementation
				grants.</text>
								</subparagraph></paragraph><paragraph id="id928d385e-fca6-422d-816c-6b6b02d871e7"><enum>(4)</enum><header>Period of
				grant</header><text>A planning grant made under this subsection shall be for a
				period of 1 year, beginning on the first day of the month in which the planning
				grant is made.</text>
							</paragraph></subsection><subsection id="id6579aed6-df6f-4124-b5ce-01153d84419d"><enum>(f)</enum><header>Implementation
				grants</header>
							<paragraph id="idc583bff5-c779-44a6-9893-96560a110f02"><enum>(1)</enum><header>Applications</header><text>An
				eligible entity desiring an implementation grant under this subsection shall
				submit to the Attorney General an application that—</text>
								<subparagraph id="idbb7b21d1-b5d8-4ca1-86fc-e5bf22ea64b3"><enum>(A)</enum><text>contains a reentry
				strategic plan as described in subsection (h), which describes the long-term
				strategy and incorporates a detailed implementation schedule, including the
				plans of the applicant to fund the program after Federal funding is
				discontinued;</text>
								</subparagraph><subparagraph id="id7bcbbc01-9063-4425-9ba7-8e15b2d4c038"><enum>(B)</enum><text>identifies the local
				government role and the role of governmental agencies and nonprofit
				organizations that will be coordinated by, and that will collaborate on, the
				offender reentry strategy of the applicant, and certifies the involvement of
				such agencies and organizations;</text>
								</subparagraph><subparagraph id="id2a5b3249-6d9e-4829-9b86-4c1b529b0423"><enum>(C)</enum><text>describes the
				evidence-based methodology and outcome measures that will be used to evaluate
				the program funded with a grant under this subsection, and specifically
				explains how such measurements will provide valid measures of the impact of
				that program; and</text>
								</subparagraph><subparagraph id="id91cfe103-2625-4ed9-829f-8ff5630d29ad"><enum>(D)</enum><text>describes how the project
				could be broadly replicated if demonstrated to be effective.</text>
								</subparagraph></paragraph><paragraph id="ide050626a-2f51-4cac-9da2-24946764e846"><enum>(2)</enum><header>Requirements</header><text>The
				Attorney General may make a grant to an applicant under this subsection only if
				the application—</text>
								<subparagraph id="id7e652ce8-c532-4d68-93f2-87f4bb75f84c"><enum>(A)</enum><text>reflects explicit support
				of the chief executive officer of the State, unit of local government,
				territory, or Indian tribe applying for a grant under this subsection;</text>
								</subparagraph><subparagraph id="id0d668cb0-6cb6-4220-94f4-0c016a9c3ff7"><enum>(B)</enum><text>provides extensive
				discussion of the role of State corrections departments, community corrections
				agencies, juvenile justice systems, or local jail systems in ensuring
				successful reentry of offenders into their communities;</text>
								</subparagraph><subparagraph id="id6145f430-33ef-443d-a026-00983ac571e8"><enum>(C)</enum><text>provides extensive
				evidence of collaboration with State and local government agencies overseeing
				health, housing, child welfare, education, substance abuse, victims services,
				and employment services, and with local law enforcement agencies;</text>
								</subparagraph><subparagraph id="id491c8097-b072-47ce-b2e0-53c3202091e3"><enum>(D)</enum><text>provides a plan for
				analysis of the statutory, regulatory, rules-based, and practice-based hurdles
				to reintegration of offenders into the community;</text>
								</subparagraph><subparagraph id="id3f6cb014-37e2-4243-af2f-4cf11ecd0eda"><enum>(E)</enum><text>includes the use of a
				State, local, territorial, or tribal task force, described in subsection (i),
				to carry out the activities funded under the grant;</text>
								</subparagraph><subparagraph id="idf7370713-d248-46ac-9e12-720037c7d253"><enum>(F)</enum><text>provides a plan for
				continued collaboration with a local evaluator as necessary to meeting the
				requirements under subsection (h); and</text>
								</subparagraph><subparagraph id="idaa690a30-6429-4cf4-9011-7054e31ae0ab"><enum>(G)</enum><text>demonstrates that the
				applicant participated in the planning grant process or engaged in comparable
				planning for the reentry project.</text>
								</subparagraph></paragraph><paragraph id="id0280d883-bb48-461d-9262-c29b17a1ce19"><enum>(3)</enum><header>Priority
				considerations</header><text>The Attorney General shall give priority to grant
				applications under this subsection that best—</text>
								<subparagraph id="ida0a1fd50-9603-4c0a-92c3-51222d764e7d"><enum>(A)</enum><text>focus initiative on
				geographic areas with a disproportionate population of offenders released from
				prisons, jails, and juvenile facilities;</text>
								</subparagraph><subparagraph id="id172a4a2e-4d7f-46ca-bcd1-2bab7a59b368"><enum>(B)</enum><text>include—</text>
									<clause id="id8dc09a94-80ca-4960-86da-f8d6c9a67ae4"><enum>(i)</enum><text>input from nonprofit
				organizations, in any case where relevant input is available and appropriate to
				the grant application;</text>
									</clause><clause id="id576ed4ba-f1f0-4fbf-81a7-e6a228deb6dd"><enum>(ii)</enum><text>consultation with crime
				victims and offenders who are released from prisons, jails, and juvenile
				facilities;</text>
									</clause><clause id="id8069fd7f-1d48-434d-8148-43ff76f60c88"><enum>(iii)</enum><text>coordination with
				families of offenders; and</text>
									</clause><clause id="id039db40e-82a1-4d27-85dc-12f663676b4d"><enum>(iv)</enum><text>input, where
				appropriate, from the juvenile justice coordinating council of the
				region;</text>
									</clause></subparagraph><subparagraph id="id574d830c-a540-4f54-b236-db11ff381fc0"><enum>(C)</enum><text>demonstrate effective
				case assessment and management abilities in order to provide comprehensive and
				continuous reentry, including—</text>
									<clause id="idc38f2c2e-f8ed-419a-b813-ffd5b8a73224"><enum>(i)</enum><text>planning while offenders
				are in prison, jail, or a juvenile facility, prerelease transitional housing,
				and community release;</text>
									</clause><clause id="id6ccbed97-4465-432f-a80d-4977a613f60c"><enum>(ii)</enum><text>establishing prerelease
				planning procedures to ensure that the eligibility of an offender for Federal
				or State benefits upon release is established prior to release, subject to any
				limitations in law, and to ensure that offenders obtain all necessary referrals
				for reentry services, including assistance identifying and securing suitable
				housing; and</text>
									</clause><clause id="id6ba02dad-de5f-46ff-ba3f-0dd57d09b149"><enum>(iii)</enum><text>delivery of continuous
				and appropriate drug treatment, medical care, job training and placement,
				educational services, or any other service or support needed for
				reentry;</text>
									</clause></subparagraph><subparagraph id="id1f2ebc95-7f7c-4765-b851-a1607f9e34e6"><enum>(D)</enum><text>review the process by
				which the applicant adjudicates violations of parole, probation, or supervision
				following release from prison, jail, or a juvenile facility, taking into
				account public safety and the use of graduated, community-based sanctions for
				minor and technical violations of parole, probation, or supervision
				(specifically those violations that are not otherwise, and independently, a
				violation of law);</text>
								</subparagraph><subparagraph id="idd34a974a-ab8a-4928-8550-ffb59a2d33dc"><enum>(E)</enum><text>provide for an
				independent evaluation of reentry programs that include, to the maximum extent
				possible, random assignment and controlled studies to determine the
