		<official-title>To amend the Clean Air Act to define next generation
		  biofuel, and to allow States the option of not participating in the corn
		  ethanol portions of the renewable fuel standard due to conflicts with
		  agricultural, economic, energy, or environmental goals.</official-title>

			 biofuel</header>
			<subsection id="id6326CD78181145AFA55B21F3780B8C41"><enum>(a)</enum><header>Definitions</header><text>Section
			 211(o)(1) of the Clean Air Act (42 U.S.C. 7545(o)(1)) is amended—</text>
				<paragraph id="idD674A0CB25D8407E9B0E1539A062F62D"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subparagraphs (E), (F),
			 (G), and (H) as subparagraphs (H), (E), (F), (G), respectively, and moving
			 subparagraph (H) (as so redesignated) to appear before subparagraph (I);
			 and</text>
				</paragraph><paragraph id="id5B17AAEA8DDB45129AC222C691929C4B"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (H) (as redesignated by
			 paragraph (1)), by striking <quote><header-in-text level="subparagraph" style="OLC">Cellulosic biofuel</header-in-text>.—</quote> and all that follows
			 through <quote>biomass</quote> and inserting <quote><header-in-text level="subparagraph" style="OLC">Next generation biofuel</header-in-text>.—The
			 term <term>next generation biofuel</term> means renewable fuel that is derived
			 from any cellulose, hemicellulose, lignin, or algae that is derived from
			 renewable biomass or nonethanol renewable fuel that is derived from renewable
			 biomass</quote>.</text>
				</paragraph></subsection><subsection id="id97DB4FB17B6B4AC7B6D5EF735B6FFF5D"><enum>(b)</enum><header>Standard</header><text>Section
			 211(o) of the Clean Air Act (42 U.S.C. 7545(o)) is amended—</text>
				<paragraph id="idC11E20A547EE43AA92245CBFE5852FA1"><enum>(1)</enum><text>in paragraph
			 (2)—</text>
					<subparagraph id="idEDEC0DAE40EF4DC8868DC5CAC4307CA6"><enum>(A)</enum><text>in subparagraph
			 (A)(i), in the second sentence, by striking <quote>cellulosic</quote> and
			 inserting <quote>next generation</quote>; and</text>
					</subparagraph><subparagraph id="id15E697816FCA4E34B3123677820A1DF6"><enum>(B)</enum><text>in subparagraph
			 (B)—</text>
						<clause id="idBDF4FE1A298A41B984DC137F574200E5"><enum>(i)</enum><text>in
			 clause (i)(III)—</text>
							<subclause id="id55979AF0AD8C4AA2A7E13177D9070C57"><enum>(I)</enum><text>in the subclause
			 heading, by striking <quote><header-in-text level="subclause" style="OLC">Cellulosic</header-in-text></quote> and inserting

			 appears and inserting <quote>next generation</quote>; and</text>

			 (7)(D)—</text>
					<subparagraph id="id6D438AAF80C64C9D90D4259BE336B25E"><enum>(A)</enum><text>in the
			 subparagraph heading, by striking <quote><header-in-text level="subparagraph" style="OLC">Cellulosic</header-in-text></quote> and inserting

					</subparagraph></paragraph></subsection></section><section id="idCD9375290B524ACD9C0E1F890FA97F2E" section-type="subsequent-section"><enum>2.</enum><header>State option of
			 non-participation in renewable fuel standard</header><text display-inline="no-display-inline">Section 211(o)(2)(B) of the Clean Air Act
			 (42 U.S.C. 7545(o)(2)(B)) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="id11E73041EEA8444AB763D57EFD2A6227" style="OLC">
				<clause id="ID57273d6f16034f798b0368219b21242a"><enum>(vi)</enum><header>Election of
				non-participation by State government</header>
					<subclause id="id2207306AB45F4D149D8397F45749857C"><enum>(I)</enum><header>In
				general</header><text>For purposes of subparagraph (A), the applicable volume
				of renewable fuel as determined under this subparagraph shall be adjusted in
				accordance with this clause.</text>
					</subclause><subclause id="idE64F75076DC5481294775DCD6FDF68E6"><enum>(II)</enum><header>Requirements</header><text>On
				passage by a State legislature and signature by the Governor of the State of a
				law that elects to not participate in the applicable volume of renewable fuel
				in accordance with this clause, the Administrator shall allow a State to not
				participate in the applicable volume of renewable fuel determined under
				subclause (I) of clause (i), other than the applicable volumes of renewable
				fuel required under subclauses (II), (III), and (IV) of that clause.</text>
					</subclause><subclause id="IDb1e007e80226457495ac4273dffb6433"><enum>(III)</enum><header>Reduction</header><text>On
				the election of a State under subclause (II), the Administrator shall reduce
				the applicable volume of renewable fuel determined under clause (i)(I) by the
				percentage that reflects the national gasoline consumption of the
				non-participating State that is attributable to that State.</text>
					</subclause><subclause id="ID968ead4d9da8464db5b7951c41586192"><enum>(IV)</enum><header>Credits to
				hold fuel sales harmless</header><text>On the election of a State under
				subclause (II), the Administrator shall provide for the generation of credits
				for all gasoline (regardless of whether the gasoline is blended) provided
				through a fuel terminal in the State to be calculated as though the gasoline
				were blended with the maximum allowable ethanol content of gasoline allowed in
				that State to apply toward the applicable volume of renewable fuel determined
				under clause
				(i)(I).</text>
