		<section id="id1B16C94DC1DB400C850617387F8FFEB7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Student Loan Simplification and
			 Opportunity Act of 2011 </short-title></quote>.</text>
		</section><section id="id75F0B905C90947DB8DAD625CE2A28287" section-type="subsequent-section"><enum>2.</enum><header>Temporary student loan
			 debt conversion authority</header>
			<subsection id="ID03fd936605b44b4b84b41dba927327f4"><enum>(a)</enum><header>Repeal</header>
				<paragraph id="id4C67CF3832A24B28862A104E91B1A164"><enum>(1)</enum><header>In
			 general</header><text>Section 459A of the Higher Education Act of 1965 (20
			 U.S.C. 1087i–1) is repealed.</text>
				</paragraph><paragraph id="idC1CD08CBBCA94C58817EDD17EF7EA3C0"><enum>(2)</enum><header>Conforming
			 amendments</header><text>Part D of the Higher Education Act of 1965 (20 U.S.C.
			 1087a et seq.) is amended—</text>
					<subparagraph id="id75C862ADA2C7499C8627D6FEA15470B7"><enum>(A)</enum><text>in section 451(a)
			 (20 U.S.C. 1087a), by striking <quote>(1) to make loans to all eligible
			 students (and the eligible parents of such students) in attendance at
			 participating institutions of higher education selected by the Secretary, to
			 enable such students to pursue their courses of study at such institutions
			 during the period beginning July 1, 1994; and (2) for purchasing loans under
			 section 459A.</quote> and inserting <quote>to make loans to all eligible
			 students (and the eligible parents of such students) in attendance at
			 participating institutions of higher education selected by the Secretary, to
			 enable such students to pursue their courses of study at such institutions
			 during the period beginning July 1, 1994.</quote>; and</text>
					</subparagraph><subparagraph id="id33948EA0B95648B69D4C9F22732394EB"><enum>(B)</enum><text>in section
			 459B(a)(2)(B) (20 U.S.C. 1087i–2(a)(2)(B)), by striking <quote>purchased by the
			 Secretary pursuant to section 459A</quote> and inserting <quote>purchased by
			 the Secretary pursuant to section 459A under the terms of that provision in
			 effect on or before June 30, 2010, or converted by the Secretary pursuant to
			 section 459A</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="ID85264239e7864d94b9be057510cf71a7"><enum>(b)</enum><header>Student loan
			 debt conversion</header><text>Part D of title IV of the Higher Education Act of
			 1965 (20 U.S.C. 1087a et seq.) is amended by inserting after section 459 the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="id81CE1C4E31BE40FAAA1E1F0AB583E2A5" style="OLC">
					<section id="idDE612BF287344EAB97B22B55491FF0F2"><enum>459A.</enum><header>Temporary
				authority to convert student loan debt</header>
						<subsection id="idBBDDCD83236843C09D3FC04B668C2056"><enum>(a)</enum><header>In
				general</header>
							<paragraph id="idB49F2721F650470184E008511E72E547"><enum>(1)</enum><header>Authority</header><text display-inline="yes-display-inline">The Secretary shall, at the request of an
				eligible borrower (as described in subsection (b)), convert an eligible student
				loan debt (as described in subsection (c)) into a Federal debt by paying the
				holder of the eligible student loan the outstanding balance of principal and
				interest on that loan, and the borrower shall enter into an agreement to repay
				to the Secretary the amount advanced to convert the debt to a Federal
				debt.</text>
							</paragraph><paragraph id="ID5e0fa18a0f6744d994144042bf51d310"><enum>(2)</enum><header>Duration of
				authority</header><text>The Secretary shall convert eligible student loan debt
				under this section for those eligible borrowers whose applications for
				conversion are received on or after January 1, 2012 and before October 1,
				2012.</text>
							</paragraph><paragraph id="ID814d1750517e4f78be5c2669f53e14d1"><enum>(3)</enum><header>Designation of
				loan</header><text>The repayment obligation of the borrower whose eligible
				student loan debt was repaid by the Secretary and converted to a Federal debt
				under this section shall be referred to as a <quote>FFEL Debt Conversion
				Loan</quote>.</text>
							</paragraph></subsection><subsection id="ID055acb8c1406431db20285687bc45452"><enum>(b)</enum><header>Eligible
				borrower</header><text>A borrower is eligible for a FFEL Debt Conversion Loan
				if the borrower, in addition to the loans described in subsection (c), has an
				outstanding loan that was made under this part, or an outstanding loan that was
				purchased by the Secretary pursuant to section 459A under the terms of that
