			 employment, and independent living services for veterans</header>
			<section id="id5B0B4664E2B8412081150CECE564A1C1"><enum>101.</enum><header>Increase in
			 maximum number of participants in programs of independent living services and
			 assistance for severely handicapped veterans</header><text display-inline="no-display-inline">Section 3120(e) of title 38, United States
			 Code, is amended by striking <quote>2,700</quote> and inserting
			 <quote>3,000</quote>.</text>
			</section><section id="id90C624C801BF416BB59EE2F8773DABF2"><enum>102.</enum><header>Participation
			 of veterans in the Transition Assistance Program of the Department of
			 Defense</header>
				<subsection id="idA099A8CA609148C5869DEF619FA35AE0"><enum>(a)</enum><header>In
			 general</header><text>Each veteran, during the one-year period beginning on the
			 date on which the veteran is discharged or separated from service in the Armed
			 Forces, shall be authorized to participate in the Transition Assistance Program
			 (TAP) of the Department of Defense.</text>
				</subsection><subsection id="idA8255F6F116342D7AF84B21A2B7989BA"><enum>(b)</enum><header>Counseling at
			 military installations</header><text>As part of their participation in the
			 Transition Assistance Program pursuant to this section, veterans shall be
			 authorized to receive transition assistance counseling under the program at any
			 military installation at which transition assistance counseling is being
			 provided to members of the Armed Forces under the program.</text>
				</subsection><subsection id="id6A700CABDAAF4431AD45DC6B060FCC62"><enum>(c)</enum><header>Memorandum of
			 understanding</header><text>The Secretary of Defense and the Secretary of
			 Veterans Affairs shall enter into a memorandum of understanding regarding the
			 participation of veterans in the Transition Assistance Program pursuant to this
			 section.</text>
				</subsection><subsection id="idC7D12944AF5B4884A032FCDD2E1F3B0B"><enum>(d)</enum><header>Veteran
			 defined</header><text>In this section, the term <term>veteran</term> has the
			 meaning given that term in section 101(2) of title 38, United States
			 Code.</text>
				</subsection></section><section id="id984068D57000495BA3F8B6374CB723CC"><enum>103.</enum><header>Study on
			 recognition of military training and qualifications of veterans by civilian
			 employers and educational institutions</header><text display-inline="no-display-inline">The Secretary of Veterans Affairs may
			 conduct a study on how the Secretary can improve the recognition of military
			 training and qualifications of veterans by civilian employers and educational
			 institutions.</text>
			</section><section id="idEF586A9EE72F45B3AD121DE410462FF9"><enum>104.</enum><header>Veterans
			 education outreach program</header>
				<subsection id="IDF1AB2E68788E4FC28B6256074E65672C"><enum>(a)</enum><header>Establishment</header><text>Chapter
			 36 of title 38, United States Code, is amended by adding at the end of
			 subchapter II the following new section:</text>
					<quoted-block display-inline="no-display-inline" id="IDAF8E51DF9F3B4508B059DA9758A7B0CC" style="USC">
						<section id="id8E938DF535E148749F3081D232C38585"><enum>3697B.</enum><header>Veterans
				education outreach program</header>
							<subsection id="IDE1E56921954443CD8522D9BE02E317CA"><enum>(a)</enum><header>In
				general</header><text>The Secretary shall provide funding for offices of
				veterans affairs at institutions of higher learning, as defined in section
				3452(f), in accordance with this section.</text>
							</subsection><subsection id="ID9A6402110958457F9DC8CA5731077B09"><enum>(b)</enum><header>Payments to
				institutions of higher learning</header><paragraph commented="no" display-inline="yes-display-inline" id="IDD252D6FB9BA2484B90FE868174148AEF"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="ID1D7792807C6E4E18B82A892E3E694DEA"><enum>(A)</enum><text>The Secretary shall,
				subject to the availability of appropriations, make payments to any institution
				of higher learning, under and in accordance with this section, during any
				fiscal year if the number of persons eligible for services from offices
				assisted under this section at the institution is at least 50, determined in
				the same manner as the number of eligible veterans or eligible persons is
				determined under section 3684(c) of this title.</text>
									</subparagraph><subparagraph id="IDB3C1B28CD9C240E8BDBD6ADA1CADAD88" indent="up2"><enum>(B)</enum><text>The persons who are eligible for
