		<official-title>To authorize the Attorney General to award grants for
		  States to implement minimum and enhanced DNA collection
		  processes.</official-title>

		<section commented="no" display-inline="no-display-inline" id="HD2DDB261850E436B94955B230DB14F03" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Katie Sepich Enhanced DNA Collection
			 Act of 2011</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="H5C5F0255995A419891EB44037B5D3F6B" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">For purposes of this Act:</text>
			<paragraph commented="no" display-inline="no-display-inline" id="H545EAF2EC471417EB36937CD3311987A"><enum>(1)</enum><header display-inline="yes-display-inline">Minimum dna collection
			 process</header><text display-inline="yes-display-inline">The term
			 <term>minimum DNA collection process</term> means, with respect to a State, a
			 process under which the Combined DNA Index System (CODIS) of the Federal Bureau
			 of Investigation is searched at least 1 time against samples from the following
			 individuals who are at least 18 years of age:</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="H5DB3F356C961425CA7845B8E788EB24F"><enum>(A)</enum><text display-inline="yes-display-inline">Individuals who are arrested for or charged
			 with a criminal offense under State law that consists of murder or voluntary
			 manslaughter.</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H33949022A87640C5BC5D3D626E68E926"><enum>(B)</enum><text display-inline="yes-display-inline">Individuals who are arrested for or charged
			 with a criminal offense under State law that has an element involving a sexual
			 act or sexual contact with another and that is punishable by imprisonment for
			 more than 5 years.</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5D1CD96842D945C59A1B8EEEA5B6BEC8"><enum>(C)</enum><text display-inline="yes-display-inline">Individuals who are arrested for or charged
			 with a criminal offense under State law that has an element of kidnapping or
			 abduction and that is punishable by imprisonment for more than 5 years.</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H27A39D86E0554284BB980F68B90E8D18"><enum>(2)</enum><header display-inline="yes-display-inline">Enhanced dna collection
			 process</header><text display-inline="yes-display-inline">The term
			 <term>enhanced DNA collection process</term> means, with respect to a State, a
			 process under which the State provides for the collection, for purposes of
			 inclusion in the Combined DNA Index System (CODIS) of the Federal Bureau of
			 Investigation, of DNA samples from the following individuals who are at least
			 18 years of age:</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="HAC4608A6D52148D6A0F00AA8161F8CF2"><enum>(A)</enum><text display-inline="yes-display-inline">Individuals who are arrested for or charged
			 with a criminal offense under State law that consists of murder or voluntary
			 manslaughter.</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7A43569180C6487DA5D987353C73675C"><enum>(B)</enum><text display-inline="yes-display-inline">Individuals who are arrested for or charged
			 with a criminal offense under State law that has an element involving a sexual
			 act or sexual contact with another and that is punishable by imprisonment for
			 more than 1 year.</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H63E3F617D1774858A6FE6E6ADF8BD36E"><enum>(C)</enum><text display-inline="yes-display-inline">Individuals who are arrested for or charged
			 with a criminal offense under State law that has an element of kidnapping or
			 abduction and that is punishable by imprisonment for more than 1 year.</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9B30B0F7987C403E91CBC07DE638E2C8"><enum>(D)</enum><text display-inline="yes-display-inline">Individuals who are arrested for or charged
			 with a criminal offense under State law that consists of burglary punishable by
			 imprisonment for more than 1 year.</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF5B5AC17F9C5416E90610E65B46581CE"><enum>(E)</enum><text display-inline="yes-display-inline">Individuals who are arrested for or charged
			 with a criminal offense under State law that consists of aggravated assault
			 punishable by imprisonment for more than 1 year.</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1F6868EDAD5C4EB0A5D56F5A0E3D9013"><enum>(3)</enum><header display-inline="yes-display-inline">State</header><text display-inline="yes-display-inline">The term <term>State</term> means any State
			 of the United States, the District of Columbia, the Commonwealth of Puerto
			 Rico, the Virgin Islands, American Samoa, Guam, and the Commonwealth of the
			 Northern Mariana Islands.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="H80C9C3B4D3BB4A5599A5A86E6C5CAE32" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Incentive payments for States to implement
			 minimum and enhanced DNA collection processes</header>
			<subsection commented="no" display-inline="no-display-inline" id="H9E49E1E6C3F74132ACA6E8A3565D7DB8"><enum>(a)</enum><header display-inline="yes-display-inline">Grants authorized</header><text display-inline="yes-display-inline">The Attorney General shall carry out a
			 grant program under which the Attorney General may make grants to States for
			 the purpose of assisting States with the costs associated with the
			 implementation of minimum or enhanced DNA collection processes.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H308E355A97F645B08B890690332A2E73"><enum>(b)</enum><header display-inline="yes-display-inline">Applications</header>
				<paragraph commented="no" display-inline="no-display-inline" id="H3D5AFE49CD7C4E53B046CBCE4AA2846C"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">To be eligible to receive a grant under
