<section id="H35EC778F99FB4639823E814594DACCAE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Criminal Alien Removal Act of 2011</short-title></quote>.</text></section> 
<section id="H7A1D79A7A07743AABA50985E36D43383" section-type="subsequent-section"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="H705CE6548CD44D2FA709105EB21613BE"><enum>(1)</enum><header>Criminal Alien</header><text>Except as otherwise provided, the term <term>criminal alien</term> means an alien who—</text> 
<subparagraph id="HFCB3901C4EBF466DB9908AB36C75D6DF"><enum>(A)</enum><text>is inadmissible by reason of having committed any offense covered in section 212(a)(2) of the Immigration and Nationality Act (8 U.S.C. 182(a)(2));</text></subparagraph> 
<subparagraph id="H5025BB33DD4F45B68A835836EBE966F6"><enum>(B)</enum><text>is deportable by reason of having committed any offense covered in subparagraph (A)(ii), (A)(iii), (B), (C), or (D) of section 237(a)(2) of such Act (8 U.S.C. 1227(a)(2));</text></subparagraph> 
<subparagraph id="H7DFC823E526F4D7995CA17A60CFB77B1"><enum>(C)</enum><text>is deportable under section 237(a)(2)(A)(i) of such Act (8 U.S.C. 1227(a)(2)(A)(i)) on the basis of an offense for which the alien has been sentenced to a term of imprisonment of at least 1 year; or</text></subparagraph> 
<subparagraph id="HF9EFDE4C895A4EBCB9C0EF54EA649EC1"><enum>(D)</enum><text>is inadmissible under section 212(a)(3)(B) (8 U.S.C. 1182(a)(3)(B)) or deportable under section 237(a)(4)(B) (8 U.S.C. 1227(a)(4)(B)).</text></subparagraph></paragraph> 
<paragraph id="H5880F58356C245CAA8E422BA9C168B8E"><enum>(2)</enum><header>Criminal Alien Program</header><text>The term <term>Criminal Alien Program</term> means the Criminal Alien Program required by section 3.</text></paragraph> 
<paragraph id="H38730381F30544BBAD3D95C2E3329B16"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Homeland Security.</text></paragraph></section> 
<section id="H69CD929B2AAD4AE7A19B4866CBA26EF9"><enum>3.</enum><header>Criminal Alien Program</header> 
<subsection id="H380F6E1C0F3648BDBAEB86C1753BEA0B"><enum>(a)</enum><header>Requirement for Criminal Alien Program</header><text>The Secretary shall carry out a program known as the <quote>Criminal Alien Program</quote> for the purposes described in subsection (b).</text></subsection> 
<subsection id="HC266ED8157B74FF69F31FF597FC600A1"><enum>(b)</enum><header>Purposes</header><text>The purposes of the Criminal Alien Program are to—</text> 
<paragraph id="HB4F98E804F2D4E458032F7A670BC8730"><enum>(1)</enum><text>identify criminal aliens who are incarcerated in a Federal, State, or local correctional facility;</text></paragraph> 
<paragraph id="H3E2928BCBCC141C9943B30039F570148"><enum>(2)</enum><text>ensure that such aliens are not released into the community upon the alien's release from such incarceration, without regard to whether the alien is released on parole, supervised release, or probation, and without regard to whether the alien may be arrested or imprisoned again for the same offense; and</text></paragraph> 
<paragraph id="H8266ED771EE5483EA5E0FE04373F83E8"><enum>(3)</enum><text>remove such aliens from the United States upon such release.</text></paragraph></subsection> 
<subsection id="H0D270D6C2A014BC3B3DC3D4F03442D08"><enum>(c)</enum><header>Technology Usage</header><text>To carry out the Criminal Alien Program in remote locations, the Secretary shall, to the maximum extent practicable—</text> 
<paragraph id="H93D86CB81E1C4608827CB56DD3D23C0D"><enum>(1)</enum><text>employ technology, such as vid­eo­con­fer­enc­ing in such locations;</text></paragraph> 
<paragraph id="H78D4242592E54BA58164B0055D4A90B1"><enum>(2)</enum><text>utilize mobile access to Federal databases of aliens, such as the Automated Biometric Fingerprint Identification System (IDENT); and</text></paragraph> 
<paragraph id="H59FB26650489426EA2186A4CE9F6EB5C"><enum>(3)</enum><text>utilize electronic Livescan fingerprinting technology in order to make such resources available to State and local law enforcement agencies in such locations.</text></paragraph></subsection> 
<subsection id="H0D4A1C70C1AB460C806D193937A1A41A"><enum>(d)</enum><header>Participation by States</header> 
<paragraph id="H085C2B8D861E4900A972B5CCA94499C1"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of law, a State shall not be eligible to receive funds pursuant to a program described in paragraph (2) unless the appropriate officials of such State—</text> 
