		<section id="HA08A076698C44C3E84AE9CBA4977069E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Bed Bug Management, Prevention, and
			 Research Act</short-title></quote>.</text>
		</section><section id="H52DFFF2741FC4162A45898BF05E1A238"><enum>2.</enum><header>Establishment of
			 research program to control and eradicate bed bugs</header>
			<subsection id="HAC2FA6BB50684D7FA8BBEFAC8E1D7E81"><enum>(a)</enum><header>Bed bug research
			 program</header><text display-inline="yes-display-inline">Section 1672 of the
			 Food, Agriculture, Conservation, and Trade Act of 1990 (7 U.S.C. 5925) is
			 amended—</text>
				<paragraph id="H40A15BCCA76B45BD9EC90369D311F8B7"><enum>(1)</enum><text>by redesignating
			 subsection (j) as subsection (k); and</text>
				</paragraph><paragraph id="H47E5AE2996264DA2A56FEA0F1443B339"><enum>(2)</enum><text>by inserting after
			 subsection (h) the following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="HDB2E20F0414646B3BFD8DECE2CBCCF86" style="OLC">
						<subsection id="H7801118FE43F45F4BF268848AA8CC418"><enum>(j)</enum><header>Bed bug
				control</header>
							<paragraph id="HE90CB4D6BD7B48DC8A000862F6DA3E49"><enum>(1)</enum><header>Authorization
				and use of grants</header><text>The Secretary, in consultation with the task
				force appointed under paragraph (2), shall award grants under this subsection
				for only for the following purposes:</text>
								<subparagraph id="HE1B1E3C0095143E5863DF5BA25AD6B5F"><enum>(A)</enum><text>Developing more
				efficacious chemicals and chemical methods of detecting, preventing, and
				managing bed bugs.</text>
								</subparagraph><subparagraph id="H28ACF0DDB21444149AD0262CF12F7984"><enum>(B)</enum><text display-inline="yes-display-inline">Identifying or discovering affordable and
				effective methods of managing bed bugs, including basic and applied biology and
				demonstration research projects.</text>
								</subparagraph></paragraph><paragraph id="H89DE4939BB31442C9DA4FB38612F0964"><enum>(2)</enum><header>Task
				force</header>
								<subparagraph id="H89AE58964DA64301A03DFE6B5F918129"><enum>(A)</enum><header>Establishment</header><text>Pursuant
				to subsection (b)(2)(C), the Secretary shall, not later than 90 days after the
				date of the enactment of the <short-title>Bed Bug
				Management, Prevention, and Research Act</short-title>, appoint a bed bug task
				force (referred to in this subsection as the <term>task force</term>) to assist
				the Secretary in awarding grants under this section.</text>
								</subparagraph><subparagraph id="H64564549267F431D9A38CF22D77C0634"><enum>(B)</enum><header>Composition</header><text>The
				task force shall be composed of members or representatives of the
				following:</text>
									<clause id="H2BE78B43F8B54721A247DCA2E7F86E9A"><enum>(i)</enum><text display-inline="yes-display-inline">The pest management industry.</text>
									</clause><clause id="H7F43B04956CE4F08BD2ADAA710A73208"><enum>(ii)</enum><text>The hospitality
				industry (including hotels, motels, and other forms of lodging or
				accommodation).</text>
									</clause><clause id="HF9FFE2DB84724069AAFBA977702FFB37"><enum>(iii)</enum><text>The multi-family
				housing management industry.</text>
									</clause><clause id="H4A388D6FDE994753A5501B346BD02F5E"><enum>(iv)</enum><text>Public health
				organizations.</text>
									</clause><clause id="H0457051988D340698B3FFE46B85D920F"><enum>(v)</enum><text>Any other group or
				industry the Secretary determines is significantly impacted by bed bugs.</text>
									</clause></subparagraph></paragraph><paragraph id="H2B32BC57D50745C8B2EA2A676831F914"><enum>(3)</enum><header>Initial
				grants</header>
								<subparagraph id="H1AF8A3B8DA974D96B8C2B1C4AC4778D8"><enum>(A)</enum><header>Requests for
				proposals</header><text display-inline="yes-display-inline">The Secretary
				shall, not later than 180 days after the date of the enactment of the
				<short-title>Bed Bug Management, Prevention, and Research
				Act</short-title> and in consultation with the task force, publish a request
				for grant proposals for research projects for the purposes described in
				paragraph (1).</text>
								</subparagraph><subparagraph id="H44634CEBC0B34FAD96D8156252D454C8"><enum>(B)</enum><header>Award of
