			 <quote><short-title>Combating Military Counterfeits Act of
			 2011</short-title></quote>.</text>

			 counterfeit military goods or services</header>
			<subsection id="idB57F53551E6A4DFAAF0C0718F6D3886B"><enum>(a)</enum><header>Trafficking in
			 counterfeit military goods or services</header><text>Section 2320 of title 18,
			 United States Code, is amended—</text>
				<paragraph id="id64678D2FD27D4420A6719B5FB16FD162"><enum>(1)</enum><text>in subsection (a),
			 by adding at the end the following:</text>

						<paragraph id="id118330281C644483A1D5E256DB063EA3"><enum>(3)</enum><header>Military goods
				or services</header>
							<subparagraph id="id216E31463A204D42B18FA9A393E570E1"><enum>(A)</enum><header>In
				general</header><text>A person who commits an offense under paragraph (1) shall
				be punished in accordance with subparagraph (B) if—</text>
								<clause id="id45B9EBCE39964C228903E8C16C763D0D"><enum>(i)</enum><text>the offense
				involved a good or service described in paragraph (1) that if it malfunctioned,
				failed, or was compromised, could reasonably be expected to cause—</text>
									<subclause id="id072CFE492ED148BE87D0A4D0D4FAEFF2"><enum>(I)</enum><text>serious bodily
				injury or death;</text>
									</subclause><subclause id="idA564B837067F41F89FD659F647FA6630"><enum>(II)</enum><text>disclosure of
				classified information;</text>
									</subclause><subclause id="id5C53ABF60566413D8FE226B1ABDE656B"><enum>(III)</enum><text>impairment of
				combat operations; or</text>
									</subclause><subclause id="idD5F594E1AB554837AE32D1DE40DC774D"><enum>(IV)</enum><text>other significant
				harm to a member of the Armed Forces or to national security; and</text>
									</subclause></clause><clause id="idBE7E80793F5A4265B4309EF2FFB57F39"><enum>(ii)</enum><text>the person had
				knowledge that the good or service is falsely identified as meeting military
				standards or is intended for use in a military or national security
				application.</text>
								</clause></subparagraph><subparagraph id="id7F96B2D14D6641068FB9249ACBF41E69"><enum>(B)</enum><header>Penalties</header>
								<clause id="id073FC61D427246139AA53279C5E54FBE"><enum>(i)</enum><header>Individual</header><text>An
				individual who commits an offense described in subparagraph (A) shall be fined
				not more than $5,000,000, imprisoned for not more than 20 years, or
				both.</text>
								</clause><clause id="id054325A7F4004C6C958542A144A083CA"><enum>(ii)</enum><header>Person other
				than an individual</header><text>A person other than an individual that commits
				an offense described in subparagraph (A) shall be fined not more than
				$15,000,000.</text>
								</clause></subparagraph><subparagraph id="idF1F78074F65F4731A91DAD2026C55F1E"><enum>(C)</enum><header>Subsequent
				offenses</header>
								<clause id="id6ED334B2323740A3AA900446F67FE69E"><enum>(i)</enum><header>Individual</header><text>An
				individual who commits an offense described in subparagraph (A) after the
				individual is convicted of an offense under subparagraph (A) shall be fined not
				more than $15,000,000, imprisoned not more than 30 years, or both.</text>
								</clause><clause id="id416CBE936C8646129E8946A9132A6CC2"><enum>(ii)</enum><header>Person other
				than an individual</header><text>A person other than an individual that commits
				an offense described in subparagraph (A) after the person is convicted of an
				offense under subparagraph (A) shall be fined not more than
				$30,000,000.</text>
								</clause></subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="id98D6328690874C5B9D14C60926EA7E33"><enum>(2)</enum><text>in subsection
			 (e)—</text>
					<subparagraph id="idFD8F1E33081048AB855F7872762B43FA"><enum>(A)</enum><text>in paragraph (1),
			 by striking the period at the end and inserting a semicolon;</text>
					</subparagraph><subparagraph id="id4D9EDBFF567249E4B18A62B09641405B"><enum>(B)</enum><text>in paragraph (3),
