		<official-title>To amend the Help America Vote Act of 2002 to require new
		  voting systems to provide a voter-verified permanent record, to develop better
		  accessible voting machines for individuals with disabilities, and for other
		  purposes.</official-title>

		<section id="ID9247F1252C6844769DBD9223335225FB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Voting Integrity and Verification Act
			 of 2011</short-title></quote>.</text>
		</section><section id="IDC83B901F986A4D838A1D0E800C4CFEDF"><enum>2.</enum><header>Promoting
			 accuracy, integrity, and security through preservation of a voter-verified
			 permanent paper record</header>
			<subsection id="id007F684CAFA04A55B306012079C27CCA"><enum>(a)</enum><header>In
			 general</header><text>Section 301 of the Help America Vote Act of 2002 (42
			 U.S.C. 15481) is amended—</text>
				<paragraph id="id0D736F8AD3754405BB35744C09A9CEA5"><enum>(1)</enum><text>by redesignating
			 subsections (b), (c), and (d) as subsections (c), (d), and (e), respectively;
			 and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id46663ADEF436497483666788E06A06F3"><enum>(2)</enum><text>by inserting
			 after subsection (a) the following:</text>
					<quoted-block display-inline="no-display-inline" id="id33B24007454A49B5B1C13FE925FA80B9" style="OLC">
						<subsection id="id3670D6B16B1F415989EA4ECB025A6917"><enum>(b)</enum><header>Additional
				requirements for voting systems purchased after 2012</header><text>In addition
				to the requirements of subsection (a), each voting system purchased after
				December 31, 2012, and used in an election for Federal office shall meet the
				following requirements:</text>
							<paragraph id="id962D921F354144C3B6A0CFE8246EE989"><enum>(1)</enum><header>Individual
				permanent paper record</header><text>The voting system shall produce an
				individual permanent paper record for each ballot that is cast.</text>
							</paragraph><paragraph id="id4C7C7DD0C9EA4E62BB070A2D7F86B7CF"><enum>(2)</enum><header>Verification</header>
								<subparagraph id="id6B45B58057274B7783639C50573844A0"><enum>(A)</enum><header>In
				general</header><text>In lieu of the requirements of subsection (a)(1), the
				voting system shall—</text>
									<clause id="id6DE06C7F2E784B8FB370CB911934DDC2"><enum>(i)</enum><text>permit the voter
				to verify the accuracy of the voter's ballot (in a private and independent
				manner), by allowing the voter to review an individual paper version of the
				voter’s ballot before the voter’s ballot is cast and counted;</text>
									</clause><clause id="id966D6DED0D844F7386DBDFC1B2372D95"><enum>(ii)</enum><text>provide the
				voter with the opportunity (in a private and independent manner) to change the
				ballot and correct any error discovered on the individual paper version of the
				voter’s ballot before the ballot is cast and counted (including the opportunity
				to correct the error through the issuance of a replacement ballot if the voter
				was otherwise unable to change the ballot or correct any error); and</text>
									</clause><clause id="id8F87AA0C8527432EAA479363903FBC99"><enum>(iii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id62AC85C4A3EF41B39EF8BEEE5E1CD099"><enum>(I)</enum><text>preserve the individual
				paper version of the voter’s ballot, after the voter has certified that the
				same accurately reflects the voter’s intent, as the individual permanent paper
				record; and</text>
										</subclause><subclause id="id19540D522AC143B2AD44CA1470C6A137" indent="up1"><enum>(II)</enum><text>preserve such individual permanent paper
				record in accordance with the provisions of paragraph (3)(B); and</text>
										</subclause></clause><clause id="idC218F3647CF34D95A5B88BAA2B24EE28"><enum>(iv)</enum><text>meet the
				requirement of subparagraphs (A)(iii) and (C) of subsection (a)(1).</text>
									</clause></subparagraph><subparagraph id="id6DC3AE58321842DDAE7739BBA6AD1439"><enum>(B)</enum><header>Readability
				requirements for machine-marked or printed paper ballots</header><text>All
				voter verified paper ballots marked or printed through the use of a marking or
				printing device shall be clearly readable by the naked eye and by a scanner or
				other device equipped for voters with disabilities so that a voter is able to
				verify the accuracy of such ballots via both visual and non-visual
				means.</text>
								</subparagraph></paragraph><paragraph id="idE6D56B6B099B4A87B65157E91247F71E"><enum>(3)</enum><header>Manual audit
