		<official-title>To authorize the President to confiscate and vest certain
		  property of the Government of Libya and to authorize the use of that property
		  to provide humanitarian relief to and for the benefit of the people of Libya,
		  and for other purposes.</official-title>

		<section id="idBBF1B083481F46B18548EF02439FBABF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Libyan Assets for Humanitarian Relief
			 Act of 2011</short-title></quote>.</text>
		</section><section id="id0AFA2C26297940EEBC54914F17797DF9"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following
			 findings:</text>
			<paragraph id="idB31F6300CC1B4EAC967F62C97557EB31"><enum>(1)</enum><text>On February 26,
			 2011, the United Nations Security Council adopted Resolution 1970, which
			 imposed an asset freeze on Colonel Muammar Qaddafi and members of his
			 family.</text>
			</paragraph><paragraph id="idADC499122D9D41DBB31B4F7761789CF7"><enum>(2)</enum><text>On March 17,
			 2011, the United Nations Security Council adopted Resolution 1973, which
			 expanded the asset freeze to include the Central Bank of Libya, the Libyan
			 Investment Authority, the Libyan Foreign Bank, the Libyan Africa Investment
			 Portfolio, and the Libyan National Oil Corporation.</text>
			</paragraph><paragraph id="idDB811EF01C834C0DBB8D2D1A0F63CEA1"><enum>(3)</enum><text>The United
			 Nations Security Council stated in Resolution 1973 that the assets frozen would
			 <quote>at a later stage, as soon as possible, be made available to and for the
			 benefit of the people of the Libyan Arab Jamahiriya</quote>.</text>
			</paragraph><paragraph id="idC2FFA02B079E4A75BCE57CD7BC1DBB2C"><enum>(4)</enum><text>On March 3, 2011,
			 the President of the United States stated that <quote>Muammar Qaddafi has lost
			 the legitimacy to lead, and he must leave</quote>.</text>
			</paragraph><paragraph id="id75614090B99B4D6EA04BCC3D2ADE32FB"><enum>(5)</enum><text>On March 29,
			 2011, the Transitional National Council of the Libyan Republic issued <quote>A
			 Vision of a Democratic Libya</quote>, which stated that its goal is
			 <quote>building a free and democratic society and ensuring the supremacy of
			 international humanitarian law and human rights declarations</quote>, and that
			 <quote>[t]his can only be achieved through dialogue, tolerance, co-operation,
			 national cohesiveness and the active participation of all citizens</quote>. In
			 that statement, the Transitional National Council pledged itself, without
			 reservation, to the establishment of <quote>a constitutional civil and free
			 state</quote> that upholds intellectual and political pluralism and the
			 peaceful transfer of power and guarantees full citizenship rights to all
			 Libyans.</text>
			</paragraph><paragraph id="idB291FFC2A5E04282AF7C6BEBACF7EE5B"><enum>(6)</enum><text>On April 7, 2011,
			 Ali Aujali, the Official Representative to the United States of the
			 Transitional National Council of the Libyan Republic, wrote to the United
			 States Secretary of the Treasury and requested <quote>immediate access to some
			 of the frozen Qaddafi regime funds to purchase needed humanitarian supplies and
			 to support critical services such as hospitals, water distribution and
			 sanitation</quote>.</text>
			</paragraph><paragraph id="id20779367DE204296BBB6809DFDD68EC8"><enum>(7)</enum><text>On May 19, 2011,
			 the President of the United States, referring to the Transitional National
			 Council of the Libyan Republic, stated that <quote>the opposition has organized
			 a legitimate and credible interim council</quote>.</text>
			</paragraph></section><section id="idB3DADD1113B744CCBEE892DFE2D200B6"><enum>3.</enum><header>Authorization of
			 confiscation of property of the Government of Libya</header>
			<subsection id="id5759E0F3C59A45B39B94242DAB90A407"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The International
			 Emergency Economic Powers Act (50 U.S.C. 1701 et seq.) is amended by adding at
			 the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idB2B69C529BE2443B8FB1DA493E0581BA" style="OLC">
					<section id="idD6D0B37F7CCD4C64BF647BAB07E9C185"><enum>209.</enum><header>Authorization
				of confiscation of property of the Government of Libya</header>
						<subsection id="id6E493D211A184A4594A581D60F8FDF0C"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text>
