		<legis-type>A BILL</legis-type>
		<official-title>To authorize the adjustment of status for immediate
		  family members of individuals who served honorably in the Armed Forces of the
		  United States during the Afghanistan and Iraq conflicts, and for other
		  purposes.</official-title>
	</form>
	<legis-body>
		<section id="id009202AF9A004DA8956E06C5835ABA63" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Military Families
			 Act</short-title></quote>.</text>
		</section><section id="id60246EE3E47A4592AC388196D29521B9" section-type="subsequent-section"><enum>2.</enum><header>Permanent resident
			 status for family members of members of the Armed Forces</header>
			<subsection id="id510944D11B274C1681A0CACD26F27341"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 245 of the
			 Immigration and Nationality Act (8 U.S.C. 1255) is amended by adding at the end
			 the following:</text>
				<quoted-block display-inline="no-display-inline" id="id3BBE70299034461895599896BC25FBE6" style="OLC">
					<subsection id="idE5914F412F924C42A02E929031C40530"><enum>(n)</enum><header>Adjustment of
				status for immediate family members of members of the Armed Forces</header>
						<paragraph id="id995AAD8B00BF451F9F87AD9AF4789551"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary of
				Homeland Security shall adjust the status of an alien described in paragraph
				(2) to that of an alien lawfully admitted for permanent residence if the
				alien—</text>
							<subparagraph id="H716DFE870CF54ECA921CE4F875E32E6"><enum>(A)</enum><text>applies for such
				adjustment;</text>
							</subparagraph><subparagraph id="HCF650D1D030F4168BB23D2C1B6195E1B"><enum>(B)</enum><text>is admissible to
				the United States as an immigrant, except as provided in paragraph (4);
				and</text>
							</subparagraph><subparagraph id="id23A526D02A9143EB9B701524515958E4"><enum>(C)</enum><text>is physically
				present in the United States.</text>
							</subparagraph></paragraph><paragraph id="H587F29EEAB6E4F67AF032C50A974458B"><enum>(2)</enum><header>Aliens eligible
				for adjustment of status</header><text>An alien described in this paragraph is
				an alien—</text>
							<subparagraph id="HEAE28D5CD317413EAB2D1FE36E17674C"><enum>(A)</enum><text>who is a parent,
				spouse, child, son, daughter, or the legal guardian of a child of—</text>
								<clause id="id6999D9322B42490BAF01A1DF5800C51E"><enum>(i)</enum><text>a
				living Armed Forces member; or</text>
								</clause><clause id="HB3E8BE22BB804431903200A08435A32D"><enum>(ii)</enum><text>a
				deceased Armed Forces member if—</text>
									<subclause id="id3126A593BFA64A6F9EA10B29E6DACB83"><enum>(I)</enum><text>the Armed Forces
				member died as a result of injury or disease incurred in, or aggravated by, the
				Armed Forces member's service; and</text>
									</subclause><subclause id="idF833A640EF244F5986E8A423C59D8041"><enum>(II)</enum><text>the alien
				applies for such adjustment—</text>
										<item id="id64EA49E56A97478FB39AC788A070C9F0"><enum>(aa)</enum><text>if
				the death of the Armed Forces member occurred prior to the date of the
				enactment of the <short-title>Military Families
				Act</short-title>, not later than 2 years after such date of enactment;
				or</text>
										</item><item id="id9F4BA22B76974ED29635976281313D85"><enum>(bb)</enum><text>if
				the death of the Armed Forces member occurred after the date of the enactment
				of the <short-title>Military Families Act</short-title>,
				not later than 2 years after the death of the Armed Forces member; or</text>
										</item></subclause></clause></subparagraph><subparagraph id="id26DFDB1D635341139D34F59118E20384"><enum>(B)</enum><text>who is the
				spouse, child, son, or daughter of an alien described in subparagraph
				(A).</text>
							</subparagraph></paragraph><paragraph id="H7B6D6FFF14224F36AD7E88185C4D3470"><enum>(3)</enum><header>Armed Forces
				member defined</header><text>In this subsection, the term <term>Armed Forces
				member</term> means an individual who—</text>
							<subparagraph id="H0BA78D1FA1724E9CAD22144F08333662"><enum>(A)</enum><text>is, or was at the
				time of the individual’s death described in paragraph (2)(B)(ii)(I), a national
				of the United States or lawfully admitted for permanent residence;</text>
							</subparagraph><subparagraph id="id41B48F47783C465CAECCB7CB6F5CC75A"><enum>(B)</enum><text>on or after
				October 7, 2001, served as a member of—</text>
								<clause commented="no" display-inline="no-display-inline" id="id15E19C24533E45CD97C3353FAF39C8B3"><enum>(i)</enum><text display-inline="yes-display-inline">the Armed Forces on active duty;</text>
								</clause><clause id="id0791030028D64367BF79160FB34D86C0"><enum>(ii)</enum><text>the National
				Guard; or</text>
								</clause><clause id="idE9DAC6249C1042D99E064343FAD05501"><enum>(iii)</enum><text>the Selected
				Reserve of the Ready Reserve; and</text>
								</clause></subparagraph><subparagraph id="id4FF10B94D60E414B9D4FE18FCAAA4A0E"><enum>(C)</enum><text>if separated from
				the service described in subparagraph (B), was separated under honorable
				conditions.</text>
							</subparagraph></paragraph><paragraph id="HFA56E4C0FECB495F8336B4003FAF10C8"><enum>(4)</enum><header>Inapplicability