			 by striking <quote>and</quote> at the end;</text>
					</subparagraph><subparagraph id="id7BF2ED866CC84E8F9508B005B06AB754"><enum>(C)</enum><text>in paragraph (4),
			 by striking the period at the end and a semicolon; and</text>
					</subparagraph><subparagraph id="idDF51C178EE2C44C49BA9CE140B8A5BA1"><enum>(D)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block changed="deleted" committee-id="SSJU00" display-inline="no-display-inline" id="idF2F0A62E969B4B76805CEAD7D3901096" reported-display-style="strikethrough" style="OLC">
							<paragraph id="id3540158394D74E44A0AB3634C428B93C"><enum>(5)</enum><text>the term
				<term>falsely identified as meeting military standards</term> relating to a
				good or service—</text>
								<subparagraph id="idCA49C333736849ACB5C701E9C77BBC35"><enum>(A)</enum><text>means the good or
				service—</text>
									<clause id="idCB5D1D93AFB14EB8A1102467F2DEAC6B"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="id6941EE7580814A3185B58D40DDD4F909"><enum>(I)</enum><text>bears a label, tag,
				stamp, product code, phrase, or emblem of any kind that indicates that the good
				or service meets a standard, requirement, or specification issued by the
				Department of Defense, an Armed Force, or a reserve component;</text>
										</subclause><subclause changed="deleted" committee-id="SSJU00" id="id8342B3BDD5C148C8B7F3CF4F8DF7BDF2" indent="up1" reported-display-style="strikethrough"><enum>(II)</enum><text>is packaged in a
				wrapper, container, box, case, or packaging of any type or nature which bears a
				label, tag, stamp, product code, phrase, or emblem of any kind which indicates
				that the good or services meets a standard, requirement, or specification
				issued by the Department of Defense, an Armed Force, or a reserve component;
				or</text>
										</subclause><subclause changed="deleted" committee-id="SSJU00" id="ID9897a419879a4d03afee26e6b2a0c1ee" indent="up1" reported-display-style="strikethrough"><enum>(III)</enum><text>is accompanied
				by or marketed with a certificate or other oral or written representation that
				the good or service meets a standard, requirement, or specification issued by
				the Department of Defense, an Armed Force, or a reserve component; and</text>
										</subclause></clause><clause id="id23017F70C47C482487D13E41EB8E45D3"><enum>(ii)</enum><text>does not meet the
				standard, requirement, or specification of the Department of Defense, an Armed
				Force, or a reserve component that is indicated or represented in a manner
				described in clause (i); and</text>
									</clause></subparagraph><subparagraph id="id1D07BB74F64E4DB8AED66AD78EAE298B"><enum>(B)</enum><text>shall not apply
				to—</text>
									<clause id="id0A8885E412944178BD55011FA53F6DA9"><enum>(i)</enum><text>the identification
				of a good or service in a manner that is unlikely to cause confusion, to cause
				mistake, or to deceive; or</text>
									</clause><clause id="id7E22CCCD66F74CCB998074187C9BC6A9"><enum>(ii)</enum><text>a good or service
				if the standard, requirement, or specification issued by the Department of
				Defense, an Armed Force, or a reserve component has only a de minimis
				relationship to national security or the safety of the members of the Armed
				Forces; and</text>
									</clause></subparagraph></paragraph><paragraph id="id2A13BB5EBB4C4B75B565942B909D10D2"><enum>(6)</enum><text>the term <term>use
				in a military or national security application</term> means the use of a good
				or service, independently, in conjunction with, or as a component of another
				good or service—</text>
								<subparagraph id="id9AE95DB06E254741BD40271F8F3EFD83"><enum>(A)</enum><text>during the
				performance of the official duties of the Armed Forces of the United States or
				the reserve components of the Armed Forces; or</text>