				capacity</header><text>In lieu of the requirements of subsection
				(a)(2)(B):</text>
								<subparagraph id="id8D6450A16F1D4F48A7555E193B4239E5"><enum>(A)</enum><header>In
				general</header><text>Each individual paper record produced under paragraph (1)
				shall be suitable for a manual audit equivalent or superior to that of a paper
				ballot voting system.</text>
								</subparagraph><subparagraph id="id073C88D885954063837F2089504AC638"><enum>(B)</enum><header>Preservation</header><text>The
				voting system shall preserve each individual permanent paper record—</text>
									<clause id="id1E5BBBABB50A401FAC21C23C7D8E6AD7"><enum>(i)</enum><text>within the
				polling place in the manner in which all other paper ballots are preserved
				within such polling place; or</text>
									</clause><clause id="id2140B8B169404CDABB90AEC59CF85D21"><enum>(ii)</enum><text>in the absence
				of such manner or method, in a manner which is consistent with the manner
				employed by the jurisdiction for preserving paper ballots in general.</text>
									</clause></subparagraph><subparagraph id="idFEDBCDB0DBD04F7E8C244BE12A5FC170"><enum>(C)</enum><header>Consistency
				with other records</header><text>All electronic records produced by any voting
				system shall be consistent with the individual permanent paper records produced
				by such voting system. In the event of any inconsistencies or irregularities
				between any electronic records and the individual permanent paper records, the
				individual permanent paper records shall be the true and correct record of the
				votes cast.</text>
								</subparagraph><subparagraph id="id1EF08AF64F5A47B9880551A1414FA5BB"><enum>(D)</enum><header>Use as official
				records</header><text>The individual permanent paper records shall be used as
				the official records for purposes of any recount or audit conducted with
				respect to any election for Federal office in which the voting system is
				used.</text>
								</subparagraph></paragraph><paragraph id="idF5EC8715A6414A6389C7E3A8E02B82E3"><enum>(4)</enum><header>Accessibility
				for individuals with disabilities</header><text>The voting system shall—</text>
								<subparagraph id="id8F1E80B6D7E34510BC1C70AE77407322"><enum>(A)</enum><text>meet the
				requirement of subsection (a)(3)(A) through the use of at least one voting
				system that is fully accessible for individuals with disabilities at each
				polling place; and</text>
								</subparagraph><subparagraph id="HC17A480612734357AE10D4EABE55D199"><enum>(B)</enum><text display-inline="yes-display-inline">meet the requirements of subsection
				(a)(3)(A) and paragraph (2)(A) by using a system that—</text>
									<clause id="id0E750C7663DF4699B790DFB7F3045C4B"><enum>(i)</enum><text display-inline="yes-display-inline">allows the voter to privately and
				independently verify the content of the permanent paper ballot through the
				conversion of the human readable content of the vote selections into accessible
				form;</text>
									</clause><clause id="idB5654C593ADF495493A67EFF085D4986"><enum>(ii)</enum><text display-inline="yes-display-inline">ensures that the entire process of ballot
				verification and vote casting is equipped for individuals with disabilities;
				and</text>
									</clause><clause id="idE0069F31970446678CE0CA34681EBF88"><enum>(iii)</enum><text display-inline="yes-display-inline">does not preclude the supplementary use of
				Braille or tactile
				ballots.</text>
									</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="idDA7B6230B85E447DBEB12F0C1C1C78E0"><enum>3.</enum><header>Award program
			 for development of accessible voting systems</header>
			<subsection id="id02C8B3DDB887443D8AA91C60D5D7FB47"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text>
				<paragraph id="id574A0E7113114570ABF1442A7725EB40"><enum>(1)</enum><header>Institute</header><text>The
			 term <term>Institute</term> means the National Institute of Standards and
			 Technology.</text>
				</paragraph><paragraph id="id62FD2DD9D6054E4E9380E01ECC3470AE"><enum>(2)</enum><header>Director</header><text>The
			 term <term>Director</term> means the Director of the Institute.</text>
				</paragraph><paragraph id="ID291322cba12e45868942d40b040f95de"><enum>(3)</enum><header>Voting
			 system</header><text>The term <term>voting system</term> has the meaning given
			 such term by section 301(b) of the Help America Vote Act of 2002 (42 U.S.C.
