		  Elementary and Secondary Education Act of 1965 and the Individuals with

		<section display-inline="no-display-inline" id="H52544E4D88FA4B629AC72C7428A53A28" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Keep Our Promise to America’s Children and Teachers
			 Act</short-title></quote> or the <quote><short-title>Keep Our PACT
			 Act</short-title></quote>.</text>
		</section><section id="H92DD8ABC1E024D0B9F1AB6159D88490B"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds as follows:</text>
			<paragraph id="H84247A7B6BA64B3991591A5070BAD558"><enum>(1)</enum><text>Children are our
			 Nation’s future and greatest treasure.</text>
			</paragraph><paragraph id="H1674D062D3944D69966BF03C5BFDCF65"><enum>(2)</enum><text>A
			 high-quality education is the surest way for every child to reach his or her
			 full potential.</text>
			</paragraph><paragraph id="H71B98F7DBF244E7F8B38394851C11A20"><enum>(3)</enum><text>The No Child Left
			 Behind Act of 2001 represents the most sweeping revision of education policy in
			 a generation.</text>
			</paragraph><paragraph id="H5B0EC0D5B139457FAAD09DFD1E42E9F4"><enum>(4)</enum><text>The Individuals
			 with Disabilities Education Act guarantees all children with disabilities a
			 first-rate education.</text>
			</paragraph><paragraph id="H03CE96EF689A4B789832A0FF5A39F10E"><enum>(6)</enum><text>The Individuals
			 with Disabilities Education Improvement Act committed the Congress to providing
			 40 percent of the national current average per-pupil expenditure for special
			 education students.</text>
			</paragraph><paragraph id="H1E3234D7A5144913B843E7919C489950"><enum>(7)</enum><text>A
			 promise made must be a promise kept.</text>
			</paragraph></section><section id="H44AECF5A32FC4BFF8A2216EA12BF5411"><enum>3.</enum><header>Full funding of
			 part A of title I of ESEA</header>
			<subsection id="H889EADB4DED54C3482AF3DDD1D75F4B4"><enum>(a)</enum><header>Funding</header><text>There
			 are appropriated, out of any money in the Treasury not otherwise
			 appropriated—</text>
				<paragraph id="H866CEF213B6C4A6F9AE6777D65E43969"><enum>(1)</enum><text>for fiscal year
			 2011, an amount that equals the difference between—</text>
					<subparagraph id="H5C8E2112379E4AB09DC3B8B9EF9492D4"><enum>(A)</enum><text>the amount
			 appropriated for fiscal year 2011 for programs under part A of title I of the
			 Elementary and Secondary Education Act of 1965, as amended by the No Child Left
			 Behind Act of 2001; and</text>
					</subparagraph><subparagraph id="HE5AAEEF124B9490B917D71576A9EFA91"><enum>(B)</enum><text display-inline="yes-display-inline">$17,729,853,000 or the full amount
			 authorized to be appropriated for that fiscal year for those programs,
			 whichever is higher;</text>
					</subparagraph></paragraph><paragraph id="HF48C64376E334325A58235DABB36C28A"><enum>(2)</enum><text>for fiscal year
			 2012, an amount that equals the difference between—</text>
					<subparagraph id="HEBC7C34F554F4D9FA93713366D15C4F0"><enum>(A)</enum><text>the amount
			 appropriated for fiscal year 2012 for programs under part A of title I of the
			 Elementary and Secondary Education Act of 1965, as amended by the No Child Left
			 Behind Act of 2001; and</text>
					</subparagraph><subparagraph id="HDD3D9B00D1BA4CCD9C64F430E9329675"><enum>(B)</enum><text display-inline="yes-display-inline">$21,690,517,000 or the full amount
			 authorized to be appropriated for that fiscal year for those programs,
			 whichever is higher;</text>
					</subparagraph></paragraph><paragraph id="H03CC2AFAA4AC4495B94EDF99CE259ACB"><enum>(3)</enum><text>for fiscal year
			 2013, an amount that equals the difference between—</text>
					<subparagraph id="H7642531F6B8349A3A797746EC0B229A0"><enum>(A)</enum><text>the amount
			 appropriated for fiscal year 2013 for programs under part A of title I of the
			 Elementary and Secondary Education Act of 1965, as amended by the No Child Left
			 Behind Act of 2001; and</text>
					</subparagraph><subparagraph id="HFE48F7E8BB0E40B98BC5D365062BB525"><enum>(B)</enum><text display-inline="yes-display-inline">$26,535,953,000 or the full amount
			 authorized to be appropriated for that fiscal year for those programs,
			 whichever is higher;</text>
					</subparagraph></paragraph><paragraph id="H27C1C065EE07428D8A2436A7A35B2C4B"><enum>(4)</enum><text>for fiscal year
			 2014, an amount that equals the difference between—</text>
					<subparagraph id="H6593C508E88944A798C05ECA923F208C"><enum>(A)</enum><text>the amount
			 appropriated for fiscal year 2014 for programs under part A of title I of the
			 Elementary and Secondary Education Act of 1965, as amended by the No Child Left
			 Behind Act of 2001; and</text>
					</subparagraph><subparagraph id="HB9EEE4B728C146CDBB6E0900D4AF07B7"><enum>(B)</enum><text display-inline="yes-display-inline">$32,463,808,000 or the full amount