				provision in effect on or before June 30, 2010.</text>
						</subsection><subsection id="ID9c4a3d078ec0440085f84f82cb5e4496"><enum>(c)</enum><header>Eligible
				student loan debt</header><text>A student loan of an eligible borrower is
				eligible for payment by a FFEL Debt Conversion Loan if—</text>
							<paragraph id="ID59d7b2bc9e6948f7b427aff1cea55c25"><enum>(1)</enum><text>the loan was
				made, insured, or guaranteed under part B, and not previously purchased by the
				Secretary pursuant to section 459A under the terms of that provision in effect
				on or before June 30, 2010;</text>
							</paragraph><paragraph id="ID0ef6c8e6866f44d9aae70b3ad59cbc71"><enum>(2)</enum><text>the loan is not
				in default; and</text>
							</paragraph><paragraph id="ID395d665b0b64490c978e460139b1a0fe"><enum>(3)</enum><text>the loan is not
				delinquent for 270 days or more.</text>
							</paragraph></subsection><subsection id="ID3d392e035e734bc082ce9fa32b00b646"><enum>(d)</enum><header>Terms and
				conditions of debt conversion loans</header>
							<paragraph id="id55EE7F4CEDD2412590FC35D4712070F3"><enum>(1)</enum><header>Continuation of
				terms</header><text>A FFEL Debt Conversion Loan shall be repayable by the
				borrower under the same terms and conditions as were applicable under the
				promissory note signed by the borrower for the eligible student loan debt being
				repaid by the Secretary under this section, including such terms as applied
				when the borrower entered repayment, and the availability of grace periods and
				deferments.</text>
							</paragraph><paragraph id="ID6f904154c0c944d99c4c457519f4489d"><enum>(2)</enum><header>Aggregate loan
				limits</header><text>Notwithstanding any other provision of this title, a FFEL
				Debt Conversion Loan shall be included in the calculation of the aggregate loan
				limit that was applicable to the borrower's eligible student loan for which the
				FFEL Debt Conversion Loan was obtained.</text>
							</paragraph><paragraph id="ID2494899bdf2d47f1a16c4f7fa39eca7c"><enum>(3)</enum><header>Other
				terms</header>
								<subparagraph id="id211C9B133B05443A932D2883687A7CA7"><enum>(A)</enum><header>FFEL
				terms</header><text>Other borrower benefits offered by the originating lender
				or the holder of the eligible student loan being repaid that are not specified
				in part B or in the borrower's promissory note for that loan are not available
				with respect to a FFEL Debt Conversion Loan.</text>
								</subparagraph><subparagraph id="ID389869323678470d9333e96ae314d44f"><enum>(B)</enum><header>Direct loan
				terms</header><text>Except as provided in paragraph (5), benefits offered only
				for loans made under this part are not available with respect to a FFEL Debt
				Conversion Loan.</text>
								</subparagraph></paragraph><paragraph id="ID85147a8a0c46488bbc7eb3ff674fa14e"><enum>(4)</enum><header>Fees</header>
								<subparagraph id="id64CE64D8B3844A70A1E2E8792B8A9256"><enum>(A)</enum><header>No fees imposed
				by Secretary</header><text>The Secretary shall not charge the borrower any
				origination or other fee for the making of a FFEL Debt Conversion Loan.</text>
								</subparagraph><subparagraph id="IDd328bde2370b4620b1d807062dbefbbe"><enum>(B)</enum><header>No fees imposed
				by holder of eligible student loan debt</header><text>Notwithstanding any other
				provision of law, the holder of an eligible student loan shall not charge the
				Secretary or the borrower any origination or other fee, including any fee for
				providing the information described in subsection (e), for the conversion of
				the eligible student loan debt to a FFEL Debt Conversion Loan.</text>
								</subparagraph></paragraph><paragraph id="IDe40fa6aa31184830a33ddda4bf5a2933"><enum>(5)</enum><header>Ffel debt
				conversion benefits</header><text>The Secretary may offer benefits to a
				borrower of a FFEL Debt Conversion Loan, in an amount that shall not exceed 2
				percent of the amount advanced on the FFEL Debt Conversion Loan, which may
				include payments to borrowers, reductions in the outstanding principal and
				interest on the FFEL Debt Conversion Loan, or such other benefits as the
				Secretary may establish.</text>
							</paragraph></subsection><subsection id="ID56ba23c59f624a6b83493f33b9a99f63"><enum>(e)</enum><header>Information
				from holders of student loan debt eligible for conversion</header><text>A
				holder of an eligible student loan shall promptly provide the Secretary with
				the amount outstanding and such other information as may be needed to convert
