			 consideration of such provisions as fall within the jurisdiction of the

		<official-title>To amend part B of title XVIII of the Social Security Act
		  to exclude customary prompt pay discounts from manufacturers to wholesalers
		  from the average sales price for drugs and biologicals under
		  Medicare.</official-title>

		<section id="H373FD916D89F44B9865B9866320F0EF9" section-type="section-one"><enum>1.</enum><header>Excluding customary prompt
			 pay discounts from manufacturers to wholesalers from the average sales price
			 for Medicare payments for drugs and biologicals</header>
			<subsection id="HE29A04537A18419ABF346BE38185C514"><enum>(a)</enum><header>In
			 general</header><text>Section 1847A(c)(3) of the Social Security Act (42 U.S.C.
			 1395w–3a(c)(3)) is amended—</text>
				<paragraph id="HE202038997014124809A859F03B3D449"><enum>(1)</enum><text>in the first
			 sentence, by inserting <quote>(other than customary prompt pay discounts
			 extended to wholesalers)</quote> after <quote>prompt pay discounts</quote>;
			 and</text>
				</paragraph><paragraph id="H866D70BB302E4D69805BCCFC0F14AF2E"><enum>(2)</enum><text>in the second
			 sentence, by inserting <quote>(other than customary prompt pay discounts
			 extended to wholesalers)</quote> after <quote>other price
			 concessions</quote>.</text>
				</paragraph></subsection><subsection id="HB2BAFE05CB484CD88B25BE0AD3A24851"><enum>(b)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to drugs and
			 biologicals that are furnished on or after January 1, 2012.</text>