								</subparagraph><subparagraph id="idEA8874CB75B54687B0CC0A4F96BE39CB"><enum>(B)</enum><text>by the United
				States to perform or directly support—</text>
									<clause id="id6ADA0039EDF64DD9AD5240B98DE2B7AC"><enum>(i)</enum><text>combat operations;
				or</text>
									</clause><clause id="idFC890E132E874FA38A04FE130B5C2F19"><enum>(ii)</enum><text>critical national
				defense or national security
				functions.</text>
									</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection id="id9D215E4BD7BF4FB5B1353DECD5682B8E"><enum>(b)</enum><header>Sentencing
			 guidelines</header>
				<paragraph id="id842AAB7241954F27A76658410A25A7CC"><enum>(1)</enum><header>Directive</header><text>The
			 United States Sentencing Commission shall review and, if appropriate, amend the
			 Federal sentencing guidelines and policy statements applicable to persons
			 convicted of an offense under section 2320(a) of title 18, United States Code,
			 to reflect the intent of Congress that penalties for such offenses be increased
			 in comparison to those provided on the day before the date of enactment of this
			 Act under the guidelines and policy statements.</text>
				</paragraph><paragraph id="idD278F05EC39A4A6FAF4A3C05EE948B6C"><enum>(2)</enum><header>Requirements</header><text>In
			 amending the Federal Sentencing Guidelines and policy statements under
			 paragraph (1), the United States Sentencing Commission shall—</text>
					<subparagraph id="idC589ED1DC6FC449488CC410B5AFB8EA4"><enum>(A)</enum><text>ensure that the
			 guidelines and policy statements, including section 2B5.3 of the Federal
			 Sentencing Guidelines (and any successor thereto), reflect—</text>
						<clause id="idCBD508806C02463D82A900C01C53F694"><enum>(i)</enum><text>the serious nature
			 of the offenses described in section 2320(a) of title 18, United States
			 Code;</text>
						</clause><clause id="id79A1E0FB73FE48FD983A51B35698AF3B"><enum>(ii)</enum><text>the need for an
			 effective deterrent and appropriate punishment to prevent offenses under
			 section 2320(a) of title 18, United States Code; and</text>
						</clause><clause id="id664B73A042A8477484985EB44EA6CBC5"><enum>(iii)</enum><text>the
			 effectiveness of incarceration in furthering the objectives described in
			 clauses (i) and (ii);</text>
						</clause></subparagraph><subparagraph id="id0848CC43D9744A49A948CA2CEA5D6DA0"><enum>(B)</enum><text>consider the
			 extent to which the guidelines appropriately account for the risk, even if
			 attenuated or unknown to the offender, to members of the Armed Forces of the
			 United States, military readiness, and national security resulting from an
			 offense committed under section 2320(a) of title 18, United States Code,
			 including in instances involving a limited value or quantity of goods or
			 services;</text>
					</subparagraph><subparagraph id="id66C49AB276ED47FB9111C2E060B4C430"><enum>(C)</enum><text>ensure reasonable
			 consistency with other relevant directives and guidelines and Federal
			 statutes;</text>
					</subparagraph><subparagraph id="id894B56D46A0147E99B7B7799772CFCD3"><enum>(D)</enum><text>make any necessary
			 conforming changes to the guidelines; and</text>
					</subparagraph><subparagraph id="idCA6B632087A14859B71789715C386206"><enum>(E)</enum><text>ensure that the
			 guidelines relating to offenses under section 2320(a) of title 18, United
			 States Code, adequately meet the purposes of sentencing, as described in
			 section 3553(a)(2) of title 18, United States Code.</text>
					</subparagraph></paragraph><paragraph id="id5A056423D297438DB3356B8A299B33DB"><enum>(3)</enum><header>Emergency
			 authority</header><text>The United States Sentencing Commission shall—</text>
					<subparagraph id="idBFF55FAC1E9141B5A92AB61595CA7A6B"><enum>(A)</enum><text>promulgate the
			 guidelines, policy statements, or amendments provided for in this Act as soon
			 as practicable, and in any event not later than 180 days after the date of
