		<official-title>To amend the Federal Water Pollution Control Act to
		  clarify the authority of the Administrator of the Environmental Protection
		  Agency to disapprove specifications of disposal sites for the discharge of
		  dredged or fill material, and to clarify the procedure under which a higher
		  review of specifications may be requested.</official-title>

		<section id="HE588D4191E4B4D15BEA89AE2D8C4CDB1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Mining Jobs Protection
			 Act</short-title></quote>.</text>
		</section><section id="HF2D274F03259480A9C6CC8D554FE96F8"><enum>2.</enum><header>Permits for
			 dredged or fill material</header><text display-inline="no-display-inline">Section 404 of the Federal Water Pollution
			 Control Act (33 U.S.C. 1344) is amended by striking subsection (c) and
			 inserting the following:</text>
			<quoted-block display-inline="no-display-inline" id="HE3CF1CEAEA1D4CFC979E1EA38D4F01A0" style="OLC">
				<subsection id="H2B9EF04FE8DF4CA6AEB25EBA9DA7A612"><enum>(c)</enum><header>Authority of
				Administrator To disapprove specifications</header>
					<paragraph id="HB7E838696B65443C9B198F7719B19C11"><enum>(1)</enum><header>In
				general</header><text>The Administrator, in accordance with this subsection,
				may prohibit the specification of any defined area as a disposal site, and may
				deny or restrict the use of any defined area for specification as a disposal
				site, in any case in which the Administrator determines, after notice and
				opportunity for public hearings and consultation with the Secretary, that the
				discharge of those materials into the area will have an unacceptable adverse
				effect on—</text>
						<subparagraph id="H64708874865047FFB1E97AF89D0C8886"><enum>(A)</enum><text>municipal water
				supplies;</text>
						</subparagraph><subparagraph id="H45C70CBB0DF74F1A99C87FAC01192657"><enum>(B)</enum><text>shellfish beds and
				fishery areas (including spawning and breeding areas);</text>
						</subparagraph><subparagraph id="H951F20B1AA9C4892B2A7D42D526E7BD9"><enum>(C)</enum><text>wildlife;
				or</text>
						</subparagraph><subparagraph id="H43BF8919C5E64CDBA31EB99E5A235E90"><enum>(D)</enum><text>recreational
				areas.</text>
						</subparagraph></paragraph><paragraph id="HC24360A021104CF88A5F103BA570AD97"><enum>(2)</enum><header>Deadline for
				action</header>
						<subparagraph id="HFDFAD206A5214396B8D6A97E3E1EA8D5"><enum>(A)</enum><header>In
				general</header><text>The Administrator shall—</text>
							<clause id="H928977A701004EB080EE292A68D3E565"><enum>(i)</enum><text>not later than 30
				days after the date on which the Administrator receives from the Secretary for
				review a specification proposed to be issued under subsection (a), provide
				notice to the Secretary of, and publish in the Federal Register, a description
				of any potential concerns of the Administrator with respect to the
				specification, including a list of measures required to fully address those
				concerns; and</text>
							</clause><clause id="H33DB83EF773549FFB91745CAF2CA6900"><enum>(ii)</enum><text>if the
				Administrator intends to disapprove a specification, not later than 60 days
				after the date on which the Administrator receives a proposed specification
				under subsection (a) from the Secretary, provide to the Secretary and the
				applicant, and publish in the Federal Register, a statement of disapproval of
				the specification pursuant to this subsection, including the reasons for the
				disapproval.</text>
							</clause></subparagraph><subparagraph id="H4327C7C850744396B27487553F43AF2B"><enum>(B)</enum><header>Failure to
				act</header><text>If the Administrator fails to take any action or meet any
				deadline described in subparagraph (A) with respect to a proposed
				specification, the Administrator shall have no further authority under this
				subsection to disapprove or prohibit issuance of the specification.</text>
						</subparagraph></paragraph><paragraph id="HA06E21D4BE774E0E95DB0C97A06BBDF1"><enum>(3)</enum><header>No retroactive
				disapproval</header>
						<subparagraph id="HEF0755AAD6104861A8C1D5AA7A6434A8"><enum>(A)</enum><header>In
				general</header><text>The authority of the Administrator to disapprove or
				prohibit issuance of a specification under this subsection—</text>
							<clause id="HF3504282C96C470B857A1022620A7379"><enum>(i)</enum><text>terminates as of
				the date that is 60 days after the date on which the Administrator receives the
				proposed specification from the Secretary for review; and</text>
							</clause><clause id="H740DD9354503400FAB5F0C4CC65A884F"><enum>(ii)</enum><text>shall not be used
				with respect to any specification after issuance of the specification by the
				Secretary under subsection (a).</text>
							</clause></subparagraph><subparagraph id="HEFF6F0F36DA84E82A852A4AD0FD7BA77"><enum>(B)</enum><header>Specifications
				disapproved before date of enactment</header><text>In any case in which, before
				the date of enactment of this subparagraph, the Administrator disapproved a
				specification under this subsection (as in effect on the day before the date of
				enactment of the <short-title>Mining Jobs Protection
				Act</short-title>) after the specification was issued by the Secretary pursuant
