		<official-title>To amend section 5542 of title 5, United States Code, to
		  provide that any hours worked by Federal firefighters under a qualified
		  trade-of-time arrangement shall be excluded for purposes of determinations
		  relating to overtime pay.</official-title>

		<section id="H437475ACC41C4AE3A959A6C52F68D8E1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Federal Firefighter Flexibility and
			 Fairness Act</short-title></quote>.</text>
		</section><section id="H829F58EA6BD14F329336A7ED927AE93E" section-type="subsequent-section"><enum>2.</enum><header>Treatment of hours
			 worked under a qualified trade-of-time arrangement</header><text display-inline="no-display-inline">Section
			 5542 of title 5, United States Code, is amended by adding at the end the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="H972E2BD160B8478F8E4D3BC54CE12F8B" style="USC">
				<subsection id="HC1D09AD6B3EF4C98A27EDC3A1814C845"><enum>(g)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H28F8F3FE316B406CAB202BBD9E5BA168"><enum>(1)</enum><text>Notwithstanding any
				other provision of this section, any hours worked by a firefighter under a
				qualified trade-of-time arrangement shall be disregarded for purposes of any
				determination relating to eligibility for, or the amount of, any overtime pay
				under this section.</text>
					</paragraph><paragraph id="H7B31CD2948A54D8CAE6D29BE981BB1F9" indent="up1"><enum>(2)</enum><text>For purposes of this section—</text>
						<subparagraph id="H9F460B8655804B1FAB212FB8D91478BB"><enum>(A)</enum><text>the term <term>qualified trade-of-time
				arrangement</term> means an arrangement under which 2 firefighters who are
				employed by the same agency agree, solely at their option and with the approval
				of their employing agency, to substitute for one another during scheduled work
				hours in the performance of work in the same capacity; and</text>
						</subparagraph><subparagraph id="HF96321783FFA4039946929CA57A7D7A1"><enum>(B)</enum><text>the term <term>firefighter</term> has
				the meaning given such term by sections 8331(21) and 8401(14),
				respectively.</text>
						</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