			 this section, in addition to any other requirements specified by the Attorney
			 General, a State shall submit to the Attorney General an application that
			 demonstrates that it has instituted policies, protocols, or regulations
			 requiring the implementation of either a minimum or enhanced DNA collection
			 process.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6F69EC20ECA3464780A8BF06B36E7D7A"><enum>(2)</enum><header display-inline="yes-display-inline">Other requirements</header><text display-inline="yes-display-inline">The Attorney General may require a State
			 desiring a grant under this section to document, for review by the Attorney
			 General, the first-year expenses associated with a State’s implementation or
			 planned implementation of a minimum or enhanced DNA collection process.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H53F65FC5E26643DE92C3B39E6004A25C"><enum>(c)</enum><header display-inline="yes-display-inline">Grant allocation</header><text display-inline="yes-display-inline">The amount available to a State under this
			 section shall be equivalent to the first-year costs to that State of
			 implementing a minimum or enhanced DNA collection process. The Attorney General
			 retains discretion to determine the amount of each such grant awarded to an
			 eligible State.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="HE3E7005F8C154BAF826506E9FE5C3DD0" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Bonus payments for States which have
			 implemented an enhanced dna collection process</header><text display-inline="no-display-inline">In the case of a State that has implemented
			 an enhanced DNA collection process and uses such process for a fiscal year, the
			 State shall be eligible to receive a bonus payment equivalent to the amount
			 available to such State under section 3.</text>
		</section><section commented="no" display-inline="no-display-inline" id="H3431554546D242DA8E8B949F6C9C15E3" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Conditions of receiving incentive and bonus
			 payments</header><text display-inline="no-display-inline">As a condition of
			 receiving an incentive grant or bonus payment under sections 3 or 4, a State
			 shall have a procedure in place to—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="HF43E8B5C6D3D4413BB4CD46DFBBD95BB"><enum>(1)</enum><text display-inline="yes-display-inline">provide written notification of expungement
			 provisions and instructions for requesting ex­punge­ment to all persons who
			 submit a DNA sample for inclusion in the index;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF2BF2AA980D94028A25F7AEC4A940268"><enum>(2)</enum><text display-inline="yes-display-inline">provide the eligibility criteria for
			 ex­punge­ment and instructions for requesting ex­punge­ment on an appropriate
			 public Web site; and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2814DBE89AFA4F318CF293768B56E3EF"><enum>(3)</enum><text display-inline="yes-display-inline">make a determination on all expungement
			 requests not later than 90 days after receipt and provide a written response of
			 the determination to the requesting party.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="H598661500CF841AD8FEF37CB2D5E87BA" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Expungement of profiles</header><text display-inline="no-display-inline">The expungement requirements under section
			 210304(d) of the DNA Identification Act of 1994 (42 U.S.C. 14132(d)) shall
			 apply to any samples collected pursuant to this Act for purposes of inclusion
			 in the Combined DNA Index System (CODIS) of the Federal Bureau of
			 Investigation.</text>
		</section><section commented="no" display-inline="no-display-inline" id="H31B6DA92503D4CA38BFC2FECD1B9C580" section-type="subsequent-section"><enum>7.</enum><header display-inline="yes-display-inline">Reports</header><text display-inline="no-display-inline">The Attorney General shall submit to the
			 Committee of the Judiciary of the House of Representatives and the Committee of
			 the Judiciary of the Senate an annual report (which shall be made publicly
			 available) that—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="H9A111E803BF5443A85CC18E575037652"><enum>(1)</enum><text display-inline="yes-display-inline">lists the States, for the year
			 involved—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="H5B10D72BC5664AFCB0F325E808E75F55"><enum>(A)</enum><text display-inline="yes-display-inline">which have (and those States which have
			 not) implemented a minimum DNA collection process and use such process;
			 and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H0180317092084EED9830A6148C9977FE"><enum>(B)</enum><text display-inline="yes-display-inline">which have (and those States which have
			 not) implemented an enhanced DNA collection process and use such process;
			 and</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H54BE72F389394C108D227F58FE27BE5F"><enum>(2)</enum><text display-inline="yes-display-inline">includes statistics, with respect to the
			 year involved, regarding the benefits to law enforcement resulting from the
			 implementation of minimum and enhanced DNA collection processes, including the
			 number of matches made due to the inclusion of arrestee profiles under such a
			 process.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="HFD7E4E9292874DC59D62F3E9E2AD19D0" section-type="subsequent-section"><enum>8.</enum><header display-inline="yes-display-inline">Authorization of
			 appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated such sums as may be necessary to carry out this
			 Act for each of the fiscal years 2012 through 2016.</text>