							<paragraph id="idD2FEDA768E3940D1BA0CD4827539757C"><enum>(1)</enum><header>Appropriate
				congressional committees</header><text>The term <term>appropriate congressional
				committees</term> means—</text>
								<subparagraph id="id55FCAB53DF7D49ECAB4A7E6E6C4F3A58"><enum>(A)</enum><text>the Committee on
				Banking, Housing, and Urban Affairs and the Committee on Foreign Relations of
				the Senate; and</text>
								</subparagraph><subparagraph id="id98E152970AE44CF5B1B1980B888AD0B0"><enum>(B)</enum><text>the Committee on
				Financial Services and the Committee on Foreign Affairs of the House of
				Representatives.</text>
								</subparagraph></paragraph><paragraph id="id7D1BB4F9DC0F449394015E99F84FA937"><enum>(2)</enum><header>Executive
				agency</header><text>The term <term>executive agency</term> has the meaning
				given that term in section 133 of title 41, United States Code.</text>
							</paragraph><paragraph commented="no" id="idB0276A26BE154AF596B03707926029CC"><enum>(3)</enum><header>Government of
				Libya</header><text>The term <term>Government of Libya</term>—</text>
								<subparagraph commented="no" id="id26225155C46049A088B92BCE2613BE36"><enum>(A)</enum><text>means the
				Government of Libya on the date of the enactment of the
				<short-title>Libyan Assets for Humanitarian Relief Act of
				2011</short-title>, including any agency or instrumentality of that Government,
				any entity controlled by that Government, and the Central Bank of Libya;
				and</text>
								</subparagraph><subparagraph commented="no" id="id12D403B3F2C1445FB301D6223585AEA9"><enum>(B)</enum><text>does not include
				a successor government of Libya.</text>
								</subparagraph></paragraph><paragraph commented="no" id="id27552D8A106B4CD688C45E9CD08A3218"><enum>(4)</enum><header>Successor
				government of Libya</header><text>The term <term>successor government of
				Libya</term> means a successor government to the Government of Libya (as
				defined in paragraph (3)) that is recognized as the legitimate governing
				authority of Libya by the Government of the United States.</text>
							</paragraph></subsection><subsection id="id529DB6C9AE934F55BFF828086CEB1A0E"><enum>(b)</enum><header>Statement of
				policy</header><text display-inline="yes-display-inline">It is the policy of
				the United States to provide humanitarian relief to and for the benefit of the
				people of Libya and to support the aspirations of the people of Libya for
				democratic self-government.</text>
						</subsection><subsection id="id9D18E038FE334912BD5F9DEB3888DC07"><enum>(c)</enum><header>Authorization
				of confiscation of property of the Government of Libya</header>
							<paragraph id="id75BD84A44F5A4300BE85338529CA3D9E"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The President—</text>
								<subparagraph id="id740A021E7DEA449784D64C1D1E3EBFBB"><enum>(A)</enum><text display-inline="yes-display-inline">may confiscate and vest, through
				instructions or licenses or in such other manner as the President determines
				appropriate, funds and other property of the Government of Libya that are
				subject to the jurisdiction of the United States in the amounts specified in
				subsection (f);</text>
								</subparagraph><subparagraph id="idDC94B2DD2B2C4918AD5DFFD195B4CD74"><enum>(B)</enum><text>may liquidate or
				sell any of such property; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id94C789B008FB4BA3A0B409A3296CFB8E"><enum>(C)</enum><text>shall deposit any
				funds confiscated and vested under subparagraph (A) and any funds resulting
				from the liquidation or sale of property under subparagraph (B) in the account
				established under subsection (d).</text>
								</subparagraph></paragraph><paragraph id="idE0045CBD8C5E4B17AC8E86D539F90209"><enum>(2)</enum><header>Vesting</header><text>All
				right, title, and interest in funds and other property confiscated under
				paragraph (1) shall vest in the Government of the United States.</text>
							</paragraph></subsection><subsection commented="no" id="id24F41C0FE2F04BC2B3410EABBA8BCCA6"><enum>(d)</enum><header>Establishment
				of account for confiscated property</header>
							<paragraph commented="no" id="id55E9158C721B4508BCB6E4372E5BAF2C"><enum>(1)</enum><header>In
				general</header><text>The President shall establish a non-interest-bearing
