		  on property acquired under hazard mitigation grant programs of the Federal

		<section id="id99A179C526EA4F249AABCBE6BB221554" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>FEMA Common Sense and Cost
			 Effectiveness Act of 2011</short-title></quote>.</text>
		</section><section id="idD7199848ED8045F3A9C6885B3F9A1814" section-type="subsequent-section"><enum>2.</enum><header>Construction and
			 maintenance of levees</header>
			<subsection id="id44409515F5D84E5289B76AD9604D75D3"><enum>(a)</enum><header>Stafford
			 Act</header>
				<paragraph id="idBB8A44132E0D4B95BCE8CEABF04EB3EC"><enum>(1)</enum><header>Predisaster
			 mitigation program</header><text>Section 203(e) of the Robert T. Stafford
			 Disaster Relief and Emergency Assistance Act (42 U.S.C. 5133(e)) is amended by
			 adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idC8657315458D4A7090388DE5348BAEE5" style="OLC">
						<paragraph id="idFD6E146EB94842399A2AC6212F82D32B"><enum>(3)</enum><header>Construction of
				levees on acquired lands</header><text>Subject to paragraph (4), and
				notwithstanding any requirement that property acquired or accepted under this
				section be dedicated and maintained in perpetuity as open space for the
				conservation of natural flood plain functions, if financial assistance provided
				under this section is used to acquire or accept property for open space
				purposes, the President may permit the construction or maintenance on the
				property of—</text>
							<subparagraph id="IDa288a1cf9441439e8bc5234227545cab"><enum>(A)</enum><text>a levee that is
				federally owned and operated;</text>
							</subparagraph><subparagraph id="IDad2f4a517a0145149ff225be602a5f20"><enum>(B)</enum><text>a permanent levee
				that is federally constructed and non-federally operated and maintained;</text>
							</subparagraph><subparagraph id="id94B3D99CD47B459C906766050FDC7DF5"><enum>(C)</enum><text>a levee—</text>
								<clause id="id6D70B5AE01B9408E8A538BF5998CF018"><enum>(i)</enum><text>that is federally
				constructed as a nonpermanent levee;</text>
								</clause><clause id="id6D3DBFD337FA4F388BAA6D849C147B04"><enum>(ii)</enum><text>that a
				non-Federal entity desires to operate and maintain as a permanent levee;
				and</text>
								</clause><clause id="idA52680F0592C479F9D0C8748983C033C"><enum>(iii)</enum><text>the owners of
				which—</text>
									<subclause id="id405693F4D18345E2B09B04E24857B2B4"><enum>(I)</enum><text>are participating
				in the emergency response to natural disasters program established under
				section 5 of the Act entitled <quote>An Act authorizing the construction of
				certain public works on rivers and harbors for flood control, and for other
				purposes</quote>, approved August 18, 1941 (33 U.S.C. 701n); or</text>
									</subclause><subclause id="id5754317108C54A78AC352669F3235789"><enum>(II)</enum><text>begin
				participating in the program described in subclause (I) within a reasonable
				period of time, as determined by the President, after the date on which the
				levee is constructed; and</text>
									</subclause></clause></subparagraph><subparagraph id="IDa19e44b2d6c346d1afdf879632bf71d5"><enum>(D)</enum><text>a non-Federal
				levee the owners of which are participating in the program described in
				subparagraph (C)(iii)(I).</text>
							</subparagraph></paragraph><paragraph id="id638FF03474D24C7DA6ACE7D368CF591C"><enum>(4)</enum><header>Downstream
				communities</header><text>The President may deny an application to construct or
				maintain a levee described in paragraph (3) if the levee poses a significant
				threat of harm to downstream
				communities.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="id5A2010EDE33447A5AAEE53C99149C362"><enum>(2)</enum><header>Hazard
			 mitigation grant program</header><text display-inline="yes-display-inline">Section 404(b) of the Robert T. Stafford
			 Disaster Relief and Emergency Assistance Act (42 U.S.C. 5170c(b)) is
			 amended—</text>
					<subparagraph id="idF6A06F6611C54853B016E97240DAFBF6"><enum>(A)</enum><text>in paragraph
			 (2)(B)—</text>
						<clause id="id0DECD68C427F4EB190E235FCC08FBCF3"><enum>(i)</enum><text>in
			 clause (i), by inserting <quote>except for the construction or maintenance of a
			 structure described in clause (ii) (including a levee),</quote> before
			 <quote>any property</quote>; and</text>
						</clause><clause id="idA2DE2EEB55614ADEB3F609D3C924D9CB"><enum>(ii)</enum><text>in
			 clause (ii)—</text>
							<subclause id="idBDEEAB83A66C418BB129BF0EA195888E"><enum>(I)</enum><text>in subclause
			 (II), by striking <quote>or</quote> at the end;</text>
							</subclause><subclause id="id2652660D29874F5B91B2E9354B0870EE"><enum>(II)</enum><text>by redesignating