				that debt under this section.</text>
						</subsection><subsection id="id6F198325B9484384BCAC67C9060A449F"><enum>(f)</enum><header>Notification</header><text>Not
				later than December 1, 2011, the Secretary shall notify eligible
				borrowers—</text>
							<paragraph id="idB81725F5A9B34C14897772FE62673ABE"><enum>(1)</enum><text>of their
				eligibility to convert an eligible student loan debt under this section;
				and</text>
							</paragraph><paragraph id="id1544C1FC5FC94DFFB2FA2554AB637367"><enum>(2)</enum><text>of the time frame
				for applying for such
				conversion.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="IDdf53a2a35d324fb287ec879aca4172dc"><enum>(c)</enum><header>Conforming
			 amendments</header>
				<paragraph id="idF6592B61723440EBABD9061196BB744E"><enum>(1)</enum><header>Cohort default
			 rate</header><text>Section 435(m)(2) of the Higher Education Act of 1965 (20
			 U.S.C. 1085(m)(2)) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idF5A0EB7FFADC440B9742699622794A87" style="OLC">
						<subparagraph id="ID6f304ba9e3e64d189761775fbeaa86b5"><enum>(E)</enum><text>For purposes of
				this subsection, a borrower who obtains a FFEL Debt Conversion Loan under
				section 459A shall continue to be considered as having entered repayment on the
				date the borrower entered repayment on the eligible student loan debt that was
				repaid by the Secretary and converted to a Federal debt under that
				section.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="id741CF390CD264C42A3A61B07B88DE8BA"><enum>(2)</enum><header>Contracts</header><text>Section
			 456(b) of the Higher Education Act of 1965 (20 U.S.C. 1087f(b)) is
			 amended—</text>
					<subparagraph id="IDc701cd0c408b4567abb4eef35a0a314d"><enum>(A)</enum><text>in paragraph (2),
			 by inserting <quote>, converted,</quote> after <quote>made</quote>; and</text>
					</subparagraph><subparagraph id="ID29542aff07a84a9e855fed618a1b6dfb"><enum>(B)</enum><text>in paragraph (3),
			 by inserting <quote>, converted,</quote> after <quote>made</quote>.</text>
					</subparagraph></paragraph><paragraph id="id518BC17FEC2F4B028203F940AA04ADBC"><enum>(3)</enum><header>Federal
			 consolidation loans</header><text>Section 428C(a)(4)(C) of the Higher Education
			 Act of 1965 (20 U.S.C. 1078–3(a)(4)(C)) is amended by inserting <quote>or
			 converted</quote> after <quote>made</quote>.</text>
				</paragraph><paragraph id="idE8502928D4D34B59AC6397A69B9A2827"><enum>(4)</enum><header>Income-based
			 repayment</header><text>Section 493C of the Higher Education Act of 1965 (20
			 U.S.C. 1098e) is amended—</text>
					<subparagraph id="id9F376242233C4AC18DB7FE089AD8511D"><enum>(A)</enum><text>in subsection
			 (a)(3)(A), by inserting <quote>converted,</quote> after
			 <quote>made,</quote>;</text>
					</subparagraph><subparagraph id="idA5AC4A5BB84E460BA2D6B1A1C66C5F08"><enum>(B)</enum><text>in subsection
			 (b)(1), by inserting <quote>converted,</quote> after <quote>made,</quote>;
			 and</text>
					</subparagraph><subparagraph id="idB5E575A1D7F047AD9111271E3330D8B6"><enum>(C)</enum><text>in subsection
			 (c), by inserting <quote>converted,</quote> after <quote>made,</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="ID13fdc7ff55784a14a9e52186a0145b53"><enum>(d)</enum><header>Inapplicability
			 of title IV negotiated rulemaking and master calendar
			 exception</header><text>Sections 482(c) and 492 of the Higher Education Act of
			 1965 (20 U.S.C. 1089(c), 1098a) shall not apply to the amendments made by this
			 section, or to any regulations promulgated under those amendments.</text>
			</subsection><subsection id="id9DEC2333AFFB492AA93E306F1F2EA850"><enum>(e)</enum><header>Annual cost
			 estimate</header><text>Notwithstanding any other provision of this Act or an
			 amendment made by this Act, the Secretary of Education shall carry out the
			 requirement of section 459A(e)(3) of the Higher Education Act of 1965, as in
			 effect on the day before the date of enactment of this Act, with respect to the
			 annual cost estimates required to be submitted not later than February 15,
			 2012.</text>
			</subsection><subsection id="ID7c6bbfa82f014e8b82b84197001184ff"><enum>(f)</enum><header>Funds for
			 Federal Pell Grants</header><text>The proceeds to the Federal Government from
			 the temporary authority to convert student loan debt provided by the amendments
			 made by this Act shall be used to carry out Federal Pell Grants under section
			 401 of the Higher Education Act of 1965 (20 U.S.C. 1070a).</text>