				account to consist of the funds deposited into the account under subsection
				(c)(1)(C).</text>
							</paragraph><paragraph commented="no" id="idE05526A6DD8D46C4B57DC9CEDA04C7B8"><enum>(2)</enum><header>Use of
				funds</header><text>The funds in the account established under paragraph (1)
				shall be available to be used only as specified in subsection (e)(1).</text>
							</paragraph></subsection><subsection id="id51BB4CE5432D4C1B9FD655F16053645C"><enum>(e)</enum><header>Use of
				confiscated property To provide humanitarian relief to the people of
				Libya</header>
							<paragraph id="id5BCF4C2F7FCE4F31A1FEFE99787E33F7"><enum>(1)</enum><header>In
				general</header><text>Subject to paragraph (2), the President may transfer
				funds from the account established under subsection (d)—</text>
								<subparagraph id="id129BDFB37D754CBBA4AAD865CCDB8B41"><enum>(A)</enum><text>to such executive
				agencies and, subject to paragraph (3), such other persons as the President
				determines appropriate, to be used only for costs related to providing
				humanitarian relief to and for the benefit of the people of Libya, consistent
				with the purposes of United Nations Security Council Resolutions 1970 (2011)
				and 1973 (2011); and</text>
								</subparagraph><subparagraph id="idBA9B74E79B1543DBB61B47CFFAD293A0"><enum>(B)</enum><text>on and after the
				date on which a successor government of Libya is recognized by the Government
				of the United States, to the successor government of Libya.</text>
								</subparagraph></paragraph><paragraph id="id22AB6EBBAADB4312AEEA6AC369B53322"><enum>(2)</enum><header>Limitations on
				transfer of funds</header>
								<subparagraph id="idE25CF0F342884EA1BC25BD68312CAD72"><enum>(A)</enum><header>Limitations on
				transfer to certain persons and organizations</header><text>None of the funds
				transferred under this subsection may knowingly be provided to—</text>
									<clause id="id100EE0FB06384BED850313212099FD44"><enum>(i)</enum><text>an organization
				designated as a foreign terrorist organization under section 219(a) of the
				Immigration and Nationality Act (8 U.S.C. 1189(a));</text>
									</clause><clause id="idF284A64C8E1F4C738B598EA0D9FDCBF7"><enum>(ii)</enum><text>a person that
				provides support for acts of international terrorism or for an organization
				described in clause (i);</text>
									</clause><clause id="id8E50CE61B317461794D3A073A071910A"><enum>(iii)</enum><text>a person whose
				property or interests in property are blocked pursuant to this Act, unless the
				transfer is authorized by the Secretary of the Treasury; or</text>
									</clause><clause id="id1A5B96DD1A344D14B6B65BF52174396E"><enum>(iv)</enum><text>a person the
				President determines is responsible for violations of internationally
				recognized human rights.</text>
									</clause></subparagraph><subparagraph commented="no" id="id4E362E24FF72491791D38C9DF460A9FF"><enum>(B)</enum><header>Prohibition on
				use of funds for military purposes</header><text>None of the funds transferred
				under this subsection may be used to purchase weapons or military equipment of
				either a lethal or nonlethal nature.</text>
								</subparagraph></paragraph><paragraph id="id62DBE7FEB7DC4F99B3CB537B1C6B2697"><enum>(3)</enum><header>Certifications
				by certain persons</header><text>The President may not transfer funds to any
				person, other than an executive agency, under paragraph (1)(A) unless that
				person certifies to the President that the person—</text>
								<subparagraph id="id4FED9CC18A0F40A5B78391C81560884F"><enum>(A)</enum><text>will use such
				funds only for the costs described in paragraph (1)(A); and</text>
								</subparagraph><subparagraph id="idB1C96D90129D416998792519B89148C2"><enum>(B)</enum><text>will not—</text>
									<clause id="idF556E5DFDCAA494DACBEB913086B3D58"><enum>(i)</enum><text>transfer any of
				such funds to a person or organization described in paragraph (2)(A); or</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="idDDAA7EE3827A4B54B03A07BFAFF0B64C"><enum>(ii)</enum><text>use any of such
				funds to purchase weapons or military equipment of either a lethal or nonlethal
				nature.</text>
									</clause></subparagraph></paragraph><paragraph id="idDB5509D030294B7093B45C95CFF0FE52"><enum>(4)</enum><header>Terms and