				to subsection (a)—</text>
							<clause id="H0D96467DC9734201A1A2030FC2EC079A"><enum>(i)</enum><text>the Secretary
				may—</text>
								<subclause id="H1416D10796AB4B37ABDE708AF7EE0763"><enum>(I)</enum><text>reevaluate and
				reissue the specification after making appropriate modifications; or</text>
								</subclause><subclause id="H6A55C4CEDEDC431CAA4ADD6BE43F5E38"><enum>(II)</enum><text>elect not to
				reissue the specification; and</text>
								</subclause></clause><clause id="HC859FF7C2EA4489A821E4B50CDC2270D"><enum>(ii)</enum><text>the Administrator
				shall have no further authority to disapprove the modified specification or any
				reissuance of the specification.</text>
							</clause></subparagraph><subparagraph id="HBD66CC68577E42BE8021CCD37F2FB3D2"><enum>(C)</enum><header>Finality</header><text>An
				election by the Secretary under subparagraph (B)(i) shall constitute final
				agency action.</text>
						</subparagraph></paragraph><paragraph id="H1524FA6DE97442FDAF00500DDDEF1643"><enum>(4)</enum><header>Applicability</header><text>Except
				as provided in paragraph (3), this subsection applies to each specification
				proposed to be issued under subsection (a) that is pending as of, or requested
				or filed on or after, the date of enactment of the
				<short-title>Mining Jobs Protection
				Act</short-title>.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H4603C54E4D7D4FB1920752B1AE2D5A94"><enum>3.</enum><header>Review of
			 permits</header><text display-inline="no-display-inline">Section 404(q) of the
			 Federal Water Pollution Control Act (33 U.S.C. 1344(q)) is amended—</text>
			<paragraph id="H8BE11839CE2549268CE9EB130D3FFED3"><enum>(1)</enum><text>in the first
			 sentence, by striking <quote>(q) Not later than</quote> and inserting the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="HDDFB4D5A1523497A8B75BC9DAB58CE8F" style="OLC">
					<subsection id="HD30CC20BD6B546D88F698E31C76ED76B"><enum>(q)</enum><header>Agreements;
				higher review of permits</header>
						<paragraph id="HA6077E98DE864189AA16371740E9383E"><enum>(1)</enum><header>Agreements</header>
							<subparagraph id="H1853DEF1F18744388BF836FCA597A82D"><enum>(A)</enum><header>In
				general</header><text>Not later than</text>
							</subparagraph></paragraph></subsection><after-quoted-block>;
				</after-quoted-block></quoted-block>
			</paragraph><paragraph id="HC28CF0623F814041859F0794E72FA167"><enum>(2)</enum><text>in the second
			 sentence, by striking <quote>Such agreements</quote> and inserting the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="H5B02E6F0A96942ABACCE7F6581B411B8" style="OLC">
					<subparagraph id="H86EA38861664474783D36F52EF6D07D9"><enum>(B)</enum><header>Deadline</header><text>Agreements
				described in subparagraph (A)</text>
					</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H35CA009BD3E345D79AF686548F5B8278"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HDC32F82C584B4CD99029B0FE8E503774" style="OLC">
					<paragraph id="HEF2FF1770BC24FE196FF0FDF185267DA"><enum>(2)</enum><header>Higher review of
				permits</header>
						<subparagraph id="H95B86E952F114E30ACC20B79BD75C1DE"><enum>(A)</enum><header>In
				general</header><text>Subject to subparagraph (C), before the Administrator or
				the head of another Federal agency requests that a permit proposed to be issued
				under this section receive a higher level of review by the Secretary, the
				Administrator or other head shall—</text>
							<clause id="HF9F2D01A16DD43F5B2E5C5A7CEB0F25C"><enum>(i)</enum><text>consult with the
				head of the State agency having jurisdiction over aquatic resources in each
				State in which activities under the requested permit would be carried out;
				and</text>
							</clause><clause id="HA06A47FD8D1A4E60A3324B662C78E12E"><enum>(ii)</enum><text>obtain official
				consent from the State agency (or, in the case of multiple States in which
				activities under the requested permit would be carried out, from each State
				agency) to designate areas covered or affected by the proposed permit as
				aquatic resources of national importance.</text>
							</clause></subparagraph><subparagraph id="H80369B81249049F29168E1BECC681028"><enum>(B)</enum><header>Failure to
				obtain consent</header><text>If the Administrator or the head of another
				Federal agency does not obtain State consent described in subparagraph (A) with
				respect to a permit proposed to be issued under this section, the Administrator
				or Federal agency may not proceed in seeking higher review of the
				permit.</text>
						</subparagraph><subparagraph id="H8AFEBDD50A4C4629BFC27E4A842DCCE9"><enum>(C)</enum><header>Limitation on
				elevations</header><text>The Administrator or the head of another Federal
				agency may request that a permit proposed to be issued under this section
				receive a higher level of review by the Secretary not more than once per
				permit.</text>
						</subparagraph><subparagraph id="HC78BB2FC984C4A878F968E800D30CCB6"><enum>(D)</enum><header>Effective
				date</header><text>This paragraph applies to permits for which applications are
				submitted under this section on or after January 1,
				2010.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
