		<official-title>To provide for a good faith exemption from suspicious
		  activity reporting requirements, and for other purposes.</official-title>

		<section id="idEBFA49B8173D4656BD153E2AB30ED677" section-type="section-one"><enum>1.</enum><header>Suspicious activity
			 reports</header><text display-inline="no-display-inline">Section 5318(g) of
			 title 31, United States Code, is amended—</text>
			<paragraph id="id4C939075C9DA43C1B03EC0C217628628"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by inserting before the
			 period at the end the following: <quote>, except as provided in paragraph
			 (5)</quote>; and</text>
			</paragraph><paragraph id="id8163795AE93147A78E7EF8352930746E"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idDFBC16080A4F461B8879E82A3F233159" style="OLC">
					<paragraph id="id4E649B06A1574ED4B5893BAE0B6E78B3"><enum>(5)</enum><header>Exemption</header>
						<subparagraph id="id83813CBA60BF49719B81C4723D902843"><enum>(A)</enum><header>In
				general</header><text>A failure to submit a report with respect to a suspicious
				transaction shall not be a violation of this subsection with respect to a
				financial institution or any person described in paragraph (1), in any case in
				which such financial institution or person—</text>
							<clause id="idF633F8AF8D674D86AD77BA533418E09A"><enum>(i)</enum><text>has in effect an
				established decision-making process with respect to suspicious
				transactions;</text>
							</clause><clause id="id36813F40D333477BBECE2C596DA3DED3"><enum>(ii)</enum><text>has made a good
				faith effort to follow existing policies, procedures, and processes with
				respect to suspicious transactions; and</text>
							</clause><clause id="id950CAEAB2CE84A1996680EE974EF5F07"><enum>(iii)</enum><text>has determined
				not to file a report with respect to a particular transaction.</text>
							</clause></subparagraph><subparagraph id="id970C1106DB8A4895A919589F0E1F515B"><enum>(B)</enum><header>Exception</header><text>The
				exemption provided under subparagraph (A) does not apply in any case in which
				the failure to submit a suspicious transaction report is accompanied by
				evidence of bad faith on the part of the financial institution or other person
				described in paragraph
				(1).</text>