				conditions</header><text>If the President exercises the authority provided
				under this section, the President shall impose such additional terms and
				conditions as the President determines appropriate with respect to the transfer
				of funds under this subsection and with respect to the use of such
				funds.</text>
							</paragraph><paragraph commented="no" id="idFF00F94AB72D48B29B855BEFAE0F6EC5"><enum>(5)</enum><header>Use by
				executive agencies</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law,
				any funds transferred to an executive agency under this subsection—</text>
								<subparagraph commented="no" id="id7FEF425A7D5E41DA91D89349B9423D19"><enum>(A)</enum><text display-inline="yes-display-inline">shall remain available until
				expended;</text>
								</subparagraph><subparagraph commented="no" id="idB4D90CE57EB444899EF9C06FB787DB3A"><enum>(B)</enum><text display-inline="yes-display-inline">shall be used only for the costs described
				in paragraph (1)(A);</text>
								</subparagraph><subparagraph commented="no" id="idA43852E211AE44A7BA91C8FC041F5BEF"><enum>(C)</enum><text display-inline="yes-display-inline">may be distributed in such manner as the
				head of the executive agency determines appropriate to accomplish the purposes
				of this section, including through grants and contributions; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id14761F1529E147B8BE407844477B017B"><enum>(D)</enum><text display-inline="yes-display-inline">may be transferred among executive
				agencies.</text>
								</subparagraph></paragraph></subsection><subsection id="id658842ABC9E14D68A55B1BB0047ED574"><enum>(f)</enum><header>Initial and
				subsequent authorizations of confiscation of property</header>
							<paragraph id="ID616be06316ff4d72b6cd29b22f27a862"><enum>(1)</enum><header>Authority</header><text>The
				authority of the President to confiscate and vest funds and other property
				under subsection (c) shall be limited as follows:</text>
								<subparagraph id="IDbdc1fa854e8f45e6b9c4da6556ea084e"><enum>(A)</enum><header>Initial
				limitation</header><text>Effective on and after the date of the enactment of
				the <short-title>Libyan Assets for Humanitarian Relief Act
				of 2011</short-title>, the President may confiscate and vest not more than
				$4,000,000,000 under subsection (c).</text>
								</subparagraph><subparagraph id="ID897dd5d5634048a28c517048a6a2f42e"><enum>(B)</enum><header>Confiscation
				and vesting of additional amounts</header>
									<clause id="idADC444D192B94FA4A045C77687BCE180"><enum>(i)</enum><header>In
				general</header><text>If, at any one time after the date of the enactment of
				the <short-title>Libyan Assets for Humanitarian Relief Act
				of 2011</short-title>, the President submits to Congress the notification
				described in clause (ii), effective on and after the day after the end of the
				30-day period beginning on the date on which that notification is submitted,
				the President may confiscate and vest not more than an additional
				$4,000,000,000 under subsection (c) over the amount authorized to be
				confiscated and vested under subparagraph (A), unless a joint resolution of
				disapproval described in paragraph (2) is enacted within the 30-day period
				after the notification is submitted.</text>
									</clause><clause id="ID305523632bd848918047ecd4f6921797"><enum>(ii)</enum><header>Notification
				described</header><text>The notification described in this clause is a
				notification—</text>
										<subclause id="idF0418416F51A4923BBCBADD9B0B3433A"><enum>(I)</enum><text>that the
				President intends to confiscate and vest the additional amount specified in
				clause (i) to be used for the costs described in subsection (e)(1)(A);
				and</text>
										</subclause><subclause id="id126419B96A4140A0A7CC3875172D8EAB"><enum>(II)</enum><text>submitted with a
				report—</text>
											<item id="idCFB795E54F474C9A8E3C7279D85F5866"><enum>(aa)</enum><text>describing the
				necessity of confiscating and vesting that additional amount; and</text>
											</item><item id="id9F21EADE447E4B799EBE5253B9D12CFF"><enum>(bb)</enum><text>detailing the
				plan of the President with respect to the use of that additional amount.</text>
											</item></subclause></clause></subparagraph><subparagraph id="idC21F07DEBAB1412192E86CDB5CA5E705"><enum>(C)</enum><header>Emergency