				effectiveness of such programs;</text>
								</subparagraph><subparagraph id="id01647e89-9a48-4dc3-8f7e-c8e1d036c64d"><enum>(F)</enum><text>target high-risk
				offenders for reentry programs through validated assessment tools; and</text>
								</subparagraph><subparagraph id="id7b547826-eec7-4846-b974-ea7e779dad1c"><enum>(G)</enum><text>target offenders with
				histories of homelessness, substance abuse, or mental illness, including a
				prerelease assessment of the housing status of the offender and behavioral
				health needs of the offender with clear coordination with mental health,
				substance abuse, or homelessness services systems to achieve stable and
				permanent housing outcomes with appropriate support service.</text>
								</subparagraph></paragraph><paragraph id="id01074a04-7093-41d6-bbc4-7fb46b79766a"><enum>(4)</enum><header>Amount</header><text>The
				amount of a grant made under this subsection may not be more than
				$925,000.</text>
							</paragraph><paragraph id="id214d48a0-8715-4348-9aa7-ec6c14e77989"><enum>(5)</enum><header>Period of
				grant</header><text>A grant made under this subsection shall be effective for a
				2-year period—</text>
								<subparagraph id="id91e9dd43-adad-4c20-92f6-ac154ebda3fb"><enum>(A)</enum><text>beginning on the date on
				which the planning grant awarded under subsection (e) concludes; or</text>
								</subparagraph><subparagraph id="id14b946c1-5a3e-4740-89b1-aaf49e6ffaed"><enum>(B)</enum><text>in the case of an
				implementation grant awarded to an eligible entity that did not receive a
				planning grant, beginning on the date on which the implementation grant is
				awarded.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="id15b166cf-256c-4cbb-a705-0a34a4968fe7"><enum>(3)</enum><text>in subsection
			 (g)(1)(B)(ii), by striking <quote>50 percent</quote> and inserting <quote>75
			 percent</quote>;</text>
				</paragraph><paragraph id="idf77dc5a9-a87e-4192-b6a9-a38caf1d5668"><enum>(4)</enum><text>in subsection (h)—</text>
					<subparagraph id="id30c7ead2-f8ba-473e-9ff4-6b2c47c4f22b"><enum>(A)</enum><text>by redesignating
			 paragraphs (2) and (3) as paragraphs (3) and (4), respectively; and</text>
					</subparagraph><subparagraph id="idd18f342d-18b0-4c2c-9a0f-28788ac87f5c"><enum>(B)</enum><text>by striking paragraph (1)
			 and inserting the following:</text>
						<quoted-block changed="added" committee-id="SSJU00" display-inline="no-display-inline" id="id88e4b24f-6688-48b9-9eaa-308d574a7bf1" reported-display-style="italic" style="OLC">
							<paragraph id="id0583b65c-c5a2-4b59-9097-7da11ec07723"><enum>(1)</enum><header>In
				general</header><text>As a condition of receiving financial assistance under
				subsection (f), each application shall develop a comprehensive reentry
				strategic plan that—</text>
								<subparagraph id="id69323140-c85e-42d1-8ec8-aa43748195f9"><enum>(A)</enum><text>contains a plan to assess
				inmate reentry needs and measurable annual and 3-year performance
				outcomes;</text>
								</subparagraph><subparagraph id="idae0c1e8e-c6d4-4949-a02a-076c3ebd869f"><enum>(B)</enum><text>uses, to the maximum
				extent possible, randomly assigned and controlled studies, or rigorous
				quasi-experimental studies with matched comparison groups, to determine the
				effectiveness of the program funded with a grant under subsection (f);
				and</text>
								</subparagraph><subparagraph id="idd3db678a-b962-40b6-9f71-123960207632"><enum>(C)</enum><text>includes as a goal of the
				plan to reduce the rate of recidivism for offenders released from prison, jail
				or a juvenile facility with funds made available under subsection (f).</text>
								</subparagraph></paragraph><paragraph id="idabf36169-db6e-4d5c-88a1-af960fc3e7a3"><enum>(2)</enum><header>Local
				evaluator</header><text>A partnership with a local evaluator described in
				subsection (e)(2) shall require the local evaluator to use the baseline data
				and target population characteristics developed under a subsection (e) planning
				grant to derive a feasible and meaningful target goal for recidivism reduction
				during the 3-year period beginning on the date of implementation of the
				program.</text>
							</paragraph><after-quoted-block>;
				</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="id422c8e7c-5676-4067-8523-4ad41dd27a2e"><enum>(5)</enum><text>in subsection (i)(1), by
			 striking <quote>under this section</quote> and inserting <quote>under

								<subparagraph id="id0e1fc800-77d4-4a21-b547-289540906c5e"><enum>(F)</enum><text>a cost-benefit analysis
				to determine the cost effectiveness of the reentry program;</text>
								</subparagraph><subparagraph id="id587cd6e2-0d86-45bd-bb1d-79b7676035eb"><enum>(G)</enum><text>increased number of staff
				trained to administer reentry services;</text>
								</subparagraph><subparagraph id="id68e3935d-87d6-4f7b-9e5b-52b393bfb079"><enum>(H)</enum><text>increased proportion of
				individuals served by the program among those eligible to receive
				services;</text>
								</subparagraph><subparagraph id="id2080ccf0-bf09-491e-8ae6-b06ce7f957b9"><enum>(I)</enum><text>increased number of
				individuals receiving risk screening needs assessment, and case planning
				services;</text>
								</subparagraph><subparagraph id="id6fee607e-04e7-4a09-a1ee-40122c668041"><enum>(J)</enum><text>increased enrollment in,
				and completion of treatment services, including substance abuse and mental
				health services among those assessed as needing such services;</text>
								</subparagraph><subparagraph id="id6864c4cc-2d23-40c9-8112-31b5f02d5ee1"><enum>(K)</enum><text>increased enrollment in
				and degrees earned from educational programs, including GED, vocational
				training, and college education;</text>
								</subparagraph><subparagraph id="id30219da8-3db3-4aad-a3d2-e2bef05e6ace"><enum>(L)</enum><text>increased number of
				individuals obtaining and retaining employment;</text>
								</subparagraph><subparagraph id="id3b1cce8f-e223-455d-8ff1-f5888b7e9857"><enum>(M)</enum><text>increased number of
				individuals obtaining housing;</text>
								</subparagraph><subparagraph id="id1f1f4329-857b-4a56-bbb0-938f6aea3cfa"><enum>(N)</enum><text>reduction in drug and
				alcohol use; and</text>
								</subparagraph><subparagraph id="idc2f1f1ad-6a56-4413-bb87-88f9e3c6b2a5"><enum>(O)</enum><text>reduction in recidivism
				rates for individuals receiving reentry services after release, as compared to
				either baseline recidivism rates in the jurisdiction of the grantee or
				recidivism rates of the control or comparison
				group.</text>
								</subparagraph><after-quoted-block>;
				</after-quoted-block></quoted-block>
						</clause></subparagraph><subparagraph id="idbadb7352-cbe2-4ea6-94d1-bae19546f79b"><enum>(C)</enum><text>in paragraph (4), by
			 striking <quote>this section</quote> and inserting <quote>subsection

				imprisonment for not less than 6 months in a Federal or State prison or
				correctional facility as a result of the conviction described in subparagraph

				factually innocent of the offense described in subparagraph (A); and</text>

				<term>offender</term> includes an
				exoneree.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="idae78819f-4f5f-4581-b82b-46fbbce87cd6"><enum>(b)</enum><header>Cost-Effective
			 alternatives to incarceration program</header>
				<paragraph id="id2b0c594a-34b4-496a-a62a-dc48a93e8afa"><enum>(1)</enum><header>Authorization</header><text>Title
			 I of the Omnibus Crime Control and Safe Streets Act of 1968 (42 U.S.C. 3711 et
			 seq.) is amended by striking part CC (42 U.S.C. 3797q et seq.) and inserting
			 the following:</text>

				alternatives to incarceration program</header>