			 15481(b)).</text>
				</paragraph></subsection><subsection id="IDc8647c8ad5204f87bf9499c20108a510"><enum>(b)</enum><header>Establishment
			 of program</header>
				<paragraph id="ID4040c42ac8734cc9a3397969042949e5"><enum>(1)</enum><header>In
			 general</header><text>The Director shall establish a program to competitively
			 award cash prizes to eligible persons that advance the research, development,
			 demonstration, and application of voting systems which are specifically
			 designed to enhance accessibility and provide independence for persons with
			 disabilities during the voting process.</text>
				</paragraph><paragraph id="IDbf743c6c61164e3e84b7d81cc684a915"><enum>(2)</enum><header>Advertising and
			 solicitation of competitors</header>
					<subparagraph id="ID17b958a8727f42659b48c26c94f9b60e"><enum>(A)</enum><header>Advertising</header><text>The
			 Director shall widely advertise prize competitions to encourage broad
			 participation, including participation by individuals, universities, and large
			 and small businesses.</text>
					</subparagraph><subparagraph id="ID04e9872ce58042db8a3476bfe56eeae7"><enum>(B)</enum><header>Announcement
			 through Federal register notice</header><text>The Director shall announce each
			 prize competition by publishing a notice in the Federal Register. This notice
			 shall include the subject of the competition, the duration of the competition,
			 the eligibility requirements for participation in the competition, the process
			 for participants to register for the competition, the amount of the prize, and
			 the criteria for awarding the prize.</text>
					</subparagraph></paragraph><paragraph id="ID528c15df7a814ecf91fb2bff2370a40d"><enum>(3)</enum><header>Administration
			 of competitions</header><text>The Director shall enter into an agreement with a
			 private, nonprofit entity for the administration of the prize
			 competitions.</text>
				</paragraph></subsection><subsection id="id05423680175F49408C097F9992EB4618"><enum>(c)</enum><header>Prize
			 competitions</header>
				<paragraph id="id6CC4860052A3432DBB7296B31A899A48"><enum>(1)</enum><header>In
			 general</header><text>The program established under paragraph (1) shall consist
			 of competitions for the development of technology designed for persons with the
			 following classifications of disabilities:</text>
					<subparagraph id="idD43D1CD458C64AC2BE037ADEA6FE189D"><enum>(A)</enum><text>Hearing.</text>
					</subparagraph><subparagraph id="idCA415BAC6FE64D81A6F697D732C8F89D"><enum>(B)</enum><text>Visual.</text>
					</subparagraph><subparagraph id="id4F9847B39C8D41D8969EC41D2CD37A2E"><enum>(C)</enum><text>Manual, tactile,
			 and mobility.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id53538954F11841B2AAC0963373895980"><enum>(D)</enum><text>A combination of
			 the disabilities described in subparagraphs (A), (B), and (C).</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7AB36DE9A35A4D2491319FE3A55C312C"><enum>(2)</enum><header>Cash
			 prizes</header>
					<subparagraph id="id0C4547B97E554563A0960DC27F6FB644"><enum>(A)</enum><header>In
			 general</header><text>Prizes shall be awarded by the judges appointed under
			 paragraph (4) based on the criteria under paragraph (3).</text>
					</subparagraph><subparagraph id="idA0D85548DA7047059070BE81C065A329"><enum>(B)</enum><header>Authority to
			 not award prize</header><text>If the judges determine that no registered
			 participants meets the objective performance criteria established pursuant to
			 paragraph (3), no prize shall be awarded.</text>
					</subparagraph><subparagraph id="idB8C1274E2365459FBD0217637C72D491"><enum>(C)</enum><header>Limitation on
			 amount and number of prizes</header><text>No more than 2 prizes may be awarded
			 for any competition and the amount of any prize shall not exceed
			 $1,000,000.</text>
					</subparagraph></paragraph><paragraph id="id5359F8B5E4A8448F8E58EE02B6E6C805"><enum>(3)</enum><header>Criteria</header>
					<subparagraph id="id4A1C684A59CE47EE986B749D946F79AB"><enum>(A)</enum><header>In
			 general</header><text>The Director shall develop criteria for awarding prizes
			 under this section such that prizes are based on the functionality and
			 usability of a prototype accessible voting machine.</text>
					</subparagraph><subparagraph id="id2695FF9100FD4F2BAD96E43A386F52D6"><enum>(B)</enum><header>Requirements</header><text>The
			 criteria developed under subparagraph (A) shall—</text>