				services from the offices assisted under this section are persons receiving
				educational assistance administered by the Department of Veterans Affairs,
				including assistance provided under chapter 1606 of title 10.</text>
									</subparagraph></paragraph><paragraph id="ID30F41ED8D90C43B78D8AD5647AE42D06" indent="up1"><enum>(2)</enum><text>To be eligible for a payment under
				this section, an institution of higher learning or a consortium of institutions
				of higher learning, as described in paragraph (3), shall submit an application
				to the Secretary. The application shall—</text>
									<subparagraph id="IDAFBD69FCC3B84A249342BF2AC97359A3"><enum>(A)</enum><text>set forth such policies, assurances,
				and procedures that will ensure that—</text>
										<clause id="IDE424918E2F254EF7B1A64E271BC05680"><enum>(i)</enum><text>the funds received by the
				institution, or each institution in a consortium of institutions described in
				paragraph (3), under this section will be used solely to carry out this
				section;</text>
										</clause><clause id="IDCCEA412E990F4A17AEB30586E0FB30C8"><enum>(ii)</enum><text>for enhancing the functions of its
				veterans education outreach program, the applicant will expend, during the
				academic year for which a payment is sought, an amount equal to at least the
				amount of the award under this section from sources other than this or any
				other Federal program; and</text>
										</clause><clause id="ID25E6B13D662F4BBB92074DA17BC4B6CF"><enum>(iii)</enum><text>the applicant will submit to the
				Secretary such reports as the Secretary may require or as are required by this
				section;</text>
										</clause></subparagraph><subparagraph id="ID0084734820784EB8BEE498996227189D"><enum>(B)</enum><text>contain such other statement of
				policies, assurances, and procedures as the Secretary may require in order to
				protect the financial interests of the United States;</text>
									</subparagraph><subparagraph id="IDD5C4A12F6256437DB40DA6EBB2CB50E9"><enum>(C)</enum><text>set forth such plans, policies,
				assurances, and procedures as will ensure that the applicant will maintain an
				office of veterans' affairs which has responsibility for—</text>
										<clause id="ID7C4AF5A37ACA4281AE40953098F9C4E6"><enum>(i)</enum><text>veterans' certification, outreach,
				recruitment, and special education programs, including the provision of or
				referral to educational, vocational, and personal counseling for veterans;
				and</text>
										</clause><clause id="IDCF0B93C9A5434457B168BC95895DBB7A"><enum>(ii)</enum><text>providing information regarding
				other services provided veterans by the Department, including the readjustment
				counseling program authorized under section 1712A of this title and the
				programs carried out under chapters 41 and 42 of this title; and</text>
										</clause></subparagraph><subparagraph id="ID04C85FE772934C089434AEF74D03BD52"><enum>(D)</enum><text>be submitted at such time or times, in
				such manner, in such form, and contain such information as the Secretary
				determines necessary to carry out the functions of the Secretary under this
				section.</text>
									</subparagraph></paragraph><paragraph id="ID7A258F0E92614A8D8D8A53E82185B297" indent="up1"><enum>(3)</enum><text>An institution of higher learning
				which is eligible for funding under this section and which the Secretary
				determines cannot feasibly carry out, by itself, any or all of the activities
				set forth in paragraph (2)(C), may carry out such program or programs through a
				consortium agreement with one or more other institutions of higher learning in
				the same community.</text>
								</paragraph><paragraph id="IDF6A08FDB083644BABEFA42F06D3EBB70" indent="up1"><enum>(4)</enum><text>The Secretary shall not approve an
				application under this subsection unless the Secretary determines that the
				applicant will implement the requirements of paragraph (2)(C) within the first
				academic year during which it receives a payment under this section.</text>
								</paragraph></subsection><subsection id="ID9D72588B024C40768EBE274146E18B00"><enum>(c)</enum><header>Amount of
				payments</header><paragraph commented="no" display-inline="yes-display-inline" id="ID0BA6C86E3BAF404EA5F06390AE314E2B"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="IDDEC69A3213744653A71E18A9F2BEA1F7"><enum>(A)</enum><text>Subject to subparagraph
