		<official-title>To amend the Clean Air Act to address air pollution from
		  Outer Continental Shelf activities.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Offshore Energy and Jobs
			 Permitting Act of 2011</short-title></quote>.</text>
		</section><section id="ID927feebcb3474db0b5774568b3517c71"><enum>2.</enum><header>Air quality
			 measurement</header><text display-inline="no-display-inline">Section 328(a)(1)
			 of the Clean Air Act (42 U.S.C. 7627(a)(1)) is amended in the second sentence
			 by inserting before the period at the end the following: <quote>, except that
			 any air quality impact of any OCS source shall be measured or modeled, as
			 appropriate, and determined solely with respect to the impacts in the
			 corresponding onshore area</quote>.</text>
		</section><section id="IDd1f98fa862b048dabe13a7cd5bfb385c"><enum>3.</enum><header>Outer
			 Continental Shelf source</header><text display-inline="no-display-inline">Section 328(a)(4) of the Clean Air Act (42
			 U.S.C. 7627(a)(4)) is amended—</text>
			<paragraph id="idF37E7808334C46649864BF4F2D39628D"><enum>(1)</enum><text display-inline="yes-display-inline">in the matter preceding subparagraph (A),
			 by striking <quote>subsections (a) and (b)</quote> and inserting <quote>this
			 subsection and subsections (b) and (d)</quote>; and</text>
			</paragraph><paragraph id="idA48D29A7582C47658DED6112EC89B7E4"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (C)—</text>
				<subparagraph id="idDE0A3DF79FD342E087E1C79D39EDFEEB"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating clauses (i) through (iii)
			 as subclauses (I) through (III), respectively, and by indenting the subclauses
			 appropriately;</text>
				</subparagraph><subparagraph id="id3DA8AFE32A3B46FD87E1E1CE5C7A1F46"><enum>(B)</enum><text>by striking
			 <quote>The terms</quote> and inserting <quote>(i)
			 <header-in-text level="clause" style="OLC">In general</header-in-text>.—The
			 terms</quote>; and</text>
				</subparagraph><subparagraph id="idECEC6C1C5B5F43188A01151F76AE5584"><enum>(C)</enum><text>by striking the
			 undesignated matter following subclause (III) (as redesignated by subparagraph
			 (A)) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="idAAE270C215FC4E30A55FF754BFB44952" style="OLC">
						<clause id="idF7F2F4D4739B4107B92E352855395B34"><enum>(ii)</enum><header>OCS source
				activity</header><text>An OCS source activity includes platform and drill ship
				exploration, construction, development, production, processing, and
				transportation.</text>
						</clause><clause id="idCBC4C6B8FF49472080F35E70FB8F1A2D"><enum>(iii)</enum><header>Emissions</header><text>Emissions
				from any vessel servicing or associated with an OCS source, including emissions
				while at the OCS source or en route to or from the OCS source within 25 miles
				of the OCS source—</text>
							<subclause id="id1A157EF2825E4B5093589BE8E41E9ED5"><enum>(I)</enum><text>shall be
				considered direct emissions from the OCS source; but</text>
							</subclause><subclause id="idEAEE6D9FAF1143049893872AB6FBF027"><enum>(II)</enum><text>shall not be
				subject to any emission control requirement applicable to the source under
				subpart 1 of part C of title I.</text>
							</subclause></clause><clause id="id81B5AD6A63FF4002BB483EF018230DA9"><enum>(iv)</enum><header>Platform or
				drill ship exploration</header><text>For platform or drill ship exploration, an
				OCS source is established at the point in time when drilling commences at a
				location and ceases to exist when drilling activity ends at that location or is
				temporarily interrupted because the platform or drill ship relocates for
				weather or other
				reasons.</text>
						</clause><after-quoted-block>.</after-quoted-block></quoted-block>
				</subparagraph></paragraph></section><section id="ID9aef3674929c4823bd6edfc40b5d82ba"><enum>4.</enum><header>Permits</header><text display-inline="no-display-inline">Section 328 of the Clean Air Act (42 U.S.C.
			 7627) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="idA79E212659E84D1D985FF29F32CD7187" style="OLC">
				<subsection id="IDe7a5b955f08d419e8622491cb7dce997"><enum>(d)</enum><header>Permit
				application</header><text>In the case of a completed application for a permit
				under this Act for platform or drill ship exploration for an OCS source—</text>
					<paragraph id="ID8125dc9376864c47adaac2e0e6b99d95"><enum>(1)</enum><text>final agency
				action (including any reconsideration of the issuance or denial of the permit)
				shall be taken not later than 180 days after the date of filing the completed
				application;</text>
					</paragraph><paragraph id="ID840c46f8e8224787873af4afce64f089"><enum>(2)</enum><text>the Environmental
				Appeals Board of the Environmental Protection Agency shall have no authority to
				consider any matter relating to the consideration, issuance, or denial of the
				permit;</text>
					</paragraph><paragraph id="ID3388237de0654d7bb70bc3acc1707714"><enum>(3)</enum><text>no administrative
				stay of the effectiveness of the permit may extend beyond the date that is 180
				days after the date of filing the completed application;</text>
					</paragraph><paragraph id="ID5aef6719b9854c6fa183f14bfd027e06"><enum>(4)</enum><text>the final agency
				action shall be considered to be nationally applicable under section 307(b);
				and</text>
					</paragraph><paragraph id="ID5fbcc35cba5649e9bad1bcf5bc6675fc"><enum>(5)</enum><text>judicial review
				of the final agency action shall be available only in accordance with section
				307(b) without additional administrative review or
				adjudication.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