				certification; confiscation and vesting to address emergency humanitarian
				needs</header>
									<clause id="idBBEF108B0C8644EF81A6773786BA2F7A"><enum>(i)</enum><header>In
				general</header><text>If, at any one time after the date of the enactment of
				the <short-title>Libyan Assets for Humanitarian Relief Act
				of 2011</short-title>, the President submits to Congress the certification
				described in clause (ii), effective on and after the date on which that
				certification is submitted, the President may confiscate and vest not more than
				an additional $2,000,000,000 under subsection (c) over the amounts otherwise
				authorized to be confiscated and vested under this paragraph.</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="idD27E270C3F2B4E678813AA6CF88E199D"><enum>(ii)</enum><header>Certification
				described</header><text>The certification described in this clause is a
				certification by the President that it is necessary to confiscate and vest the
				additional amount specified in clause (i) to address an emergency need for
				additional humanitarian assistance.</text>
									</clause></subparagraph></paragraph><paragraph id="id70E2E0AB4650495CBA12C6769FAFFEDD"><enum>(2)</enum><header>Joint
				resolution of disapproval</header>
								<subparagraph commented="no" id="idBEDED472EB9F4D10945CB9DB623373AE"><enum>(A)</enum><header>Joint
				resolution of disapproval</header><text>In this paragraph, the term <term>joint
				resolution of disapproval</term> means only a joint resolution of the 2 Houses
				of Congress, the sole matter after the resolving clause of which is as follows:
				<quote>That Congress disapproves of the confiscation and vesting of the amount
				of funds or other property specified in section 209(f)(1)(B)(i) of the
				International Emergency Economic Powers Act.</quote>.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idBE6E2FE5F78549F3B03099BAF90A1672"><enum>(B)</enum><header display-inline="yes-display-inline">Procedures for considering
				resolutions</header>
									<clause id="id9DC2DC25B2064A04AE273CD33DABAB68"><enum>(i)</enum><header>Introduction</header><text>A
				joint resolution of disapproval—</text>
										<subclause id="id10485D58CCAD46BEB1AA3027F574F217"><enum>(I)</enum><text>may be introduced
				in the House of Representatives or the Senate during the 10-day period
				beginning on the date on which a notification described in paragraph (1)(B)(ii)
				is submitted;</text>
										</subclause><subclause id="id7EF3EAAF53E4415293C22489F53EC463"><enum>(II)</enum><text>in the House of
				Representatives, may be introduced by any Member of the House of
				Representatives;</text>
										</subclause><subclause id="id31ED6CE169734C3DA14BEFB9424470E6"><enum>(III)</enum><text>in the Senate,
				may be introduced by any Member of the Senate; and</text>
										</subclause><subclause id="idA8676416D128431A823AF06EFD52D3F6"><enum>(IV)</enum><text>may not be
				amended.</text>
										</subclause></clause><clause commented="no" display-inline="no-display-inline" id="id182A6F62EED84C49B367E52647E772C8"><enum>(ii)</enum><header>Referral to
				committees</header><text display-inline="yes-display-inline">A joint resolution
				of disapproval introduced in the Senate shall be referred to the Committee on
				Banking, Housing, and Urban Affairs and a joint resolution of disapproval
				introduced in the House of Representatives shall be referred to the Committee
				on Foreign Affairs.</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="id77F312A8340345A6B58720DA83279FDA"><enum>(iii)</enum><header display-inline="yes-display-inline">Committee discharge and floor
				consideration</header><text display-inline="yes-display-inline">The provisions
				of subsections (c) through (f) of section 152 of the
				<act-name parsable-cite="TA74">Trade Act of 1974</act-name> (19 U.S.C. 2192)
				(relating to committee discharge and floor consideration of certain resolutions
				in the House of Representatives and the Senate) apply to a resolution of
				disapproval under this paragraph to the same extent as such subsections apply
				to joint resolutions under such section 152, except that—</text>
										<subclause commented="no" display-inline="no-display-inline" id="id39AA4E0774E94FB3BC2D244B975BBD3C"><enum>(I)</enum><text>subsection (c)(1)
