		<official-title>To ensure that American materials are used for
		  Smithsonian construction activities and are sold in Smithsonian gift shops, and
		  for other purposes.</official-title>

		<section id="H101932F9754E47F5B55D7755644042E0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Buy American at the Smithsonian Act of
			 2011</short-title></quote>.</text>
		</section><section commented="no" id="HFF77616F3A0A4C8B9A8FB046BCD94D56"><enum>2.</enum><header>Ensuring American
			 materials are used for Smithsonian construction activities and are sold in
			 Smithsonian gift shops</header>
			<subsection id="HB76ABB208E1345FF96FFEB885AE864FA"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Notwithstanding any
			 other provision of law, the Secretary of the Smithsonian Institution may not
			 use any funds made available under Federal law to construct a facility of the
			 Smithsonian Institution or to construct an alteration of such a facility unless
			 the Secretary certifies that, except as provided under subsection (b)—</text>
				<paragraph commented="no" id="H8C0A194090F543E5BEF9BCEEFECCF8CE"><enum>(1)</enum><text display-inline="yes-display-inline">all materials used for construction
			 activities relating to any facility of the Smithsonian Institution are produced
			 in the United States; and</text>
				</paragraph><paragraph commented="no" id="HE14FB55DE79D4AAD8D10C50138E8BDFB"><enum>(2)</enum><text display-inline="yes-display-inline">all materials for sale in any gift shop of
			 the Smithsonian Institution are produced in the United States.</text>
				</paragraph></subsection><subsection id="H31F35D832FC64A7D84AF819A79D8848C"><enum>(b)</enum><header>Exemptions</header><text display-inline="yes-display-inline">The Secretary of the Smithsonian
			 Institution may exempt a material used for construction activities relating to
			 a facility of the Smithsonian Institution from inclusion in a certification
			 under subsection (a) if the Secretary finds that—</text>
				<paragraph id="H89FC951C9BF9450EB14BF8C83E782269"><enum>(1)</enum><text display-inline="yes-display-inline">including the material would be
			 inconsistent with the public interest;</text>
				</paragraph><paragraph id="H5377B25D833E4C3782DF7A5F63577900"><enum>(2)</enum><text display-inline="yes-display-inline">the material, as produced in the United
			 States, is not produced in a sufficient and reasonably available amount or is
			 not of a satisfactory quality; or</text>
				</paragraph><paragraph id="H8C2536FE78AF4140822078E595ED4B20"><enum>(3)</enum><text display-inline="yes-display-inline">use of the material produced in the United
			 States will increase costs by more than 25 percent.</text>
				</paragraph></subsection><subsection id="HA4F63246D33E46B78A8E4CA093FB3D6F"><enum>(c)</enum><header>Publication and
			 notice of exemptions</header><text display-inline="yes-display-inline">If the
			 Secretary of the Smithsonian Institution determines that it is necessary to
			 exempt a material from inclusion in a certification under subsection (a) based
			 on a finding under subsection (b), the Secretary shall, before the date on
			 which such finding takes effect—</text>
				<paragraph id="H73D8C46FC99F4203A753BF8B3B090CE6"><enum>(1)</enum><text display-inline="yes-display-inline">publish in the Federal Register a detailed
			 written justification as to why the exemption is needed; and</text>
				</paragraph><paragraph id="H9C2F9F02C7024315B94C83895B8747E7"><enum>(2)</enum><text display-inline="yes-display-inline">provide notice of such finding and an
			 opportunity for public comment on such finding for a reasonable period of time
			 not to exceed 15 days.</text>
				</paragraph></subsection></section></legis-body>