			 enactment of this Act, in accordance with the procedure set forth in section
			 21(a) of the Sentencing Act of 1987 (28 U.S.C. 994 note), as though the
			 authority under that Act had not expired; and</text>
					</subparagraph><subparagraph id="idCFE6AD73F00141AF8D2631B3ECA831A8"><enum>(B)</enum><text>pursuant to the
			 emergency authority provided under subparagraph (A), make such conforming
			 amendments to the Federal sentencing guidelines as the Commission determines
			 necessary to achieve consistency with other guideline provisions and applicable
			 law.</text>
					</subparagraph></paragraph></subsection></section></legis-body>
	<legis-body display-enacting-clause="no-display-enacting-clause">
		<section changed="added" committee-id="SSJU00" id="ida3b2e4eb-d295-4232-956c-85299b0f1dc7" reported-display-style="italic" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Combating Military Counterfeits Act of
			 2011</short-title></quote>.</text>
		</section><section changed="added" committee-id="SSJU00" id="id7fa4658a-5953-4984-9fa1-261f00ed45a6" reported-display-style="italic"><enum>2.</enum><header>Trafficking in
			 counterfeit military goods or services</header>
			<subsection id="id65d8d038-afb6-4f1c-8272-4c3b7fd2eccb"><enum>(a)</enum><header>Trafficking in
			 counterfeit military goods or services</header><text>Section 2320 of title 18,
			 United States Code, is amended—</text>
				<paragraph id="id9a31e8db-82ca-4a6b-bbc8-92e8cbef1787"><enum>(1)</enum><text>in subsection (a), by
			 adding at the end the following:</text>
					<quoted-block changed="added" committee-id="SSJU00" display-inline="no-display-inline" id="id31ebc9d3-3c58-41af-9629-d2242ae8359a" reported-display-style="italic" style="OLC">
						<paragraph id="id478441a0-e9cb-41b5-bc11-1b4241ec8a06"><enum>(3)</enum><header>Military goods or
				services</header>
							<subparagraph id="id9917e4f1-5186-45ba-a350-bc569cddd456"><enum>(A)</enum><header>In
				general</header><text>A person who commits an offense under paragraph (1) shall
				be punished in accordance with subparagraph (B) if—</text>
								<clause id="idadb630ae-2b99-4a67-825d-3de2aa5d9e22"><enum>(i)</enum><text>the offense involved a
				good or service described in paragraph (1) that if it malfunctioned, failed, or
				was compromised, could reasonably be foreseen to cause—</text>
									<subclause id="id7c39d915-a36e-4810-a422-efd130d86e51"><enum>(I)</enum><text>serious bodily injury or
				death;</text>
									</subclause><subclause id="id0da8b8e8-2547-4205-8191-aedd1ab174fd"><enum>(II)</enum><text>disclosure of classified
				information;</text>
									</subclause><subclause id="id4537b1f7-dd04-4059-8161-c447292258e0"><enum>(III)</enum><text>impairment of combat
				operations; or</text>
									</subclause><subclause id="idf0398a8b-db21-41e8-bdc1-7ce822627386"><enum>(IV)</enum><text>other significant harm
				to a member of the Armed Forces or to national security; and</text>
									</subclause></clause><clause id="idd77ca107-6bda-4126-a5ff-b644b1f188d6"><enum>(ii)</enum><text>the person had knowledge
				that the good or service is falsely identified as meeting military standards or
				is intended for use in a military or national security application.</text>
								</clause></subparagraph><subparagraph id="id9c5f7913-6966-4426-8bfc-30f8db389156"><enum>(B)</enum><header>Penalties</header>
								<clause id="idbb83b8f2-4a3c-4f6e-b334-872ee5db1d4f"><enum>(i)</enum><header>Individual</header><text>An
				individual who commits an offense described in subparagraph (A) shall be fined
				not more than $5,000,000, imprisoned for not more than 20 years, or
				both.</text>
								</clause><clause id="id8fffef26-4638-4348-bfe7-e7ae3ef25e8f"><enum>(ii)</enum><header>Person other than an
				individual</header><text>A person other than an individual that commits an
				offense described in subparagraph (A) shall be fined not more than