				grants</header><text display-inline="yes-display-inline">Not later than 180
				days after the date of such publication, the Secretary shall—</text>
									<clause id="HBD3312EEB8DB4D04804294AEA5234772"><enum>(i)</enum><text>evaluate such proposals in consultation with the task force; and</text>
									</clause><clause id="HF4ADDF14F40A4FBC87DA38FFB7FA8739"><enum>(ii)</enum><text>award grants to
				entities that submitted grant proposals for research projects the Secretary
				determines are meritorious for the purposes described in paragraph (1).</text>
									</clause></subparagraph><subparagraph id="H453872EC1BF040508AF851D87424549B"><enum>(C)</enum><header>Notification
				requirement</header><text display-inline="yes-display-inline">The Secretary
				shall notify the task force of any award made under subparagraph (B) not later
				than 30 days after awarding such grant.</text>
								</subparagraph></paragraph><paragraph id="H93BFE9CA557744F681C582308B73B554"><enum>(4)</enum><header>Subsequent
				grants</header>
								<subparagraph id="H615EB1BB68E2459AA28508D008206613"><enum>(A)</enum><header>Evaluation of
				initial grants</header><text display-inline="yes-display-inline">The Secretary
				shall, in consultation with the task force, evaluate each research project
				conducted under any grant awarded under paragraph (3)(B).</text>
								</subparagraph><subparagraph id="H381B0B11DC414D2996056EFDA9B5C810"><enum>(B)</enum><header>Award of
				grants</header><text display-inline="yes-display-inline">The Secretary shall,
				in consultation with the task force, award grants to fund additional research
				projects that the Secretary determines to be promising or necessary based on
				the evaluation conducted under subparagraph (A).</text>
								</subparagraph><subparagraph id="H5F2C5359DFEB4A179DB00FACA0923841"><enum>(C)</enum><header>Notification
				requirement</header><text display-inline="yes-display-inline">The Secretary
				shall notify the task force of any award made under subparagraph (B) not later
				than 30 days after awarding such grant.</text>
								</subparagraph></paragraph><paragraph id="H6584E3DF763545968F5BD8CA3701A8D7"><enum>(5)</enum><header>Consultation and
				coordination</header><text>To expedite the approval or registration under
				section 3, section 18, or section 24 of the Federal Insecticide, Fungicide and
				Rodenticide Act (7 U.S.C. 136a, 136p, and 136v) of the methods identified or
				discovered through research projects funded under this section, the Secretary
				shall consult and coordinate with the Administrator of the Environmental
				Protection Agency regarding—</text>
								<subparagraph id="HF0CE9D9AC6254887AAA02B35EA1C1103"><enum>(A)</enum><text>the awarding of
				grants under this section; and</text>
								</subparagraph><subparagraph id="HDE20D0AFE74D4052B0E3F6DC045992C3"><enum>(B)</enum><text>the evaluation of
				the results of such research
				projects.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HD0731971057E445082D82C95E37580B1"><enum>(b)</enum><header>Waiver of
			 matching funds requirement</header><text>Subsection (c)(2) of such section is
			 amended—</text>
				<paragraph id="HE8719BE3509D416E94CF0191CFA602CC"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>or</quote> at the end of
			 subparagraph (A);</text>
				</paragraph><paragraph id="HBAC5CDB194764839A6780694F4210E17"><enum>(2)</enum><text>by striking the
			 period at the end of subparagraph (B) and inserting <quote>; or</quote>;
			 and</text>
				</paragraph><paragraph id="HEE42C8391E3D498598D4601C410A5A44"><enum>(3)</enum><text>by adding at the
			 end the following new subparagraph:</text>
					<quoted-block display-inline="no-display-inline" id="H3A3547E8212B4D178753D89F8E367C2E" style="OLC">
						<subparagraph id="H353028DDDF6D4D198C77910D486EDE0C"><enum>(C)</enum><text display-inline="yes-display-inline">the project involves a pest that has been
				designated as a pest of public health significance by the Environmental
				Protection Agency and the Centers for Disease Control and Prevention, as
				described in section 2(nn) of the Federal Insecticide, Fungicide, and
				Rodenticide Act (7 U.S.C.
