		  from establishing health care provider standards of care in medical malpractice
		  or medical product liability cases, and for other purposes.</official-title>

		<section id="H009FC67073DE473A94E4494E85AA7D97" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Provider Shield Act of 2011</short-title></quote>.</text>
		</section><section id="H4637F0ECF58A40808F5B0495B71BF2B1"><enum>2.</enum><header>Construction
			 regarding health care provider standards of care</header>
			<subsection id="H51D8517A32644175BDD4708D196EF313"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The development,
			 recognition, or implementation of any guideline or other standard under any
			 health care reform provision shall not be construed to establish the standard
			 of care or duty of care owed by a health care provider to a patient in any
			 medical malpractice or medical product liability case.</text>
			</subsection><subsection id="H73C4ECDC2F2D4F339A976DB409503C5B"><enum>(b)</enum><header>Definitions</header><text>For
			 purposes of this Act:</text>
				<paragraph id="H1294942E78B749238A5C726CEB893EBA"><enum>(1)</enum><text display-inline="yes-display-inline">The term <quote>health care reform
			 provision</quote> means any provision of the Patient Protection and Affordable
			 Care Act (Public Law 111–148) and the amendments made by that Act, including
			 the following:</text>
					<subparagraph display-inline="no-display-inline" id="H1A11F37ED4E646B38F5F1DB6E2037047"><enum>(A)</enum><text>Section 2701
			 (relating to adult health quality measures).</text>
					</subparagraph><subparagraph id="HF527941F76974B14912436DC5F824D84"><enum>(B)</enum><text display-inline="yes-display-inline">Section 2702 (relating to payment
			 adjustment for health care-acquired conditions).</text>
					</subparagraph><subparagraph id="HBB33C34D89814ADFA7351B499B5E25A0"><enum>(C)</enum><text display-inline="yes-display-inline">Section 3001 (relating to hospital
			 value-based purchasing program).</text>
					</subparagraph><subparagraph id="H1D4DD97F3E9743A89A204EF69662B267"><enum>(D)</enum><text display-inline="yes-display-inline">Section 3002 (relating to improvements to
			 the physician quality reporting system).</text>
					</subparagraph><subparagraph id="H447A5A1609644B49B1F9C6456A9DF7C0"><enum>(E)</enum><text display-inline="yes-display-inline">Section 3003 (relating to improvements to
			 the physician feedback program).</text>
					</subparagraph><subparagraph id="H1CDAC92106BB47DB89CCAABEAF49403B"><enum>(F)</enum><text display-inline="yes-display-inline">Section 3007 (relating to value-based
			 payment modifier under the physician fee schedule).</text>
					</subparagraph><subparagraph id="H893249D2A5744D6CBB0F5DBD4FA99210"><enum>(G)</enum><text display-inline="yes-display-inline">Section 3008 (relating to payment
			 adjustment for conditions acquired in hospitals).</text>
					</subparagraph><subparagraph id="HE168D1D98F204734A8B609F366843A1B"><enum>(H)</enum><text display-inline="yes-display-inline">Section 3013 (relating to quality measure
			 development).</text>
					</subparagraph><subparagraph id="HDAC32735E5134DC4BE155D825BAC61D7"><enum>(I)</enum><text display-inline="yes-display-inline">Section 3014 (relating to quality
			 measurement).</text>
					</subparagraph><subparagraph id="H8060C5D7D5274F5687815CA10E26EFD5"><enum>(J)</enum><text display-inline="yes-display-inline">Section 3021 (relating to establishment of
			 Center for Medicare and Medicaid Innovation within CMS).</text>
					</subparagraph><subparagraph id="H49D6D1CF191344F7AC11085D050ADD06"><enum>(K)</enum><text display-inline="yes-display-inline">Section 3025 (relating to hospital
			 readmissions reduction program).</text>
					</subparagraph><subparagraph id="H50929A6457FD4914A5806814BCE49149"><enum>(L)</enum><text display-inline="yes-display-inline">Section 3501 (relating to health care
			 delivery system research; quality improvement technical assistance).</text>
					</subparagraph><subparagraph id="HE6DF5DFD0FB14F5B86FD70E483EF9928"><enum>(M)</enum><text display-inline="yes-display-inline">Section 4003 (relating to clinical and
			 community preventive services).</text>
					</subparagraph><subparagraph id="H9C40941D083240F996A04E572A69CBCB"><enum>(N)</enum><text display-inline="yes-display-inline">Section 4301 (relating to research on
			 optimizing the delivery of public health services).</text>
					</subparagraph></paragraph><paragraph id="HEEA3E13FAB48401BB413549B3EE61D57"><enum>(2)</enum><text display-inline="yes-display-inline">The term <quote>medical malpractice or
			 medical product liability case</quote> means a medical malpractice action or
			 claim (as defined in section 431(7) of the Health Care Quality Improvement Act
			 of 1986 (42 U.S.C. 11151(7))) and includes a liability action or claim relating
			 to a health care provider’s prescription or provision of a drug, device, or
			 biological product (as such terms are defined in section 201 of the Federal
			 Food, Drug, and Cosmetic Act or section 351 of the Public Health Service
			 Act).</text>
				</paragraph><paragraph id="HD3D5464F74DB4B3991076C9CAFE7564A"><enum>(3)</enum><text display-inline="yes-display-inline">The term <quote>State</quote> includes the
			 District of Columbia, Puerto Rico, and any other commonwealth, possession, or
			 territory of the United States.</text>
				</paragraph></subsection><subsection id="H5CDCBB31BFA84DC9A03DAFE3331AF53E"><enum>(c)</enum><header>Savings Clause
			 for State Medical Malpractice or Medical product Liability Laws</header><text display-inline="yes-display-inline">Nothing in this Act shall be construed to
			 modify or preempt any substantive or procedural state law governing medical
			 malpractice or medical product liability cases or to impair State authority
			 regarding legal standards or procedures used in medical malpractice or medical
			 product liability cases.</text>
			</subsection><subsection id="H01F8921E51724591ABCD2D1356FA50CE"><enum>(d)</enum><header>Conforming
			 Amendment</header><text>Section 3512 of the Patient Protection and Affordable
			 Care Act (Public Law 111–148) is repealed.</text>