			 subclause (III) as subclause (IV); and</text>
							</subclause></clause><clause id="idA22EF7525FD64A07B49BD1DD9667D5A0"><enum>(iii)</enum><text>by inserting
			 after subclause (II) the following:</text>
							<quoted-block display-inline="no-display-inline" id="id917122E5A7ED4C43934F4367B5082683" style="OLC">
								<subclause id="idE2A8ED6F8D884C4C9AA4EB6A9ABD9CD3"><enum>(III)</enum><text>subject to
				paragraph (5), a levee described in paragraph (4);
				or</text>
								</subclause><after-quoted-block>; and</after-quoted-block></quoted-block>
						</clause></subparagraph><subparagraph id="idA85CDCDC83F54D6FBA39408DFA32D5BC"><enum>(B)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="id456342D0CF754FC08125E2A5273084B9" style="OLC">
							<paragraph id="id54552554FC904DFFA7340A14DA3EA6F6"><enum>(4)</enum><header>Levees</header><text>A
				levee described in this paragraph is—</text>
								<subparagraph id="id7646AADFC0DB420CA7A82A5C2CE763A1"><enum>(A)</enum><text>a levee that is
				federally owned and operated;</text>
								</subparagraph><subparagraph id="id033FD5CF24014374B6C7A098313353AC"><enum>(B)</enum><text>a permanent levee
				that is federally constructed and non-federally operated and maintained;</text>
								</subparagraph><subparagraph id="id8E99FB5CFD6041F39A58C33B1606D15B"><enum>(C)</enum><text>a levee—</text>
									<clause id="id9C9A522889C241AE8886374C2B6B36B8"><enum>(i)</enum><text>that is federally
				constructed as a nonpermanent levee;</text>
									</clause><clause id="id2ABFCC3FE5154249BC6C1A2189994699"><enum>(ii)</enum><text>that a
				non-Federal entity desires to operate and maintain as a permanent levee;
				and</text>
									</clause><clause id="id1BB474EFE19B436DA9308DFCB8255DD6"><enum>(iii)</enum><text>the owners of
				which—</text>
										<subclause id="id9DC5DF1F249747A0A6165F4D2D61B654"><enum>(I)</enum><text>are participating
				in the emergency response to natural disasters program established under
				section 5 of the Act entitled <quote>An Act authorizing the construction of
				certain public works on rivers and harbors for flood control, and for other
				purposes</quote>, approved August 18, 1941 (33 U.S.C. 701n); or</text>
										</subclause><subclause id="idCC84485BE88B4B688ED7B29119F347B9"><enum>(II)</enum><text>begin
				participating in the program described in subclause (I) within a reasonable
				period of time, as determined by the President, after the date on which the
				levee is constructed; and</text>
										</subclause></clause></subparagraph><subparagraph id="idDE00F3F859C34FA68DC54F8AC479BF3C"><enum>(D)</enum><text>a non-Federal
				levee the owners of which are participating in the program described in
				subparagraph (C)(iii)(I).</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFB9DB525DF5A421194FF24E9CE59BCDB"><enum>(5)</enum><header display-inline="yes-display-inline">Downstream communities</header><text display-inline="yes-display-inline">The President may deny an application to
				construct or maintain a levee described in paragraph (4) if the levee poses a
				significant threat of harm to downstream
				communities.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection id="id08F09FA1FFD544258FC08BD9B31B6A70"><enum>(b)</enum><header>Construction of
			 levees under hazard mitigation programs relating to floods</header>
				<paragraph id="idAC5420AE654E405A99EB264E389082B4"><enum>(1)</enum><header>Flood
			 mitigation assistance</header><text>Section 1366 of the National Flood
			 Insurance Act of 1968 (42 U.S.C. 4104c) is amended by adding at the end the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="id4C366217AA5245318907DFC8A20F7183" style="OLC">
						<subsection id="id403A3B1535D4490A9152FB0A89F6CB13"><enum>(n)</enum><header>Construction of
				levees on acquired lands</header>
							<paragraph id="idA7E70A5DA3B64D62ADB56B441E552F6B"><enum>(1)</enum><header>In
				general</header><text>Subject to paragraph (2), and notwithstanding any
				requirement that property acquired or accepted under this section be dedicated
				and maintained in perpetuity as open space for the conservation of natural
				flood plain functions, if the mitigation activities funded under subsection (a)
				include the acquisition or acceptance of property for open space purposes, the
				Administrator may permit the construction or maintenance on the property
				of—</text>
								<subparagraph id="id297E771A313F4D5A861D87E8429DCB5C"><enum>(A)</enum><text>a levee that is
				federally owned and operated;</text>
								</subparagraph><subparagraph id="id6AE0EF1E9C12451C822BCF18B8271335"><enum>(B)</enum><text>a permanent levee