							<section id="idda44fe1f-c001-43f6-8c0e-a1bab7679aa5"><enum>2901.</enum><header>Definitions</header><text display-inline="no-display-inline">In this part:</text>
								<paragraph id="id120cda5d-65c8-4653-a2b6-4432d9f782e1"><enum>(1)</enum><header>Eligible
				offender</header><text>The term <term>eligible offender</term> means an
				individual who—</text>
									<subparagraph id="id3481c50a-dfde-4f46-9b72-0b1d1eaee317"><enum>(A)</enum><text>has been charged,
				sentenced, or convicted of a crime for which a sentence of imprisonment of more
				than 1 year is authorized; and</text>
									</subparagraph><subparagraph id="id77A59B5E00824909B72BD1265271C70A"><enum>(B)</enum><text>does not have 1 or more
				prior convictions for—</text>
										<clause id="idE76BECD337164467BFB3D8D96AA2A476"><enum>(i)</enum><text>a felony crime of
				violence with the intent to cause death or serious bodily harm;</text>
										</clause><clause id="id159D21DF2FBF419E93AECBD6B8840424"><enum>(ii)</enum><text>an offense involving
				rape;</text>
										</clause><clause id="id804B9ACC9376435E9BDEBEFCFABA174F"><enum>(iii)</enum><text>a sex offense against a
				minor; or</text>
										</clause><clause id="id03B89C06DE8A4829910E4215860711E1"><enum>(iv)</enum><text>a drug offense involving
				a deadly weapon.</text>
										</clause></subparagraph></paragraph><paragraph id="id0df77e87-e082-48ac-9078-43c9df8118a6"><enum>(2)</enum><header>Probation with
				enforcement program</header><text>The term <term>probation with enforcement
				program</term> means a program that—</text>
									<subparagraph id="id15c13a46-8307-445a-8c22-56472c2ee02b"><enum>(A)</enum><text>reduces drug use, crime,
				and recidivism by requiring swift, predictable, and graduated sanctions for
				noncompliance with the conditions of probation, as determined by the Attorney
				General;</text>
									</subparagraph><subparagraph id="iddd818a0e-9059-4775-b516-bb228931f3ab"><enum>(B)</enum><text>identifies for enrollment
				in the program eligible offenders who are serving a term of probation and who
				are at high risk of failing to observe the conditions of supervision and of
				being returned to incarceration as a result of the failure;</text>
									</subparagraph><subparagraph id="id545805cf-291f-4ecc-ba28-875d390892ad"><enum>(C)</enum><text>notifies eligible
				offenders of the rules of the probation demonstration program, and consequences
				for violating such rules;</text>
									</subparagraph><subparagraph id="id8700b784-1423-4fe1-9f77-50d112a34f98"><enum>(D)</enum><text>monitors eligible
				offenders for illicit drug use with regular and rapid-result drug
				screening;</text>
									</subparagraph><subparagraph id="idde6dde81-7e99-4e44-ae4b-7ea4e6f38c2b"><enum>(E)</enum><text>monitors eligible
				offenders for violations of other rules and probation terms, including failure
				to pay court-ordered financial obligations, such as child support or victim
				restitution;</text>
									</subparagraph><subparagraph id="idd3ea199a-6e3c-4820-99e2-65cc1b925c2b"><enum>(F)</enum><text>responds to violations of
				the other rules and probation terms with immediate arrest of the violating
				eligible offender, and swift and certain modification of the conditions of
				probation, including imposition of short jail stays (which may gradually become
				longer with each additional violation and modification);</text>
									</subparagraph><subparagraph id="idd9470205-52ef-4a62-b7d7-c156ca993973"><enum>(G)</enum><text>immediately responds to
				eligible offenders who have absconded from supervision with service of bench
				warrants and immediate sanctions;</text>
									</subparagraph><subparagraph id="id2f851f77-e9d7-4410-87c8-89d875829a13"><enum>(H)</enum><text>provides rewards to
				eligible offenders who comply with such rules;</text>
									</subparagraph><subparagraph id="id5aacf92c-35c2-4520-995e-25d2ad5977c2"><enum>(I)</enum><text>ensures funding for, and
				referral to, substance abuse treatment for eligible offenders who repeatedly
				fail to refrain from illicit drug use; and</text>
									</subparagraph><subparagraph id="id29b07981-3f7c-4e9b-b19e-69172f51b9dd"><enum>(J)</enum><text>establishes procedures to
				terminate program participation by, and initiate revocation to a term of
				incarceration for, eligible offenders who habitually fail to abide by program
				rules and pose a threat to public safety.</text>
									</subparagraph></paragraph><paragraph id="id7e0fed50-6ab3-4296-b346-2875f5b9e930"><enum>(3)</enum><header>Law enforcement or
				prosecution drug treatment alternative to prison or jail
				program</header><text>The term <term>law enforcement or prosecution drug
				treatment alternative to prison or jail program</term> means a program
				that—</text>
									<subparagraph id="idf1b44776-e7b8-4376-9b8e-4d9d7c6ab320"><enum>(A)</enum><text>is administered by a
				prosecutor or law enforcement officer of a State, Indian tribe, or local
				government;</text>
									</subparagraph><subparagraph id="id709e3059-51cc-4b54-ba70-07af544fc3af"><enum>(B)</enum><text>requires an eligible
				offender who is sentenced to participate in the program (instead of
				incarceration) to participate in a comprehensive substance abuse treatment
				program that is approved by the State or Indian tribe and licensed, if
				necessary, to provide medical and other health services;</text>
									</subparagraph><subparagraph id="id09910fb5-bf06-40f5-8b21-f731f47c30a1"><enum>(C)</enum><text>requires an eligible
				offender to receive the consent of the prosecutor or law enforcement officer
				involved to participate in the program;</text>
									</subparagraph><subparagraph id="id1269dda0-223e-45c0-8dcb-cbf9e30ef658"><enum>(D)</enum><text>in the case of an
				eligible offender who is sentenced to participate in the program, requires the
				offender to serve a sentence of imprisonment with respect to the crime involved
				if the prosecutor or law enforcement officer, in conjunction with the treatment
				provider, determines that the eligible offender has not successfully completed
				the relevant substance abuse treatment program described in subparagraph
				(B);</text>
									</subparagraph><subparagraph id="id128f0bdb-c686-46ab-b01a-c026f2ead71d"><enum>(E)</enum><text>provides for the
				dismissal of the criminal charges that lead to the participation of an eligible
				offender in the program if the eligible offender is determined to have
				successfully completed the program;</text>
									</subparagraph><subparagraph id="idc995b3e0-9712-45ed-a188-f7d1526b4399"><enum>(F)</enum><text>requires each substance
				abuse provider treating an eligible offender under the program to—</text>
										<clause id="idc748de75-6648-498f-b151-953d875077d6"><enum>(i)</enum><text>make periodic reports of
				the progress of the treatment of the eligible offender to the law enforcement
				officer involved and to the appropriate court in which the eligible offender
				was convicted; and</text>
										</clause><clause id="idcbf079c4-144d-4c23-a46f-c4dd460b751b"><enum>(ii)</enum><text>notify the prosecutor or
				law enforcement officer involved and the appropriate court if the eligible
				offender absconds from the facility of the treatment provider or otherwise
				violates the terms and conditions of the program, consistent with Federal and
				State confidentiality requirements; and</text>
										</clause></subparagraph><subparagraph id="id0e3aa93e-fce5-409c-a1f2-8b54bd5a48f3"><enum>(G)</enum><text>has an enforcement unit
				comprised of law enforcement officers involved, the duties of which shall
				include—</text>
										<clause id="id2c93800a-7f77-4db6-ab4c-ac38616f31dc"><enum>(i)</enum><text>verifying the address of