						<clause id="id1DC52BFEE5044ABEB21FA1E12DB9DA3B"><enum>(i)</enum><text>take into account
			 the challenges voters with disabilities face during the voting process,
			 including—</text>
							<subclause id="id84F40140A6CD4D18A57AF585A1E71DE8"><enum>(I)</enum><text>the need of
			 voters with manual disabilities to be able to use prosthetics and personal
			 assistive devices during the voting process without electromagnetic
			 interference;</text>
							</subclause><subclause id="idC3667AD4F6B74444AE5B4275B70FBC79"><enum>(II)</enum><text>the challenges
			 facing voters with visual impairments and the best means to accommodate those
			 voters, including, the need for voters to manually adjust font size (to account
			 for persons with poor vision and tunnel vision), color content, and contrast
			 for electronic voting machines;</text>
							</subclause><subclause id="id2F9F075295FF4B56B73C41A9B82F2FA5"><enum>(III)</enum><text>the need of
			 voters to use various voter system interfaces such as synchronized audio output
			 that allows the voter to adjust the rate of speech, the audiofrequency, and
			 volume of the audio interface and which provides that such setting shall reset
			 to a standard default for each voter;</text>
							</subclause><subclause id="idF8B3388BAE764A849CC7ED2D89D48C20"><enum>(IV)</enum><text>the need of
			 voters to simultaneously use a tactile interface that permits the voter to
			 rewind, repeat, pause, and skip any audio cues, presentations, and ballot
			 measures;</text>
							</subclause><subclause id="idD96A3512CEDA492B9F70E39F01D76636"><enum>(V)</enum><text>the need of
			 voters who rely on mobility aids, such as wheelchairs, to adjust the height of
			 a voting system and to be able to see any visual cues or prompts from a seated
			 position; and</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="idDA8B093CC2B248DDB3EF4D4C04A9EB5D"><enum>(VI)</enum><text>the need of
			 voters with cognitive disabilities including using visual and audio cues
			 simultaneously;</text>
							</subclause></clause><clause commented="no" display-inline="no-display-inline" id="idEE03F3DD8A38419DA8B58ACC3E60DB67"><enum>(ii)</enum><text>require that any
			 prototype accessible voting machine entered into the prize competition allows
			 voters with disabilities to independently verify the accuracy of the ballot
			 cast on the voting system; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id5FB38DE129AE4B8A8BBCBE2C64F903AB"><enum>(iii)</enum><text>be designed
			 to—</text>
							<subclause id="ID7db344be6f3b4135b8a5a95d420734fb"><enum>(I)</enum><text>stimulate
			 innovation in the development and design of accessible voting systems in a way
			 that Federal procurement standards cannot;</text>
							</subclause><subclause id="ID03970744e0554452be983ce1afbfc28f"><enum>(II)</enum><text>help overcome
			 traditional obstacles in the design of accessible voting systems;</text>
							</subclause><subclause id="IDbf539ca6959e44318b75ceebd0a9dcf4"><enum>(III)</enum><text>educate,
			 inspire, and motivate the public to participate in the process of developing
			 and designing accessible voting systems; and</text>
							</subclause><subclause id="ID9edfd579edf5407d93f8a3d18c92ddc3"><enum>(IV)</enum><text>enhance the
			 accessibility and independence of the voting process.</text>
							</subclause></clause></subparagraph><subparagraph id="ID8fd3050547454398a7c60be069f001b9"><enum>(C)</enum><header>Consultation
			 with other entities</header><text>In establishing the criteria under
			 subparagraph (A), the Director shall consult—</text>
						<clause id="IDef0a63cd559e4d058e737489ed6707a6"><enum>(i)</enum><text>with various
			 disability rights groups with special knowledge concerning the challenges
			 facing persons with disabilities in each of the classifications in
			 subparagraphs (A), (B), and (C) of paragraph (1);</text>
						</clause><clause id="ID7e527be21d5744bc8c1567967f6041eb"><enum>(ii)</enum><text>with other
			 Federal agencies, including—</text>
							<subclause id="id39BCC382E887415D98D72919227174D7"><enum>(I)</enum><text>the Election
			 Assistance Commission; and</text>
							</subclause><subclause id="id305B28A3092B48F19C2024FAA654B670"><enum>(II)</enum><text>the National
			 Science and Technology Council; and</text>
							</subclause></clause><clause id="IDb043fcd836aa4536a895b9d55a61cc1e"><enum>(iii)</enum><text>with private
			 organizations, including professional societies and industry