				that is federally constructed and non-federally operated and maintained;</text>
								</subparagraph><subparagraph id="idA7502DB9BE2440CEA2985713C0C7FA62"><enum>(C)</enum><text>a levee—</text>
									<clause id="idEB0BEB24A7C44C08A3F756F6B340C9E1"><enum>(i)</enum><text>that is federally
				constructed as a nonpermanent levee;</text>
									</clause><clause id="id2B2F9010D5924E2CA7AF602AD2F5CF94"><enum>(ii)</enum><text>that a
				non-Federal entity desires to operate and maintain as a permanent levee;
				and</text>
									</clause><clause id="id7CD6E3D8C4DC4BD09E4FFDBCC2BBA6C3"><enum>(iii)</enum><text>the owners of
				which—</text>
										<subclause id="id1CAE421D0DC448A985554BBD97E87B3D"><enum>(I)</enum><text>are participating
				in the emergency response to natural disasters program established under
				section 5 of the Act entitled <quote>An Act authorizing the construction of
				certain public works on rivers and harbors for flood control, and for other
				purposes</quote>, approved August 18, 1941 (33 U.S.C. 701n); or</text>
										</subclause><subclause id="idD2BCA6EB61A1440BBF30FFB7EC862A05"><enum>(II)</enum><text>begin
				participating in the program described in subclause (I) within a reasonable
				period of time, as determined by the Administrator, after the date on which the
				levee is constructed; and</text>
										</subclause></clause></subparagraph><subparagraph id="idDCB159738F404E3E92B044F2F2B8A663"><enum>(D)</enum><text>a non-Federal
				levee the owners of which are participating in the program described in
				subparagraph (C)(iii)(I).</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9AAF222860D146219139E383A2CA8A91"><enum>(2)</enum><header display-inline="yes-display-inline">Downstream communities</header><text display-inline="yes-display-inline">The Administrator may deny an application
				to construct or maintain a levee described in paragraph (1) if the levee poses
				a significant threat of harm to downstream
				communities.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="idB1BD2CE47BA040D88D95F464918A04BA"><enum>(2)</enum><header>Grants for
			 repetitive insurance claim properties</header><text>Section 1323 of the
			 National Flood Insurance Act of 1968 (42 U.S.C. 4030) is amended by adding at
			 the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idB37EC84E9EB74F7B937A4AAB30046583" style="OLC">
						<subsection commented="no" display-inline="no-display-inline" id="id6583CC5CD0464092BF5294E508EDBFDA"><enum>(c)</enum><header display-inline="yes-display-inline">Construction of levees on acquired
				lands</header>
							<paragraph commented="no" display-inline="no-display-inline" id="idB1AD010B128846F98FF7933F7E33FA7A"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to paragraph (2), and
				notwithstanding any requirement that property acquired or accepted under this
				section be dedicated and maintained in perpetuity as open space for the
				conservation of natural flood plain functions, if the mitigation activities
				funded under subsection (a) include the acquisition or acceptance of property
				for open space purposes, the Administrator may permit the construction or
				maintenance on the property of—</text>
								<subparagraph id="id407D9A7E98EE48EA85E11733C0B57D6E"><enum>(A)</enum><text>a levee that is
				federally owned and operated;</text>
								</subparagraph><subparagraph id="id7EA8B38AA8974631857E42A359AC1EC5"><enum>(B)</enum><text>a permanent levee
				that is federally constructed and non-federally operated and maintained;</text>
								</subparagraph><subparagraph id="idC689E9300C5E42D592F99F0A6BA9831E"><enum>(C)</enum><text>a levee—</text>
									<clause id="idE68612AD6B164ABFB55ADA1059E0675F"><enum>(i)</enum><text>that is federally
				constructed as a nonpermanent levee;</text>
									</clause><clause id="idBA132F5FC4D4407E99E92EB0353DBFD8"><enum>(ii)</enum><text>that a
				non-Federal entity desires to operate and maintain as a permanent levee;
				and</text>
									</clause><clause id="id482D07CB56D34759B6186003E95762B2"><enum>(iii)</enum><text>the owners of
				which—</text>
										<subclause id="idCF741BFABEDC4C7198A6A4D7B0601455"><enum>(I)</enum><text>are participating
				in the emergency response to natural disasters program established under
				section 5 of the Act entitled <quote>An Act authorizing the construction of
				certain public works on rivers and harbors for flood control, and for other
				purposes</quote>, approved August 18, 1941 (33 U.S.C. 701n); or</text>
										</subclause><subclause id="id3A9936C3910A4B3E9446BC4B21F44F79"><enum>(II)</enum><text>begin
				participating in the program described in subclause (I) within a reasonable