				of such section 152 shall be applied and administered by substituting <quote>10
				days</quote> for <quote>30 days</quote>; and</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="id39425C4A24EA4F899054A58DE145F408"><enum>(II)</enum><text>subsection
				(f)(1)(A)(i) of such section 152 shall be applied and administered by
				substituting <quote>Committee on Banking, Housing, and Urban Affairs</quote>
				for <quote>Committee on Finance</quote>.</text>
										</subclause></clause></subparagraph><subparagraph id="ID725f3541dfa740879e2ea0bc5f9a875f"><enum>(C)</enum><header>Rules of House
				of Representatives and Senate</header><text>This paragraph is enacted by
				Congress—</text>
									<clause id="IDe65ec8e086d7410eaa3e04135e91f2ad"><enum>(i)</enum><text>as an exercise of
				the rulemaking power of the Senate and the House of Representatives,
				respectively, and as such is deemed a part of the rules of each House,
				respectively, but applicable only with respect to the procedure to be followed
				in that House in the case of a joint resolution, and it supersedes other rules
				only to the extent that it is inconsistent with such rules; and</text>
									</clause><clause id="ID7a47823c50dc451e9dae23d7a8e46161"><enum>(ii)</enum><text>with full
				recognition of the constitutional right of either House to change the rules (so
				far as relating to the procedure of that House) at any time, in the same manner
				and to the same extent as in the case of any other rule of that House.</text>
									</clause></subparagraph></paragraph></subsection><subsection id="id2D9FE19182A84450998ED38F070BFD1E"><enum>(g)</enum><header>Recordkeeping</header>
							<paragraph id="id89C9E807E8EA41929018AA771FBABA2F"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The President may, in
				exercising the authority provided under this section, require any person to
				keep a full record of—</text>
								<subparagraph id="idC5D294B9FC024295A344D72AA826E357"><enum>(A)</enum><text display-inline="yes-display-inline">any act or transaction carried out pursuant
				to any regulation, instruction, license, order, or direction issued under this
				section, either before, during, or after the completion of the act or
				transaction;</text>
								</subparagraph><subparagraph id="id12D70148832E45408586FE3C32D412ED"><enum>(B)</enum><text display-inline="yes-display-inline">any property in which any foreign country
				or any national of a foreign country has or has had any interest; and</text>
								</subparagraph><subparagraph id="id908E76EBBEEB494D8DEDB1586BD2B089"><enum>(C)</enum><text display-inline="yes-display-inline">any other information the President
				determines necessary to carry out the provisions of this section.</text>
								</subparagraph></paragraph><paragraph id="id1C8D468602154886876512C982E4410D"><enum>(2)</enum><header>Production of
				information</header><text display-inline="yes-display-inline">The President may
				require any person—</text>
								<subparagraph id="id2EDAF79EB30C43B79A46ABC4EE2D3C5C"><enum>(A)</enum><text display-inline="yes-display-inline">to provide any information required to be
				kept by the person under paragraph (1) under oath and in the form of reports or
				any other form; and</text>
								</subparagraph><subparagraph id="id1933B5D3B2BB4752B5DFD7531FC79098"><enum>(B)</enum><text display-inline="yes-display-inline">to produce any books of account, records,
				contracts, letters, memoranda, or other papers in the custody or control of the
				person that relate to any information required to be kept under paragraph
				(1).</text>
								</subparagraph></paragraph></subsection><subsection id="idEF93DBB657304ABCA8AB78E3DAB726F2"><enum>(h)</enum><header>Reports on use
				of funds</header>
							<paragraph id="idDF156CFAC19A45519196322A5169EF10"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Not later than 90
				days after the President first confiscates and vests funds or other property
				under subsection (c), and every 90 days thereafter, the President shall submit
				to the appropriate congressional committees a report detailing, for the 90-day
				period preceding the submission of the report—</text>
								<subparagraph id="id6EA0033CD6BE4E0096980BA6C3D08247"><enum>(A)</enum><text display-inline="yes-display-inline">the amount of funds and other property
