		<section changed="deleted" committee-id="SSJU00" id="S1" reported-display-style="strikethrough" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Strengthening and Focusing Enforcement
			 to Deter Organized Stealing and Enhance Safety Act of
			 2011</short-title></quote> or the <quote>SAFE DOSES Act</quote>.</text>
		</section><section changed="deleted" committee-id="SSJU00" id="IDeeaa1dec851e418aae0a990cf4e8d08a" reported-display-style="strikethrough"><enum>2.</enum><header>Theft of medical
			 products</header>
			<subsection id="ID708d965a002b4241ae1cf489f7a5a7ca"><enum>(a)</enum><header>In
			 general</header><text>Chapter 31 of title 18, United States Code, is amended by
			 adding at the end the following:</text>

					<section id="ID8792d067c2ec43239b9630f44a253286"><enum>670.</enum><header>Theft of
				medical products</header>
						<subsection id="ID1ce13fa134cb452cac6e1c0fe237e5ca"><enum>(a)</enum><header>Definitions</header><text>In
				this section—</text>
							<paragraph id="ID0ae379e6ad1e4e36ab3c969c27d4d019"><enum>(1)</enum><text>the term
				<term>biological product</term> has the meaning given the term in section 351
				of the Public Health Service Act (42 U.S.C. 262);</text>
							</paragraph><paragraph id="IDfd4280a585b546d499cce55eafba9f8b"><enum>(2)</enum><text>the terms
				<term>device</term>, <term>drug</term>, <term>infant formula</term>, and
				<term>labeling</term> have the meanings given those terms in section 201 of the
				Federal Food, Drug, and Cosmetic Act (21 U.S.C. 321);</text>
							</paragraph><paragraph id="IDe8bf8df4f8044bdc9a8b58cd41bbabae"><enum>(3)</enum><text>the term
				<term>medical food</term> has the meaning given the term in section 5(b) of the
				Orphan Drug Act (21 U.S.C. 360ee(b)); and</text>
							</paragraph><paragraph id="IDa287efa866ac49f4a4c75e6926937de7"><enum>(4)</enum><text>the term
				<term>medical product</term> means a drug, biological product, device, medical
				food, or infant formula that—</text>
								<subparagraph id="IDb3573d5c8bf54799bf721804a565b231"><enum>(A)</enum><text>is being stored
				for transportation, or is being or has been transported, shipped, or received;
				and</text>
								</subparagraph><subparagraph id="ID305f681b6739459aba73cbe4770a4c90"><enum>(B)</enum><text>has not yet been
				made available for retail purchase by a customer at the time of the relevant
				conduct described in subsection (b).</text>
								</subparagraph></paragraph></subsection><subsection id="ID92c6c8741a62489e88bc90d3807992ba"><enum>(b)</enum><header>Offenses</header><text>It
				shall be unlawful, using any means or facility of interstate or foreign
				commerce, or in or affecting interstate or foreign commerce, to
				knowingly—</text>
							<paragraph id="IDf6c5732492dc458fb903e7e99038504e"><enum>(1)</enum><text>steal, take
				without authorization, embezzle, carry away, or obtain by fraud or deception a
				medical product, or attempt or conspire to do so;</text>
							</paragraph><paragraph id="ID1fac4a179fb9404a95a584cd0781be87"><enum>(2)</enum><text>transport, handle,
				traffic in, or store a stolen medical product, or attempt or conspire to do so;
				or</text>
							</paragraph><paragraph id="ID9d124d22adbe4be0a624ef46c82373c0"><enum>(3)</enum><text>participate, in
				any way, in a scheme to alter, forge, or falsify the labeling or documentation
				(including documentation relating to origination or shipping) of a stolen or
				expired medical product.</text>
							</paragraph></subsection><subsection id="IDdb57d3e3b7aa4ccb96226ecaf4d76025"><enum>(c)</enum><header>Penalties</header>
							<paragraph id="IDac13de34643141b9a6fe0e2129b73953"><enum>(1)</enum><header>In
				general</header><text>Any person that violates subsection (b)—</text>
								<subparagraph id="id2B5F836AD79B4B478BA24A58C858BCB3"><enum>(A)</enum><text>if the value of
				the medical product or products is less than $5,000, shall be fined under this
				title, imprisoned for not more than 3 years, or both; and</text>
								</subparagraph><subparagraph id="id3F1C3006FEE74C03AEE751EEB8FFC154"><enum>(B)</enum><text>subject to