				136(nn)).</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HD5258B0F6C184DF380B9D4AB33ED8D7F"><enum>(c)</enum><header>Conforming
			 amendments</header><text>Such section is further amended—</text>
				<paragraph id="H827BEFD573034A1A8905325631997997"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), by striking
			 <quote>through (i)</quote> and inserting <quote>through (j)</quote>; and</text>
				</paragraph><paragraph id="H736B9C0FC177445E93E2EA9EF0285EF8"><enum>(2)</enum><text>in subsection
			 (b)(2), by striking <quote>through (i)</quote> and inserting <quote>through
			 (j)</quote>.</text>
				</paragraph></subsection></section><section id="HD7EB1E19DA3543C1B2E61548CB6B51E2"><enum>3.</enum><header>Amendments to
			 Federal Insecticide, Fungicide, and Rodenticide Act to improve efforts to
			 control and eradicate bed bugs</header>
			<subsection id="HE11014BB54BD48A398FDBC751D614FEE"><enum>(a)</enum><header>Inclusion of bed
			 bugs in definition of vector organisms</header><text display-inline="yes-display-inline">Section 2(oo) of the Federal Insecticide,
			 Fungicide, and Rodenticide Act (7 U.S.C. 136(oo)) is amended by inserting
			 <quote>bed bugs,</quote> after <quote>cockroaches,</quote>.</text>
			</subsection><subsection id="H41AD4CB6F93644B2BEA068F58B5BFBBA"><enum>(b)</enum><header>Definition of
			 adverse effects</header><text display-inline="yes-display-inline">Section 2(bb)
			 of the Federal Insecticide, Fungicide, and Rodenticide Act (7 U.S.C. 136(bb))
			 is amended by adding before the period at the end of the last sentence the
			 following: <quote>, such as whether there are insufficient efficacious
			 alternative registered pesticides available for the use, whether the lack of
			 sufficient efficacious alternative registered pesticides will reasonably lead
			 to the misuse of other pesticides or other inappropriate pest management
			 strategies that pose risks to the environment or human health, and whether the
			 registration or approval of use of the public health pesticide will play a
			 significant part in managing pest resistance</quote>.</text>
			</subsection><subsection id="H3A1DF47F99F544EA9085453429A5F8EE"><enum>(c)</enum><header>Efficacy data
			 for exempted pesticides</header><text display-inline="yes-display-inline">Section 25(b) of the Federal Insecticide,
			 Fungicide, and Rodenticide Act (7 U.S.C. 136w(b)) is amended by adding at the
			 end the following new sentences: <quote>Notwithstanding the exemption of a
			 pesticide under this subsection, the Administrator shall require the submission
			 of efficacy data (and evaluate such data) if the pesticide is labeled for or
			 proposed to be labeled for the control of a pest of public health significance.