				an eligible offender and other contacts; and</text>
										</clause><clause id="id63637c38-0f97-4d12-aefa-ed2fe211fd24"><enum>(ii)</enum><text>if necessary, locating,
				apprehending, and arresting an eligible offender who has absconded from the
				facility of a substance abuse treatment provider or otherwise violated the
				terms and conditions of the program and returning the eligible offender to the
				appropriate court for sentencing for the crime involved.</text>
										</clause></subparagraph></paragraph><paragraph id="id0d57e186-24fb-4655-9c73-987035c042fb"><enum>(4)</enum><header>Reentry
				court</header><text>The term <term>reentry court</term> means a program
				that—</text>
									<subparagraph id="id6b05bf3f-d48f-4ac6-8357-f2e4acefad2f"><enum>(A)</enum><text>monitors juvenile and
				adult eligible offenders reentering the community;</text>
									</subparagraph><subparagraph id="idf0380bab-b233-4f66-99fc-e4d6eb5f0a0c"><enum>(B)</enum><text>provides juvenile and
				adult eligible offenders reentering the community with coordinated and
				comprehensive reentry services and programs, such as—</text>
										<clause id="idafa3f4be-039f-450a-909e-4431f8ea9f2d"><enum>(i)</enum><text>drug and alcohol testing
				and assessment for treatment;</text>
										</clause><clause id="id653560e1-7f53-4e1c-9397-ecdcbbb7c73f"><enum>(ii)</enum><text>assessment for substance
				abuse from a substance abuse professional who is approved by the State or
				Indian tribe and licensed by the appropriate entity to provide alcohol and drug
				addiction treatment, as appropriate;</text>
										</clause><clause id="idcb90d009-3a0f-4b06-9b41-363732b6e1b8"><enum>(iii)</enum><text>substance abuse
				treatment from a provider that is approved by the State or Indian tribe, and
				licensed, if necessary, to provide medical and other health services;</text>
										</clause><clause id="ideb8980d1-4fd6-4881-881b-3c87cbc2754b"><enum>(iv)</enum><text>health (including mental
				health) services and assessment;</text>
										</clause><clause id="id9b214fd0-700b-4783-b873-1cd87a62cb7f"><enum>(v)</enum><text>aftercare and case
				management services that—</text>
											<subclause id="iddf9b55c1-0dd1-49a9-98d3-f668db50d5ab"><enum>(I)</enum><text>facilitate access to
				clinical care and related health services; and</text>
											</subclause><subclause id="idfe02f834-c570-4c4d-a7fd-b03d3b8e2685"><enum>(II)</enum><text>coordinate with such
				clinical care and related health services; and</text>
											</subclause></clause><clause id="id1ba2cff8-6929-4fc9-aa56-4a5331f97459"><enum>(vi)</enum><text>any other services
				needed for reentry;</text>
										</clause></subparagraph><subparagraph id="id848421b9-9440-40e9-9432-ad6bcf5d17c5"><enum>(C)</enum><text>convenes community impact
				panels, victim impact panels, or victim impact educational classes;</text>
									</subparagraph><subparagraph id="idcfc5ffaa-06b5-45a1-a39f-0081df9bae18"><enum>(D)</enum><text>provides and coordinates
				the delivery of community services to juvenile and adult eligible offenders,
				including—</text>
										<clause id="idac787cdb-3967-47f5-8745-7cdd12b9ce63"><enum>(i)</enum><text>housing
				assistance;</text>
										</clause><clause id="id06e091b0-c280-450e-84bb-2168be78b5cc"><enum>(ii)</enum><text>education;</text>
										</clause><clause id="id02dc4adc-f56f-41a2-bd3f-a6b9ec6effff"><enum>(iii)</enum><text>job training;</text>
										</clause><clause id="idc9063d85-bef1-40b8-87ec-a9021c173ead"><enum>(iv)</enum><text>conflict resolution
				skills training;</text>
										</clause><clause id="idcef26a12-e66c-4f81-9165-d93447708371"><enum>(v)</enum><text>batterer intervention
				programs; and</text>
										</clause><clause id="id2a1a6d53-9502-4ad8-b0bf-2c1754a6422b"><enum>(vi)</enum><text>other appropriate social
				services; and</text>
										</clause></subparagraph><subparagraph id="id654541b6-6507-497e-8ea1-35f8d374a326"><enum>(E)</enum><text>establishes and
				implements graduated sanctions and incentives.</text>
									</subparagraph></paragraph></section><section id="iddc601223-826a-4a0f-85a2-ebc031891dd2"><enum>2902.</enum><header>Grant
				authority</header>
								<subsection id="id1d461345-d450-44f6-83c6-5f26f9d859a0"><enum>(a)</enum><header>In
				general</header><text>The Attorney General may make grants to States, local
				governments, territories, Indian tribes, nonprofit agencies, or any combination
				thereof, to develop, implement, or expand programs that provide alternatives to
				incarceration, in accordance with this part.</text>
								</subsection><subsection id="id84af7619-e28e-4ac4-b0e4-1c6c323e7251"><enum>(b)</enum><header>Allowable uses</header>
									<paragraph id="idf69ab7fe-a43c-45d6-9d37-8d21f4f8f5af"><enum>(1)</enum><header>In
				general</header><text>A grant under this part may be used for the expenses of a
				law enforcement or prosecution drug treatment alternatives to prison or jail
				program, a problem-solving court, including a reentry court, or a probation
				with enforcement program including for—</text>
										<subparagraph id="id8e7d29fc-bfa2-4eee-be21-3b5b51c3ad55"><enum>(A)</enum><text>salaries, personnel
				costs, equipment costs, and other costs directly related to the operation or
				evaluation of the program;</text>
										</subparagraph><subparagraph id="id1121a674-cf10-4eb9-95ba-f3eba1b519fa"><enum>(B)</enum><text>payments for providers
				that are approved by the State or Indian tribe and licensed, if necessary, to
				provide needed treatment or education to eligible offenders participating in
				the program, including aftercare supervision, mental health services, substance
				abuse services, vocational training, education, and job placement; and</text>
										</subparagraph><subparagraph id="idafba4e3a-fd5e-42c6-8524-b94cf63ce333"><enum>(C)</enum><text>payments to public and
				nonprofit private entities that are approved by the State or Indian tribe and
				licensed, if necessary, to provide mental health, alcohol and drug addiction
				treatment to offenders participating in the program.</text>
										</subparagraph></paragraph><paragraph id="id2f781bf4-2ccd-44b2-99e0-3aa7352f15c5"><enum>(2)</enum><header>Supplement and not
				supplant</header><text>Grants made under this part shall be used to supplement,
				and not supplant, non-Federal funds that would otherwise be available for
				programs described in this part.</text>
									</paragraph></subsection><subsection id="ide9784f31-c48b-4358-aff5-c6022efc0e55"><enum>(c)</enum><header>Applications</header>
									<paragraph id="id76032811-4301-4d5f-b321-76d70960529c"><enum>(1)</enum><header>In
				general</header><text>A State, local government, territory, Indian tribe, or
				nonprofit agency desiring a grant under this part shall submit an application
				to the Attorney General in such form and containing such information as the
				Attorney General may reasonably require.</text>
									</paragraph><paragraph id="ide122552b-8580-468e-ad70-ca6ca854c40c"><enum>(2)</enum><header>Application
				contents</header><text>An application submitted under paragraph (1)
				shall—</text>
										<subparagraph id="id00c14db3-e11e-4eea-b57d-7751f1a29d68"><enum>(A)</enum><text>describe the program to
				be assisted under this part and the need for the program to serve eligible
				offenders;</text>
										</subparagraph><subparagraph id="idf4caf520-50f8-4a18-aa82-14b5859f31f7"><enum>(B)</enum><text>describe a long-term
				strategy and detailed implementation plan for the program, including how the
				applicant plans to pay for the program after the Federal funding is
				discontinued;</text>
										</subparagraph><subparagraph id="id1e746349-db49-4ec3-89d6-8445df70a68c"><enum>(C)</enum><text>identify the governmental