			 associations.</text>
						</clause></subparagraph></paragraph><paragraph id="IDa6af7d6024a04265877916802f8f3f3b"><enum>(4)</enum><header>Judges</header>
					<subparagraph id="id6B1193A75E8940DF9209B8A4D2086951"><enum>(A)</enum><header>In
			 general</header><text>For each prize competition the Director shall appoint a
			 panel of qualified judges. Such panel shall include individuals from outside
			 the Institute and from the private sector.</text>
					</subparagraph><subparagraph id="id781BEC5654754210BEC484A022CC76DF"><enum>(B)</enum><header>Disqualification</header><text>A
			 judge may not—</text>
						<clause id="ID156e9a0935d84c719c1bc830a5690bff"><enum>(i)</enum><text>have personal or
			 financial interests in, or be an employee, officer, director, or agent of, any
			 entity that is participating in the prize competition; or</text>
						</clause><clause id="ID8b65155d66e04a68b303000dbfcb4d23"><enum>(ii)</enum><text>have a familial
			 or financial relationship with an individual who is participating in the prize
			 competition.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="IDd4bcf7982870400ab75db5ee0fc77fc1"><enum>(d)</enum><header>Eligibility</header><text display-inline="yes-display-inline">A person is eligible to win a prize under
			 this section if—</text>
				<paragraph id="id6322E79D215743F4992533D958937633"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id05EE614389334100980A905956EBF00B"><enum>(A)</enum><text>in the case of a
			 corporation, such person is incorporated and maintains a primary place of
			 business the United States; and</text>
					</subparagraph><subparagraph id="id826A374665284EC2A3AFA0E2D44424CE" indent="up1"><enum>(B)</enum><text>in the case of an individual or
			 partnership, such individual, or each such individual in the partnership, is a
			 citizen of the United States or an alien lawfully admitted for permanent
			 residence in the United States;</text>
					</subparagraph></paragraph><paragraph id="idE69E2EA08283439EB0EC5EC1F18F7B41"><enum>(2)</enum><text>such person is
			 not an employee or entity of the United States or an laboratory accredited
			 under section 231 of the Help America Vote Act of 2002 (42 U.S.C. 15371);
			 and</text>
				</paragraph><paragraph id="IDad182c122f15473fbe6d92e5257a0a43"><enum>(3)</enum><text>such person
			 registers for the competition by submitting an application containing such
			 information as the Director may require.</text>
				</paragraph></subsection><subsection commented="no" id="ID57bf42fa33134399be044bd6a8ac45d6"><enum>(e)</enum><header>Trade
			 secrets</header><text display-inline="yes-display-inline">The Director shall,
			 to the extent possible, protect any trade secrets or proprietary information
			 related to any submission for a competition under this section.</text>
			</subsection><subsection id="IDa02a0196742f4798b5903bc787d77404"><enum>(f)</enum><header>Termination</header><text>No
			 prizes shall be awarded under this section for competitions announced after
			 September 30, 2013.</text>
			</subsection><subsection id="IDe0da866282fe442699a283db54d18d57"><enum>(g)</enum><header>Authorization
			 of appropriations</header>
				<paragraph id="IDb0d6d5d790f34f00b9d05af8721c42fd"><enum>(1)</enum><header>In
			 general</header>
					<subparagraph id="IDfde896c7068c4455ad147b89d43fc2e2"><enum>(A)</enum><header>Awards</header><text>There
			 are authorized to be appropriated to the Director $2,000,000 for each of the
			 fiscal years 2011, 2012, and 2013 for the purpose of awarding prizes in
			 competitions pursuant to this section.</text>
					</subparagraph><subparagraph id="ID71c6d7f328784708ac06b81be9d09482"><enum>(B)</enum><header>Administration</header><text>In
			 addition to the amounts authorized in subparagraph (A), there are authorized to
			 be appropriated to the Director $1,000,000 for each of fiscal years 2011, 2012,
			 and 2013 for the administrative costs of carrying out this section.</text>
					</subparagraph></paragraph><paragraph id="ID3e6f5c260a014719b8df048aa7cf05d5"><enum>(2)</enum><header>Carryover of
			 funds</header><text>Funds appropriated for prize awards under this section
			 shall remain available until expended, and may be transferred, reprogrammed, or
			 expended for other purposes only after the expiration of 10 fiscal years after
			 the fiscal year for which the funds were originally appropriated.</text>
				</paragraph></subsection></section></legis-body>