			 The Administrator shall not permit the sale or distribution of any product that
			 is marketed, distributed, or sold with a claim that such product will control a
			 public health pest if the efficacy data submitted under this subsection does
			 not support such claim.</quote>.</text>
			</subsection><subsection id="H7C536F0667044DD38DCDF85A76C9BADF"><enum>(d)</enum><header>Bed Bug
			 Prevention and Mitigation Pilot Program</header><text display-inline="yes-display-inline">The Federal Insecticide, Fungicide, and
			 Rodenticide Act is amended by inserting after section 20 (7 U.S.C. 136r) the
			 following new section:</text>
				<quoted-block display-inline="no-display-inline" id="H8ABA5CAC7C77498A9F4FD7DD620E0707" style="OLC">
					<section id="H1786D47D6FFC4FE5A5FEEDCF3733B1A9"><enum>20A.</enum><header>Bed Bug
				Prevention and Mitigation Pilot Program</header>
						<subsection id="H678D39162F224C55ADBF568E4FE13D4B"><enum>(a)</enum><header>Grant
				authority</header><text display-inline="yes-display-inline">Using funds
				appropriated to carry out this Act, the Administrator shall award grants to
				three State agencies whose plans have been approved by the Administrator in
				accordance with the requirements of section 11 for the purposes of conducting a
				pilot program under which political subdivisions of the State and housing
				authorities in the State use the grant funds to supplement on-going bed bug
				prevention and mitigation activities. At least one of the three grants shall be
				awarded to one such State agency that, before November 1, 2009, submitted a
				public health exemption request under section 18, which proposed a use of a
				pesticide to control bed bugs, but which was voluntarily canceled under section
				6(f).</text>
						</subsection><subsection id="H72FF4384437E4502819A332670551CDD"><enum>(b)</enum><header>Distribution of
				Funds</header><text display-inline="yes-display-inline">As a condition on the
				receipt of the grant under subsection (a), the recipient State agency, working
				in conjunction with the State department of health, shall agree to distribute
				the grant funds to political subdivisions and housing authorities—</text>
							<paragraph id="H31F624D953D0487582FA06C88F426472"><enum>(1)</enum><text>addressing
				persistent bed bug infestations; and</text>
							</paragraph><paragraph id="H2732131833B14028A91F819F7766E5F1"><enum>(2)</enum><text>whose residents
				lack the financial resources to adequately mitigate bed bug infestations
				without assistance.</text>
							</paragraph></subsection><subsection id="HA2ECBCE866C941FEA5F566E1E4898DBD"><enum>(c)</enum><header>Time for award
				and distribution</header><text display-inline="yes-display-inline">The grants
				under subsection (a) for a fiscal year shall be awarded within 180 days after
				the appropriation of funds for that fiscal year to carry out this Act.
				Recipient State agencies shall begin disseminating grants within 120 days
				receiving the grant funds.</text>
						</subsection><subsection id="HF0FC5E9185C74C90B87067DBF7ADB15A"><enum>(d)</enum><header>Use of
				Funds</header><text>Grant funds may be used—</text>
							<paragraph id="HA71F3DE9DB3044FB86DDC431C36A4998"><enum>(1)</enum><text>to retain
				commercial applicators to perform bed bug prevention and mitigation activities
				that are proven to effectively control bed bugs;</text>
							</paragraph><paragraph id="H052821CED935449996708A21087703D7"><enum>(2)</enum><text>to purchase and
				distribute mattress covers;</text>
							</paragraph><paragraph id="H34A274A612244173B95EA2868E5D7736"><enum>(3)</enum><text>to conduct bed bug
				monitoring activities; and</text>
							</paragraph><paragraph id="HAFF860C73E6C43EEB2041B0737282881"><enum>(4)</enum><text>to treat used
				mattresses and furniture using methods proven to control all life stages of bed
				bugs.</text>
							</paragraph></subsection><subsection id="H9598D723328744248C8EA911779F8C4E"><enum>(e)</enum><header>Data
				Collection</header><text>After the end of fiscal year 2016, the Administrator
				shall collect from the recipient State agencies the following data:</text>
							<paragraph id="HD3DD425DAB544FDCB95E41A5A3757590"><enum>(1)</enum><text>The number of
				political subdivisions and housing authorities receiving grant funds and total
				funds awarded to each political subdivision and housing authority.</text>
							</paragraph><paragraph id="HF017076A77C94E5B9637FC89359EF4CA"><enum>(2)</enum><text>The criteria used
				to award funds to such political subdivisions and housing authorities.</text>
							</paragraph><paragraph id="HF93430FEFBC24606A8E0E7345E01395B"><enum>(3)</enum><text>The success
				achieved in reducing bed bug infestation and the methods used to manage bed bug
				infestation.</text>
							</paragraph><paragraph id="H3103BF5D687E4B1F94D733F2944777D1"><enum>(4)</enum><text>Documented results
				of intervention efforts with some measurement of infestation rates both before
				and after intervention.</text>
							</paragraph></subsection><subsection id="H4F5FDA8F41614477B8BC6C527E3068C7"><enum>(f)</enum><header>Report to
				Congress</header><text>Not later than January 1, 2017, the Administrator shall
				submit to Congress a report setting forth the data collected under subsection
				(e).</text>
						</subsection><subsection id="HC1DD1EC065444D7CB0966E8550770B62"><enum>(g)</enum><header>Expiration of
				grant authority</header><text>No grants may be made under subsection (a) after
				September 30,
				2017.</text>