				and community agencies the activities of which shall be coordinated under the
				project;</text>
										</subparagraph><subparagraph id="id2c1dea6c-13a6-4abf-bff9-4ccf82ec61d6"><enum>(D)</enum><text>certify that—</text>
											<clause id="idf117714c-4db4-4eeb-a6d9-10c3c69b0563"><enum>(i)</enum><text>all agencies affected by
				the program, including community corrections and parole entities, have been
				appropriately consulted in the development of the program; and</text>
											</clause><clause id="id9e0a5e11-6f7d-4d3a-ad8e-6fda2cb7d25f"><enum>(ii)</enum><text>there will be
				appropriate coordination with all such agencies in the implementation of the
				program; and</text>
											</clause></subparagraph><subparagraph id="id24475bf1-9351-4339-82a5-8ef6e0db8c90"><enum>(E)</enum><text>describe the methodology
				and outcome measures that will be used to evaluate the program.</text>
										</subparagraph></paragraph></subsection></section><section id="id5df8f204-63b8-4185-a7e1-874d569e48cf"><enum>2903.</enum><header>Federal
				share</header>
								<subsection id="ide7ef171c-6627-41e7-88c9-30a316d29d6c"><enum>(a)</enum><header>Matching
				requirement</header><text display-inline="yes-display-inline">The Federal share
				of the cost of an activity carried out using a grant under this part shall be
				not more than 50 percent.</text>
								</subsection><subsection id="id9059c6c4-29cb-40bc-ba55-5444434ec059"><enum>(b)</enum><header>In-Kind
				contributions</header>
									<paragraph id="id4eca0f97-64cf-42f7-9544-501fe85f9e9d"><enum>(1)</enum><header>In
				general</header><text>Subject to paragraph (2), the recipient of a grant under
				this part may meet the matching requirement under subsection (a) by making
				in-kind contributions of goods or services that are directly related to the
				purpose for which the grant was awarded.</text>
									</paragraph><paragraph id="id9a260504-dfce-467c-b3fe-e223918946c1"><enum>(2)</enum><header>Maximum
				percentage</header><text>Not more than 75 percent of the amount provided by a
				recipient of a grant under this part to meet the matching requirement under
				subsection (a) may be provided through in-kind contributions under paragraph
				(1).</text>
									</paragraph></subsection></section><section id="id47efb00f-b519-47c0-8655-2f44bcd9398a"><enum>2904.</enum><header>Geographic
				distribution</header><text display-inline="no-display-inline">The Attorney
				General shall ensure that, to the extent practicable, the distribution of
				grants under this part is equitable and includes States, local governments,
				territories, Indian tribes, or nonprofit agencies—</text>
								<paragraph id="id20252f9f-a398-4a50-8567-bb14479d94e6"><enum>(1)</enum><text>in each State; and</text>
								</paragraph><paragraph id="idcb86ceec-b6ea-4261-b157-4271592a5261"><enum>(2)</enum><text>in rural, suburban,
				tribal, and urban jurisdictions.</text>
								</paragraph></section><section id="id8ca7f39a-212a-4a6b-9668-de6fd55d485f"><enum>2905.</enum><header>Reports and
				evaluations</header><text display-inline="no-display-inline">Each entity
				receiving a grant under this section shall submit to the Attorney General, for
				each fiscal year in which funds received under the grant are expended, a
				report, at such time and in such manner as the Attorney General may reasonably
				require, that contains—</text>
								<paragraph id="idd3926ef1-7619-462e-8ace-417d49b2f1dd"><enum>(1)</enum><text>a summary of the
				activities carried out under the program assisted by the grant;</text>
								</paragraph><paragraph id="idaa826158-f823-4b7a-a2c8-b89c944fac02"><enum>(2)</enum><text>an assessment of whether
				the activities are meeting the need for the program identified in the
				application submitted under section 2902(c); and</text>
								</paragraph><paragraph id="id49c0ab4d-0646-4e4c-8c00-b4fbaa3e5e00"><enum>(3)</enum><text>such other information as
				the Attorney General may require.</text>
								</paragraph></section><section id="id4a30f15a-04e2-4f6a-902a-29e659b27e42"><enum>2906.</enum><header>Training and
				technical assistance</header><text display-inline="no-display-inline">The
				Attorney General may, using amounts made available to carry out this part,
				establish training and technical assistance for grantees, including—</text>
								<paragraph id="id4a68cdd4-a572-4342-9b4b-ebcc82197443"><enum>(1)</enum><text>providing education,
				training, and technical assistance for States, Indian tribes, territories,
				local governments, service providers, and nonprofit organizations relating to
				problem-solving courts, law enforcement or prosecution drug treatment
				alternative to prison or jail programs, and probation with enforcement
				programs;</text>
								</paragraph><paragraph id="idb37a2783-1b6a-4cce-9ffc-b1ac22412403"><enum>(2)</enum><text>collecting data and best
				practices from grantees and other agencies and organizations;</text>
								</paragraph><paragraph id="id26f633ec-d74e-417c-9b4b-0443cffe3edb"><enum>(3)</enum><text>developing and
				disseminating evaluation tools, mechanisms, and measures to better assess and

				to States and other relevant entities about best practices, policy standards,
				and research findings; and</text>
								</paragraph><paragraph id="id5c27efe1-1e76-4614-9ca1-a6ebb37c11db"><enum>(5)</enum><text>interdisciplinary and
				profession-specific training for relevant professionals on information and
				skills necessary to plan, implement, or expand problem-solving courts, law
				enforcement drug treatment alternative to prisons programs, and probation with
				enforcement programs.</text>
								</paragraph></section><section id="idd5d84ebc-fc5c-4419-b22c-569cfc62b90a"><enum>2907.</enum><header>Authorization of
				appropriations</header>
								<subsection id="id285694b9-b509-47a6-81d5-7d5af7158347"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">There are authorized
				to be appropriated to carry out this part—</text>

				may be used by the Attorney General for salaries and administrative expenses;
				and</text>

				nor less than 2 percent may be used for technical assistance and
				training.</text>

				construction</header><text display-inline="no-display-inline">Nothing in this
				part shall be construed to prevent a grantee that operates a drug court under
				part EE when the grant under this part is awarded from using funds from the
				grant under this part to supplement the drug court in accordance with section
				2902(b)(1).</text>

				factually innocent of the offense described in subparagraph (A); and</text>

				<term>offender</term> includes an
				exoneree.</text>

			 of grantees</header>
			<subsection id="id88f1f69f-4f65-4af2-9e6c-7676468d9c54"><enum>(a)</enum><header>Definition</header><text>In
			 this section, the term <quote>unresolved audit finding</quote> means an audit
			 report finding or recommendation that a grantee has used grant funds for an
			 unauthorized expenditure or otherwise unallowable cost that is not closed or
			 resolved during a 1-year period beginning on the date of an initial
			 notification of the finding or recommendation.</text>
			</subsection><subsection id="idf42b8220-19a1-4d8e-bea6-757263cd9cae"><enum>(b)</enum><header>Audit
			 requirement</header><text>Beginning in fiscal year 2012, and every 3 years
			 thereafter, the Inspector General of the Department of Justice shall conduct an
			 audit of not less than 10 percent of all grantees that are awarded funding
			 under—</text>
				<paragraph id="id34a127ad-df72-4d9c-83b9-66556f235b70"><enum>(1)</enum><text>section 2976(b) of title
			 I of the Omnibus Crime Control and Safe Streets Act of 1968 (42 U.S.C.