<subparagraph id="H869579B0810A4A95A3DE505645E21CC7"><enum>(A)</enum><text>cooperate with the Secretary to carry out the Criminal Alien Program;</text></subparagraph> 
<subparagraph id="HAF69A91893F6416B8A4F4BC6A71BEA8B"><enum>(B)</enum><text>expeditiously and systematically identify criminal aliens who are incarcerated in a prison or jail located in such State; and</text></subparagraph> 
<subparagraph id="H7F13FC17A3764F36AFE795E806A41A0C"><enum>(C)</enum><text>promptly convey the information collected under subparagraph (B) to the Secretary to carry out the Criminal Alien Program.</text></subparagraph></paragraph> 
<paragraph id="H6CFD769A37274DF8A2F5F38520A90187"><enum>(2)</enum><header>Programs</header><text>The programs described in this section are any law enforcement grant program carried out by personnel of any element of the Department of Justice, including the program described in section 241(i) of the Immigration and Nationality Act (8 U.S.C. 1231(i)).</text></paragraph> 
<paragraph id="H2E8DA9608750440DAAC3DD1D0AD5D523"><enum>(3)</enum><header>Other authorities</header><text>To assist States in participating in the Criminal Alien Program, appropriate officials of a State—</text> 
<subparagraph id="H461A5DD7D6AC4230B04BDDB2B777DD8C"><enum>(A)</enum><text>are authorized to hold an illegal alien for a period of up to 14 days after the date such alien completes a term of incarceration within the State in order to effectuate the transfer of such alien to Federal custody if the alien is removable or not lawfully present in the United States; and</text></subparagraph> 
<subparagraph id="HDED48FE732114D28B8580678BA1549C9"><enum>(B)</enum><text>are authorized to issue a detainer that would allow an alien who completes a term of incarceration within the State to be detained by the State prison until personnel from U.S. Immigration and Customs Enforcement is able to take the alien into custody.</text></subparagraph></paragraph></subsection> 
<subsection id="H7F081D2137EC47CCBDB1DCD88781BE98"><enum>(e)</enum><header>Evaluation of Incarcerated Alien Populations</header><text>The Secretary, acting in conjunction with the Attorney General and the appropriate officials of the States, as appropriate, shall carry out the Criminal Alien Program as follows:</text> 
<paragraph id="HC40B6AC6F1D64A908124DF3A86F2B570"><enum>(1)</enum><text>Not later than December 31, 2012, identify each criminal alien who—</text> 
<subparagraph id="HA8C10965481748EBAE96837F10951AFE"><enum>(A)</enum><text>is incarcerated in a Federal correctional facility; and</text></subparagraph> 
<subparagraph id="H800A998DF04B4D5AB13C5E6857410DAC"><enum>(B)</enum><text>will be deportable or removable upon release from such incarceration.</text></subparagraph></paragraph> 
<paragraph id="HC6E6435A26CB472F8FED15DCA5DA6B10"><enum>(2)</enum><text>Not later than December 31, 2014, identify each criminal alien who—</text> 
<subparagraph id="HAC1E60C3980644188483DF66D8BE7067"><enum>(A)</enum><text>is incarcerated in State or local correctional facility;</text></subparagraph> 
<subparagraph id="H9542BF2825444973AFF08E2FF90F45D3"><enum>(B)</enum><text>is serving a term of 3 or more years; and</text></subparagraph> 
<subparagraph id="HCCB29F08C3A94A628162687C6378ACBF"><enum>(C)</enum><text>will be deportable or removable upon release from such incarceration.</text></subparagraph></paragraph></subsection></section> 
<section id="H3120E66418C3495E8EDA90402A8494B0"><enum>4.</enum><header>Redesignation</header><text display-inline="no-display-inline">Section 642 of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (8 U.S.C. 1373) is—</text> 
<paragraph id="H083D1F31DDB84EBE9EC12D8F7B9B291C"><enum>(1)</enum><text>redesignated as section 296 of the Immigration and Nationality Act; and</text></paragraph> 
<paragraph id="H295C2CB0867344EC8726B568A87BBFE9"><enum>(2)</enum><text>inserted into such Act after section 295 of such Act.</text></paragraph></section> 
<section id="H2FBCBF7F38384EA4930AE9A6BB019672"><enum>5.</enum><header>Annual Reports to Congress</header><text display-inline="no-display-inline">The Secretary shall submit to Congress an annual report on the implementation of the Criminal Alien Program and the other provisions of this Act, including the Secretary's progress in meeting the deadlines set out in section 3(e).</text></section>