			 authorized to be appropriated for that fiscal year for those programs,
			 whichever is higher; and</text>
					</subparagraph></paragraph><paragraph id="H337CA36E00D74A15B2FAC52AB1E4981B"><enum>(5)</enum><text>for fiscal year
			 2015, an amount that equals the difference between—</text>
					<subparagraph id="HD23A67BDBF1245D7BEA28FD51FEAB5AE"><enum>(A)</enum><text>the amount
			 appropriated for fiscal year 2015 for programs under part A of title I of the
			 Elementary and Secondary Education Act of 1965, as amended by the No Child Left
			 Behind Act of 2001; and</text>
					</subparagraph><subparagraph id="HB3F2E14B017C41DEAB21206779287227"><enum>(B)</enum><text display-inline="yes-display-inline">$39,715,885,000 or the full amount
			 authorized to be appropriated for that fiscal year for those programs,
			 whichever is higher.</text>
					</subparagraph></paragraph></subsection><subsection id="H091172AF9FE14413B5A8F3210937BF8B"><enum>(b)</enum><header>Use of
			 Funds</header><text>Funds appropriated under subsection (a)—</text>
				<paragraph id="HB168D3CC482D461CB03B43A692412887"><enum>(1)</enum><text>shall be used to
			 carry out programs under part A of title I of the Elementary and Secondary
			 Education Act of 1965, as amended by the No Child Left Behind Act of 2001;
			 and</text>
				</paragraph><paragraph id="H967E7BE4B53942B8AD1681AFB55CF569"><enum>(2)</enum><text>shall be allocated
			 among such programs in the same ratio as funds otherwise appropriated to carry
			 out such programs.</text>
				</paragraph></subsection></section><section id="H892656FE47FE4AE5AEC0BE7533F482AE"><enum>4.</enum><header>Mandatory funding
			 of the Individuals With Disabilities Education Act</header>
			<subsection id="H6FDC03D1745247468BC4260925EEF136"><enum>(a)</enum><header>In
			 General</header><text>Section 611(i) of the Individuals with Disabilities
			 Education Act (20 U.S.C. 1411(i)) is amended to read as follows:</text>
				<quoted-block id="H61F85FF9D1BE484FAB74222BB140F2CB" style="OLC">
					<subsection id="H93A70673246649828CDF7ECE4E2B1957"><enum>(i)</enum><header>Mandatory
				Funding</header><text>For the purpose of carrying out this part, other than
				section 619, there are appropriated, out of any money in the Treasury not
				otherwise appropriated—</text>
						<paragraph id="HD74FD63E7B164C018461E102E6852567"><enum>(1)</enum><text>$13,993,372,000
				for fiscal year 2011;</text>
						</paragraph><paragraph id="H870D1E385BB548058EAAC42D8DAD56CD"><enum>(2)</enum><text>$17,019,632,000
				for fiscal year 2012;</text>
						</paragraph><paragraph id="HB12A95DFADD241ACA2A14DA1D8B67AA9"><enum>(3)</enum><text>$20,700,363,000
				for fiscal year 2013;</text>
						</paragraph><paragraph id="HC676A9A50F444DC99D91F73185F92253"><enum>(4)</enum><text>$25,177,103,000
				for fiscal year 2014;</text>
						</paragraph><paragraph id="H606E091748464F99B38BB592D26D15C7"><enum>(5)</enum><text>$30,622,000,000
				for fiscal year 2015; and</text>
						</paragraph><paragraph id="H7C883D950BA4401C80CEA29651FAD558"><enum>(6)</enum><text>for fiscal year
				2016 and each subsequent fiscal year—</text>
							<subparagraph id="H8DBAEDFA1A7646FCB699A22CE9B5A4A7"><enum>(A)</enum><text>the number of
				children with disabilities in the prior school year in the States, outlying
				areas, and freely associated States who received special education and related
				services—</text>
								<clause id="HACB8FEF44E794F6E8DBA18A35544C5C2"><enum>(i)</enum><text>aged 3 through 5
				if the States, outlying areas, and freely associated States are eligible for a
				grant under section 619; and</text>
								</clause><clause id="HFC76A2B9741D4F6C8419DCD3CE5A24FD"><enum>(ii)</enum><text>aged 6 through
				21; multiplied by</text>
								</clause></subparagraph><subparagraph id="HC1F7F526695945A4BDADB514856EA207"><enum>(B)</enum><text>40 percent of the
				average per-pupil expenditure in public elementary schools and secondary
				schools in the United States; adjusted by</text>
							</subparagraph><subparagraph id="HB0D9D3E31FF04BF8A2D6C0823A0F6ECF"><enum>(C)</enum><text display-inline="yes-display-inline">the rate of annual change in the sum of 85
				percent of such State’s, outlying areas, and freely associated State’s
				population described in subsection
				(d)(3)(A)(i)(II).</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HBBA822091A634BADAF40A4A72240CC89"><enum>(b)</enum><header>Effective
			 Date</header><text>The amendment made by subsection (a) shall take effect on
			 October 1, 2010.</text>
			</subsection></section><section id="H16B77D4B992D4BE4AC3E1057C437AB53"><enum>5.</enum><header>Offset</header><text display-inline="no-display-inline">The amounts appropriated by this Act and the
			 amendments made by this Act shall be expended consistent with pay-as-you-go
			 requirements.</text>