			 3797w(b));</text>
				</paragraph><paragraph id="id1b7a3054-0a3a-4b32-8354-a5de7d0a353f"><enum>(2)</enum><text>part CC of title I of the
			 Omnibus Crime Control and Safe Streets Act of 1968 (42 U.S.C. 3797q et seq.),
			 as amended by this Act;</text>
				</paragraph><paragraph id="id8ea78eef-24a1-4382-b746-0eb656d8c19a"><enum>(3)</enum><text>part DD of title I of the
			 Omnibus Crime Control and Safe Streets Act of 1968 (42 U.S.C. 3797s et
			 seq.);</text>
				</paragraph><paragraph id="idc3f0ee84-543c-400e-a4fc-e70b9b477115"><enum>(4)</enum><text>part JJ of title I of the
			 Omnibus Crime Control and Safe Streets Act of 1968 (42 U.S.C. 3797dd et seq.);
			 or</text>

			 of the Second Chance Act of 2007 (42 U.S.C. 17511, 17521, and 17531).</text>
				</paragraph></subsection><subsection id="id5e4fa124-ba3e-4526-8a81-4c14263560d0"><enum>(c)</enum><header>Mandatory
			 exclusion</header><text>A grantee that is found to have an unresolved audit
			 finding under an audit conducted under subsection (b) may not receive grant
			 funds under the grant programs described in paragraphs (1) through (5) of
			 subsection (b) in the 2 fiscal years following the fiscal year to which the
			 finding relates.</text>
			</subsection><subsection id="idCF05D0A87DD6406184A7592661404627"><enum>(d)</enum><header>Reimbursement</header><text>If
			 a grantee described in subsection (c) is awarded funds under a grant program
			 described subsection (b) during the 2-fiscal-year period in which the grantee
			 is barred from receiving grants under subsection (c), the Attorney General
			 shall pay to the General Fund of the Treasury an amount that is equal to the
			 amount that was improperly awarded to the grantee.</text>
			</subsection><subsection id="idf167b308-be82-4a68-9f39-66d63aaa3474"><enum>(e)</enum><header>Priority of grant
			 awards</header><text>The Attorney General, in awarding grants under the
			 programs described in paragraphs (1) through (5) of subsection (b) shall give
			 priority to eligible entities that during the 2-year period preceding the
			 application for a grant have not been found to have an unresolved audit
			 finding.</text>
			</subsection><subsection id="idDC185BAC8FB24B3C8C26D55EA0A055B9"><enum>(f)</enum><header>Nonprofit organization
			 requirements</header>
				<paragraph id="ID5005c2e7a1f14b9588e12807835ca4f6"><enum>(1)</enum><header>Definition</header><text>For
			 purposes of this section and the grant programs described in subsection (b),
			 the term <term>nonprofit organization</term> means an organization that is
			 described in section 501(c)(3) of the Internal Revenue Code of 1986 and exempt
			 from taxation under section 501(a) of such Code.</text>
				</paragraph><paragraph id="ID51d8182f25e248a2bfbc9cc31c3b9e7b"><enum>(2)</enum><header>Prohibition on awarding
			 of grants</header><text>The Attorney General may not award a grant under a
			 grant program described in subsection (b) to a nonprofit organization that
			 holds money in offshore accounts for the purpose of avoiding paying the tax
			 described in section 511(a) of the Internal Revenue Code of 1986.</text>
				</paragraph><paragraph id="ID4906dcd4b9214faa8db90f78bc2dba1b"><enum>(3)</enum><header>Disclosure</header><text>Each
			 nonprofit organization that is awarded a grant under a grant program described
			 in subsection (b) and uses the procedures prescribed in regulations to create a
			 rebuttable presumption of reasonableness for the compensation of its officers,
			 directors, trustees and key employees, shall disclose to the Attorney General,
			 in the application for the grant, the process for determining such
			 compensation, including the independent persons involved in reviewing and
			 approving such compensation, the comparability data used, and contemporaneous
			 substantiation of the deliberation and decision. Upon request, the Attorney
			 General shall make the information disclosed under this subsection available
			 for public inspection.</text>
				</paragraph></subsection></section><section changed="added" committee-id="SSJU00" id="id55cd1b62-828d-4e1c-a615-7bc1b608ac4e" reported-display-style="italic"><enum>4.</enum><header>Federal reentry
			 improvements</header>
			<subsection id="idcc426dbf-b809-48a0-9900-2216e6d2c39d"><enum>(a)</enum><header>Responsible
			 reintegration of offenders</header><text>Section 212 of the Second Chance Act
			 of 2007 (42 U.S.C. 17532) is repealed.</text>
			</subsection><subsection id="ide26d931b-a906-4ea1-963e-5fd39e5e620e"><enum>(b)</enum><header>Federal prisoner
			 reentry initiative</header><text>Section 231 of the Second Chance Act of 2007
			 (42 U.S.C. 17541) is amended—</text>

				</paragraph></subsection><subsection id="id2c57a930-0a20-4e68-bf91-1ebe3a0bbb37"><enum>(d)</enum><header>Termination of study on
			 effectiveness of depot naltrexone for heroin addiction</header><text>Section
			 244 of the Second Chance Act of 2007 (42 U.S.C. 17554) is repealed.</text>
			</subsection><subsection id="id0b7dc8bc-c680-49fa-940d-ff2c1559661a"><enum>(e)</enum><header>Authorization of
			 appropriations for research</header><text>Section 245 of the Second Chance Act
			 of 2007 (42 U.S.C. 17555) is amended—</text>
				<paragraph id="ide93af157-5b8f-4830-ac7f-883e4d59aeac"><enum>(1)</enum><text>by striking <quote>243,
			 and 244</quote> and inserting <quote>and 243</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6336766f-b9b4-4f50-908e-0128ad180025"><enum>(2)</enum><text>by striking <quote>2009
			 and 2010</quote> and inserting <quote>2012, 2013, 2014, 2015, and
			 2016</quote>.</text>
				</paragraph></subsection><subsection id="idd67838eb-75f9-4f3c-b608-ebb43fe83896"><enum>(f)</enum><header>Good time conduct
			 calculation</header>
				<paragraph id="idED900DB9FB594BF4BD343277ABD9A72B"><enum>(1)</enum><header>In
			 general</header><text>Section 3624(b) of title 18, United States Code, is
			 amended—</text>
					<subparagraph id="ID1fea75d5d0cf40ccada087fa796d39f6"><enum>(A)</enum><text>by striking paragraph (1)
			 and inserting the following:</text>