				confiscated and transferred under this section;</text>
								</subparagraph><subparagraph id="id2EE581130A3F42F3A71B1DF1D4AE3F26"><enum>(B)</enum><text>the executive
				agencies and other persons to which such funds were transferred;</text>
								</subparagraph><subparagraph id="id45B3EF9CE82144A2B33A91340877FBCA"><enum>(C)</enum><text>the manner in
				which such funds were used; and</text>
								</subparagraph><subparagraph id="idC0A25EE09B814E178EBA04D3F0C5B1E5"><enum>(D)</enum><text>the amount
				remaining in the account established under subsection (d) at the end of the
				90-day period.</text>
								</subparagraph></paragraph><paragraph id="id13D5B293608D470A984823C81C575996"><enum>(2)</enum><header>Special rule
				with respect to report relating to authorization of confiscation of additional
				amounts</header><text>If, after the date on which a report is required to be
				submitted by paragraph (1) and before the next such report is required to be
				submitted, the President submits to the appropriate congressional committees
				the report described in subsection (f)(1)(B)(ii)(II), the President—</text>
								<subparagraph id="idE311A9501A8F4D9EA445EE4D05E1E706"><enum>(A)</enum><text>shall include in
				the report described in subsection (f)(1)(B)(ii)(II) the information required
				to be included in the report required by paragraph (1) for the period
				that—</text>
									<clause id="id5D4467379AF549B6B416015652F116BC"><enum>(i)</enum><text>begins on the
				date on which the last report required by paragraph (1) was required to be
				submitted; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="idBF0D0499D0D94C978A25AFADD7AA11F8"><enum>(ii)</enum><text>ends on the date
				on which the President submits the report described in subsection
				(f)(1)(B)(ii)(II); and</text>
									</clause></subparagraph><subparagraph id="id414172665F4D4326A2D5EA565EEE12ED"><enum>(B)</enum><text>may include in
				the next report required by paragraph (1) only the information required by
				paragraph (1) for the period—</text>
									<clause id="id77C5CCD096704B5A944A014B05DE7F33"><enum>(i)</enum><text>beginning on the
				date on which the report described in subsection (f)(1)(B)(ii)(II) is
				submitted; and</text>
									</clause><clause id="idABC75D7104B042D4B8DDDD9929C3871B"><enum>(ii)</enum><text>ending on the
				date on which the report required by paragraph (1) is required to be
				submitted.</text>
									</clause></subparagraph></paragraph></subsection><subsection commented="no" id="id32B6849FEE114EF6855EC16E3C0E4D3C"><enum>(i)</enum><header>Government
				Accountability Office Report</header><text display-inline="yes-display-inline">Not later than 180 days after the date of
				the enactment of the <short-title>Libyan Assets for
				Humanitarian Relief Act of 2011</short-title>, and every 180 days thereafter,
				the Comptroller General of the United States shall submit to the appropriate
				congressional committees a report assessing the confiscation and vesting of
				funds and other property under subsection (c) and the use of funds under
				subsection (e).</text>
						</subsection><subsection id="id7FFA030B1D8048F3A69A9166585BBF5F"><enum>(j)</enum><header>Penalties</header><text display-inline="yes-display-inline">The penalties provided for in subsections
				(b) and (c) of section 206 shall apply to a person that violates, attempts to
				violate, conspires to violate, or causes a violation of this section or any
				regulation, instruction, license, order, or direction issued under this section
				to the same extent that such penalties apply to a person that commits an
				unlawful act described in section 206(a).</text>
						</subsection><subsection id="id9CB789C5FD30470AAF0ECB8CDA97F23C"><enum>(k)</enum><header>Judicial
				review</header>
							<paragraph id="id579B3FA598234B3DA3133210C0CCF227"><enum>(1)</enum><header>Safe
				harbor</header><text>A person that complies fully with a regulation,
				instruction, license, order, or direction issued under this section may not be
				held liable for a violation of this section.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDC7C62A1FC0D42438D0D8164F1C7B5CA"><enum>(2)</enum><header>Good faith
				compliance</header><text>A person may not be held liable in any court for or