				paragraph (2), for any other violation, shall be fined under this title,
				imprisoned for not more than 20 years, or both.</text>
								</subparagraph></paragraph><paragraph id="ID8e3308fc7baa47ce9f0530799464654b"><enum>(2)</enum><header>Additional
				factors</header><text>Any person that violates subsection (b) shall be fined
				under this title and imprisoned for not less than 1 year nor more than 20 years
				if—</text>
								<subparagraph id="id60504B3151FB450CA03056A3A3232799"><enum>(A)</enum><text>the value of the
				medical product or products is not less than $5,000; and</text>
								</subparagraph><subparagraph id="IDc7dbc384f7b24ec18bd5ad3052c05808"><enum>(B)</enum><text>the—</text>
									<clause id="idAEF810FCB7224BFEB84CAFF58862D660"><enum>(i)</enum><text>person—</text>
										<subclause id="IDdc6c6896a16a4b21a0eeb8b192cae454"><enum>(I)</enum><text>buys, or otherwise
				obtains, a medical product, knowing or with reckless disregard as to whether
				the medical product is expired or has been stolen, with the intent to sell or
				distribute the medical product;</text>
										</subclause><subclause id="IDc6e89a096e6a46f4bf806b6e4c1a8966"><enum>(II)</enum><text>sells, or
				distributes, a medical product, knowing or with reckless disregard as to
				whether the medical product is expired or has been stolen; or</text>
										</subclause><subclause id="ID8ba59f831c274705ba4544285bb4c322"><enum>(III)</enum><text>at the time of
				the violation is employed by, or is an agent of, an organization in the supply
				chain from which the stolen or expired medical products were removed, including
				a manufacturer, wholesaler, repacker, own-label distributor, private-label
				distributor, jobber, broker, drug trader, transportation company, hospital,
				pharmacy, or security company; or</text>
										</subclause></clause><clause id="IDf6543af8b87c4e379371f206c0de7af1"><enum>(ii)</enum><text>violation—</text>
										<subclause id="ID1730b98ba7504ea0b8e744570902b4cd"><enum>(I)</enum><text>involves the use
				of violence, force, or a threat of violence or force;</text>
										</subclause><subclause id="IDf542338ebc2f4ba785df08f9fb95385e"><enum>(II)</enum><text>involves the use
				of a deadly weapon;</text>
										</subclause><subclause id="IDa27ef726ff8b422483140c43c534ab2d"><enum>(III)</enum><text>results in
				injury, including the injury of deprivation of treatment, or death caused by
				ingestion or use of a stolen or expired medical product; or</text>
										</subclause><subclause id="IDaffa2a2f6d584d0fbcb57bbd8f246286"><enum>(IV)</enum><text>is the second or
				subsequent offense under subsection (b) committed by the person.</text>
										</subclause></clause></subparagraph></paragraph><paragraph id="ID4259c385dad74ac7ace48349288c8625"><enum>(3)</enum><header>Civil
				penalties</header>
								<subparagraph id="IDb07a86bf092347ab821380c51a80968d"><enum>(A)</enum><header>In
				general</header><text>The Attorney General may bring a civil action in an
				appropriate United States district court against any person that engages in
				conduct that violates subsection (b).</text>
								</subparagraph><subparagraph id="ID3d3ebcc3d1d24151885c8f6811135b51"><enum>(B)</enum><header>Penalty</header><text>In
				a civil action brought under subparagraph (A) the court may impose a civil
				penalty in an amount not more than the greater of 3 times the economic loss
				attributable to the violation or
				$1,000,000.</text>
								</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="IDab380d3f1068435aafbdfc27f5075258"><enum>(b)</enum><header>Civil
			 forfeiture</header><text>Section 981(a)(1)(C) of title 18, United States Code,
			 is amended by inserting <quote>670,</quote> after <quote>657,</quote>.</text>
			</subsection><subsection id="IDf5747e67c3884de9b1f8019eb370c9c8"><enum>(c)</enum><header>Technical and
			 conforming amendment</header><text>The table of sections for chapter 31 of
			 title 18, United States Code, is amended by adding after the item relating to
			 section 669 the following:</text>