				(B), the amount of the payment which any institution shall receive under this
				section for any fiscal year shall be $100 for each person who is described in
				subsection (b)(1)(B).</text>
									</subparagraph><subparagraph id="ID2E2C01D10EB045C5A179EF6D43C0A9DF" indent="up2"><enum>(B)</enum><text>The maximum amount of payments to any
				institution of higher learning, or any branch thereof which is located in a
				community which is different from that in which the parent institution thereof
				is located, in any fiscal year is $150,000.</text>
									</subparagraph></paragraph><paragraph id="ID3015DC21076E400FA96EB4013A7851BD" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="IDB0F9C03FE2F345999CCAA559DA23422C"><enum>(A)</enum><text>The Secretary shall pay
				to each institution of higher learning which has had an application approved
				under subsection (b) the amount which it is to receive under this section. If
				the amount appropriated for any fiscal year is not sufficient to pay the
				amounts which all such institutions are to receive, the Secretary shall ratably
				reduce such payments. If any amount becomes available to carry out this section
				for a fiscal year after such reductions have been imposed, such reduced
				payments shall be increased on the same basis as they were reduced.</text>
									</subparagraph><subparagraph id="IDCBF2A7ECC56E44B9B8E67B224DD3CCFF" indent="up1"><enum>(B)</enum><text>In making payments under this section
				for any fiscal year, the Secretary shall apportion the appropriation for making
				such payments, from funds which become available as a result of the limitation
				on payments set forth in paragraph (1)(B), in an equitable manner.</text>
									</subparagraph></paragraph></subsection><subsection id="IDF92E0C44118E4268ABEA1C62AC26920A"><enum>(d)</enum><header>Coordination
				and provision of assistance, technical consultation, and
				information</header><text>The Secretary, in carrying out the provisions of this
				section, shall seek to assure the coordination of programs assisted under this
				section with other programs carried out by the Department pursuant to this
				title, and the Secretary shall provide all assistance, technical consultation,
				and information otherwise authorized by law as necessary to promote the maximum
				effectiveness of the activities and programs assisted under this
				section.</text>
							</subsection><subsection id="IDFE032E91DB56402CB6E6BAAE2AA35856"><enum>(e)</enum><header>Best practices
				and administration</header><paragraph commented="no" display-inline="yes-display-inline" id="ID5F86A0CB53C44242B91531C8B4CE0A66"><enum>(1)</enum><text>From the amounts made
				available for any fiscal year under subsection (f), the Secretary shall retain
				one percent or $20,000, whichever is less, for the purpose of collecting
				information about exemplary veterans educational outreach programs and
				disseminating that information to other institutions of higher learning having
				such programs on their campuses. Such collection and dissemination shall be
				done on an annual basis.</text>
								</paragraph><paragraph id="ID3B1A569D3CAD4731B9F71821E0519DD5" indent="up1"><enum>(2)</enum><text>From the amounts made available under
				subsection (f), the Secretary may retain not more than two percent for the
				purpose of administering this section.</text>
								</paragraph></subsection><subsection id="ID1B0B596E6A9B4CEBBD0C93B3ACF804AD"><enum>(f)</enum><header>Authorization
				of appropriations</header><text>There is authorized to be appropriated to carry
				out this section $6,000,000 for fiscal year 2012 and each fiscal year
				thereafter.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="ID4CB434DF09974A94B0EE767177C8AF91"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of sections at the beginning of chapter 36 of
			 title 38, United States Code, is amended by inserting after the item relating
			 to section 3697A the following new item:</text>

				</subsection></section><section id="idC9B2A7A1F0E543B89E91658EF092102E"><enum>105.</enum><header>Department of
			 Labor program to secure job opportunities for veterans</header>
				<subsection id="id7F5ADC0944174D01A65F7A2DBEFDB924"><enum>(a)</enum><header>Definitions</header><text>In
			 this section:</text>
					<paragraph id="id190B4A03CF7646958A454D1561C175B6"><enum>(1)</enum><header>Covered
			 veteran</header><text>In this subsection, the term <term>covered veteran</term>