				period of time, as determined by the Administrator, after the date on which the
				levee is constructed; and</text>
										</subclause></clause></subparagraph><subparagraph id="id48FE91ED3F69445184CAD0128DE45A0E"><enum>(D)</enum><text>a non-Federal
				levee the owners of which are participating in the program described in
				subparagraph (C)(iii)(I).</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFD5C5488AADB47389D6490A22811A2BA"><enum>(2)</enum><header display-inline="yes-display-inline">Downstream communities</header><text display-inline="yes-display-inline">The Administrator may deny an application
				to construct or maintain a levee described in paragraph (1) if the levee poses
				a significant threat of harm to downstream
				communities.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="IDf740f7c3bbe842cf8a39007a37f90035"><enum>(3)</enum><header>Severe
			 repetitive loss program</header><text>Section 1361A(g) of the National Flood
			 Insurance Act of 1968 (42 U.S.C. 4102a(g)) is amended—</text>
					<subparagraph id="idDC2E15B95297412CB10EF55DC3364229"><enum>(A)</enum><text>in paragraph (1),
			 by striking the period at the end and inserting the following: “, including
			 that, subject to paragraph (5), and notwithstanding any requirement that
			 property acquired or accepted under this section be dedicated and maintained in
			 perpetuity as open space for the conservation of natural flood plain functions,
			 the Administrator may permit the construction or maintenance on such property
			 of—</text>
						<quoted-block display-inline="no-display-inline" id="id313F009DACEB4CCBB6805814A2999C85" style="OLC">
							<subparagraph id="idB3C3CCC1911C46D1AA4CFB6C47F27FBB"><enum>(A)</enum><text>a levee that is
				federally owned and operated;</text>
							</subparagraph><subparagraph id="id4251AA089C46423DBD17D028C832AD7B"><enum>(B)</enum><text>a permanent levee
				that is federally constructed and non-federally operated and maintained;</text>
							</subparagraph><subparagraph id="idB548632BFBDF4AA9ACD47A8F1867934A"><enum>(C)</enum><text>a levee—</text>
								<clause id="id3DD76A0F6FC0417F9365DD96CA3C4A1E"><enum>(i)</enum><text>that is federally
				constructed as a nonpermanent levee;</text>
								</clause><clause id="id7E33A2E678CA4A57BECF7F8BF709BF82"><enum>(ii)</enum><text>that a
				non-Federal entity desires to operate and maintain as a permanent levee;
				and</text>
								</clause><clause id="id91F8811679EE40A3B3C77787AC8F8276"><enum>(iii)</enum><text>the owners of
				which—</text>
									<subclause id="id21134A1ED0A740B5A2CE7B794916C3DB"><enum>(I)</enum><text>are participating
				in the emergency response to natural disasters program established under
				section 5 of the Act entitled <quote>An Act authorizing the construction of
				certain public works on rivers and harbors for flood control, and for other
				purposes</quote>, approved August 18, 1941 (33 U.S.C. 701n); or</text>
									</subclause><subclause id="id69319A1033684348ABF1117A0D304ED2"><enum>(II)</enum><text>begin
				participating in the program described in subclause (I) within a reasonable
				period of time, as determined by the Administrator, after the date on which the
				levee is constructed; and</text>
									</subclause></clause></subparagraph><subparagraph id="id6EDC44BEFECF4A8395D95EC9480DDA4B"><enum>(D)</enum><text>a non-Federal
				levee the owners of which are participating in the program described in
				subparagraph (C)(iii)(I).</text>
							</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="id7EF5F4FB56E541C191A22494658A490B"><enum>(B)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="idDC0673A56F914AC4A51C3C9CA43F7E10" style="OLC">
							<paragraph commented="no" display-inline="no-display-inline" id="idED1F0FEFB61949A8ADC757AFF9CD04B5"><enum>(5)</enum><header display-inline="yes-display-inline">Downstream communities</header><text display-inline="yes-display-inline">The Administrator may deny an application
				to construct or maintain a levee described in paragraph (1) if the levee poses
				a significant threat of harm to downstream
				communities.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection id="id945023C1707A4301875A98E126198E3E"><enum>(c)</enum><header>Applicability
			 of amendments</header><text>The amendments made by this section shall apply to
			 all property acquired or accepted pursuant to section 203 or 404 of the Robert
			 T. Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C. 5133 and
			 5170c) or section 1323, 1366, or 1361A of the National Flood Insurance Act of
			 1968 (42 U.S.C. 4030, 4104c, and 4102a) before, on, or after the date of
			 enactment of this Act.</text>
			</subsection></section></legis-body>