			 theft-related offenses</header>
			<subsection id="IDc6b0c8801b454faa9382ea8671bdf947"><enum>(a)</enum><header>Interstate or
			 foreign shipments by carrier</header><text>Section 659 of title 18, United
			 States Code, is amended in the fifth undesignated paragraph, by striking
			 <quote>10 years</quote> and inserting <quote>20 years</quote>.</text>
			</subsection><subsection id="IDac9f01f8a08647b4bd491eb8bb9a9414"><enum>(b)</enum><header>Racketeering</header><text>Chapter
			 95 of title 18, United States Code, is amended—</text>
				<paragraph id="ID0c9d2d952c6741f7b6896a54dd1f95e3"><enum>(1)</enum><text>in section
			 1952(a)(3)(A), by striking <quote>5 years</quote> and inserting <quote>20
			 years</quote>; and</text>
				</paragraph><paragraph id="IDe09f06128ecc4a3aa80ca5a29a8848ec"><enum>(2)</enum><text>in section
			 1957(b)(1), by striking <quote>ten years</quote> and inserting <quote>20
			 years</quote>.</text>
				</paragraph></subsection><subsection id="IDa7683334115d471381d50d74e4cabeba"><enum>(c)</enum><header>Breaking or
			 entering carrier facilities</header><text>Section 2117 of title 18, United
			 States Code, is amended in the first undesignated paragraph by striking
			 <quote>ten years</quote> and inserting <quote>20 years</quote>.</text>
			</subsection><subsection id="ID114b5a979f1645f99252d76399210f65"><enum>(d)</enum><header>Stolen
			 property</header><text>Chapter 113 of title 18, United States Code, is
			 amended—</text>
				<paragraph id="ID79e40bf93b2f4eeba9f90846fe62ad8e"><enum>(1)</enum><text>in section 2314,
			 in the sixth undesignated paragraph, by striking <quote>ten years</quote> and
			 inserting <quote>20 years</quote>; and</text>
				</paragraph><paragraph id="ID2a1cbaf88d244e15a51b507a654f144e"><enum>(2)</enum><text>in section 2315,
			 in the fourth undesignated paragraph, by striking <quote>ten years</quote> and
			 inserting <quote>20 years</quote>.</text>
				</paragraph></subsection></section><section changed="deleted" committee-id="SSJU00" id="ID2c40620cb4954b35925a57840da714a3" reported-display-style="strikethrough"><enum>4.</enum><header>Amendment to
			 RICO</header><text display-inline="no-display-inline">Section 1961(1)(B) of
			 title 18, United States Code, is amended by inserting <quote>, section 670
			 (relating to theft of medical products)</quote> before <quote>, sections
			 891</quote>.</text>
		</section><section changed="deleted" committee-id="SSJU00" id="IDa647e08252fc48a38aaa9b9ebe1bb578" reported-display-style="strikethrough"><enum>5.</enum><header>Amendment to
			 title III</header><text display-inline="no-display-inline">Section 2516(1) of
			 title 18, United States Code, is amended—</text>
			<paragraph id="idDE7AB2480CB946BCA7188D9B607B1475"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraph (s) as paragraph
			 (t); and</text>
			</paragraph><paragraph id="id70D861DB75884C0CB52BB81401CB499D"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after paragraph (r) the
			 following:</text>

			 order of restitution</header><text display-inline="no-display-inline">Section
			 3663A(c)(1)(A) of title 18, United States Code, is amended—</text>
			<paragraph id="id88CCAF7493EA4D72B1C89E2666052F4B"><enum>(1)</enum><text display-inline="yes-display-inline">in clause (ii), by striking
			 <quote>or</quote> at the end;</text>
			</paragraph><paragraph id="id97B6FDE96CB042A294E00648B53171EC"><enum>(2)</enum><text display-inline="yes-display-inline">in clause (iii), by striking
			 <quote>and</quote> at the end and inserting <quote>or</quote>; and</text>

			 United States Sentencing Commission</header><text display-inline="no-display-inline">Pursuant to its authority under section 994
			 of title 28, United States Code, and in accordance with this Act, the United
			 States Sentencing Commission shall review and, if appropriate, amend the
			 Federal Sentencing Guidelines and policy statements applicable to a person
			 convicted of an offense under section 2118 of title 18, United States Code,
			 section 670 of title 18, United States Code, as added by this Act, or other
			 section of title 18 of the United States Code, amended by this Act.</text>

