		<official-title>To amend titles 23 and 49, United States Code, to
		  streamline the environmental review process for highway projects, and for other
		  purposes.</official-title>

	<legis-body style="OLC">
		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Project Delivery Improvement Act
			 of 2011</short-title></quote>.</text>
		</section><section id="IDbfeac6544e734aa9b6f4717913d10d53"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
			<paragraph id="ID49bb3012b6ab47cea9204a8907a347e7"><enum>(1)</enum><text>in addition to
			 amounts available as of the date of enactment of this Act, the United States
			 needs to expend $20,000,000,000 to maintain the transportation infrastructure
			 of the United States;</text>
			</paragraph><paragraph id="IDee1d029f130a4c37a45e639e08a5eacd"><enum>(2)</enum><text>up to
			 $80,000,000,000 per year in additional spending could be used for projects that
			 would provide positive economic returns;</text>
			</paragraph><paragraph id="IDf09a579a06ff45398fff14465c2d6233"><enum>(3)</enum><text>the United States
			 needs at least $255,000,000,000 per year in transportation spending during the
			 50-year period after the date of enactment of this Act—</text>
				<subparagraph id="id13150D0C2CE74706A25CB0BA0342648D"><enum>(A)</enum><text>to maintain the
			 transportation system of the United States in a state of good repair;
			 and</text>
				</subparagraph><subparagraph id="idDA952682B4C044B8BE5163723C693FA5"><enum>(B)</enum><text>to complete
			 necessary upgrades of that system;</text>
				</subparagraph></paragraph><paragraph id="idA5F04CC955CF43A0A8377060E090987A"><enum>(4)</enum><text>transportation
			 spending as of the date of enactment of this Act falls 60 percent short of the
			 amount required; and</text>
			</paragraph><paragraph id="ID25cad033c7f8453791c0513b7f3caf3c"><enum>(5)</enum><text>because revenues
			 deposited in the Highway Trust Fund are declining—</text>
				<subparagraph id="idE5208036F81A4FD5ACA801D441B80B9F"><enum>(A)</enum><text>transportation
			 project costs need to be reduced; and</text>
				</subparagraph><subparagraph id="id883335F05F134F4AB34EC4CA5EC443E1"><enum>(B)</enum><text>regulatory
			 requirements for those projects should be streamlined.</text>
				</subparagraph></paragraph></section><section id="IDcc4be5d6d1f64e1b9e0ec4171233e716"><enum>3.</enum><header>Environmental
			 review process</header>
			<subsection id="idA67C2694904D4E9CBF14B3179712EDF7"><enum>(a)</enum><header>Use of
			 proprietary and experimental products</header><text>Section 112 of title 23,
			 United States Code, is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id84077044BB6444528996BBABCA1522BE" style="OLC">
					<subsection id="id19DB387D8E8C41C6A6E7FD494F287168"><enum>(h)</enum><header>Use of
				proprietary and experimental products</header><text>Notwithstanding any other
				provision of this section—</text>
						<paragraph id="id537011BEDFA642D2BBCA2D1C27D01CB3"><enum>(1)</enum><text>a State may use
				for any highway project 1 or more proprietary, patented, or experimental
				products selected by the State without competitive bidding or approval by the
				Secretary; and</text>
						</paragraph><paragraph id="id8711094FD37F4D3395AE8D158C38DAD5"><enum>(2)</enum><text>the use by the
				State of a product described in paragraph (1) for a highway project shall not
				affect the eligibility of the State or the highway project to receive Federal
				funds.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="ID041c430ecb994766b3244030e0eaab6e"><enum>(b)</enum><header>Preservation of
			 Parklands</header><text>Section 138 of title 23, United States Code, is
			 repealed.</text>
			</subsection><subsection id="idFC2A4F37E5AD49499B6314ABA4099C4D"><enum>(c)</enum><header>Participating
			 agencies</header><text>Section 139 of title 23, United States Code, is
			 amended—</text>
				<paragraph id="idA5F7EC9751C44460B25387758234CD97"><enum>(1)</enum><text>in subsection
			 (c)(5), by striking <quote>may be</quote> and inserting <quote>shall
			 be</quote>;</text>
				</paragraph><paragraph id="idAF6C895D51CE487C8191CDF023B8082A"><enum>(2)</enum><text>in subsection
			 (d), by striking paragraph (1) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="id60C8AA2F179F47678DE5AF98AF17544E" style="OLC">
						<paragraph id="id0467433FB59E4F5AAC9847283C7D40FF"><enum>(1)</enum><header>In
				general</header><text>The lead agency shall be responsible for—</text>
							<subparagraph id="idE986BBE236A24AA5A27C42A571831888"><enum>(A)</enum><text>determining the