						<quoted-block changed="added" committee-id="SSJU00" display-inline="no-display-inline" id="idBA5DEE2D59C04C0F8BD6ABC0E4F969EF" reported-display-style="italic" style="OLC">
							<paragraph id="idEFA1B6ECFC0F40ECAAB67B5BB205309E"><enum>(1)</enum><text>Subject to paragraphs (2)
				and (3)(C), a prisoner who is serving a term of imprisonment of more than 1
				year, other than a term of imprisonment for the duration of the prisoner’s
				life, shall receive credit toward the service of the prisoner’s sentence, in
				addition to the time actually served by the prisoner, beginning on the date on
				which the sentence of the prisoner commences, at the rate of 54 days per year
				of sentence imposed, if the Bureau of Prisons determines that the prisoner has
				displayed exemplary compliance with institutional disciplinary
				regulations.</text>
							</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="ID9e9bd41645ff44e783d1c2160b39c54f"><enum>(B)</enum><text>by striking paragraphs
			 (3) and (4) and inserting the following:</text>
						<quoted-block changed="added" committee-id="SSJU00" display-inline="no-display-inline" id="idC44BFD58E17C4D6796017DDF6BFC97E8" reported-display-style="italic" style="OLC">
							<paragraph id="IDd300c49fefd44b9d8c4214146343a67e"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id751F536A58794417B0C31B850D6E5EAD"><enum>(A)</enum><text>This subsection shall
				apply to all prisoners serving a term of imprisonment for offenses committed on
				or after November 1, 1987.</text>
								</subparagraph><subparagraph changed="added" committee-id="SSJU00" id="idFD83E62D98CB4352BBC8FAF75692D197" indent="up1" reported-display-style="italic"><enum>(B)</enum><text>With respect to a
				prisoner serving a term of imprisonment on the date of enactment of the Second
				Chance Reauthorization Act of 2011, this subsection shall apply to the entirety
				of the sentence imposed on the prisoner, including time already served.</text>
								</subparagraph><subparagraph changed="added" committee-id="SSJU00" id="id4EB3F705B05E4D0D962FD85BCA780A03" indent="up1" reported-display-style="italic"><enum>(C)</enum><text>A prisoner may not be
				awarded credit under this subsection that would cause the prisoner to be
				eligible for release earlier than the time already served by the prisoner on
				the imposed
				sentence.</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="idCC4D52D927734CD9B1C4071DBA94EBCA"><enum>(2)</enum><header>Effective
			 date</header><text>The amendments made by paragraph (1) shall take effect 90
			 days after the date of enactment of this Act.</text>
				</paragraph></subsection><subsection id="idD64160A965D6428E9EE74B0511990AC9"><enum>(g)</enum><header>Federal prisoner
			 recidivism reduction programming enhancement</header>
				<paragraph id="id921b13a4-22a8-4955-8ce1-f861d4baf547"><enum>(1)</enum><header>In
			 general</header><text>Section 3621 of title 18, United States Code, is
			 amended—</text>
					<subparagraph id="id32ab87f0-63b6-4604-a14a-95fbffc6afea"><enum>(A)</enum><text>by redesignating
			 subsection (g) as subsection (i); and</text>
					</subparagraph><subparagraph id="id3eb5d456-9975-42c1-8b1f-b16f85e389b6"><enum>(B)</enum><text>by inserting after
			 subsection (f) the following:</text>
						<quoted-block changed="added" committee-id="SSJU00" display-inline="no-display-inline" id="id28059dbe-50ae-4fdd-8fe9-555a9bf53808" reported-display-style="italic" style="OLC">
							<subsection id="ida35b251a-1461-4c8b-8263-e6d105f9f6fd"><enum>(g)</enum><header>Incentive for
				prisoners' participation in reentry programs proven To reduce
				recidivism</header>
								<paragraph id="id3f04e677-f7f9-49a5-818a-1f61982f94b7"><enum>(1)</enum><header>Definitions</header><text>In
				this subsection—</text>
									<subparagraph id="id15780960-4b2d-4242-96b6-52577cddc4bd"><enum>(A)</enum><text>the term
				<quote>demonstrated to reduce recidivism</quote> means that the Director of
				Bureau of Prisons has determined that appropriate research has been conducted
				and has validated the effectiveness of the program on recidivism; and</text>
									</subparagraph><subparagraph id="id4804b2ba-3e74-4808-a8b0-18b82d1bb57f"><enum>(B)</enum><text>the term
				<quote>successfully participates</quote> means that a prisoner has been
				enrolled for a period of not less than 180 days during the 12 months preceding
				the award of credit in 1 or more programs—</text>
										<clause id="id50f180cc-993c-4e98-82c8-ec2d53ce6e49"><enum>(i)</enum><text>for which the prisoner is
				eligible; and</text>
										</clause><clause id="idfd47f75c-b44a-4d0b-8994-09429a65bf90"><enum>(ii)</enum><text>that meet the treatment
				and program needs of the prisoner.</text>
										</clause></subparagraph></paragraph><paragraph id="idBE5C11E6A07D4B99B9EBECF55F1EB4C7"><enum>(2)</enum><header>Eligibility to earn
				additional credit</header>
									<subparagraph id="id08EAFFB4109C4D1E94BD6D0FDC54747C"><enum>(A)</enum><header>In
				general</header><text>Except as provided in subparagraph (B), any prisoner who,
				in the judgment of the Director of the Bureau of Prisons, successfully
				participates in a program that has been demonstrated to reduce recidivism, is
				eligible to earn additional credit toward satisfaction of the sentence being
				served by the prisoner.</text>
									</subparagraph><subparagraph id="idF7DD2CCBA21B4D47983A2D23A52FD9D0"><enum>(B)</enum><header>Limitation on
				eligibility</header><text>Any prisoner who has more than 1 conviction for an
				offense involving rape or has been convicted of a sex offense against a minor
				is not eligible to earn additional credit toward satisfaction of the sentence
				being served by the prisoner under subparagraph (A).</text>
									</subparagraph></paragraph><paragraph id="id71fe9f46-b02a-432f-9ef1-6b5e8c4b2412"><enum>(3)</enum><header>Credit toward service
				of sentence</header><text>Except as provided in paragraph (4), a prisoner may
				receive credit toward service of the sentence of the prisoner of up to 60 days
				per year for each year in which the prisoner is in custody of the Bureau of
				Prisons and successfully participates in a program described in paragraph (2).