			 products</header>
			<subsection id="H18C84DA5FA9C43468DB805577A8CC272"><enum>(a)</enum><header>Prohibited conduct and
			 penalties</header><text>Chapter 31 of title 18, United States Code, is amended
			 by adding at the end the following:</text>

					<section id="HF29B99C07E204667ADD05974B5688CC8"><enum>670.</enum><header>Theft of medical
				products</header>
						<subsection id="H00B2501B33C24CE2BB29A73267F3B03D"><enum>(a)</enum><header>Prohibited
				conduct</header><text>Whoever, in, or using any means or facility of,
				interstate or foreign commerce—</text>
							<paragraph id="H9789C21F77BF4736BECF4EFE57EE6E70"><enum>(1)</enum><text>embezzles, steals, or by
				fraud or deception obtains, or knowingly and unlawfully takes, carries away, or
				conceals, a pre-retail medical product;</text>
							</paragraph><paragraph id="HC8A7B45DC2C74604A4CF3641A7A961E0"><enum>(2)</enum><text>knowingly and falsely
				makes, alters, forges, or counterfeits the labeling or documentation (including
				documentation relating to origination or shipping) of a pre-retail medical
				product;</text>
							</paragraph><paragraph id="H09574AC5687B417D8B9BF1E4A12B3738"><enum>(3)</enum><text>knowingly possesses,
				transports, or traffics in a pre-retail medical product that was involved in a
				violation of paragraph (1) or (2);</text>
							</paragraph><paragraph id="H78A1106EF22244B6AAAA420DB072A1F4"><enum>(4)</enum><text>with intent to defraud,
				buys, or otherwise obtains, a pre-retail medical product that has expired or
				been stolen;</text>
							</paragraph><paragraph id="H39F8D1B7A7954BAC992927B51B4A5362"><enum>(5)</enum><text>with intent to defraud,
				sells, or distributes, a pre-retail medical product that is expired or stolen;
				or</text>
							</paragraph><paragraph id="HA700AE39EF044489858196C021278275"><enum>(6)</enum><text>attempts or conspires to
				violate any of paragraphs (1) through (5);</text>
							</paragraph><continuation-text continuation-text-level="subsection">shall be punished as provided in
				subsection (c) and subject to the other sanctions provided in this
				section.</continuation-text></subsection><subsection id="H27AD63B3F73C4D0DA33E34DC9F247F95"><enum>(b)</enum><header>Aggravated
				offenses</header><text display-inline="yes-display-inline">An offense under
				this section is an aggravated offense if —</text>
							<paragraph id="HAFBFC9842FD8452BA5937555440E2E34"><enum>(1)</enum><text>the defendant is employed
				by, or is an agent of, an organization in the supply chain for the pre-retail
				medical product; or</text>
							</paragraph><paragraph display-inline="no-display-inline" id="HE28D13D756FE4CB7AB578D2E48ED2D12"><enum>(2)</enum><text>the violation—</text>
								<subparagraph id="HB452ED0826C9418DB8D363A1E7546280"><enum>(A)</enum><text>involves the use of
				violence, force, or a threat of violence or force;</text>
								</subparagraph><subparagraph id="H2114FBB97CF2466BB960DFEFC4DB53DF"><enum>(B)</enum><text>involves the use of a
				deadly weapon;</text>
								</subparagraph><subparagraph id="H5D059F7048164574B70C20C751BD952A"><enum>(C)</enum><text>results in serious bodily
				injury or death, including serious bodily injury or death resulting from the
				use of the medical product involved; or</text>
								</subparagraph><subparagraph id="H5CAD334258444CE7B34443D3519A4A69"><enum>(D)</enum><text>is subsequent to a prior
				conviction for an offense under this section.</text>
								</subparagraph></paragraph></subsection><subsection id="HF93B68D9D23A49398EF76D246DB09E5D"><enum>(c)</enum><header>Criminal
				penalties</header><text>Whoever violates subsection (a)—</text>
							<paragraph id="HA0B96364F8B642BF9F89A00DC9EC3F05"><enum>(1)</enum><text>if the offense is an
				aggravated offense under subsection (b)((2)(C), shall be fined under this title
				or imprisoned not more than 30 years, or both;</text>
							</paragraph><paragraph id="H7E614E33A9B44190B7203053308C1BCF"><enum>(2)</enum><text>if the value of the
				medical products involved in the offense is $5,000 or greater, shall be fined
