		<official-title>To amend title 10, United States Code, to authorize the
		  Defense Commissary Agency to conduct a pilot program at military installations
		  to be closed or subject to an adverse realignment under a base closure law
		  under which a commissary store may sell additional types of
		  merchandise.</official-title>

		<section id="H0E411D8AC6AC4DA692249F9DC19B5683" section-type="section-one"><enum>1.</enum><header>Enhanced commissary stores
			 pilot program</header>
			<subsection id="HC5C3102329FD4349AB132DAC5F4F53CF"><enum>(a)</enum><header>Authority To
			 operate enhanced commissary stores</header><text display-inline="yes-display-inline">Subchapter II of chapter 147 of title 10,
			 United States Code, is amended by inserting after section 2488 the following
			 new section:</text>
				<quoted-block display-inline="no-display-inline" id="H7F696F0CCEE0465587AAB9D143151A82" style="USC">
					<section id="H7183ECDD32DB468B87D6418BB479C66B"><enum>2488a.</enum><header>Enhanced
				commissary stores</header>
						<subsection id="H5DACE06875564ABB8AB26390E7A2A117"><enum>(a)</enum><header>Authority To
				operate</header><text display-inline="yes-display-inline">The Defense
				Commissary Agency—</text>
							<paragraph id="HE9DE8CAAC6BB41BB97AB13C84C934FD1"><enum>(1)</enum><text display-inline="yes-display-inline">shall operate an enhanced commissary store
				at Naval Air Station, Brunswick, Maine; and</text>
							</paragraph><paragraph id="H3BE32FE82EF1403B932B09E21CA08D3D"><enum>(2)</enum><text display-inline="yes-display-inline">may operate an enhanced commissary store at
				such other military installations designated for closure or adverse realignment
				under a base closure law as the Defense Commissary Agency considers to be
				appropriate.</text>
							</paragraph></subsection><subsection id="HFA549E7D2AB7407F9C4389795F11B244"><enum>(b)</enum><header>Additional
				categories of merchandise</header><paragraph commented="no" display-inline="yes-display-inline" id="H6A914FD66B0443DABAB9A434F7ACE2E6"><enum>(1)</enum><text display-inline="yes-display-inline">In addition to selling items in the
				merchandise categories specified in subsection (b) of section 2484 of this
				title in the manner provided by such section, an enhanced commissary store also
				may sell items in the following categories as commissary merchandise:</text>
								<subparagraph id="H2AF32E37EFE94A11B08C3F9C0E64F9E1" indent="up1"><enum>(A)</enum><text>Alcoholic beverages.</text>
								</subparagraph><subparagraph id="HDCA961C9A89B4184904FD3E7146C7A2E" indent="up1"><enum>(B)</enum><text>Tobacco products.</text>
								</subparagraph><subparagraph id="H2F7916543FFF4EFBB29C80763598D2B0" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">Items in such other merchandise categories
				(not covered by subsection (b) of section 2484 of this title) as the Secretary
				of Defense may authorize.</text>
								</subparagraph></paragraph><paragraph id="HF1554155B0494A11BC9658239C5F7B2E" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Subsections (c) and (g) of section 2484 of
				this title shall not apply with regard to the selection, or method of sale, of
				merchandise in the categories specified in subparagraphs (A) and (B) of
				paragraph (1) or in any other merchandise category authorized under
				subparagraph (C) of such paragraph for sale in, at, or by an enhanced
				commissary store.</text>
							</paragraph></subsection><subsection id="HCF826B35C4EC4C8A989EF04F7F3046C0"><enum>(c)</enum><header>Sales price
				establishment and surcharge</header><text display-inline="yes-display-inline">Subsections (d) and (e) of section 2484 of
				this title shall not apply to the pricing of merchandise in the categories
				specified in subparagraphs (A) and (B) of paragraph (1) of subsection (b) or in
				any other merchandise category authorized under subparagraph (C) of such
				paragraph for sale in, at, or by an enhanced commissary store. Instead, the
				Secretary of Defense shall determine appropriate prices for such merchandise
				sold in, at, or by an enhanced commissary store.</text>
						</subsection><subsection id="H9AB63B3152DC440D8B0AD82E77791593"><enum>(d)</enum><header>Retention and
				use of portion of proceeds</header><paragraph commented="no" display-inline="yes-display-inline" id="H37DC12F80F0A404AB004D8D268141D44"><enum>(1)</enum><text display-inline="yes-display-inline">The Secretary of Defense may retain amounts
				equal to the difference between—</text>
								<subparagraph id="H10931A05AF24496DBA603690DE4857A4" indent="up1"><enum>(A)</enum><text>the retail price of merchandise in the
				categories specified in subparagraphs (A) and (B) of paragraph (1) of
				subsection (b) and in other merchandise categories authorized under
				subparagraph (C) of such paragraph for sale in, at, or by an enhanced
				commissary store; and</text>
								</subparagraph><subparagraph id="H0A1D063DEAFD4E5F9DD39AF8060F1DF9" indent="up1"><enum>(B)</enum><text>the invoice cost of such
				merchandise.</text>
								</subparagraph></paragraph><paragraph id="HAD58B5C6F2584ECFB833318826AA5C62" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The Secretary of Defense shall use amounts
				retained under paragraph (1) for an enhanced commissary store to help offset
				the operating costs of that enhanced commissary
				store.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HA77D4C1048B54636B930AAD04501CE5A"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of sections at the beginning of such chapter
			 is amended by inserting after the item relating to section 2488 the following
			 new item:</text>