				$15,000,000.</text>
								</clause></subparagraph><subparagraph id="id31c8a847-ca97-4b2c-9827-bbea488464f0"><enum>(C)</enum><header>Subsequent
				offenses</header>
								<clause id="ide3b8c2f3-ba19-4f45-a396-474afe865531"><enum>(i)</enum><header>Individual</header><text>An
				individual who commits an offense described in subparagraph (A) after the
				individual is convicted of an offense under subparagraph (A) shall be fined not
				more than $15,000,000, imprisoned not more than 30 years, or both.</text>
								</clause><clause id="id9cda2225-b071-4483-a404-8e67194d3b83"><enum>(ii)</enum><header>Person other than an
				individual</header><text>A person other than an individual that commits an
				offense described in subparagraph (A) after the person is convicted of an
				offense under subparagraph (A) shall be fined not more than
				$30,000,000.</text>
								</clause></subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="id994cbd9e-036d-463e-96a1-cb80fb87606c"><enum>(2)</enum><text>in subsection (e)—</text>
					<subparagraph id="idc6b24bb3-0d82-42a6-ad3a-3e52353893e2"><enum>(A)</enum><text>in paragraph (1), by
			 striking the period at the end and inserting a semicolon;</text>
					</subparagraph><subparagraph id="ide8f38e42-392c-48df-9a0d-13bfdf8c917a"><enum>(B)</enum><text>in paragraph (3), by
			 striking <quote>and</quote> at the end;</text>
					</subparagraph><subparagraph id="ide4e59bcc-0f81-4c19-a30e-b1807103cf44"><enum>(C)</enum><text>in paragraph (4), by
			 striking the period at the end and inserting a semicolon; and</text>
					</subparagraph><subparagraph id="id662ab67f-35b3-4d85-b466-a14480b0a2ff"><enum>(D)</enum><text>by adding at the end the
			 following:</text>
						<quoted-block changed="added" committee-id="SSJU00" display-inline="no-display-inline" id="idebea8981-6b9f-4a67-8c94-72677c181e33" reported-display-style="italic" style="OLC">
							<paragraph id="id359798a1-554f-48ed-bbe2-682ceaf3c9d6"><enum>(5)</enum><text>the term <term>falsely
				identified as meeting military standards</term> relating to a good or service
				means there is a material misrepresentation that the good or service meets a
				standard, requirement, or specification issued by the Department of Defense, an
				Armed Force, or a reserve component; and</text>
							</paragraph><paragraph id="idb4763738-e308-4081-be64-cb896226ae39"><enum>(6)</enum><text>the term <term>use in a
				military or national security application</term> means the use of a good or
				service, independently, in conjunction with, or as a component of another good
				or service—</text>
								<subparagraph id="id11915ab8-d002-4845-aba1-fe78567ebac0"><enum>(A)</enum><text>during the performance of
				the official duties of the Armed Forces of the United States or the reserve
				components of the Armed Forces; or</text>
								</subparagraph><subparagraph id="id9047a54b-4412-4495-8586-5252473a5e4f"><enum>(B)</enum><text>by the United States to
				perform or directly support—</text>
									<clause id="id1ba7a2a0-0043-4aab-82fe-9a369ec9a566"><enum>(i)</enum><text>combat operations;
				or</text>
									</clause><clause id="id60954851-0b67-4511-ad26-9524bd88a63e"><enum>(ii)</enum><text>critical national
				defense or national security
				functions.</text>
									</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection id="id1d4569c0-da9e-49f8-a8d6-0e620ba4bb02"><enum>(b)</enum><header>Sentencing
			 guidelines</header>
				<paragraph id="id66CE991AD2754734AE5D0A6E27222845"><enum>(1)</enum><header>Definition</header><text>In
			 this subsection, the term <term>critical infrastructure</term> has the meaning
			 given that term in application note 13(A) of section 2B1.1 of the Federal
			 Sentencing Guidelines.</text>
				</paragraph><paragraph id="iddfe8d898-0196-4c5a-8cd3-22e61f22310c"><enum>(2)</enum><header>Directive</header><text>The
			 United States Sentencing Commission shall review and, if appropriate, amend the
