		<official-title>To amend the Surface Mining Control and Reclamation Act
		  of 1977 to limit the liability of a State performing reclamation work under an
		  approved State abandoned mine reclamation plan.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>State
			 liability under a reclamation program</header><text display-inline="no-display-inline">Section 405(l) of the Surface Mining Control
			 and Reclamation Act of 1977 (30 U.S.C. 1235(l)) is amended by striking
			 subsection (l) and inserting the following:</text>

				<subsection id="id74893D5B8F764729A2590F926B95247A"><enum>(l)</enum><header>State
				liability</header>
					<paragraph id="idD94403A2E0E54F6B834CD2A3C63F5A82"><enum>(1)</enum><header>Definition of
				gross negligence</header><text>In this subsection, the term <term>gross
				negligence</term> means reckless, willful, or wanton misconduct by a
				State.</text>
					</paragraph><paragraph id="id206B382851C548378712CBB2D5D533D6"><enum>(2)</enum><header>Liability</header><text>No
				State shall be liable under any provision of Federal law for any costs or
				damages incurred as a result of action taken or omitted in the course of
				carrying out a State abandoned mine reclamation plan under this section,
				including reclamation activities conducted by a State pursuant to a State
				abandoned mine reclamation plan approved under this section.</text>
					</paragraph><paragraph id="idF4ED6EB4595448A9BE5F405708D17C61"><enum>(3)</enum><header>Exceptions</header><text>This
				subsection shall not preclude liability for any costs or damages incurred as a
				result of gross negligence or intentional misconduct by the
				State.</text>