				under this title, imprisoned for not more than 15 years, or both, but if the
				offense is an aggravated offense other than one under subsection (b)(2)(C), the
				maximum term of imprisonment is 20 years; and</text>
							</paragraph><paragraph id="HD3A364155F5E49D8852D100FFB599A5C"><enum>(3)</enum><text>in any other case, shall
				be fined under this title, imprisoned for not more than 3 years, or both, but
				if the offense is an aggravated offense other than one under subsection
				(b)(2)(C), the maximum term of imprisonment is 5 years.</text>
							</paragraph></subsection><subsection id="HF17960EC08224D1EAB2674428D7139C0"><enum>(d)</enum><header>Civil
				penalties</header><text display-inline="yes-display-inline">Whoever violates
				subsection (a) is subject to a civil penalty in an amount not more than the
				greater of—</text>
							<paragraph id="H65C4F72101CA404D8CA24FF4384613BC"><enum>(1)</enum><text>three times the economic
				loss attributable to the violation; or</text>
							</paragraph><paragraph id="H7466661A619F482199CCD9D92C0F9A26"><enum>(2)</enum><text>$1,000,000.</text>
							</paragraph></subsection><subsection id="H24DD9235396F4503B6802528406DC8EE"><enum>(e)</enum><header>Definitions</header><text>In
				this section—</text>
							<paragraph id="HAAF363F4462F40929F7817E77BE43C26"><enum>(1)</enum><text>the term <term>pre-retail
				medical product</term> means a medical product that has not yet been made
				available for retail purchase by a consumer;</text>
							</paragraph><paragraph id="H02E3E11CF5F344C0857502078F0355E4"><enum>(2)</enum><text>the term <quote>medical
				product</quote> means a drug, biological product, device, medical food, or
				infant formula;</text>
							</paragraph><paragraph id="H47DCABE89FFC43CB8D6BB3978532F662"><enum>(3)</enum><text>the terms
				<term>device</term>, <term>drug</term>, <term>infant formula</term>, and
				<term>labeling</term> have, respectively, the meanings given those terms in
				section 201 of the Federal Food, Drug, and Cosmetic Act;</text>
							</paragraph><paragraph id="HA108D06530814D2A850ACDF6632859FD"><enum>(4)</enum><text>the term <term>biological
				product</term> has the meaning given the term in section 351 of the Public
				Health Service Act;</text>
							</paragraph><paragraph id="HF7F2D71ADC084A9A8B3DCC69E13ABACB"><enum>(5)</enum><text>the term <term>medical
				food</term> has the meaning given the term in section 5(b) of the Orphan Drug
				Act; and</text>
							</paragraph><paragraph id="H3AA873ADEA5E42B59D6CCC38D468DE4A"><enum>(6)</enum><text>the term <quote>supply
				chain</quote> includes manufacturer, wholesaler, repacker, own-labeled
				distributor, private-label distributor, jobber, broker, drug trader,
				transportation company, hospital, pharmacy, or security
				company.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HF4BD4344E9DB4EAEA5249993F5164E2B"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of sections at the beginning of chapter 31 of
			 title 18, United States Code, is amended by adding after the item relating to
			 section 669 the following:</text>

			</subsection><subsection id="H4FF4FAD961084E779AE05C6EA650DA03"><enum>(b)</enum><header>Racketeering</header>
				<paragraph id="HA131F3764AED45179FAA785157A04100"><enum>(1)</enum><header>Travel Act
			 Violations</header><text>Section 1952 of title 18, United States Code, is
			 amended by adding that the end the following:</text>

			 Laundering</header><text>Section 1957(b)(1) of title 18, United States Code, is
			 amended by adding at the end the following: <quote>If the offense involves a
			 pre-retail medical product (as defined in section 670) the punishment for the
			 offense shall be the same as the punishment for an offense under section 670
			 unless the punishment under this subsection is greater.</quote></text>
				</paragraph></subsection><subsection id="HDAB878A0C0C241B9B57F7C2C6424EA7C"><enum>(c)</enum><header>Breaking or entering
			 carrier facilities</header><text display-inline="yes-display-inline">Section