			 Federal Sentencing Guidelines and policy statements applicable to persons
			 convicted of an offense under section 2320(a) of title 18, United States Code,
			 to reflect the intent of Congress that penalties for such offenses be increased
			 for defendants that sell infringing products to, or for the use by or for, the
			 Armed Forces or a Federal, State, or local law enforcement agency or for use in
			 critical infrastructure or in national security applications.</text>
				</paragraph><paragraph id="idbbff9a64-c9fd-44bb-839e-3e055a06fb65"><enum>(3)</enum><header>Requirements</header><text>In
			 amending the Federal Sentencing Guidelines and policy statements under
			 paragraph (2), the United States Sentencing Commission shall—</text>
					<subparagraph id="idb284cb4b-fc7e-4013-9f07-d9c7b946e66a"><enum>(A)</enum><text>ensure that the
			 guidelines and policy statements, including section 2B5.3 of the Federal
			 Sentencing Guidelines (and any successor thereto), reflect—</text>
						<clause id="id8023dba0-d446-40c8-8b72-421fc8584cec"><enum>(i)</enum><text>the serious nature of the
			 offenses described in section 2320(a) of title 18, United States Code;</text>
						</clause><clause id="id9656466d-1a24-4215-beb1-fb38e8a1c12a"><enum>(ii)</enum><text>the need for an
			 effective deterrent and appropriate punishment to prevent offenses under
			 section 2320(a) of title 18, United States Code; and</text>
						</clause><clause id="ide740cba3-8884-4c64-a6a1-a327e3f29446"><enum>(iii)</enum><text>the effectiveness of
			 incarceration in furthering the objectives described in clauses (i) and
			 (ii);</text>
						</clause></subparagraph><subparagraph id="idef4e48f3-bece-405d-ab68-45be88fd5fc5"><enum>(B)</enum><text>consider an appropriate
			 offense level enhancement and minimum offense level for offenses that involve a
			 product used to maintain or operate critical infrastructure, or used by or for
			 an entity of the Federal Government or a State or local government in
			 furtherance of the administration of justice, national defense, or national
			 security;</text>
					</subparagraph><subparagraph id="id338d218c-b829-4034-97d4-d675a61f05a0"><enum>(C)</enum><text>ensure reasonable
			 consistency with other relevant directives and guidelines and Federal
			 statutes;</text>
					</subparagraph><subparagraph id="idcc047ef7-5b35-4e66-8ee7-8673f08f3925"><enum>(D)</enum><text>make any necessary
			 conforming changes to the guidelines; and</text>
					</subparagraph><subparagraph id="id90955e4a-f59a-4644-ad98-fb753ac43be3"><enum>(E)</enum><text>ensure that the
			 guidelines relating to offenses under section 2320(a) of title 18, United
			 States Code, adequately meet the purposes of sentencing, as described in
			 section 3553(a)(2) of title 18, United States Code.</text>
					</subparagraph></paragraph><paragraph id="id8170289a-e5a3-42f6-afc2-3a98ca5bda3f"><enum>(4)</enum><header>Emergency
			 authority</header><text>The United States Sentencing Commission shall—</text>
					<subparagraph id="id28b2a962-3d9a-4c4e-aeec-d48637ce669d"><enum>(A)</enum><text>promulgate the
			 guidelines, policy statements, or amendments provided for in this Act as soon
			 as practicable, and in any event not later than 180 days after the date of
			 enactment of this Act, in accordance with the procedure set forth in section
			 21(a) of the Sentencing Act of 1987 (28 U.S.C. 994 note), as though the
			 authority under that Act had not expired; and</text>
					</subparagraph><subparagraph id="idc905fdf8-554f-401e-acbd-6803b73975a3"><enum>(B)</enum><text>pursuant to the emergency
			 authority provided under subparagraph (A), make such conforming amendments to
			 the Federal Sentencing Guidelines as the Commission determines necessary to
			 achieve consistency with other guideline provisions and applicable law.</text>
					</subparagraph></paragraph></subsection></section></legis-body>