				Any credits awarded under this subsection shall vest on the date the prisoner
				is released from custody.</text>
								</paragraph><paragraph id="id461e58f5-ddb6-415f-b231-eb660c00798e"><enum>(4)</enum><header>Limitation on awards of
				credit</header>
									<subparagraph id="id4436efe3-2742-41b0-877c-30d98046f7cb"><enum>(A)</enum><header>In
				general</header><text>A prisoner may accrue credit toward service of the
				sentence of the prisoner under this subsection if the credit accrued under this
				subsection, when combined with any reductions in the period of time the
				prisoner remains in custody resulting from participation in a residential
				substance abuse program and credit received under section 3624(b), does not
				exceed 33 percent of the sentence imposed on the prisoner.</text>
									</subparagraph><subparagraph id="id39a8b0ed-ee8c-4632-9b0c-74d2269d57b2"><enum>(B)</enum><header>Prior time
				credit</header><text>No credits shall be awarded for any time spent in—</text>
										<clause id="id38d1aac2-0443-4dc4-aa49-2b3670771bdc"><enum>(i)</enum><text>programs during the
				180-day period preceding the enactment of the <short-title>Second Chance Reauthorization Act of 2011</short-title>;
				or</text>
										</clause><clause id="id19dc8ca1-833f-4da1-b6a0-ce2700e495b9"><enum>(ii)</enum><text>official detention prior
				to the date the sentence commences under section 3585(a).</text>
										</clause></subparagraph></paragraph><paragraph id="idda9dc1c7-d6f8-4972-abd6-49e1a3959306"><enum>(5)</enum><header>Receipt of credit at
				end of year</header><text>A prisoner may receive credit at the end of each year
				of the sentence being served by the prisoner, beginning at the end of the first
				year of the sentence, subject to a determination by the Director by the Bureau
				of Prisons that during the year the prisoner display exemplary compliance with
				institutional disciplinary regulations. For purposes of this section, the first
				year shall commence on the date the sentence commences under section
				3585(a).</text>
								</paragraph></subsection><subsection id="id28C7B4600EF34BA2B736899D8472242D"><enum>(h)</enum><header>Partnerships to Expand
				Access to Reentry Programs Proven to Reduce Recidivism</header>
								<paragraph id="ID8f518ef4cbb844a58bc9511b067ba7a1"><enum>(1)</enum><header>Definitions</header><text>The
				term <term>demonstrated to reduce recidivism</term> means that the Director of
				Bureau of Prisons has determined that appropriate research has been conducted
				and has validated the effectiveness of the type of program on
				recidivism.</text>
								</paragraph><paragraph id="ID0cd8e3795b6b42bb921d2c338da75175"><enum>(2)</enum><header>Eligibility for
				recidivism reduction partnership</header><text>A faith-based or community-based
				nonprofit organization that provides mentoring or other programs that have been
				demonstrated to reduce recidivism is eligible to enter into a recidivism
				reduction partnership with a prison or community-based facility operated by the
				Bureau of Prisons.</text>
								</paragraph><paragraph id="ID73729b44413249c1b70328392f942cfd"><enum>(3)</enum><header>Recidivism reduction
				partnerships</header><text>The Director of the Bureau of Prisons shall develop
				policies to require wardens of prisons and community-based facilities to enter
				into recidivism reduction partnerships with faith-based and community-based
				nonprofit organizations that are willing to provide, on a volunteer basis,
				programs described in paragraph (2).</text>
								</paragraph><paragraph id="IDac5972023b6643039a9dd6a95ccf5a8b"><enum>(4)</enum><header>Reporting
				requirement</header><text>The Director of the Bureau of Prisons shall submit to
				Congress an annual report on the last day of each fiscal year that—</text>
									<subparagraph id="id83774F690CF842B0BAD4C90B1628AA7C"><enum>(A)</enum><text>details, for each prison
				and community-based facility for the fiscal year just ended—</text>
										<clause id="ID6f712a7a597d4b84a4f5cf900d1976d2"><enum>(i)</enum><text>the number of recidivism
				reduction partnerships under this section that were in effect;</text>
										</clause><clause id="ID8a7a5a9b84bc40ad888c60b5b0825220"><enum>(ii)</enum><text>the number of volunteers
				that provided recidivism reduction programming; and</text>
										</clause><clause id="ID05a71705c7ad475eb1b2c15c8c03660e"><enum>(iii)</enum><text>the number of
				recidivism reduction programming hours provided; and</text>
										</clause></subparagraph><subparagraph id="id175C73DA50914C3E92E55888FBC720D8"><enum>(B)</enum><text>explains any disparities
				between facilities in the numbers reported under subparagraph
				(A).</text>
									</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id36edc8de-bd60-4ebe-9f71-ccdad2def6ec"><enum>(2)</enum><header>Effective
			 date</header><text>The amendments made by paragraph (1) shall take effect 180
			 days after the date of enactment of this Act.</text>
				</paragraph></subsection></section><section changed="added" committee-id="SSJU00" id="idF7FF7FAD290D4056AA4F148ACFCEEEB2" reported-display-style="italic"><enum>5.</enum><header>GAO study and
			 report</header>
			<subsection id="id2592856276D24056852F6205A74712E8"><enum>(a)</enum><header>Study</header><text display-inline="yes-display-inline">The Comptroller General of the United
			 States shall conduct a study that—</text>
				<paragraph id="id1924595811014D2FBA7320A976312E75"><enum>(1)</enum><text>identifies all programs
			 and initiatives for prisoners within the custody of the Federal Government that
			 focus on prisoner reentry, criminal recidivism, substance abuse treatment,
			 mentoring, or career training; and</text>
				</paragraph><paragraph id="idDE496E6B7660412BB93F69D2228BC6A0"><enum>(2)</enum><text>evaluates whether there
			 are any programs or initiatives identified under paragraph (1) that are
			 duplicative or overlapping in nature.</text>
				</paragraph></subsection><subsection id="id926EFDCB7DF84A1D81AB7B823AAD2BD1"><enum>(b)</enum><header>Report</header><text>The
			 Comptroller shall submit to Congress a report on the findings of the study
			 conducted under subsection (a), which shall include—</text>
				<paragraph id="id5D6B260195F74A13A27BB09A93149095"><enum>(1)</enum><text>a description of the cost
			 of any duplicative or overlapping programs or initiatives; and</text>
				</paragraph><paragraph id="id9184935738D6451AADD61F5C6A456EEB"><enum>(2)</enum><text>recommendations
			 on—</text>
					<subparagraph id="idB164882830094547AE16D59B35160077"><enum>(A)</enum><text>how to achieve cost
			 savings within the programs and initiatives identified under subsection (a)(1);
			 and</text>
					</subparagraph><subparagraph id="idFA339C0AE1214C488D947424476BE05B"><enum>(B)</enum><text>which Federal agency
			 would be best equipped to administer the programs and initiatives.</text>
					</subparagraph></paragraph></subsection></section></legis-body>