			 means a veteran with traumatic brain injury or post-traumatic stress
			 disorder.</text>
					</paragraph><paragraph id="id283EDA7ADEF14C3CA355E13146781E0D"><enum>(2)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Labor, acting through the
			 Assistant Secretary for Disability Employment Policy.</text>
					</paragraph><paragraph id="idCFD8401718584358BDF0119B017CDE60"><enum>(3)</enum><header>Veteran</header><text>The
			 term <term>veteran</term> means a veteran, as defined in section 101 of title
			 38, United States Code.</text>
					</paragraph></subsection><subsection id="id3CE379299643432884BA338422260B65"><enum>(b)</enum><header>Technical
			 assistance</header><text display-inline="yes-display-inline">The Secretary
			 shall carry out a program through which the Secretary shall—</text>
					<paragraph id="idF771868DAD3F45FFBF9FC4C6306D239B"><enum>(1)</enum><text>provide technical
			 assistance to prospective employers and employers of covered veterans, to
			 enable the prospective employers and employers to employ and retain covered
			 veterans;</text>
					</paragraph><paragraph id="id51FE2EC6CFE5413483384DAC3D04D45F"><enum>(2)</enum><text>provide technical
			 assistance for entities in the workforce development system, to enable the
			 entities to help covered veterans obtain employment and succeed in that
			 employment;</text>
					</paragraph><paragraph id="id4EA33EE3B9654B42AED72B42CD6F68C4"><enum>(3)</enum><text>receive referrals
			 for technical assistance described in paragraphs (1) and (2) from reserve
			 components described in section 101 of title 10, United States Code, business
			 organizations, and Federal agencies; and</text>
					</paragraph><paragraph id="idBDAD3DB307EC4F629EDB1DC19FCA26D3"><enum>(4)</enum><text>conduct outreach
			 concerning such technical assistance through regional offices of the Department
			 of Labor.</text>
					</paragraph></subsection><subsection id="idFF285D92D47B4CF6A90017E2738BD320"><enum>(c)</enum><header>Information on
			 best practices</header><text>The Secretary shall disseminate information on
			 best practices related to assisting covered veterans in obtaining employment
			 and developing strategies to succeed in that employment. The Secretary shall
			 disseminate the information to business organizations and employers (including
			 veteran-owned businesses), human resource organizations, government agencies,
			 and Federal contractors.</text>
				</subsection><subsection id="idBBC3D27E6B6B4762B24F2C064FA27F41"><enum>(d)</enum><header>Interagency
			 working group</header>
					<paragraph id="id22AF141E48B0402FBF2B34C119FCB5A2"><enum>(1)</enum><header>Establishment
			 of working group</header><text>The Secretary shall establish a working group,
			 consisting of representatives of Federal agencies with programs that assist
			 covered veterans in obtaining or maintaining employment.</text>
					</paragraph><paragraph id="idCB1881D3D975437685AE0AF8380605B1"><enum>(2)</enum><header>Duties of
			 working group</header><text>The working group shall share information on best
			 practices, share resources, and develop a plan, for providing such assistance
			 to the covered veterans. The working group shall submit the plan to the heads
			 of the Federal agencies.</text>
					</paragraph><paragraph id="id070E601E01964F36BC1E0F67DFC43643"><enum>(3)</enum><header>Functions of
			 Federal agencies</header><text>Each head of a Federal agency receiving the plan
			 shall consider the plan and make appropriate changes to carry out functions
			 that assist covered veterans in obtaining and maintaining employment.</text>
					</paragraph></subsection></section></title><title id="id21D838931CDE4CA1ABD923E4EA226E6F"><enum>II</enum><header>Assistance for
			 homeless veterans</header>
			<section id="idAB0154E961944B5EAE4AA32A4969A462"><enum>201.</enum><header>Repeal of
			 sunset on extension of enhanced protections for servicemembers relating to
			 mortgages and mortgage foreclosure under Servicemembers Civil Relief
			 Act</header><text display-inline="no-display-inline">Subsection (c) of section
			 2203 of the Housing and Economic Recovery Act of 2008 (50 U.S.C. App. 533 note)
			 is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="id2085294150ED47F7A054259D736C9F78" style="OLC">
					<subsection id="id26D4F2B3517E45238AA4CE83CF9F2B37"><enum>(a)</enum><header>Effective
				date</header><text display-inline="yes-display-inline">The amendments made by
				subsection (a) shall take effect on the date of the enactment of this