				of certain grounds of inadmissibility</header>
							<subparagraph id="id3856E919F6054E708758A3B323FD8581"><enum>(A)</enum><header>In
				general</header><text>The provisions of paragraphs (4), (5), (6)(A), (7)(A),
				and (9)(B) of section 212(a) shall not apply to an adjustment of status made
				pursuant to this subsection.</text>
							</subparagraph><subparagraph id="id939AECDDE3C74A7284625D79B52CCF65"><enum>(B)</enum><header>Waiver</header><text>The
				Secretary of Homeland Security or the Attorney General, as appropriate, may
				waive any other provision of section 212(a) (other than paragraph (2)(C) and
				subparagraphs (A), (B), (C), (E), and (F) of paragraph (3)) with respect to an
				adjustment of status made pursuant to this subsection—</text>
								<clause id="idF5336C9D711747A49FF4C9522FF4A52A"><enum>(i)</enum><text>for humanitarian
				purposes;</text>
								</clause><clause id="idB07C8BB3C1C1439891496D7C062B73DF"><enum>(ii)</enum><text>to assure family
				unity; or</text>
								</clause><clause id="id002EC8A34B0C4C9E9129325CA07944E3"><enum>(iii)</enum><text>if such waiver
				is otherwise in the public interest.</text>
								</clause></subparagraph></paragraph><paragraph id="H5DBD8C11DCAC4EB5BD3D80110099FAC9"><enum>(5)</enum><header>Fee
				authority</header><text>The Secretary of Homeland Security or the Secretary of
				State, as appropriate, may establish a fee pursuant to section 9701 of title
				31, United States Code, for the processing of an application for an adjustment
				of status made pursuant to this subsection.</text>
						</paragraph><paragraph id="ID3a7cf3c7bb49431982077b7456e8ac0e"><enum>(6)</enum><header>Jurisdiction</header>
							<subparagraph id="id98D35727AF674ED7A34771E13204D3D7"><enum>(A)</enum><header>Secretary of
				Homeland Security</header><text>Except as provided in subparagraph (B), the
				Secretary of Homeland Security shall have exclusive jurisdiction to determine
				eligibility for an adjustment of status made pursuant to this
				subsection.</text>
							</subparagraph><subparagraph id="idFA3ADC5D27414A2B8B32676BEBEDE99E"><enum>(B)</enum><header>Attorney
				General</header><text>Notwithstanding paragraph (1) or subparagraph (A), in
				cases in which an alien has been placed into deportation, exclusion, or removal
				proceedings, either prior to or after filing an application for an adjustment
				of status pursuant to this subsection, the Attorney General shall have
				exclusive jurisdiction and shall assume all the powers and duties of the
				Secretary of Homeland Security until proceedings are terminated, or if a final
				order of deportation, exclusion, or removal is
				entered.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id58A165433F2E4070BAFD1F744826369F"><enum>(b)</enum><header>Exemption from
			 direct numerical limitations</header><text display-inline="yes-display-inline">Section 201(b)(1) of the Immigration and
			 Nationality Act (8 U.S.C. 1151(b)(1)) is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="idC6A24E27EB0143CAA7E0F525023216B0" style="OLC">
					<subparagraph commented="no" display-inline="no-display-inline" id="idE124B664016549D586FF03AB357A7546" indent="up1"><enum>(F)</enum><text>Aliens provided permanent residence
				status under section 245(n).</text>
					</subparagraph><after-quoted-block>.
				</after-quoted-block></quoted-block>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="idBF5AD3BEEA6B4D91BB390B52A84FE2C1"><enum>3.</enum><header>Filipino
			 veterans family reunification</header>
			<subsection commented="no" display-inline="no-display-inline" id="id39518823B5F1484FB6D878A7CEED1FE4"><enum>(a)</enum><header>Short
			 title</header><text>This section may be cited as the <quote><short-title>Filipino Veterans Family Reunification
			 Act</short-title></quote>.</text>
			</subsection><subsection id="ID17510536056841529ccafc68d4428805"><enum>(b)</enum><header>Exception from
			 direct numerical limitations</header><text>Section 201(b)(1) of the Immigration
			 and Nationality Act (8 U.S.C. 1151(b)(1)), as amended by section 2(b), is
			 further amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id1BDD0B459A9945B2B72D090CA17E2114" style="OLC">
					<subparagraph id="id669B54416342447CBA37B04FCB301FFF" indent="up1"><enum>(G)</enum><text>Aliens who—</text>
						<clause id="idF06DA979F0754DDEA07CBA4A099D5A0C"><enum>(i)</enum><text>are eligible for a visa under
				paragraph (1) or (3) of section 203(a); and</text>
						</clause><clause id="IDd7ef6d69d68c4a828e984fe0f6632bcd"><enum>(ii)</enum><text>have a parent (regardless of
				whether the parent is living or dead) who was naturalized pursuant to—</text>
							<subclause id="ID7f52201b44ab4bdbb5fd53fc19484079"><enum>(I)</enum><text>section 405 of the Immigration Act of
				1990 (Public Law 101–649; 8 U.S.C. 1440 note); or</text>
							</subclause><subclause id="ID3a4c9d88db2546c0b22195b729f32a41"><enum>(II)</enum><text>title III of the Act of October 14, 1940
				(54 Stat. 1137, chapter 876), as added by section 1001 of the Second War Powers
				Act, 1942 (56 Stat. 182, chapter
				199).</text>
							</subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section></legis-body>
