		<official-title>To amend title 18, United States Code, to provide
		  additional aggravating factors for the imposition of the death penalty based on
		  the status of the victim.</official-title>

		<section id="HE69EF9CBCE6448B99E019B5D0091C10F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Justice for Public Servants Act of
			 2011</short-title></quote>.</text>
		</section><section id="H06BC4948E8504A9FAE04F50E86582B8E"><enum>2.</enum><header>Aggravating
			 Factors for Death Penalty</header><text display-inline="no-display-inline">Section 3592(c) of title 18, United States
			 Code, is amended by inserting after paragraph (16) the following:</text>
			<quoted-block display-inline="no-display-inline" id="H0CCD5245C137403BB2263BB9FA3A318E" style="OLC">
				<paragraph id="HA2258403A33344AA821E8F4984CE9ADC"><enum>(17)</enum><header>Killing of
				Member of Congress</header><text display-inline="yes-display-inline">The
				defendant committed the offense against a Member of Congress (as defined in
				section 2106 of title 5) or an employee of Congress (as defined in section 2107
				of title 5)—</text>
					<subparagraph id="HC6A80C194C774E27A968DB08CF14C231"><enum>(A)</enum><text>while he or she is
				engaged in the performance of his or her official duties;</text>
					</subparagraph><subparagraph id="H1CF857F9AB354509B8CA2B8FCB860A3A"><enum>(B)</enum><text>because of the
				performance of his or her official duties; or</text>
					</subparagraph><subparagraph id="H36BC2535B85A47258B6064B4F805D80E"><enum>(C)</enum><text>because of his or
				her status as a public official or employee.</text>
					</subparagraph></paragraph><paragraph id="H4E516987938E4C8F89DAEC424F18E25F"><enum>(18)</enum><header>Killing of law
				enforcement officer</header>
					<subparagraph id="H1D6FA596F3BD4977A10ECFE396680240"><enum>(A)</enum><text>The defendant
				killed or attempted to kill, in the circumstance described in subparagraph (B),
				a person who is authorized by law—</text>
						<clause id="HE64E31C8AB9A4F70B8FE45C5D13A7BB2"><enum>(i)</enum><text>to
				engage in or supervise the prevention, detention, investigation, or
				prosecution, or the incarceration of any person for any criminal violation of
				law;</text>
						</clause><clause id="HCE0C0D2BC68D46EF96C2D0C8A88A80C8"><enum>(ii)</enum><text>to apprehend,
				arrest, or prosecute an individual for any criminal violation of law; or</text>
						</clause><clause id="H27DB45A535B24ACFA74702F6F9EAEA87"><enum>(iii)</enum><text>to be a
				firefighter or other first responder.</text>
						</clause></subparagraph><subparagraph id="H3987700C313D411A83CE346A67C7CBF1"><enum>(B)</enum><text>The circumstance
				referred to in subparagraph (A) is that the person was killed—</text>
						<clause id="HA563F167C9DB45379154AAE24538B6EF"><enum>(i)</enum><text display-inline="yes-display-inline">while he or she was engaged in the
				performance of his or her official duties;</text>
						</clause><clause id="H9B60B6477CAC4C1D80C31354FCBBF022"><enum>(ii)</enum><text>because of the
				performance of his or her official duties; or</text>
						</clause><clause id="H96C9D14435CF422789CEA0E6DD2AB7D8"><enum>(iii)</enum><text>because of his
				or her status as a public official or
				employee.</text>
						</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
