		<official-title>To amend the National Labor Relations Act to ensure the
		  right of employees to a secret ballot election conducted by the National Labor
		  Relations Board.</official-title>

		<section display-inline="no-display-inline" id="H612938D7CD3B4D538E28E72187F912B6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Secret Ballot Protection
			 Act</short-title></quote>.</text>
		</section><section id="HF1691E7A89024FE09DA50F2719D74A08"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
			<paragraph id="H40D829629626432D849C392FE20A0E43"><enum>(1)</enum><text display-inline="yes-display-inline">the importance of a secret ballot election
			 has been recognized by the United States for over 100 years;</text>
			</paragraph><paragraph id="H4754382745AF45ECACE2D94499D95BF1"><enum>(2)</enum><text>the fundamental
			 democratic right to choose by secret ballot is the only method that ensures a
			 choice free of coercion, intimidation, irregularity, or illegality;</text>
			</paragraph><paragraph id="HA93657B203EF4096BE9E925972ECED5D"><enum>(3)</enum><text>the recognition of
			 a labor organization by way of a private agreement, rather than a secret ballot
			 election supervised by a neutral third party, threatens an employee’s right,
			 codified in the National Labor Relations Act, to choose whether or not to be
			 represented by a labor organization; and</text>
			</paragraph><paragraph id="HACAA0EBDEE1A4484ABC7799B0BC06D32"><enum>(4)</enum><text>preserving
			 workers’ right to choose whether or not to be represented by a labor
			 organization through a secret ballot election is important to the strength of
			 the national economy.</text>
			</paragraph></section><section id="HF385CD62BD9F439DB95C06D382D26B7A"><enum>3.</enum><header>National Labor
			 Relations Act</header>
			<subsection id="H980407E061F2438F8ECFAF997F172680"><enum>(a)</enum><header>Recognition of
			 representative</header>
				<paragraph id="H3AE1AA2E8D0C47DFA6F08B29146BFCD7"><enum>(1)</enum><header>In
			 general</header><text>Section 8(a)(2) of the National Labor Relations Act (29
			 U.S.C. 158(a)(2)) is amended by inserting before the colon the following:
			 <quote>or to recognize or bargain collectively with a labor organization that
			 has not been selected by a majority of employees in a unit appropriate for such
			 purposes in a secret ballot election conducted by the National Labor Relations
			 Board in accordance with section 9</quote>.</text>
				</paragraph><paragraph id="HB2266C7CDEC146D5977553016C0C756B"><enum>(2)</enum><header>Application</header><text>The
			 amendment made by paragraph (1) shall not apply to collective bargaining
			 relationships that were recognized before the date of enactment of this
			 Act.</text>
				</paragraph></subsection><subsection id="H4FD84A5814C14EE18D3B2AF627E04684"><enum>(b)</enum><header>Election
			 required</header>
				<paragraph id="H5194850776C2410CB47655DEDE49C25B"><enum>(1)</enum><header>In
			 general</header><text>Section 8(b) of the National Labor Relations Act (29
			 U.S.C. 158(b)), as amended by subsection (c) of this section, is
			 amended—</text>
					<subparagraph id="H359016F3254B4ECFB8D0184AA698B893"><enum>(A)</enum><text>by striking
			 <quote>and</quote> at the end of paragraph (6);</text>
					</subparagraph><subparagraph id="H111D19503F35463ABA600C7C3C7B2050"><enum>(B)</enum><text>by striking the
			 period at the end of paragraph (7) and inserting <quote>; and</quote>;
			 and</text>
					</subparagraph><subparagraph id="HB0747FBE7A5342C6B0D323FBB1FA85DB"><enum>(C)</enum><text>by adding at the
			 end the following:</text>

							<paragraph id="H5D11587AD0C249C286E34C4D8035BF37"><enum>(8)</enum><text display-inline="yes-display-inline">to cause or attempt to cause an employer to
				recognize or bargain collectively with a representative of a labor organization
				that has not been selected by a majority of employees in a unit appropriate for
				such purposes in a secret ballot election conducted by the National Labor
				Relations Board in accordance with section
				9.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="HDFC6575D19D340DD817FDF2F3EAC9037"><enum>(2)</enum><header>Application</header><text display-inline="yes-display-inline">The amendment made by paragraph (1) shall
			 not apply to collective bargaining relationships that were recognized before
			 the date of enactment of this Act.</text>
				</paragraph></subsection><subsection id="H01476F25D7AF49B0A85A0F5041398E0A"><enum>(c)</enum><header>Secret ballot
			 election required</header><text>Section 9(a) of the National Labor Relations
			 Act (29 U.S.C. 159(a)), is amended—</text>
				<paragraph id="HFCA4382C9CB54946BEA98521D1C78D35"><enum>(1)</enum><text>by inserting
			 <quote>(1)</quote> after <quote>(a)</quote>;</text>
				</paragraph><paragraph id="H95063FFA551947EA98E05F30B63EE79F"><enum>(2)</enum><text>by inserting after
			 <quote>designated or selected</quote> the following: <quote>by a secret ballot
			 election conducted by the National Labor Relations Board in accordance with
			 this section</quote>; and</text>
				</paragraph><paragraph id="HF68B54A4D8334A92BA77CC12EF9C392F"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block id="HE5D4BDE972154AA1B7AEA0273DACE49B">
						<paragraph id="H8B4A65459D5845C3B7385F35D2377ED1"><enum>(2)</enum><text display-inline="yes-display-inline">The secret ballot election requirement of
				paragraph (1) shall not apply to collective bargaining relationships that were
				recognized before the date of enactment of the Secret Ballot Protection
				Act.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HEFF79DB1E2DB4097961C3A2EEBBBBDE4"><enum>(d)</enum><header>Conforming
			 amendments</header><text>Section 9(c)(1) of such Act (29 U.S.C. 159(c)(1)) is
			 amended—</text>
				<paragraph id="HEA7D1FF9D03C4DC29616B1726FB4D60F"><enum>(1)</enum><text>in subparagraph
			 (A)—</text>
					<subparagraph id="HC89DE34A36484439A09C20CFEDD86DDC"><enum>(A)</enum><text>in clause (i), by
			 striking <quote>and that their employer declines to recognize their
			 representative as the representative defined in section 9(a)</quote> and
			 inserting <quote>by a representative</quote>; and</text>
					</subparagraph><subparagraph id="HA7348C5163824B558DCE41CD6714AEED"><enum>(B)</enum><text>in clause (ii), by
			 striking <quote>section 9(a);</quote> and inserting <quote>subsection
			 (a),</quote>; and</text>
					</subparagraph></paragraph><paragraph id="HD3A0FBDDAAE54DF9A5F3AA798CC32313"><enum>(2)</enum><text>in subparagraph
			 (B), by striking <quote>alleging</quote> and all that follows through
			 <quote>defined in section 9(a)</quote>.</text>
				</paragraph></subsection></section><section id="H0729E75B90E84C81824AC31CEA5A0CC9"><enum>4.</enum><header>Regulations</header><text display-inline="no-display-inline">Not later than 6 months after the date of
			 the enactment of this Act the National Labor Relations Board shall review and
			 revise all regulations promulgated before such date to implement the amendments
			 made in this Act to the National Labor Relations Act.</text>