				Act.</text>

			</section><section display-inline="no-display-inline" id="H0ED0E80DAD5C415B955A89618652B273" section-type="subsequent-section"><enum>202.</enum><header>Improvement of
			 payments for providing services to homeless veterans</header>
				<subsection id="H02CF3239973440EEABB726C4247DAFE1"><enum>(a)</enum><header>Improvement of
			 payments</header><text display-inline="yes-display-inline">Section 2012 of
			 title 38, United States Code, is amended—</text>
					<paragraph id="HBC6E49631D554DB88EADCC8F4E518DC5"><enum>(1)</enum><text>by striking
			 <quote>per diem</quote> each place it appears;</text>
					</paragraph><paragraph id="H811E4AA1BA704B0E8DFF9F2D97FB11FC"><enum>(2)</enum><text>in subsection
			 (a)(2)—</text>
						<subparagraph id="HCA83F86239C84F21828EBF093C3680F9"><enum>(A)</enum><text>in subparagraph
			 (A)—</text>
							<clause id="HBFC75CCD53EE46158EDD577FC168AFE8"><enum>(i)</enum><text>by
			 striking <quote>daily cost of care</quote> and inserting <quote>annual cost of
			 furnishing services</quote>; and</text>
							</clause><clause id="HFD2211DFB7C141B7A0C013DDC0C513CE"><enum>(ii)</enum><text>by
			 striking the second sentence;</text>

			 subparagraph (B) and inserting the following new subparagraph (B):</text>
							<quoted-block id="HB5649936D54145A78586B16C9F637575" style="USC">
								<subparagraph id="HB06C48DAD00B47FD988580AC2F0EF06E" indent="up2"><enum>(B)</enum><text>The Secretary shall annually adjust
				the rate of payment under subparagraph (A) to reflect anticipated changes in
				the cost of furnishing services and to take into account the cost of providing
				services in a particular geographic area. The Secretary may set a maximum
				amount payable to a grant recipient under this
				section.</text>
								</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
						</subparagraph><subparagraph id="H4EDA93CAD03E4301B09B900108408FD1"><enum>(C)</enum><text>in subparagraph
			 (C), by striking <quote>other sources of income</quote> and all that follows
			 through the period at the end and inserting <quote>the cost of services
			 provided by the grant recipient as the Secretary may require to assist the
			 Secretary in making the determination under subparagraph (A).</quote>;</text>
						</subparagraph><subparagraph id="H98702D22A48E43D196874ACC644A5844"><enum>(D)</enum><text>by striking
			 subparagraph (D) and inserting the following new subparagraph (D):</text>
							<quoted-block id="H1DB480E283684C27B7D91F45A38C362A" style="USC">
								<subparagraph id="H50E0D4497F09477D987C1B479CE6AECD" indent="up2"><enum>(D)</enum><text>In making the determination under
				subparagraph (A), the Secretary may consider the availability of other sources
				of income, including payments to the grant recipient or eligible entity for
				furnishing services to homeless veterans under programs other than under this
				subchapter, payments or grants from other departments or agencies of the United
				States, from departments or agencies of State or local governments, or from
				private entities or organizations.</text>
								</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
						</subparagraph><subparagraph id="HAC60810AFA094974A370054A5589BC9B"><enum>(E)</enum><text>by adding at the
			 end the following new subparagraph:</text>
							<quoted-block display-inline="no-display-inline" id="H4875BB37392A4803856E1141E7F3029B" style="USC">
								<subparagraph id="HE0729A435C044BA5883B21FA09E90B5C" indent="up2"><enum>(E)</enum><clause commented="no" display-inline="yes-display-inline" id="id4317FE895108419580695A5822FD5091"><enum>(i)</enum><text display-inline="yes-display-inline">The Secretary shall authorize payments
				under this subsection to each grant recipient on an annual basis but shall make
				a payment to each grant recipient for each calendar quarter in an amount equal
				to a portion of the annual amount authorized for such recipient.</text>
									</clause><clause id="idC2645A066CCC4705BB324D944B262364" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">Upon the expiration of a calendar
				quarter—</text>
										<subclause id="id45346B1364244728A3BF44F154479845"><enum>(I)</enum><text display-inline="yes-display-inline">each grant recipient shall provide to the
				Secretary a statement of the amount spent by the recipient during that calendar
				quarter;</text>
										</subclause><subclause id="idB508593A613E47F49E26AFDD3527023F"><enum>(II)</enum><text display-inline="yes-display-inline">if the amount spent is less than the amount