				with respect to any act or omission done in good faith in connection with the
				administration of, or pursuant to and in reliance on, this section, or any
				regulation, instruction, license, order, or direction issued under this
				section.</text>
							</paragraph><paragraph commented="no" id="id939ECC3954244BDCB1A269F832648831"><enum>(3)</enum><header>No legal
				process with respect to confiscated property</header><text>Any funds or other
				property confiscated and vested under subsection (c), including any proceeds
				from the liquidation or sale of such property, shall be immune from any legal
				process or attachment.</text>
							</paragraph><paragraph commented="no" id="id858EEABDC87F472EB8B342CB9757E8EE"><enum>(4)</enum><header>Actions taken
				under this section</header><text>No action taken under this section, other than
				the imposition of penalties with respect to a person under subsection (j),
				shall be reviewable in any court in the United States.</text>
							</paragraph><paragraph commented="no" id="id05B90665836E44EF98122E3DCF479B92"><enum>(5)</enum><header>Rule of
				construction</header><text>This section does not create any right or benefit,
				substantive or procedural, that is enforceable at law or in equity by any party
				against the United States, any agency of the United States, any officer or
				employee of the United States, or any other person.</text>
							</paragraph></subsection><subsection id="idACB9EB21792D47B6B2FC486B75C75073"><enum>(l)</enum><header>Termination</header>
							<paragraph id="idD266135B280141D6AABB29ED4088019C"><enum>(1)</enum><header>In
				general</header><text>Except to the extent necessary to carry out the plan
				required by paragraph (2), the provisions of this section (other than
				subsections (a), (g), (j), (k), and (m)) shall terminate on the date described
				in paragraph (3).</text>
							</paragraph><paragraph id="idDC74ED7E451A4EAAB255091066F05AFE"><enum>(2)</enum><header>Plan for
				distribution of remaining amounts</header><text>On the date described in
				paragraph (3), the President shall submit to the appropriate congressional
				committees a report describing the plan of the President for using any funds
				remaining of the amounts confiscated and vested under this section that—</text>
								<subparagraph id="id626B0D3639D34D058E535EE394D7453C"><enum>(A)</enum><text>describes how any
				of such funds that are obligated as of that date will be expended; and</text>
								</subparagraph><subparagraph id="id989A1262ABDC4206AA56CC7C7D3561EB"><enum>(B)</enum><text>provides for the
				distribution of any of such funds that are unobligated as of that date to a
				successor government of Libya.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idEF321150C0FD42338B1B019B7D4C8403"><enum>(3)</enum><header>Date
				described</header><text>The date described in this paragraph is the date on
				which the national emergency declared by the President with respect to Libya
				pursuant to section 202 expires and is not continued by the President.</text>
							</paragraph></subsection><subsection id="idD36D8956EF18482CA5AE64E527745DCD"><enum>(m)</enum><header>Regulations</header><text display-inline="yes-display-inline">The President shall prescribe such
				regulations as may be necessary to carry out the provisions of this
				section.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="idFACACB3D8C964283B47A4932419C5213"><enum>(b)</enum><header>Clerical
			 amendment</header><text>Section 204 of the International Emergency Economic
			 Powers Act (50 U.S.C. 1703) is amended—</text>
				<paragraph id="idDCF9B1739B1D44CDBFA849B04AE9BF62"><enum>(1)</enum><text>in subsection
			 (b), by striking <quote>Whenever</quote> and inserting <quote>Except as
			 provided in subsection (e), whenever</quote>; and</text>
				</paragraph><paragraph id="id85A9149AF6AA4CCDA2BC73B71336DC65"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id914519F304624DBE94330199982B70FE" style="OLC">
						<subsection id="id0CBC73EB4D9942D18883E8121A8E245F"><enum>(e)</enum><header>Reports
				relating to confiscation of assets of the Government of Libya</header><text>If
				the President exercises the authority provided under section 209, the President
				shall submit reports in accordance with subsection (h) of that
				section.</text>