			 2117 of title 18, United States Code, is amended by adding at the end of the
			 first undesignated paragraph the following: <quote>If the offense involves a
			 pre-retail medical product (as defined in section 670) the punishment for the
			 offense shall be the same as the punishment for an offense under section 670
			 unless the punishment under this section is greater.</quote>.</text>
			</subsection><subsection id="H22A1C407751F4629AE9A2270B5E5FC28"><enum>(d)</enum><header>Stolen
			 property</header>
				<paragraph id="HFD5BDAA3B8504A1D86791733F60E064A"><enum>(1)</enum><header>Transportation of
			 stolen goods and related offenses</header><text display-inline="yes-display-inline">Section 2314 of title 18, United States
			 Code, is amended by adding at the end of the sixth undesignated paragraph the
			 following: <quote>If the offense involves a pre-retail medical product (as
			 defined in section 670) the punishment for the offense shall be the same as the
			 punishment for an offense under section 670 unless the punishment under this
			 section is greater.</quote>.</text>
				</paragraph><paragraph id="H98A5A5598D994CDE90E726B2D0DABB0F"><enum>(2)</enum><header>Sale or receipt of

			 States Sentencing Commission</header>
			<subsection id="id0FDFFE2354C246548D30496191EF7D55"><enum>(a)</enum><header>In
			 general</header><text>Pursuant to its authority under section 994 of title 28,
			 United States Code, and in accordance with this section, the United States
			 Sentencing Commission shall review and, if appropriate, amend the Federal
			 sentencing guidelines and policy statements applicable to persons convicted of
			 offenses under section 670 of title 18, United States Code, as added by this
			 Act, section 2118 of title 18, United States Code, or any another section of
			 title 18, United States Code, amended by this Act, to reflect the intent of
			 Congress that penalties for such offenses be sufficient to deter and punish
			 such offenses, and appropriately account for the actual harm to the public from
			 these offenses.</text>
			</subsection><subsection id="id87218B4669AE4AA1A1654642ACCDE982"><enum>(b)</enum><header>Requirements</header><text>In
			 carrying out this section, the United States Sentencing Commission
			 shall—</text>
				<paragraph id="ID08859b57598c4844ac6d49d1002d5f4d"><enum>(1)</enum><text>consider the extent to
			 which the Federal sentencing guidelines and policy statements appropriately
			 reflect—</text>
					<subparagraph id="IDbdced6da8ed54437a5fc9f209a36aac3"><enum>(A)</enum><text>the serious nature of
			 such offenses;</text>
					</subparagraph><subparagraph id="ID1dafd46bb57d42489b1e1872af03b427"><enum>(B)</enum><text>the incidence of such
			 offenses; and</text>
					</subparagraph><subparagraph id="ID903f229e0cf340ceab455016c4149c5a"><enum>(C)</enum><text>the need for an effective
			 deterrent and appropriate punishment to prevent such offenses;</text>
					</subparagraph></paragraph><paragraph id="IDb8e433ea307f496b8ac22e6817f13b55"><enum>(2)</enum><text>consider establishing a
			 minimum offense level under the Federal sentencing guidelines and policy
			 statements for offenses covered by this Act;</text>
				</paragraph><paragraph id="IDd3f71f5de3c8479482a2baefaaa6a696"><enum>(3)</enum><text>account for any
			 additional aggravating or mitigating circumstances that might justify
			 exceptions to the generally applicable sentencing ranges;</text>
				</paragraph><paragraph id="ID134c10eeea134f3c9eca607459a4186f"><enum>(4)</enum><text>ensure reasonable
			 consistency with other relevant directives, Federal sentencing guidelines and
			 policy statements;</text>
				</paragraph><paragraph id="ID957917690bfb40f983fa33b1895d1223"><enum>(5)</enum><text>make any necessary
			 conforming changes to the Federal sentencing guidelines and policy statements;
			 and</text>
				</paragraph><paragraph id="ID2cefa5100f8b470c9b912b73ea1590b0"><enum>(6)</enum><text>ensure that the Federal
			 sentencing guidelines and policy statements adequately meet the purposes of
			 sentencing set forth in section 3553(a)(2) of title 18, United States
			 Code.</text>