				purpose of and need for a project; and</text>
							</subparagraph><subparagraph id="id651D732FF3914BBCA6034E2B6C734C97"><enum>(B)</enum><text>inviting and
				designating participating agencies in accordance with this
				subsection.</text>
							</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="id161A8BE13E0F4621A2303250BD6A4CEB"><enum>(3)</enum><text>in subsection
			 (f)—</text>
					<subparagraph id="id249C0EA9DA26478A92C8923CC7E61B23"><enum>(A)</enum><text>in paragraph (1),
			 by striking <quote>provide an opportunity for involvement by participating
			 agencies and the public in defining</quote> and inserting <quote>provide for an
			 opportunity for public comment on the definition of</quote>;</text>
					</subparagraph><subparagraph id="idE387854448FD49FAA814E426146CC567"><enum>(B)</enum><text>in paragraph
			 (2)—</text>
						<clause id="id0B53A18E751A44818A998670B84496FB"><enum>(i)</enum><text>by
			 striking <quote>Following participation under paragraph (1)</quote> and
			 inserting the following:</text>
							<quoted-block display-inline="no-display-inline" id="id9346301206B742C2BFBDD3199E388BDE" style="OLC">
								<subparagraph id="idCC0D50EA0DDC497197B57B6180CE2F5D"><enum>(A)</enum><header>In
				general</header><text>After the period of public comment under paragraph
				(1)</text>
								</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
						</clause><clause id="idA4A62D1F2453489E951E15A3B81936A9"><enum>(ii)</enum><text>by
			 adding at the end the following:</text>
							<quoted-block display-inline="no-display-inline" id="id20D54D70A2104100BE5D8FF5A69E1178" style="OLC">
								<subparagraph id="idF6823604DA1F4024BD81301C92CAFE9C"><enum>(B)</enum><header>Long-range
				transportation plan</header><text>For a project included in an adopted
				long-range transportation plan under section 134 or 135, the lead agency may
				use the purpose and need presented in the plan without further agency
				collaboration.</text>
								</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
						</clause></subparagraph><subparagraph id="id07F7D382DAB74EAABCA39A4F52AD6FE7"><enum>(C)</enum><text>in paragraph (4),
			 by striking subparagraph (B) and inserting the following:</text>
						<quoted-block display-inline="no-display-inline" id="idF2E6A150B05747B1AB8C93627D47415F" style="OLC">
							<subparagraph id="id999FC81375084A58AC746DEDBD565761"><enum>(B)</enum><header>Range of
				alternatives</header>
								<clause id="idE11B85FF86C4451EBF1055CB1302527D"><enum>(i)</enum><header>In
				general</header><text>Following participation under paragraph (1), the lead
				agency shall determine the range of alternatives for consideration in any
				document which the lead agency is responsible for preparing for the
				project.</text>
								</clause><clause id="id5BB699204B76491B82FC51C8C2F03C75"><enum>(ii)</enum><header>Exclusion of
				alternatives</header><text>The lead agency may exclude from consideration under
				clause (i) any alternative that, as determined by the lead agency, would not
				meet the purpose of and need for the project determined under paragraph (1)(A),
				regardless of whether the alternative would impact the environment to a greater
				degree than the preferred
				alternative.</text>
								</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection id="ID7310ed827a4d47cebaa79d31a745372b"><enum>(d)</enum><header>Limitations on
			 Claims</header><text>Section 139(l) of title 23, United States Code, is
			 amended—</text>
				<paragraph id="IDd20b41bc0bc54e3898b7411fce85f005"><enum>(1)</enum><text>in each of
			 paragraphs (1) and (2), by striking <quote>180 days</quote> each place it
			 appears and inserting <quote>90 days</quote>; and</text>
				</paragraph><paragraph id="ID09decc29852c4ed2b7db8a7b71be956f"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id406DA4EDB6554268A4BA32B0989BF14A" style="OLC">
						<paragraph id="ID03541fc84bc242d6b654750b1e571a5f"><enum>(3)</enum><header>Burden of
				proof</header><text>In any claim described in the first sentence of paragraph
				(1), the individual or entity bringing the claim shall bear the burden of
				proving the
				claim.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="IDd67ffefab8f84de5870e56d1655c9f7e"><enum>(e)</enum><header>Exclusions;
			 Document Combination</header><text>Section 139 of title 23, United States Code,
			 is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idBD85D7D5EFA44665AE69E2093F202FD9" style="OLC">