				provided for that calendar quarter, repay to the Secretary the balance;
				and</text>
										</subclause><subclause id="id2CF54219361B467D836BA9111AF41C91"><enum>(III)</enum><text display-inline="yes-display-inline">if the amount spent by a grant recipient
				for such purpose for a calendar quarter exceeds the amount provided to the
				recipient for that quarter, the Secretary shall make an additional payment to
				the recipient in an amount equal to the amount by which the amount so spent
				exceeded the amount so provided, as long as the total amount provided to such
				recipient in a calendar year does not exceed the amount of the annual payment
				for that recipient.</text>
										</subclause></clause></subparagraph><after-quoted-block>;
				</after-quoted-block></quoted-block>
						</subparagraph></paragraph><paragraph id="HBAEA4A93EE6E4168B2B18B6EDE55C71D"><enum>(3)</enum><text>in subsection (a),

			 reviewing of the process by which referrals for mental health care are given to
			 individuals who, during a post deployment health assessment administered by the
			 Secretary of Defense, are identified as having a potential mental health
			 condition. Such monitoring and reviewing shall identify and compare, on a
			 regular basis, the number of individuals to whom such referrals are issued with
			 the number of individuals who complete a course of treatment for a mental
			 health condition subsequent to receiving such a referral.</text>
			</section><section id="id941AE26F27454C90B32AA696780D0088"><enum>302.</enum><header>Improvements
			 to plans for veterans with traumatic brain injury for rehabilitation and
			 reintegration into the community</header><text display-inline="no-display-inline">Section 1710C(b) of title 38, United States
			 Code, is amended—</text>

				professional counseling, marriage and family counseling, training, and mental
				health services as are necessary in connection with that
				deployment.</text>

			 Uniformed Services University of the Health Sciences permitted to perform

				and related mental health services for veterans under section 1712A of title
				38.</text>
								</paragraph><paragraph id="idCBA2E6DD55EA47CDBF760F5FC5BF7768" indent="up1"><enum>(2)</enum><text>The limitation in subsection (a)
				relating to the percentage of graduates of a class at the University that can
				perform civilian Federal service in lieu of active duty in the uniformed
				services shall not apply to graduates who perform civilian Federal service
				under paragraph (1) of this subsection.</text>
								</paragraph><paragraph id="id525A330B1F8640E0A89D023B7C65BED3" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idD9E01E58C3A94BC5914186B31A97EB2E"><enum>(A)</enum><text>The Secretary of
				Veterans Affairs may reimburse the Secretary of Defense for the expenses
				incurred by the Secretary of Defense in providing education under this chapter
				to a person who performs civilian service under paragraph (1).</text>
									</subparagraph><subparagraph id="id36DC7E9FD05B4B32965AC55D798FB831" indent="up1"><enum>(B)</enum><text>If the Secretary of Veterans Affairs
				reimburses the Secretary of Defense as described in subparagraph (A) with
				respect to a person, the Secretary of Defense may not recall such person to
				active duty in the uniformed services without the consent of the Secretary of
				Veterans Affairs.</text>

			 of the Department of Veterans Affairs</header>
			<section id="idEE40059C55A441C78FD51D93E24F2F46"><enum>401.</enum><header>Monitoring of
			 Integrated Disability Evaluation System</header>
				<subsection id="id0E1CB4CCFE564AAC8B98682FA326B73F"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary of
			 Defense and the Secretary of Veterans Affairs shall jointly develop a
			 systemwide monitoring mechanism to identify and address issues arising out of
			 facilities and offices of the Department of Defense and the Department of
			 Veterans Affairs involved in the Integrated Disability Evaluation
			 System.</text>
				</subsection><subsection id="id8B85168C145E45A3B87DEFF9D61C04E7"><enum>(b)</enum><header>Elements</header><text>The
			 monitoring mechanism required by subsection (a) shall include the following,
			 with respect to the Integrated Disability Evaluation System:</text>
					<paragraph id="id4FEEFD4B114D4452B55FA73574817EE9"><enum>(1)</enum><text>Continuous
			 collection and analysis of data on—</text>
