<official-title display="yes">To amend Rule 11 of the Federal Rules of Civil Procedure to improve attorney accountability, and for other purposes.<pagebreak/></official-title>

<section id="H7E102311591D4799AC27BF3E0C24D4FE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Lawsuit Abuse Reduction Act of 2011</short-title></quote>.</text> </section>
<section id="H52B68F42B2FF4FD7B9FD8607C78BE5CF"><enum>2.</enum><header>Attorney accountability</header> 
<subsection id="HBB5EB809B60F465595D6E7E2F19557D4"><enum>(a)</enum><header>Sanctions under Rule 11</header><text display-inline="yes-display-inline">Rule 11(c) of the Federal Rules of Civil Procedure is amended—</text> 
<paragraph id="H996DE65C218E44ECA8E323061065A12A"><enum>(1)</enum><text>in paragraph (1), by striking <quote>may</quote> and inserting <quote>shall</quote>;</text> </paragraph>
<paragraph id="H01AD1E6AF87043CCA277F698B51ABFB7"><enum>(2)</enum><text>in paragraph (2), by striking <quote>Rule 5</quote> and all that follows through <quote>motion.</quote> and inserting <quote>Rule 5.</quote>; and</text> </paragraph>
<paragraph id="H043F1803D2624660AD32EC38A97C7822"><enum>(3)</enum><text>in paragraph (4), by striking <quote>situated</quote> and all that follows through the end of the paragraph and inserting <quote>situated, and to compensate the parties that were injured by such conduct. Subject to the limitations in paragraph (5), the sanction shall consist of an order to pay to the party or parties the amount of the reasonable expenses incurred as a direct result of the violation, including reasonable attorneys’ fees and costs. The court may also impose additional appropriate sanctions, such as striking the pleadings, dismissing the suit, or other directives of a nonmonetary nature, or, if warranted for effective deterrence, an order directing payment of a penalty into the court</quote> .</text> </paragraph></subsection>
<subsection id="HCC3C5F987BFD4632847B32FDD630751E"><enum>(b)</enum><header>Rule of Construction</header><text display-inline="yes-display-inline">Nothing in this Act shall be construed to bar or impede the assertion or development of new claims, defenses, or remedies under Federal, State, or local laws, including civil rights laws.</text> </subsection></section>