					<subsection id="ID227adac95bcf4e0baa5422a7324a7b2d"><enum>(m)</enum><header>Categorical
				Exclusions; Document Combination</header>
						<paragraph id="IDbb179f7510444e2fa9fdb623954059fc"><enum>(1)</enum><header>Categorical
				exclusions</header>
							<subparagraph id="ID0f88c533e79c48ca84a5fdbf6a6b4584"><enum>(A)</enum><header>In
				general</header><text>A highway project carried out within the right-of-way of
				a Federal-aid highway or a highway funded under section 118(e) shall be
				considered to be a categorical exclusion under section 771.117(a) of title 23,
				Code of Federal Regulations (or a successor regulation).</text>
							</subparagraph><subparagraph id="IDde5694651c994c03acab61148368325a"><enum>(B)</enum><header>State
				authority</header><text>A State may designate or classify a highway project
				carried out by the State as a categorical exclusion under section 771.117(a) of
				title 23, Code of Federal Regulations (or a successor regulation).</text>
							</subparagraph></paragraph><paragraph id="ID3df28437cd794e0485dfc35fabf00f1b"><enum>(2)</enum><header>Document
				combination</header><text>To further expedite the environmental review process
				for a project under this section, the Secretary may combine the final
				environmental impact statement and the record of decision for the project if a
				preferred alternative is identified in the environmental impact
				statement.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="ID187483a7179b4251bcb5a3c72c267401"><enum>(f)</enum><header>Policy on
			 lands, wildlife and waterfowl refuges, and historic sites; de minimis
			 impacts</header><text>Section 303 of title 49, United States Code, is
			 amended—</text>
				<paragraph id="idA8DB7C182F13433FB89FF638C9BF128B"><enum>(1)</enum><text>by striking the
			 section heading and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="idE68C41E84B0E4388AF8427FE494B7C16" style="USC">
						<section id="id4A086DCA491D4BC0BC7E523E9D3B9780"><enum>303.</enum><header>Policy on
				lands and wildlife and waterfowl
				refuges</header>
						</section><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="id16A2BECCDFE549ADB43665E19AD84220"><enum>(2)</enum><text>in subsection
			 (a), by striking <quote>, wildlife and waterfowl refuges, and historic
			 sites</quote> and inserting <quote>and wildlife and waterfowl

				</paragraph><paragraph id="idF69DFCCFDD684436B6AEC4ECE379E44D"><enum>(3)</enum><text>in subsection
			 (c)—</text>
					<subparagraph id="id89E73EB0B3DC492AB9FD4686D066F6DA"><enum>(A)</enum><text>in the matter
			 preceding paragraph (1)—</text>
						<clause id="idE0DE771684F9430AA60AC1D33382F44F"><enum>(i)</enum><text>by
			 striking <quote>Subject to subsection (d), the Secretary</quote> and inserting
			 <quote>The Secretary</quote>; and</text>
						</clause><clause id="idDB2999159F284C38A5C2AC4C0701289B"><enum>(ii)</enum><text>by
			 striking <quote>, or land of an historic site of national, State, or local
			 significance (as determined by the Federal, or local officials having
			 jurisdiction over the park, area, refuge, or site)</quote>; and</text>
						</clause></subparagraph><subparagraph id="id2561FDDE6BCC4A71BB46667924ABADC1"><enum>(B)</enum><text>by striking
			 paragraphs (1) and (2) and inserting the following:</text>
						<quoted-block display-inline="no-display-inline" id="id68F691FEA6A7431FA646DE64C84264ED" style="OLC">
							<paragraph id="idE52075E2D9634FCCB7379F9AE6C55265"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id31C25CFF2BF2425D832571188CB786E9"><enum>(A)</enum><text>there is no prudent and
				feasible alternative to using that land; and</text>
								</subparagraph><subparagraph id="id951D865EBFCA4E3D9B297C796524CAEC" indent="up1"><enum>(B)</enum><text>the program or project includes all
				practicable planning to minimize harm to the park, recreation area, or wildlife
				and waterfowl refuge resulting from the use; or</text>
								</subparagraph></paragraph><paragraph id="id78AA6AD33DE64E29A9E2457F8B72D4E3"><enum>(2)</enum><text>the Governor of
				the State, and, if applicable, the mayor or chief executive officer of the
				city, county, or borough having management responsibility for or ownership of
				areas or sites described in paragraph (1)(B) agree that the transportation
				project is the preferred alternative.</text>
							</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6E834386C15149D69994592CA006FEAC"><enum>(4)</enum><text>by striking
			 subsection (d).</text>