						<subparagraph id="idBA8150C4696E4E94A854024A9BA26417"><enum>(A)</enum><text>staffing levels
			 of the Department of Defense and the Department of Veterans Affairs;</text>
						</subparagraph><subparagraph id="id7E8E6B83DF814416BEC3DC716227451D"><enum>(B)</enum><text>sufficiency of
			 exam summaries; and</text>
						</subparagraph><subparagraph id="id518DFB89AB4643BC9E0719363C823D5D"><enum>(C)</enum><text>diagnostic
			 disagreements.</text>
						</subparagraph></paragraph><paragraph id="idF9D0BE6EB9D54D66B81188B870D041FE"><enum>(2)</enum><text>Monitoring of
			 available data on caseloads and case processing time by individual rating
			 offices of the Department of Veterans Affairs and the physical evaluation
			 boards of the Department of Defense.</text>
					</paragraph><paragraph id="idBC59867656A74335AB5B9C69D4A53575"><enum>(3)</enum><text>A formal
			 mechanism for agency officials at local facilities to communicate challenges
			 and best practices to Department of Defense and Department of Veterans Affairs
			 headquarters.</text>
					</paragraph></subsection></section><section id="idCDC820B044BD4490B92DDDFEAF50759E"><enum>402.</enum><header>Independent
			 review of transition from receipt of benefits and services from Department of
			 Defense to receipt of benefits and services from Department of Veterans
			 Affairs</header><text display-inline="no-display-inline">The Comptroller
			 General of the United States, the Inspector General of the Department of
			 Defense, and the Inspector General of the Department of Veterans Affairs may
			 form an independent board to review the effectiveness and efficiency of the
			 process by which members of the Armed Forces transition from the receipt of
			 benefits and services from the Department of Defense to the receipt of benefits
			 and services from the Department of Veterans Affairs.</text>
			</section><section id="idC18523B575D2467F88100DAB99FE6286" section-type="subsequent-section"><enum>403.</enum><header>Treatment of certain
			 misfiled documents as motions for reconsideration of decisions by Board of
			 Veterans' Appeals</header><text display-inline="no-display-inline">Section 7103
			 of title 38, United States Code, is amended—</text>
				<paragraph id="id8DC19F3B0ADE404C8A86940CBF1C2C83"><enum>(1)</enum><text>by redesignating
			 subsection (c) as subsection (d); and</text>
				</paragraph><paragraph id="idDE087B693A45433CAD93072DFA9C98CC"><enum>(2)</enum><text>by inserting
			 after subsection (b) the following new subsection (c):</text>
					<quoted-block display-inline="no-display-inline" id="id7D5EB3DD179542A5A181578B783A78CF" style="OLC">

				paragraph (2), if a person adversely affected by a final decision of the Board,
				who has not filed a notice of appeal with the United States Court of Appeals
				for Veterans Claims under section 7266(a) of this title within the period set
				forth in that section, files a document with the Board or the agency of
				original jurisdiction referred to in section 7105(b)(1) of this title that
				expresses disagreement with such decision not later than 120 days after the
				date of such decision, such document shall be treated as a motion for
				reconsideration of such decision under subsection (a).</text>
							</paragraph><paragraph id="id60A4CDC73AC1480BB7F5BCCC84190B9D" indent="up1"><enum>(2)</enum><text>A document described in paragraph (1)
				shall not be treated as a motion for reconsideration of the decision under
				paragraph (1) if—</text>
								<subparagraph id="idAD90AA99D4C142DD956AB0B85E714AF9"><enum>(A)</enum><text>the Board or the agency of original
				jurisdiction referred to in paragraph (1)—</text>
									<clause id="id9284F304BF884ED989D14F18F3041F09"><enum>(i)</enum><text>receives the document described in
				paragraph (1);</text>
									</clause><clause id="idE1D5596AD4164DD7A5241969CD0F5E88"><enum>(ii)</enum><text>determines that such document
				expresses an intent to appeal the decision to the United States Court of
				Appeals for Veterans Claims; and</text>
									</clause><clause id="idA35BA9C4E7D249279CB8A676CC51AF3C"><enum>(iii)</enum><text>forwards such document to the
				United States Court of Appeals for Veterans Claims; and</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF2F95C616B2948CCBE975B1BD4AFF8B7"><enum>(B)</enum><text>the United States Court of Appeals for
				Veterans Claims receives such document within the period set forth by section
				7266(a) of this
				title.</text>
